On motion duly made, seconded and carried, the meeting adjourned to re- convene October 3, Attest: 1~55. ~illage Marf~ger MINUTES OF ADJOURNED REGULAR MEETING, October 3, 1955 Meeting was called to order in the Village Office at 8:00 P.M. Present were Mayor Behmler, Trustees Livingston, Pierce and Wenkstern, Attorney Bonham and Manager Leikvold. HEARING - ASSESSMENT Curb & Gutter Grant & Yale The Clerk announced that the proposed assessment for Curb & Gutter, Grant and Yale had been filed in his office on the 12th day of September, 1955, and that notice of hearing on said assessment had been given in the form and manner as provided by law. The Clerk presented an affidavit showing publication of such notice in the official newspaper, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor announced that the meeting was open for the consideration of objections to the assessment theretofore filed with the Village Clerk for Curb & Gutter on Grant and Yale. The Clerk reported t~at ~Titten object~ons b~d been filed by the lo.ow- ing persons afffecting the following described lots, pieces or parcels of land, to wit: None The following persons were then heard and presented their objections to said assessment: None After due consideration of all said objections, Pierce introduced the following resolution and moved its adoption: RESOLUTION CONFI~4ING ASSESSMENT FOR CURB AND GUTTER, GRANT AND YALE BE IT RESOLVED By the Village Council of the Village of Mound, Minnesota 1600 VILLAGE OF MOUND as follows: 1. The Village Clerk has with the assistance of the engineers hereto- fore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the construction of curb and gutter on Grant and Yale Avenue against every~assessable lot, piece or parcel of land in accordance with the provisions of of law, and has prepared and filed with the Village Clerk tabu- lated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amo~nt calculated against the same. 2. Notice has been duly published as required by law that this council would meet in regular session at tl~s time and place to pass on the proposed assessment. 3. Said proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opport~n~ity has been given to all interested persons to present their objections, if any, to such proposed assessments or to any item thereof, and no objections have been filed. The amounts specified in the proposed assessment are changed and altered as follows: No changes This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially bene- fited by the construction of curb and gutter on Grant and Yale Ave. in the Village in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount so set out is hereby levied against each of the respective lots, pieces or parcels of land therein described. 6. Such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and n~aed in said proposed assessment with the changes and alterations hereinabove made, are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 7. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall there~oon be and constitute the special assessment for the construction of curb and gutter on Grand and Yale Avenue. 8. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the s~ue have been paid at the rate of four per cent per ann~m. 9. Such assessment shall be payable in five equal annual installments payable on the 1st Day of January in each years beginning in the VILLAGE OF MOUND 1601 year 19~6, and continuing until all of said installments Shall have been paid, each installment to be collected with taxes collectible durin§ said year by the county auditor. To the first installment shall be added interest on the entire assessment from the date hereof to December 31, 19~6. To each subsequent in- stallment shall be added interest for one year on all unpaid in- stallments · 10. The Village Clerk is hereby directed to make up and file in the office of the county auditor of Henne?in County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon the first day of January in each year. The motion for the adoption of the foregoing resolution was duly seconded by Wen~stern, and ~pon vote being taken thereon the following voted in favor thereof: Pierce Wenkstern Livingston Behmler and the foil°wing voted against the same: None, whereupon said resolution was declared duly passed and adopted. A letter was read from the business manager of the School District #85 written on behalf of the school board protesting the assessment on the Shirley Hills Drainage Project. The Attorney advised the Council that the legal date for filing a formal protest had passed. The Council directed the Manager to acknowledge the letter and eXplain why the Council placed the assessment they did on the school property. "ON" SALE LIQUOR ~enkstern moved that the ,On Sale" liquor store be closed as of January l, 19~6. Livingston seconded the motion. After some discussion of the motion, Livingston moved that the motion be tabled until a full council is present. Fire Hall Bonds (previously certified) 2,800 and further not to levy the $1~?00 for Project #1~, the $6,300 for the P.I.R. Fund nor the $3,000 for Street Improvement Bonds, all previously certified.
