regarding federal and state reimbursement for damage
to public property caused by the July 23rd storm.
We will receive reimbursement for 90% of the costs
associated with the public damage. John Norman,
Len Harrell, Geno Hoff, Greg Skinner, Jim Fackler
and Don Bryce deserve a great deal of credit for
compiling the data necessary in a very short period
of time. They kept excellent records and were able
to organize it quickly for the Federal Emergency
Management Agency (FEMA). It was a job well done

The City Council of Mound, Hennepin County, Minnesota, met in
regular session on Tuesday, August 25, 1987, at 7:30 P.M. in the
Council Chambers at 5341 Maywood Road, in said City.
Those present were: Mayor Steve Smith, Councilmembers Don Abel,
Liz Jensen, Phyllis Jessen and Skip Johnson. Also present were:
City Manager Edward J. Shukle, Jr., City Clerk Fran Clark, City
Attorney Jim Larson, City Planner Mark Koegler and the following
interested citizens: Jim Thompson, Rod Lund, Rollie Mattson, Tom
Albert, Mike Delmore, Todd Truax, Terry Selle,' julie Niccum, and
Tom Reese.
The Mayor opened the meeting and welcomed the people in atten-
dance.

The City Manager explained the request that was presented to the
Park Commission was to allow a 12 foot deck on the Commons and to
construct retaining walls. The Park Commission did not approve
the deck but is recommending approval of the retaining walls,
with the Building Inspector's/Engineer's approval of the con-
structio~ plans.
MOTION made by Jessen, seconded by Jensen to concur with the
Park Commission's recommendations denying the request for a
12 foot deck on the Commons, but approving the construction
of retaining walls with the Building Inspector's/Engineer's
approval of the construction plans for property abutting
Devon Commons, described as Lot 14, Block 14, Devon. The
vote was unanimously in favor. Motion carried.

ments as stated above. The vote was 4 in favor. Councilmember

The City Hanager presented the schedule of meetings regarding the
proposed Public works facility referendum.
There'was discussion by the Council on flip'flopping the proposed
new addition to the Riley Building.
HOTION by Abel, seconded by Smith authorizing the the spend~

flopping the new addition to the Riley Building and setting
a meeting for Saturday, August Z9, 1987, at 7:00 A.M. to

HINUTES - HOUND CITY COUNCIL - AUGUST 29, 1987
The City Council of Mound, Nennepin County, Minnesota, met in
special session on Saturday, August 29, 1987, at 7:00 A.M. in the
Council Chambers at 5341 Maywood Road, in said City.
Those present were: Mayor Steve Smith, Councilmembers Don Abel,
Liz Jensen, Phyllis Jessen and Skip Johnson. Also present were:
City Clerk Fran Clark, City Engineer John Cameron.
The Mayor opened the me6ting.
The purpose of this meeting was to receive a report from the City
Engineer on the feasibility of filp-flopping the new addition to
the Riley Building. The City Engineer explained that .if thi.s is
done there would be an 900 square foot gain and the cost would be
$66,500. The additional costs would come from having to move the
wash bay to another area and having additional outside walls.
There was Council discussion.on the report.
HOTION made 'by Smith, seconded by Abel to approve making the
necessary changes to make the new addition to the Riley
Building face the east instead of the west. The vote was
unanimously in favor. Hotion carried.
The Council 'discussed the extra cost and decided not to change
the maximum amount of the referendum from $790,000.
The Council then reviewed the Fact Sheet for the referendum and
made revisions. They then instructed the City Clerk to prepare
the revised Fact Sheet and get it ready for printing and a mail-
ing to all registered voters in the' City.
Councilmember Jessen was excused.
HOTION made by Abel, seconded by Johnson to adjourn at 9:30
A.M. The vote was unanimously in favor. Motion carried.

MOUND ADVISORY PARK COMMISSION MEETING
AUGUST 13, 1987
Present were: Chair Nancy Clough; Commissioners Shirley Andersen, Cathy Bailey,
Cheryl Burns, Marilyn Byrnes, Andy Gearhart(1E), Linda Panetta and Lowell Swanson;
City Manager Ed Shukle; Park Director Jim Fackler and Secretary Marge Stutsman.
Council Representative Phyllis Jessen and Commissioner Delores Maas(1E). were. absent
and excused. Also present were the following interested persons: Bernard Lister,
Jayne Hetchler.and Rick Riley of Berg & Associates.
MINUTES
The minutes of the Park Commission meeting of July 9, 1987 were presented for con-
sideration. Burns moved and Byrnes seconded a motion to accept the minutes of the
July 9th Park Commission meeting as presented. The.vote was unanimously in favor.
REQUEST FOR PURCHASE OF ALL OR PART OF LOTS 21 AND 5~ BLOCK 28, SETON
Bernard Lister., 2721 Tyrone Lane was present and stated he presently owns Lots 6
and 20 (driveWay for his property) of Block 28, Seton and Lots 1-3 and 10-12 inclu-
sive, Block 29, Seton including adjoining. I/2 of vacated Ashbourne Road; he's trying
to annex all or part of Lots 21 and 5 to make a building site. .Of Lots 6 and 20,
only abOut 12 feet is presently Used for the driveway .and the rest (28 feet) would
be added to the 40 feet width of Lots 21 and 5 and hop.~fully that would give him
enough land to do something With. He commented,.when ~ewer and water came through,
he was assessed on the basis of 3 building sit'es-and under the present zoning code,
he does not have enough street frontage .for even two building sites. He wants to
acquire, enough 'land to build another house on ~Tyr°ne Lane.
The Park Director explained these parcels. (Lots 21, 5 and part of 22 and 4) adjoin
Tyrone Park and are tax forfeit land; it is-a'wooded area. It was noted there is
a drainage ditch between the lots and the park. (A minimum of 40 feet on'a public
right-of-way is required for'a buildable site.)
The Commission discussed the request at length. The Commission took no action.
Commissioner Bailey stated her reason for not making a recommendation was she does-
n't wish to give up park land--feels it would set a precedent and there should be
a hardship shown such as someone needing access to house, etc. Most of the Commis-
sion concurred that they did'not wish to.have land adjacent to a park sold because
in the future, it would be hard to get it back.if park were to be enlarged.
Mr. Lister questioned if there would be back taxes or as.sessments as this would
affect his-decision if the Council approved releasing the land. He stated the land
south of the drainage ditch blended with his land. Also he asked if this could be
referred to .the Council on September 8, 1987 rather than on August 25, 1987.
MAINTENANCE PERMIT REQUESTS
Request for scul'p~ure/or bench done on damaged Cottonwood tree on Commons; applicants
were not present.
The Park Director reported that the winds from the big storm took the top off the
Cottonwood and he had a contractor out to remove it and Jacquelyn Head asked if
there was a possibility to make a sculpture out of it and he told her to make a
request, but the only way he would agree to it was if she'd sign a paper stating if
Commission did not agree with it, she would remove the stump as we would have had
done to ground level at her expense.

I contacted.the City of Orono regarding their support of candidates
for the Minnehaha Creek Watershed District. They indicated that
three names have been submitted from the LMCD, whom they are going
to suppor.t. Those persons are a~ follows: David Cochran, 4640
Lynwood Circle, Deephaven; Norman'W. Paurus, 2500 Casco Point Road,
OrOno; Robert T. Brown, 21860 Byron Circle, Greenwood. Here is a
brief description of each:
David Cochran - Was a long time member of the Minnehaha Creek Watershed
District. Served as the mayor of Greenwood for a number of years. He is
also a lakeshore resident. He is currently retired. ApparentlY, Mr.
Cochran was up for appointment for the Watershed District not too long
ago. He was 'not appointed due to the fact that the lake area did not
provide other choices. It is the LMCD's position that Mr. Cochran would
be an excellent choice.
Norman Paurus - He previously served on the Orono City Council for a
number 'of years. Also on the LMCD Board and served as chairman of the
board. He is also a lakeshore resident.
Robert Brown - He was on the LMCD Board since 1972, up until last year.
He served as.an officer on the LMCD. He also is a member of one of the
subcommittees.
I honestly do not know much about'these persons. I would think with
their background and experience, as has been described to me by Frank
Mixa, Executive Director of LMCD, they wou)d make good representatives
to the district and would represent the interest of the Lake Minnetonka
area.

Monthly Report for August, 1987
I. STATISTICS
The police department responded to 727 calls for service in August. There
was another significant increase in Part I offenses for the month. Forty-
eight Part I offenses were reported~inCluding 2 criminal sexual conduct,
10 burglaries, 33 larcenies, 2 vehicle theft, and 1-arson.
Part II crimes accounted for 65 calls for service. There were 5 child
abuse, 18 criminal damage to propert~ 3 forgery/NSF checks, 1 liquor vio-
lation, 4 DWI's, 8 assaults (two domestic assaults), 10 harassment com-
plaints, 5 runaway/incorrigibility, and 11 other offenses.
The patrol division issued 151 adult citations and 12 juvenile citations.
There were 113 warnings isSued during August.
The department arrested 3 juveniles for felony crimes. Thirteen adults were
arrested for misdemeanors and 2 juveniles for misdemeanors.
There were 20 medical emergencies, 5 property damage accidents and 1
personal injury accident. Animal complaints accounted for 98 contacts.
department assisted neighboring departments 23 times in August.
The
Property valued at $18,942 was stolen during the month.
II. INVESTIGATION
one criminal sexual conduct and 7 child protection matters have been inves-
tigated during the month. These investigations have accounted for approx.
75 hours of investigative time. Officer Grand was assigned to assist in
child protection matters for eight shifts during the month.
Additional cases have involved two liquor investigations, a domestic
assault, 5 worthless check/forgery, 2 theft and damage to property, a
possession of stolen property case, and a major burglary of a local business.
The possession of stolen property resulted in the arrest of 3 suspects with
stolen auto parts and accounted for 20 hours of investigative effort. The
business burglary involves the Meyer's K.O. Station and is on-going.
Sgt. Hudson attended a 20 hour annual legislative update during the month.

Formal complaints were issued for 20 cases in August. Some of the cases
issued included assault, fleeing a police officer, gross misdemeanor DWI,
open bottle, no insurance, careless driving, worthless check, and driving
after suspension.
The department has investigated 55 child protection cases through the
month of August.
III. MANPOWER
Officer Todd Limond is continuing in the field training program and it is
hoped that he will be ready to go out on his own in.another month.
Robert Meuwissen has completed his internship with the department and has
recently joined the Mound Reserves.
Officers used 5 sick days, 5 days of vacation, 5 days of comp-time, and
2 holidays during the month. Approximately 71 hours of overtime was used
during the month. A large portion was caused by the use of sick time.
IV. TRAINING
Fourteen days of training was received in August. Ail officers were also
involved in firearms trainin~ during the month. Other training included
civil defense, emergency medical technician, and the annual criminal law
update.
V. POLICE RESERVES
A total of 136 hours were donated by the police reserves during the month.
The bulk of the hours were in community service functions and ride-alongs.
The reserves are currently working hard to prepare for the annual benefit
dance September 11, 1987.
Three new members have been added to the unit, bringing their compliment
to 9 officers.

AUGUST MONTHLY REPORT
The City had 3 special and 2 regular Council Meetings in August with 2 new or-
dinances and 9 resolutions. There was Agenda preparation for each meeting and
items to clear up after each meeting.
Linda"and I have been extremely busy getting ready for the upcoming special
bond election. Judges have been contacted and appointed by the City Couhcil.
They have been assigned to precincts. The training of these judges, as
required by law, will be in September. Training guides and manuals were made
.up and sent to each judge in preparation for the training meeting. Paper bal-
lots were printed and are available at City Hall for absentee voting. We are
required to have ballots available 30 days before an election for absentee
voting.
Inputting the budget into the computer was done. This is a time consuming
project that requires changing the the years that are reported, inserting ac-
tual figures for 1986, projected figures for the end of 1987 and proposed
figures for 1988.
The special assessment hearings will be held in September. These special
assessments are for Central Business District Parking Maintenance, unpaid tree
removal charges, unpaid clean-up charges and delinquent utility bills which
will be p3aced upon.-taxes. In addition to these, there are supplemental
assessments placed upon property which have waivers signed and do not require
a public hearing. Hearing notices were made up and have been submitted to the
newspaper for publication. The mailed notice requires additional information
and this also has been done, with the mailing to take place on September 8th.
The Central Business District Parking Maintenance Assessment is a long and in-
volved formula and this year with the changes i.n the downtown area has become
a nightmare. There will probably be a push in the near future to either aban-
don this program or a change in the formula will be needed.
I have completed a study of fees for licenses and permits that the City
issues. This topic will probably come up during the budget process.

meeting. The topics for this meeting were the upcoming 1990 Census, election
law changes, and the data privacy law.
The usual calls and questions from residents were handled.

SUBJECT: August's Recycling
Starting in August Supercycle, Inco now has contracts with all of
the following cities: Mound, Spring Park, Minnetrista, Tonka Bay,
Greenwood, Shorewood, Woodland, Deephaven and Excelsior. We all
have the same day for pickup, the first Friday of the month° There
were some misses in August, but Supercycle was real good in going
back and picking them up.
In the past Metropolitan Council has reimbursed the City 50¢ per
household and $4.00 per ton of material picked up. Hennepin County
will now be refunding cities this rebate. Hennepin County will
also assist in the purchasing of containers for curbside collection
by providing 80% of the funding o{ $2.00 per container, whichever
is.less. This might be something we would want to look into, I've
had a number of inquiries about them.
August's pickup was 15.43 tons with 347 households participating.

August's Activity Report
In August we pumped 23,001,O00 gallons of water, There were 7 new account~
in August, we had 7 T-off for non-paymeAt, 34 final readings, 10 outside
readers installed and 985 meters read. We sent out 56 letters to customers
that do not have outside readers. These letters are to inform them
of the City Code that all houses are required to have outside readers
installed. At this time a few have called to make appointments. The
State Health Department was out this month for our annual water systems
inspection. I feel it went very well. We should receive their report
in about 2 months. We met with the disaster people to go over the damages
from the storms in July.
SEWER DEPARTMENT
We are still out jetting sewer lines in the Mound Proper area. We are
not as far as I would like to be this year. Our summer help is gone
now so we will only be cleaning 3 days a week. We televised the sewer
line on Shoreline Blvd. for the upcoming road project. Looks like we
will have only 2 digs, other than those 2 digs the rest of the line
looks very good. We had 1 sewer pump sent out for major repairs. There
are 3 more pumps to be pulled for repair that we will repair ourselves.

SUBJECT: August's Activity Report
We had a very busy month starting out with storm sewer problems. At
the end of Kildare Lane in Island P~rk we had a mudslide that covered
the outlet of a 12" storm drain. The bad part is that we couldn't
get a backhoe down the hill to dig it out we dug it out by hand and
after we opened it'up we discovered that the slide crushed the end
of the pipe and bent it back into the bank. We hired a crane with
a clambucket to dig the bank out, Minnetonka Portable Dredging
(Bill Niccum) did the work. It took about 5 hours to open the
ditch enough so we could cut the old culvert off and replace it with
a new 12' section. The ~ost of the machine was $840.00 and $96.00
for the culvert, with the City providing the labor. We also layed
20 tons of rip rap on the side hill to try to prevent this from
happening again.
Our sealcoating has been completed except for the cleanup of the
excess rock. We sealed between 9 and l0 miles of streets and 6
parking lots. The shooting of the oil and laying of the rock was
done by Alllied Blacktop Co. They did the job in 3 days. The
amount of material used 42,519 gallons of oil and 2000 tons of rock.
The repair of retaining walls that were damaged because of the July 23
storm are slowly but surely being repaired. The big one on Island
View Dr. across from Skip's house is finished except for sod, the one
at the corner of Devon and Tuxedo is about half way finished. There
are 3 others that have to be worked on. It looks to me like he is
doing a good job.

GENERAL COMMENT
Like the Other departments, the two storms created alot of work for the
Parks crew. Clean up and repair to parks and commons areas took priority
over'other tasks. We currently have everything in order and when the
Federal funds come in for repair, we will finish up. The damage was
mainly in water run offs over commons s'horeline and beaches, washing
away top soil and sand. 0nly one tree was lost on Brighton Commons, a
48" Cottonwood that cost $660.00 for removal.
Other areas that time has been spent in August have been in budget pre-
paration and dispersing of the CDBG funds for parks equipment and repair.
Currently, we have had the staff cut down to one person on mowing, one
on maintenance and myself. At the peak, we had two staff people in
each of these areas. The person on mowing crew returned to school and
the maintenance man, Bob Johnson, a retiree, who can only make $6000,
topped out pay wise before we could complete the work that needed to be
accomplished. In the 1988 budget, the line item for these workers has
been increased to $8000 each. This will allow for much needed repairs
to be accomplished.
CEMETERY o
The storm caused a number of graves to settle and headstones to sink.
The parks crew has aided the caretaker in filling these sites. The
headstones will be reset as the caretaker has the opportunity.

COMMONS
The LMCD has increased the permit fee they charge to the City and other
docks they oversee. This fee is now determined on boat length per dock,
whereas it was just $10.00 per dock, it will now be on a graduated scale
from $10.00 through $35.00. The 1988 budget will show a double of that
fee; 1987 = $4,000, 1988 = $8000.
The rip rapping for 1987 is just about completed. We have done 1485
linear feet at a cost of $9000 in material. This again is in the budget
for 1988 and a new schedule for contract work and ~ity crew work has
been set up for 1988. We have had alot of compliments 'on this work from
residents.
TREE REMOVAL
August saw eight trees removed from City property at a cost of $1175.
We had one forced removal from a private home of $485. There were four
notices sent out on private hazardous trees for removal.
PARKS
Currently, we are beginning to get the parks and equipment ready for
winter. This is storing all picnic tables, beach equipment and servicing
tractors.
Also, we are installing the equipment purchased through the CDBG funds.
The bench on the corner of Lynwood and County Road 110, was donated
by the Lions and installed by the City crew.

AUGUST REPORT
Sales for the month of August were down considerably from a year ago
in August. This August we had $77,312.00 in sales. Last year in August
we did $82,467. A combination of cooler weather this August, plus one
extra day of business last year in August. The extra day happened to be
a Friday.
Our mid-year inventory is completed and has been analyzed.
Without going into too many boring details, the bottom llne is that
sales were up for the first six months of this year and expenses have
been kept at an absolute minimum so far. Although we have been lucky
that nothing major has had to be repaired. We also had a nice mild
winter in the first part of the year which helped us some. This was
probably not as significant to us than it was to other departments.
Some of the increase in sales is due to the natural cost of goods rising.
The rest of the increase is due, seriously, to the beautiful, hot and
dry spring and early summer we had. If we can do slightly better from
September through December, we should come very close to realizing the
profit we made in 1986.
On a final note. Next time you are in the store, Look Upi Out of
the goodness of his heart, our landlord offered to supply us with brand
spanking new ceiling tiles, at no cost to us, except the time involved in
putting them up. It took myself and two other part time employees the
better p~rt of an entire Sunday (10 hrs) to complete the task. The reason
it took so long was because there was a lot of cutting involved. When the
dust settled Sunday, at 7:00 PM, we had a bright new ceiling and a very
messy floor. A word of caution, if you ever do this type of job yourself,
wear long sleeve shirts.

This list~of inspections does not include the 29 inspections done by the substitute
inspector during my absence.
With the heavy rains hitting the area in late July, there were site inspections due
to damage of occupiQd structures applying for F.E.M.A. assistance.
The monthly report for July was submitted to the City Manager during the month.
Planning Commission reports were submitted to the commissioners. The Planning
Commission referred 8 zoning cases to the City Council for action, which required
one public hearing; they referred one house moving, two minor subdivisions, two
variances, one conditional use permit, one zoning amendment, and Mr. and Mrs. Meisel
withdrew their request for a zoning amendment to allow retail/mail order business
in the Central Business district after Planning Commission action. A report was
submitted to the City Council for the amendment to the zoning code for exterior
storage. A special meeting was called for August 31st to continue discussion
.on exterior.storage with the Planning Commision and the City Council. Interviews
were held with two Planning Commission applicants. A party was held at Bill Meyer's
house on August 24th as a "going-away" potluck supper for Ken Smith.

I referred 4700 Wilshire over to the City Prosecutor for notification warning of
possible legal action. Five citations were issued during the month.
Meetings were held with Contel, Ess, Jim Nordby and~Union 76, etc. to go over blue-
print changes and submitted revisions. I met with Westonka Estate manager to post
an apartment for non-occupancy and talked to the staff at hospital, adult protection,
and the occupants' attorney to assure that the tenant would rece.lve help prior to
returning to Mound'. Discussed several fire code items With the Chief and Fire Mar-
shal. Plan review was conducted on five homes and additions during August.
I attended a staff meeting and a presentation of the new proposal for a public
works facility. I met with the City Manager to discuss the additional staff that
I am proposing for the 1988 budget year. A report was submitted to him with a
breakdown of job duties and a statement of need. I submitted answers to a survey
from the Planning Commission subcommittee for a Housing Maintenance Ordinance. I
attended a Program Planning Committee meeting.of the North Star Chapter of Building
Officials to plan the programs, places, times from the meetings through February,
1988.
The car was in for a bath, oil change, tune-up, and normal tank fills during the
month.
The total number of building permits issued, in August was 37, with a valuation of
$863,622.00. The valuation figures will be submitted in October, as Marge is on
vacation this week.
In addition, our Department prepared the monthly calendar of the September City
meetings and events. Marge arranged appointments for inspections of. building,
plumbing, and substitute building inspectors. Marge prePared the Park Commission
agenda, wrote the mioutes, and typed some of the material.
* Site inspections include the review of the Planning Commission requests
and requirements, complaints and follow,up to code compliance such as, no building
permit, re-check of compliance notice, review status of various sites for the City
Prosecutor, pre-construction meetings at the site for building permit applicants
or realtors, fire damage and periodic co~merclal inspection updates.
** The heating inspections during the construction of project are included
under the framing and final inspections of the building. The heating installations
mentioned are for separate equipment being placed in homes and businesses. Several
of the inspections for framing involved framing and insulation of the same structure.

BUDGET
A majority of my time in August was spent preparing for the 1988
budget. I analyzed the enterprise funds and prepared a rate study for
the Water and Sewer Funds. This is included as part of the budget
process. Ed will introduce this budget to the Council on September 8.
I will be at the Council meeting to assist Ed in answering any questions
the Council may have.
DISASTER RELIEF
The Federal Government declared Hennepin County a disaster area
after the storm that hit us on July 23rd. Therefore, the City is
eligible to receive federal grants for the damage to municipal pro-
perty. All costs and damages had to be documented on the appropriate
forms. The most difficult aspect of filling out the forms was break-
ing down labor and equipment costs by each damage site. The total
damage for the City was approximately $54,~00. The major items in-
cluded the damage to the City owned retaining walls and the City wide
debris .clean up after the storm.
The Federal disaster relief inspectors came to Mound on August 19th.
Geno Hoff, Gre~ Skinner and Jim Fackler took them to the sites that were
damaged in Mound. The inspectors report agreed with a majority of our
claims. They have computerized the Federal Relief Grant Program and
have to send their inspection reports to a central office. We should
find out in a few weeks the amount of reimbursement we will be granted.
COMPUTER UPDATE
We continued work on the finance system for our new computer.
Judy Fisher entered all the vendors into the system for accounts payable.
Gayle Burns entered the July balances into the finance system. We are
now ready to process August activity into the new computer. Our next
scheduled training is for utility billing in September. Also, Len Harrell
plans on starting the police program ENFORS in September.

RE: Lake Level, Flow and Precipitation Summary for July 1987.
Lake levels in Lake Minnetonka continued to decline through the early part of
July. Two rainstorms occurred in July that had significant impact on the lake
level. The first rainfall occurred on July 20 and raised the lake level about 5
inches. The second rainstorm that occurred was very intense and raised the lake
by approximately 11 inches. There was no discharge from the outlet structure
at Grays Bay as a result of this increase in lake level. There was, however
substantial flooding along Minnehaha Creek as a result of the rainstorm. The
Creek flow at the Browndale Dam in Edina has maintained a flow through July with
a substantial increase on July 29, 1987. This is shown by the attached graph,
lake elevations and stream flow summary.
The 30 year average precipitation for July at the National Weather Service
Station in Maple Plain is 4.65 inches. The actual precipitation recorded in
Wayzata for July was 14.12 inches. The attached maps of the' District show the
rainfall distribution for July.

Disaster Relief Award
We have received notice of the Disaster Relief Funding for damage
done to municipal property on July 23, 1987. The total grant
awarded is $42,728, of which $32,047 is the Federal share,~
$6,409 is the State share and $4,272 is the City's share. The
following is a breakdown by area of the grant awarded:
