Present were Mayor Behmler, Trustees Wenkstern, Livingston and Litts, Attorney Bonham and Manager Leikvold. REZONING Sylvan Height s The following ord ~nce was read: ORDINANCE NO. 56 AN ORDINANCE AMENDING ORDINANCE NO. 46, RELATING TO THE USE OF CERTAIN PROPERTY The Village Council of Mound ordains: Zoning Ordinance No. 46, as amended, is hereby amended as fol lows: Section 1. B? zoning as Industrial property and by expanding the Industrial District on the "Zoning Map of Mound, Minnesota", attached to said ordinance to include that certain tract or tracts of land in the Village of Mound, County of Hennepin and State of Minnesota described as follows: Lots 4,5,6,7,8,9,10 and 11, Block 5, Sylvan Heights Addition and Yost Street, as heretofore vacated; Section 2. Resolution on DIVISION OF EXPENSE SURFACE iMPROVEMENTS Litts offered the following resolution and 'moved its adop- tion: WHEREAS it is desirable that the Council adopt a policy per- taining to the division of expense of surface improvements to be to be borne by the Village and affected property owners, ~nd ~HEREAS the council has given affected property owners ample opportunity to express their views on the matter at public hear- ings upon such proposed improvements, and WHEREAS the council has obtained information relating to such division of expense from comparable municipalities, and WHEREAS, it.is'apparent to the council that a substantial increase in surface improvenents may be soon undertaken, and WHEREAS the Council has given careful and extensive con- sideration to all of the foregoing, NOW, THEREFORE, BE IT RESOLVED THAT: 1. one hundred percent of curb and gutter improve- ments shall be borne by and assessed to property affected by such improvements; 2. one hundred percent of sidewalk improvements shall be borne by and assessed to property affected by such improvements, sa~e in exceptional circum- stances to be determined by the council; 3- one hundred percent of the engineering expense incurred by the foregoing shall be borne by the Village · Wenkstern seconded the motion and the roll being called, the vote was: Livingston Yea Litts yea wenkstern yea Behmler yea And so the motion was carried. Resolution on ASSESSMENT OF CORNER LOTS Livingston offered the following resolution and moved its i538 VILLAGE OF MOUND ado pt ion: WHEREAS it is desirable that the Council adopt a policy per- taining to the assessment of corner lots affected bv surface im- provements, and WHEREAS the Council has given corner lot owners affected by such improvements full opportunity to be heard on the matter at public hearings held on such proposed improvements, and WHEREAS the council has carefully considered all factors per- taining to the assessment of corner lots affected by such improve- ments, NOW, THEREFORE, BE IT RESOLVED That corner lots affected by surface improvements shall be assessed 100% of such improvements installed thereon. was: Litts seconded the motion and the roll being called, the vote Livingston Yea Litts Yea Wenkstern Yea Behmler Yea And so the motion was carried. Creation of Fire Zones - The following fire zones are h~reby~ated and established in the Village of Mound:. a. Fire Zone One (1) shall consist of the Commercial District Tract "A" and the Industrial District; b. Fire Zone Two (2) shall consist of the Mdltiple Dwelling District; c. Fire Zone Three (3) shall consist of the Residential District Subdivision "A" and the Residential Sub- division "B". Section 2. Attest: Village M~nager MEETING 0F CANVASSING BOARD April 27, 1955 FIRE STATION Purs'uant~to due call and notice thereof, a meeting of the Village Council of the Village of Mound, Hennepin County, Minnesota, was duly held at the Village Hall on Wednesday, April 27, 19~ at 8 o,clock P.M. The following members were present: Mayor Behmler, Trustees Litts and Wenkstern; and the follo~Ang were absent: Trustees Livingston and Pierce. The Clerk presented affidavits showing posting and publica-- tion, which affidavits were examined and found satisfactory and ordered placed on file.
