The City Council of Mound,. Hennepin County, Minnesota, met in regular session
on Tuesday, October 27, 1987, at 7:30 P.M. in the Council Chambers at 5341
Haywood Road, in said City.
Those present were: Mayor Steve Smith, Councilmembers Don Abel, Liz Jensen,
Phyllis Jessen and Skip johnson. Also present were: Acting City Manager Frau
Clark, Acting City Clerk Linda Strong,~City Attorney Curt Pearson, City En-
gineer John Cameron, City Planner Mark Koegler, Police Chief Len Harrell, and

The Mayor opened the meeting and welcomed the people in attendance.

MINUTES
MOTION made by Abel, seconded by Jensen to approve the minutes of the
October 13, 1987, Regular Meeting, as presented. The vote was unanim-
ously in favor. Motion carried.
PUBLIC HEARING:. DELINQUENT'UTILiTY BILLS
The Mayor opened the public hearing. Mr. Mark Nadon, 4725 Hampton Road, was
present stating that he having financial problems and could not fully pay his
utility bill. The City' Clerk advised him to come to City Hall October 28,
1987, and work out a contract ~or payment. He agreed'to do this. The Mayor
closed the public hearing.
Able moved and Jensen seconded the following resolution:

recommended denial of this proposed vacation because to approve it would deny

Ms. Sandra Konnad, her attorney David 01son, Mr. Steve Schroeder, and Mr. Jack
Cook's attorney Carter DeLaittre were present. There was discussion regarding
the two conflicting surveys, one done for Ms. Konnad, the other done for Mr.
Cook and both done by the same surveying company. Ms. Konnad's survey shows
that some items on Mr. Cook's property encroaches onto her property. The
Building Official explained that the Planning Commission recommended approval

of the variance and the Council approved the variance based on the survey sub-
mitted by Mr. Cook which did not show encroachments onto Ms. Konnad's
property.
After more discussion by all parties it was decided no action will be taken
until another survey is obtained,
DISCUSSION ON ITEM #7 IN RESOLUTION #87-145, AMENDMENT TO BALBOA MN. CORP.
CONDITIONAL USE PERMIT
Item #7 in Resolution #87-145 reads as follows: "No activity shall occur in
the trailer parking area between the hours of 10:00 p.m. to 7:00 a.m."
Mr. Mark Lundgren of Balboa Mn., the Managing Director of Operations Mr. james
Bruha, and Mr. Ron Zamansky attorney for Toro were present. Mr. Lundgren ex-
plained that when the revision to the Conditional Use Permit for Balboa.was
approved he thought that Toro could live with this restriction. Mr. Zamansky,
representing Toro stated that it is absolutely necessary that Toro be allowed
to have trailer activity during the restricted hours. He stated that they
would try to minimize the activity as much as possible. He also stated that
Toro was not aware of any restrictions when they leased the building.
The following residents voiced their disapproval of the trailer activities
during the restricted hours: Mr. A1 Shay, 5348 Lynwood Blvd., Mr. Lauren Hof-
teig, 2216 Noble Lane, and Mr. Jerry Kohls, 5424 Lynwood Blvd. Mr. Shay also
stated that the landscaping that has been installed is not sufficient to block
any noise.
The Council discussed both the trailer issue and the landscaping. The Council
suggested that Balboa, Toro and the residents try to find a compromise.
MOTION.made by Johnson, seconded by Jessen to refer with matter back to
Staff {City Manager and City Planner) to work with Balboa, Toro and the
residents to see if they can work out a compromise for the restricted
hours. No action was taken at this time on Item #7. The vote was un-
animously in favor. Motion carried.
REQUEST FOR ISSUANCE OF A BUILDING PERMI~ FOR 2867 WESTEDGE BLVD. (LOT 11~
BLOCK 2~ WESTWOOD) BY MR..RICHARD fi. SMITH, 6600 MOHAWK TRAIL, EDINA
The Building Official summarized the events concerning this lot, the MPCA cor-
respondence regarding the Woodcrest Dump Site which led to her decision not to
issue a building permit.
Mr. Richard Smith was present and explained his position regarding the MPCA's
delayed site investigation and the precautions he is willing to take and still
build a home on the site.

There was discussion by the Council.
NOTION made by densen, seconded by Abel to authorize the issuance of a
Building Permit to Mr. Richard H. Smith for Lot I1, Block 2, Westwood,
provided that soil samples are taken and analyzed for hazardous waste
and that Hr. Smith will provide a hold harmless agreement so the City is
not held liable in the future, before the permit is issued. The vote
was 3 in favor with Jessen and Johnson voting nay. Motion carried.

The Building Official explained that the Planning Commission recommended
denial..She then reviewed the previously granted variances for this pffoperty.
The last variance allowed the former owner to enclose ·what used to be a deck
with the stipulation that no deck be added at a future date.
Mr. & Mr. Erlander were present and asked if a 4 foot deck instead of an 8
foot deck could be added. The Council explained that this request would have
to go back to the Planning Commission for review.
Mr. Orval Fenstad, 4356 Wilshire Blvd., was present objecting to the deck
being allowed.
MOTION made by Abel, seconded by Johnson to DENY the request for
lakeshore setback variance to allow the construction of an 8 foot deck
at 4354 Wilshire Blvd. {Lot 80, Phelps Island Park First Division, also

Motion carried.

.The City Engineer stated that soil borings were just done and a full

There were questions from some of the Planning and Park Comm{ssioners present
regarding the above items.
The City Planner stated that the Staff would like to continue to follow the
RFP. He would like to see the Staff continue to pursue discussion with the
developer and detail their outline more and then bring it back to the Council
and Commissions for further review.

The City Attorney reported that he has reviewed the Option Agreement and sees
no problem with continuing this item for two weeks until the City Engineer has
had time to review the ~esults of the soil tests. The Council agreed. Item
will be on the November lOth Agenda.

MOTION made by Jessen, seconded by Abel to authorize__the .payment of
bills as presented on the pre-list in the amount of $140,733.31, when
funds are available. A roll call vote was unanimously in favor. 'Motion

Case No. 87-674 Side yard setback variance for 2068 Bellaire Lane

Mr. & Mrs. Howard J. McKinney were present.
The Building Official explained that applicant recently purchased the home
and he has put a detached garage on the property already and would like to
add a 14 by 26 foot addition to the living space of the existing home. The
structure is 4.3 to 5.3 feet from the north property line instead of the
required 6 foot setback. Applicant would like to keep in line with the non-
conforming setback, rather than set the addition back the .7 feet, and it
would, because of the tilt of the home actually go further away from the lot
line as it gets to the east. The staff recommends approval of the request.
Because of the short construction season, Mr. McKinney asked if this could
be put on the Council agenda for November 10th.
Andersen moved and Jensen seconded a motion to recommend approval of the
request.
The Commission discussed how close this structure was to being up to building
code and if bringing it up to building code or fixing the foundation should
be required. The McKinneys stated they plan to put in 100 amp service, a
new roof, vinyl siding, etc. and that home will look like new.
The vote on the motion was unanimously in favor.
This will be on the Council agenda for November~lOth.

RESOLUTION TO RECOGNIZE AN EXISTING NONCONFORMING
STRUCTURE TO ALLOW AN ADDITION FOR LOT 58, MOUND

WHEREAS, the applicant has applied for a variance to recognize an
existing nonconforming 4.3 foot side yard setback for Lot 58, Mound Addition;
PID No. 14-117-24 41 0031; and
WHEREAS, the subject property is located within the R-3 One and Two
Family Zoning District, which according to City Code, requires a 30 foot front
yard setback, 6 foot side yard and lO foot side yard setbacks and a 15 foot rear
yard; and
WHEREAS, Section 23.404(8) provides that alterations may be made to
building containing a lawful nonconforming residential unit when the alteration
will improve the livibility thereof, but the alteration may not increase the
number of units; and
WHEREAS, the Planning Commission has reviewed the request and does
recommend approval.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Mound, Minnesota as follows:
1. That the City does hereby authorize the existing nonconforming
principal structure setback at 2068 Bellaire Lane; PID No. 14-117-24
41 0031.
2. City Council authorizes existing structural setback violation
and authorizes the alteration setforth below, pursuant to Section
23.404(8) with the clear and express understanding that the use
remains as a lawful nonconforming use subject to all the provisions
and restrictions of Section 23.4Q4.
3. It is determined that the livibility of the residential unit
will be improved by authorizing the following alterations to the
nonconforming use property:
Expansion of the principal structure with a 14 by 26 foot one story
addition as shown on the site plan identified as Exhibit A.

PROPOSAL: The applicant is proposing to add.a 14 by 26 ~oot addition to the living
space of the existing home. The existing structure is °4.3 to 5.3 feet from the
north property line. The addition would continue from the 5.3 foot setback to the
east at an angle in line with the existing home.
The R-3 Zoning District requires a 6 foot side yard and a lO foot side yard' for lots
of record when the lot width is greater than 40 feet and less than 80 feet; a 30
foot front yard setback, 15 foot rear yard setback and a lot size of 6,OOO'square
feet for a single famil~ residence.
COMMENTS: The lot area, south'side'yard, accessory building setback, and rear
yard setback are conforming on this property.
RECOMMENDATION: The staff recommends approval of the requested variance to align
an addition within 5.3 feet of the.north property llne as a .7 foot setback for..
the addition would be an unusual hardship, for'the property owner.
The abutting neighbors have been notified.
This will be referred to the City Council on November 24, 1987.

October's Activity Report
This month is the time of the year to prepare for winter.
A total of 9 pieces of equipment were outfitted with plows and or wings
to do the snow removal chores. 39 pieces of equipment were checked for
the correct amount of anti-freeze. The 2 sweepers were winterized and
put into storage for the season. Our loader was completely inspected
and serviced for winter use.
A total of 22 snow tires were installed on the units needing them.
Other items this month included the normal number of regular servicing
and various breakdowns.

October's Activity Report
In October we pumped 22,766,000 gallons of water. There were 5 new accounts,
14 T-offs for non payment, 9 T-ons, 6 meters tested, 11 meters repaired', 49
final reading~ 4 outside readers installed and 1021 meters read out of 1052.
We had 1 water main break.
We have installed a 2" drain pipe from the water tower on Chateau to the
catch basin on Chateau and Fairview. This will handle the water that is
pumped out of the pit that houses the control valve for opening and closing
the tower. The water was pumped previously Onto the ground, but this
created problems with one resident in that his backyard would occasionally
flood.
Construction has begun on Seton Place at Wilshire & Bradford. Sewer and
water should be installed by the first week in November.
Have been talking with the County regarding the plan for the road and
bridge update. Only one problem so far concerning the interconnect
piping and air release valve. I hope to have this resolved within the
next couple of week.
SEWER DEPARTMENT
The Sewer Department has been busy cleaning wet wells and filters most of

October's Recycling
October 10 was the first Saturday that the compost site was open. The
site has been open every Saturday since then, there has been a total
of about 200 loads of leaves brought out there. Saturday, October 31
was a very popular day, people where waiting in line to dispose of
their leaves, a total of 125 loads where brought in that day alone.
We're planning on keeping the site open this Saturday and maybe next
Saturday, depending on the weather and the demand.
Thank you Phyllis for the terrific idea of placing signs in all of
the City's employees yards. You made my day. About every month I
get a couple of calls for people that want signs, every little bit

October's Activity Report
We spent the first part of the month picking up leaves off of the stree'ts
and parking lots.
The Street Department ended up cleaning up the Bickman property after the
Fire Department burned down the house. We had some extra debris that we
couldn't dispose of on the property so we hauled it to the landfill at
the City's expense. The first time we hauled in 8 loads of dirt to dress
up the area and I thought it looked good. About a week later the City
got a letter from Mr. Bickman stating that he was dissatisfied with the
clean up and he wanted more done. We hauled in 10 more loads of fill
and regraded the entire yard, hopefully this will satisfy him.
This is the time of year when we put our summer equipment in storage
and get our snow equipment ready for the winter season. It takes about
5 full days for the transition if ~e~ have no problems.
We have completed our first salt and sand mixing of the 87 - 88 winter
season. We have about 1300 tons of mix on hand, that's good for about
4 sandings.

Monthly Report for October, 1987
I. STATISTICS
The police department responded to 661 calls for service in October. There
were 32 Part I Offenses reported for the Month. There was 1 assault, 4
burglaries, 24 larcenies, 2 vehicle thefts, and 1 arson.
There were 62 Part II Offenses in October. Those offenses included 3 child
abuse/neglect, 3 forgery/NSF checks, 13 damage to property, 10 DWI's, 3
simple assaults, 8 domestics (5 with assaults), 8 harassments, 10 runaway/
incorrigibility, and 4 other offenses.
The patrol division issued 171 adult citations and 10 juvenile citations.
A total of 134 warnings were issued.
Two juveniles were arrested for felonies and one adult. Twenty-four misde-
meanor arrests were made including 13 juveniles.
The department responded to 32 medical emergencies, 10 property damage
accidents, and 78 animal complaints. The department assisted neighboring
agencies 18 times during the month.
II. INVESTIGATIONS
Five cases involving child protection issues were investigated during the
month and accounted for approximately 35 hours of investigative time. An
aggravated assault accounted for an additional 20 hours of investigation.
Other cases investigated included 2 forgeries, another check case, a liquor
background, a theft, and several truancy problems at Grandview Middle School.
Formal complaints were issued in 16 cases in October. The complaints
involved disorderly conducts, DWI's, dog at large, providing liquor to a
minor, and several other cases.
The department has investigated 61 child protection matters to date.

III. MANPOWER
Officer Limond has progressed and is currently working on his own.
Officers used 7 holidays, 14 vacation days, 4 sick days, and 4 comp-time
days during the month. Officer Grand was assigned plain clothes for 9
shifts during the month while Sgt. Hudson was on vacation.
Some over-time was necessitated because of illness and several officers
were required to appear in court on a variety of cases.
Sgt. Hudson attended a one day training on the D.A~R.E. Program and I
attended a two day school on employment practices.°
IV. POLICE RESERVES
The Mound Police Reserves donated 201.5 hours in October.
The reserve unit is up to 10 members, with several still in training.' One
individual has requested an inactive status for 6 months due to a family
illness.'
The reserves assisted with the Homecoming parade, Our Lady of the Lake
Marathon, Community Service CPR class, and a couple of dances. The reserves
also distributed candy to the elementary schools for Halloween.
The reserves currently have approximately $6,000 in their operating account.
Attached are the computer printouts from the new system. It became operational
in October.

OCTOBER MONTHLY REPORT
The City Council had 2 regular meetings in October with I new or-
dinance and 13 resolutions. There was Agenda preparation and
items to clear up after each meeting.
Levy sheets and certified copies of resolutions were prepared and
submitted to Hennepin County for each of the following:

The Mound City Code of Ordinances was updated to include all 8
new ordinances that have been adopted since the recodification.
All election materials had to be reviewed and put back into
storage.
Hennepin County has sent their latest list of seven tax forfeit
parcels. I have submitted these to the various departments and
the City Engineer for review. These will be on a future Agenda
with our recommendations and for your review.
I have started to coordinate the Certificates of Title, State
Deeds, easements, etc. for the card index I did in June on the
following property:

During the month of October, I attended one Planning Commission Board of Appeals
on October !2th, 1987 and the Planning Commission Recognition Dinner on Octo-
ber 16th, 1987 at A1 & Alma's. I attended two City Council meetings on October
13th and the 27th. Marge attended the Planning Commission meeting and the Recog-
nition Dinner, and one Park Commission meeting. There were 22 working days in
October. I was off on leave the 22nd of October. Marge traded working a Saturday
to train in on the new word processor and was off one day compensation. The fol-
lowing inspections were conducted during the month of October:

This list of inspections does not include the 23 inspections for our Department
by the substitute inspector during my absence and 1 blueprint plan review for
new home construction. Jim Thompson, Plumbing Inspector, turned in 44 inspec-
tion cards which were completed since his previous inspection card submittal
for plumbing services.
The monthly report for September was submitted to the City Manager during the
month. Planning Commission reports were submitted to the Commissioners. The
Planning Commission referred 6 Zoning cases to the City Council for action; 4
variances and 2 minor'subdivisions. The Planning Commission Recognition Dinner
at A1 & Alma's gave the City the opportunity to thank the Commissioners for
their many hours of volunteer time spent to review all of the various cases be-
fore them during this past year.

During the month of October, i worked with City Prosecutor on several cases
pending Court action. The garage which was ordered relocated at 6165 Sinclair
and the gravel removed from the Park land has been ~ccompllshed. I met with a
landlord this month regarding his rental property to assure completion of his
necessary improvements to the structure. Inspection and Planning Department has
sent declarations, covenants and by-laws for the "Seton Place" addition to the
City Attorney'for review of the extended plat for Mr. Richard Smith. The sub-
division of land had a pre~construction meeting with Public Works and the City
Engineer to start construction in the near future.
I meet with Mark Lund§ren of Balboa for a walk-thru inspection of numerous permits
that have been obtained during the past couple of years. I. devoted an afternoon
to list any items that needed completion and we have narrowed down the total re-
modeling of the former Tonka Toys building to just a few small items. Kraus
Anderson has completed the project of the former HEI/Ms. Dees building which was
converted to the new Contel facility. The Lolli-Pop Dragon Nursery which has ex-
panded floor area in the Community Center, received a temporary approval pending
exit sign placement. I met with Steve Coddon to discuss the possible conversion
of part of his building to a~ Deli Take Out facility. Plan review was conducted
on 6 homes and 5 residential additions during October.
! attended a staff meetin§., State Building Division Code meeting, a luncheon
heating inspectors meeting, and a North Star Chapter meeting during the month of
October. The Minnesota State Building Code Division reviewed the new revisions
to.several sections of the State Building Code.as well as a review of the R-1
Multiple Family Plan Review Provisions. The North Star Chapter meeting in Edina
was held at the. new Edinbourgh Park facilityt Topic update of the national
building code changes in St. Louis to be published in the 1988 Uniform Building
Code, as well as a speaker from the Minnesota Masonry Institute, a discussion of
cold weather construction standards and the application of brick in construction.
The City vehicle had the normal gasoline fills during the month. A shopping trip
to Snyders for film and a shopping trip to obtain some handout "trick or treats"
for the Planning Commission Recognition Dinner.
The total number of building permits issued in October was 41 with a valuation of
$960,137. The valuation figures are attached on the Building Activity Report for
October.
In addition, Marge has prepared the monthly calendar for the November City meetings
and events. Marge has arranged appointments for inspections of building, plumbing,
and the substitute building inspectors. Marge has prepared the Park Commission
Agenda, written the minutes for Planning and Park. Marge arranged with Public Works
to have some grave sites staked out for markers and prepared two cemetery deeds for
signatures on grave sites sold this fall.
* Site inspections include the review of the Planning Commission requests and re-
quirements, slate inspections for flood plain verification for mortgage companies,
complaints and follow-up to code compliance such as, no building permit, re-check
of compliance notice, review status of various sites for the City Prosecutor, pre-
construction meetings at the site for building permit appli-cants or realtors, fire
damage and periodic commercial inspection updates.

** The heating inspections during the construction of project are included
under the framing and final inspections of the building. The heating installa-
tions mentioned are for separate equipment being placed in homes and businesses.
Several of the inspections for framing involved framing and insulation of the
same structure.

GENERAL COMMENT
October was a month of finishing projects and preparing, for
winter.
We finished with the planting of the trees under CDBG monies and
also the timber berms around play equipment. .Projects remaining
is the installation of'park benches, 'player benches and trash
cans provided under this program. This will be done in the
spring of 1988.
All summer equipment such as mowers, have been prepped for winter
storage and put away. All picnic tables and trash cans have been
retrieved from the parks and stacked for winter.
The summer seasonal staff is now gone. I feel we were able to
accomplish much this summer. The main area was the rip-rapping
of 1495 linear feet by the Parks c.rew. We were able to keep up
with the daily maintenance of the parks, with only allowing a few
projects to carry over for 1988.
CEMETERY
The cemetery was not vandalized this Halloween as it has been in
the past. Generally, there is turned over headstones. The
grounds have been fertilized for winter and markers put up by the
Public Works department for winter location of graves.
In 1988, we will be looking into the fee charged for a burial
site to see if an increase is needed.

COMMONS
The Commons are now being inspected for Compliance of Winter dock
storage. The majority of boats are out of the water and the
docks are being placed on the shoreline.
We have set up the list for rip-rapping to do in 1988 for both
the contractor portion and the Parks crew portion. The
applications for the contract work has been sent into the
Watershed. This has gone in now because the work will be done
this winter. The rip-rap to be done by the City crew will have a
separate permit and we will apply for it the first part of 1988.
The dredges at Jennings Bay and Black Lake are proceeding. The
Jennings Bay group feels they will be ready in February of 1988.
The Black Lake dredge application has gone to the DNR, Watershed
and the Corp of Engineers. The Watershed engineers will not let
us side cast the dredgings below the 931.5 elevation. The DNR
permit is down to the 929.4 elevation. This has become a problem
because the area we were going to use for the dredgings has an
elevation of 930.0. We are now looking into trucking the
dredgings. The dredging quotes are due within two weeks.
TREE REMOVAL
In October we had fifteen trees removed from City property at a
cost of'$2,795',
PARKS
We have seen some vandalism in the Parks this month. The sign
from the Mound Depot has disappeared and a few picnic tables have
been abused. The covered picnic table at Carlson Park had some
one try to dismantle it. We replaced all of the missing nuts and
bolts and damaged the threads so they could not be removed.

GFOA FALL CONFERENCE
I attended the State Conference for Finance Uirectors in October.
The theme of the conference this year was budgeting. There were
sessions on the council perspective of the budget process,
communicating the budget to the council and the press and
examples and illustrations of outstanding budget documents. The
budget documents judged as outstanding tended to be more visual
than our budget, i,e. they used graphs and pictures to illustrate
various.points. Besides budgeting, there were sessions on m~cro-
computers, investment management and financ.ial reporting (audit
workpapers). The conference was organized, informative and well
worth attending.

MINUTES OF THE
MOUND ~DVISORY P~RK COMMISSION MEETING
October 8, 1987
Present were: Chair ~ancy Clough; Commissioners Shirley Andersen, Cathy .
Bailey(1E), Andy Gearhart(2E), and Lowell Swenson; Council Representative
Phyllis Jessen; Park Director Jim Fackler; Dock Inspector Dell Rudolph and
Secretary Marge Stutsman. Absent and excused were Commissioners Cheryl Burns
(1E & 1U), Marilyn Byrnes(2E), Delores Maas(2E & 1U) and Linda Panetta(1E).
Also present were interested persons: Karen and Ned Podany.
MINUTES
The minutes of the Park Commission meeting of September 10, 1987 were presented
for consideration. Chair Clough stated that Commissioner Bailey had been ex-
cused from the September 10th meeting and that should be reflected in the minutes.
Swenson moved and Clough seconded a motion to accept the minutes of the Septem-
ber 10th, 1987 Park Commission meeting as written with the one change. The
vote was unanimously in favor.
SINCLAIR ACCESS - Proposal for adding 4 new dock sites and making access by
filling portion of Park Lagoon adjacent to Lots 1 and 2, Block 17, The Highlands
The Dock Inspector Dell Rudolph explained that the City has 98.5 feet of lake-
shore off of Lagoon Park where people had had docks, but they were moved out
and the sites abandonedbecause of a conflict over an access to them. Because
of the big demand for docks in the Priest Bay area, he believes the City ought
to reconsider using this area and making it accessible by filling or construct
a board walk. Park Director Jim Fackler advised that this marsh area is not
recognized by theDNR and doesn't fall under their jurisdiction; but under the
jurisdiction of the City's Wetland Ordinance which we'need to look at. The
diagram enclosed in the packet shows the triangular area approximately 6 by 9
feet that would need filling. He stated a survey would be needed to determine
the lot lines. Filling would bemost economical for City as there is some fill
available. It would need to accommodate the skidster loader as there is clean
up and other work needed 'such as opening up marsh and putting in small timber
bridge, etc. Dell suggested dock sites should be opened to anyone in town; it
is a nice beach and that probably 4 docks could be put in for about 6 boats
using only the inside of the two outside docks because of the necessity of main-
taining 10 foot sideyards. It w~s discussed that parking w-as very limited in
this area.
The Podanys of 6165 Sinclair Road commented on the lack of parking and past
problems with snowmobilers and people bringing in ice houses through the lagoon.
Mrs. Podany stated there was concern there may be problems with children and
unsupervised swimming; in the past, people have broken a bridge they had and
the snowmobilers have congregated in the middle of the pond and built bonfires.
Mr. Podany questioned why this is being brought up again as it has been before
the Council and turned down several times. He also commented realtors are
crossing his property and showing the front of lakeside stating this is lake-
shore for the development. The Park Co~mission discussed the various points.
Jim stated clearing brush, etc. would improve visibility out there and access
could be limited by installing posts, etc.
Jessen moved and Clough seconded a motion to recommend that the City have
survey done of the Park property. The vote was unanimously in favor.

Dell Rudolph commented these 3 dock requests are preliminary and, at the Novem-
ber meeting, they will have robe approved or disapproved.
CARIX)W ROAD/KENMARE COMMONS - Proposed addition of 1 new dock site (~31630)
Dell Rudolph explained that dock site off end of Carlow Road ~-as filled and
cleaned up and, in June it ~ras temporarily okayed as a site for this sun, her
because of low water. He said it has worked out very well and he is requesting
to have it as a permanent site.
The Commission discussed the possibility of making parking spots for 1 or 2 :
cars. Staff said Carlow goes right down to lake and thought there wasn't
room. It was noted there is parking on one side of Carlow.
Clough moved and Gearhart seconded a motion to recommend that this dock site
be continued next year. The vote ~-as unanimously in favor.
DOCK SITE ~ 01200 - For new house at 1547 Bluebird La~
Dell Rudolph advised that a new home is being built on land abutting the con~ons
and he is sure the homeowner will want a dock site. He put this on the agenda
because of the restriction City has in that particular area. The Commission
discussed briefly.
Jessen moved and Clough seconded a motion to reco~nend that we allow a dock
site.in that'area for the new abutting'homeowner. The vote was unanimously
in favor.
1745 Wildhurst Lane - Request for stairway to be built on Park Property
William and Elaine Lovkvist have submitted a request to build a stairway with
double handrails on steep bank tO Park and Co~ons area with a light at the
top of the stairway. The Park Director explained that the light and the top
2 risers of the stairway will be on their private property; the stairway will
be built to City specifications. Commission discussed that there are no
other obstructions on this Come, ons and it was suggested that no walkw~ybe
allowed beyond the stairway to a dock site. Jim stated area had been filled
in s0 there was no need for a walkway; Dell commented there are two new homes
going in which will be abutting properties and need dock sites.
Clough moved and Gearhart seconded a motion to recommend that request be
accepted with the condition that steps not be extended out beyond the lowest
riser. The vote was unanimously in favor.
REPORTS
Council Representative Phyllis Jessen had nothing new to report and City Manager
Ed Shuklewas on v~cation.
The Park Director Jim Fackler passed out two handouts; first one on C.D.B.G.
and other one on Rip Rap Priorities. He explained that of the $10,000. that
was allotted, we spent $9,999.30. The figures on the right of sheet were
estimates. He gave a breakdown of actual costs and commented improvements
were all to low income areas as required for C.D.B.G. add will be completed

by next Spring. On rip rapping, the sheet shows what has been done this year;
they were able to do much more than they expected. Jim stated next year they
plan to cut down on contracted work. They will contract only for areas that
are inaccessible by the City crew. Bob Johnson and John Taffe have done most

The Dock Inspector Dell Rudolph reported that the letter sent to the L.M.C.D.
relative to the fee increase has resulted in a meeting being set up for Saturday
morning at the Park Bench in Spring Park (change from J.J. Hill's Ironhorse),
October 10th at 7:30 a.m. to discuss the matter. In addition to the high fees
based on number and length of boats, Dell stated hew-ants to discuss the late
fee for license applications received byL.M.C.D, after December 1st. He stated
there is no way we could meet that deadline. Jim con~nented that the City, being
a bordering City to Lake Minnetonka, also pays $8,000 a year to L.M.C.D. Dell
stated he needs representation from the Park Con~nission at that meeting. The
Council has already adopted the fees for the 1988 year and any L.M.C.D. increase
would have to be on top of that. The Chair and several others agreed to attend
the meeting.
Jim reported status of the Jennings Bay Dredge and the Black Lake Dredge. He'll
keep us updated.
Surmmer Recreational Proqram
Council Representative Phyllis Jessen explained that in the past years, we had
a good director and a good program going; but now there seems to be no Continuity
in the program.and she is suggesting that we askwhatCOmmunity Services could
offer. The Commission discussed kinds of complaints received, how other communi-
ties operated their programs, etc., looking into getting someone on an intern-
ship and problem of little money to attract professional type of supervisor.
It %-as thought we need to explore each idea anyone has. Jim noted that part of
our problem is that our parks do not have shelters for when it rains or place
with shade if very hot and he has talked with Don Ulrick, Community Services
Director, who will be at the November meeting regarding his suggestions on a
program.
The Chair asked Jim to look into getting an intern. Jim stated our program does
offer only minimal experience to enchance their education and he has not had
any success in previous years to get an intern; but he will %~ite to some col-
leges with inquiries.
Absentismwas discussed and what constitutes an excused absence. Members un-
able to attend a meeting should contact the Chair or the City Office.
The Chair also requested Stephen Burke be sent a note thanking him for his letter
of application and advise him, since there are no openings at this time, his
letter will be kept on file.

Lake Level, Flow and Precipitation Summary for September 1987.
Lake levels in Lake Minnetonka have continued to decline through the month of
September as illustrated by the attached graph and lake elevations. There has
not been any discharge from Lake Minnetonka since November of 1986. Minnehaha
Creek at the Browndale Avenue Dam in Edina has maintained a flow of
approximately 5 cfs throughout most of September. This is shown by the monthly
flow summary, o
The 30 year average precipitation for September at the N~tional Weather Service
station in Maple Plain is 2.83 inches. The actual precipitation recorded in
Wayzata for September was 1.44 inches. A summary of precipitation is attached.
