2001-08-22 MOUND CITY COUNCIL MINUTES SPECIAL MEETING OF AUGUST 22, 2001 The City Council of the City of Mound, Hennepin County, Minnesota, met in special session on Wednesday, August 22, 2001, at 5:30 p.m. in the council chambers at 5341 Maywood Road in said City. Councilmembers Present: Mayor Pat Meisel, Councilmembers Bob Brown, Mark Hanus, Kim Anderson and Peter Meyer. Others Present: City Attorney, John Dean; City Manager, Kandis Hanson; Acting City Clerk, Bonnie Ritter; George Hoff The meeting was called to order at 5:34 p.m. by Mayor Meisel. 1. CONSIDER~ IN CLOSED SESSION, A PROPOSED SETTLEMENT OFFER IN THE POLSTON, ET AL~ LAWSUIT Mayor Meisel announced that the Council would go into executive session to consider a proposed settlement offer in the Polston, et al, lawsuit. 2. ACT UPON THE PROPOSED ~ETTLEMENT OFFER IN OPEN SESSION City Attorney, John Dean, explained that the Council met in executive session with the League of Minnesota Cities' Legal Counsel, George Hoff, and reviewed a proposed settlement agreement that has been signed by the plaintiffs and by MetroPlains. The City is the only party left to sign this settlement agreement. MOTION by Brown, seconded by Hanus to adopt the following resolution. Ayes: Brown, Hanus, Meisel and Anderson. Nayes: Meyer. Motion carried. RESOLUTION NO. 01-68: RESOLUTION AUTHORIZING SETTLEMENT OF PENDING . LITIGATION (ROBERT POLSON ET AL, VS. CITY OF MOUND 3. APPROVE RESOLUTION ORDERING ENVIRONMENTAL ASSESSMENT WORKSHEET {EAW) MOTION by Hanus, seconded by Brown to adopt the following resolution. All voted in favor. Motion carried. RESOLUTION NO. 01-69: RESOLUTION AUTHORIZING PREPARATION OF EAW FOR METROPLAINS PROJECT 4. ADJOURNMENT MOTION by Hanus, seconded by Brown to adjourn the meeting at 6:24 p.m. All voted in ' favor.
