SEPTEMBER 30, 1986
The City Council of Mound, Hennepin County, Minnesota, met in
special session to go over the proposed 1987 Budget on Tuesday,
September 30, 1986, at 5:30 P.M. in the Council Chambers at 5341
Maywood Road, in said City.
Those present were: Mayor Bob Polston, Councilmembers Phyllis
Jessen, Gary Paulsen, Russ Peterson and Steve Smith. Also
present were: City Manager Edward J. Shukle, Jr., City Clerk
Fran Clark, Finance Director John Norman, Building Official Jan
Bertrand, Fire Chief Don Bryce, Acting Police Chief Bill Hudson,
Liquor Store Manager Joel Krumm, Street Superintendent Geno Hoff,
Sewer & Water Superintendent Gregg Skinner, Park Director Jim
Fackler.
The Council went over the following proposed Budgets and asked
various questions of the Department Heads:

SEPTEMBER 30, 1986
The City Council of Mound, Hennepin County, Minnesota, met in
regular session on Tuesday, September 30, 1986, at 7:30 P.M. in
the Council Chambers at 5341Maywood Road, in said City. This
meeting followed the Budget Hearing.
Those present were: Mayor Bob Polson, Councilmembers Phyllis
Jessen, Gary Paulsen, Russ Peterson and Steve Smith. Also
present were: City Manager Edward J. Shukle, Jr., City Clerk
Fran Clark, City Attorney Jim Larson, City Engineer John Cameron,
City Planner Mark Koegler, Building Official Jan Bertrand and the
following interested citizens: William Christian, Patricia
Kargel, Dagmar Christian, Jerry Kargel, Ray Johnson, Orr Fenstad,
Rick Sathre, Dan Martin, Phyllis Marton, Tom Ess, Judy Ess,

The Mayor opened the meeting and welcomed the people in
attendance.
The Minutes from the September 10, 1986, Special Meeting were
presented for consideration.
NOTION made by Smith, seconded by Peterson to approve the
Minutes of the September 10, 1986, Special Meeting, as
presented. The vote was unanimously in favor. Motion
carried.
The Minutes of the September 16, 1986, Regular Meeting were
presented for consideration.
NOTION made by Peterson, seconded by Smith to approve the
Minutes of the September 16, 1986, Regular Meeting, as
presented. The vote was unanimously in favor. Notion
carried.
PUBLIC HEARING: DELINOUENT UTILITY BILLS
The City Manager reported that the amount is down to $q,876.60.
The Mayor opened the public hearing and asked if there was anyone
present who wished, to address the Council regarding a delinquent
utility bill. No one responded. The Mayor closed the public
hearing.

PUBLIC HEARING:
CONSIDERATION OF SUBDIVISION OF LAND (PRELIM-
INARY PLAT & LOT VARTANCE) AT q6X~ LAKESIDE LANE
PID #18-11T-2~ ~2 001~/0016
The City Planner explained the proposed subdivision and the lot
width variances. The two newly created lots would have 13,600
square feet in Lot I and 31,800 square feet in Lot 2J He further
stated that this variance request does meet the criteria for
granting a variance. The Planning Commission recommended
approval with the stipulations of the staff.
The Mayor opened the public hearing and asked if there was anyone
present who wished to address the Council on the requested
subdivision.
Bill Christianson - owner of the Lot 7, Block 9 asked about
grading and drainage plans. Rick Sathre, representing Mr.
Ess stated that they will work with them on this plan. The
City Engineer stated that this a grading and drainage plan is
one of the stipulations.

The Mayor opened the public hearing and asked if there
was anyone present who wished to speak regarding their
assessment,
Orr Fenstad asked if the parking lot across from the
Post Office, which is being used primarily for bus
users, is being charged to the CBD. He suggested that
that part of the lot not be,charged to the businesses.
The City Manager explained that the total amount of the
assessment has changed because a re-evaluation of the
assessment for the old Super Valu was done to be more
fair to the current owner.

REOUEST FOR STREET LIGHT - CANARY LANE
The City Manager presented the Council with a petition for a
street light for the 1500 block of Canary Lane. The Police Dept.
has reviewed the area and recommends the installation of the
light.

MOTION made by Paulsen, seconded by Jessen to approve the
payment of bills, as presented on the pre-list, in .the amount
of $260,637.39, when funds are available. A roll call vote

OCTOBER 1, 1986
The City Council of Mound, Hennepin County, Minnesota, met in
special session to continue the hearing on the Proposed 1987
Budget on October 1, 1986, at 6:20 P.M. in the Council Chambers
at 5341Maywood Road, in said City.
Those present were: Mayor Bob Polston, Councilmembers Phylli.s
Jessen, Gary Paulsen, Russ Peterson and Steve Smith. Also
present were: City Manager Edward J. Shukle, Jr., City Clerk
Fran Clark, Finance Director John Norman, Fire Chief Don Bryce,
Acting Police Chief Bill Hudson, Liquor Store Manager Joel Krumm,

The majority of the Council decided to take $4,000'.00 from line
item #4411 in the City Council Budget and put it in the
Contingency Account.
The City Manager went over the General Fund Revenues,
Expenditures, the Assessed Valuation, Levies and the Mill Rate
with the Council.
The HRA has requested that the City levy one-third of a mill for
their operations at 2020 Commerce Blvd.

WHEREAS, Minnesota Statutes, Section 412.851 provides that the City
Council may be resolution vacate anystreet, alley, public grounds, or public
way or any part thereof, when it appears in the interest of the public to do
so; and
WHEREAS, the City of Mound has claimed a street and utility easement
over the following described land:

preitmfnary pIat approvaI granted as Lot 1 does not front on a pubiic
street.

included on the pIat.
FINAL GRADING AND UTILITY PLAN
No fill is shown at the rear of the proposed house on Lot 2, even
though the walkout elevation is approximately 2 feet above the
existing ground. If this area is to be filied, then compensating
excavation will probabIy be require by the Minnehaha Creek Watershed
District since the. existing grade is at or below 931.5. If this is
not revised for approval by the Minnehaha Creek Watershed District at
this time, it will need to be done before a building permit can be
issued.
A separate permit from the City is required before the street can be
excavated to instai1 the new sewer and water services.

The Minnehaha Creek Watershed District's Board of Managers reviewed the plans on
September 18, lg86 from Mr. Ess for the proposed fill for placement of the
building pad, compensatory excavation for the building pad fill, rip-rap,
filling in of the man-made lagoon behind the rip-rap, and dredging. The permit
was tabled pending: 1) review and approval by the DNR for the dredging, 2)
review of the plans and calculations balancing cut and fill for the building
pad, and 3) review of past MCWD Permits which allowed filling of man-made boat
slips.
The applicant has submitted exhibits showing a first floor elevation of 2feet
above the projected regional flood elevation and calculations which demonstrate
a balance of cut and fill for the proposed building pad. While these exhibits
meet District standards for residential development on the lake, the Board of
Managers expressed their concern about the low elevation of the backyard and
that the present and future owners be made awar~..that this portion of the
property may be subject to periods of shallow flooding.
At the request of the owner's representative, Clifford Reep, we direct this
letter to you in the hopes of eliminating unnecessary delay for the applicant in
the City's review of the subdivision request.

In the existing situation, Hr. Essts ownershlp Is 'one parcel. HIs
proposal Is to subdlvlde the property Into 1~o lots, each of whlch would
be as large or larger Than the mJorlty of the other lots In the
nelghborhoodo The prellmlnary plat shows the geometry of these ~o
proposed lots and the area of each above the ordinary hlgh water mark of
Lake Nlnnetonka.
The maJorlty of' the 'lo~s In the neighborhood were orlglnally platted
with 50 feet of lot w.ldth and frontage on the pubilc streets. The slx
lots which Mr. Ess owns each were plak-fed at the sa~e standards, wlth
frontage on Ivy Lane. Ivy Lane was never constructed and the city has
slnce vacated the road.
The action to vacate the road has created a difficult sltuatlo, for Hr.
Ess. The original slx lots wlth 50 feet of street frontage 'each now
have become one parcel wlth a total street frontage of 24 feet. The
construction of one home on this property would not be a reasonable use
of the property. The fact that the road was never opened for use has
created a hardship on the land.
We believe that the request to subdivide the property Into two building
lots Is the minimum reasonable use of the property. Thls request for
subdlvlslon creates the need for two varlances for lot ~'Idth at the
streeT. ^ppi ication for a bulldlng permit on the existln9 parcel would
trigger the need to obtaln a variance for lot width at the street, as
well. The proposal Is to plat Lots 1 & 2, each with equal street
frontage on Lakes lde Road and to create a cross easement from Lot 1 to
Lot 2 and Lot 2 to Lot 1 for the shared use of that part of vacated Ivy
Lane leadlng Into the Internal portion of the property,

Applicant BaKYy Rettke was present and also neighbors, Mr. and Mrs. Stokke.
The BuildingOfficial, Jan Bertrand, explained that in 1977, they were granted
a side yard setback va-riance in order to improve the existing home. It has a
3.8 to 4.4' side yard on. the n~rthwest corner . At that tlme, home was enlarged
and a deck added. Applicant' is asking again to recognize an undersized lot
and also nonconforming, sldeyard to expand the lower.level below the existing
deck which is the 16 feet shown on the survey. She statedaPplicant is purchasing
the lots alongside him to the west and there is the possibility of his having
conforming lot size. She is recommending"approval of the expansion as perimeter
of the existing structure will not be expanded to make more nonconforming.
The neighbor on Lot 22, Mr. Stokke, stated he is in favor of allowing the expansion.
The Planning Commission. questioned zoning on the block and if it had been part
of. 0rono (always been in Mound), if zoning had changed, size of other lots on
block. Requbst was'discussed and that if applicant owns Lots 24 and 25 to the
west, he could'have two very close to conformihg lots; also that the existing
structure and proposedaddition wou4d than be within the setback requirements
with a combinetioh/division of land.
Reese moved to cure the nonC~nformancy .by requiring Lot 24~be split and joined
with 23 and 25 to make them as near conforming as reasonable'and to recommend
tw° building sites be allowed without further reference to the Planning Commis-

front property line to allow a 22 by 26 foot garage to be constructed in the
same location-as the existing detached accessory building.
The Zoning Ordinance Section 23.407 allows a front yard setback of 8 feet and
a 4 foot side yard setback on lakeshore lOts'fordetached accessory buildlngs
with the garage doors facing the side property line. Mr. and Mrs. Radintz
are proposing to change the existing garage doors facing south to Edgewater
Drive to face'the side property )ina at the northeast. The setbacks requested
would be in line with the existing detached garage approximately 2 feet to the
front property line. This would al)ow them to preserve the existing mature
maple tree to the east of the existing garage.
The site condition has a neighbor's driveway to the southwest approaching Edge-
water Drive. Edgewater Drive swings to the northwest direction which makes
visibility difficult from the neighboring driveway.
RECOMMENDATION: Staff woutd recommend granting a five foot setback variance
to allow the construction of a 26 by 22 foot detached accessory building. How-
ever, the southeast wal] of the garage should be parallel to the front property
line thereby the side yard setback would be less than 4 feet at the northwest
corner. This would allow the neighbor additional visibility to the northeast
upon approaching the Edgewater Drive right-of-way. The variance approval should
also be conditioned upon the 6 foot privacy fence being relocated 20 feet from
the front property line or the variance should include approval in the same
location.

for a new structUre under, the provisions of the UnlformBullding.Code, State

Dear Mr. Shukle:
Thank you for sharing some tlme to review the CSAH 15 layout wlth members of my
staff and I last Friday.
As we discussed, I am enclosing the letter from Commissioner Braun which grants the
variance from State Ald Standards for CSAH 15 from CSAH 110 (Commerce Boulevard) +~
CSAH 19 (Shadywood Road). It permlts a street width of 44~, with no parking,
Instead of the requlred 52~; except that 52~ shall be provided between Willshlre
and Commerce Boulevards.
As we explained on Friday, the resolution (J84-179) passed on October 23, 1984 by
the Mound Clty Council approves a preliminary layout showing a 44t roadway width
from approxlmately 300~ east of the post office to Cypress Lane.
My staff assures me that a 52~ roadway can be constructed on the proposed alignment
but to provide the typical sectlon I.e., 52~ roadway with 5~ berms and 5~ sidewalks
on each slde, addltional right of way Is necessary along the south side.
We are currently preparing detail plans for this proJect and want to proceed
without any uncertalntles about our design. Therefore, we are asking for an
assurance from the City of Mound that we can proceed with a 52~ roadway on this
segment of the project without any repercussions.

Dear Mr. Genzlinger:
Upon the advice of a Variance Committee appointed expressly for the purpose of
recommending to me the validity of Hennepin County's request for a variance from
State Aid Rules § 8820.9912, I hereby grant the variance so as to permit a
street width of 44 feet with no parking except that the full 52 feet, with no
parking, shall be provided west of Willshire Boulevard to Commerce Boulevard.
The variance is conditional upon receipt of a resolution by the County of
Hennepin that indemnifies, saves and holds harmless the State of Minnesota and
all its agents and employees of and from any and all claims, demands, actions
or causes of actions of any nature or character arising out of or by reason of,
in any manner, the reconstruction of Shoreline Boulevard (CSAH 15) from Commerce
Boulevard in Mound to Shadywood Road in Orono, in any other manner than as a 52'
wide street with no parking when undivided or a 68' wide street with no parking
when a 14 foot median is present in accordance with the Minnesota Rules § 8820.9912
and further agrees to defend at their sole cost and expense any action or proceeding
commenced for the purpose of asserting any claim of whatsoever character arising as
a result of the .granting of this variance.

RESOLUTION APPROVING HENNEPIN COUNTY PRELIMINARY
IMPROVEMENT PLAN FOR CSAH NO. 15
WHEREAS, Hennepin County has presented a preliminary
layout of CSAH 15 improvement reflecting the City Council's
resolution passed on January 24, 1984; and
WHEREAS, the County intends to seek County State Aid
funding for this project, which would require a variance from
State Aid standards from the Minnesota Department of
Transportaion.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Mound, Minnesota, that the preliminary plan for CSAH
15 improvement be hereby approved, and
BE IT FURTHER RESOLVED that the City of Mound concurs
with Hennepin County's request to obtain a variance from the
State Aid standards from the Minnesota Department of

I. Statistics
The police department received 745 calls for service in the month of
September. Of those 745 calls, 29 were part I offenses and 76 were Part
II offenses. ~ ....
The Part I offenses included 1 criminal sexual conduct, 4 burglaries, 20
larcenies. 3 vehicle thefts, and 1 arson.
The part II offenses included 1 child abuse/neglect case, 2 forgery/NSF
check cases, 21 criminal damage to propertY cases, 1 narcotic case, 8
DWI's, 2 simple assaults, 14 domestic assaults, 11 harassing phone call
cases, 5 runaway/incorrigibility cases, disturbing the peace cases
and 3 all other offenses.
There were 9 accidents (1 with injuries), 15 medicals, 137 animal
complaints, and 15 mutual aid calls.
The patrol division issued 289 adUlt citations which included 30 parking
citations, 39 juveniles received Citations. There were 187 warnings
issued.
Adult arrests for the month of September include 2 for larceny, 1 for
vehicle theft, 8 DWI's, 1 for domestic assault, and 2 for disturbing
the peace.
Juvenile arrests for the month of September included 5 for larceny, 9
for property damage, 2 for narcotics, and 1 for liquor laws.
II.
Investigations
Cases investigated for the month of September were 1 child/abuse case, 4
burglaries, 1 internal investigation, 1 check case and 1 arson.
III.
Manpower
The number of days utilizing patrol officers in plain clothes were
increased as was August, due to chief of police out of town and the
investigator assuming his duties. 3 officers were used a total of 9
days in plain clothes. 8 3/4 hours were spent on the Officer Friendly
program between Grandview Middle School and Shirley Hills Elementary.

A total of 60.7 hours of overtime was utilized of which none was assigned.
96 hours of comp time was used by various hours at various times. 54½
hours of comp was accumulated. The acting chief is responsible for most
of the earned comp time.
IV. Trainin8 Time
Off. Grand, who is the firearms/range officer, spent several hours with
the Mound Police Reserve unit.
V. Reserves
The Mound Police Reserves donated 403 hours to the department in the month
September. Most of the time spent by the reserves was with the regular
officers as a ride-along.
The dance held on September 12, 1986, was a large success and neted the
reserve unit approximately $1,500.
The reserve unit will be putting in more time now due to school being in
and the athletic events.
VI. Complaints Sisned
25 formal complaints were issued and signed in September. One for checks,
1 for narcotics, 3 for DWI, 1 for possession of stolen property, 4 for
gross DWI, 3 for aggrivated DWI, 1 for drinking in a city park, 4 for
driving after revocation, 1 for speeding and giving false information to a
police officer, 1 for violation of a motorcycle restriction, 1 for
unauthorized use of telephones, 1 for dog at large (5 counts), 2 for
driving after suspension, and 1 for fleeing an officer.

September Monthly Report
There were two Council Meetings in September, which means agenda
preparation, packets, minutes, resolutions and follow-up items
from each meeting.
The Primary Election was September 9, 1986. Before that election
there are a lot of last minute details that need to be dealt
with. A training session for the election judges was held.
A public accuracy test of the election counting equipment was
done. To do this test 150 ballot cards from each precinct must
be punched so that it appears there were different situations in
voting, i.e. undervotes, overvotes, blank ballots, etc. This all
takes time and there has to be a master sheet for each precinct
showing what the count should be to compare with the machine
count.
In any election the forms from Hennepin County arrive on the
Friday before the election. These forms are then disseminated to
the various supplies:of' each precinct.
We are open for absentee voting on the Saturday before any
election from 1:00 P.M. to 3:00 P.M. and are open until 7:00 P.M.
on the Monday before any election for absentee voting. The
Monday before the Tuesday election is when each precinct must be
set-up (all voting booths and miscellaneous supplies), keys
obtained for the various precincts, and the Precinct Chairpeople
come to pick up their material.
The filings for municipal offices were open from September 9 to
September 23. Two persons filed for the Mayoral position and 4
persons filed for the two Council positions. After the filings
closed the ballot pages were ordered and the paper ballots for
absentee voting. The paper ballots were ready for distribution
on October 3, 1986. This is required by State Statute.

Since the Primary Election all ballot frames were removed from
the machines and are being prepared for the General Election.
The proposed 1987 ~udget £igures were inputted into the computer.
I calculated and completed the 1987 Fire Contract for the
contract cities. The Contracts were then forwarded to those
cities.
Assessment hearing notices were prepared, the tax books checked-
to verify names, addresses, and notices were published and sent
to all the parties concerned regarding the following:

Unpaid Clean-Up Changes
Delinquent Water & Sewer Chargs
Unpaid Capping of Sewer 4ine
Sanitary Sewer & Water Extension

Supplemental Assessments
Resolutions were prepared for all the above assessments~
There were the usual calls from residents with questions and
problems to handle.

GENERAL COMMENT
The Parks Department is now at two personnel on hand, John Taffe and
myself. At this time we are currently putting away equipment used this
summer and preparing the equipment to be used this winter. John will
be leaving in approximately two weeks and will return again next spring.
TREE REMOVAL
We have done trimming of the area west of the Depot building at Mound
Bay Park. The shade from the trees did not allow the cedar roof to dry.
Thus, moss grew on the shakes and the dampness caused this area to need
reroofing. Tree removals are down, complaints have not come in this
month as they have in past months. We may see a balance left in the
budget for removals it this keeps up.
RIP RAPPING
With the monies coming available for rip rapping in 1987, a Master Plan
will be set up to show which areas will be rip rapped over the next
four years. For 1987, we intend to contract out the following:

CEMETERY
With the budgeted monies for tree trimming at the cemetery, this area
will be in excellent shape for 1987. The storage building is completed
and enhances the area.
PARKS
With school back in session, we have seen the vandalism problem dropped.
Over the summer, we had numerous picnic tables abused and the Depot
building got a good amount of graffito. All recreation equipment
will be checked for wear and safety. Repairs will be done next spring
before use begins. The tennis court will have their nets removed and
the doors locked. Kids have used these courts, when the nets are down,
to ride their bikes. The damage comes from skidding their tires on
the court surface, which is painted.
DOCKS
The rip rapping of Ashlund, Surfside, Beachside and Wiota Commons (south
Eagle) has been completed by City crew.

Plan review was completed on 12 building permit applications, Two meetings
were conducted with the architect and sprinkler company for the Toro addition
to the Balboa.facility, Subdivision/plat on Commerce Boulevard required a
meeting with the City Engineer and City Planner.and myself before application
is made to the Planning Commission,
! attended the quarterly Minnegasco Heating Inspectors~ Meeting in Bloomington.
! met with the City Manager to discuss the progress to do repairs on the City
Ha11Is skylights for the W. J. White Company. Scheduling of the skylight repairs
were done in mid-September. I received two apartment complex complaints during
September for 2009 Commerce Boulevard and'2631 Commerce Boulevard. These com-
plaints resulted in researching of property owners~,correspondence and code
compliance reports to be issued on. one of the complexes with the other one
pending an inspection in mid-October.
Significant time was spent at various meetings during September. The regular
Board of Appeals meeting for the Planning Commission handled several cases

of t~aining items. I attended two City Council meetings on the 16th and 30th
of September, a staff meeting was held on the afternoon of the 9th with Depart-
ment meetings following to disseminatethe information to the co-workers..Harge
and I attended a LOGIS.afternoon meeting, in Brooklyn Center. LOGIS met with
various commun|t|es tb. dlscuss the recent development of their build|ng inspec-
tion management program.~ The programm|.ng involved issuing building permits,
computerizing applications, recordi'ng.necessary'planning information on prop-
erties, with various work processing capabi.'iities. The estimated cost Of the
program and a disCusslonwith the Finance Department fo)loved our meeting at
LOGIS. Various inquiries were hand)ed by. our.Department pertaining to zoning,
code requ|rements,..permit procedures, etc..

to have the Public Works stake out.two.grave sltes for burials as well as
several graves staked out for markers '(monuments) and discussed with HcCombs
Knutson updating the cemetery map.

There are three main reasons for the increase for fire
contract. First of all, the calls for service have
increased which increases the cost of operating the fire
department. Second, insurance cost have also increased in the
fire fund. Finally, a rescue vehicle with a cost of $40,O00
is to be purchased next year, Mound's share of the vehicle
is $20,940.
Transfer to Sealcoat Fund (½ of total cost) $26,000
In prior years the transfer to Sealcoat Fund was taken
from Liquor profits. For 1987, the liquor fund profits
are projected to cover ½ of the sealcoat costs. Therefore,
the general fund must pick up the other ½ of the sealcoat
project costs.

PROBATION PERIOD
I passed my probation period of one year on September 16th. The year
went by fast and I found the work to be challenging. I am thankful
for the good work done throughout the year by the Finance Department
Staff. Their experience and abilities helped to make my transition from the
auditing profession to finance director go smoothly. I look forward
to more good years in the future.

September's Monthly Activity Report
The street Dept. didn't get a lot of repair work done on the streets
this month because of the weather. We did finish the manhole and
gate valve repairs. Also the Water Dept. had a water main break on
Co. Rd. llO and two water taps which we blacktopped. We bought
50 ton of blacktop and 222 tons of sandfill in September.
We had the vac-all out for ten days and cleaned 29 sump catch basins.
A sump catch basin is a structure that traps the debris from a storm
sewer before it gets to an open ditch or a lake.
When the weather was bad the Street crew worked in the shop. Tim and
Greg had to rebuild the dumpbody on Unit #15, that's a 1975 2~ ton
dumptruck. They put a new bottom in the dumpbox and rebuilt the tail-
gate.
We sandblasted three dumptruck boxes and painted them, also Unit #13 was
completely reworked and painted. (looks like new)
SIGN DEPARTMENT
We put up 5 No parking signs on Bartlett Blvd. and repaired the guard-
rail on Brighton Blvd. and Co. Rd. 125.

September's Monthly Activity Report
WATER DEPARTMENT
In September we pumped 19,897,O00 gallons of water. There were 5
new accounts for September. Joyce and myself attended the AWWA
Convention in St. Cloud. There were 15 outside readers installed,
33 final readings and 9 meter-outside reader repairs.
We will be sending out meter cards to the customers for the next
3 months to have them read their inside meter. This will enable
us to check and see if the inside meter and outside reader are
reading the same.
SEWER DEPARTMENT
We had i complaint of sewer backing up into a house at 4544 Dorchester.
Damon answered the call and found it to be plugged in the residents
line. We will be cleaning 29 sewer wet wells and filters in October.
This takes approximately 2 weeks.

SEPTEMBER 1986 REPORT
Sales for the month of September were $63,467.00. Down considerably from
last year because of two important factors: the wet weather, and last
year people were stockpiling their liquor supplies because the Federal
Excise Tax rose sharply on distilled spirits, October 1st of 1985.
Liquor alone this month was down 27% from September of last year.
For the first time ever we were open on Labor Day. Sales were not as
good as Memorial Day's sales. However, sales were what they normally
would be for a Monday. We really didn't have an option as to whether to be
open or closed. The other private stores in the area were open so we were
unfortunatel, y forced into it.
With summer over you can noticeably see a sharp drop in the sales of beer
and wine coolers. Now that the colder season is here, wines, cordials,
liqueurs and spirits pick up considerably. White goods such as vodkas,
gins, rums and tequilas slow down, but other packages like canadians,

o£ $797,175 with a cost of goods sold totaling 8601,748,
leaving a gross profit o£ $195,427 or 24.51 percent o£ sales.
The operating expenses were $134,289, so the liquor store had
an operating income of 861,138 . The non-operating revenue,
which includes interest earnings, amounted to 86,196 and
the non-operating expenses totaled $?52, leaving a net
income of $66,582 .

STATE AUDITOR ARNE CARLSON NOTES PROFIT MARGINS DOWN IN 1985 FOR
MUNICIPAL LIQUOR STORES IN MINNESOTA
State Auditor Arne Carlson today said that city liquor profit
margins decreased in 1985 while sales remained constant.
· Liquor store income continues to be squeezed by competitive
market forces," Carlson said. "With profitability declining, cities
are increasingly forced to evaluate liquor store operations." Carlson's
report indicates that ~n 325 cities which operated liquor stores, 47
suffered net losses in 1985.
Ten cities closed their liquor stores in 1985, and thirteen closed
during 1984. In contrast to these cutbacks, 19 stores contributed $100,000
or more to their city's general fund.
"The total sales of city liquor stores were $136.3 million in 1985
compared to $136.1 million in 1984, even though 10 stores were closed,"
Carlson said.
"The survivors among these stores will be those that can compete
successfully with the private sector," Carlson said. He noted some
municipal liquor stores are converting to low-margin "off-sale" only
operations. They are dropping the "on-sale" or liquor-by-the-drink
operation, which has higher operating costs. The 10 stores closed
in 1985 and 13 stores in 1984 were primarily on-sale operations.
Operating expense continued to rise, to 25.9 percent of sales
in 1985 as compared to 25.8 percent in 1984. Net income for all
stores totaled $9.2 million, down Sl.02 million from a year
earlier, and down from $13.9 million in 1981. Contributions of
net income to governmental funds totaled $9.2 million, as compared
to $9.1 million a year earlier.
One-hundred-two stores made no contributions to ~ther municipal
funds in 1985, and seven of those required contributions from
governmental funds.
According to a 1981 law, liquor stores having a net loss in any two of
three consecutive years, or any liquor store not making a contribution to
the city in any two of three consecutive years, must hold a public hear-
ing to decide whether the city shall continue to operate a municipal
liquor store.

Page 5 top of the page following D: The word "placed" has been inserted
instead of the word "integrated" and the entire new phrase shall read "All
aluminum, glass, and can recyclables shall be placed into containers
and not mixed with other forms of solid waste or mixed municipal solid

adopted by the County Board." This rewording does not tie the County to
any one specific technology of intermediate processing but would let
the County specify the details for collection appropriate to processing
technology at that time.

Page 6 Section V-B Subsection 1. Language was changed so that the
MAXIMUM charge that can be levied is a misdemeanor. A lesser and more
appropriate charge can be levied at the discretion of the prosecutor.

ORDINANCE NUMBER THIRTEEN
SOLID ~s. STE SOURCE SEPARATION
FOR HENNEPIN (XDUNTY
An ordinance regulating the separation of recyclable materials from mixed
municipal solid waste by generators, before collection of such materials within
Hennepin County; defining the geographic area and the types of materials subject
to designation; establishing procedures and principles to be followed by the
various municipalities located in Hennepin County in order to reduce the
of solid waste generated in the County and to recover and deliver acceptable
waste generated within the County to a resource recovery facility, as specified
herein; in order to promote the health, w~lfare and safety of the public pursuant
to Laws of Minnesota 1969, Chapter 847, and Minn. Stat. Section 473.801, et. seq.
WHEREAS, the Metropolitan Council, by state statute, has established a
source-separation goal of at least sixteen (16%) percent for Hennepin County~ 'and
WHEREAS, in accordance with Minnesota Statutes, Hennepin County is required
to establish source-separation goals for each city in Hennepin County; and
WrlE~2~, said sixteen (16%) percent source-separation goal is hereby
established for each city in Hennepin County; and
WHEREAS, the County desires to provide financial incentives for cities to
establish source-separate progr~m~ to meet their city's source-separation goals
and contribute toward meeting County source-se, pa.ration goals; and
WHEREAS, the County desires to establish a further inducement to cities to
develop source-separation programs which meet source-separation goals by adopting
a County source-separation ordinance requiring the separation of m/xed municipal
waste by generators, before collection, of materials which can be readily
separated for use or re-use; and
WHEREAS, the County desires to support local source-separation programs by
establishing a facility or facilities to receive, store, process and/or prepare
for sale, reuse, or otherwise dispose of recyclable materials.
The County Board of Hennepin County, Minnesota, does ordain:
SECTION I DEFINITIONS
The following words' ahd phrases, when used in this ordinance, unless the
context clearly indicates otherwise, shall have the meanings ascribed to them in
this section.
Subsection 1 "Aluminum Recyclables" shall be deemed to include all
disposable containers fabricated primarily of aluminum and commonly used for
soda, beer, or other beverages.
Subsection 2 "Can Recyclables" shall be deemed to include ali disposable
containers fabricated primarily of metal or tin.
Subsection 3 "Cities" means statutory and home rule charter cities and
towns authorized to plan under sections 462.351 to 462.364.

Subsection 4 "Collection" means the aggregation of waste from the place at
which it is generated and includes all activities up to the time when the waste
is delivered to a "waste facility".
Subsection 5 "Collector/s" means any person/s who owns, operates or leases
vehlcles for the purposes of collection and transportation of any type of mixed
municipal solid waste, and/or recyclables.
Subsection 6 "Compostible Material" means organic material consisting of
grass clippings, leaves and other forms of organic yard waste.
SUbsection 7 "County Board" is defined as 'the Hennepin County Board Of
Commissioners and their authorized representatives.
Subsection 8 "Department" means the Hennepin County Department of
Environment and Energy.
Subsection 9 "Facility" means any resource recovery facility or related
Transfer Station or similar facility to which waste is required to be delivered.
Subsection 10 ~Carbage" means animal and vegetable wastes resulting from
the handling, preparation, cooking and consumption of food.
Subsection 11 "Generation" means the act or process of producing waste (as
defined in Minn. Stat. Sec. 115A. 03, Subd. 11).<=
Subsection 12 "Generator" means any person who generates waste (as defined
in Minn. Stat. Sec. 115A. 03, Subd. 12).
Subsection 13 "Glass Recyclables" shalI be deemed to include jars, bottles
and containers which are transparent or translucent and primarily used for
packaging and bottling of various matter.
Subsection 14

"Hauler" means a collector or transporter of recyclable

Subsection 16 "Mixed Municipal Solid Waste" means garbage, refuse and other
solid waste from residential, commercial, industrial and co~m-~unity activities
which is generated and collected in aggregate, but does not include auto hulks,
street sweepings, ash, construction debris, mining waste, sludges, tree and
agricultural wastes, tires and other materials collected, processed and disposed
of as separate waste stream-~.
Subsection 17 "Municipality" means any incorporated city within the
boundaries of Hennepin County, Minnesota.
Subsection 18 "Paper Recyclables" shall be deemed to include paper of the
type commonly referred to as newsprint. Expressly excluded, however, are all
magazines or similar periodicals.
Subsection 19 "Person" means any human being, any municipality or other
public agency, any public or private corporation, any partnership, any firm,
association, or other organization, any receiver, trustee, assignee, agent or
other legal representative of any of the foregoing or any other legal enti.ty.
Subsection 20 "Political Subdivision" means any municipal corporation,
governmental subdivision of the state, local government unit, or special
district.
Subsection 21 "Recyclable Materials" means all items of re_*use designated
by the Hennepin County Department of Environment and Energy to be part of an
authorized recycling program and which are intended for transportation,
processing and remanufacturing or reuse. ..
Subsection 22 "Recycling" means the process of collecting and preparing
recyclable materials and reusing the materials in their original fora or using
them in m~nufacturing processes.
Subsection 23

materials from mixed muh/cipal solid waste at. the source of generation.
Subsection 25 "Solid Waste" has the meaning given it in Minn. Stat. Section
116.06, Subdivision 10.
Subsection 26 "Recyclable Materials Processing Facility" means a facility
established and used for the receiving, storage, preparing and/or processing of
recyclablematerials for sale or reuse.
Subsection 27 "Waste Tire" means a pneumatic tire or solid tire for motor
vehicles as defined in Minn. Stat. 169.01. and included in the Solid Waste
Management Plan pursuant toM inn. Stat. 115A.46.
SECTION II GENERAL PROVISI(I~S
Subsection! 'It shall'be the responsibility of each municipality to adopt
an ordinance or ordinances relating to the separation of recyclables within the
boundaries of the municipality, the purpose of said ordinance being to reduce the
amount of solid waste generated within the municipalityby at least 16% which is
an amount established by the Metropolitan Council and adopted by the Hennepin
County Board.
Subsection 2 The implementation and enforcement of said ordinance shall be
the responsibility of each respective municipality. If a municipality should
fail to implement a program by January 1, 1988, or implement a program which
fails to meet the waste reduction percentage established by the Hennepin County
Board, the provisions appearing in Section V of this Ordinance shall come into
effect. This Ordinance shall not prohibit a municipality or municipalities from
entering into agreements relating to any facet of source separation of
recyclables.

SECTX(~N XXX REPORTING REQUX~S
Subsection I Each municipality shall report all information relating to
waste generation, collection an~ disposal within its boundaries to the Hennepin
County Department of Environment and Energy. Such information shall include but
not be limited to; data on tonnage generated in the municipality, data on
recyclable materials generated and collected within the municipality, and such
addltlonal Information as ~s reque-~ted ~y ~he Department of Environment a~d
Energy. Such information shall be provided on an annual basis by or on March 1st
of each year, or as otherwise directed by the Department of Environment and
Energy.
SECTICN IV MI~XCIPAL FAILURE TO HEEr STANXIa/~S ESTABLISHED IN SECTION .Il
If any mUnicipality fails to establish or implement a source-separation
ordinance as provided in SECTION II, or fails to meet the percentage level of
waste reduction as established by the County Board, the County Board may
implement a source-separation program which includes source separation provisions
as provided in section V, within the boundaries of said municipality. If such a
program is implemented it shall be enforced upon all persons residing in said
municipality. This ordinance shall be applicable to all municipalities,
~{ncorporated areas, and political subdivisions within the ~eo~raphical
boundaries of Hennepin County Minnesota.
SECTION V SOURCE SEPARATION PROVISIONS -
~- County Board may ~!e~nt any of the provisions contained in this
secti_~_-with!_-_'the bou~=ie~ of a municipality, if said municipality fails
to meet the requirements est_~b!ished in section II of this ordinance.
Subsection i Pre-collection. All persons who are owners, lessees, and
occupants of any building, c~rcial or residential, within Hennepin County,
which generates mixed municipal solid waste, shall separate from all solid waste
the designated recyclable materials before disposal, removal or collection:
a.)
Paper recyclables, which shall be bundled separately and
secured in such' a manner as' to prevent them from being
blown or scattered, and shall be maintained in a dry
condition free of any other substance and shall not be
placed in plastic bags.
b. ) Aluminum recyclables shall be clean of all contents and
such recyclables shall not be placed in plastic bags.
c.)
Glass recyclables shall be clean of all contents.
Caps, lids and all metal shall be removed prior to
collection and such recyclables shall not be placed
in plastic bags.
d. ) Can recyclables shall be clean of all contents.
Can recyclables shall not be placed in plastic bags.
Ail aluminum, glass and can .recyclables shall be ~ into containers and
not mixed with other forms of sol~d waste or mixed municipal solid waste in a
manner consistent with the rules, regulations and procedures adopted by
County Board.
Subsection 2 Container Requir~nts. Containers shall be provided by all
persons who are owners, lessees, or occupants of any building, c~r~ial or
residential, and shall be:
a.)
maintained in a cle~n m~ sanitar~ condition in accordance
with all pertinent health statutes, ordinances, rules and
regulations;
b.)
located in ~uch a manner so as to prevent them from being
overturned or obstructing pedestrian or motor vehicle
traffic or being in violation of any statute, ordinance,
rule or regulation; and
c. ) free of any holes, gaps or spaces. "
Such further specifications relating to c5n~ainers may be adopted by the
County Board.
Subsection 3 Collection. The collection, removal and disposal of
recyclables shall be supervised by the County Board, which shall have the power
to establish the time, method and routes of service. Special times for large
item pick-up may also be established. Collection provisions shall include but
not be limited to the following:
a. ) Notice of dates and times of collection will be published
or otherwise made available to persons affected herein.
b. ) Collection shall be conducted by licensed collectors or
haulers of recyclables.
c.)
The Department ~a¥ establish drop-off or collection sites
where any person may deposit recyclables at such times and
locations as determined.
d.)
It shall be unlawful for any person other than employees of
the Department, or authorized persons, collectors or haulers
to distribute, collect, remove or dispose of recyclable
materials after said materials have been placed or deposited
for collection.
e.)
Nothing in this Ordinance shall abridge the right of any
person to give or sell their recyclable materials to any
recycling program lawfully operated for profit, non-profit
or charitable purposes.
f.)
Nothing in this Ordinance shall abridge the right of any
authorlze~ recycllng program to lawfully operate within
Hennepln County, subject to such other licensures o= 'other
regulations as may be required by law.
g.)
It shall be unlawful for a person to collect, remove or
dispose of mixed municipal solid waste wh/ch consists of
recyclables combined with other forms of mixed municipal
solid waste.
· Subsection i Misd__~eanor. Any person who fails to con~l.¥ .
wzth the provisions of this ordinance ~ay be charged with a vzolatzon
· not exceeding a misdemeanor and upon conviction shall be punished as
provided by law. A separate offense shall be dee=ed_ ccnmitted upon
each day during or on which a violation occurs or continues.
Subsection 2 Remedies Cumulative. No remedy set forth in
this Ordinance for violation of this Ordinance is intended to be
exclusive of a~y other available remedy or remedies, but each and
every such remedy shall be cumulative and shall be in addition to
every other remedy given under this Ordinance of now or hereafter
existing at law or in equity or by statute. , No delay in the
exercise of any remedy for any violation' of this Ordinance shall
later impair or waive any such right or power of the County.
Subsection 3 Injunctive 'Relief. In the event of a violation
or a threat of violation of this Ordinance, the County may institute
appropriate actions or proceedings including application for
injunctive relief, action to compel perform~_nce or other appropriate
action to prevent, restrain, correct or abate such violations or
threatened violations.
Subsection 4 Costs and Special Assessments.
a).
If a Hauler or any Person within said County collects or
disposes of recyclables in violation of this Ordinance, the
County ~ay take. the necessary steps to correct such violations
and the costs thereof may be recovered in a civil action in
any court of competent jurisdiction and the Property Tax a~
Public Record as a special tax against the real property owned
by such Hauler or Person.
b).
If any municipality, unincorporated area, or political
subdivision within the geographical boundaries of Hennepin
County fails to meet the requirements established in Section II
of this ordinance, the County Board, to the extent that it has
assumed the responsibilities that the local unit has failed to
assume pursuant to Section II, may seek reimbursement in any
court of competent jurisdiction, for all costs, expenses and
expenditures which the County has incurred incident to the
adoption, implementation, administration and enforcement of a
source-separation ordinance within the boundaries of a local unit.

Subsection i Warnings. The Department or any of its duly authorized
represents, tires and collectors and haulers of recyclabies, may issue a warning
notice to any person observed not in compliance with any provision of this
Ordinance.
a.) The warning notice shall be on such form(s) as provided by the
Department.
b. ) Forms shall be provided to collectors and haulers who may issue
such warning notices by placing or attaching them to waste
containers or on the prem~se.$ where the violation occurs. .
c.) A copy of any warning notice as issued by a collector or hauler
shall be forthwith sent to the Department.
Subsection 2 Collection Refusal. A collector or hauler may, upoa
· issuance of a warning ~tice for noncompliance, not accept for collection of
noncomplying waste materials.
Subsection 3 Costs for Compliance. A collector or hauler may, upon
is~,.ance of a warning for noncompliance, undertake to render any noncomplying
recyclables placed for collection to be in compliance and a reasonable fee for
undertaking shall be allowed and reported to 'the. Department. The Department
may certify the fee as' costs to the County Auditor as a special tax to be
assessed against the real property of the person in noncompliance.
Subsection 4 Citations. The Department or any of its duly authorized
representatives shall have the power to issue citations for violations of
this Ordinance, but this shall not permit such representatives to physically
arrest or take into custody any violator except on warrant duly issued.
a. ) Form of Citations: Citations shall contain at least the
following:
{1)
The ~mme and address of the person charged with the
violation or the owner or person in charge of the
premises, at which the violation occurs.
(2) The date and place of the violation.
(3) A short description of the violation followed by the
section of this Ordinance violated.
(4)
The date and place at which the person receiving the
citation shall appear and a notice that if such
person does not respond, aw arrant maybe issued
for such person's arrest.
(5) The hams of the person issuing the citation.
(6) Such other information as the Court may specify.

b)
Issuance of Citations: Whenever any representative of the
Department discovers any violation of this Ordinance, he
may issue a citation to the person alleged to have corn-'
mitred the violation and such citation shall be in the
form specified in paragraph A) of this subsection.
Such citation shall, be made out in quadruplicate (4).
One copy thereof shall be issued to the person alleged
to have committed the violation; one copy shall be
filed with the Department; two copies thereof shall
be filed with the County Ordinance Violation Bureau.
c)
Issuance: The citation sbmll be issued to the person
charged with the violation, or in the case of a
expressly or impliedly authorized to accept such issuance.
d)
Appearance: After the issuance of the citation and
within such time as shall be fixed by court rule, the
person charged with the violation shall report to the
Violations Bureau.
e)
Complaint: ~If the person charged with the violation
does not appear at the Bureau within the time
specified by court rule, the Bureau shall sehd him a
notice directing him to respond to the citation
within seven days of the date of the' notice and if
such person fails to respond, the Bureau shall cause
a complaint to be signed and a warrant to be issued
for the arrest of such person to compel his
appearance in court.
SECTION VI SEPARABILITY
It is hereby declared to be the intention of the County Board tha~ the
several provisions of this ordinance are separable in accordance with the
following:
Subsection i If any court of competent jurisdiction shall adjudge any
provision of this ordinance to be invalid, such judgment shall not
affect any other provision of this ordinance not specifically included in said
judgment.
SECTION VII PROVISIONS AREACCUMUI-~TIVE
The provisions in this Ordinance are accumulative and additional limitations
upon all other laws and ordinances heretofore passed or which may be passed
hereafter, coveringany subject matter in this Ordinance.

Off. John McKinley called this morning and informed me that it was
official that he placed first overall as the National Champion, out
of 119 dogs. He placed second in obedience, 3rd in total attack,
and a member of the first place team.
I talked to Len this morning and he requests tha~ a reception be held
for John upon his return. McKinley will be returning on October 12,
1986, evening hours. I would like to talk to you about this reception.
