HEARINGS 1. WILSHIRE DRIVE - STREET ASSESi~MENT The attorney declared the publication and mailing to be legal and sufficient. Engineer Schoelt presented the completed ~roject and showed how the assess- ment was made. Myron Skow, owner of Tract B of Registered La~d Survey asked to ha~e his assess~ent broken do~. Darwin Dickey, owner of Lots 2~, and 2~, Block 3 of Shirley Hills Unit "F" w~s also ~resent. Allan Liebrenz representing School District #?77 asked Mr. Schoel! to review for the bede- fit of the ~eo~le ~resent wh~t the school would h~ve to pay. Mr. Schoell said the school has a lot of affected frontage an~ drainage which brings the assessment high, but that it rece~ve~ credit for the storm sewer ticipated in in 19~3. Mr. Gustafson re~resenting Mt. Olive Lutheran Church and Dick Olson representing the America~ Legion were also present Pfeifer moved and Johnson seconded the motion. SPECIAL USE PER,fIT - Cabinet Shop in Highlands The attorney declared the publication was legal and sufficient. Frank Tusler, owner of the property in question, and Sverard Geyan of G & S Cabinets were present. ~[r. Geyan was questioned by the Council as to the noise that would come from his building. He said with doors and windows closed there would be no noise. He said he had plans for apartments above but would build only the lower part first. Question of noi~e in summer brought u~ the possibil~.ty of air conditioning. K. Kammanm, owner of the property across the street, said he had been in Commercial and assessed Commercial for many years and he did ~ot like to see any change. It was exolaine~ to him that this was not a hearing on the changing of zoning, but a request for a special use per, it; namely, a cabinet shop on a commercial-zoned piece of property. The Council was informally polled. Mr. He.~kkita said he would prefer to see a better appearing bu~tding than just a concrete buitding~ dress it to conform with the residential buildings. He would also like to see some limits on appearance as to storage, hours of operated_on and mossibly have a re'wiew~! and a study of the noise to see if it should be reissued. Mm. Johnson said he would abstain. Mr. Pfeifer agreed with Mr. Heikk~la and if there were any complaints received it wo%~ld have to be refused. If no noise factor, no problem. Mr. [(oehn felt some~hst the same, but was con- cerned about too many restrictions being ?!a~ed on it, the b~.~i!5er become discouraged. Mr. Geyan was asked if -there weren't some other vlaces he could build his shop. He said th~.s was close to his home, and it vms difficult to f~nd a location. Mr. Tusler asked if this could be continued so he co,told bring an engineer ~,fno might explain if sir conditioning would help. Hearing continued to April 21st. HEARINGS (continued) 3. SHIRLEY HILLS UNIT "F" Lots 11-24, Block 2 This hearing was continued from the meeting of March 17th at which time these lots were not acted upon as advertised. Russ Orn was present. VILLAGE FIRE MARSHALL The Village Manager was asked to reword the ordinance pertaining to the Village Fire Marshall and report at the next meeting or later. BOARD OF HEALTH Heikkila moved and Pfeifer seconded a motion. RESOLUTION 64-76 RESOLUTION APPOINTING BOARD OF HEALTH Roll Call Vote: Heikkila Aye Pfeifer Aye So carried and resolved. Johnson Aye Koehn Aye DUTCH ~.M DISEASE ~ · Mr. Kopp reported that the Dutch elm disease no doubt would be becoming serious in Mound soon and some provision should be made to eliminate the breeding places of the Dutch elm beetle. Johnson moved and Heikkila seconded a motion ORDINANCE NO. 172 AN ORDINANCE AMENDING CHAPTER 60, MOUND CODE OF ORDINANCES, ENTITLED "NUISANCES" THE VITJ.AGE .COUNCIL OF MOUND, MINNESOTA ORDAINS: That Chapter 60, Mound Code of Ordinances entitled "Nuisances", be, and hereby is, amended by adding to the provisions of Section 60.02 thereof subdi- vision "11" as follows, to-wit: Section 60.02 11. All dead standing trees which present a hazard to life or property, all elm or other trees found harboring the Dutch elm beetle, all dead standing elm wood, and all cut elm or other wood found harboring Dutch elm beetle." 2. FIREFLIES REQUEST The Fireflies have requested Permission to sell beer at their May 9th dance, proceeds of which are used to equip a Little League Team. No action. REMOVAL OF CONDEMNED HOUSES The Village Manager requested permission to remove the structures on the following pieces of property and to assess the cost to the property owners: Lots 15 and 16, Block 15, Shadywood Point - owned by R. N. L. Anderson Lot 21, Block 12, Woodland Point - owned by Woodland-Dreamwood Improve- ment association Lots 10 and 15, Block 10, Woodland Point - owned by Helen Knox The Attorney said a notice should be sent to the owner of last record and a copy posted on the structure. Heikkila moved and Pfeifer seconded a motion to have these buildings removed as soon as the legal procedures are carried out. Unanimously carried.
