HEARING ON VACATION OF A PORTION OF LINDEN STREET
December 15, 1952
Meeting called to order at 8:00 P.M. by ~cting Mayor Behmler.
Present were Trustees Pierce and Livingston, and Manager Leikvold.
Mayor Davis and Trustee Bi¥ out of town.
The purpose of the meeting was an open hearing on the va-
Cating of part of Linden Street. The following interested
property owners were present: Mr. Baker and Mr. Batdorf re-
presenting Mound Metalcraft, Mr. W~. Koehler, Mr. Joe Krause,
Mr. L. E. 0berdeck, Mr. E. J. Piche, Mr. Dale Mickelson
and Mr. Erwin Lange. The Mana~er read the official published
notice.
Mr. Behmler asked Mr. Krause what his reaction was. Mr.
Krause promptly replied he was in favor of vacating Linden Street
but thought Dell Street should be widened at the same time. He
thought the street should continue on east as it was started past
the Red & ~ite Store. Mr. Oberdeck wondered why the ~oad
couldn't be widened on the south side rather than to cut off the
front of the lots on the north side. Mr. Pierce tried to ex-
plain that it would cause a bottle neck and to leave the jog in

the road was poor village planning. Mr. Koehler spoke up and
said the road can be widened on the south side as the village
owns the land there.
Mr. Baker said that he was under the impression that the
widening of the street had been taken care of saveral Tears ago
between the Village and Mr. Koehler by him donating land on the
south side for street and parking area. Jogs in 9treets are a
common thing. He cited Minneapolis. He said if 26 feet were
to be taken from the p¥~opertv they proposed to purchase, which
is residential property, he doubted any gain the Village would
make would offset the damage done to that property by cutting
back into the hill. It would spoil two residences, the one the~
were purchasing and the one belonging to Mr. 0berdeck. ~e went
on to sa~ that the building they proposed to put up would be put
at the edge of the road line so that trailers unloading wo~l~
within the 26 feet, and the 26 feet would be considered as park-
ing space~
Mr. Pierce said with Metalcraft enlarging there would be
sti]~! greater need for parking space. Mr. Baker did not think
they would need to park on Dell Street. The~ would use the park-
ing space on the north side. The building they intended to put
up would be in line with the Red ~ ~ite Store and not built at
an angle as their present building. He did not feel they would
ever extend the factory to the east.
Mr. Koehler presented a letter to the Council and at the
same time said he would have ~9,000 invested in the property and
he womld not consent to having ~n~thing cut off the front as it
wouldn't be worth anything as a residence. It would slope way
back to the house. He maintained there was a jog in the road
farther east and that by using t¼e land on the south side, this
jog woul~ be eliminated. Mr. Koehler, according to the letter,
felt the matter should be tabled until abstract tile is received,
which should be within a few da~s.
Mr. Baker said that there is very little traffic on Dell
Street, and that it may be many years before anything would need
to be done to the street. Mr. Baker went on to say that we are
ali interested in Mound and want to do the thing of most benefit
to the Village, that Mound Metalcraft was making an investment of
~1~0,000 and wouldn't be vet? apt to sell and move out of the
Village.
Mr. Krause said that he was looking to the future and that
he wasn't down here to buck Metalcraft, but that he would like
to see Dell Street straightened out and widened.
Mr. P~erce asked Mr. Krause if Linden Street were to be
vacated if it wo~.~td create an~ additional burden to his property.
He did not think so.
Mr. Piche, who was asked his opinion, said that he has a
five--year lease on the building where he operates his garage, but
it is not adequate for a garage and he plans to make some other
arrangements, bat as long as he is in there, he would like some

parking space. If the property belonging to the Village could
be fixed into a good parking lot, he would be willing to rent
it from the Village.
Mr. Koehler felt the matter should be tabled 'until ab-
stract of title is received, which would be within a few days.
Mr. Bake,r said with the new problems coming up, he would like
to stud~ it a little more. There is the matter of transpor-
tation too. And if there were to be any changes, he would like
to give it a little more consideration. He did not want to
place Metalcraft in a position whereby the deal would not go
through. He went on to say that if it is of no more importance
to the Village and the? were going to let these technicalities
stand in the way, it would be good to know it and to know it
now. Mr. Pierce said that they were only thinking of the future.
Mr. Gruhn appeared at the meeting then. He said that he
would be glad to give some of his frontage to the Village to
widen Dell Str~et. At the sane time he would want to cooperate
with Mound Metalcraft. He ~ouldn't want to take away anything
they needed.
Mr. Baker said he would like to have the Village improve
the swamp for parking even within the next year.
Mr. Pierce then asked for a corner of the lot, not that
we would use it now, but so we would have a right to it when
it was decided to widen. Mr. Baker said that when that time
came he was sure, if he still owned it, that he would be will-
ing to sit down and discuss it. It would not interfere with
what the~ proposed to do now. He said the property would still
be considered residential.
Mr. Mickelson of the Ford Garage was asked how the Mound
Chamber of Commerce who had agreed a couple of weeks ago to
help Metalcraft buy this property had felt about closing this
street. He said that no interested adjoining property owner
in the Chamber of Commerce had voiced any objection, that
there had been no mention made of a roadway easement, and that
the Mound Chamber of Commerce was primaril~ interested in keep'
lng Mound Metalcraft in town.
Mr. Pierce wondered if the adaitional land (vacated street)
they received wouldn't be worth as much as the land along Dell
Street and thereb~r increase the value of the property.
Mr. Baker said that as long as the building stands it is
still regarded as residential. In the event it was torn down
and a commercial structure is built this matter of providing
for an easement or for cutting across that corner could be
brought before the Council and acted upon at that time. He
said they do not propose to tear down the house. AnT agree-
ment of that kind wo:~ld have to appear in the abstract. He
had no objection to a provision that a corner co~.~ld be taken
off.

Mr. Behmler asked if this meant the 26-foot strip across the
front of the property. Mr. Baker said ~.ot 26 feet, b~t a corner
to modify the corner sticking oat in the street; any fat'ure bmitd-
ings being built will be put on the same line; no commercial
seructmre can be erected beyond that given bmilding line.
Mr. Baker proposed to have the Village Attorne~v draw ap a
proposad agreement to be s~bmitted to the interested parties.
Mr. Beh~ler said that we have reached a point where the next
step is to refer it to oar legal department, indicating to that
department ~hat has gone on, and have them look into the legal
aspects and draw up the Coancil's decision so you can have some-
thing in writing to present to the financing institation.

tinaed December 17, 1952 at 7:00 }~'.M.

The Manager tabulated the bids on the truck. After some
discussion Mr. Pierce ~ade a ~.otion to accept the bid of Pioneer
Track, Inc., provided that the interpretation of the '~ouncil is
correct that the bid isin~.!~.e amoant of ~1,854.9t net, f.o.b. Mound.
Mr. Livingston seconded, and it was carr~ed unanimoasl¥.
Mr. Pierce made a motion that wt~en Park Construction Company
pays the ~361.50 they owe the Village that a check be made to them
in the amoant still due them of l)42,24~3.2~. Motion seconded by
Livingston and carried ananimoaslv.
The Council instracted t5e Manager to attend the meeting of
the Henneoin Count~ League of Towns and Manicipalities at the Red
Owl Auditorium, Hopkins on Friday, December 19, 1952 at 8:15 P.M.
Livingston and Pierce would also attend if oossible.
