Re: Walgreens Redevelopment Project
Summary. Following the Metropolitan Council's approval of the Comprehensive Plan Amendment
(CPA) related to the Walgreens redevelopment project that took place on May 23, 2012, the City
Council is required to formally adopt the CPA and to put it in effect.
Additionally, an action is being requested related to termination of a Conditional Use Permit on the
property at 2281 Commerce Boulevard (John's Variety and Pets) as the subject property is part of the
Walgreens redevelopment area and the CUP will no longer be needed when the existing business
vacates the premises.
Members are advised that both resolutions are draft and are under review by Staff, including the City
Attorney, and therefore may be subject to possible revision and /or additional comments. Staff will
• provide further comment at the May 29"' special meeting.

RESOLUTION NO. 12
Resolution Adopting the Mound Comprehensive Plan Amendment
for Walgreens Redevelopment Project and Putting the
Comprehensive Plan Amendment into Effect
WHEREAS, the applicant, Semper Development, requested a Comprehensive Plan
Amendment to facilitate a Walgreens redevelopment project; and
WHEREAS, the properties are located near the southwest corner of the intersection of
Lynwood Boulevard and Commerce Boulevard in downtown Mound; and
WHEREAS, the Comprehensive Plan Amendment will reguide the following properties
as follows; and
WHEREAS, pursuant to Chapter 462, Section 355, Subdivision 2 of the Minnesota State
Statutes, the Planning Commission held an official public hearing on December 6, 2011
to allow formal public comment on the proposed comprehensive plan amendments; and
WHEREAS, the City Council reviewed the matter at its January 24, 2012 meeting and
recommended approval of the aforementioned Comprehensive Plan Amendment; and
WHEREAS, the City Council adopted the Comprehensive Plan Amendment with the
following conditions:
1. Applicant shall be responsible for payment of all costs associated with the
Comprehensive Plan Amendment Request.

WHEREAS, the City Council's preliminary approval of the Comprehensive Plan
Amendment was also made subject to review and approval by the Metropolitan Council;
and
WHEREAS, at its May 23, 2012 meeting, the Metropolitan Council reviewed the
Comprehensive Plan Amendment and found it meets all Metropolitan Land Planning Act
requirements, conforms to the regional system plans, is consistent with the 2030
Regional Development Framework and is compatible with the plans of adjacent
jurisdictions.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Mound that
the Comprehensive Plan Amendment is hereby adopted and put into effect.
Adopted by the City Council this 29 day of May 2012.

Approval of Resolution Terminating Conditional Use Permit (CUP)
approved by Resolution No. 90 -72 by the City Council on July 30,
1990 and recorded in the Office of the Registrar of Titles of Hennepin
County, Minnesota on November 1, 1990, as Document No. 2134072
WHEREAS, the applicant, Semper Development, with the consent of the property
owners, submitted land use, subdivision, alley vacation applications and related
requests to facilitate a Walgreens redevelopment project; and
WHEREAS, the property at 2281 Commerce Boulevard, which is part of the project area
for the Walgreens redevelopment project is subject to a conditional use permit;
approved by Resolution No. 90 -72 that was adopted by the City Council on July 30,
1990; and
WHEREAS, Resolution No. 90 -72 was recorded in the Office of the Registrar of Titles of
Hennepin County, Minnesota on November 1, 1990, as Document No. 2134072; and
WHEREAS, the applicant requests that the City Council consider an action to terminate
the conditional use permit with such termination to become effective the day construction •
for the Walgreens redevelopment project commences on the site; and
WHEREAS, the holder of the conditional use permit has consented to the request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mound,
Minnesota as follows:
The conditional use permit adopted by City of Mound Resolution No. 90 -72 will
terminate and become effective the day construction for the Walgreens
redevelopment project commences on the site.
2. The current activities regulated by the conditional use permit on the property at
2281 Commerce Boulevard may continue to operate until such termination date.
3. This resolution pertains for the following legally described property:
