The City Council of Mound, Hennepin County, Minnesota, met in regular session
on Tuesday, September 22, 1987, at 7:30 P.M. in the Council Chambers at 5341
Maywood Road, in said City.
Those present were: Mayor Steve Smith, Councilmembers Don Abel, Liz Jensen,
Phyllis Jessen and Skip johnson. Also present were: City Manager Edward J..
Shukle, Jr., City Clerk Fran Clark, City Attorney Curt Pearson, City Planner
Mark Koegler, and the following interested citizens: James McGee, Irene
Bazewicz, Gayle Schuffenhauer, Gene Garvais, Brian johnson, Richard Rucinski,
Robert Huffman, Roland McAllister, Thomas Maxwell, Kent Westberg, Neil Weber,
James Dobesh, June Fitz, Bill Macnamee.
The Mayor opened the meeting and welcomed'the people in attendance.

MOTION made by Abel, seconded by Jensen to approve the minutes of the
'September 8, 1987, Regular Meeting, the September 15 and 16, 1987, Spe-
cial Budget. Neetings, as presented. The vote was unanimously in favor.

The Mayor opened.the public hearing. No one responded. The Mayor closed the
public hearing. The City Manager reported that the revised figure is
$1,867.92.

#24-117-24 41 0104, was present and objected to the $375.00 proposed assess~
ment for tree removal. He stated the tree was not on his property. The Coun-
cil looked at pictures submitted by Mr. 'McGee. The M~yor closed the public
hearing.
HOTION made Smith, seconded by ~ohnson to continue this item to the next
meeting, in order to have the Staff study this further and determine
whose tree it is. The vote was unanimously in favor. Motion carriedL

The Mayor. opened the Public hearing. Ms. Irene Bazewicz, 3530 Tuxedo Blvd.,
PID #23-117-24 33 0'011, was present and objected to the $266.43 proposed
assessment against her property. The Cquncil removed Ms. Bazewicz's assess-
ment from the proposed assessment roll and deferred action on it until the
next meeting asking for a Staff report. The Mayor closed the public hearing.

COMMENTS & SUGGESTIONS FROM CITIZENS PRESENT
There were no comments or suggestions from citizens present.
PRELIMINARY DISCUSSION:. LOST LAKE PROPOSAL
The City Manager explained that there was only one proposal received in
response the the Request for Proposals on the Lost Lake property. It was from
Developer, Waterford Development Group, 1nc. and Architect/Planner, Richard
Schwarz/Neil Weber, Inc. Mr. Weber was present. He explained that this
proposal has a concept drawing and that they tried to tailor their proposal to
the Request for Proposals. He further explained that their idea would be for'
the City to turn over the Lost Lake site to the developer at no charge and
that tax increment financing be used for the the development of the channel,
trails and the wetlands. The developer would finance the Country Inn,
restaurant/pub, etc.
The Council discussed the proposal and the approach that-should now be taken.
The City Manager suggested following the procedure as outlined in the RFP and
working out a timetable.
The Council then directed the Staff (City Manager and City Planner) to work
with Mr. Weber and Mr. Bienapfl giving them background and ideas from the
various commissions and working out more specifics. The developer would then
make a formal presentation to the City Council, Park and Planning Commission
on October 27, 1987.

The City Council of Mound, Hennepin County, Minnesota, met in
special session on Wednesday, September 30, 1987, at 7:30 P.M. in
the Council Chambers at 5341 Maywood Road, in said City.
Those present were:
Liz Jensen, Phyllis Jessen and ~Skip Johnson. Also present were:

interest payment on those bonds, the City.needs to levy an addi-
tional $81,030. The levy was set at..$1~335,977 in Resolution
~87-157. This needs to be amended to $1,417,007.

Sgt. Hudson has been attempting to investigate the liquor license application
that was submitted by Joel Turunen for the business Tonka Star. The investi-
gation has been restricted by the lack of cooperation of the principals in
providing needed information. Mr. Turunen has been requested to provide
financial information and information regarding his investment of $95,000.00
in the businesses. As of this date, no documentation has been provided.
The original application fees and pro-rated liquor license fee were paid by
Mark Saliterman and Bill Alexander. According to Mr. Alexander, Mr. Saliterman
has advanced $23,000 to Alexander to assist in re-opening the business for
which Alexander has re-negotiated his lease agreement. The $23,000 will be
repaid through higher square footage costs and has been backed by the fixtures
and equipment currently in the establishment. Mr. Alexander is to be respon-
sible for the lease with Mr. Saliterman for eight years and there is a stipu-
lation that Alexander can not sub-lease mr sell the business without Saliterman's
approval.
Sgt. Hudson's investigation would indicate that the same equipment and fixtures
that Mr. Turunen is claiming as his investment is currently controlled by
Mr. Saliterman through the new lease agreement.
In further investigating, Sgt. Hudson spoke with a Mr. Ernest McNamee at the
business location. Mr. McNamee stated that he was a managing partner under the
name of Mack II, Inc. and that Turunen was only a "silent partner." McNamee
claims that he will be investing $5,000 and will be responsible for the day to
day operations of the establishment.
Hudson became aware of facts regarding health department violations that will
need to be corrected, as well as several outstanding bills with the state and
the city that also need to be satisfied before the business can re-open.
At this time I can not support approval of the liquor license for the Tonka Star.
The investigation has uncovered that there are more principals involved and
additional funds involved that. were not disclosed in the original application.

shall be submitted to the City Clerk within 30 days after such changes are
made. In the case of a corporation, the licensee shall notify the City
Clerk vhen a person not listed in the application acquires an interest which,

of a person pursuant to the provisions of Section 800:10, Subd.' 2.
Subd. 3. Chantes in Corporate Form - Early Termination of License.
.A~.y change of ownership or beneficial interest or sales o£ stock entitled
to be voted at any meeting of the stockholders of a corporation which result
'in.a change in voting control of the corporation by the persons owninE shares
of stock ~herein shall be deemed equivalent to a transfer of the license
issued to such corporation, and any such license shall be revoked and
temtnated 30 days after any such change in ownership or beneficial interest
of shares, unless the Council shall have been notified of such change in
writing and shall have approved thereof.
Subd. 4. Chan~es in Physical Condition of Licensed Premises - Notification
-- Requirements. Proposed enlargement, alteration, or extension of premises
previously licensed Shall be reported to the City Clerk at or before the time
application is made for a building permit for any such change, and the
licensee shall also give such. information as is required by Section 800:10,
Subd. 2.
Subd. 5. Licensee's Responsibility. Every licensee is responsible for
the conduct o£ his or her place of business and the conditions of sobriety
and order in it. The act of any employee on the licensed premises authorized
to sell intoxicating liquor there is deemed the act of the licensee as
~ell, and the licensee shall be liable to all penalties provided by this
Section and the law equally~rlth the employee.
Subd. 6. Inspections. Every licensee shall al.toy any peace officer,

SUBJECT: Side yard setback variance
EXISTING ZONING:. R-2 Single Family Owelllng
PROPOSAL: The applicant, Jack Cook, is requesting a variance to allow an attached
deck with a walkway within zero feet to the slde property line at the west. The
size of the deck on the north is not included with the application.. He is also
requesting to add a second floor on this dwelling as well as a.portlod of the
attached garage which was granted under the previous, variance Resolution # 86-104.
The R-2 Zon).ng District requires a 6. foot side yard, 50 foot lakeshore'Setback,
a 20 foot front yard setbaCk, a lot slze Of 6~'000 square feet, and a 40 foot lot
width. The existing lot is a conforming parcel. .The structure, however, has a
3.7 to 4.1 foot setback to the'west, lot line to the principal structure, and a
zero foot side yard setback to an entryway to the basement level of the home.
The attached garage. Is under construction, at this. time as well as some of the
other repairs to the'dwelling have gone. beyond the scope of the original variance
approval. Hr. Cook, at the present time,' Is under a stop order to cease all modi-
fications to the principal structure. He Is being allowed to continue with the
attached gar.age which was previously approved.
The applicant has constructed.' the deck and walkway at thls time, has added patio
doors and windows, .and beam supports to get' ready to add a second .floor to the
dwelling. The only difficulty, that Hr. Cook has had with this lot has been the
existing dwelling and its close proximity to the west lot line and also to the
right-of-way 'of' Denbigh Road.'
The lot area does meet the requirements for the R-2 Zoning Ordinance provisions
and the east property line setback, as well as the lakeshore setback does comply
with the R-2 District requirements.
RECOHHENDATION: The staff does not. recommend approval of the walkway along the
west property line. However, the recommendatlons that the deck walkway be reduced
to within 30 inches or less from grade within that 3 foot setback could allow steps
down from the patio door which was instal)ed and than proceed along the walkway
and than allow steps to be constructed to the elevated portion of the deck
on lakeside. A similar circumstances happened on 4832 Bedford Road for a Hr. Mark

WHEREAS, there was a state tax deed §iven to the City of Mound
on October 12, 1984, filed October 19, 1984 as document number 1607356; and
WHEREAS, this deed was intended to be a grant of an easement
from the State, which could be interpreted to convey the South 77 feet of
Lot 5,.Block 12, Seton, but from a review of the instrument intended only
to set up a utility easement over the East 15 feet of the South 10 feet of

Originally, I had sent a copy of a proposed Quit Claim Deed from
the City of Mound to K & W Investments, Inc., to Curt Pearson for
review. Unfortunately, in the original' Deed, I left out the
Block and Subdivision.
As per Curt's 'request, I am sending you, direct, a Quit Claim
Deed, which should correctly identify the property with the
exceptions noted.
My understanding is that this will be presented to the City
Council at its meeting on October 13j 1987. The need for the
Deed .is to clear up some confusion that developed as a result of
a prior. Deed.
I underst'and that Curt Pearson sent a copy of the prior Deed to
Mr. Cameron for his review. I am also sending a copy of this
Deedt to John Cameron so that he has it available for that
purpose.
Hopefully, we can get a resolution from the City, authorizing the
Mayor and Manager to execute this Quit Claim Deed and resolve the
potential problem with my client's property (potential gap
between the part reserved by the City, namely the Northerly 3
feet and the description used by the State of Minnesota, from
whom my client purchased title).

Dear Bill:
This will acknowledge receipt of your letter of October 1,
1987. I have reviewed the proposed quit claim deed which you
transmitted and find that it is defective in a couple of ways.
First of all, Lot 5 is conveyed but it does not indicate that
this is in the Seton Addition, so therefore I am sure the docu-
ment would be unrecordable. Second, the City Manager, rather
than the CitY Clerk, is required to sign conveyances in the City's
name. I therefore suggest that a new deed be typed with those
corrections and delivered to Mr. Shukle at City Hall for considera-
tion by the City Council at its meeting on October 13, 1987.
In the meantime, we are sending copies of the deed to Ed and
to John Cameron, the City Engineer. I am asking Mr. Cameron~
to check the description to be sure that the easements being
retained by the City are true and correct with what is in place
and the City's needs in this area. I presume Mr. Cameron will
be in a position to tell us by October 13 if the redrafted quit
claim deed you deliver to City Hall protects the City's interests.
With those protections, I believe the City Council can proceed
to adopt a resolution authorizing the Mayor and Manager to execute
a quit claim deed to K & W Investments, Inc.

I am enclosing herewith a copy of a Title Opinion by Roger Reed
as to Lot 5, except the Northerly 3 feet thereof in Block 12 of
Seton. As you can see, he has raised some questions regarding
this Lot.
It would appear that the City does own the North 3 feet of Lot 5.
As you can see, the tax certificate refers to the South 77 feet
of Lot 5, rather than Lot 5 lying South of the North 3 feet
thereof. There is also a Deed to the City of Mound, which was
intended to be a grant of an easement from the State, dated
.October 19, 1974 and filed as Document No. 1607356, which could
be interpreted to convey the South 77 feet of Lot 5, Block 12,
Seton, but obviously from a review of the instrument intended
only to set up a utility easement over the East 15 feet of the
South 10 feet of Lot 5.
To resolve any questions of ownership and the easements thereon,
I have drafted a Quit Claim Deed running from the City of Mound
to K & W Investments, Inc., the purchaser of this property, from
the State of Minnesota and the prior fee owner, William P. Burton
and wife. K & W Investments purchased the property from the
State of Minnesota on contract and recently received a Deed which
is in its possession, and also has a Deed from the prior fee
owner covering the property.
I would appreciate your reviewing this carefully and if you have
any questions, do not hesitate to contact me. I understand that
this will have to go before the Council, which will be in the
second week of October, and if you feel it is in proper order, we
will recommend that the City execute a Quit Claim Deed to K & W
Investments so that the question of a potential gap between the
property owned by K & W Investments, Inc. and that retained by
the City is resolved.

thereof. There could be a strip of land between this
property and the road preventing access to the road.
Inquiry should be made to be sure that the north 3 feet of

and has access to a public street.

AMENDMENT TO CDBG JOINT COOPERATION AGREEMENT
The accompanying Amendment No. I to the Joint Cooperation Agreement your
community executed with Hennepin County to qualify the Urban Hennepjn County
CDBG program for Fiscal Years 1988, 1989 and 1990 is presented for ratifi-
cation. A sample resolution authorizing the execution of the Amendment is
provided to help expedite the process.
The Amendment became necessary because of additional requirements issued by
HUD in Notice 87-10 {provided previously under separate cover} and just
recently con~nunicated to Rennepin County.
The sections of the Agreement which are amended and the requirement that
each is intended to satisfy are as follows:

THIS AGREEMENT made and entered into by and between the COUNTY OF
HENNEPIN; State of Minnesota, hereinafter referred to as "COUNTY," and the

all program income generation except as derived from activities
with an approved revolving account.
COUNTY will retain ten percent {10%} of all program income
paid to COUNTY to defray administration expenses.
The remaining ninety percent {90%) of the program income paid
to COUNTY shall' be credited to the grant authority of COOPER-
ATING UNIT whose activity generated the program income and
shall be used for fundable and eligible CDBG activities con-
sistent with this Agreement.
COOPERATING UNIT is authorized to retain program income
derived from activities with an approved revolving account
provided such income is used only for eligible activities in
accordance with all COBG requirements as they may apply.
4J COOPERATING UNIT shall maintain appropriate records and make
reports to COUNTY as may be needed to enable COUNTY to monitor
and report to.HUD on the use of any program income.
5. Any program income that is on hand or received subsequent to
the closeout or change in statusof COOPERATING UNIT shall be

The following provisions shall apply to real'property acquired or
improved in whole or in part using CDBG funds.
COOPERATING UNIT shall promptly notify COUNTY of any modification
or change in the use of real property fr.o~, that planned at the time
of acquisition or improvement including disposition.
B. COOPERATING UNIT shall reimburse COUNTY in an amount equal to the
current fair market value (less any portion thereof attributable to
expenditures of non-CDBG funds) of property acquired or improved
with CD~G funds that is sold or transferred for a use which does
not qualify under the CDBG regulations.
C. Program income generated from the disposition or transfer of
property prior to or subsequent to the closeout, change of status
or termination of this Agreement shall be treated as stipulated in
Section VII, paragraph E of this Agreement.
Section IX. METROPOLITAN CITIES, shall be added to the original
contract and shall read:

Any metropolitan city executing this agreement shall defer their
entitlement status and become part of Urban Hennepin County only
under condition that a statutory provision authorizing deferral of
metropolitan city status becomes enacted prior to the official
allocation of the FY 1988 CDBG funds.
Should the statutory provision authorizing deferral of metropolitan
city status not be enacted it will be necessary for Harm,pin County
and any metropolitan city executing this agreement to request HUD
to approve the inclusion of the metropolitan city as a part of
Urban Hennepin County for purposes of planning and implementing a
joint community development and housing assistance program. In
such a case this agreement shall be fully effective.
This .agreement shall be .effective for the same period as the original
agreement.
Except as hereinabove amended, the terms, condition and provision of
said Contract No. 70~ , dated September 15, 1987, shall remain in full
force and effect.
COOPERATING UNIT, having signed this agreement, and the Hennepin
County Board of Commissioners having duly approved this agreement on

THIS AGREEMENT made and entered into by and between the COUNTY OF
HENNEPIN, State of Minnesota, hereinafter referred to as "COUNTY," and the

UNIT," said parties to this Agreement each being governmental units of the
State of Minnesota, and is made pursuant to Minnesota Statutes, Section
471.59;
WITNESSETH;
COOPERATING UNIT and COUNTY agree that it is desirable and in the
interests of their citizens that COUNTY secure Community Development Block
Grant funds as an Urban County within the provisions of the Act as herein
defined and, therefore, in consideration of the mutual covenants and promises
contained in this Agreement, the parties mutually agree to the following
terms and conditions.
I. DEFINITIONS
-The definitions contained in 42 USC 5302 of the Act and 24 CFR Part
570.3 of the Regulations are incorporated herein by reference and made a part
hereof, and the terms defined in this section have. the meanings given them:
A. "The Act" means the Housing and Community Development Act of 1973,
Title I of Public Law 93, 383, as amended by the Housing and Commu-
nity Development Reconciliation Amendments of 1985, 42USC5301ET.SEQ.
B. "Regulations" means the rules and regulations promulgated pursuant
to the Act, including but not limited to 24 CFR Part 570.
C. "HUD" means the United States Department of Housing and Urban Devel-
opment.
D. "Cooperating Unit" means any city or town in Hennepin County which
has entered into a cooperation agreement which is identical to this
Agreement, as well as Hennepin County which is a party to each
Agreement.
E. "Statement of Objectives and Projected Use of Funds" means the docu-
ment bearing that title or similarly required statements or docu-
ments submitted to HUD for authorization to expend the entitlement
'amount and which is developed by the COUNTY in conjunction with
COOPERATING UNITS as part of the Community Development Block Grant
Program.
II. PURPOSE
The purpose of this Agreement is to authorize COUNTY and COOPERATING
UNIT to cooperate in undertaking, or assisting in undertaking, community
renewal and lower income housing activities, specifically urban renewal and
publicly assisted housing and authorizes COUNTY to carry out these and other
eligible activities which will be funded from annual Community Development
Block Grants from Fiscal Years 1988, 1989 and 1990.
III. AGREEMENT
A. The term of this Agreement is for a period commencing on the
effective date of October 1, 1987, and terminating no sooner than
the end of program year sixteen (XVI) covered by the Statement of
Objectives and the Projected Use of Funds for the basic grant amount
authorized by HUD subsequent to the effective date.
B. Notwithstanding any other provision of this Agreement, this Agree-
ment shall be terminated at the end of the three-year program period
during which HUD withdraws its designation of COUNTY as an Urban
County under the Act.
C. This Agreement shall be executed by the appropriate officers of
COOPERATING UNIT and COUNTY pursuant to authority granted them by
their respective governing bodies, and a copy of the authorizing
resolution and executed Agreement shall be filed promptly by the'
COOPERATING UNIT in the office of the Hennepin County Administrator,
and in no event shill the Agreement be filed later than August 28,
1987.
IV. ACTIVITIES
COOPERATING UNIT agrees that awarded grant funds will be used to under-
take and carry out within the terms of this Agreement certain projects
involving one or more of the essential activities eligible for funding under
the Act. COUNTY agrees and will assist COOPERATING UNIT in the undertaking
of such essential activities by providing the services specified in this
Agreement. The parties mutually agree to comply with all applicable require-
ments of the Act and the Regulations and other relevant Federal and/or
Minnesota statutes or regulations in the use of basic grant amounts. Nothing
in this' Article shall be construed to lessen or abrogate COUNTY's responsi-
bility to assume all obligations of an applicant under the Act. including the
development of the Statement of Objectives and Projected Use of Funds pursu-
ant to 24 CFR 570.300 et.seq..
A. COOPERATING UNIT further specifically agrees as follows:
COOPERATING UNIT will in accord with a COUNTY established
schedule prepare and provide to COUNTY, in a prescribed form, an
annual request for the use of Community Development Block Grant
Funds consistent with this Agreement, program regulations and
the Urban Hennepin County Statement of Objectives.
2. COOPERATING UNIT shall use all funds receiVed pursuant to the
Agreement for each annual program within eighteen (18) months of
the authorization by HUD of the basic grant amount. Expenditure
period extensions may be requested in cases where the authorized
activity has been ' itiated and/or subject of a contract.
3. COOPERATING UNIT shall use funds provided pursuant to Section V.
of this Agreement to undertake no more than three (3) grant
funded activities administered by the COOPERATING UNIT. Each
activity shall have a budget of at least seventy-five hundred
dollars ($7,500), or the total amount of the planning allocation
of COOPERATING UNIT if less than seventy-five hundred dollars
($7,500). A COOPERATING UNIT may assign less than seventy-five
hundred dollars ($7,500) to an activity when the activity is one
that is programmed by at least one other COOPERATING UNIT and
administered by only one COOPERATING UNIT on behalf of the
others, provided that the total activity budget is at least
seventy-five hundred dollars ($7,500).
4. COOPERATING UNIT will take actions necessary to accomplish the
community development program and housing assistance goals as
contained in the Urban Hennepin County Housing Assistance Plan.
5. COOPERATING UNIT shall ensure that all programs and/or activi-
ties funded in part or in full by grant funds received pursuant
to this Agreement shall be undertaken affirmatively with regard
to.fair housing, employment and business opportunities for
minorities and women. It shall in implementing all programs
and/or activities funded by the basic grant amount comply with
all applicable federal and Minnesota Laws, statutes, rules and
regulations with regard to civil rights, affirmative action and
equal employment opportunities and Administrative Rule issued by
the COUNTY.
6. COOPERATING UNIT shall participate in the citizen participation
process as established in compliance with the requirements of
the Housing and Community Development Act of 1974, as amended.
7. COOPERATING UNITS shall comply with all of the administrative
guidelines of the COUNTY now in effect or as hereafter
promulgated.
8. COOPERATING UNITS shall prepare, execute, and cause to be filed
all documents protecting the interests of the parties hereto or
any other party of interest as may be designated by the COUNTY.
COUNTY further specifically agrees as follows:
1. COUNTY shall prepare and submit to HUD and appropriate reviewing
agencies on an annual basis all plans, statements and program
documents necessary for receipt of a basic grant amount under
the Act.
COUNTY shall provide, to the maximum extent feasible, technical
assistance and coordinating services to COOPERATING UNIT in the
preparation and submission of the request for funding.
COUNTY shall provide ongoing technical assistance to COOPERATING
UNIT to aid COUNTY in fulfilling its responsibility to HUD for
accomplishment of the comnunity development program and housing
assistance goals.
COUNTY shall upon official request by COOPERATING UNIT agree to
administer local housing rehabilitation grant programs funded
pursuant to the Agreement, provided that COUNTY shall receive
ten percent (10%) of the allocation by COOPERATING UNIT to the
activity as reimbursement for costs associated with its opera-
tion.
COUNTY will, as necessary for clarification and coordination of
program administration, develop and implement Administrative
Rules consistent with the Act, Regulations'and HUD administra-
tive directives.
V. ALLOCATION OF BASIC GRANT AMOUNTS
Basic grant amounts received by the COUNTY under the Act shall be allo-
cated as follows:
A. COUNTY shall retain ten percent (10%) of the annual basic grant
amount for the undertaking of eligible activities.
The balance of the basic grant amount shall be apportioned by COUNTY
to COOPERATING UNITS in accordance with the formula stated in part C
of this section for the purpose of allowing the COOPERATING UNITS to
make requests for the use of funds so aportioned. The allocation is
for planning purposes only and is not a guarantee of funding.
Each COOPERATING UNIT will use as a target for planning purposes an
amount which bears the same ratio to the balance of the basic grant
amount as the average of the ratios between:
1. The population of COOPERATING UNIT and the population of all
COOPERATING UNITS.
2. The extent of poverty in COOPERATING UNIT and the extent of
poverty in all COOPERATING UNITS.
3. The extent of overcrowded housing by units in COOPERATING UNIT
and the extent of overcrowded housing by units in all COOPERAT-
ING UNITS.
4. In determining the average of the above ratios, the ratio

It is the intent of this section that said planning allocation
utilize the same basic elements for allocation of funds as are set
forth in 24 CFR 570,4. The COUNTY shall develop these ratios based
upon data to be furnished by HUD. The COUNTY assumes no duty to
gather such data independently and assumes no liability for any
errors in the data furnished by HUD.
VI. COUNTYWIDE DISCRETIONARY ACCOUNT
In the event that any COOPERATING UNIT cannot commit, expend or does
not request its planning allocation, or a portion thereof, pursuant
to Section V of this Agreement, COUNTY will assign the unexpended or
unallocated grant funds to the Countywide Discretionary Account.
The assignment shall also include funds pursuant to Section IV
paragraph A.2. of this Agreement.
COUNTY will retain ten percent (10%) of all funds placed in the
Countywide Discretionary Account to defray administrative expenses.
COUNTY will, on or before March I of each year, inform each COOPER-
ATING UNIT of the Countywide Discretionary Account balance and will
provide each COOPERATING UNIT the opportunity to make a request for
use of all or a portion of the funds.
VII. FINANCIAL MATTERS
Reimbursement to the COOPERATING UNIT for expenditures for the
~mplementation of activities funded under the Act shall be made upon
receipt by the COUNTY of Summary of Project Disbursement form and
Nennepin County Warrant Request, and supporting documentation.
All funds received by COUNTY under the Act as reimbursement for
payment to COOPERATING UNITS for expenditure of local funds for
activities funded under the Act shall be deposited in the County
Treasury.
COOPERATING UNIT and COUNTY shall maintain financial and other
records and accounts in accordance with requirements of the Act and
Regulations. Such records and accounts will be in such form as to
permit reports required of the County to be prepared therefrom and
to permit the tracing of grant funds and program income to final
expenditure.
D. ,COOPERATING UNIT and COUNTY agree to make available all records and
accounts with respect to matters covered by this Agreement at all
reasonable times to their respective personnel and duly authorized
federal officials. Such records shall be retained as provided by
law, but in no event for a period of less than three years from the
last receipt of program income resulting from activity implementa-
tion. COUNTY shall perform all audits of the basic grant amount and
resulting program income as required under the Act and Regulations.
COOPERATING UNIT shall return all program income derived from
activities funded in total or part from the basic grant amount
COUNTY upon its generation, except as derived from activities
with approved reolving accounts.

1. COUNTY will retain ten percent (10%) of all program income to

2. The remaining 90 percent (90%) of the program income shall be
credited to the grant authority of the COOPERATING UNIT whose
activity generated the income and be used for fundable and eli-
gible Community Development Block Grant activities consistent
with this Agreement.
Should an approved activity be determined to represent an ineligible
expenditure of grant funds the COOPERATING UNIT responsible shall
reimburse the COUNTY for sJch ineligible expense.
1. All reimbursements for ineligible expenditures shall be placed
in the Countywide Discretionary Account, except as provided for
in Section VII.F.2. of this Agreement.
2. When it is determined by the COUNTY that grant funds have been
expended on an eligible activity and through no fault of the
COOPERATING UNIT the project fails or is no longer eligible, the
program reimbursement shall be treated as program income in
Section V!I.E. of this Agreement.
VII. EXECUTION

SEPTEMBER PARKS DEPARTMENT REPORT
The budget preparation for 1988 occupied the first part of September.
I feel that for 1988, because of the adopted budget, the year will
be a progressive one. There were key areas in the budget that will
allow the Parks Commission and the Parks Department to be active in
full,' filling the needs in park development, Commons preservation and
equipment procurement...
September is a month where the Parks Department begins preparation
for the winter season. With the seasonal staff being finished in
the first week of October, we must have all of the summer equipment
stored. Along with the equipment, we are doing repairs that were put
off due to mowing, which is a priority. Now that the growth of the
grass has slowed, these maintenance areas can be performed.
PARKS
CDBG has allowed $10,O00 to be put towards parks in low income areas.
In September, we have done work at Belmont; Seton, Edgewater, Tyrone
and Avon Parks. This work has been in the form of sandboxes, retaining
walls ahd filling in sandy areas at the swing sets. We will.be planting
48 trees, erecting a single picnic table shelter and installing benches
in these parks in the upcoming weeks.
COMMONS
Currently, we are preparing for the 1988 boating season by getting the
application form ready. This form is mailed to ali permit holders just
before the first of the year. We have met with the LMCD's dock inspector
and provided him with information on the number of docks and boats at
Commons sites. We are looking to get a change in the increased fee
proposed for 1988. This fee was $4000 in 1987 and will be $8000 under
their new fee schedule. We feel the increase is too much.

The application for the dredge at Black Lake has been sent to the DNR
and the Watershed District. We hope to have this done in late 1987 or
early 1988. The dredge on Jennings Bay is also looking like it will
carry over into 1988, The group has just secured its permit and is
trying to get a contractor, We have received a quote on the owner
portion and it is very favorable,
CEMETERY
We are still seeing graves settling from the storms early in the year.
The caretaker has been busy repairing these areas.
TREE REMOVAL
We removed one tree from private property at the cost of $485. This
was a forced removal, a bill will be sent to the owner, and if not paid,
will be assessed. Three other trees were scheduled for removal from
City property, but have not been taken yet.

Good news in September for all you figure watchers, watchers of statistics
that is, sales for September were $70,685, compared to September of
1986 when sales were $63,467. An increase of ll%i I really haven't a
clue as to the reason for this exceptional month. One.reason may be
that the Labor Day weekend fell in September whereas, last year the
Labor Day weekend fell at the very end of August. That has some
bearing on. this months success but I know it didn't account for all of
the $7,000 increase.' For the year now we are up $20,700.
One factor that may spoil our October sales is the National Football
League players strike. Moundites, as all other true blooded Americans,
really enjoy their beer when observing those Sunday and Monday night
games. This mai depress them severely and cause them to do some absurd
thing like work on their houses more, or rake their lawn, or actually,
God forbid, buy a book. We must pray for and encourage the Twins to go
all the way to the World Series. This could save us.
The Christian Brothers winery, in an attempt to gain back a share of
the market that they have lost, have come out with a new line of cordials,
i.e. Blackberry, Wild Berries, Apricot and Peach Brandies. We opted to
buy a few cases and have a tasting on them. The tasting was not a
complete success. Unfortunately, the day we held the tasting, the weather
was in the 70's. Not very condusive for that type of product. Earlier
in the month, we als° had an Almaden White Zinfandel wine cooler demo,
which went a lot better.
One of my part time employees went back to college the first week of
September. I have been without someone to replace him which is all
right since we are coming into a slower season. However, I will get
somebody in shortly so we can train the person in before the holidays.
So I am not desperate at this point and am waiting for the right
individual to come along.

COMPUTER UPDATE
September was our first month off the LOGIS financial
system. I am satisfied with the way the new financial system is
operating. The utility billing system will be converted by computer
tape transfer. This will save staff time from having to enter all
the account numbers, addresses, names, etc. We plan on converting
the fil&s in October, run parallel in November and drop off LOGIS
for the December billing cycle.
INVESTMENTS

Monthly Report for September, 1987
I. STATISTICS
The police department responded to 640 calls for service in September. There
were 40 Part I offenses reported including 4 criminal sexual conduct, 10
burglaries, 24 larcenies, and 2 vehicle thefts.
There were 51 Part II offenses for the month. Those offenses included 2
child abuse/neglect, 2 forgery/NSF checks, 12 criminal damage to property,
2 weapons violations, 1 narcotic violation, 3 liquor law violations, 7'
DWI, 5 assaults (2 domestic), 8 domestics, 11 harassment, 5 runaway/incor-
rigibility, and 2 public peace.
The patrol division issued 138 adult citations and 7 juvenile citations. A
total of 136 warnings were issued for the month.
The department cleared 12 Part I offenses by arrest and 21 Part II offenses.
Adults accounted for 19 arrests and juveniles for 14 arrests.
The department handled 12 medical emergencies, 10 accidents (3 with injuries),
and 124 animal complaints. The department provided neighboring departments
assistance on 26 occasions.
Property valued at $26,475 was stolen during the month.
II. INVESTIGATION
Seven cases involving child protection matters were investigated during the
month of September. Those seven cases accounted for over 48 hours of
investigative time. Officer Grand was assigned plain-clothes for two shifts
during the month to assist.
Two liquor background investigations accounted for 20 hours of investigative
time. Other cases investigated include 3 thefts, 1 forgery, 4 check cases,
and 1 truancy.

Formal complaints were issued on four cases during the month. One case,
a child protection issue, involved a 47 year old male being charged with two
counts of criminal sexual conduct in the first degree and one charge in the
second degree. Two other males were charged with disorderly conduct and one
male was charged with fifth degree assault.
The department has investigated 58 child protection matters through the
month of September.
III. MANPOWER
Officer Limond has been put out on his own when another officer is working.
Officer Limond is still not ready to work without some supervision.
Officers used 8 holidays, 11 vacation days, 3 sick days, and 3 compensatory
days during the month. Some over time was realized due to officer illness
and the Labor Day weekend.
IV.
POLICE RESERVES
The Mound Police Reserves donated 256.5 hours duringthe month of September.
The reserves held their annual benefit dance during the month.
The reserves are currently up to 9 members, of which two are still training.
Several applications have been received from individuals wanting to join
the reserve unit.
With the start of the school year, the reserves have been busy at football
games and dances. They have also been called on for 3 transport details
and several community service details.

September Activity Report
This month shop work included 4 battery changes, 5 oil changes, 3 tune-ups,
and 2 alternators. "
A new tailgate had to be built and installed for Unit #15 which is an
older dump truck shared by the Water, Street, and Parks. This job was
performed in our shop at a cost of approximately $100 by Tim Johnson
and myself saving the City considerable expense, instead of taking it
to a fabricating shop.
Unit #4 our Sewer tanker also required extensive frame repair which
was also done in our shop.
Many fuel related problems have been occurring since we changed to
purchasing fuel from Superamerica. It is my opinion we should look
at other sources of obtaining fuel. These problems include clogged
fuel injector, catalytic converters and fuel filters.
This month aiso is the start of winter preparation for storage and cold
weather operation.

SEPTEMBER MONTHLY REPORT
The City had 2 regular Council Meetings, 2 special Budget Hear-
ings, and 1 special Canvassing Meeting in September with I neW
ordinance and 34 resolutions. There was Age~da preparation for
each meeting'and items to clear up after each meeting.
Preparation for the Special Bond .Election on September. 29th was
done. I had Linda conduct the training session for the Election
Judges. She did a very' good job. She also had to inventory and
order all supplies needed for each precinct. The City was open
for absentee voting on the Saturday before the election from 1:00
P.M. to 3:00 P.M. and again until 7:00 P.M. on the Monday before
the elect'ion. On.-September 28th each precinct was set-up (all
voting booths and miscellaneous supplies), keys were obtained for
the various precincts and the Precinct Chair People came to pick
up their materials. The election was a success this time.

Resolutions were prepared for the following special assessment

Resolutions were prepared cancelling 7 levies for which money is
available to 'make the bond and interest payments in 1988.
The finishing touches were put on the proposed 1988 Budget. New
account numbers to coincide with the new computer system were put
on each line item and inputted into the computer for each depart-
ment.
Hennepin County is getting ready for a tax forfeit land sale and
their were a number of calls and questions from them on the
property they 'will be selling.
There were the usual calls, questions and research don'e on
specific items during the month.

SUBJECT: September's Activity Report
The sweepers were out for a week cleaning up the rest of the buckshot
leftover from sealcoati~g, so that job is behind us for another year.
We had the Vat-all out for three days cleaning sump catch basins, we
cleaned 12 of them but we have alot more to do. We had a backhoe hired
for a day and a half to open up the end of some storm sewers and cleanout
some drainage ditches.
We finished patching manhole covers and gate valves this month so that
part of getting ready for winter has been completed. We do have some
other patching to do but it depends on the weather.
The Cul-de-sac on the southend of Grove Lane has been giving us some
problems for the last few year. When they were building the new houses
in there they had trouble locating sewer stubs so they took a backhoe and
dug behind the curbing in 4 different spots and the result being that the
curb and gutter settled taking the blacktop with it. To repair this we
removed 265' of curb and gutter and replaed it bringing it back to grade
and overlayed the entire cul-de-ssc with a blacktop mat.
We did some work on the parking lots this month such as stripping, new signs
and changing some of the parking. We changed the parking in the post office
lot from parallel to angle parking and made it a one-way, going from north
to south and moved the mail drop boxes from Shoreline Blvd. to the east
side of the lots. So you can deposit the mail from the drivers seat.
We have received a number of favorable remarks saying th~tit was a good
idea and it should have been done years ago.

SUBJECT: September's Recycling
On September 26th Hennepin County give residents an opportunity to
safely dispose of their household hazardous wastes by bring them to
the maintenance garage located on County Road 15 in Spring Park.
There were about 100 people that took advantage of this.
In September another flyer went out as a reminder for people of the
dates of pick-up and what can be recycled.
_Starting this Saturday, October lO the compost site will be open
from 10:00 a.m. till 5:00 p.m. for disposing of leaves. The City
will have someone there to make,sure that is all that is being
disposed of.
September pick-up was 12.O5 tons with 354 household participating.

September's Activity Report
In September we 'pumped' 23,520,000 gallons of water. There was ! water
main break. I think that we may be looking at a major road repair on
this break in the Spring. I hope I am wrong. There were 7 T-off's
for non-pay, az this time we have only turned back on 5. There were
1,034 meter read this month out of 1,O52, 34 final readings, 1 service
call, 8 new accounts and 6 outside readers installed. This month was
packed full with budget meetings, new Public Works Facility meetings
and meetings with contractors.
In August we sent out 59 letters to residents requesting that they
contact us for outside reader installation. At this time we have
received only 9 calls, not a very good response. I will meet with
the City Manager to discuss a different approach.
SEWER DEPARTMENT
The Sewer'Dept. has been cleaning sewer lines this month. There was 1
sewer back-up. We will be looking at the possibility of replacing
approximately 200' of sewer line in the easement between Bedford Rd. and
Wilshire Blvd.. This area has been a real problem in the past. We televised
the line a few months back, while reviewing the tape we found that we have
100' of pipe that has settled, along with that we had 3 cracked joints and
a large amount of roots. I am planning on replacing the entire length
with 8" PVC pipe.
