MINUTES - MOUND CITY COUNCIL - REGULAR MEETING
APRIL 29, 1986
The City Council of Mound, Hennepin County, Minnesota, met in
regular session on Tuesday, April 29, 1986, at 7:30 P.M. in the
Council Chambers at 5341Maywood Road in said City.
Those present were: Mayor Bob Polston, Councilmembers Phyllis
Jessen, Gary Paulsen, Russ Peterson and Steve Smith. Also
present were: City Manager Edward J. Shukle, Jr., City Attorney
Curt Pearson, City Engineer John Cameron, City Clerk Fran Clark,
Building Inspector Jan Bertrand, Finance Director John Norman and
the following interested citizens: Larry Connolly, Cheryl Grand,
Steve Coddon, Steve Kakos, Buzz Sycks, and Vern Nichols.
The Mayor opened the meeting and welcomed the people in
attendance.
iThe Minutes from the April 15, 1986, Regular Meeting were
presented for consideration.
MOTION made by Paulsen, seconded by Smith to approve the
Minutes of the April 15, 1986, Regular Meeting as presented.
The vote was unanimously in favor. Motion carried.
PUBLIC HEARING: DELINOUENT UTILITY BILLS
The Mayor opened the public hearing and asked if there was anyone
present who wished to address the Council regarding a delinquent
utility bill.
PATRICIA BARTHEL, 3061 Brighton Blvd. stated that she has
been out of work since August and would like to make
arrangements to pay the bill, but that she cannot pay the
entire amount. The Mayor asked that she come into City Hall
tomorrow to work out a payment arrangement with the City
'Clerk and the Utility Billing Clerk.
The Mayor closed the public hearing.
Paulsen moved and Peterson seconded the following resolution:

SET DATE FOR PUBLIC HEARING: AMENDMENT TO YEAR XI CBDG FUNDS
MOTION made by Jessen, seconded by Peterson to set May 13,
1986, at 7:30 P.M. for a public hearing to consider an
amendment to Year XI CBDG funds. The vote was unanimously in
favor. Motion carried.
CITY OF MINNETRI~TA:
REOUEST FOR UTILITIES FOR MAPLE HILLS
The City Engineer explained his letter of April 22, 1986,
relating to the question raised by some Mound residents about a
lack of sufficient water pressure in the Dutch Lake area. He
stated that a desirable City watermain pressure would be in the
range of 50 to 60 P.S.I. After checking, the average main
pressure at the hydrants on the end of Walnut Road and at the
last hydrant on County Road 15 at the intersection of Westedge
Blvd. and south of County Road 15 was 40 P.S.I. The pressure on
the hydrant located at the intersection of Westedge Blvd. and
County Road 15 and at the hydrant on the end of Maple Road was 50
P.S.I. He further reported that the difference in pressure is
due mostly to the difference in elevation between these hydrants.
Their calculations show the pressure would be approximately 35
P.S.I. at the end of the proposed cul-de-sac in the new plat. He
then stated that the extension of these mains should not lower
the water pressure to any of the existing homes in Mound.
The Mayor suggested that the Staff check to see if the lower
water pressure would have any effect on the fire rating the city
receives from insurance carriers.
The Engineer then recommended that the City of Mound charge the
developer $12,979.89 as a fee to connect to the City's utilities.
He explained that this figure was arrived at by charging in the
nine proposed lots in Minnetrista the same as they would be
charged if they were located in Mound and had never paid a sewer
or water assessment.
The City Attorney then suggested that in addition to the above
figure, Mound should also charge for any legal or.engineering
costs it might incur for this work and that this should all be
put into the form of an agreement between the two cities.
Councilmember Smith asked that utility billing procedures for the
new lots be included in the agreement.
MOTION made by Paulsen, seconded by Smith directing the Staff
to do the following:

The City Clerk explained that this should be the last piece of
property that needs to be subdivided for right-of-way in the
Lynwood Blvd. Realignment Project.
Paulsen moved and Jessen seconded the following resolution:

The City Clerk explained that on the last list of tax forfeit

needed' on two of the parcels. The parcels were as follows:

Mr. Coddon presented his request to the Council.

The Building Inspector explained that Kraus-Anderson has
requested a 6~ square foot sign that will identify the
construction site of Town Square. Under the ordinance the
maximum construction sign shall not exceed 32 square feet. This
would be a temporary identification sign. The staff and the
Planning Commission are. recommending approval on the condition
that no grand opening banners or pennants be placed on the
office/retail shops until the construction identification sign is
removed.

LOT SIZE VARIANCE
The Building Inspector explained that Mr. Barrow has requested a
variance in lot size and width to allow construction of a single
family home with conforming setbacks. The Zoning Code requires a
10,000 square foot lot in the R-1 District with a lot width of 60
feet. This lot is 9,060 square feet and is 50 feet wide. It is
well within the 10% allowable. The Planning Commission has
recommended approval.
The Mayor asked that the following statement be added to the
proposed resolution, "No further variances will be granted." The
Council agreed.

COMMENTS& SUGGESTIONS FROM CITIZENS PRESENT
The Mayor asked if there was anyone presented who wished to make
a comment or suggestion to the Council.
STEVE KAKOS, 6381 Maple Road, stated that he is a Mound
resident and lives below the proposed development in
Minnetrista. He complained that he was not notified of the
rezoning in Minnetrista. The City Clerk explained that
Minnetrista handles their public hearing notices differently
than Mound and Mound was not aware at that time that
MinnetriSta expected Mound to send out their notices to our
residents. Mound requires the developer of a property to
supply the names and addresses of the persons within the
required distance and it makes no difference if there are
people from other communities on the list, Mound sends out
the notices. An intern at Minnetrista has done a survey
since this problem arose and found that most other cities
handle notices the same as Mound. Until Minnetrista changes
their policy on hearing notices, Mound has been and will
continue to send out the notices received from Minnetrista.
Mr. Kakos then asked that before the utility hook-up is
approved, which was one of the conditions of the preliminary
plat approval, that the City of Mound make sure that the
watershed from this new plat is not going to cause problems
for the residents of Mound. The Council directed the City

Engineer to check on this with Minnetrista.
DENNIS ERICKSON, 2424 Avon Drive, suggested that the City
look into other sites for a Public Works facility, i.e. the
Balboa property east of the NSP substation on Lynwood Blvd.,
the Riley bus garage (currently used by Contel), or working
out some kind of joint maintenance venture with the School
District using their property and buildings.
The Mayor explained that a number of sites were looked at
before the decision was made that the site near the Fire
Station was the most economical and best site. A primary
concern of the Council was not to take more property off the
tax rolls and the City owns the site that was proposed.
The Council thanked the people for their comments and
suggestions.
WATER SHUTOFF POLICY
The City Manager stated that since he has been here, each month
the delinquent utility bills have gone up ($3,000 January to
$1~,000 April 1st). It takes the City 6 to 8 months to finally
turn someones water off using the present policy. He then turned
the subject of a new policy over to Finance Director John Norman.
Mr. Norman stated that the Water Fund has consistently been
running with losses for 1984, 1985 and already in 1986, the
expenditures have exceeded revenues by $45,835.00. He explained
that he has checked with other cities and our collection policy
appears to be the most lenient. The proposed policy would be the
same as in the past except the City would no longer hang Red Tags
as a final notice. The letter sent to the resident notifying
them of the public hearing would be rewritten and would be the
final notice. Also proposed is a change in the connection fee
from $15.00 to $35.00 so the Water Department can cover the costs
of disconnection and reconnection of service.
Mayor Polston and Councilmember Peterson stated they would be in
favor of increasing the.connection fee but had some reservations
about not giving people enough notice before shutting off their
water service which Mayor Polston stated he has seen'.come back to
haunt some cities in legal costs.
Smith moved and Jessen seconded the following resolution:

LICENSE RENEWALS
The Building Inspector stated that the House of Moy's Restaurant
License is up for renewal and she and the Fire Marshal are
recommending it not be renewed because the restaurant still does
not have the required fire extinguishers in place. The Temporary
Certificate of Occupancy that was issued on April 14, 1984,
required fire extinguisher placement throughout the building at
5555 Shoreline Blvd. To date this has not been done.
MOTION by Smith, seconded by Paulsen to authorize the
extension of the House of Moy's Restaurant License until May
15, 1986, and if they do not install fire extinguishers by
then the Council will take the necessary action to revoke the
licenses of the House of Moy, because it could be detrimental
to the general public's health, safety and welfare not to
have the extinguishers in place. If the extinguisher's are
placed the Restaurant License will be renewed for one year.
The vote was unanimously in favor. Motion carried.

payment of bills as presented on the pre-list, in the amount
of $127,033.q8, when funds are available. A roll call vote
was unanimously in favor. Notion carried.
PUBLIC WORKS FAClLIT~
The Mayor reported that he and the City Manager met with Brad
Lemberg of BRA to discuss what items could be cut from the Public
Works Facility proposal to lower the cost. The following 4 items
were listed:

2. Outdoor Storage area west of
City Hall

sold and then using the money
from the sale to put in the

He further'reported that they again discussed a metal vs. a
concrete structure and found that by the time the metal building
was brought up to code and the added insurance costs, we would
again have the high costs.
The Council discussed having another survey of buildings or sites
in Mound and asked the City Manager to inquire about the old
Riley bus garage that Contel is now using.
The Council discussed waiting until the November election to
bring the question up again feeling that the special election did
not'bring enough people out to vote.
ROTARY CLUB MEMBERSHIP
MayOr Polston reminded ~he Council that when the City Manager was
hired they agreed that he should belong to at least, one service
organization in the community and the City would pay for the dues
of the organization. The City Manager has applied and been
accepted by the Rotary Club at a cost of $600.00 per year. Money
to be taken from the City Manager/Clerk Dues & Subscriptions
budget and the balance from the Council Dues & Subscriptions
budget.
MOTION made by Polston, seconded by Peterson to authorize the
payment of dues to the Rotary Club for the City Manager for 1
year in the amount of $600.00. The vote was unanimously in
favor. Motion carried.

PROPOSAL: The applicant is requesting appruval of a preliminary plat fur a
Planned Development Area (PDA) in order to construct eight single family
detached 'homes. Planned Development Areas are established by conditional use
permit un~er the Mound Zoning Gode.
The site o~nsi§ts of two acres of lard with fruntage on Highland Boulevard un
the west and Lake Ml~e~n the east. The property slopes from west to
east and has an elevation differential of 64 feet. The western two-thirds of
the site is relatively level and the eastern one-third contains slopes
exceeding 50 percent. At the present time, the property oontains a con~nercial
d aycare facility.
Creative Developers, Inc. proposes to establis~eight~single-family lots
ranging in size from 6,260 square feet to 8,104 g~fa~a~e feet and a common
outlot totalling 31,941 square feet.' This equa-f~fiD--an average lot area of
10,900 square feet per unit which is within the density requirement of the R-1
district.
The proposed site plan calls fur oonstruction of eight units with flour common
driveways. If oonstructed as proposed, the project will require side yard
variances and a lot width variance. E~_tails of the physical aspects of the

~: The subject parcel is z~ned Sirgle Family Residential (R-I) and the
proposal is fDr single-family detached uses. Since the proposed use of the
property is consistent with the zoning code and comprehensive plan, the
proposed layout of the lots is the mawr issue presented in this case.
Planned Development Area requests typically involve some comprumise. As
proposed, the city is being asked tD grant variances for lot width and side
yard setbacks in exchange fur the removal of a nonconforming land use ard the
consolidation of beach lot activities including docks. Due to the steep slope
on the eastern one-third of the site,- the plan as prup~sed w~uld have less
impact on the lake shore than dividing the parcel into individual lot
frontages. ~dditionally, the City has review authority in association bylaws
and covenants, both of which could be drafted to guarantee use of the shore
line outlot as proposed.
~IGN: If the Planning O~t~;~ision finds that {he project represents a
reasonable use of the property and meets the criteria for a Planned
Development Area, Staff reoonm~nds approval of the oonditional use permit and
preliminary plat fur Cooks Bay Estates contingent upon the fullowing:
1. Grading, drainage ard utility plans shall be prepare~ by the applicant ard
.appruved by the City Engineer.
2. Home Owner Association bylaws, articles of in corporation, ard covenants
shall be reviewed by the City Attorney.
3. The developer shall submit a phasing plan for the project clearly
identifing anticipated unit construction and renuval of the existing day-care
facility. If required, the developer .shall post a performance bond in an
am3unt acceptable to the city in order to guarantee dem31ition of the existing
day-care building.
4. Common driveway areas shall be at least 16 feet wide in order to
aco~n~udate two way usage, expanded parking and emergency vechicle access.
5. Use of outlot A should be limited exclusively to property owners an~ thei
quests.
6. Park dedication fees should be oollected in acoordance with section 22.37
of the Mourd oode.
7. The 'applicant shall submit plans bo the watershe~ district.
8: Prupose~ docks shall be reviewed and appruved by the LMCD.
9. Variances as shown on Pruposed Subdivision Plan dated March 25, 1986 shall

outlot "A" will not hinder the assessor in determining and allocating
the full value of the lakeshore and its inherent amenities (view,
boating,~swimming, etc.).
Depending on how the deeds are written, the lakeshore value will
be allocated in equal or proportionate amounts to the eight
building sites with "no value" assigned to outlot "A", or else
all of the lakeshore value will be assigned to outlot "A" with
the resulting tax statement being sent to some type of homeowner's
association. Again, the method used will be determined by how
the deeds are written, but in no case will the value of the lake-
shore be omitted from the tax roll.

We the undersigned, disagree with the tentative development plans
to construct several (6-7) multi family dwellings along Wilshire
Boulevard on Island Park in the City of Mound for the following
reasons:
As homeowners and residents, we believe there would be health
hazards in residences located near the existing sewer drainage
drum/and system - located on the northwest section of Bradford
and Wilshire Blvd.
As homeowners and residents, we believe this development would
interrupt and permanently disturb the natural presence of wild-
life in the area.

or less space between the blacktop and the edge of the channel
and marsh area.
As homeowners and residents, we believe that increased traffic
levels would be detrimental and direct access off of Wilshire
Boulevard inb~to driveways or access roads would negatively effect
the direct flow of traffic along the main road artery - County
Road 125 - Wilshire Boulevard.
As homeowners and residents, we believe any further development
plans along this lake and wilderness setting would negatively
impact property values in the Wilshire/Bradford area and would
fUrther over-saturte the area with housing units and destroy
the preservation of a natural setting within the neigh~borhood.

As requested, we have reviewed the preliminary plans submitted for the
above project and have the following comments and recommendations.
Preliminary Development Plan
· 1. We do not think the proposed layout is'very desirable for a couple of
reasons. The first being the location of an existing MWCC lift
station in the front yard of the center unit on Lots 3 and 4. This
· lift station has a number of above ground projections which do not
enhance the view to or from the proposed building. Secondly, we would
also suggest this unit be rotated to 'line up better with the other 2
units, which ofcourse will require a variance to the 50 foot
shoreline setback, but will reduce or eliminate the need for a front
yard variance.
Preliminary Utility and Drainage Plan
1. The purpose and the final deposition of the existing 18" C.M.R. under
County Road No. 125 needs to be determined.
~2. Approval from the MWCC will be needed to construct manhole no. i over
the existing 8' line. This main is owned by the MWCC not the City of
Mound. We believe the proposed manhole is too close to the lift
station.
3. We would suggest that the proposed sanitary sewer main and watermain
not be located so far into Lots i and 2. If these are to be City
mains, which I assume they will be, easements will be required.
Public Works will require the sanitary sewer main to be 8" if it is to
be public and not private.
4. Services for Lot 3 should not run through the lift station easement.
All water services require individual curb stops.

The Twin Home building depth on Lots 3 and 4 after a 50 foot setback
from the lake and a 30 foot setback from the street rlght of way would
be 10 feet. This Is caused by a small bay or Indentation In the
shoreline behind this buildlng.
The street right of way in front of Lots 3 and 4 has a bend in It while
the pavement curves away from the lots by about 7 feet, creating the
appearance of a 20 foot setback at the closest corner of this house.
The minimum modification for the side yard setback for the garages on
Lots 2, 3, 4 and 5 would be 3 feet. These are attached garages with no
living space above this part of the garage.

ton desi9n that part of Lynwood Boulevard between Belmont Lane and the point
where trucks will enter from the Balboa parking lot and that part of Fairview
Lane between County Road No. 15 and the Dakota Railroad;
WHEREAS, pursuant to the request of the City Council at their regular

As you know., the revised Conditional Use Permit which you had
applied for was denied by the City Council. Generally, denial
of Conditional Use Permits are not reconsidered for at ]east one
year. It is up to the City Council to decide if this matter should
be reconsidered. That would be the purpose of the discussion on
May 13th. If they decide to reconsider it, I believe they would
set a date for a public hearing for a future date so the area
residents would be informed. I will place it on the May 13th
agenda. You may wish to appear at that time to provide any

Mr. Jacobson has an undersized 40 by 80 foot lot on Block 30 which he has had
for many years. He.would like to construct a storage building on this vacant
piece of land. The'size of which Will be within ten percent of the lot area.
This undersized )or could possibly be combined in the future with other ad-
jacent lots in the area.
Recommendation:
If the Planning Commission feels they would grant the requested
variance to the owner, Mr. Jacobson, to relieve any undue hard-
ship for the undersized )or, staff would recommend the following
condition;'
1. They would recommend an agreement be drafted with the title
of the property that the accessory building lot would have
to be combined with another building site or the garage re-
moved within a specific time period.
P.S. It appears that the neighbor's privacy fence is encroaching on this lot.

Steve Smith-brought up the Court's ruling on a Dove Lane house the City has con-
demned. · He questioned, if we shouldn't get the Clty Attorney's opinion-on 'what
action to take; he thought Commission should conslder'tabling request until an
~p. lnion is gotten. The Planning Commission discussed'the problem and though~
the Councll should work out legalities. It was also discussed that-neighbor's
fen~e, is encroaching on lot and that a garage on the lot would decrease the ~
value of'the rental house on Lots 2 and 3. It was thought, possibly, the o~ner
of Lots 8 and ~ would be a logical buyer of Lot 10.
The vote on .the.motion ~as all in favor except Steve Smith abstained because
there is not enough information as to legal aspects. The other members gave
their reason for the denial; it was to uphold the integrity of the Zoning Code.

The variance I am seeking, I feel, is not an unreasonable
request. I wish to build a 15' x 21' garage on the 40' x
80' lot I own located on the corner of Clare & Wilshire
Blvd. (lot 10, block 30 Seton Addition).
If I am unable to build this garage the hardship-will be
two fold: One, for financial reasons, in order to pay off
a contract deed on my exsisting residence, it was necessary
for me to sell off some of my land around my exsisting res-
idence (4700 Wilshire Blvd.). The property I sold has on it
a basement~ype structure which will soon be removed in order
to make wa~' for a new dwelling to be built by the new prop-
erty owner Mr. Ron Gerhing. I have many personal effects
stored there and will have no place to put them. Second,
I have owned the property at the corner of Clare & Wilshire
Blvd. since 1946 and at that time it was under the Excelsior
township. I have paid taxes on this property since that
time. I would hate to think that all the money which I have
paid in taxes has been for nothing.

posed is 26.67 feet by 21.33 feet with a conforming setback of 20 feet from the
front property line and plus IO feet to the West property line. In 1979, the
City yacated 6 inches of Kildare Road in front of Mr. Payne's property to remove
..his h~m the public right-of-way and grant him a variance to construct a
7 foot by 11½ foot expansion to his deck.
The R-2 Zoning District requires a 20 foot front yard setback, 6. foot side yard
setback and 15 foot rear yard setback. The minimum dwelling size is 840 square
feet.
Recommendation: The Staff recommends the approval of the request to recognize
the existing non-conforming structure upon the condition:
1. The addition proposed will be constructed to meet the
current setback regulations.
2. The addition will bring the structure over the minimum
floor area in the R-2 Zoning District.
3. Some structural modifications to the existing dwelling
will be made in the way of support beams and posts.

WHEREAS, Richard P. Payne, owner of the property known as Lots 10
and ll, Block 14, Seton, has applied for a variance to recognize an existing
nonconforming structure to allow construction of a 21.33 by 26.67 foot tuck-
under garage 2 story addition to their home with conforming setbacks; and
WHEREAS, the City Code requires a 20 foot front yard setback from
the front property line in the R-2 Zoning District; and
WHEREAS, the existing structure is .2 feet from the front property
line and the proposed addition will be 20 feet from the front property line with
conforming side yard setbacks; and
WHEREAS, the Planning Commission has reviewed the request and does
recommend the variance to recognize the nonqonforming existing structure to
afford the property owner reasonable use of his property.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Mound does hereby approve the variance to recognize the existing nonconforming
structure to allow a 2 story addition with a tuckunder garage with conforming
sideyard and front yard setbacks for Lots 10 and 11, Block 14, Seton; PID Numbers
19-117-23 23 0008/0009 to afford the property owner reasonable use'of his prop-
erty upon the condition that:
1. If the existing tuckunder garage door is to remain in place,
the basement garage must be brought up to current building code

The recent applicati~ fora building permit for a 14 x 66 foot m~nufactured
housing unit identified a potential deficiency in the existing City Code. At
the present time, the City has no restrictions on manufactured housing
providingthat it complies with the State Building Code. Manufactured housing
units can be placed in the R-l, R-2, R-3 and R-4 zoning districts with little
or no restrictions on the physical form of the unit.
Cities generally restrict the form of manufactured housing by enacting minimum
height and width provisions. In order to be valid, such provisions must apply
to all types of single family detached housing and can not specifically target
manufactured units.
For discussion purposes, I have assembled the following ordinance
modification, the intent of which is to regulate manufactured housing so that
it closely conforms tm the general style of housing within the community. It
would modify Section 23.410 which is found on page 19 of the Mound Zoning
Code,
23.410 MinimumResidential Reguirements
(1).'
The following minimum floor area requirements shaI1 be applied to all
new residential dwelling construction:
(A) Single-Family Detached Dwelling
840 sq. ft. per dwelling
(B) T~w°FamilyDwellings
800 sq. ft. per dwelling

(2) Height Limitations - No single family home shall be less than 15 feet

(3) Width Limitations - No single family home shall be constructed in the
R-I, R-2, R-3 and R-4 use districts where the length of the main
structure exceeds the width of the main structure by more than a
multiple of three. The minimum width of a single family home shall
not be less than 20 feet. "
A modification of the ordinance in this manner would prevent placement of
ar%other 14 x 66 foot manufactured housing unit.

At the last Council Meeting,~Councilmember Smith asked me to finds'out
how much in postage it would cost to notify Mound residents of the
public hearing on ~ezoning in Minnetrista.
I feel we have to take more than just the postage into account. Please
let me explain.the procedure.
Minnetrista sends Mound a notice and a map showing the area in question.
Mound uses a plastic template that is scaled to show 350 feet~ on a map.
The middle of thls template is placed on the edge of the property and
all Property Identification Numbers that fall in the 350 foot area must
be copied down. (See attached map. The cross hatched area is the
property to be rezoned and the shaded area are the parcels in Mound
who must be notified.) In this case there are 25 parcels affected in
Mbund. You must then go to the tax books and look up all the names
and addresses for the Property I.D. numbers. Labels must then be
typed for these people. Copying of the notice Minnetrlsta sent, pasting
labels on envelopes, inserting the notice and mailing. Then an
affidavit is filled out that the notice has been sent.
The following is a breakdown of the costs involved for Mound:

All dock applications have been processed and assigned except for one.
Two abutting owners'have not met the final deadline and were sent letters
to appear before the Park Commission for approval or denial of their
sites. Refunds have been issued to those entitled to them. I have 3
or q phone requests for a shared dock if they become available. There
are still a fair number of watercraft licenses to come in, but the
response for same has been good. The DNR is very late with renewals
this year.
Here are some statistics for this year:

The water I~ almost at a record high this year, so many areas ale awash
and lots of docks that were left In are under water. We can expect
much erosion of shoreline,
The new LHCD ordinance on-less.boats at a dock is now in effect. We
should be thinking about changing our Commons'dock ordinance to comform
for next year.
I am planning to log erosion'problems this year as I inspect docks.
This will enable us to plan and prioritize some repair and rip-rap
with funds that will need to. be budgeted for this important work.
I expect to st~rt~do/ck and boat inspections in about two weeks.

Rick Jacobson' was present for his father, P. L. Jacobson
Rick Jacobson explained that his Father wants to put up a storage building on the
hO by 80 foot lot.just off of Wilshire BOulevard which he purchased for a garage
site over ~0 years ago when area was Excelsior Township.

Jacobson stated his father, had a contract due and'he':.had had to sell Some of

It Is against the code.
Byrnes moved.and Thal seconded a motion to deny the: variance request.
Steve Smith.brought up the Court's ruling on'a Dove Lane house the City has con-
demned. 'He questioned. If we shouldn't get the City Attorney's opinion on what
action to take; he thought Commission .should consider'tabling request'untll an
dp. inion is gotten. The Planning Commission discussed the problem and though~
the Council should work out legalities. It was also discussed that neighbor~s
fence. Is encroaching on lot and that a garage on the lot ~ould decrease the '.
value of'the rental house on Lots 2 and 3. It was thought, possibly, the owner
of Lots 8 and. ~ would be a loglcal buyer of Lot 10.
The vote on .the.motion was ail in favor except' Steve Smith abstained because
there is not enough information as to legal aspects. The other members gave
their reason for the denial; It was to uphold the integrity of the Zoning Code.
Commission I~eyer left for another meeting in Hinnetrista.
Exterior Storage Ordinance Draft
The Building Official explained the proposed, draft and that this'draft would be less
restrictive; It ~ould limit the quantity of' stored equipment to .4 and keep the front
yards open. She would like to get'.the boats off the.streets. .The Commission dis-
cussed the draft briefly; questioned If all equipment m~st be licensed, and the wording
of conditions, densen and ~elland are not comfortable wi. th parking boars'In the side
yard setback on property line. The Commission discussed sett'ing a date fora public
hearing: on this draft to'be held at the Planning CommissiOn level on June 23rd. No
furthe~ action was taken.

Jansen moved and Byrnes seconded a motion to adjourn the meeting at 8:45 P.H;' The
vote was ali in favor, so meeting was adjourned.

Monthly Report for April, 1986
I. Statistics
The police department received 643__calls for service in the month of April,
1986. There were 24 Part I CriM~s repo~ted.~nd 85 Part II Crimes. In
addition, there were 8 accidents, 3 with injuries; 13 medical emergencies;
and 90 animal complaints. Mound Police were called to assist other agencies
11 times during the month.
The Patrol division issued 240 adult citations, incldding 45 parking viol'
lations. There were 11 arrests for DWI, all adults. .In addition, the
department issued 161 warnings, most of. Which were fort equipment violations.
There were 6 adults arrested for felonies and 57 arrested for misdemeanors.
Three juveniles were arrested for felonies and 14 for misdemeanors.
Property valued at $9,496 was stolen :during the month of April; of which
$6,056 was recovered. These figures represent a 64% recovery rate.
II. InvestiEation
Child abuse cases, again, took the greatest amount of investigative time
during the month. A total of'41.5 hours were expended in investigating
9 cases of abuse.
.-There were investigations conducted involving an infant death, check cases,
several thefts, and burglary.
There were 16 formal,complaints issued in April. Some of the cases included
/unauthorized use of a motor vehicle, escape from custody, criminal
vehicular operation, fleeing a police officer, several gross misdemeanor
DWI's, and a number of dog complaints.
III. Manpower
Sgt. Hudson was on vacation the first week of April and patrol Officers
assisted in working plain-clothes and following up on active cases. Patrol
officers worked a total of 10 shifts in plain-clothes in April.

IV. Trainin8
A total of 144 hours of training was received by officers of the department.
The areas of training included sexual assault and abuse (24), firearms (9),
NCIC Computer Operation (16), advanced accident investigation (24), fraud
(8), state vehicle safety seminar (24), animal control (24), and emergency
preparedness ~16).
V. Overtime
Overtime was kept to 15 hours for the month of April. Most ofthe overtime
was caused by arrest situations that necessitated an officer to continue
over shift.
Re-establishment of comp time, effective April 15th, should help to keep
overtime within the alloted budget.
._ VI. Reserves
The reserves donated 270.5 hours to the department in the month of April.
Over 100 hours of that time was spent in a squad either with another reserve
or a regular officer.

The reserves were involved in teaching two first aid courses at Community
Services and one class for an area boy scout troop.

AUDIT
I spent many hours getting ready for the first audit. During a four
week period, from March to April, I put in 50 hours per week. After
going through the audit process ~nce, I~look forward to next years
audit. It will be easier to answer questions when I have been present
for the entire year.
GENERAL FUND
The General Fund balance stands at $500,000 at the end of 1985.
This is up considerably from the Iow of $1OO,OOO in 1982. I was
at a seminar where 50% of the total general fund budget was suggested
to be kept in reserve. With our budget of $1,800,0OO, for the
general fund, a $900,000 fund balance would be necessary under this
guideline. I believe it is not necessary to have 50% of budget as
a reserve. I believe our reserve of $500,000 is sufficient.

were up and expenses were down. The auditors were glad we didn't
transfer out more than the operating income (this was done the years
preceeding this one). The increased competition in the area's liquor
stores will make it hard to duplicate the profits next year.

1985 was also a fairly good year for the Sewer Fund. Also,. the MWCC
audited flow of gallons.for Mound came up less than. the amount we
paid for during 1985. We will be receiving a sizeable credit next

In April, I became a Mohawk. I joined the Westonka Jaycees. I
attended one meeting and was elected treasurer. It never fails,
when they find out someone is a CPA, automatically they are elected
treasurer.

APRIL 1986 REPORT

For the month of April we had $59,601.01 in sales. This compares with
$66,012.01 in April of last year. .A drop in sales of $6,411.00. I
anticipated a slower month for two reasons. Easter was in the month of
March this year, whereas it fell in April in 1985. This accounted for
a small part in the loss of sales. The major reason I believe we were
down was because of the inclement weather, I hope. Last year we had
a beautiful, warm, sunny spring. We keep a daily log of the weather
and going back over it, I noticed that last year there were seven days
of 80 degree weather, four days of 70 degree weather and eight days of
rain. This year there were no days in the SO's, four days in the 70's,
and twelve days of rain. Not a pretty picture. And definitely not
good conditions for selling beer.
In the month of April I was on vacation for seven days. Julie Clyne,
the Assistant Manager, took over for me while I was gone. She assumed
most of my responsibilities and did an outstanding job filling in for
me. I can always feel comfortable leaving the store in her hands. She
should be commended for her performance, not only in this instance, but
also for the job she dOes day in and day out.
Other than that, nothing much out of the ordinary occurred. We had a
Seagram's Wine Cooler tasting on the 18th. A little over six cases
were sold. Anheuser Busch introduced their new low cost Busch beer
into the Minnesota market. Seems to be doing fairly well. Some of
the liquor and beer companies are having internal shakeups in their
personnel and I have had to deal with new sales people and drivers,
which makes matters a bit difficult at times because things don't
run as smoothly as when you are used to those people you have known
and their routines. The audit was completed and John Norman showed
me the figures for the store for 1985. They looked encouraging.
That's about the extent of it. Hopefully, things will pick up in
May. We have a target of $82,639.12 to reach.

April Monthly Activity Report
In April we pumped 19,071,000 gallons of water and 1 new account was
recorded. The failure rate for water meters and OR's was 0.9%. 982
meters were read out of 1,022 for April. We will be flushing fire
hydrants June 2 thru June 20. We will try to do the whole town in
this 3 weeks period. Bob Johnson is back for the summer so he will
be st'arting to repair lawns that were damaged this winter due to main
breaks.
The Sewer Dept. had 2 sewer back-ups in April. The first one was at
4626 Manchester Rd. There was no damage to property, but the City paid
the Roto-Rooter bill, seeing it was in our stub. We may have to dig it
up to find the problem. The second back-up was at 5856 & 5842 Grandview
Blvd. The cause was a faulty relay causing the pump not to shut off and
air locking the pump. The City paid for cleaning the carpe~ at 5856
Grandview Blvd. The bill was $95.00. The owner at 5842 Grandview Blvd.
has not yet Submitted any estimate of damages. This should be about ~ less
than that of 5856 Grandview Blvd.

April Monthly Report
If you read the March report you khow we rented a cherrypicker for
trimming trees on the street right-of-way. We planned to spend
$2,000 dollars for rent, but do to the early spring and 6 days of rain
we cut our tree trimming short, but we did get alot done. The areas
~that we did were half of the Highland, all of Woodcrest, Bluffs,
Chesterpark, Brighton Commons and Wychwood areas. It cost the City
$1,000 for 50 hours of rent for the cherrypicker,we returned the truck

This past winter the Water Dept. had a mainbreak on Lakeside Lane in
Three Points, after the frost went out the road caved in so we had to
cut the blacktop out and haul it away. Its going to be an expensive job.
We filled in the hole with 70 yards of 3/4 to dust limestone. The patch
is 106' X 24' and has to be repaired with a paver, we are getting bids
for the job.
April 10th we started to dismantle snow equipment. The first thing was
the snowblower, it takes about 5 hours to remove the blower and install
the sidewalk broom. The City has 7 miles of sidewalk and they were swept
the llth and 14th. The City has five 2½ ton dumptrucks with wings, plows
and sanders, it took 2 men 14 hours to dismantle and store snow equipment.
We put the wings and plows at the Lost Lake site and the sanders in the garage.
SWEEPING
The City has 2 sweepers, a 1969 Elgin Pelican and a 1981 Elgin Premier.
The 1969 Sweeper has 14,000 miles on it,(thats alot of sweeping) and the
1981 sweeper has 1493 hours. In the spring we go through these machines
from top to bottom. I'll list some of the parts that have to be replaced

and maybe it will help you understand why it takes money to operate
equipment. This is for one sweeper, 2 oil filters, 1 hydraulic filter,
1 hydrostatic filter, 2 engine air filters, 2 cab filters, 3 V-belts for
hydraulic pump, 5 gallons hydrostatic fluid, 2 gallons engine oil, 10 gallons
hydraulic fluid and a complete lub job. Here are some of the parts that
are replaced every few days. Each sweeper has 5 dirt shoes, 1 main broom
and 1 gutter broom. This year we order 24 rear dirt shoes @ $13.OO each
or $312.00, 24 front dirt shoes @ $9.00 each or $216.00, 4 main brooms
@ $173.00 each or $692.00 and 30 gutter brooms @ $54.00 or $1,560.00
The Spring cleanup takes about 3 weeks depending on the weather and other
jobs that have to be done right away. During the spring cleanup the Street
Dept. works 4 days a week, 10 hours days because its faster and cheaper,
(no overtime) the earlier you start in the a.m. the less traffic you have,
also after each day you have to wash the machine, lub, change filters and
make minor adjustments which takes about ! hour, thus by working 4 days
you cut 1 hour of maintenance (save time & money). We won't get done
sweeping in April so I will finish my report in May.
EQUIPMENT & REPAIR
The repair bills were a little higher than we expected. We broke an axel
on Unit #16 that's a 2% ton dump truck and the cost of parts were $170.00
and 8 hours labor. We had some extra re~airs on the 2 sweepers and the
blue tanker truck because of outside storage. We replaced a $100.00
battery in the tanker which was 7 months old, also a high pressure pump
on the 1981 sweeper cost $270.00 and 4 hours labor. The 1969 sweeper
had some window damage because of vandelism.

April Monthly Report
As we all know the Bond Issue was defeated. This was a real
disappointment for everyone but it is really discouraging when so
much time is put into preparing for an election and only 714
people vote. The City is required to be open to accept absentee
ballots on the Saturday before the election from 1:00 P.M. to
3:00 P.M. and on the evening before the election from 5:00 P.M.
~to 7:00 P.M. We hold a training session for the precinct
chairpeople and another with all election judges. This took two
afternoons before the election. It is required before each
election to bring all judges up-to-date on any new laws, go over
all procedures on election day and answer any questions they
might have. All election supplies must be inventoried and
readied for each precinct to pick up the evening before the
election.
On the day before the election all voting booths (machines),
flags and stands, tables, and miscellaneous supplied are
delivered to each of the six precincts. Everything is set up and
prepared for election day. Election Day for me starts at 6:00
A.M. when the Library (Precinct #2) is opened (they have a
complicated .security system and only allow the City Clerk to have
a key and instructions for entering). From there it is-traveling
from precinct to precinct answering any last minute questions or
supplying items needed for the day. The end of the day comes
when all the votes are in and totaled and the results tallied.
The City Council meets the next evening to canvass the results of
the election which in this case were disappointing.
After the election is over all new registrations received on
election day are processed and submitted to Hennepin County along
with the precinct lists. The County then updates the voting
records of all voters. They then send the lists back to us to
verify. So you can see when the election is over there are still
alot of loose ends to handle.

There were two regular City Council meetings and one canvassing
meeting in April requiring agenda and packet preparation,
minutes, resolutions and items to be dealt with before and after
the meetings.
There were two bid openings in April, the 1986 Seal Coat Program
and the Bartlett Blvd. Repair Project.
There were several property description problems this month, one
involved the HRA when the building at 2020 Commerce was built,
the other turned out to be a private matter that the resident
thought should be corrected by the City. It is amazing how
residents want the City to provide legal services for private
matters (title qustions, etc.) that they should hire attorneys to
do, but~all these things require time and research to arrive at
the point of directing residents ~on how the matter should be
handled.
The Lynwood Blvd. Realignment Project required time be spent on
coordinating the parcels that needed to be acquired for right-of-
way, traded for other parcels and subdivided.
.Tax Forfeit property which required easements be placed on them
before they are released for public sale was handled. We will be
dealing with about 14 parcels in the near future.
And as always, there were numerous phone calls and questions from
residents.

PARKS DEPARTMENT MONTHLY REPORT, APRIL
The Parks Department in April, began showing activity in all areas of
its' responsibilities.
TREE REMOVAL
Fourteen hazardous tree complaints were received and are being processed.
I anticipate that the line item for thee removal, $19,OOO, will be
expended by late August.
DOCKS
With the early ice melt, we have a hurried schedule for dock permits,
dock site locations and general information. Also, the increase in
home sales have brought a number of realtors and prospective buyers
in for explanations of the Commons. All available sites have been
assigned and the Dock Inspector, Dell Rudolph, has aided some 30
additional residents in sharing a dock site.
CEMETERY
The caretaker, Howard Simar, has done an excellent job in bringing the
cemetery grounds back into shape after the winter months. We cited a
contractor for dumping dirt and cement block at the cemetery. He was
also instructed to remove all material brought in.
PARKS
With the weather in April being very wet, the Parks Department, John
Taffe and myself have been mostly involved in setting up and repairing
the equipment. Along with the seasonal preparations, we had to move all
of our equipment out of the Anderson Building to the Lost Lake Stock
area outside. With no protected areas, I am anticipating numerous
problems related to this type of storage, such as; vandalism, theft and
equipment breakdown.
The summer season has a number of projects planned. The first is the
volleyball court at Mound Bay Park and water fountains at Swenson,
Clover and Three Points Parks. These were begun in 1985 and will be
finished in the next few weeks.
GENERAL COMMENT
The Parks Department is making progress in all areas, but the rest-
rictions of not having a maintenance building and limited funds, put
constraints on service levels in all areas.
