The City Council of the City of Mound, Hennepin County, Minnesota, met in regular session
on Tuesday, July 22, 1997, at 7:30 PM, in the Council Chambers at 5341 Maywood Road, in
said City.
Those present were: Mayor Bob Polston, Councilmembers Andrea Ahrens, Mark Hanus, Liz
Jensen and Leah Weycker. Also in attendance were: City Manager Edward J. Shukle, Jr., City
Attorney John Dean, City Engineer John Cameron, City Planner Bruce Chamberlain, Building
Official Jon Sutherland and City Clerk Fran Clark. The following interested citizens were
present: Glenn & Brenda Isaacson, Greg Smith, Diane Rosencranz, Chris Alverez, Brenda
Bedell, Jerry Mader and Joe Zylman.
The Mayor opened the meeting and welcomed the people in attendance. The Pledge of
Allegiance was recited.

The Building Official explained that the Planning Commission recommended approval. Since that time
it was discovered that there was an error made when the applicant drew in the hardcover on the survey.
There is additional hardcover on the site, which can be removed from the calculations and it may be that
a variance is not needed. Staff would like to work with the applicant to revise the placement of hardcover
on the survey. Then if a variance is needed it would go back to the Planning Commission for review and
recommendation.
The Building Official explained that the applicant calculated hardcover that was not on the lot. They
calculated their whole driveway and they did not need to calculate the area in the road right-of-way. There
was also a shed on the property that appears is nonconforming to setbacks which would require
recognizing. The applicant may move this shed which would then make it conforming. He has discussed
this with the applicant. If the hardcover is at 40% or less, the applicant would not need a variance.
The original Staff recommendation was for denial. The Planning Commission recommended approval,
finding that the hardcover could be calculated at 40% ratio rather than a 30% ratio.
The applicant expressed frustration with the process.
MOTION made by Hanus, seconded by Ahrens to table the request and have the applicant
go back in through either a survey or being able to identify the irons themselves to Staff's
satisfaction and have the information brought back to the Planning Commission.
The Council discussed the motion.
Hanus withdrew his motion and Ahrens withdrew her second.
MOTION made by Hanus, seconded by Ahrens to have the applicant go back in through
either a survey or being able to identify the irons themselves to Staff's satisfaction and have
the information brought back to the Planning Conmfission for further clarification, if
necessary. The vote was unanimously in favor. Motion carried.
MOTION made by Polston, seconded by Hanus to refund the variance fee to the applicant,

1.7 ADD-ON ITEM: ADVERTISEMENT FOR BIDS & SETTING BID OPENING FOR

The City Manager explained this is for three properties for the Auditor's Road hnprovement Project.
Suggested date is Wednesday, August 20, 1997, at 11:00 A.M.
MOTION made by Jensen, seconded by Hanus to authorize and advertisement for bids for
Building Demolition - Auditor's Road Improvement Project, for Wednesday, August 20, 1997,

1.8 CONTINUED PUBLIC HEARING: CONDITIONAL USE PERMIT,
WESTONKA SCHOOLS, SHIRLEY HILLS ADDITION. (PLEASE NOTE:
THIS HEARING SHOULD BE CONTINUED UNTIL A DATE CERTAIN
DUE TO THE CURRENT STUDY UNDERWAY REGARDING THE
FEASIBILITY OF RENOVATING THE EXISTING WESTONKA COMMUNITY
CENTER. (SUGGESTED DATE: AUGUST 26, 1997.)
The City Manager explained that on June 10th this Public Hearing was continued to this date. The purpose
of the continuance was to wait until the study was completed on the renovation of the existing Westonka
Community Center. That study is not completed yet as the committee is still meeting and a joint City
Council Meeting Mound/Minnetrista and the Committee who is studying the renovation will be held on
Thursday, July 24. This meeting will be to talk about where we are headed. Thus, the recommendation
is for the Council to continue this public hearing until Tuesday, August 26, 1997. The School District
agrees with the continuance.
MOTION made by Hanus, seconded by Ahrens to continue this public hearing until August
26, 1997. The vote was unanimously in favor. Motion carried.
COMMENTS AND SUGGESTIONS FROM CITIZENS PRESENT.

1.9 APPROVAL OF FINAL PLAT, MAPLE MANORS, JOE ZYLMAN
The Building Official explained that at the April $th Council Meeting the Council asked that the following
issues be addressed:
1. Get the balance of the escrow account. This has been resolved and the applicant has
submitted additional funds.
2. The commons area and the homeowners agreement. This is being resolved by the addition
of an Exhibit and wording change to the proposed resolution (Item//4).
3. gl0 of the conditions in the proposed approval resolution. There were some conditions
in the proposed resolution that had to do with the modification of the flood plain for
the holding pond. The Building Official and the City Engineer are conffortable with
the language in the resolution that we can get that elevation change modified on
the plat before it is filed.
4. The hardcover issue. Staff addressed that issue. A memo from the City Planner states
that a variance is not required because there is less than 30% hardcover on the whole
site.
5. The agreement with the Watershed District. The Watershed District Permit and
agreement issue has now been resolved. The letter from the Watershed District was
on Page 2714 of the packet.
The City Engineer presented the erosion control change in the development agreement and reviewed it with
the Council. There is a fee requirement of $500 for each lot to ensure that erosion control barriers and

all other steps required to be taken to control erosion have been taken and remain continuously in place.
This may be part of the Letter of Credit on the original development contract. This will save the developer
from having to come up with $500 each time he takes out a building permit.
The City Engineer reported that he and the Public Works Superintendent have reviewed the plans and specs
with the Developer. They had a pre-construction conference today and they are ready to finalize a few
of the minor things that were of concern. They will be furnishing a revised building plan and normal
submittals, i. e. the lift station, etc., then they will be ready to go.
The Council discussed the hardcover issue as it relates to a PDA or PUD. The City Attorney suggested
that typically any variances would be addressed in the resolution for the PUD or PDA. The Council asked
the City Attorney to address this hardcover issue.
The Mayor suggested that the Council move on to the next item on the Agenda and come back to Maple
Manors. The Council agreed.
1.10 APPROVAL OF CONSERVATION EASEMENTS, TEAL POINTE SUBDIVISION
City Planner explained that the final plat for Teal Pointe was approved in 1995. One of the conditions of
final plat approval was that Conservation Easements be established along the wetland edge for all the lots
in Teal Pointe. There are 9 lots in the subdivision and each had a conservation easement established 50
feet from the edge of the wetland, inland from that point. The conservation easements were drafted in
order to conserve the natural vegetation and topography along the wetland edge and among other things
they disallowed construction, tree removal, and excavation within those areas. The easement was not filed
with the County along with other plat documents. For whatever reason, this fell through the cracks. Now
all the lots have passed from the original developer into new ownership. There are a couple of issues to
look at this evening.
The conservation easement was determined at the time of the project being platted to be
a good tool to protect the evironrnent during and after development of the property.
The extent and restrictions of the conservation easement as originally drafted, make
development on some of the parcels nearly impossible. This was not discovered until some
of the building permits came into the city for review. The area of development is actually
very small and difficult to put a home on. Staff has reviewed the issue and spoken to the
current owners of the Teal Pointe lots, with the exception of the owner of Lot 5. All are
willing to accept a modified conservation easement on their property from what was
originally drafted.
The Planner stated that Lots one through three would have an easement applied exactly the
same as was originally proposed. In return for the easement on Lots one and two, the
owner would like assurance from the City that no additional review requirements would be
placed on the development of those lots. Lots four through nine would have a modified
easement applied to them. Lots four through nine the easement would change from a 50
foot area on the edge of the wetland to a 40 foot area. Lots four and five within that would

have the same management restrictions as the original easement. Lots six through nine
would allow necessary grading and tree removal to occur in the easement within restricted
limits and only during the initial construction of the home. Upon the Certificate of
Occupancy being issued, the restrictions on management of the easement area would revert
to the language originally drafted, so it would be mom restrictive.
The City Engineer explained that basically what's happening is that many of the lots that are being
developed are very difficult to develop with the existing conservation easement and what the City Council
is being asked to review and look at whether they would be willing to apply new conservation easements
with the approval of the property owners in that development. The way the original conservation easement
is worded it allows absolutely nothing to be done (grading, filling, fertilizing, weed spraying, etc.) in the
easement area. This makes some of these lots almost impossible to develop. Once the initial construction
is completed, then they cannot do further grading or tree removal in the easement area.
In Staff's opinion, the modified conservation easement meets the intent of the EAW but allows the property
owners enough flexibility to adequately develop the land.

1.9 APPROVAL OF FINAL PLAT, MAPLE MANORS, JOE ZYLMAN
The City Attorney reported that in something that is not a PDA type development you look at each
individual lot which is the clear intent of 350:1225, Subd. 6b of the City Code. The exception to that is
in the PDA provisions where you are looking at cluster platting where there will be portions of the PDA
where setbacks, lot area, density, hardcover with respect to an individual lot will not be met. Then the
question is, can you look at the subdivision as a whole? Unfortunately, them is nothing in Section 350:46
that specifically addresses that issue.
The Council discussed the common land that the Homeowners Association will have ownership of and
control over. The City Attorney advised that if anything was to be built upon that land, it would have to
come before the Council for approval.
A revised resolution was handed out for consideration. This included that erosion control paragraph in
the Developer's Agreement, the deletion of Paragraph 11, and the new Article XI Dissolution in the
Articles of Incorporation of Maple Manors Homeowners Association, Inc.

1.11 RESOLUTION AUTHORIZING APPLICATION FOR A
METROPOLITAN COUNCIL PLANNING ASSISTANCE GRANT

The City Manager explained that we are now required to update our comprehensive plan by December 31,
1998. In order to assist communities, the Metropolitan Council is making available grants and loans to
cover the costs of these updates. He and the City Planner are recommending that we apply for the funds
in both grant and loan form. The maximum amount under the grant is $20,000. The estimate for this is
between $30,000 and $60,000 because it also requires a stormawater management plan as well as general
land use issues. In the loan application we have figured $40,000 with 20% coming from the City. This
is an interest free loan.

A. Financial Report for June, 1997 as Prepared by Gino Businaro, Finance Director.
We have received verbal communication from the Minnehaha Creek Watershed District (MCWD)
that the Proposed Cooperative Agreement that you recently approved has been approved by the
MCWD at their Meeting of July 10, 1997. We are awaiting receipt of the approved document.
In addition, please note that under Item//6 above, the MCWD has eased its requirements regarding
Cooperative Agreements since they recently established a Task Force to Study Rule B.

Notice regarding the joint Minnetrista/Mound City Council Meeting of July 24, 1997, 7:30 P.M.,
Mound City Hall. The agenda will mainly focus on the possible renovation of the WESTONKA
Community Center. If we have time, there may be other issues you would like to discuss i,e.,
compost site, etc. The Joint Committee studying the possible renovation will also be attending.

A copy of the Minutes of the Westonka School Board referring to a discussion they had at their
July 14, 1997 School Board Meeting asking that the City of Mound give a commitment regarding
the sale of the Lynwood Site and an addition to Shirley Hills if a survey, to be done by Decision
Resources, comes back with a negative response. The Minutes do not reflect what the actual
discussion was so you may want to view a tape of the meeting via Channel 20. I also have a copy
of the tape from that portion of the meeting if you do not have cable or the opportunity to view it.
1.12 SURVEY - WESTONKA COMMUNITY CENTER
MOTION made by Polston, seconded by Hanus to authorize the expenditure of $2,600 for the
survey for the Conununity Center. The School Board made an offer that was predicated upon
some guarantees from the City Council that they do not want to give them at this time. The
City could recover this expenditure as the project proceeds.
Councilmember Weycker asked if that was the total. The Mayor stated it was $1,300 per
participant. The City Manager stated the total estimate for the survey was $3,360. which
would be $1,120 per participant.
The vote was 4 in favor with Weycker voting nay. Motion carried.

MINUTES-JOINT CITY COUNCIL MEETING WITH CITY OF MINNETR/STA CITY
COUNCIL-JULY 24, 1997-MOUND CITY HALL
The meeting was called to order at 7:30 p.m. Members Present: Mound City Council:
Mayor Bob Polston, Councilmembers Ahrens, Hanus, Jensen, and Weycker. Minnetrista City
Council: Mayor Ed Gale and Councilmember Cheryl Fischer. Also Present:
Westonka School Board Representatives to Joint Committee studying Westonka Community Center
Renovation: Bruce Charon and Bill Pinegar. Others present: Mike Looby, Director of
Community Education and Personnel, Westonka Public Schools; Bert Haglund, TSP/EOS; Ed
Shukle, City Manager; Sue Weibel, Cathy Bailey, Elta Erickson, Leona Peterson, Dotty O'Brien,
Sandy Wing and Patsy Kiesow.
Possible Renovation of Westonka Community Center
Bert Haglund was asked to review, in summary form, the design and cost estimate for the proposed
renovation. He reviewed the base project and the alternates proposed which total in excess of $9
million. He emphasized that the project was a "lean" project in terms of minimal improvements to
bring the buildings up to code and provide the necessary space for the various activities that would
be located in the facility.
Discussion focused on the cost estimate and whether this proposal is the only option to consider for
providing the space needed for the various school district functions and community functions.
The discussion then moved to reviewing a preliminary draft of a survey to sample the community
on their feelings toward a renovated community center. Decision Resources, Inc., provided a rough
draft of a survey and the group provided their input on the survey. The City Manager and architect
were directed to contact Decision Resources to make corrections and suggest changes to the
document. A final draft of the document will be presented to the group at the next meeting.
Questions were asked about Spring Park's involvement along with Orono and Independence, all
cities that are a part of the Westonka School District, Mayor Polston and Mayor Gale are going to
contact the mayors of these cities to invite them to attend the next meeting. The entire Westonka

Fackler reviewed the public land permit for Robert Carlson on
Brighton Commons. He noted it is a Class C. He stated the
request is consistent with all City Codes and resolutions.
Staff recommends approval of a five year permit. He reviewed
the conditions for approval.
Funk noted the permit is noted as a new construction and asked
if it should be a maintenance permit. The applicant noted it
is a replacement of the stairs.
Motion by Tulberg, seconded by Ahrens to approve the public
land permit as submitted. Motion carried unanimously.

Fackler reviewed the request for an after-the-fact variance from
City Code relating to a dock design. The dock exceeds the width by
2 feet. He recommended the dock conform to the Code requirement.
He stated there is a question how the LMCD would look at this. If
deemed to be a permanent dock, an LMCD permit would be required.
He recommended this be referred to them.
James Krenik, 5240 Pike Road explained why the dock is configured
the way it is. He stated there is no way a regular dock can be
walked on. He noted it is in the exact location as the old dock.
He discussed the dock construction and how the measurement was
calculated. He explained the wood posts were used for safety
concerns. He discussed compromises to adjust the dock size.
Bev Botko, neighbor stated the dock is more stable now, and she
supported the new dock.
Ahrens asked if the dock would be removed at the end of the season.
Krenik stated he would like to keep it in year round.
Ahrens asked why this should be taken to the LMCD. Fackler stated
there is a question about the permanency of the dock.
Ahrens asked if a permit has been issued yet. Fackler noted one
has not. Krenik discussed his concerns about safety. He didn't
believe this area is being congested any more than it already is.
Ahrens asked for clarification of how the width is determined.
McCaffrey stated the width is considered to be the platform.
In response to a question from the audience, Fackler noted it is
the LMCD's determination what constitutes a permanent dock vs. one
that stays in all winter.
Goldberg asked if the silt situation is a significant reason to
approve the dock. McCaffrey agreed docks in silt are less stable.
Ahrens asked what provisions are in the Code now to approve a
variance to dock widths. Fackler stated it is up to the DCAC to
make a recommendation. The other docks must also be considered.
Goldberg didn't believe this is a problem if there is justification
and there is a consensus the silt/safety issue is a problem.
Fackler suggested putting a limitation on the dock itself, and if
the configuration changes, the reduction would have to come into
compliance.

A request has been received for a after-the-fact variance
to Mound City Code, Section 437:15 ~Maximum Dimensions,

The applicant is Mr. James Krenik, who has a abutting home
at 5240 Pike Road, on Waterside Common.
The dock that was installed exceeds in the width by two
feet. As you will note on the attached exert from Mound City
Code ~Docks for which a license is required by this Section
437:15 shall not be less than 24" wide or more than 48" in
width...'. To aid in keeping people informed on these
limitations information is sent with every renewal dock
application. This information is addressed on the City of
Mound Dock Program Information sheet and the Cover Letter,
of which copies are attached.
Staffs recommendation is to follow City Code based on
principle that the limitations of the dock dimensions reduce
the congestion of multiple city docks.

a license is required by this Section 437:15 shall not be less than 24" wide or more than 48" in
width with the exception that one 72" x 72" section is allowed on L, T, or U shaped docks
provided that this configuration be limited to a setback of 10 feet from private property and shall
not infringe on an adjacent dock site. Docks shall not exceed 24 feet in length except where
necessary to reach a water depth of 48', using Lake Minnetonka elevation levels of 929.40 feet
above sea level. Channel docks, where navigation is limited and docks must be installed parallel
to the shoreline, cannot be less than 24." wide or more than 72" in width. The length shall be
limited to a setback of 10 feet from private property or not to infringe on an adjacent dock site.
Docks shall be of plank or rail construction. Dock posts shall be of equal height above the dock
boards and shall be at least two rail construction and constructed to comply to standards and
specifications approved by the Dock Inspector. Ail docks shall be built or placed with the
longitudinal axis thereof perpendicular to the shoreline unless variations otherwise may be
permitted in accordance with the conditions of the area. Docks which are in existence June 1,
1989, shall be brought into compliance with all provisions of the City Code when expansion or
modification is requested, or replacement of 50% or more of any such dock that is damaged,

CITY OF MOUND DOCK PROGRAM INFORMATION
-he City of Mound is licensed by the Lake Minnetonka Conservation District (LMCD) to operate
proximately 400 multiple docks. To be eligible to lease one of these sites, you must be
permanent or summer resident of Mound. Applications are available at City Hall on the
.rs= working day of the year for new applicants, and are mailed to licensee's from prior
year during December each year. See dock application for current fees. These fees are due
with.the completed application by February. 28th. The following priorities govern the
issuance of dock licenses per the Mound City Code.

Last Priority. Residents owning private lakeshore within the City which has dockable
lake frontage shall have the last priority each year for a dock on public lands.
First Priority. An abutting owner has first priority for a City designated location
within his or her lot lines extended to the shoreline. Docks shall be located in
accordance with the dock location map.
Second Priority. A licensee or, if licensee has not applied for a new dock license,
the shared owner as shown on the permit application for the preceding year, has second
priority when applying for a dock permit for the same location held by the licensee the
immediately preceding year. Second priority licensee has no priority of dock locations
where a first priority license is in effect.
Third Priority. A duly qualified applicant has third priority on locations vacant
after the first and second priority applications have been made within the prescribed
time limit described in this ordinance. Licenses will be issued to such applicants in
the order of application dates. There shall be no third priority where the first and
second priorities are in effect. Residents owning private lakeshore within the City
which has dockable lake frontage shall have the last priority each year for a dock on
public-lands.
Administration of Priority. The Dock Inspector shall assign all locations to the
applicants upon compliance with this ordinance and subject to reasonable conditions and
Council approval.
Ail applications received after February 28th shall be subject to a minimum late fee of
$20.00, and will be placed in a third priority category. There will be no late fee charged
new residents who apply after February 28th of the calendar year in which the resident
to the City. Residents of the City of Mound, 65 years of age or older, shall pay 50%
the required license fee for a dock.
RULES AND REGULATIONS
(PORTION OF CITY CODE SECTION 437)
Subd. 1. Dock Location Map Definition. There shall be on file in the City Hall a drawing
of the City of Mound that is maintained by the Dock Inspector showing the approved locations
of private docks that may be constructed on or abutting public shoreland under the control
of the City.
Subd. 2. Annual Review of MaD. Approved dock location maps shall be kept and maintained
by the Dock Inspector and shall be reviewed by the Park and Open Space Commission at least
once a year. The Park Advisory Commission shall review the dock location map between
September 1 and December 31 before each new boating season so their recommended changes may
be referred to and considered by the City Council on or before January 15. Maps shall
contain all approved dock locations as established by the Council upon the advice and
recommendation of the Dock Inspector and Park Advisory Commission. Final approval of the
dock location map and the number of dock licenses to be permitted shall be recommended by the
Dock Inspector, reviewed by the Park Commission and Approved by the City Council.
Subd. 3. Dock Inspector to Review Application. The Dock Inspector shall determine and
approve the location of each permit according to the specifications of the approved dock
location map.
Subd. 4. Costs of Erection and Maintenance. Licensed docks shall be erected and
maintained by the licensee at his or her sole expense and liability for same.
Subd. 5. ~uspension of Eliqible Location. The City Council may suspend a dock location
where it appears that a location as established on the dock location map reasonably
interferes with the use of public waters or imposes a hardship on property owners abutting
on public streets or public commons.
ubd. 6. One Dock Per Family; Apartment Buildinq. No more that one dock shall be
!~rmitted for each resident family. An apartment building or multiple dwelling owner shall
ot apply for dock licenses for his renters or lessees. He or she is entitled to apply for
an individual private dock license for himself or herself if he or she is a resident of the
City.
Subd. 7. Construction Materials; Use of Car Tires. Ail private docks shall be constructed
cf materials specified by the Building Inspector and the Dock Inspector and in accordance
with all building codes of the City. The standards for the public health, safety, and
neral welfare and neither the materials or the workmanship for an approved licensed private
ck shall result in docks being located on public lands which are unsightly, unsafe or
create a public nuisance. No tire or tires shall be hung or attached on dock posts, dock
poles, or on dock hardware of any dock on or abutting public shoreland under the control of

Subd. 8. Inspections - Notice of Non-Compliance - License Revocation. The Dock Inspector
or such other officer as may be designated by the City Manager or the City Council, may at
any reasonable time inspect or cause to be inspected any dock erected or maintained upon or
abutting upon any public street, road, park, or commons, and if it shall appear that any
such dock has not been constructed or the area surrounding the dock site is not being
maintained in accordance with the application or the license granted therefore, or with the
plans or location approved by the Council, or shall it appear that such dock is in a
condition that no longer complies with the requirements of this ordinance or other ordinances
of the City, the City, by its City Manager or any other officer designated by him, shall
forthwith notify the owner thereof in writing specifying the way or ways in which said dock
does not comply with the ordinances of the City, after which said owner shall have ten days
to remove such dock or make the same comply with the terms of the City's ordinances and the
terms of the application and issuance of the license granted to said licensee. In the event
such owner shall fail, neglect, or refuse to remove such dock or make the same comply with
the terms of the City regulations within the period of ten days, the license therefor shall
be revoked by direction of the City Council or the Dock Inspector and by notice in writing
to the licensee, and said notice shall be issued by the City Manager or any other officer
designated by him or her. Any appeal will be made in writing and submitted to .the City
! Manager by a certified letter or by personal delivery to the City Manager for his or her
~¢onsideration.
~%$ubd. 9. Notice of Revocation~ All notices herein required shall be in writing by

~ Subd. 10. Dock Storage. No person shall store, leave or abandon any dock, dock section,

storage in approved areas.

Section 437:20. Penalties. Any person or persons who shall violate any of the prohibitions
or requirements of this ordinance shall be guilty of a misdemeanor. In addition to any
criminal penalties as above provided, the City Council may remove or cause to be removed any
dock erected without a license as required by this Section 437, or where any license has been
revoked as provided by this Section 437. Removal of unlicensed docks or docks which fail to
comply with the City Code will be at the expense of the owner or licensee. No person
convicted of violating City ordinances relating to docks will be issued a dock license for
e present or for the next boating season, and said person forfeits any priorities set forth

Enclosed is your 1997 Dock License Application Form. The dock fees for 1997 have
remained the same as 1996. Following are some general rules relating to your dock license.
Permits will not be issued to any non-resident of Mound. Proof of residency or proof
of boat ownership must be furnished if requested. Any false information given or
violations of Dock Ordinance 437 shall be reason for denial or revocation of permit.

Applications received on March 1, 1997 and before April I are subject to a

Application renewals for non-abutting residents not received BY MARCH 31st
will not retain a second (2nd) priority status, and will be placed in a third (3rd)
priority category.

Senior citizens are eligible for reduced rates. Senior Citizens (65 years or older
at time of application) pay 1/2 the base permit fee for the type of dock they
desire. Senior citizens sharing a dock with a non-senior pay 1/4 the base
permit fee for the type of dock they desire. The non-senior sharing a dock with
a senior pays 3/4 the base permit fee, plus the $30.00 share fee.
WATERCRAFT LICENSES REQUIRED. A copy of the Minnesota Watercraft License
is required to be submitted for each boat or watercraft to be stored at your dock,
including boats of shared dock holders. A DOCK LICENSE WILL NOT BE ISSUED
WITHOUT THIS INFORMATION.
5. No dock can be installed until a dock location site is granted by the Dock Inspector

Licenses and permits are Non-Transferable. Dock licenses issued by the City are
personal in nature and may be used only by the licensee or members of their
households. No dock licensed by the City or located on public streets, roads, parks,
or public commons may be rented, leased, or sublet to any person, partnership or
corporation. If a licensee or permit holder rents, leases, sublets, or in any manner
charges or receives consideration for the use of his or her dock, his or her license shall
be revoked.
7. CONSTRUCTION ON PUBLIC LANDS.

A permit is required for construction of any kind on any public lands, or the
alteration of the natural contour of any public lands, such as: stairways,
retaining walls, trimming of trees, etc.
No person shall maintain any boathouse or other structure on public lands
without first receiving a special Maintenance Permit from the City, in
accordance with Section 320 of the City Code. Applications for remodeling,
maintaining or repairing existing boathouses, retaining walls, stonework, decks,
landscaping, trimming of trees or brush, or other types of improvements on
public lands may be obtained from the Building Department.'
RESPONSIBILITIES AS A DOCK LICENSE HOLDER
Install your own dock that meets City specifications for safety, size and
materials.
Maintain the cleanliness of the area by your site, including grass cutting and
weed trimming. Aquatic plants that are protected by law require permits prior
to removal. Remove Eurasian Water Milfoil from the shoreline around your
dock.

BE IT RESOLVED, that the City Council of the City of
Mound, Minnesota, authorizes entering into a cooperative agreement
with the office of the Drug Policy in the Minnesota Department of
Public Safety for the project entitled, "Southwest Metro Drug Task
Force" during the period from January 1, 1998 through December 31,
1998. Edward J. Shukle, Jr. is hereby authorized to execute such
agreements as are necessary to implement the project on behalf of
the Mound Police Department.

Dear Mr. Platisha:
Enclosed is a proposed Development Agreement between the City of Mound and Northern
Hospitality, Inc. regarding the development of the Lost Lake Inn to be located on the Lost Lake
property in the City of Mound, Minnesota. Exhibit A of the agreement indicates the proposed
location for such a facility and also indicates other conceptual uses of the property owned by the City
of Mound and an adjacent parcel privately owned but to be acquired at some future date by the City
of Mound.
This proposed agreement has been drafted by the City Attomey based upon the sample agreement
you forwarded to me regarding Giants Ridge near Biwabik, Minnesota and past experience with such
agreements in other communities.
Please review the enclosed Development Agreement and if you have any changes to suggest in the
agreement or if you are satisfied with the agreement, please contact me as soon as possible. I would
like to have the City Council review this agreement at their next scheduled regular meeting which
is Tuesday, August 12, 1997. If this is not possible, the next regular meeting is scheduled for
Tuesday, August 26, 1997.

AGREEMENT
THIS AGREEMENT is made and entered into this ~ day of , 1997,
by and between the City of Mound, Minnesota, a Minnesota m, micipal corporation ("City.") and
Northern Hospitality, Inc., a Minnesota corporation (hereim~ter "Northern").
RECITALS:
First: Northern is interested in pursuing the development of that cer~ai~ area of land which is
a pan of a trac~ of land described in the amached l~xhibit A (hereinat:~er the "Development Area");
Second: Northern is proposing development within the Development Area of a hotel facility and
related parking and which also may include restaurant and meeting facilities (hereinafter the
"Development");
Third: The City wishes to cooperate with Northem's efforts with Development and is willing
to proceed as dc'~a'ibed in this Agreement;
Fourth: The parties acknowledge that Northern will expend substantial time and effort, and incur
substantial expeme in pursuing the Development;
Fifth: Northern is willing to undertake the above describe activities with thc reasonable assurance
from the City that it will support and cooperate with Northern in it~ Development effort~.
Sixth: The City and Northern have executed this Agreement to document their understanding
with respect to the proposed Development.
AGREEMENT
NOW, THEREFORE, in consideration of the premises and mutual obligations of the
parties contained herein, each of them does hereby represent, covenant and agree with the other
as follows:
l. Statement of Iment
h is the intention of the parties that Northern viii proceed with the development activitie~
necessary tn permit Development, in a manner, and on terms and conditions, which are
mutually acceptable to Northern and the City. The parties acknowledge that in order for
Development to be constructed,. Northern may at some point need financi-1 assistance
from the City and/or the Mound Housing and Redevelopment Authority ("HRA"). This
Agreement does not, however, constitute either approval of such financial assistance, nor
does it obligate the City. to provide such assistance - or tn secure such assisran~ce from the
}IRA.
2. I~nderT. akina ~' Northern.
Northern i~tencls to undertake and pur~e certain activities with respect to the
Development During ~he term of thi~ A~eement, Northern will undertake n~rket
studies; formal discussions with the City. and lIRA regarding the terms for the
relatio-~hips with Northern; preparation of architectural design drawings for the
Developmcnt; formal negotiations with financing sources; and preparation of marketing
and management plan.
Upon execution of this Agreement, Northern shall promptly proceed to gather and analyze
relevant data, and to prepare the var/ous development and design studies needed to
determine the feasibility, of the specific development proposals for the Development
Northern will first undertake prelimina:7 studies to:
determine the nature of the market for the utilization of the Development
b)
pre-pare a preliminary master plan of the Development Area showing the
Development and other uses planned by the City in thc Development Area;
c) make a cost estimate of the Development;
dctm'm{ne the nature and form of any assistance which Northern
contemplates it m~y request from thc City an/or HRA and the financial
daza supporting such request; and
e) determine the feasibility of the proposals in the Emancial m~rket place.
3. City's Undertakin,~ and A~eement.
The City agrees to cooperate with Northern in Northem's undertakings, and specifically
a~ree that during the term of this Agreement the City will not enter into an agreement or
solicit proposals for the purchase of the Development Area.
4. Term.
The term of this Agreement shall be for a period of six (6) months, provided that, either
party may terminate this Agreement upon thirty (30) days written notice tn the other, in
the event that: (a) the City determines, in good faith, thzx Northern is not diligently
pursuing the Development or (b) Northern determines., in good faith, tha the
Development is not feasible. The City may also terminate the Agreement for failure or
Northern to meet its obligations under par~-Avhs 5D or 5E. The par~es may, by mtmml
written ~-~'eement extend this Agreement for such further periods ~s they ~hu]l determine
to be ~ppropriate from time to time.

This agreement constitutes the entire agreement b~tween the pa_,'ties relative to the
proposed Development. Unless specifically described herein, no obligation shall
be inferred or construed.
As expansion of the foregoing, Northern understands that further and sepamm
action, for which no obligation is crea~d hereunder, will be required before the
City and/or HRA are obligated to take various actions with respect to the
Development, Those actiom may include, w'ithout limitation:
a) establishment of Project Are~ and Tax Increment District;
b)
agreement to provide tax increment or other financial assistance to the
Development;
c) zoning and subdivision
agreement to sell the Development Property to Northern and the terms of
such an agreement; and
e) construction of public improvements to serve the Development.

Northern further understands that many of the actions which the City may be
called upon to take require the reasonable discretion and in some instances the
legislative judgment of the City, such actions may be made only following

specific decision in such maners.

officers agents and employees from any claim or cause of action of whatever

the Adult Basic Education Program, the Head Start Program, the
Westonka Community Action Network, and the TRI-AX Public Access
Cable Television Production Studios, in addition to gymnasium
space. The intent of the current proposal is to remodel and
renovate this facility to better serve the needs of its users·

JULY 1997 MONTHLY REPORT
This year July was not a very good month for sales by my standards. There were a couple of
factors that contributed to the slow month. Weather has always played an important role to the
success of any liquor establishment, especially this one, due to the close proximity to a major
recreational area as Lake Minnetonka.
I cannot remember a summer when we have had so many violent storms as this one. It was a
very wet month, with rain occurring for more than half of the days in the month. When that
happens, people cannot get out to use the lake.
In the 13 years that I have been here we have never closed the store due to inclement weather.
One day this year we had to close up a half hour early because the civil defense sirens were
blaring and the skies were very ominous. My employees called me at home that night asking
what they should do. For their safety, I told them to lock up and get out of there.
Another reason our sales were down over July of last year was because this year the Fourth of
July fell on a Friday and we were closed. Had we had this normal Friday's business, we would
have matched what we did in sales during July of '96.

The police department responded to 892 calls for service during the month
of July. There were 47 Part I offenses reported. Those offenses included
2 criminal sexual conducts, 2 robberies, 6 burglaries, 1 aggravated assault,
31 larcenies, 3 vehicle thetis, and 2 arsons.
There were 67 Part II offenses reported. Those offenses included 3 child
abuse/neglect, 1 forgery/NSF checks, 4 narcotics, 4 damage to property,
11 liquor law violations, 12 DUI's, 4 simple assaults, 3 domestics (1 with
an assault), 3 harassment's, 9 juvenile status offenses, and 13 other
offenses.
The patrol division issued 154 adult citations and 12 juvenile citations.
Parking violations accounted for an additional 32 tickets. Warnings were
issued to 125 individuals for a variety of violations.
There were 4 adults and 7 juveniles arrested for felonies.

INVESTIGATIONS
The investigators worked on 2 child protection cases in July. Other cases
investigated included narcotics, robbery, assault, threats, theft, damage to
property, and juvenile status offenses. Some follow-up investigation was
done on the recent homicide case.
Formal complaints were issued for selling alcohol to minors, assault,
underage consumption of alcohol and failure to complete construction.

Personnel/Staffin~
The department used approximately 34 hours of overtime during the
month of July. Officers used 385 hours of comp-time, 209 hours of
vacation, 8.5 hours of sick time, and 9 holidays. Officers eamed 13.5
hours of comp-time.
The Mound Police Department hired three new employees to fill openings
within the department. Bob Donahue was hired as a police officer, Sandi
Effertz was hired as a secretary and Ryan Piper was hired as a community
service officer.

CONSTRUCTION ACTIVITY
There were 33 building permits issued in July for a construction value of $ 797,218. We issued
30 plumbing, mechanical, and miscellaneous permits for a total of 63 this month, and 425
permits year-to-date. Total valuation now stands at $3,843,531.
PLANNING & ZONING
The Planning Commission reviewed six cases and sent on four variances and one minor
subdivision case to the City Council. One variance case was withdrawn.

1998 Budqet Preparation
To comply with the truth in taxation laws, the city must certify the proposed
levy to the county and adopt the proposed budget by September 15. The State
Department of Revenue has provided us the necessary forms and instructions.
The Local Government Aid for 1998 has been calculated by the State Department
of Revenue and it will be in the amount of $322,089. The Homestead and Agri-
cultural Credit Aid amount will be $492,044 and the 1998 Local Performance Aid
will be $12,850. The balance of revenues needed will be provided by fees and
local property taxes. The State Department of Revenue has certified the local
property tax levy limit. This is a new requirement mandated by the last session
of the legislature. Our levy limit for 1998 was set at $1,390,967. This amount
does not include special levies ( levies for bonded indebtedness, etc.) or special
assessments.
Fiscal Policy Committee
On Thursday, July 10, I attended the meeting of the Fiscal Policy Committee of the League
of Minnesota Cities. After a review by the league's staff of the last legislative session,
the members expressed their disappointment about a number of actions taken by our
legislators that have adverse impact on cities. The consensus seems that cities faired
poorly with the legislature and that many legislators are not understanding the critical,
vital impact of the services that cities provide to citizens. All members of the committee
agreed that the League of Minnesota Cities must find a way to be more effective with the
legislature in advocating for cities.

July Activity Report
For the first two weeks we were working in three points
preparing for the seal coating that will be done on August 6,
1997. The sewer department spent time cleaning line and the
water department did hydrant and standpipe repairs. Then came
the storm on the 17th. I have not seen a storm like this
since May of 1965. The rest of the month was spent cleaning
up the mess and getting it chipped up.

JULY MONTHLY REPORT
There were 2 regular Council Meetings in July. Packet preparation
as done for each of those meetings. Minutes were prepared after
each of those meetings. Resolutions were prepared. There were
clean-up items from the meetings and things that had to be sent to
various persons.
I put together directions and a map for the Kevin Sorbo park
dedication. We are getting calls everyday from all over the
country about this event.
This is the time of year when prioritizing is very important in my
job because of all the things that need to be done in a timely
manner, i.e. special assessments, public hearings and just everyday
tasks.
There were a number of research items and the usual calls from
residents.

1.0 General Items
1. l The Boathouse. The new Minnetrista council has shown no
interest in further enforcement of any of their ordinances that may have been
violated by the construction of the boathouse. It appears that they are
willing to accept the status quo. Bil Hawks has stated that he is willing to
drop his lawsuit against the LMCD, if the LMCD agrees to drop further
prosecution. In effect this would be gmndfathering the structure. This has
been my recommendation for many months, ever since the nature of this
disagreement became known. I dislike havinsg someone "get away" with
circumventing thc law, but to my way of thinking, with Minnetrista
dropping out of active interest, the issue is not worth the LMCD and the rest
of the cities carrying the load. And the structure has become a "destination"
on the lake, much like Jimmie Jam's house, - or the Regional Park! ~
are your feelings on this issl~?
1.2 The district continues to operate two members short. Victoria
as a city has small interest in thc lake, and this being so. has had difficulty
in finding a citizen willing to make the sacrifice to serve, Orono has been
specially invited to rejoin the District. There are very new members,just
beginning their learning curve, from Minnetonka, Greenwood, and
Wayzata.
1.3 A high water emergency was declared 7/30. This provides for
closed throtOe operation within 6CIO ft of any shore. For bays less than
1200 feet across, the so called regulated bays, this means 100% closed
throttle. I have had some calls, pro and con on this, but when the reasons
are explained, most are satisfied.
2.0 Exotic Species Task Force.
2.1 Thus far 610 acres have been harvested, Because of the high
water, with the consequent lack of emergence of the weed, it appears that
the season may be cut a week short.
2.2 Other than Irwin Jacobs' FLW Bass Fishing Contest, and a
couple of sailing regattas, compliance with the boat washing program has
been spotty. No boats were washed for the Don Shelby Silverado
Tournament. Only one was washed for the Denny Green Tournament.

With the discovery of zebra mussels in the St Croix, it appears that the
problem is closing in upon us. More stringent measures to assure
compliance may be necessary for next year.
3.0 Water Structures
3.1 Further favorable action on the Wayzata boat launch up grade
was taken.
4.0 Lake Use.
4.1 We have a request to allow larger charter boats on the lake. A
code change was drafted and approved at a first reading. Much more input
from the public and other boaters will be sought before later readings.

The Minnehaha Creek Wamr~eci Disrric~ (MCWD) r~duces flooding in Hennepin and Carver
Counties by using wetlands, wet detention basins and dams, including the Gray's Bay Dam on
Lake Minnetonk~-

DOCK AND COMMONS ADVISORY COMMISSION
MINUTES
JULY 17, 1997
Present were: Commissioners Frank Ahrens, Jim Funk, Mark Goldberg,
Dennis Hopkins, and Gordy Tulberg. Parks Director Jim Fackler,
Dock Inspector Tom McCaffrey and Secretary Clare Link. Those
absent and excused were: Mayor Bob Polston. The following
interested citizens were present: Steve Sexton, Rita Pederson, Bev
Botko. Marilyn Byrnes, Robert Carlson, and Jim Krenik.
APPROVAL OF JUNE 12, 1997 DCAC MINUTES
Ahrens noted a change on Page 6, under Capital Outlay 1998, under
motion. Ahrens believed lights would not be needed on most docks.
Motion by Ahrens, seconded by Funk to approve the minutes of
the June 12, 1997 Dock and Commons Advisory Commission as
amended. Motion carried unanimously.
AGENDA CHANGES
Shared docks will be discussed at the August meeting (Item 8).
1998 PERMIT FEES
Fackler noted the fees for 1998 would remain the same as in 1997.
Motion by Ahrens, seconded by Funk to recommend the fees
remain the same for 1998 as 1997. Motion carried unanimously.
PUBLIC LAND PERMITS
A. Robert Carlson, 4991 Brighton Blvd.
Fackler reviewed the public land permit for Robert Carlson on
Brighton Commons. He noted it is a Class C. He stated the
request is consistent with all City Codes and resolutions.
Staff recommends approval of a five year permit. He reviewed
the conditions for approval.
Funk noted the permit is noted as a new construction and asked
if it should be a maintenance permit. The applicant noted it
is a replacement of the stairs.
Motion by Tulberg, seconded by Ahrens to approve the public
land permit as submitted. Motion carried unanimously.

JAMES KRENIK, 5240 PIKE ROAD
Fackler reviewed the request for an after-the-fact variance from
City Code relating to a dock design. The dock exceeds the width by
2 feet. He recommended the dock conform to the Code requirement.
He stated there is a question how the LMCD would look at this. If
deemed to be a permanent dock, an LMCD permit would be required.
He recommended this be referred to them.
James Krenik, 5240 Pike Road explained why the dock is configured
the way it is. He stated there is no way a regular dock can be
walked on. He noted it is in the exact location as the old dock.
He discussed the dock construction and how the measurement was
calculated. He explained the wood posts were used for safety
concerns. He discussed compromises to adjust the dock size.
Bev Botko, neighbor stated the dock is more stable now, and she
supported the new dock.
Ahrens asked if the dock would be removed at the end of the season.
Krenik stated he would like to keep it in year round.
Ahrens asked why this should be taken to the LMCD. Fackler stated
there is a question about the permanency of the dock.
Ahrens asked if a permit has been issued yet. Fackler noted one
has not. Krenik discussed his concerns about safety. He didn't
believe this area is being congested any more than it already is.
Ahrens asked for clarification of how the width is determined.
McCaffrey stated the width is considered to be the platform.
In response to a question from the audience, Fackler noted it is
the LMCD's determination what constitutes a permanent dock vs. one
that stays in all winter.
Goldberg asked if the silt situation is a significant reason to
approve the dock. McCaffrey agreed docks in silt are less stable.
Ahrens asked what provisions are in the Code now to approve a
variance to dock widths. Fackler stated it is up to the DCAC to
make a recommendation. The other docks must also be considered.
Goldberg didn't believe this is a problem if there is justification
and there is a consensus the silt/safety issue is a problem.
Fackler suggested putting a limitation on the dock itself, and if
the configuration changes, the reduction would have to come into
compliance.
Ahrens stated the spacing between the docks is 30', and this dock
is at 31'

Tulberg stated he would defer it to the LMCD. Fackler stated the
applicant has indicated the dock is removable.
Hopkins stated a legal dock would be just as stable. He asked if
it could be approved if there were a "T" on the end. McCaffrey
stated it wouldn't matter.
Goldberg suggested a condition be placed that the dock be limited
to a straight dock.
Hopkins asked how long the posts will last.

dock is replaced.
Motion by Goldberg, seconded by Tulberg given the safety
concerns of docks in that amount of silt, an increased
structural dock makes sense, and given that neighborhood,
there isn't a major space problem; therefore, motion to
recommend approval of the after-the-fact variance to remain at
six feet in width with the following conditions: l) toward
satisfying the principal of not increasing congestion, limit
the dock to a straight dock; 2) towards eventually conforming
to the ordinance when the posts rot out, bring the dock back
down to four feet. Motion carried unanimously.
DOCK CONSTRUCTION, DESIGN WINTER DOCK STORAGE
Ahrens asked for clarification of dock licenses being applied for
by the 10th of January. Fackler stated it is in the ordinance but
not enforced. Ahrens was concerned about docks being left in and
the timeliness of the dock inspection. He believed certain bays
should not have docks year round. Hopkins suggested leaving it to
the discretion of the dock inspector.
Commissioners discussed the dock inspection process. Ahrens stated
he would rather see the Code enforced as it exists. He didn't
believe the Code was overly restrictive.
Fackler reviewed a proposed text amendment where the dock inspector
would have the ability to remove a dock license after notification
of the request to remove a dock. Commissioners discussed the text
amendment language.
Ahrens stated the docking of non-owned watercraft is also a
problem. Commissioners discussed visiting dock permits. Hopkins
stated the dock inspector could notify the boat owners. Goldberg
suggested limiting the number of times a dock site holder can have
a visitor. He suggested 48 hours 2-3 times during the season.
Fackler stated it doesn't become a problem until neighbors become
irritated. Goldberg suggested language stating a neighbor has the

right to complain.
Ahrens directed staff to revise the ordinance language back to work
on language to close the loophole so there is something to enforce
when there is a problem with visitors to docks. He suggested
permitting and fees of $15 for a 21-day period. He also suggested
the dock fees for 1999 be raised from $15.
Goldberg asked how many 21 day time periods should be allowed for
a dock holder. Fackler stated one.
Commissioners continued discussion of winter dock storage. Ahrens
believed what exists should be enforced. Fackler explained how it
would be enforced. Language can be added where the dock license
could be revoked if a dock is not removed.
1998 BUDGET REQUEST
Fackler reviewed a breakdown of the capital outlay calendar.

Ahrens explained why a line item should be labeled contractual
rather than professional services. Commissioners discussed the
amounts budgeted. Goldberg suggested professional services be
lowered to $1500, and $5,000 be designated for contractual
services.
Ahrens suggested the lights line item be called something else.
Fackler suggested it be renamed maintenance.
REVIEW ENCROACHMENT POLICY
Goldberg stated the encroachment policy has been rewritten to
recognize the need for encroaching structures to be removed from
the Commons area eventually. The life of an encroaching structure
has also been defined. He reviewed changes to the flowchart. He
stated the City Attorney will follow-up with comments in writing.
He suggested the City Council direct him to draft it into ordinance
form if approved as a policy. A permit fee was suggested. Some of
the liability language is vague.
Goldberg reviewed a memo from the Building Official regarding
encroachments. He directed Fackler to have Sutherland review
Exhibit J of the procedure manual for the next meeting.
Ahrens suggested language be added on the flowchart following
Exhibit J, ", guidelines for writing staff reports for public land
permits," He stated the flowchart boxes should be changed from 3
to 5 years. He also noted a location on the chart where a "yes"
should be labeled "no".
Goldberg directed staff to check the ordinances to see if there is
anything between 1960 and 1973 that addresses encroachments.

FISHING DOCKS
Hopkins noted there is a storm sewer that dumps into the lake in
the area where a fishing dock could be located. He asked who would
be responsible to clean it out. Fackler stated the City would have
to correct the situation.
Hopkins stated shoreline fishing could be allowed, and a dock would
not be needed. He stated the neighbors are in favor of having a
fishing area. Fackler explained what would need to be done to
prepare the area for fishing.
Hopkins discussed the need to have the storm sewer cleaned out.
Commissioners discussed the proposal and the need for additional
information.
Ahrens stated he would prefer to see a fishing dock in a park like
setting. He stated he would not like to see the funding come from
the dock fund.
Goldberg suggested staff determine what will be required to clean
the pipe, dredge the area, permitting costs, etc.
PROPOSED ORDINANCE AMENDMENTS - 1997
Discussed under winter dock storage.
Avalon Park MultiDle Dock
Fackler stated the docks at Avalon Park were reviewed to see what
would be needed. He noted the setback is 30' on each site. He
reviewed the width, length and area of the proposed dock. He
explained where boats would be located. Commissioners discussed
the configuration.
Fackler reviewed the docks proposed for Devon to eliminate
congestion problems. Ahrens stated there is a boathouse located in
this area which will need to be addressed at a future meeting.
Fackler reviewed the dock configuration, width, length and area
which is similar to the Avalon Park dock. The difference is in the
configuration in order to avoid an existing storm drain.
OTHER BUSINESS
Fackler reviewed plans for stairways. Goldberg stated the concern
is stairways could be put in without approval. Fackler stated each
case would need a Public Lands Permit and City Council approval.
He stated the typical plan would cost $800, and he is getting
another estimate.

Motion by Goldberg, seconded by Tulberg to accept the stairs
as proposed and give approval to spend $800 on a plan for the
wood stairs to other areas with approval on each individual
request. Approval is also granted to budget in 1998 for the
installation of stairs on Canary (budgeted $5,000). Motion
carried unanimously.
ADJOURNMENT
MOTION made by Tulberg, seconded by Goldberg to adjourn the
Dock & Commons Commission Meeting at 10:11 p.m. Motion
carried unanimously.

Application of Minnehaha Creek Watershed District
Rule B - Stormwater Management
June 26, 1997
Manager Gross moved, seconded by Manager Maple, that the following resolution be
adopted by the Board of Managers of the Minnehaha Creek Watershed District.
WHERAS, the Minnehaha Creek Watershed District (MCWD) through MCWD Rule B regulates
stormwater and erosion and sedimentation for individual development and redevelopment
projects within the MC D s jurisdiction; and
WHEREAS, MCWD Rule B allows in certain limited circumstances permit applicants to make a
monetary contribution to a dedicated MCWD water quality/stormwater storage fund in lieu of
constructing stormwater facilities on-site; and
WHEREAS, MCWD Rule B allows the MCWD to accept contribution to the above referenced
fund when (1) an agreement for a regional facility, is in place with the affected municipality; or
(2) there is an existing or planned MCWD regional stormwater facility within the same
subwatershed; or (3) the Board of Managers determines that another facility in a different
subwatershed is of a higher water quality priority and would better serve the public health and
welfare and the purpose of the watershed law; and
WHEREAS, in response to concerns from municipalities within the MCWD, the Board of
Managers has formed a Stormwater Management Task Force to develop recommendations to
revise Rule B and a Task Force report is expected within a period of 120 days.
THEREFORE, BE IT RESOLVED by the Minnehaha Creek Watershed District Board of
Managers that the MCWD will continue to accept contributions under Rule B and during this
period pending any revisions to Rule B, the contributions will be allowed and held in escrow for
stormwater management purposes without specifically requiring that there be an agreement in
place for a regional stormwater facility with the affected municipality.

Overview of Regional Ponding Agreements
July 1997
The Minnehaha Creek Watershed District has a policy of promoting regional stormwater
ponding facilities throughout the watershed. By providing for stormwater treatment for larger
areas, ponds can be placed at strategic locations which both maximize cost efficiency, and create
opportunities for these stormwater ponds to serve as recreational amenities.
The MCWD is promoting the regional ponding concept in partnership with the
municipalities in the watershed. This parmering approach assures that watershed initiatives are
integrated with the local stormwater management planning process in each city.
The MCWD's Water Resources Management Plan provides that each capital
improvement project involves some combination of MCWD and local cost sharing. In
developing the appropriate funding plan for all MCWD projects, and considering the appropriate
share of local funding, the MCWD seeks a mutually agreeable cost sharing arrangement. Some
factors to consider are whether the water resources to be improved or protected as a result of the
project are significant regional assets of the watershed; the extent to which cities or affected
subwatersheds contribute to the problem being addressed; the extent to which cities or
subwatershed districts receive particular local benefits, including flood control, water quality,
recreational benefits, or increased tax base for the project; the extent to which cities have, in the
past, or will in the future, construct similar projects or undertake similar problematic or
regulatory activities without district funding; the necessity of the project and the availability of
local funds.
In drafting Regional Ponding Agreements with municipalities, the MCWD is committed
to recognizing the circumstances unique to each individual municipality while at the same time
treating the municipalities fairly and consistently. Because the circumstances of each
municipality are different, there is not one model or "boiler plate" regional ponding agreement.
The responsibilities assumed by the MCWD and the individual municipality vary
depending upon numerous factors, such as whether the regional facility will be built on property
already owned by the City, whether the construction of the regional facility involves retrofitting
an existing stormwater basin, and the size of the area the facility will be serving. In determining
the responsibilities of the parties, the MCWD seeks to insure that the costs to the municipality in
assisting in the construction of regional stormwater facilities is fully recognized. The cost to a
municipality that already owns property where a pond can be constructed can be vastly different
from a municipality that is considering acquiring property for the facility. Likewise, both of
these costs will be different if all that is required is retrofitting an existing storrnwater detention
basin.
