The pu~ose, of. the. meeting was to review the.amendments to Village
Zoning Ordinance No. 40,prior to ratification by the Village Council,
and to m~e any further reco~enSatlons.there to.
After a reading and discussion of the ordinance in its revised form,
the board found no fault with the amendments. It found itself of this
opinion, however, that the logic of circumstances surroundin~ the
ordinance, and the implication~ read into the Zonin~ law itself -
Especially with r~fe~ence to appeals from dicisions of the building
inspector - indicated2that the board had supervisory authority in
enforcing bhe Zoning Law, from who~e decisions the village council
was only to serve as a court o~ la~t, Appeal. Further, that the
village council was to supply its legislatiMe function in improving
the law on recommendations borne out by the experience of the board.
Such a delegation of power, hov~ever, as far as the ordinance is concerned,
is~founded largely on implication, rather than being definitely
stated. It is, therefore, recommended by the Board of Zoning
Appeals that the Zoning Law be so worded as to be more definite
and specific in its division of authority.
Having unanimously expressed itself in te~ms of the above, the meating
adjourned.
