REGULAR MEETING~ DECEMBER ~ 19~l(Election on Dec. 4)
Mayor D~vis, Bly, White and Wi. nkel present, Pierce out of town.
Minutes of the November 6 meeting were read and approved on
MOTION by White, second by Winkel.
Mrs. F. G. Wallace, President of the PTA, was present to
request help from the council in procuring a warming house for
the skating rink on the high school grounds. Pointed out that
'the village had a considerable sum of money invested in a hockey
rink that was not being used and had recently installed a new
fire hydrant at a cost of some ~300. at the request of school
officials to facilitate flooding of the rink. Ed Behmler was
appointed by Mayor Davis to act as the council's representative
if a cormmittee was organized to work on the problem.
Frank Groschen of the Mound Volunteer Fire Department
presented the department's annual report to the council.;'
PUBLIC HE&RING was opened on the proposed amendment to the
Zoning Ordinance. The notice of hearing was resd. Pat Guy asked
for the flo~r and was granted permission to speak. He reviewed
his plans for 'using the Casino as a place of business and voiced
an objection to restrictions on the use of the property. Phil
David, a home owner in the vicinity of the Casino, remarked that
the neighbors would be satisfied if the new owner conducted the
Casino as orderly as Art Faught had.
Pat Guy stated that he intended to operate a restaur~t as
part of the Casino. Ed BJerke then informed thc council that he
would not stand by idly if Guy was granted a permit to operate a
~l~x~x reataurant after a ~permit had been rejected for his lot
on the corner.
On MOTION by k~ite, second by Bly, the manager was instructed
to re-advertise, to amend the Zoning ordinance itself rather than

the park on both sides of Central Avenue. Public hearing would
be held at 8:00 p.m. in the Krause Building on Thursday, December
27, 19~1.
PUBLIC HEARING on Vacating part of Alley in Shirley Hills
Unit F ~E~i~ convened. Letter from Herbert E. Wolner, one of
the owners of the propertvin the immediate area, was read. In
the letter Wolner stated that Mound Properties Inc. had no
objection to the vacation. Following RESOLUTION Was off,red by
Bly:
WHERE~S, the only property owner abutting on the part of the
20-foot alley between Lots 4 and 5, Block 3, Shirley Hills Unit F,
has requested the village ~uncil in a petition dated October 12,
19~l, to vac~te s~ch p~t of alley according to law,
AND k~EREAS, a public haaring was held on November ~, 19~l, before
the vi].lage~ council on such petition after due published notice
had been given bv the cl~rk on October 18, 1951, and all ~rsons
interested were givena an opportunitv to be heard,
AND WHEREAS, £t appears th~ it ~ll be for the best interest of
the village to approve such petition,

NOW, THEREF0~E, BE IT RESOLVED, that such petition is hereby
granted and the part of the alley above mentioned is hereby
vacated as a public alle~.

The Council canvassed the returns of the December 4 village
election and on MOTION by White the following returns were
declared: 750 ballots had been received, 538 were voted and
returned, and 212 were unused and returned; For the office of
Mayor, William I. Davis received 325 votes and A. S. Brazman
209 votes; For trustee Ed Behmler received 465 votes and S.
Heleine Beane 72 votes; For Constable J. S. Adams had 267 votes
and John Skinner 262 votes; For Justice of the peace M. Charles
Kelly bad 389 votes. Second by Winkel and the returns were
canvassed.
~ petition ~om 12 residents of Shirley Hills requested a
street light at the x~x~ intersection of Woodbine Avenue ~d
Edgewater Drive near Block 6, Shirley Hills Unit B. ~ White
offered a RESOLT~ON approving the new light, second by BIT,
Carried. The manager was also instructed to investigate the
necessity of a lihht at the corner of County Road No. 125 and
WoOdbine Avenu~ and if he thought ~x~ a light was needed he should
reguest same from Interstate Power.

MOTION by White, second by Bly the ~plications were
approved.
Latest development of the Condemnation Suit filed by the
Village against irene Bergin for the Highway ll0 Improve-
ment was reviewed. Revealed that the appraisers appointed
by the court had arrived a t a figure of 9950. for an
award. Various councilmen presented their viewpoints.
Bly offered the following: RESOLVED that we reluctantly
tender Irene Bergin the smm of $950. as set by the court's
appraisers in the condemnation proceedings.
Second by White. Carried unanimously.
The Snow Removal Ordinance proposed by the manager and
prepared by the village attorney was read.~x~M. W. Howell
who'owns two cottages on Central Avenue objected strenuously
on grounds it would discriminate against summer dwellers who
are not out here to shovel their snow in the winter. He
thought that village personnel should clean the sidewalks.
On MOTION by Bly, second by ~nite, the proposal was tabled
until a later meeting.
The request of Mound Meta~craft to exchange small triangles
of property owned by the corporation and the village was
again discussed. Manager Storey reported that he had
examined the deed and investigated and ~uld discover no
restriction in reference to disposal of the property which
had been obtained from J. C. Krause. Bly offered the
following: ~ESOLVED that the manager be authorized to
request Mound Metalcraft to prepare deeds at its expense
for the proposed transfer of the two pieees of property
being discussed. Second by Winkel. Carried.

ADJOURNED MEETING~ December 27, 1951--Mayor Davis and Councilmen
Bly, Pierce and Winkel present. White working.
PUBLIC HEARING opened on the proposed amendment to the Zoning
Ordinance. Hearing had been advertised in the December 13
issue of the PILOT. Pat Guy, R. J. Rondorf, Phil David
and variou~ councilmen gave their views on the matter after
the proposed change was read. Decis~anmm on the matter was
tabled until the next regular meeting.
The proposed exchange of small triangles of land owned by
the village and Mound Metalcraft again ~iscussed. W.H.A.
Koehler and Mr. Cnounse and Gordon Batdorf of Metalcraft
were present. Mr. Koehler objected strenuously to the
transfer. He informed the council that if the tranfer was
effected he would bring suit to recover the north 40 ft.
of Lots 40, 41, 42 and 43, Koehler's Addition which had been
deeded to the village to widen Dell Street in 19;~Jl. This
matter was also tabled.
Mrs. F. G. Wallace, president of the PTA, Ray Jarvey of
Upper~ Tonka Council, and the Judson Snells and Bradley
Morrison of the Boym Scouts were present to request a
warming house for the skating rink. After a lengthy
discussion it was decided that the village would fix a
rink at the park and use part of the ~ vilion for a warming
house.
On Motion by Winkel, second by Bly, the meeting was
adjourned at 11:20 p.m.

Dr. Davis welcomed newly-elected councilman Edward Behmler
to the council.
On RESOL~TION by Pierce, second by Bly, the Minnetonka
PILOT was designated as the official newspaper.
ON RESOLUTION by Blv, second by Winkel, the State Bank of
Mound was designated as the depository for village funds.
On MOTION by Bly, second by Winkel, Edward Behmler was
elected to serve as acting mayor in the absence of Dr. Davis.
