1952-05-091326 VILLAGE OF MOUND MINUTES 0~ ADJOURNED REGULAR MEETING, MAY 9th., 1952 Meeting called to order at 8:35 P.M., in the basement of the Krause Building, by Acting Mayor Bebmler. Also present were Councilmen Bly and Livingston,' Ma~or Davis and Councilmen Pierce absent for cause. In attendance were Wm. Feyder of Toltz, King & Day, Village Engineers, Rev. Fagerlin, representing St. John,s Lutheran Church, A. R. Kelly, Div. Engineer, and John R. Sever- son, Right of Way Land & Tax Dept., Great Northern Railroad and Joe Krause. The purpose of the meeting was to conduct the hearing on the Assessment Roll prepared for the Improvement. of Central Ave., Highway No. ll0, Pro- ject No. 14 as advertised in the Pilot issues of April l0 and 17, 1952. Bly stated that there was one only protest in writing filed with the Village, it being from Consolidated School District No. 85, dated May 6, 1952, as quoted below: "Re: Plat 61710 61690 Curb and Sidewalk Assessments" Parcel ~ssessment Amount $441.54 7225 169.08 5000 394.08 "Protest is being filed with reference to the above subject assessments set 'up against the parking lot area. I have been inforu~ed by the School Board that last year when plans were being NOTICE IS HEREBY GIVEN that the Council of the Village of Mound will meet at 8 o'clock P.M. on the 9th day of May, 1952 in the basement of the Krause Building in said village to pass upon the proposed assessment for the im- provement of Highway 110, North . of the Great Northern tracks tO the village limits, consisting of the widening of said highway and the installation of curb, gutter and sidewalks. The proposed assessment amounts to $8,94&$8. The area to be assessed is the property abutting on. said im- provement. The proposed assess- ment is on file in the village office, and open to inspection by public. Any person desiring to object to the assessment is re-.~ quested to file with the actiDg village manager, a written state- ment of his objections on or be- fore the date of hearing. Edna J. Gooder Acting Village Manager (4-10, 17) made for the Highway Improvement Pro- ject at a meeting held in the Krause Building, the Village agreed to absorb the improvement cost as pertaining to the area compris- ing the parking lot. The School on the other hand, agreed to accept assessment for sidewalk, curb, and gutter improvement ex- tending North on the School side by the athletic field." "Signed Allan F. Liebrenz, Business Manager" Wm. Feyder, Engineer who was present at the meeting of May 8, 1951 stated as follows: "To my knowledge, at any meeting I attended, there was never any mention or discussion on the part of the Village of reducing o~ eliminating the assessment regard- ing the School parking lot area." Bly stated that he had read the above quoted letter to each of the three Councilmen present at the May 8, 1951, meeting, namely Mayor Davis, Councilmen White and Winkel, none of whom fecal I any such agreement, and further that no mention was made of same in the Minutes of said Meeting. Rev. Fagerlin requested that provision be made for a twenty foot wide driveway instead of the ten foot width provided for on the plans, as an entrance in the rear of the St. Jo~hns Lutheran Ohuffch.~. Accordingly, the assessment for Plat N. 6121~, Parcel 7800 was corrected to provide for the change. Mr. A. R. Kelly, Division Engineer, Great Northern Railroad, after examining the Assessment made against the Railroad Orooerty for 7 inch sidewalk, amounting to a total of 101.76, stated that the Railroad Company ~ould make no objection to the same. Wm. Feyder stated that a correction was in order for the Assessment against Plat No. 61690, Purcell No. 5000. The change was due to the fact that the School District had been assessed for a 66 foot frontage, which actually was a Village roadway. This correction was made leaving a frontage of 14 feet only to be assessable against this parcel and changed the total assessment from $394.08 to $58.80 After full consideration given to the one formal objection and to the corrections as listed heretofore in the minutes, Living- ston offered the following resolution and moved its adoption: h~EREAS: Pursuant to proper notice duly given as required by Minnesota Statute, number ~12.4~1, the Council of the Village of Mound has met and heard and passed upon all objections to the proposed assessment for the improvement of Central Cvenue, Project No. l~, from the Great Northern Railway tracks North to the village limits and has emended such proposed assessment as it deems ~ust. Therefore, Be it Resolved by the Village Council of the Village of Mound, Minnesota: That such proposed assessment as amended a copy of which is attached hereto and made a part hereof be and the same is hereby accepted and sh~l constitute the special assessment against the lands named therein, and each tract of land there- in included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. BE IT FURTHER RESOLVED: That such assessment shall be payable in equal annual installments extending over a period of ten (lO) years, the first of said installments to be payable on or before the first Monday of Jan'uarv, 1953, and one install- ment each year thereafter. Said installment shall bear interest at the rate of six per cent per annum. To the first installment shall be added in- terest on the entire assessment from the date of this resolu- tion up to and including August 15, 1953, to each subsequent installment when due shall be added interest for one year on all unpaid installments. Said assessment and the accruing interest t½,~r~on sh~i be ._~ lien 'upon the property included therein concurrent with general taxes, and, BE IT FURTHER RESOLVED: That the clerk forthwith transmit a certified duplicate of such assessment with each installment and interest set forth separately to the County Auditor to be extended in the proper tax lists of the county, and such 1328 VILLAGE OF MOUND assessments shall be collected and paid over in the same mMner ss other municipal taxes, provided that any owner of any property so assessed may ~t any time prior to the certification of the assessment to the County Auditor pay the whole of the assessment against an~ parcel or any annual installment, without interest, to the Village Treasurer; and he may at any time thereafter pa~ the whole of such assessment or any annual instalment, thereof, with interest, as to any lot, piece or parcel effected thereby. Bi~ seconded, and the vote for adoption stood 3 Yeas, No Nays. Bly offered the following resolution, and moved its adoption, seconded bT Livingston: '/fHE~&S, Mr. Fe.vder, of the Village Engineers, has presented the following recommendations for changes in the Plans for Im- provement of Project No. 14, 1. Eliminate the concrete gutter crossing the intersection of Grandview Drive and Central &ye., and replace with a 15-inch diameter culvert, including end sections. 2. Install culverts with end sections under the Bergen Driveway, and the Pollock Driveway, NOW, THEREFOR BE IT RESOLVED that the Engineers be authorized to instruct the Contractor to perform the work as recommended above, as an extra under their contract, at the unit prices under the contract for sLlch work. The vote for the adoption of the resolution stood 3 Yeas, No Nays. Eugene Hodge, owner of the former Leekle¥ property, at the Cor- ner of Todd and Chase, appeared and offered opposition to the proposed plan to use excess fill dirt from Project 14, in grad- ing Chase Street from the intereection with Morgan to Todd. The Council advised him that it was their general feeling that fill material, which was available for this purpose, and under the terms of our contract with the Park Construction Co., could be placed there at no expense to the Village, represented the sav- ing of man~ hundreds of dollars, and although they were in s.vm- path¥ with his desire to retain the large lawn now existing on the road right-of-way in front of his house, they felt that this road should be graded now, when it could be done without cost to the Village.
