Vern Anderson, Mound Retail Association and myself,
scheduled a meeting with the local businesses and
individuals for March 6. We invited 45 people and
19 people attended at 7:30 A.M. in City Hall. Prior
to the meeting each person was sent a copy of the
Lost Lake study prepared by Maxfield Research Group
and was told the desire of the City Council to
obtain input and reaction to the report. A good
discussion was held. General consensus was that
the City does have complete control over the pro-
perty and can dictate the types of uses of the
property. Commercial use was favored over resi-
dential use but whatever the use is, the group
wanted to'be able to tie it into the wetlands
portion of the property. In addition, consensus
seemed to be that if the additional two acres to the
east that are owned by Balboa were made a part of a
development proposal, the project would be signi-
ficantly enhanced. Members in attendance as well
as those who didn't appear at the meeting were
asked to submit comments in writing by March 18 on
what they thought were possible uses for the property.

the Mayor and City Council and myself to the Grand
Opening of his new store. This event is scheduled
for March 18, at 9:00 A.M. at the Coast-to-Coast
Store in Mound. Please mark your calendars.

The City Council of Mound, Hennepin County, Minnesota, met in
regular session on Tuesday, February 24, 1987, at 6:30 P.M. in
the Council Chambers at 5341Maywood Road, in said City.
Those present were: Mayor Steve Smith, Councilmembers Don Abel,
Liz Jensen, Phyllis Jessen and Skip Johnson. Also present were:
City Manager Edward J. Shukle, Jr., City Clerk Fran Clark,.
Finance Director John Norman, Building Official Jan Bertrand,
Fire Chief Don Bryce, Park Director Jim Fackler, Police Chief Len
Harrell, City Attorney Curt Pearson, and the following interested

The City Council interviewed the following persons for an
appointment as Mound's representative to the Lake Minnetonka
Conservation District.

attendance.
SWEARING IN OF NEW COUNCILMEMBER
The Ci. ty Clerk swore in Donald W. Abel as the new Councilmember
to fill the unexpired term of Steve Smith who became Mayor in
January.
L.M.C.D. APPOINTMENT

Police Chief with 2 checks totaling $100.00 to be put toward the
purchase of a bullet proof vest. The Mayor and Police Chief
thanked them for their donation.

The Building Official explained the request and reported that the
Planning Commission has recommended approval with 3 conditlons as
stated in the proposed resolution on Page 373 of the Council
Packet. The applicants, Craig Gustafson and Larry Shaw, were
present. Councilmembers Abel and Johnson recommended that a ~th
condition be added to the resolution, "Prior to commencement of
· business, the underground storage tank being used to store used
oil shall be checked to determine that the tank is in a sound
condition". The Council agreed.

this variance because they felt there was no hardship.
The Council discussed the Building Official's recommendation that
the variance be approved because of the shape of the lot and the
topography of the site. Setbacks were also discussed.

GORDON WOLF COMMONS DOCK PERMIT FOR lq87
Park Director, Jim Fackler, reviewed the problems that have
occurred since 1985 with regard to Gordon Wolf's commons dock
site ~31360. The Park Commission has recommended that the City
Council deny Gordon Wolf's 1987 application for a commons dock.
Abel moved and Johnson seconded the following resolution:

L.M.C.D. INTERVIEt7
The City Council interviewed I~. Gary Birnbaum, 3110 Highland
Blvd. for the position of L.M.C.D. representative from Mound.
Decision to be made on Saturday, February 28, 1987, at 7:00 A.M.
when one more interview will be held.
HENNEPIN COUNTY COMMUNITY HEALTH DEPT. PRESENTATION. GEORGE
George Bowlin, Hennepin County Community Health Dept., did a
slide presentation on the health services available thru Hennepin
County.
The Council thanked Mr. Bowlin for his presentation.
LAKE MINNETONKA REGIONAL PARK PRESENTATION. NElL WEBER. HENNEPIN
COUNTY PARKS
Mr. Neil Weber, Hennepin County Park, stated that a regional park
has been considered for this area for many years. He stressed
that lake access is not a key issue, the park is the key issue,
althpugh with the park would come some additional parking spots
for lake access. This would then take the pressure off the lake
communities to find more parking spots. They are currently
looking at 3 parcels of land with approximately 292 acres.
Preliminary plans would call for 2 accesses, one on Halsteads
Bay' and one on Smithtown Bay. In the Lake Minnetonka Regional
Park budget is also the realignment of County Road 4~.
There was discussion on the following: 1. The lack of use that Carver Park receives and the need
for another Regional Park so close to Carver Park.
2. The tax base that would be lost if a park were put in.
The Council thanked Mr. Weber for his presentation.

DEPARTMENT HEAD ANNUAL REPoRTs
The following Department Heads presented their annual reports to
the City Council: City Clerk Fran Clark, Building Official Jan
Bertrand, and Fire Chief Don Bryce.
PROPOSED L.M.C.D. LEGISLATION~.BOB RASCOP
Bob Rascop, Chairman of the L.M.C.D., reviewed a bill that the
L.M.C.D. would like to see the Legislature pass. This bill deals
with lake usage charges; removal of substandard structures~
docks, boats, or fallen trees within 50 feet of the lake; 2 Metro
Council ideas, one relating to public access sites and another,
the L.M.C.D.'s review and approval of any agency having an impact
on the lake; and compensation for expenses incurred in the
performance of duties as a board member of the L.M.C.D. ·
The Council thanked Mr. Rascop for his presentation.

lq87 MUNICIPAL INSURANCE PROGRAM
Earl Bailey was present and went over the premiums and the
coverage for the 1987 City of Mound insurance program. Property,
crime, equipment, general liability, auto and E.M.T.'s will again
· be covered thru the League of Minnesota Cities Insurance Trust.
Liquor,. Public Official's E & O, Police Professional, Worker's
Compensation and Bonds will be thru private sources. The total
cost for 1987 will be $143,785. In 1986, it was.$1qO,260. The
projected amount for 1987 was budgeted at $189,389.

MINUTES OF SPECIAL CITY COUNCIL MEETING OF FEBRUARY 28, 1987
The meeting was called to order at 7:00 AM, at the city hall. Members
present: Mayor Steve Smith, Phyllis Jessen,. Liz Jensen, Skip Johnson and
Don Abel. Absent: none. Also present: Leonard Kopp and Ed 5hukle,.Ci:ty
Manager.
MaYor Smith asked Mr. Kopp to make an opening statement why he wanted to
be considered ~or the position on the LMCD. Following the interview .with
Mr. Kopp, the Council discussed the appointment. It was moved by Don Abel,
seconded by Liz Jensen to appoint Tom Reese to serve on the LMCD from the
City of Hound. It was then moved by Skip Johnson, seconded by Mayor Smith
to amend the motion to 'appoint Tom Reese contingent upon him stepping down
from the Planning Commission. The vote was then taken on the amendment.
The following were in favor: Johnson, Smith, Abel and Jensen. Nayes:
Jessen. The vote was then taken on the orlglnal motion. The vote was
unanimously in favor. Mayor Smith then called Tom Reese. Mr. Reese then
indicated he would let Mr. Smith know by Sunday evening, whether or not
he would accept the appointment. It was then moved by Phyllis Jessen,
seconded by Don Abel and carried unanimously to appoint Leonard Kopp as
alternate representative if Mr. Reese declined.
The LMCD legislation issue was briefly discussed.

RESOLUTION AUTHORIZING A CONDITIONAL USE PERMIT FOR THE
ESTABLISHMENT OF A PLANNED DEVELOPMENT AREA (PDA), APPROVAL OF
VARIANCES AND APPROVAL OF A PRELIMINARY PLAT FOR THE MORSE ADDITION,
PID NO. 13 117 24 23 0006.
WHEREAS, the City Council held a public hearing on March 10, 1987,
pursuant to the Mound Code of Ordinances to consider the issuance of a
conditional use permit to establish a Planned Development Area to allow
development of b~o new single family homes, two twin homes (4 maits) and create
a new lot area for an existing residential structure. The hearing also
considered two lot width variances and the preliminary plat; and
WHEREAS, the subject property meets the criteria for the establishment of
a Planned Development Area as stated in Section 23.411' of the Mound Code of
Ordinances; and
WHEREAS, the proposed uses are allowable under the Planned Development
Area; and
WHEREAS, the applicant, has applied for lot width variances of 52.5 feet
for Lots 2 and 3, Block 3; and
WHEREAS, The proposed variances satisfy the criteria for granting
variances as stated in Section 23.506.1 of the Code of Ordinances; and
WHEREAS, the preliminary plat is generally consistent with the Mound

PROPOSAL: The applicant is requesting approval of a conditional use permit to
establish a 5.~a~ Planned Development Area (PDA). The PDA will include an
existing residenoe, two new single detached structures amd two twin homes (four
units) for a total of .seven housing units. The entire parcel is zoned R-1 which
requires a 10,000 square foot .lot size or equivalent density.
The PDA allows for mixed types of housing providing that they comply with the
density standards of the underlying zoning district. Each of the major
components, of the POA (twin homes, existing house, n~ single family homes) will
be reviewed separately.
The northern boundary of the proposed PDA abuts land zoned B-2. In this area
which is shown asOu~ot Ben the proposed plat, two twin home structures are
being proposed. The total area of Outlot B is 40,460 square feet which equates
to 10,115 square feet per unit. Ail four units will be served by a common
driveway similar to the one in existsnceat the PortHarrison Townhomes. The
proposed twin home units will comply with the provisions of the Mound Zoning
Code.
The existing residence in the center of the PDA will remain in its present form.
The house is served by a looped driveway with one enhance point along Commerce
Boulevard. There is no planned drivewsy cor~ction between the existing l--~me
ar~ any of the proposed units.
The southern end of the planned development area contains two proposed
single-family home sites. Access for both of the proposed lots is from Sherwood
Drive which ig a cul-de-gac located ~outh of the applicant'g g~oge~y. The
applicant is negotiating with appropriate land owners to secure ownership of a
15-20 foot strip of land as a coonection to the cul-de-sac. Because both of the
lots are provided access by this strip of lar~, they do not meet the lot width .
requirement of 60 feet at the building setback line thereby requiring variances.
Depending oo the final configuration of the entrance area, the variances may .be
as substantial as 50 feet.
The remainder of the property (69,100 square feet) is shown as an outlot for
comn~n use. The applicant indicated that the out/or area may contain a walking
path and common boat docks for each of the housing units.
~: Approval of the planned development area is a reasonable method of
developing the subject land parcel. The inclusicn of the two twin homes on the
north side provides a good buffer between the B-2 commercial land and the
existing single-family uses to the south. Lots 2 and 3 lie in a remnant parcel
which is difficult to serve with city streets. Due to the unusual shape of the
parcel and the surrounding topography, the proposed variance complies with the
criteria for granting variances as stated in the Mound Zoning Code. As a whole,
the parcel represents a positive use of the vacant land while preserving the
existing residential structure.
RECOMMENDATION: Staff recommends approval of the conditional use permit
establishing the Morse Addition as a planned'development area, lot width
variances for Lots 2 and 3 of Block 3 and a preliminary plat of the Morse
Addition subject to the following conditions:
Grading, drainage and utility plans and the access to Sherwood Drive shall
be reviewed and approved by the city engineer.
2. The plans shall be reviewed and approved by the Watershed District.
The driveway location on ~rce Boulevard s~l be ~i~ed ~ approved
by Hennepin County.
4. Lot width variances for Lots 2 and 3 shall not exceed 50 feet.

As requested, we have reviewed the above preliminary plat and have the
foiiowing comments and recommendations. We have reviewed oniy the preliminary
plat application and ieft the variance and conditional use review for the City
Planner to comment on.
Grading and Drainage
We are concerned about how the runoff will be handled from Outlot B.
The natural slope of this portion of the property is to the north,
which will need to be changed somewhat to divert the runoff away from
the existing residence. The easiest method is to install curb and
gutter along the proposed driveway and divert most of the water from
the proposed development directly onto Commerce Boulevard.
At the time of final plat application a more complete grading plan
wii1 be needed showing proposed grading for not oniy Outiot B, but
aiso Lots 2 and ~ and the access to these lots.
Utilities
The proposed sewer and water services as shown for the twin homes on
Outlot B are acceptable with the following exceptions:

A cleanout will be required at the property line on the existing
sewer service at which point the individuai services may be
extended to each unit.
A check vaive wili be required on the sewer service at each unit.
We have suggested to the Owner's Engineer a much more acceptable plan
for extending the sanitary sewer and watermain from the Sherwood Drive
cul-de-sac than the proposed shown on the pian submitted. This wouid
invoive acquiring a utility easement from an adjacent property owner,
so the sanitary sewer and watezinain couid be extended due north f~om
where they presently terminate. This would make it much easier to
separate the services for each iot and for the City to maintain their
portion.
A more detailed of the utilities plan will be necessary at the time of
Final Plat Application.

The Uniform Fire Code requires a minimum access of 20', whereas the
preliminary plat shows only 15' for Lots 2 and 3.
In conclusion, we would recommend approval of the preliminary plat
contingent upon the following conditions:

2. Cleanouts and check valves be installed on the sewer services for the

Our request is for a planned unit development. The development will
consist of three single family residences and two,two family residences.
The one acre parcel to be used for the multi family dwellings
abuts an existing B-2 commercial zone. Therefore we are requesting
a conditional use permit for this parcel to be used for two multi
family homes.
A commons area is being established along the shoreline to be
owned jointly by the seven home owners. This outlot will include
a commons docking area. This is to insure that there is a minimum
impact on the natural habitat of the shoreline and wetlands.
The other part of this request is for a variance to enable
the two single family residences to be set back from Sherwood Drive
further than usual.
We expect to provide the city of Mound with fine quality

. Originally, Sherwood Shores Development was approved and
completed as a quiet Cul de sac area. We, the undersigned, object
to any unreasonable reconstruction of the area.
II.
The Morse Developmentxcurrently has a paved road (A) from
Commerce Boulevard which extends east to a location just short of
the 2 proposed single family dwellings (BI & B2) See Plat.
III.
As an alternative to disruption of the Cul de sac on Sherwood
Drive, the Morse Addition could extend the paved road A to the
~ro~osed dwellings B1 & B2.
IV.
We object to the construction of a road from Sherwood Drive Cul
de sac to the proposed dwellings on the following grounds:
(1). Construction of said driveway would necessarily
result in 3 driveways being situated within the narrow
, confines of 25 feet.
(2). Construction of the proposed road would result in the
loss of trees & foilage, thereby diminishing the esthetic
beauty of the Cul de sac.
(3). During winters of normal or abnormal snowfall, plowing
of three narrowly constructed driveways could cause
serious problems with the abutting three landowners.
(4). Finally, it is likely or even probable that if the
roadway is constructed as proposed, eventually the
roadway will be connected to Commerce Boulevard
from the Morse addition, thereby increasing vehicular
traffic and creating a hazard to small children who
live in the area.

PROPOSAL: The applicant is proposing to split a parcel into t~o lots of 18,200

Tract A as proposed by the applicant contains an existing residence. Proposed

which is irregularly shaped is depicted as a buildable parcel without the

a northeastern direction. Since the garage doors do not face the street, the
accessory building (garage) is in ccmpliance with the setback, requirements.
The proposed plan shows a driveway access for both lots which for~s a common

the following comments and recommendations. We understand that this division
of land wi]_I now be done as a Registered Land Survey (R.L.S.), which should be

An R.L.S. is much the same as a plat with the following exceptions:
Dedication of land for public use such as right-of-way or

is readiiy availabie in an easement across the northeriy position of Tract B,
but it appears water service wouid have to come from the City main iocated in

MISCELLANEOUS
.It has been the City's policy to collect deficient street assessments
resulting from the creation of new buildable parcels. In this case the
property would be deficient one unit charge from the 1979 Street Improvements
in the amount of $1,828.15 which should be assessed against Tract B. The"
existing assessments remaining (footage and area) would be spread between the
two parcels.
The proposed R.L.S. shows a driveway easement over the northwest corner of
Tract A, which we assume is necessaz7 to gain access to the existing garage..
This easement wiii need to be recorded as a separate document.
It appears that the existing legal description for the property describes
to the centerline of Bartlett Boulevard. If this is the case, the~-5 feet used
for right-of-way of Bartlett Boulevard will need to be shown as a separate
tract and then deeded to the City. This item will need to be clarified before
the final R.L.S. is prepared.
In conclusion, we would recommend approval of the preliminary plat
contingent.upon the following conditions:
1. The applicant be responsible for furnishing water service to Tract B.
Arrangements be made to pay one deficient street unit charge in the

The City Engineer reviewed his report and commented that if. the property

PROPOSAL: Case Number 87-610 lies immediately west of the proposed registered
land survey, Case Number 87-609. It is being proposed as a separate approval,
possibly due to a surveying discrepancy that occurs along the common lot line
between the two areas. The city engineer is providing separate comments on the
engineering aspects of this case.
The applicant is proposing to est_~hlish four lots, all of which conform to the
requirements of the Mound Zoning Code. Sizes of the proposed lots are as
follows: Tract A - 10,000 square feet, Tract B - 11,200 square feet, Tract C-
13,200 square feet and Tract D - 12,480 square feet. All of the proposed lots
contain 60 feet of width at the building setback line, have a 30 foot front yard
setback, 10 foot side yard setbacks and observe a 50 foot setback from Lake
Minnetonka.
RECOMMENDATION: Staff recommends approval of the registered land survey dated
January 12, 1987.
As a postscript to this report: the applicant should be aware that lake
frontages shown on the plan are 44 feet for each lot. The Lake Minnetonka
Conservation District requires 50 feet of lake shore frontage ~or each private
dock.

problem of the gap between the two properties be solved before both R.L.S.'s
are finalized.
At this time, we wiSh to emphasize the point that this parcel of unknown
size (probabiy somewhere in the vicinity of iO' wide) should be combined with
one of the two R.L.S.'s, preferably the westerly parcei under consideration as
Case ~87-610. The. foliowing excerpt is fz~mMound's Platting and Subdivision
Reguiations, Section ~'~0.i15, Subd. 8, Lot Remnants. "Ail remnants of lots
below minimum size left over after subdividing of a iarger tract must be added
to adjacent lots, rather than be aliowed toremain as unusable parcels." We
have discussed this situation with Curt Pearson and beIieve you will find he is

The Chairman opened the publlc ~earing. Douglas Dion 'had questiOn about road
and ]and on other side. Coddon owns parcel; however it is contested'parcel;
he noted'that'Vincent Johnson paid taxes on the parcel for 30 years.. The
Chairman closed'the public hearing and the Commission discussed the request.
Meyer stated he didn't think the building lot size that is available above
the 929.4 contours is appropriate'on Tracts A or D; while legal, didn't think
.appropriate for Mound. Reese questioned that applicant will want to be
pu]ling docks for the 44 foot wide lot. Both Hayer and Reese are against
creat'ing bowling a]]ey lots. Coddon stated al1 buildings wi]l be at'least
'20 feet apart; that the aesthetics fit very we1], and.the setbacks and stan-
dards will be met. Meyer would ]ike Commission to do some planning.
Jensen moved and Andersen seconded amotion to recommend approval of the
preliminary plat contingent upon the conditions in Cameron~s report; i.e.
1') Applicant be responsible for furnishing water service to al1 four lots;
2) Arrangements be made to pay 3 deficient street unit charges in the amount

As you requested, we have reviewed the vacation request submitted by ~RW
Properties for a portion of Lynwood Boulevard (platted as Dell Street). There
are actually two separate vacations included in this application. The first
part of the request is for vacation of that part of the original platted
right-of-way of Lynwood Boulevard which is no longer required for street
purposes. This is due to the relocation of a portion of Lynwood Boulevard
during reconstruction last scmmer. The attached plan indicates the proposed
street vacation as parcel 1. We have reviewed the description submitted and
find it to be in order. You will note that the City will be retaining drainage
and utility easements over the entire portion of the vacated street.
The second part of the request covers vacation of a street easement the
City has over the 26 feet northeriy and adjacent to the piatted right-of-way of
Lynwood BouIevard. This easement vacation is covered by two separate iegaI
descriptions. The description for the portion designated as parcei 2 on the
attached pian aiso retains drainage and utiiity easements for the City. This
is necessary because of the sanitary sewer iocation and a Minnegasco gas main.
The second portion of this easement vacation is indicated as parceI 3 on the
attached pIan which does not retain any of the easements for the City.
For your information, we have included a third parcel of p~operty on the
enclosed plan indicated as parcel 4. This small triangular piece of land is a
portion of the Anderson building property which the City no longer has a need
for, therefore, title could be transferred to 3RW Properties. Drainage and
utility easements would also be retained by the City over this entire parcel.
We recommend approval of the street vacation and easement vacation as

The City Engineer, John Cameron, explained that this was the result of tl~e
relocation of LynWood Boulevard and the owner of Commerce Place have reqbested
that the Ci. ty.rellnquish their rights to the portion of the property they do
not need any longer. Parcel 1 is the dedicated right-of-way of Lynwood Boule-
vard (before relocation) and street portion is not needed, but the City.has
numerous· utilities located in there and we need to retain the utility ease-
ments. Parcels 2 and 3 were street easements granted to the City at one.time;
while they are not needed for street, Parcel 2 has a gas main and sanitary
sewer in it and a utility easement should be retained. Parcel 3 is clear and
they recommend all easements be vacated on' Parcel 3.
Beth Andrews stated this land may be occupied With some landscaping, but this
property.was originally comtemplated that the shopping center really occupied ·
everything north of. Lynwood Boulevard realigned.

PROPOSAL: The applicant is proposing to amend the provisions of the Central
Business District (B-I) to allow Class II restaurants as conditional uses.
Class II restaurants are defined as fast-foot, convenience and drive-in
restaurants where a majority of customers order and are served their food at a
counter in packages prepared to leave the premises; or are able to be taken to a
table, counter, automobile or off the premises to be consumed; or a drive-in
where most customers consume their food in an automobile regardless of how it is
served. When the zoning ordinance was amended in 1983, Class II restaurants
were not included in the B-1 zone due to the desire to preserve B-1 land for
more intensive, less automobile oriented commercial uses. Since that time,
additional information has become available which seems to indicate that a
review of this decisioo is appropriate.
Mound presently has a significant area zoned B-1. Although focusing on the Lost
Lake site, the Highest and Best Use Study for the Lost Lake property completed '
by the Maxfield Research Group provided a general overview of future business
activity in Mound. The study generally found that specialty retail, general
retail and office uses were not likely to grow significantly due to a lack of
tmmatisfied demand. In light of this finding, it seems reasonable to review the
downtown area to see if additional restaurant development my be appropriate in
lieu of other coa~ercial ventures.

The nature of fast-food/convenient restaurants also seems to have changed in
recent years. Restaurants have g~ne to an emphasis on take-out food and recent
facilities exclude in-car consumgtion of food. Pizza restaurants such as
Dominos, Gina Maria's (proposed new use), Paul Revere's and other such as Leeann
Chin offer extensive delivery service an(] few if any tables for in-house
consu~pti~. These types of facilities are small in scale and have less traffic
conflicts, [~rticularl¥ if the facility emphasizes delivery services.
~: In light of the changes noted above, it seems reasonable to allow at
least' small scale convenience/fast-food restaurants in the B-1 district. If the .
Planning Oomnissio. agrees with this position, it has two options:
Modify the ordinance to allow Class II restaurants as conditional uses"~n
fha B-! zone; or
If the (k~mission has concerns about large scale fast-food installations fn
the CBD area, it could limit the size of Class II restaurants allowed~ by
conditional use permit to those less than 2,000 square feet in gross floor

Zoning Code to add Class II Restaurants (Fast Food, Convenience and Drive-In)

The City Planner reviewed his report and stated that if this amendment was
not approved, there will be no review of the second case (87-613). He .stated
that since 1983, there'have been some changes and new information that lends
'credence that this amendment should be reviewed. Recent study found that there
did not seem to be a significant demand for office, general or specialty retail.
Fast food business have changed somewhat and take-out restaurants are becoming
very numerous, particularly ones. that offer deli.very services, that it may be
a good idea to see if there is room in the B-1 for certain types of take'out,
Convenience foods, while still a11owlng enough room for future commercial
purposes. It was noted that any' change applies to all the B-1.
Commission questioned where Captain Billy's fits. It is primarily a liquor
set do~n type Of restaurant. Jensen asked Vern Andersen for. his thoughtS on
this ~se:' as he's a downtown businessman. He feels people would welcome any
business; an~ he can see no problem with this. This is close to the Pond
Arena, young people d~nft have to get into cars to get snacE. Weiland
commented that any growth W°uld'put restaurant in another classification
with table area.
The Chairman opened the public hearing and as no one responded, he closed
the public hearing.
The Commission brlefly discussed the options in the staff report.
Ken.-Smith moved and Meyer seconded a motion to recomn~nd staff recommenda-
tion - Option .1 to. the City Council. The vote was unanimously 'in favor.
The City Council will set the public hearing for Hatch 10, 1987.

explained his operation,..that they'have2 other locations,.one in Hlnnetonka
and one in.Eden Prairie.' ~eneralty,.they have about 5 or 6 people working;
total persons employed will be about 20;'they'll be hired locally and range
in age from 18/1~ to 30.. The company has a couple of'vehlcles; delivery
people :provide own vehicles and own insurance, etc.; hours .they are pro-
posing are from 4 to midnight Monday through Thursday; Friday and Saturday
4 to 1A.H.; and Sundays from 3 to 11 P.M. They posslbly might do lunches
from 11 to 1:30 P.M. The'ratio of delivery'to take out is' 40/60. He
questioned If they would be able to have a couple of tables for people to
eat at "on.the run"? He feels:location is good with Con~nunlty Center, Arena,
etc. so close. In response to question on the video games, he stated it was
a food place.first and customers use videos while waiting for food. In re-
sponse to .a question on clean up, he said they were'just as concerned about -
a clean operation., loitering as cranking out a good pizza. They do not want
to be a hangout for kids. They clean |mmediate area and are concerned about
image.
The Chairman opened the public hearing. Hike Hueller and Phil Hasch were
in favor of.the restaurant. The.Chairman then closed the public hearing.
Smith moved and Andersen seconded a motion to recommend acceptlng staff
recommendation with the 3 conditions and approving subject tothemhavlng
the amendment.passed. .The vote was unanimously in favor.
The City Council will set the public hearing for March 10, 1~87.

WHEREAS,' the City Council held a public hearing on March 10, 1987,
pursuant to Section 23.505 of the Mound Zoning Code, to consider the issuance of
a conditional use permit for construction of a multiple family dwelling (2 new
units, 4 existing units) and a side yard setback variance; and
WHEREAS, multiple family dwellings are allowed in the General Business
(B-2) zone by conditional use permit in accordance with Section 23.630.3 of the
Mo~d Zoning Code; and
WHEREAS, the applicant has requested the recognition of an existing 18
foot side yard variance; and
WHEREAS, the propose~ variance satisfies the criteria 'for Granting
variances as stated in Section 23.505.1 of the Mound Zoning Code; and

As proposed, approval of the new addition will require recognition of an
existing variance and approval of a new variance. In cases such as this, the
B-2 zone requirements are applied in the R-4 multi-familyrequirementsare used
as a general guide.
~: The B-2 zone requires a total lot area of 20,000 square feet and 30
foot front, side and rear yard setbacks. The existing four-plex sits 12 feet
from the side lot line requiring recognition of an existing 18 foot variance.
The site plan shows a 24 foot front yard setback requiring a six foot variance.
The applicant has stated that the front yard variance is due to soil conditions.
A review of soil boring information seems to indicate that soil corrections will
be necessary regardless of building placement. The proposed addition has a rear
yard setback of 72 feet.
The ordinance requires 2 1/2 parking spaces for each dwelling ~nit and one of
the spaces must be covered. Based upon six units, 15 spaces are required. The
site plan contains parking spaces abutting the three garages. This can ~e
counted as allowable parking provided that access of maneuvering room is
adequate. Under the proposed configuration, it is possible that a vehicle
'parking in the driveway of the western new unit will block access to the
existing ~arage and approach driveway area.
RECOMMENDATION: The proposed addition constitutes an improvement to the
existing property and removes two existing nonconforming uses. As Uroposed, the
approval will require reixxjnition of the existing 18 foot side yard variance,
approval of a 6 foot front yard variance and the variance from the required
number of parking stalls. Of the proposed variances, the side yard variance and
parking variance seem reasonable considering existing conditions. The front
yard variance, however, does not seem to be necessary and if the building were
moved six feet to the north, parking/driveway circulation would be improved.

ance. He commented that in talking with Hr. Hasch, he thought he could
relocate the building back six feet and make that conformlng.'ln addition
to the 5 conditions listing in his report, Koegler suggested adding # 6.

It is again time to consider programs for the Community Development
Block Grant Program administered by. Hennepin County. This is the
thirteenth year' of the program, hence year XlII.
CDBG. funds may be used to support and implement a wide range of housing
and community development activities. The national objectives of the
CDBG Program are:
1. Developing viable urban communities by providing decent
housing, a suitable living envlornment and expanded economic
opportunitues:principally for low and moderate income persons.
2. Aid in the prevention or elimination of slums or blight.
3. Meet other community development needs having a particular
urgency.
CDBG funds are federal monies, distributed from the Department of HOusing
and Urban Development to urban Hennepin County. We work with a County
representative, Larry Blackstad, who will be present at public hearing
on determining whether or not programs are eligible, assisting us in
developing programs, etc.
For the past two to three years, the City of Hound has been involved with
a continuing program which involves the Westonka Senior Center and its
operation. We have also been involved with the Senior Citizen Counseling
Program and Westonka Rides, which is a primarily Senior utilized bus
program. We participate in funding these programs for Senior Citizens in
the Westonka area with the cities of Orono, Spring Park and Minnetrista.

Mound has chosen to spend a portion of its annual CDBG funds on the Senior
Center Program. We have a]so spent money on economic deve]opment activities
which include a two percent loan program to )ocal businesses to fix up
their faci]ities or strengthen their business, participated in rehabi)it-
ating homes that meet HUD and County criteria for rehabilitation for ]ow
and moderate' income persons, contributed to the local domestic abuse program
in this area and done several neighborhood park improvements with CDBG monies.
Attached you will see several documents relating to the YEAR Xlll program
for your consideration and a resolution recommending approva] of these
programs for YEAR XlII. The following programs are proposed:

I will briefly comment on each of these programs..
Westonka Senior Center/Operation and Senior Citizen Counseling Programs
As I' stated above, these two programs have been in existence for the past
two to three years. The Senior Center itself is located in the Westonka
Community Services Building. Mound's portion goes toward the payment of
· )
the Center Di. rectors salary and fringe benefits. It also covers other
related expenses and a portion of the Westonka Rides dispatch and fringe
costs (see proposed 1988 Senior Center Budget). Representatives of the
Westonka Senior Citizens will be present at the hearing Tuesday to answer
any questions regarding their program that you may.have.
Comprehensive Plan Update
The City of Mound's Comprehensive Plan.was developed several years ago
and has never been updated. The building official and city planner have
remarked to me several times, that the comprehensive plan is an important
document and one that should be kept up to date. It also is required by
the Metropolitan Council under the Land Use Planning Act. This is a very
important program that the staff and planning commission feel needs to be
done.
Economic Development
We have been working with a local flrm on relocating thelr buslness within
the city. There is a possibility that this firm will obtain some other loan
arrangements, but the City will participate with CDBG funds. I am not able
to disclose any other details on this matter at this time.

Rehabilitation of Private Property
This is an annual program that we have that enables low and moderate income
persons meeting HUD criteria for fixing up their homes as they relate to
health and safety standards.
The public h~aring on Tuesday evening, allows interested citizens to voice
their opinions and concerns regarding the use of the CDBG program monies.
The time table for this program'is July 1, 1987 through December 31, 1988.
It is my belief that the above programs are very necessary and'are well worth
the CDBG monies available for their implementation.

Dear Mayor and City Council,
We are submitting our Senior Center budget to be considered
for funding from the 1988 Community Development Block Grant funds.
Our budget sheet is enclosed.
We would like to explain the large overall (21%) increase for
this next year. As you know, our coordinator is subcontracted from
Senior Community Services. The Board of Directors of Senior Commu-
nity Services recently studied salaries of 65 agencies which have
similar senior coordinator positions and discovered their coordi-
nators were receiving salaries in the lower five percentile. Be-
cause they felt the agency should be more equi~able.~ about sala-
ries, they raised the coordinator salary to forty-five percentile
range. This really changed our budget plans. This concern was
expressed at our budget meeting on March 2nd and we understand
that we can expect little or no increase in future years' budgets.
We will be attending the public hearing on Tuesday evening
to make this request and will look forward to answering any ques-
tions that you might have.

The 1980 Mound C~mprehensive Plan will be updated to reflect changes in the
development pattern between 1980 and 1987 and changes in city policy. The plan
should be in conformance with the requirements of the Metropolitan Council.
Task 1 - Review. Goals and Policies
Goals and policies should be reviewed to determine if changes are appropriate.
Upon identification of goals and policies in need of modification, new and/or
modified statements will be drafted for presentation and review by the city.
Task 2 - Inventory and Analysis
The Inventory and Analysis section of the existing plan should be updated 'to
reflect the most recent population, household and employment projections of the
U.S. Census Bureau, Metropolitan Council and other sources. This section should
also include an analysis of land use trends and existing and future major
issues,
Task 3 - Land Use
The land use section of the ~omprehensive Plan should be updated to reflect
recent development, and, current socioeconomic projections by both the city and
the Metropolitan Council. Modifications of the text of the existing plan will
be presented to the Planning Commission and City Council.
Task 4 - Housing
The housing section of the Comprehensive Plan will be edited and modified
consistent with CityandMetropolitan Council projections and applicable goals
for low and moderate income housing and modest cost housing. Suggested map and
Graphics changes will be included.
Task 5 - Recreation
The existing recreation section will be updated to indicate recent park
developments. Suggested modifications will be presented to the Park and
Recreation Commission.
Task 6 - Transportation
The transportation section of the plan will be updated consistent with recent
projects and current plans for the city, state and county. Modifications will
include recent transportation studies completed by all governmental
jurisdictions.
Task 7 - Implementation
Modification of the implementation section will consist of an assessment of
existing ordinances and control measures ag their effectiveness in implementing
the 1987 Mound Comprehensive Plan. General recommendations will be provided to
address identified deficiencies.
The implementation section will also include an update Of the capital
~mprovement program which contains statements of short and long-range
improvements and applicable funding mechanisms.
Task 8 - Shoreland Management Ordinance
A shoreland management ordinance is ho be assembled concurrenh to the
preparation of the Comprehensive Plan. The ordinance should be prepared in
conformance with the requirements of the Minnesota Department of Natural
Resources.

RESOLUTION RESCINDING COUNCIL ACTION OF
FEBRUARY 28, 1987, REGARDING L.M.C.D. APPOINTMENT
WHEREAS, the City Council met in Special Session on
February 28,~ 1987, to appoint a representative to the L.M.C.D.;
and
WHEREAS, the City Council took official action to'
appoint Thomas Reese to serve as the City's L.M.C.D.
representative contingent upon him resigning from the Planning
Commission; and
WHEREAS, Mr. Reese would still like to remain on the'
Planning Commission and also serve as the L.M.C.D.
representative.
NOW, THEREFORE, BE IT RESOLYED that the City Council of
the City of Mound, Minnesota, does agree to rescind its action of
February 28, 1987, regarding the L.M.C.D. appointment;
BE IT FURTHER RESOLVED that the City Council hereby
appoints Thomas Reese as its representative to the L.M.C.D. with
the understanding that he can continue in his position on the
Planning Commission. The L.M.C.D. terms expires September 30,
1988.

AN ORDINANCE AMENDING C~TER IX OF THE CODE OP
ORDINANCES BY ADDING SECTIONS 910:00 THROUGH 910:35,
INCLUSIVE, RELATING TO CONTROLLED SUBSTANCES
The City of Mound Does Ordain:
Chapter IX of the Code of Ordinances is amended to add Sections 910:00, 910:05,
910:10, 910:15, 910:20, 910:25, 910:30, and 910:35 reading as follows:
Section 910 - Controlled Substances
Section 910:00. Controlled Substances. State Statute Incorporated. Controlled
Substance Defined. The five schedules of controlled substances listed in Minnesota
Statutes 1986. Section 152.02, as amended, are hereby incorporated in and made a part of
this Section as completely as if set out herein in full. For the purposes of this Section,
a controlled substance is any substance listed in the five schedules of controlled
substances in Minn. Stat., 1986, Section 152.02.
Section 910:05. Prohibited Acts. It shall be unlawful for any person to manufacture,
possess, constructively possess, sell, give away, barter, exchange, distribute, or
otherwise transfer any controlled substance, except on a lawful prescription by a person
licensed by law to prescribe and administer controlled substances.
Section 910:10. Possession Defined. Possession shall mean having the controlled
substance on one's person or in constructive possession including, but not limited to,
constructive possession by that owner of a motor vehicle or by that driver of a motor
vehicle if the owner is not present who keeps or allows to be kept in the motor vehicle a
controlled substance.
Section 910:15. Excepted Lawful Businesses and Professions. Section 910:05 of this
ordinance shall not apply to the following in the ordinary course of their trade, their
business, or their profession provided, however, this exception shall not be a defense to
the doing of the acts prohibited in Section 910:20 hereof:
Subd. 1. Practitioners, persons licensed by law to prescribe and administer
controlled substances.
Subd. 2. Pharmacists duly registered and licensedwith the Minnesota State Board of
Pharmacy.
Subd. 3. Manufacturers.
Subd. 4. Pharmacists as manufacturers.
Subd. 5. Wholesalers.
Subd. 6. Warehouseperson.
Subd. 7. Persons engaged in transporting such controlled substances as agent or
employee of a practitioner, pharmacist, manufacturer, warehouseperson, wholesaler,
or common carrier.
Subd. 8. Public officers or public employees in the performance of official duties
requiring possession or control of such controlled substances, or persons aiding
such officers or employees in the performance of such duties.
Subd, 9. Any patient as herein defined with respect to procuring, possession, and
use of a controlled substance in accordance with the terms of a prescription and
prescribed treatment.
Subd. 10. Persons who procure, possess, or use such controlled substance for the
purpose of lawful research, teaching, or testing, and not for sale.
Subd. 11. Lawfully licensed and registered hospitals or bona fide institutions
wherein sick or injured persons are cared for and treated, or by bona fide hospitals
for the treatment of animals.
Section 910:20. Unlawful Procuring, Purchase, Delivery or Possession. No person shall
procure, purchase, deliver, or possess, or attempt to procure, purchase, deliver, or
possess, a controlled substance in any of the following manners:
Subd. 1. By fraud, deceit, misrepresentation or subterfuge, or
Subd. 2. By the forgery or alteration of a prescription, or
Subd. 3. By the concealment of a material fact, or
Subd. 4. By the use of a false name' or the giving of a false address, or
Subd. 5. By making a false statement in any prescription, order, report, or record
relative to a controlled substance, or
Subd. 6. By falsely assuming the title of, or falsely representing any person to be a
manufacturer, wholesaler, warehouseperson, pharmacist, practitioner, or other
person described in Section 910:15 hereof, or
Subd. 7. By making, issuing, or uttering any false or forged prescription.
Section 910:25. Confiscation and Disposition of Controlled Substances. Any controlled
substance found in the possession of any person convicted of a violation of this ordinance
shall be confiscated and shall be forfeited to the Chief of Police who shall make proper and
timely disposition thereof by destroying it.
Section 910:30. Use of Original Containers and Labels Required. All patients having
possession of any contr--~lled substance, by lawful prescription of practitioner while such
controlled substance is lawfully in such person's possession, shall keep such controlled
substance in the original container in which it was delivered until used in accordance with
such prescription, and shall not remove the pharmacist's originallabel identifying the
prescription from such original container.
Section 910:35. Possession o__f Injection Implement. No person except dealers in
surgical instruments, apothecaries, physicians, dentists, veterinarians, nurses,
attendants and interns of hospitals, sanitoriums or any other institution in which persons
are treated for disability or disease, shall at any time have or possess any hypodermic
syringe or needle or any instrument adapted for the use of cocaine or narcotic drugs or any
controlled substance defined in Minnesota Statutes 152.02. or as defined in Title 21
United States Code 812 by subcutaneous injections and which is possessed for that purpose.
unless such possession be authorized by the certificate of a physician issued within a
period of one year prior to any time of such possession.

FEBRUARY 1987 MONTHLY REPORT
February is always a short month. Seems like it just starts and
it's over. The City Council held two regular Council Meetings in
February. Preparation for those meetings was done. Then the
usual minutes, resolutions and items that needed to be handled
after the meetings, i.e. contracts, letters, etc.
I spent time preparing my 1986 annual report which was presented
to the City Council on February 24, 1987.
The computer recommendation which was presented to the City
Council on February 10, 1987, was put on the word processor.
There were 2 afternoon meetings with Hennepin County regarding
the new optic scan system. The first meeting was a general
meeting of all the municipalities purchasing the new optec scan
election equipment. Basic information was given at this meeting
regarding who to contact in the county level for what; a copy of
the State Certification for the equipment was given out; an
Implementation Committee Meeting was set. Business Records
Corporation, the manufacturer of the Optec III was present with
samples of all three ballot box styles (steel, aluminum or
portable), a privacy shield for the ballot box, voting booths
aluminum cased, (as we have), blow-molded plastic, and
handicapped. There was also a question and answer session.
The second meeting was the Hennepin County Elections
Coordinating Committee regarding the implementation of the new
system and scheduling who would work on the following:
1. A new election judges training manual.
2. City/County coordination.
3. Policies and procedures that will be followed.
We will be standardizing our work so that the results can be used
anywhere in Minnesota.

The 19 tax forfeit parcels I spoke about in my January report
were all researched by me, maps were made, zoning determined and
all information sent to the City Engineer, Sewer & Water
Superintendent, Street Superintendent, and Park Director for
their comments or suggestions. The Assessing Clerk was given the
list and will be compiling all the special assessments against
these parcels. After I receive all the information, it will be
coordinated and will be on a future agenda with recommendations
for disposition.
Index tabs were needed for each new code book. Linda took on
that job and did it very neatly and efficiently. All the pages
were inserted into the new binders. We did find a couple of
errors (either deleted pages, additional pages that were left
out, or pages that were out of order). They ones found have been
corrected.
As always, a number of residents calling or stopping in with
a variety of questions and problems.

I. STATISTICS
The police department responded to 590 calls for service in the month
of February; up 43 calls from Februaryi986. Calls for Part I offenses
were 26; including 2 criminal sexual conduct, 3 burglaries, 16 larcenies,
4 vehicle thefts, and 1 arson.
Part II offenses accounted for 79 calls; up 38.6% from the same period
last year. Part II offenses included 19 damage to property, 4 abuse/
neglect, 7 forgery/NSF check cases, 4 narcotiCs violations, 13 DWI's,
1 weapons violation, 6 domestics, 4 assaults' and 21 other reported
crimes.
The patrol division issued 240 adult citations, including 48 parking
violations. Juveniles accounted for an additional 18 violations.
A total of 196 warnings were issued for various infractions.
There were 7 adults arrested for felonies and 5 juveniles. Adults
were arrested for 32 misdemeanor crimes and juveniles accounted for
an additional 7 misdemeanor violations.
The department responded to 11 medical emergencies, 10 property damage
accidents, 3 personal injury accidents, and 105 animal complaints.
A total of $25,000.00 in assorted property was stolen in February.
The department recovered propertyvalued at $5,062.00.
II. INVESTIGATION
Several cases in February have demanded a good deal of investigative
time.. Sgt. Hudson and Officer Grand spent in excess of 40 man-hours
investigating a kidnapping situation where a woman from California
was held and abused in Mound. The case also included a young child
whoneeded additional care.
A sexual assault has required an additional 40 to 50 hours and is
still not completed. Sgt. Hudson also investigated 12 separate
abuse/neglect cases in February. These cases necessitated 41 hours
of investigative time. So far, in 1987, the department has investigated
17 abuse/neglect cases; well ahead of the number reported last year.

Sgt. Hudson spent 24 hours at an EMT refresher course during the
month.
III. MANPOWER
Officers used a total of 19 shifts for a variety of time off.
Vacation time accounted for 5 days, comp-time accounted for 3
days, holidays accounted ~or 9 days, and officers missed two days
because of illness. One officer was shifted for plain-clothes for
a period of 9 days in February.
IV. OVERTIME
Approximately 55 hours of overtime were expended in February. The
overtime was necessitated by the week-end investigation of the
kidnapping.case, covering two short shifts for officers who were
ill, holiday-pay for President's Day, and for court appearances
for off-duty officers. Approximately eight hours of overtime
accrued from officerswho got involved with late breaking arrest
situations.
V. TRAINING
Officers attended 60 hours of training and the police secretary
accounted for an additional 8 hours of training. The areas of
training included EMT refresher, narcotics investigation, child
abuse, drug prevention, and intoxilyzer recertificationo
VI. FO~4J%LCOMPLAINTS
Formal complaints were issued for 19 cases involving both felony
and misdemeanor charges. Charges ranged from unauthorized use of
a motor vehicle and forging a perscription to junk vehicles and
dogs at large.

AUDIT
A good portion of my time was spent in preparation for the annual audit.
All year-end adjustments must be made to close out the accounts for 1986.
The final audit report is scheduled to be presented to the council the
second meeting in April. The auditor and myself will be in attendance
at that meeting.

DOCK LICENSES
The deadline for dock licenses applications was the end of February.
There was a large volume of dock applications received the last few
days in February. The projected income for dock licenses is $38,000.
The projected expenses for commons docks is $54,000.

FEBRUARY 1987 REPORT
February was another exceptional month, as far as Februaries go. It is
the shortest month of the year, therefore the slowest. The above average
weather didn't hurt matters at all. There are no major holidays in
February that are of any significance to us. Ground Hog's day, Valentine's
day and Presidentts day are not exactly events that will lead to the
stampeding of our doors. The same holds true for March this year, since
Easter is late. And as far as St. Patrick's day is concerned, well, that
is no blockbuster either.
To date this year, we have had 12,357 customers as compared to 12,150
to date last year. With this good weather, it is easier for people to
get around. Now I am sure March this year will fall far short of March
of last year because Easter fell in March of 86. But, then I am hoping
it will turn completely around for us in April.
I am hiring a new part-time person at the end of the month. Nobody
is leaving, it's just that I am one short for the Easter holiday and
the upcoming warmer weather. I noticed a week ago that the State is
going to raise the minimum wage increments reaching $4.25 by 1989. I
hope there is something that can be done about raising the ceiling on
P.E.R.A. Right how, it is at $3,900 an employee can earn in a year
before the City has to make any contributions. If Municipal Liquor stores
are to continue to survive, something will have to be done about this.
We had some cash register repair service done to our machines at the end
of the month. One of the registers had a problem with a printer that
was skipping a line. They both had faded tapes and needed ribbons and
rollers. The cost was about $100.OO for parts and labor, which really
isn't too bad when you consider we have someone out only twice a year to
work on the machines. It is a good preventive measure that is far less
expensive than signing a service contract~

February's Recycling
February's pickup went very smoothly, only 1 person called to say she
was missed. After the snow had melted some newspaper and other items
were found in the parking lot across from the post office, so these
had to picked up also.
Last Fall the City of Mound and the City of Minnetrista opened a
compost site out at the city garages in Minnetrista. This past week
Hennepin County has been out there shedding up the leaves. This compost
will not be ready for use though until the Fall of 87 or Spring of 88.
It's best if it works for about 18 months. From this point on we should
have compost available all the time. We're still having our 20 loads
of compost hauled in from Hennepin County this Spring to the stock pile.
This Spring we would like to have the compost site open on Saturdays
for~6:to 8 weeks.- Mound has someone there on Saturdays and Minnetrista
takes care of it during the week.
February's pick-up was 15.22 tons.

February's Monthly Report
I. mentioned in my January report that we started to work on cutting brush
and trimming trees, also the removal of d~ad trees from city property.
We have spent about 2% weeks in February on this project, we've spent
most of the time in Island Park. We plan to continue this work as long
as time and weather permits.
STREET SIGN MAINTENANCE
The weather has been so mild this month we have had some time to work on'
signs. We've straightened about 100 posts and replaced 25. We replaced
15 Stop signs, 6 No Parking, 3 No Dumping and 14 street signs.
We posted road restrictions on city streets the 27th. We have received
a number of calls from contractors asking for permits to come in with
heavy loads, we have turned them down.
STREET MATERIALS PURCHASED AND TRANSPORTED
We didn't have much time for hauling material this month because we
were busy with other work, but we did haul 424 tons of buckshot and 63
ton of sandfill. If time permits we plan to haul some washed sand to
the beaches the first part of March.
EQUIPMENT
The Street Dept. received their new pickup truck the 25th, it's a Chevy
3/4 ton, 4 X 4 Diesel, Candy Apple Red (sharp). It's equiped with a
8' Western plow and 3 Tote boxes. It should be in service the first
week of March.
CEMETARY
We staked out 3 graves and 2 stones.

February's Monthy Activity Report
WATER DEPARTMENT
In February we pumped 18,344,000 gallons of water. There were 2 new
accounts, 4 T-off for non-payment, 2 water main breaks and 14 final
readings. This month with the weather being nice we concentrated on
the stuck meter and outside reader list. We also did some early
spring cleaning. As you are aware the annual reports were presented
to the Council this month. Many hours were put into~ these reports.
Hopefully next year's preparation will not take as long as this
years did. The 2 new 4 X 4 pick-ups ~arrived this month. It has taken
1 week to set up each truck. At this time both trucks will be going
back to Bob Ryan Chevy at Buffalo for a few minor repairs. We are still
waiting the arrival of the last truck.
I have met with John Cameron regarding repair and/or replacement of
water mains, gate valves and sewer televising for the County Road 15
project.
SEWER DEPARTMENT
The Sewer Dept. reported no sewer back-ups for February. With the mild
weather we worked on sewer easement and manhole repair. With' the nice
weather we've had it would have been nice to start our sewer line
maintenance, but with no place to store the tanker and jet we will
hold off until the middle or end of April.

February's Monthly Activity Report
This months shop activities included 9 oil changes: 3 for the Police
Dept., 3 for the Street Dept., 2 for the Water & Sewer Dept. and 1
for Administration.
The Building Inspectors car. (Unit #19) required a new exhaust system.
The bulk of shop time this month was spent on the installation of
equipment on the new vehicles such as: running boards, radios, warning
lites, fire extinguishers. Most of this equipment was taken from
existing truck and transferred to the new ones. Steel was purchased
to build trailer hitches for each respective vehicle as each department
has a specific requirement, which means each one has to be individually
built for a specific type of service. Tim Johnson was instrumental
in this part of the operation and he did an outstanding job at a cost
to the city that could not be compared to if the work was done outside
the shop.

During the month of February, the Inspection Department attended two Planning
Commission meetings on February 9th and February 16th, two City Council meetings
on February 10th and February 24th. The Presidents' Holiday, we scheduled the
Planning and Zoning Commission training meeting to co-incide with the schedule
of the City Attorney, Curt Pearson. The following inspections were conducted by
myself during the month of February:
(Site inspections include the review of the Planning Commission requests and
requirements, complaints and follow-ups to code compliance such as, no building
permit, recheck of compliance notice, review status of various sites for the
City Prosecutor.; pre-construction meetings at the site for building permit
applicants or realtors, fire damage and periodic commercial inspection updates.)

The heating inspections during the construction of projects are included under
the framing and final inspections of buildings. The heating installations men-
tioned are for separate equipment being placed in homes and businesses. Several
of the inspections for framing involve framing and insulation of the same struc-
ture.
Monthly reports and the annual report were submitted to the City Manager with
annual report presented to the City Council. The Zoning reports were submitted

to the Planning and Zoning Commission. The staff met with the City Manager
regarding office procedures and I also attended the staff meeting.
Plan review was conducted on 14 single.family homes and additions as well as
the sprinkler system for the State Bank of Mound.. Meetings were held twice with
Paul and Pat Meisel regarding the possible remodeling and addition to the old
Bank Building .on Commerce Boulevard. Stuart Chazin and Greg Gustafson met to
discuss renovation of the old Standard Station.
The North Star Chapter meeting was held in Brooklyn Park with the topics covered
being moisture problems within homes due to inadequate insulation and ventila-
tion, also sound control within buildings.
I attended Court proceedings regarding 4610 Kildare Road. Slides were organized
for a future City Council presentation on exterior storage.
The City vehicle was taken in to the repair garage for muffler replacement.
The usual reports were drafted for Planning Commission, proposed resolutions,
dictation and correspondence, purchase orders for inspection notices, building
codes, etc. and ordering of other sUpplies. Correspondence was mailed out for
code compliance on 13 locations.
I met.with several contractors during February tO bid City Hall sheetrock
repairs. Research of the Grandview apartment history was conducted and corres-
pondence was written to the owner for building refinancing. The last day of
FebruarY was taken 'off from work as a compensation day for me. The City offices
were open for'19 working days. It has'been a very busy month with the mild
weather that we have had during this winter season..The total number of building
permits issued in February was 23 with .a valuation of $837,737. A copy of the
Building Activity Report is attached. The total valuation for the year of 1987
is $1,287,056.
In addition, our Department prepared the monthly calendar'of the March Ci.ty
meetings and events; arranged to have the Public Works stake out a grave site
and check if a particular space in the old section of the' cemetery could be used.

The Commons Dock program and the rip rapping of the shoreline has
occupied the major time this month.
Currently, I am finalizing the contract rip rapping project, sched-
uling materials for the city crew rip rapp areas, aiding in the
supervision of the construction of the vestibule on City Hall, and
checking into the dredging of Jennings Bay and overseeing the Commons
Dock applications.
Also, I have begun to update the Parks Improvement Plan by looking at
the 1982 Five Year Plan. I have currently made a rough draft to give
to the Parks Commission and will do so at the next meeting.
SPECIFIC
Tree Removal
February saw the removal of four trees, all from street right of ways.
These four trees had a combined total of $750.00. This brings the
total expense to date to $6100.
Commons
A lot of progress has been made in rip rapp. I have begun to receive
inquiries from residents about other areas. The rip rapping priority
schedule is based on areas seeing the worst erosion. When the dock
inspector returns for the season, we will have a different schedule
for summer rip rapp. Then in early fall, we will have a schedule for
winter contract rip rapping.

As you may recall, the Delegates at the
last AMM Legislative Policy Adoption
Meeting on November 6, 1986
considered a proposed policy dealing with
Fiscal Disparities and sent it back to
Committee for more work. After several
meetings and many hours of work, the
Committee has developed a revised policy
proposal for your consideration. The new
proposal was approved by the AMM Board
on February 19th. at special meeting.

Delegates and Managers/Administratures. Copies of
the proposed fiscal disparities policy have been
mailed to the Chief Administrative Official only
for distibution to Mayors and Councilmembers.

Background· Based on membership action at the November 6, 1986
meeting to refer Fiscal Disparity (F.D.) Policy back to the Revenue
Committee, a small technical committee was formed by President
Thistle and Chairman Fehst to form a recommendation for Revenue
Committee action·
Committee. The committee, chaired by Nell Peterson, Bloomington,
included Bob Bocwinski, Columbia Heights; Charles Darth, Brooklyn
Park; Barry Johnson, Minnetonka; Gene Van Overbeke, Eagan; and Dick
Asleson, Apple Valley. The committee met three times and was
monitored by John Anderson, Shakopee; Diane Lynch, St. Paul; Larry
Lee, Bloomington; Bill Barnhart Minneapolis, and Jeff Van Wychen,
Minneapolis who also provided computer runs.
Recommendation. The sub committee made recommendations to the
Revenue Committee which met and after some modification has
recommended the attached policy that has been changed as follows:
a. The Committee reached an implied agreement that the program was
intended to narrow the disparity in taxable base rather than rates
which imply mill rate which has variable meanings based on location
and/or local options· Therefore the word BASE replaces RATE in
the bold type policy·
b. The Committee unanimously agreed to eliminate G-5 central
administration based on the fact that Anoka County indicated a desire
to continue administration and there is not evidence that a change is
needed.
c. Specific recommendation for F.D. factors were to modify the
policy on TIF contribution and contribution rate· The contribution
rate to be reduced by 2% per year for 5 years to 30%. Existing pre
1979 TIF value to be held harmless until the existing bonds are paid
with only new value created through issuance of new debt to be
subject to the F.D. contribution.

I-G FISCAL DISPARITIES
G-1 TAX BASE SHARING PROGRAM
The basic premise for the need for a tax base sharing or tax base
redistribution system in this Metropolitan Area, is that much
commercial and industrial (C/I) development occurs based on location
and/or availability of land or particular services. If the seven
county Metropolitan Area were one political and economic unit, such as
the Houston or Omaha areas, the growth of C/I development in any part
would benefit the whole equally and tax base sharing would be
unnecessary. However, in this area with 139 cities plus many townships
and school districts that is not the case. Thus, there are many cities
that because they are fully developed with no room for expansion, or
they are located away from the center of activity without appropriate
services, or have space but are inconvenient from major transportation
facilities cannot attract C/I development. Whereas, others, more
favorably located or serviced cannot keep C/I development away. This
creates a situation, in general, where the tax base value per area,
per household, or per capita is higher, and the taxing ability of the
governmental unit greater, allowing a lower tax rate or collection of
more dollars to provide service. This, also, creates a situation where
two identical C/I facilities could have a large disparity in their
property tax rates.
THE AMM SUPPORTS A PROGRAM OR PROGRAMS WHICH CONSTRAIN TAX BASE
DISPARITIES IN THE METROPOLITAN REGION WITHIN A REASONABLE RANGE
WITHOUT STIFLING LOCAL INITIATIVES OR UNIQUE COMMUNITY NEEDS.
G-2 OPPOSE DRASTIC CHANGE
To compensate for these disparities, the 1971 legislature passed the
Fiscal Disparities Act, with a rather complicated formula, whereby 40%
of all C/I development and inflation growth from 1971 on is contributed
to a Metropolitan Pot and redistributed based on population and fiscal
capacity. After 15 years of operation, the magnitude of distribution
values both in terms of net value decrease and net value increase is
significant for many cities. If fiscal disparities were repealed in
total with no replacement or adjustments, property taxes in many cities
would increase very significantly just as they would decrease in
others.
BECAUSE THE MAGNITUDE OF FISCAL DISPARITY DISTRIBUTION IN TERMS OF
NET VALUE INCREASE AND DECREASE TO MANY CITIES IS SIGNIFICANT, THE
AMM SUGGESTS THAT NO CHANGES BE MADE THAT WOULD CAUSE DRASTIC SINGLE
YEAR SHIFTS IN PROPERTY TAXES.
G-3 FORMULA MODIFICATIONS
The Association of Metropolitan Municipalities has spent two years of
committee work studying the fiscal disparities formula and the affects
of various modificications to that formula. There are basically two
major policy issues that need to be dealt with in a package to
accommodate the majority of cities. The first is a fairness or equity
question that deals with issues such as the 1971 Base value exemption,
equalization of the contribution, minimum distribution, etc. The
second policy issue is the rate of contribution. The AMM feels that
40% is too great especially if the base against which it is applied is
expended. Each. variable factor has a major impact on a certain subset
of cities and thus changes must be done carefully.
THE AMM MEMBERSHIP SUPPORTS MODIFICATION OF THE FISCAL DISPARITIES
~FORMULA THROUGH INCLUSION OF SEVERAL FACTORS AS A ~WHOLE. ANY CHANGES
OTHER THAN THOSE REFERENCED IN-AMM GENERAL FISCAL DISPARITIES POLICIES
OR SPECIFIED HEREIN OR ANY DELETION OR SIGNIFICANT MODIFICATION OF A
SPECIFIC FACTOR LISTED -HEREIN WILL RESULT IN THE AMM OPPOSING ANY
FISCAL DISPARTIY LEGISLATION UNLESS OTHERWISE AUTHORIZED BY THE BOARD
OF DIRECTORS.
FORMULA FACTORS:
-PHASE IN ~971 BASE VALUE AT 5% PER YEAR FOR 20 YEARS FOR CONTRIBUTION
PURPOSES. THE BASE VALUE FOR SOUTH ST. PAUL SHOULD BE THE CURRENT
VALUE.
-EXEMPT ALL VACANT LAND FROM CONTRIBUTION.
-CONTRIBUTION VALUES SHOULD
PREVIOUS YEARS RATIO BY
GREATER.
BE EQUALIZED TO 85% BY INCREASING THE
UP TO 3% OR THE CURRENT RATIO WHICHEVER IS
-THE SALES RATIO FACTOR SHOULD BE BASED ON A SAMPLE WHICH IS
STATISTICALLY SOUND TO REFLECT ACCURATELY THE REALISTIC LEVEL OF
ASSESSMENT. THIS MAY INCLUDE USING A COUNTY WIDE AVERAGE IF AN
APPROPRIATE NUMBER OF SALES HAS NOT OCCURRED LOCALLY. USE OF THE
MEDIAN RATHER THAN AGGREGATRE RATIO SHOULD BE ADOPTED SINCE THIS
MEASURE IS OENERALLY MORE REFLECTIVE OF LOCAL ASSESSING PRACTICES AND
IS LESS SUBJECT TO WIDE VARIATIONS OF SALES.
-REDUCE THE CONTRIBUTION RATE BY 2% PER YEAR FOR 5 YEARS UNTIL 30% HAS
BEEN REACHED. ALL CONTRIBUTIONS THEREAFTER WILL BE AT THE RATE OF 30%.
-THE FISCAL CAPACITY FACTOR SHOULD
MANUFACTURED HOUSING AND UTILITY VALUE.
BE MODIFIED TO INCLUDE
-THE POPULATION AND TIMES TWO MULTIPLIER SHOULD BE REMOVED FROM THE
DISTRIBUTION FORMULA AS MINIMUM DISTRIBUTION FACTORS.
-THE TWO DIFFERENT POPULATION
MARKET VALUE AND DISTRIBUTION
WITHIN THE FORMULA.
YEARS USED TO CALCULATE THE PER CAPITA
SHOULD REMAIN AS THEY ARE CURRENTLY
-EXISTING VALUE IN PRE 1979 TIF DISTRICTS SHOULD REMAIN EXEMPT FROM
FISCAL DISPARITY CONTRIBUTION UNTIL EXISTING DEBT HAS BEEN RETIRED.
NEW VALUE CREATED WITHIN THESE DISTRICTS IN CONJUNCTION WITH NEW DEBT
ISSUED SHALL BE SUBJECT TO FISCAL DISPARITIES CONTRIBUTION.
G-~ TOTAL DISTRIBUTION
There has been some suggestions made to utilize the fiscal disparity
formula as a mechanism to create a separate transportation or
development fund by only distributing 90% of the tax dollars raised.
This would be a hidden property tax.

This letter is to inform you that we are adding KTMA,
Channel 23 to our channel line up as a result of the
overwhelming number of requests we have received.
Channel 23 will temporarily be placed on Channel 32.
Originally Channel 32 was Dow Jones; however, that
service no longer exists. It was taken over by AP/TMS,
an alpha/numeric news service. Based on a recent
subscriber poll less than 3% of those surveyed even knew
what the service was and fewer claimed to view it. Keep
in mind that we do carry the Financial News Network on
Channel 34.
Channel 23 will appear on its properly designated channel
as soon as the necessary equipment arrives~
We are currently doing a complete market survey of our
entire Lake Area subscriber base. It is our intention
to seek suggestions, comments and criticisms so that
we can respond by making changes to improve our service.

On Monday, March 9, 1987, the Metropolitan Parks and Open Space Commission
will be briefed by Suburban Hennepin Regional Park District staff about the
Feasibility Report and Acquisition Master Plan for Lake Minnetonka Reqional
Park. Council park planning staff expects that a staff comment and recom-
mendation for action will be presented to the commission at its following
regular meeting on March 23, 1987.
The March 9 briefing is tentatively scheduled for 4:30 p.m. in the Metropolitan
Council Chambers at 300 Metro Square Bldg. in St. Paul. The briefing will be
followed by Metropolitan Parks and Open Space Commission discussion and an
opportunity for other interested persons to comment to the commission. Copies
of the plan will be available at the meeting.
