The City Council of Mound, Hennepin County, Minnesota, met in
regular session on Tuesday, September 27, 1988, at 7:30 P.M., in
the Council Chambers at 5341 Maywood Road, in said City.
Those present were: Mayor Steve Smith, Councilmembers Don Abel,
Liz Jensen, Phyllis Jessen, and Skip Johnson. Also present were:
City Manager Edward J. Shukle, Jr, City Clerk Fran Clark, City
Attorney Curt Pearson, City Engineer John Cameron, Water & Sewer
Superintendent Greg Skinner, Street Superintendent Geno Hoff,
Building Official Jan Bertrand, and.the following interested

MOTION made by Jensen, seconded by Jessen to approve the
minutes of the September 20, 1988, Regular Meeting, as sub-
mitted. The vote was unanimously in favor. Motion carried.
PUBLIC HEARING: DELINQUENT UTILITY BILLS
City Manager Ed Shukle explained that the revised amount was
$3,145.48. The Mayor opened the public hearing. There was no
response. The Mayor closed the public hearing.
Johnson moved and Abel seconded the following resolution:

The City Attorney stated that an appraisal was done and the ap-
praisal indicated that the Mr. Hoese's property benefited by the
amount of the assessment.

STREET IMPROVEMENT - REMAINDER OF DRUMMOND ROAD
The City Engineer explained that the City has received a petition
for upgrading the remaining unimproved portion of Drummond Road,
west of Amhurst Lane by construction of a 16 foot wide bituminous
road with bituminous curbs. The cost of this would be shared by
the three property owners on the petition along with the City
which also owns abutting property. He has received bids on this
project and they were as follows:
Preferred Paving $5,265.00
G.L. Contracting $4,463.00
The total cost of .the project, including the City's expenses,
i.e. engineering, legal, fiscal and administrative costs, is
.$4,900.00. He then presented the preliminary assessment roll
that would be assessed in 1989.
Janet Nelson, 4828 Island View Drive, stated that she is opposed
to the paving of the remainder of Drummond Road. The City En-
gineer pointed out that Mrs. Nelson was not being assessed for
this project.
Johnson moved and Abel seconded the following resolution:

A. 1988 CBD PARKING MAINTENANCE ASSESSMENT
The City Manager explained that he has only had one objection to
this years CBD Assessment and that came from John Bierbaum of
Commerce Place. The City Manager explained that Commerce Place
maintains their own parking lot entirely. He then explained he
has contacted Mr. Bierbaum who has agreed to pay this year's
assessment, but he will be coming to a future Council Meeting to
request that this property be removed from the CBD parking main-
tenance district.

The Mayor asked if there were any comments or suggestions from
the citizens present.

storage area next to City Hall.

Phil Haasch, 4810 Northern Road, suggested the Council use the
Westedge Blvd. site for materials storage. The Council explained
that site has been sold.
Neil Anderson, 5413 Church Road, suggested the Council look into
sharing an already existing site with another municipality.
Jeanette Gellman, 3056 Highland Blvd. suggested using the parking
lot behind the Post Office for materials storage.
CONTINUED DISCUSSION: 5440 LYNWOOD BLVD./PARKING FOR EMPLOYEES
The City Manager reported that he has contacted Bill Clark Oil
and Balboa regarding parking for the public works employees.
Bill Clark Oil stated they do not have any space available. Bal-
boa is willing to lease 10 spaces on a month to month basis for
$250.00 per month or $25.00 per space.
There was discussion on other options i.e. using the Central
Business District parking lot across from the Post

Office, Parking at the Lost Lake materials storage site and car-
pooling to the public works facility.
MOTION made by Johnson, seconded by Smith to authorize the
City Manager to negotiate a lease with Balboa Corporation of
Minnesota for 6 parking spaces at not to exceed $25.00 per
space per month. The vote was unanimously in favor. Motion
carried.
The Council then discussed what to d9 with the house at 5440 Lyn-
wood Blvd.
MOTION made by Smith, seconded by'Johnson to place the City
owned house at 5440 Lynwood Blvd. on the market for sale at
the same price the City paid for it or the appraised value,
if that is higher. The vote was unanimously in favor. Mo-
tion carried.

The City Clerk explained that these are assessments for which
waivers have been signed.

The Building Official explained the request and stated that the
Planning Commission recommended not approving this request be-
cause the sign is almost double the size allowed in a residen-
tially zoned area.
The Council discussed the request ~n~ reviewed the zoning map.
It was discovered that.-part of this property is in the B-1 zoning
district (central business district).
MOTION made by Johnson, seconded by Abel that a sign permit
be issued to the Bethel Methodist Church as requested, but
that the sign can only be placed on the portion of property
that is zoned B-1. The vote was unanimously in favor. Mo-
tion carried.
MOTION made by Johnson, seconded by Smith to refund the
$50.00 variance application fee to Bethel Methodist Church
because a variance was not required. The' vote was unanim-
ously in favor. Motion carried.

The Building Official"explained the request. The Council dis-
cussed rezoning the lots to R-3. The Council decided that be-
cause the lots are within the allowable 10% lot area for the R-1
zoning they would approve a lot size variance. The builder
stated he would only build 2 single family homes on the lots.
The Council discussed the following conditions 'for the
subdivision:
1. The existing house which appears to straddle the two
new lots shall be removed.
2. The applicant shall coordinate utility access to the
site with the City Engineer and prepare any easements
necessary for the installation of serwices.
3. The applicant shall prepare a legal description of the
proposed lots that is in a form acceptable to Hennepin
County. 'A copy of the legal description shall be sub-
mitted to the City Engineer for review prior to filing
with the County.
4. The applicant shall pay the unit charge for street of
$1,768.45.
5. The applicant will come in after the houses are built
and apply for a rezoning to bring all these lots under
i zoning district.

The City Attorney explained that he and the attorney for the
State Bank of Mound, Bill Koenig, have worked out an escrow
agreement and two Quit Claim Deeds, A & B. Mr. Cossette has ap-
plied for a conditional use permit. Conditions for the CUP have
also been drafted. These conditions have been added to Quit
Claim Deed B. Mr. Koenig will file the appropriate deed upon
completion of the CUP process.

The City Manager explained that Susan Morrisey has requested that
the City repair or replace her fence next to Belmont Park because
she contends the children who use the park are destroying it.
The Park Director reviewed the situation, took pictures of the
fence and is of the opinion that this fence is deteriorating due
to rot or weathering. This fence is also on private property.
The Council took no action on this item.

The City Manager highlighted the proposed 1989 proposed Budget,
General Fund and Enterprise Funds. The Council decided to res-
chedule the Budget Hearing to Monday, October 3, 1988, at 6:30
P.M.
PAYMENT OF BILLS
MOTION made by Abel, seconded by Jessen to authorize the
payment of bills as presented on the pre-list in the amount
of $163,019.42, when funds are available. A roll call vote
was unanimously in favor. Motion carried.

MINUTES - MOUND CITY COUNCIL - SPECIAL BUDGET HEETING
The City Council of Mound, Hennepin County, Minnesota, met in
special session on Monday, October 3, 1988, at 6:30 P.M., in the
Council Chambers at 5341 Maywood Road, in said City.
Those present were: Mayor Steve Smith, Councilmembers Don Abel,
Liz Jensen, Phyllis Jessen and Skip Johnson. Also present were:
City Manager Edward J. Shukle, Jr, City Clerk Fran Clark,
Finance Director John Norman, Fire Chief Don Bryce, Police Chief
Len Harrell, Street Superintendent Geno Hoff, Sewer & Water Su-
perintendent Greg Skinner, Park Dirgctor Jim Fackler, Liquor
Store Manager Joel Krumm, Building Official Jan Bertrand, Recy-
cling Coordinator JoYce Nelson and the following interested
citizens: Andrea Ahrens, Bob Koenig and Parker Hodges.
The Mayor opened the meeting and welcomed the people in atten-
dance.
LOST LAKE PARK DEVELOPMENT PLaN
The City Manager handed out a memo outlining a schedule of how
this study will progress.
1989 PROPOSED BUDGET
FIRE ' DEPART){ENT
The Fire Chief reviewed his budget with the Council.
The Fire Chief asked for approval from the Council for the
firemen to use a 3 1/2" blinking red:light in their cars when
responding to fire calls.
MOTION made by Smith, seconded by Johnson to allow the pur-
chase of a 3 1/2" blinking red lights. These lights to be

used = .-the cars of firemen responding to fire and rescue
calls. The lights to be allowed with the understanding that
the firemen cannot ignore the traffic laws when the lights
are used. The vote was unanimously in favor. Motion
carried.

RESOLUTION TO APPROVE THE FINAL PLAT OF SETON VIEW

WHEREAS, the final plat of Seton View has been submitted in the manner
required for platting of land under the City of Mound Code of Ordinances,
Section 330 and under Chapter 462 of the Minnesota State Statutes and all
proceedings and have been duly conducted thereunder; and
WHEREAS, the City Council on March 10, 1987, held a public hearing pursuant
to Chapter 3, Section 330:30 of the City of Mound Code of Ordinances, to
consider the approval of the preliminary plat for Seton View located on

Plat approval is granted for Seton View as requested by William and
Oudith Niccum upon compliance with the following requirements:
1. As per final plat, Exhibit "A".
Completion of the requirements and conditions listed in
Resolution No. 87-43 approving the preliminary plat.
The Developer is to sign a Development Contract and furnish to
the City a performance bond or bonds in the amount of
to cover grading, drainage and utility construction, as per plans
approved by the City Engineer.
Approvals are to be submitted from all agencies requiring review,
such as MCWD, MPCA, Minnesota Health Department, DNR, Hennepin
County Highway Department, etc.
Submission of any additional escrow funds as necessary to defray
City costs for Engineering, Legal and Planning Fees that may be
charged against said account under City Ordinance Section
~0:145, Subdivision 2.
City Attorney's title opinion approval.
Three (3) deficient street unit charges of $1,828.15 per unit for
a total amount of $5,484.45 shall be paid.
Park dedication in the amount of the fee which is applicable at
the time of building permit issuance but in no case less than
$300.00 per dwelling unit.
That the City Clerk is hereby directed to supply a certified copy of
this Resolution to the above named owner and subdivider after the
completion of the requirements for their use as required by M.S.A.
462.358.
That the Mayor and City Manager are hereby authorized to execute the
certificate of approval on behalf of the City Council upon compliance
with the foregoing resolution.
D. This final plat shall be filed and recorded within 60 days of the .date
of the signing of the hardshells by the Mayor and City ~anager in
accordance with Section 3~0 of the City Code of Ordinances and shall
be recorded within 180 days of the adoption date of this Resolution
with one copy being filed with the City of Mound.
BE IT FURTHER RESOLVED that such execution of the certificate upon said
plat by the Mayor and City Manager shall be conclusive showing of proper
compliance therewith by the subdivider and City Officials and shall entitle
such plat to be placed on record forthwith without further formality, all in
compliance with M.S.A. 462 and the City of t4ound Code of Ordinances·

wildlife pond approved under Permit #87-6281, to remove the island
shown on the plans, and to include 200 additional feet of riprap along
the main shoreline.
The Department has received no negative comments regarding your
proposal, the .only concerm being the control of purple loosestrife.
Therefore, Permit #87-6281 is hereby amended to allow for the enlarged
pond as showm on the plans received November 9, 1987 (excluding the
island) and to riprap 200 additional feet of mainland with the
condition that the applicant follow Department of Natural Resources
guidelines for purple loosestrife (contact Steve Oie, DS~ Section of
Fisheries at 296-2959). Ail other, terms and conditions of the permit
shall remain in full force and effect.

AGREEMENT BETWEEN THE CITY OF MINNETRISTA AND THE CITY OF MOUND
RELATIVE TO PROVIDING UTILITY SERVICE TO A MINNETRISTA PROPERTY OWNER
THIS AGREEMENT, made and entered into this day of
1~, by and between the City of Minnetrista, a municipal corporation, of the
County of Hennepin and the State of Minnesota, hereinafter called
"Minnetrista", and the City of Mound, a municioal corporation of the County of
Hennepin and State of Minnesota, hereinafter called "Mound" and Lois B.
Sandquist and Earl D. Sandquist, the Owners of property described as the East
172 feet of Government Lot l, except the South 478.5 feet of the East 66 feet
thereof, Section 15, Township ll7 North, Range 24 West of the 5th Principal
Meridian, hereinafter called the "Owner".
W ITNESSETH:
WHEREAS, Mound has inplace a sanitary sewer line within 100 feet of the
Mound City limits along its boundary with Minnetrista; and
WHEREAS, property in Minnetrista described as the East 172 feet of
Government Lot l, except the South 478.5 feet of the East 66 feet thereof,
Section 15, Township ll7 North, Range West of the 5th Principal Meridian is
isolated from existing sanitary sewer in Minnetrista and is owned by the Owner
who wants to connect to City sewer; and
WHEREAS, Mound has indicated that they will allow a sanitary sewer
connection to the Mound inplace line so that the existing home on said property
in Minnetrista can be served by said service; and
WHEREAS, the parties have mutually agreed that it is in the best interest
of all parties to provide sanitary sewer service from the Mound system to the
Minnetrista property owner, and that Minnetrista and the Owner of said property
will pay to Mound the following established amounts and will abide by the rules
and regulations established for the Mound system and as set forth in this
Agreement,
NOW, THEREFORE, in consideration of the mutual covenants and agreements
herein described,
IT IS HEREBY AGREED as follows:

The entire cost of the service connection shall be borne by the Owner
of said property requesting the connection.
Within the limits established in this agreement, the property owner in
Minnetrista shall be allowed to connect to and become part of the
sewer system of Mound, and shall be subject to the same charges and
regulations as property owners of Mound.
Prior to the time that the property owner connects to Mound's sanitary
sewer system, said Owner shall pay to Mound the availability and
connection charges as follows:

The Owner in Minnetrista connected to the Mound system shall be billed
usage charges on the basis of the same sewer rates applicable to users
in Mound, said charges to be billed directly to the user in Mound.
Minnetrista shall guarantee payment of these charges, subject to the
cooperation of Mound in providing information to Minnetrista which
will allow Minnetrista to specifically assess unpaid sewer use charges
against the Minnetrista property.
The Owner in Minnetrista connecting to the Mound systems shall be
required to obtain a construction permit from Mound for a sewer
connection and shall pay all connection fees in the same amounts and
manner as Mound residents.
Mound shall not be responsible to any person, firm, or corporation for
damages claimed as a result of backing up of sewers in any basement in
Minnetrista.
Mound will perform all normal maintenance on the sanitary sewer main
lines within the Mound corporate boundaries. Minnetrista and/or the
property owner will perform all normal maintenance on the above
described property sanitary sewer line within the Minnetrista
corporate boundaries.
Construction of the service line shall be the responsibility of the
Owner in Minnetrista and under the auspices of Minnetrista.
All sanitary sewer construction by Minnetrista and the Owner in
Minnetrista shall meet the requirements of Mound's Sanitary Sewer
Standard Specifications, and any special provisions deemed necessary
by the Mound City Engineer.
10.
Mound agrees to cooperate and make available any and all records,
plans, specifications, and other materials which may be necessary for
Minnetrista.
11. The Residential Equivalency Unit (REV) charged by the MWCC for this
hook-up shall come from the City of Minnetrista's allotment.
IN WITNESS WHEREOF, the parties have hereunto authorized and entered into
this Agreement upon authority of the City Council of the City of Minnetrista
and the City Council of the City of Mound.

WHEREAS, the applicant has applied for a variance to construct a
new home within 6.7 ft. of the rear property line abutting a
dedicated private boulevard to The Bartlett Place plat For Lot

WHEREAS, the R-2 single family zoning district requires a 15 Foot
rear yard and the property is not defined as Lot, Lakeshore under
the definition of the zoning code which would require a 50 foot
setback to the Ordinary High Water elevation of 929.5 N.G.V.D. to
the water; and
WHEREAS, the existing structure is setback 50 feet from the Ordi-
nary High Water elevation of the lake which will be removed and

PROPOSAL: The applicant is proposing to construct a new home
within 6.7' of the rear property line abutting a dedicated
boulevard commons to The Bartlett Place Addition.
COMMENTS: The R-2 zoning district requires a t5' rear yard set-
back when the property is not reparian to lakeshore. The
proposal indicates the 50' setback from the ordinary high-water
elevation. However, due to the commons, which is dedicated to
The Bartlett. Place the new home would be approximately 2' closer
to the.south lot line than the present structure. The applicant
is proposing to remove both the detached garage and the existing
home on the lot and replace them with new structures. At the
present time, there is a granite retaining wall and a small shel-
ter building out on The Bartlett Place boulevard property. The
side yard, front yard and lakeshore setback is in compliance with
the R-2 zoning district as well as the lot area and lot width.
RECOMMENDATION: The line of site of the homes, puts the homes
abutting his property in line with the existing-structure. Taking
the average of the two homes, the applicant is concerned with the
lake view if the 15' setback is maintained to the property line.
I have discussed the application for the vacation of The Bartlett
Place boulevard to the applicant arid woula suggest that he
proceed with an application for a vacation. The

property owners. If= The Bartlett Place boulevard is vacated, the
50' setback wou)d be most restrictive. Unless the vacation of

WHEREAS, the City Council of the City of Mound is the
governing body of the City of Mound; and
WHEREAS, the City Council has received two resolutions
from the Housing & Redevelopment Authority of the City of Mound:
one entitled, "Resolution Approving the Mound Housing and
Redevelopment Authority Budget for the Year 1989 Pursuant to MSA
Chapter 462.545, Subdivision 6" and the other entitled,
"Resolution Establishing the Tax Levy for the Mound Housing and
Redevelopment Authority for the Year 1989"; and
WHEREAS, the City Council, pursuant to the provisions
of MSA 462.545, Subdivision 6, must by resolution consent to the
proposed tax levy of the Housing and Redevelopment Authority of
the city of Mound.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Mound, Minnesota, that a special tax be levied upon
real and personal property within the City of Mound in the amount
equal to one-third of a mill, not to exceed $24,000.
BE IT FURTHER RESOLVED that the said one-third mill,
not to exceed $24,000.00 is approved by this Council to be used
for the operation of the Mound Housing & Redevelopment Authority
pursuant to the provisions of MSA 462.411 thru 462.705, and shall
be certified as a tax levy to the County Auditor of Hennepin
County on or before October 25, 1988.

Several months ago I discussed with the owner's, husband, Bret
Hagge, what he needed to do to split his existing tax parcels of
Lots 3 and. 4, Block 1, Batdorf's First Addition. I told him
during our phone conversation he needed to comply with the zoning
ordinance requirements Section 23.40?, Item 1, which states "no
accessory building or structure shall be constructed on any
residential lot prior to the time of construction of the prin-
cipal building to which it is accessory."
Ms. Gron)and has a detached garage on their property which is lo-
cated on north Lot 3, which will need~to be removed or relocated
prior to lot separation approval by the Inspection Department..
also told Mr. Hagge that he could proceed to apply for separation
of these tax parcels and then proceed to come to my office and
app)y for a demolition or moving building permit, with his only
other option being a variance granted by the City Council to al-

At the October meeting of the Mound City Council, action was
taken and passed by a 3 to 2 vote to override and change the
recommendation on the proposed 1989 dock fees. The proposed
increases by the Dock Inspector, Park Director and Finance
Director were part of a 5 year program to make the Mound Dock and
Commons self supporting by 1992. This program was prepared and
implemented in 1987 after.many hours of thought and preparation
by this committee. It was examined by the City Manager and Park
Commission and presented to the City Council for action on a year
to year basis.
After two years, the program has increased its income
considerably, is ahead of the projected amount, and has funded
some excellent improvements of rip-rapping, dredging and other
maintenance. Many par.tieipants in the dock program have offered
fine compliments after years of no improvements on the Commons by
the City. Dock site holders have accepted the idea of a minor
increase in .fees each year in order to maintain the Commons. It
is difficult to understand the wisdom of the City Council action
to disturb this well working 5 year plan with an additional fee
increase for what appears to have no specific reason.
I believe that elected officials have a responsibility to Staff
and Contract workers, as well as the residents of Mound, to honor
their thought-out proposals and efforts to do their jobs
effectively and with a feeling of self satisfaction.
I know that the elected Park Commissioner defended the 1989
requests'as she was well informed on its contents and objectives.
Action to change the proposed dock fees an additional $5 across
the board was taken in spite of this. It is very defeating to
those involved on a day to day basis to have this happen. I hope
in the future, these thoughts will help change this attitude and
promote harmony.

1989 TAX LEV~
The 1989 budget contains a tax levy of $1,351,245, which is down
$65,762 from the 1988 levy. The main reason for the decrease is
the large increase of local government aid. The calculation of
taxes was changed by the legislature for 1989 taxes. The old
mill rate system is gone (the mill rate would have gone from
20.18 to 18.67) The new tax system will see certain classes 'of
ta.xpayers have their taxes go up, while others will go down.
What we can conclude is t~at the overall tax burden (City share
alone, not school district or county) on the taxpayers in Mound
will go down. It will be very interesting to follow the next
legislative session. There will be heavy pressure to reform the
tax reform legislation of 1988.
COMMERCE TAX INCREMENT BONDS
We made the first principal payment on the $2,100,000 tax
increment bonds of 1985. Prior to the last payment, all payments
were for interest only. The levy decrease for 1989 will cause
the tax increment revenue to decline slightly. However, the
decline will not be large enough to jeopardize the payment of the
tax inc~ement bonds. I will monitor the tax increment revenue
and report any significant changes to you.

September's Activity Report
This months report will not have any statistics. The reason is we do
not have all ihe papers, out of t'he boxes from the move from the old
shop to the new facility.
The County Road 15 project, the budget and preparing for the move took
up the bulk of our time this month. The final paving of County Road
15 is slated for October 1.
The repairs on the motor for Well #7 have been completed and is now
ready :o be put back in service.

Monthly Report for September, 1988
STATISTICS
The police department responded to 823 calls for service
during the month, of September. There were 29 Part i offenses
reported. Those offenses included 7 burglaries, ]8 lar-
cenies, 1 arson, and 3 vehicle thefts.
There were 70 Part Il offenses reporteO, Those offenses in-
cluded 2 child abuse/neglect, 1 forgery/NSF checks, 10
criminal damage to property, 1 weapons violation, 1 nar-
cotics violation, 6 liquor violations, lO DWi, 5 simple as-
sault, 14 domestics (4 with assaults), 6 harassment, 3
runaway/ truancy, and ll miscellaneous other offenses.
The patrol division issued 225 adult-citations and 20
juvenile citations. Parking violations accounted for an ad-
ditional 31 citations. An additional ]62 warnings were
issued during the month.
Two adults and four juveniles were arrested for felonies in
September. Twenty-four adults and twenty-one juveniles were
arrested for misdemeanors.
The deoartment assisted in 8 vehiclular accidents, 2 with
personal injuries. There were 35 medical emergencies and 99
animal complaints. Officers assisted surrounding agencies
on mutual aid calls 24 times in September.
Property valued at $]0,202 was stolen during the month and
$2,745 of that was recovered.
Il. INVESTIGATION
Two child protection cases were investigated during the
month of September. The.department has investigated 50
child protection cases since the first of the year·
Other cases investigated included several check cases, a
child aL)duct, ion, a criminal sexual conduct case, two as-
saults, an auto %heft, minors in possession of alcohol,
burglary, ~nO damage to property.
MOIJND POLICE DEPARTMENT
MONTHLY REPORT - SEPTEMBER, ]988
Investigator Grand is spending three days per week in the
schools. Presentations are being made to students in health
classes and "Officer Friendly" presentations are being made
in the lower grades. A contest has been started in the
elementary schools to name our new robotic car.
'Formal complaints were issued for fourteen cases involving
depriving another of parental rights, bribery, theft, as-
sault, DWI, possession of a controlled substance, worthless
cr~ecks, no license, speed, dog at large, and criminal damage
to property.
MANPOWER:
The department used approximately 50 hours of overtime
during the month of September. A good portion was for a
required training course for all officers.
Officers earned about 50 hours in comp-time in September and
used over' 40 hours during the month. Officers also used 14
days Of vacation, 9 holidays during the month.
IV. TRAINING
All police personnel attended a four hour course on sexual
harassment in September.
Two officers attended a decision shooting course sponsored '
through Alexandria Vo-tech at a local range.
V. RESERVES
The Police Reserves donated approximately 343 hours during
September. They assisted in the Muscular Distrophy
Telethon, 4 footbal games, 2 dances at the Communitv Center,
and the Officer Freindly Program. Four reserves az'tended a
First Responder School.
The Police Reserves held their fourtf~ successful annual
benefit dance.

The bulk of shop time this month was taken up by preparing to move to
the new Public Works Facility.
We bought raw steel and built a new work bench and cutting edge rack.
The remaining time was used to clean and pack materials and inventory
to be moved.
We engaged the company that installed the hoist in the old shop to move
it to the new shop because it's still under warranty.

Recycling Coordinator
September's Recycling
At the Recycling Task Force meeting on September 22 the Task Force
recommended to pay 50% of the container cost up to a maximun of $5.00
per household. Also at this meeting it was decided that Met Council
will be responsible for developing an awarness of recycling to the
general public in the Twin Cities Metropolitan Area.
This Saturday, October 8 the compost site will be open from 9:00 a.m.
till 5:00 p.m. for about the next 5 - 6 weeks.
I've been trying to get ahold of the other members of our Recycling
committee ~o see if they woUld be interested, one person is for sure.
We might have to place an article in the paper to get more interested
parties.
The apartment complexs seem to be doing real well with their containers.
September's recycling as 19.50 tons and 484 households.

September's Activity Report
We spent the first 10 days of the month checking every street in town to
see that we didn't have any gate valves or manholes that were above the
blacktop grade. When we did find the high ones we covered the exposed
edges with a blacktop patch to prevent the snowplows from hitting them.
This might be the last of the blacktoping for this year unless the weather
warms up in October.
We did some more sidewalk repair at the corner of Three Points and Commerce
Blvd. It looks like a truck cut the corner and drove on the sidewalk, thus .
breaking down 3 sections of concrete. The street crew removed the old
sidewalk and Bob Lycholm framed and poured the new one, $224.00. We have
some more sidewalk work to take care of in front of the Catholic church will
take care of it next mont~.
When the City sold the Westedge property it was with the understanding that
the City would provide a driveway from Westedge to his property. We put
in a driveway 35' long and 14' wide, 4 loads of 3/4" to dust and a 20'
culvert. It took about a half a day to do the job.
We had Widmers being in a backhoe for a day to do some ditching at the storm
sewer outlets.
We finished out'the month moving out of Balboa and into our new facility,
we were out of Balboa the 3Oth.

The City had 2 regular Council Meetings, in September with 2 new
ordinance and 37 resolutions. There was Agenda preparation for
each meeting and items to clear up after each meeting.
Preparation for the Primary Election on September 13th was done.
Linda and I conducted two training sessions for the Election
Judges, one in the afternoon and one in the evening. Linda in-
ventoried and ordered all supplies needed for each precinct. A
test deck of ballots was prepared for each precinct and each
machine was tested for accuracy. The city was open for absentee
voting on the Saturday before the election from 1:00 P.M. to 3:00
P.M. and again until 7:00 P.M. on the Monday before the election.
On September 12th each precinct was set-up (all voting booths and
miscellaneous supplies), keys were obtained for the various
precincts and the Precinct Chair People came to pick up their
materials. This was our first time using the new Optec III-P
equipment and everything ran smoothly. The company we purchased
the machines from sent 6 technicians in to cover Hennepin County
and we were fortunate to have one in Mound covering the lake area
communities. The technician will be here again during' the
General Election.
Notices were prepared, published and sent to all residents
proposed to be assessed for the following improvement projects:
County Road 15 Street Improvement, County Road 15 Street Light
Improvement, Drummond Road Storm Sewer & Street Improvement, CBD
Parking Maintenance, Delinquent Sewer & Water Bills, Unpaid
Mowing Charges, Unpaid Weed Removal Charges, and Unpaid Tree
Removal Charges.
Resolutions were prepared for all the above proposed assessments
and the following supplemental assessments:
Supplemental Assessments - Levy #'s 11164 to 11166
Resolutions were prepared cancelling 6 levies for which money is
available to make the bond and interest paYments in 1989.
The finishing touches were put on the proposed 1989 Budget.

Well, the inevitable finally happened. Sales went from $86,056
in August to $76,986 in September. We are still continuing along
an upward trend, however. In 1987, September's sales were
$70,685. After the third quarter we are $71,740 ahead of last
year. I am anticipating (conservatively) that we should end the
year somewhere in the vicinity of $80,000 over last year. Don't
anyone quote me on this or take it to the bank!
"Murphy's Law" struck agai'n. On Tuesday morning, September 20th,
I opened the store and stepped into a nightmare. The previous
night we had a rare rainstorm of 1 1/4". Our roof decided it was
time again to play havoc on the store. "Squish-squish, slop-
slop, drip-drip!" I should have worn my golashes. Water was
literally raining in everywhere: above the cash registers, into
the beer cooler (looked like the everglades in there), in the
backroom. I mean it reminded of a Beirut scene. At first I was
stunned. Was I in the right place? Then I began to laugh. Things
like this typically seem to follow me around for no particular
sane reason. Then I decided I had had it~. I was furious! I
called~up our property manager and spewed forth an oratory that I
am sure would not have been appropriate for a prime time
televis.ion debate. I finally came to my senses. I called up Ed
and invited him over to view the premises. He probably wishes
today he had brought an umbrella. Well, Ed, being the busy man
he is, .and with an important council meeting scheduled for that
evening, asked, "How can I help, Joel?" "I need buckets", I
exclaimed. So Ed called Jim Fackler. And Jim, being the nice
fellow he is, had one of his employees bring over several buckets
which were emptied many times that day because the water
continued to come in for a couple of .days.

The rest of the day was spent using the wet vac, cleaning off
bottles, taking down soggy ~nd d~ngerous ceiling tiles, etc. No
great damage to report. Just to my ego. As of this very day,
the roofers are still repairing the infamous roof. It seems that
the new roof that was put up two years ago was done improperly
(obviously) by non-union roofers, who today our landlord tells me
are out of business. I suggestd to the owner that in the future
he take a good look at employing reputable contractors instead of
always accepting the lowest bid. The guy who is working up there
now is doing good work. He tells me it leaks like a sieve.
Tells me that their company bid on the new roof two years ago.
He tells me they were $10,000 over the lowest bid. Tells me they
would have guaranteed the roof for 20 years. I tell the
landlord, "You get what you pay for".
This ends the continious saga of the Pourous Roof.

GENERAL COMMENT
The Parks Department is now at two personnel on hand, Pat Cheney
and myself. At this time we are putting away equipment used this
summer and preparing equipment to be used this winter.
We have moved all of the Parks equipment from .the Balboa storage
area over to the old Public Works garage on the Island. The
Parks. Department will be working out of this site from now on.
TREE REMOVAL
We have done more trimming of the area west of the Depot building
at Mound Bay Park. This cleaned up an area that was overgrown
with low hanging branches and vines.
There was one forced tree removal from a private residence.
PARKS
We have removed all picnic tables and trash containers from the
parks for winter storage. This year we have improved a storage
area at the west of the Depot, under the roof, for picnic table
storage. This will keep them out of the rain and snow which
caused a lot of wood rot in the past. The parks received a final
mowing and areas that we have done improvements in land fill have
been seeded.
DOCKS
There will be one final viewing.of the dock areas this year. It
is done late in the year to observe how the docks have been
stored.
The 1989 rip rapping will be done along Brighton Commons. There
is @n area about 1500 Ln. Ft. that will be contracted out this
winter that is located along Cambridge Lane. The City crew will
do the area in front of Brighton.

September 1988 Monthly Report
During the month of September, we had 21 working days with one
holiday. I have taken one week vacation and one week at the In-
ternational Conference of Building Official's Education and Code
Development meeting in Seattle Washington. I would like to thank
the City Council for the opportunity to attend the conference.
The Inspection/Planning Department has had two Planning Commis-
sion meetings on September 12th and 26th, two City Council meet-
ings on September 20th and 27th with a special Task Force meeting
on September 29th. The Planning Commission received a tour of
the parks and zoning concerns to be addressed in the Comprehen-
sive Plan on Saturday, September 24th for five hours. Peggy
James also attended one Park Commission meeting on September 8th.
The City Planner, Mark Koegler, attended the Planning Commission
meeting the second week in September in my absence. The
Inspection/Planning Department conducted the following inspec-
tions during the month of September:

This list of inspections does not include 29 inspections con-
ducted by the substitute inspector during the month. There were
8 plan reviews completed during September. The monthly report
for August was submitted to the City Manager, as well as the nor-
mal 'correspondence, inspection notices and reports to the Plan-
ning and Zoning Commission.
The Planning Commission meetings in September reviewed three
minor subdivisions, one sign variance, and one public hearing for
zoning amendment and conditional use permit. The Planning Com-
mission reviewed the Shoreland Management as part of the Com-
prehensive Plan, and a letter from the City Attorney on the Hous-
ing Maintenance and Occupancy Draft Ordinance. The Planning Com-
mission had a tour on Saturday, the 24th of the areas of the City
with topics being unimproved roads, exterior storage problems,
multiple dockage, and home occupations.
There were three citations written in September for stop work or-
~ders, as .well as warning tags and correction inspection notices.
The Court has ordered removal of 2965 Oaklawn as of October 8th.
I have made arrangements with Public Works and the Fire Depart-
ment to proceed after the 8th of this month with removal and
cleaning up of the area.
I attended the regular staff meeting in September. I attended
the National Building Code Development and Education Seminar in
Seattle, Washington. Topics at the seminar were computer systems'
available to different municipalities and governmental agencies,
code review of spray-on fire proofing application, a plan review
session for non-structural plan review, as well as many proposed
Code changes to the 1988 edition of the 1988 Uniform Building
Code.
The City vehicle received a screw in a tire this month which
resulted in repair of a flat tire, winterizing of the vehicle
during my absence from the office, and the normal gasoline fills
during the month. The department also picked-up additional
photographic film.
The total number of building permits issued in the month of Sep-
tember was 45 with a valuation of $528,765. The valuation
figures are attached on the building activity report for August.

In addition, Peggy has prepared the monthly calendar for October
city meetings and events. She has arranged appointments for the
inspections of buildings, plumbing, and the substitute inspector.
She did prepare the Planning Commission agenda for September 12th
and 26th, and has written the minutes. She has completed the
Park Commission agenda and minutes as well as correspondence for
the Building Official and Park Superintendent. She did attend a
tour that the Planning Commission had on September 24th.
* Site inspections include the review of the Planning Commis-
sion requests and requirements, site inspections for flood plain
verification, complaints and follow-up to code compliance such as
no building permit, recheck of exterior storage compliance
notices, review status of various sites for the city prosecutor,
preconstruction meetings at the site for building permit applica-
tions or realtors, fire damage and periodic commercial inspection
updates.
** · The heating inspections during the construction of a project
are included under the framing and final inspection of the build-
ing. The heating installations mentioned are for separate equip-
ment being placed in homes and businesses.
NOTE:
,'When workmen came to demolish our old porch and build
a new one, they had a number of power tools that needed
to be plugged into the outlet in our house. Each morn-
ing we,d open the door 'for them to slip an extension
cord through the mail slot, and later in the day they
would unplug it. Early one afternoon they knocked on
the door to say they had to rent a piece of equipment
that was available only at ? a.m. the next morning.
,,Ma'am, if you don't mind," said one of the men, ,,we,d

PRESIDENT'S MESSAGE
Happy fall to ~ll of you! I'm sure the ~d o~ our hot, /Lot weak, er
is ~ w~come to you as it is to me. I hope that anyone who ca~ch~ me
complaining about the cold ~is winter stamps on my toe.
It's t~e to fi~_ .you in a little better on t:he reasoning behind
our ~tablishment of the W~tonka Sen~or Citizen's Foundation (or, to
save space, the Foundation or W.S.C.F.).
Senior Citiz~ Cent~ are funded by a va~ety of government funds
and organization, wI~ch in ~ turn' are funded by other sources.
City, county, state and Federal funds are allocated £o w~rious purposes.
The Volunteers of ~erica subsidize our lunch progr~ and ~hey are in
tu~u~, subsidized. They need our contributions as w~_, to keep ~e
program solv e~.
It has become apparent, with the growing demands upon ~ the sources
of funding, that at some future date we may not receive sufficient ~unds
to keep o~r Center alive for the future Seniors. We're not talking next
year, but maybe 15-20 years'down ~e line. We fe~ ~at Senior programs
~re of such a great benefit that we do not want them to have to stop.
Therefore, the Foundation!
We hope that through gifts of all sor~s - Memorials to departed loved
ones, honors to persons we appreciate, just plain gifts to a good cause -
we can accumulate a large fund. When ~ fund has grown and we need
money to keep the Cedar viable, we will be able to use the interest for
t~ purpose~.
Many of us who will be contributing to the Foundation now, or in
coming years, will not live to see the day it must be ~ed. We know that
is ~ue! We ~e working and giving for fu~e Seniors - some of whom at
~s. time are our own ~'~b~dren and grandchildren.
This is the legacy we are giving for ~at future!

Land Use
Question
Should the League support the passag, e of a recodified,
unified, and modified land use planmng law?
Background
The League has been cooperating and.participating in a review of the municipal
land use planning statutes. The Governor's Advisory Council on State-Local Rela-
tions is conducting that review. That effort has produced draft legislation which
was initially before the 1988 Legislature.
The draft legislation makes' many substantial changes to the current planning and
zoning statutes (Minnesota Statutes, Chapter 462). These changes would require
the creation of a separate board of adjustment (city councils would not be able
to issue variances, but could only review the action of the board of adjustment
on appeal); modify the definition of undue hardship required for issuance of
variances to a lower, easier to meet standard of undue difficulty, require the adop-
tion of a brief comprehensive plan as a prerequisite of adopting zoning or other
official controls, and; prohibit the practice of conditional zoning where a city
agrees to rezone a parcel of property but only if the owner complies with certain
conditions. The legislation also authorizes cities to impose impact fees on develop-
ment in order to pay for infrastructure improvements.
Current League Position
· The League supports selected amendments to the existing planning enabling
statutes and opposes proposals that restrict cities' current substantive and
procedural flexibility to address unique circumstances.
Argument
Should the League support the passage of a recodified,
unified, and modified land use planning law?
Yes
The legislation would unify the local
government planning statutes making
land use control powers and
procedures easier to teach and learn.
It would clear up existing ambiguities
in the law, p::ovide additional author-
ity to cities in some regards, and at-
tempt to promote intergovernmental
cooperation among local units of
government.
No
The legislation would create as many
uncertainties as it would resolve, as
well as restrict cities' flexibility in
adopting administrative procedures
and structures that meet unique local
needs. Further, opponents of the
legislation argue that the current law
is not broken and there is no need for
substantial reform.'
