Brazman offered the following resolution and moved its adoption.

BE IT RESOLVED, the Tax Levy for the 1960 Budget be certified to the County
Auditor as follows:

WHEREAS, the following sums of money be budgeted for the Village of Mound for
the following purposes for the current year:

STREET LIGHTING PROJECT #17
Trustee Batdorf introduced the following resolution and moved its adoption:
RESOLUTION DETERMINING TOTAL COST, DIRECTING ASSESSMENT AND
PROVIDING FOR THE ISSUANCE AND SALE OF STREET LIGHTING IMPROVE-
MENT BONDS, FIXING FORM AND SPECIFICATIONS THEREFOR, DIRECTING
THEIR EXECUTION AND DELIVERY AND PROVIDING FOR THEIR PAYMENT.
BE IT RESOLVED by the Village Council of the Village of Mound, Minnesota, as
follows:
1. It is hereby determined that a contract has been entered into for
the construction of a street lighting improvement heretofore designated
as Street Improvement Project No. 17 and the estimated expense of
said improvement has been determined and is hereby declared to be
$26,676.00.
Z. It is further determined that the sum of $20,007 shall be assessed
against property specially benefited by said improvement and the sum
of $6,669 and interest thereon shall be provided by ad valorem levies
against all of the taxable property in the village. The clerk, with the
assistance of the engineer, shall prepare an assessment roll. All
deferred assessments shall be collected in five installments with taxes
for the years 1959 to 1963 inclusive. Interest on deferred ins~t~}n~ents
shall be 6%. ~,~:,'
3. It is necessary to provide money to pay a pq~tion of the cost of
said improvement by the issuance of general ob~ .~ion bonds pursuant
to Minnesota Statutes, Section 42-9,091 in the a~t of $17,000. The
bonds shall bear date October 1, 1959, consist Of {7 bonds numbered
1 to 17, both inclusive, bear interest as hereinafter set forth payable

July 1, 1960, and simiannually thereafter on January 1 and July 1 in
each year and mature serially on January 1st in the amom~t of $2., 000
in 1961, 1962 and 1963, and $4000 in 1964 and 1965, the maturities
herein set forth being such as in the opinion of the council are war-
ranted by the anticipated collections of assessmer~s and ad valorem
levies for the village's share of the Cost.
4. The offer of Mound State Bank to purchase bonds issued hereunder
bearing interest at the rate of 4 1/2 % per annum at the par value
thereof is hereby determined to be a favorable offer and is hereby
accepted. In accordance with said bid, both prinicpal and interest on
said bonds shall be payable at Mound State Bank in Mound, Minnesota.
The bonds shall be in substantially the following form:

KNOW ALL MEN BY THESE PRESENTS That the Village of Mound,
Hennepin County, Minnesota, acknowledges itself to be indebted and for value
received hereby promises to pay to bearer from its Street Improvement Project
No. 17 Fund on the 1st day of January, 19 , the sum of ONE THOUSAND DOL-
LARS and to pay interest thereon from the date hereof until the principal amount is
paid at the rate of four and one half {4 1/2%) per annum at the par value thereof,
interest to maturity payable July 1, 1960, and semiannually thereafter on the 1st
day of January and the 1st day of July in each year. Both prinicipal and interest
are payable at Mound State Bank in Mound, Minnesota, in any coin or currency of
the United States of America which at the time of payment is legal tender for public
and private debts. For the prompt and full payment of such principal and interest
as the same respectively become due the full faith, credit and taxing powers of the
village have been and are hereby irrevocably pledged.
Ail bonds of this issue are subject to redemption at any time on pay-
ment of par and accrued interest to date of redemption.
This bond is one of an issue of $17,000 g~cipal amount, all of like
date and tenor except as to maturity, ali issued by the vill~l~~ for the
purpose of providing money to defray the expense incurred or to be incu2~, in
making an improvement heretofore designated as Street Improvement Pro'ii,ct No.
17 as authorized by Chapter 429, Minnesota Statutes, and by resolution of the
council and is payable primarily from special assessments to.be hereafter levied
against property benefited by said improvement and from ad valorem taxes hereto
fore levied for the general village share of the cost.
IT IS HEREBY CERTIFIED AND RECITED That all acts, conditions
and things required by the Constitution and Laws of the State of Minnesota to be done,

To happen, to exist and to be performed precedent to and in the issuance of this
bond have been done, have happened, do exist and have been performed in regular
and due form, time and manner as so required; that the full faith and credit of the
village is pledged for the payment of the principal and interest of the bonds of this
issue when the moneys on hand in the appropriate fund are insufficient for the pur-
pose and taxes will be levied upon all of said property, if needed, to take care of
any deficiency, without limitation as to rate or amount and that the issuance of this
bond did not cause the indebtness of the village to exceed any constitutional or
statutory limitation thereon.
IN WITNESS WHEREOF, the Village of Mound, Hennepin County,
I~innesota, by its Village Council, has caused this bond to be executed in its behalf
by the signature of the Mayor and countersigned by the Village Clerk and its
corporate seal to be hereto affixed, all as of October 1, 1959.

6. · The bonds shall be mimeographed or dittoed under the direction
of the village clerk and shall be executed on behalf of the village by the signature
of the mayor and countersigned by the village clerk, and the corporate seal of the
village shall be affixed to each thereof. When the bonds have been so executed
they shall be delivered by the village treasurer to the purchaser thereof upon
receipts of the pu~ chase price heretofore agreed upon, and the purchaser shall not
be obligated to se~, to the proper application thereof.
7. The-bonds issued hereto%der shall be payable from Street Improve-
ment Project No. 17 - 1959 Fund heretofore created and there is hereby irrevoca-
bly appropriated to such fund all special assessments heretofore or hereafter levied
for the improvement referred to in paragraph 1 hereof, provided that if any pay-
ment of principal or interest shall become due when there is not sufficient money
in said fund to pay the same the treasurer shall pay such principal or interest from
the general fund of the village and such fund shall be r.~imbursed for such advances
out of proceeds of assessments for said improvements~~ when collected,

The village clerk shall deliver a copy of this resolution to the County Auditor of
Hennepin County and obtain his certificate in accordance with Section 475.63 Minn-
esota Statutes.
9. It is hereby determined that the improvement to be financed by
the issuance of bonds hereunder will benefit the entire village and the village hereby
covenants with the holders from time to time of said bonds as follows:
a. It will cause the assessments for said improvement to be prompt-
ly levied so that the same will be collectible commencing in 1960 and
will take all steps necessary to assure prompt collection.
b. It will keep complete and accurate books and records showing all
receipts and disbursements in connection with each improvement, the
assessments levied therefor and other funds appropriated for their
payment and all collections thereof and disbursements therefrom,
moneys on hand and balance of unpaid assessments,
c. It will cause its said books and records to be audited at least
annually by qualified public accountants and will furnish copies of such
audit reports to any interested person upon request.
10. The officers of the village are hereby authorized and directed to
prepare and furnish to the purchaser of the bonds and to the attorneys approving
the same certified copies of all proceedings and records of the village relating to
said bonds and to the financial condition and affairs of the village, and such other
certificates, affidavits and transcripts as may be required to show the facts within
their knowledge, or as shown by the books and records in their custody and under
their control relating to the validity and marketability of said bonds, and such
instruments including any hereto fore furnished shall be deemed representations
of the village as to the facts stated therein.
The motion for the adoption of the foregoing resolution was duly
seconded by Trustee Petersen, and upon vote being taken thereon the following
voted in favor thereof:
