1959-12-092038 VILLAGE OF MOUND Total Number of votes cast 950 votes AND WHEREAS, pursuant to M. S.A. No. ZlZ. 36, the Village Council shall meet as a Canvassing Board and declare the results ~ appearing from said returns, and WHEREAS, pursuant to said statute, the Village Council now meets as a Canvassing Board for such purpose, NOW THEREFORE BE IT RESOLVED that the following persons are declared elected to the following offices: Mayor Trustee Constable Justice of the Peace H. B. R. Howard C. (Bud) Orn Lamont Weiland William R. Koenig The Village Clerk is hereby instructed to give written notice to each person chosen toh~'~ election to the office named and to certify the results of said election to the County Auditor. The mayor declared the meeting of the Mound Village Council as a Election Canvassing Borad closed and the Council to reconvene immediately as a Council for the Regular Meeting of December 9, 1959 at the Mound Fire Station. MINUTES OF THE REGULAR MEETING OF DECEMBER 9, 1959 at 7:30 P.M. at the Mound Fire Station. Present were: Mayor Larson, Trustees Gulden, Batdorf and Petersen; Attorney Ploetz and Manager Boxe11. The Minutes of the November 10, 1959 regular meeting were read. Petersen moved and Gulden seconded a motion to accept the minutes of the November 10, 1959 regular meeting as read. The vote was unanimously in favor. So carried and accepted. VILLAGE Of MOUND 2039 The Minutes of the November 13, 1959 adjourned meeting were read. Batdorf corrected the minutes to read: (page 2033 -second paragraph) "Now therefore be it resolved, by the Village CoUncil of the Village of Mound, the Village Council having heard the facts and determined them to be as stated herein, that councilman Brazman is not entitled to exercise the powers and duties of the office of Councilman expiring December .31, 1960, that he be and hereby is, removed therefrom, and a vacancy in the same office be, and hereby is, declared to exist." Batdorf moved and minutes of November 13, 1959 be accepted as read and corrected. Gulden seconded the motion. The vote was unanimously in favor. So carried and accepted. The Minutes of adjourned meeting of November 18, 1959 were read. Batdorf moved and Petersen seconded a motion to accept the minutes of November 18, 1959 adjoUrned meeting as read. The vote was unanimously in favor. So carried and accepted. The Minutes of the adjourned meeting of November 27, 1959 were read. Batdorf moved and Gulden seconded a motion to accept the minutes of November 27, 1959 adjourned meeting as read. The vote was unanimously in favor. So carried and accepted. Manager Boxell read a letter from the Municipal Commission of the State of Minnesota announcing a hearing by theiCommission on the incorporation petition of Minnetrista Township and the proposed annexation of Island Park to the Village of Mound on December 28, 1'959 at 10:00 A.M. in the County Commissioner's ROom of the Hennepin County 'Courthouse. Mayor Larson continued the Annexation Hearing until the regular meeting of January 12, 1960 at 8:00 P.M. at the Mound Fire Station, by executive order. 2040 VILLAGE OF MOUND HEARING ON REASSESSMENT OF ASSESSMENT ROLL - Project #17 Street Lighting Project. The hearing was declared open by Mayor Larson. The Village Manager displayed the publication of notice and the ass- essment map. Attorney Ploetz acknowledged the petition filed by Bethel Methodist Church as benefited property owner assessed. Attorney Francis Colgrove spoke in support of the Bethel Methodist Church petition objecting to their assessment, as their counsel. A petition was presented having been filed with the villag& clerk, by individual taxpayers not in the assessment area. Mr'. Frank Living- ston was- sp~keman for the grOup of Z3 signers. Attorney Ploetz read the petition. Frank Livingston spoke for the taxpayer~ petition. A discussion followed. W. D. Roberts spoke the efforts of the petitioners. Gene Carr spoke against petition, fi'~rst as editor of the offical newspaper and secondly as the president of the ~ber of Commerce. The petition for Bethel Methodist Church was discussed. Francis Colgrove spoke as counsel for the church. D~du~sion followed. Hugh Rice spoke for the Our Lady of the Lake Catholic Church and stated the Catholic church was satisfied to pay their share and expressed their approval of the project. Mayor barson expressed his and the council's appreciation of the statement by Mr. Rice. Ray Koehn spoke against assessment of any churches or schools. Harry Martin spoke for the Bethel Methodist petition. A five minute recess was declared by Mayor Larson. Gulden moved and Petersen seconded a motion, that the Village property lying Ely of the tin shed, and Wly of the Wly line of Maple Avenue extended be assessed at a 50% benefit factor, and the product thereof, $403. Z0 be added to the assessment roll, and Be It Further Moved, that the Bethel Methodist Church benefit factor be changed, from 91.7% to 65%,and their assessment be accordingly reduced to thd product thereof, $963.05.' The vote was unanimously in favor. So carried. VILLAGE OF MOUND 2041 RESOLUTION ADOPTING ASSESSMENT STREET LIGH~ NG PROJECT #17 Batdorf offered the following resolution and moved its adoption. seconded the motion. Petersen WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed new assessment for'hte improvement of County Road No. 110 from a line across ~aid road, being an extension Northwesterly of the Southwesterly line of Lot 11, Auditor's Subdivision No. 167, Hermepin County, Minnesota, Northerly to the .Northerly line of Todd Avenue, extended Westerly.across said road, and the improvement of County Road No. 15, from the intersection thereof with County Road 110, Easterly to the Easterly line of Maple Street, extended Southerly across said road, by Street Lighting Project No. 17; and has amended.such proposed assessment as it deems just. NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL, VILLAGE OF MOUND, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby adopted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed, improvemen~ in the amount of the assessment levied against it. 2. Such assessment shall he payable in equal annual installments extending over a period of five (5) years, the first of the installments to be payable on or before the first Monday in January, 1960, and shall bear interest at the rate of six (6) percent annum from the date of the adoption of this assessment resolution. To the first installment.shall be added interest on the entire assessment from the date of this resolution until December 31~ 1959. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor; pay the whole of the. assessment on such proper~ty, with interest accrued to the date of payment, to the village treasurer, except that no interest shall be charged if the entire assessment is paid within 30 .days from the adoption of this resolution; and he may, at any.time thereafter~ pay to the co.unty treasurer the.entire amount of t~he assessment remaining unpaid, with interest, accrued to December 31 of the year in:Which such payrn~t is made... 4. The clerk shall forthwith transmit a certified duplicate of this assess- ment to the county auditor to be e~,tended on the proper tax lists of the county, and such.assessments shall be collected and paid over in the same manner as other municpal taxes. PETITION FOR STREET LIGHTS Batdorf moved and Petersen seconded a motion. BE IT MOVED, the Northern States Power Company be authorized to install lights at the intersection of the Grandview Junior High school drive and Commerce Blvd. (Hwy. #110) and at the intersection of Halstead Lane and Bay Ridge Drive. The vote was unanimously in favor. So carried. Manager Boxell read the hi-lights of the Minnesota Dept. of Health letter, in . regard to the tests taken in the Three Points area of Mound. Batdorf moved and Petersen seconded a motion to adjourn until the adjourned meeting of December 15, 1959 at the Mound Fire Station at 7:30 P.M. The vote was unanimously in favor.
