five days of completion of such construction or repair, the village
may, in its option~ perform the same amd cha~ge the cost thereof to
Westonka Telephone Company. P~ovided further, if Westonka Telephone
Company fails to replace and restore road way and street structure·
of any damage becoming apparent within one year~ promptly and with-
in five days receipt of notice thereof from the village, the village~
in its option~ may perform such restoration a~d charge the co~t
thereof to Westonka Telephone Company.
We·tonka Telephone Company must assume all responsibility for such
conduit construction and any injuries to persons or damage to prop-
erty arising out of or resulting from said construction and must in-
demnify and hold the village harmless from any damages to the village~
lawsuits and costs of defendants for such claim against the village~
and Jud~ents awarded against the village as a result of any such
laws uit ·.

Westonka Telephone Company will provide necessary warning lights and
b&rriera for their excavations, and will not excavate in such a fashion
as te block all vehicle traffic except upon specific pemission of the
village therefor.
Westonka Telephone Company assumes all responsibility for relocation
and cost of relocation of such conduit construction in the event of
the change of grade, elevation~ or location of such streets and roads.

COMMISSIONERS AWARD IN WELL SITE NO. ~ CONDEMNATION
~fH~JREAS, the Village of Mound did by resolution duly adopted October 2, 1961
order the acquisition of lands and ease~nts for the purpose of a well site, pump-
ing station, and water main in Water Extension Project 61, I-U, consolidated, by
proceedings under the right of emi~enttdommin;
WHEREAS, condemnation proceedings under Minnesota Statute llT.20~ere duly
iniUmted pursuant thereto, commissioners were appointed, qualified, did appraise
the parcels proposed to be taken and did reach a high appraisal of $2,000 there-
for and a low appraisal of $1700 therefor
AND WHEREAS, pursuant to said Minnesota Statute 117.20 the owner of the con-
demned parcels has the right to demand partial payment of the award pending final
determination in an amount not to exceed ?5% of the commissioners award
NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF MOUND,
