AN ORDINANCE REGULATING THE
ACQUISITION, POSSESSION, DELIVERY AND
USE OF PROHIBITED DRUGS
THE COUNCIL OF THE VILLAGE OF MOUND ORDAINS:
Section 1. The acquisition, possession, delivery and use of
barbiturates and other prohibited drugs shall be regulated as provided
in this ordinance.
Section 2. , Definitions:
Subdivision 1. Prohibited Drugs. As used herein the term
"prohibited d'rug" 'means:
(a) Barbital and ~ny derivative thereof; including
but not limited to the following: diethylbarbituric
acid; 'any alkyl, aryl, metallic or halogenated deri-
vative of barbituric acid; vernol (barbitone);'
proponal, ipral; dial; neonal (sonaryl); sandoptal;
amytal; phenobarbital (luminal); phandorn; nectal;
allonal which contains allylisopropyl-barbituric
acid in combination with amidopyrine) medianl; any
preparation, mix.re or othrr substance containing
any of the foregoing substances.
(b)
Amphetamine and any derivatives thereof including
but not limited to such substances as follows:
desoxyephedrine (methamphetamine) mephentermine,
pipradol, phenmetrazine, methylphenidate or any salt
mixture or optical isomer thereof which salt mixture
or optical isomer has a stimulating effect on the
central nervous system.
(c)
Chloral Hydrate (Chloral); Chlordiazepoxide and its
salt (Librium); Diazepam (Valium); Ethchlorvynol
(Placidyl); Ethinamate (Valmid); Glutethimide
(Doridan); Meprobamate (Miltown, Equanil, Meprospan,
Meprotabs); Methyprylon (Noludar); Paraldehyde.
Subdivision 2. Acquire. The term "acquire" or "acquisition"
shall mean to procure, obtain',' to get control of, or to possess prohibited
drugs, or to attempt to procure, obtain, seek to obtain control of or to
possess prohibited drugs.
Subdivision 5. Possess. The term "possess" or "possession"
shall mean to own, control, h~ve authority to administer, or to exercise
dominion over prohibited drugs.
Subdivision 4. Deliver. The term "deliver" or "delivery"
shall mean tra~'sfer, give~ furnish',-sell, dispose of, barter, exchange,
administer, dispense, distribute or supply in any manner whatsoever. The
term "deliver" or "delivery" shall in addition to the foregoing include an
offer, tender or attempt to do any of the acts listed, as well as the actual
completed co~missf, on thereof.
Subdivision 5. Patient. The term "patient" means the individual
for whom a prohibited drug is"'pre'scribed, or to whom a prohibited drug is
administered, pursuant to direction of a physician or licensed practitioner.
Subdivision 6. User. The term "user" shall mean any person who
uses a prohib'it~d drug, When su--~6'~person is not a patient: and the term "user"
shall include any person who is a patient and uses a prohibited drug in excess
of that prescribed by the patient's physician or licensed practitioner.
.S~bdivision_7. Person. The term "person" includes individual,
corporation, partnership, and association.
Subdivision 8. Practitioner. The term "practitioner" means a
person licensed bY l'~'w '%o pre'ecrib~- an'd ~dminister any of the prohibited drugs
as defined above.
Subdivision 9. Pharmacist. The term "pharmacist" means a
person duly licensed and registered ~h the Minnesota State Board of Pharmacy
as a registered pharmacist.
Subdivision 10. Prescription. The term "prescription" means
a written or oral order by a practitioner to a ~)~armacist for a prohibitive
drug or stimulant for a particular patient, whi~<~ specifies the date of its
issue, the name and address of such practitioner, the name and a~ress of
%he patient (and, if such barbiturate or stimulant is prescribed for an
animal, the species of such animal), the name and quantity of the prohibited
drug prescribed, the directions for the use of such drug, the date of expira-
tion of prescription, and in the case of a written order the signature of
such practitioner. An oral order by a practitioner for a prohibitive drug
must b~ promptly reduced to writing by the pharmacist.
Subdivision 11. Manufacturer. The term "manufacturer" means
persons other than pharmacists who prepare drugs in dosage forms by mixing,
compounding, encapsulating, entableting, or other process.
Subdivision 12. Wholesaler. The term "wholesaler" means persons
engaged, in t~ 'business of distribUti'~g prohibited drugs to persons included
in any of the classes named in Section 5~Subd. 1.
Subdivision 13. Warehouseman. The term "warehouseman" means
persons who store prohibited 'drugs, 'for others and who have no control over
the disposition of such prohibited drugs or stimulante except for the purpose
of such storage.
Section 3. Unlawful Acquisition, Possession or Delivery of
Prohibited Drugs.
It shall be unlawful for any person to acquire, possess, or deliver
prohibited drugs, except (1) in the ordinary course of trade, business, or pro-
fession, or (2) pursuant to a valid and subsisting prescription. ~
Subdivision 1. Ordinary Course of Trade, Etc. The phrase,
"ordinary course ~'f trade~ business or profession" 'shall mean the lawful and
usual performance of a business or professional transaction involving prohibited
drugs by one or more of the following:
a. Practitioner
b. Pharmacist
c. Manufacturer
d. Wholesaler
e. Distributor
f. Warehouseman
g. Physician
h. Nurse
i. Persons engaged in transporting such prohibited
drugs as agent or employee of a practitioner, pharmacist, manufac-
turer, warehouseman, wholesaler, distributor, common or private
carrier.
j. Any patient as herein defined, other than a
user, with respect to procuring, possession and use of a
prohibited drug in accordance with the terms of a valid and sub-
sisting prescription and in accordance with prescribed treatment.
k. persons whose business or profession requires the
procurance, possession or use of prohibited drugs for the purpose of
lawful research, teaching or testing, and not for sale.
1. Lawfully licensed and registered hospitals,
nursing homes, and bonafide institutions wherein sick or injured
persons are cared for and treated.
m. Licensed veterinarians and bonafide hospitals
for the treatment of animals.
Subdivision 2. Valid Prescription. A valle and subsisting prescrip-
tion shall mean a prescription properly issued by a physician or licensed
practitioner, which prescriDtion is in effect at the time of acquisition,
possession, delivery or use of the prohibited drug.
Section 4. Improper Acquisition, Etc. Prohibited. No person shall
acquire, possess or deliver a prohibited drug, and no person shall attempt
to acquire, possess or deliver a~prohibited drug, by any arti£ice, trick,
scheme or device, including the following:
Subdivision 1. By fraud, deceit, misrepresentation or subter-
fuge, or
subdivision 2. By the forgery or alteration of a prescription, or
'subdivi'sion ~. By the concealment of a material fact, or
'subdivision 4. By the use of a false name or the giving of a
false address, or
Subdivision 5. By making a false statement in anyprescription,
order, report, or record relative to a prohibited
drug, or
Subdivi~on 6. By falsely assuming the title of, or falsely
representing any person to be, a manufacturer,
wholesaler, warehouseman, pharmacist, practit ioner
or other person described in Section 5, Subd. 1

Subdivision 7. By making, issuing or uttering any false or
forged prescription.
Section 5. Prescription. No physician or licensed practitioner or
other person authorized b~ law to issue prescriptions shall issue a prescription
for a prohibited drug, except for the comfort, care, health or welfare of a
specifically named and identified person, who is a patient of the person
issuing the prescription.
Section 6. Delivery by Pharmacist. No pharmacist or licensed druggist
shall de'liver any prohibited drug to any person whomsoever, except pursuant to
a valid and subsisting prescription, or pursuant to a proper and usual practice
in the ordinary course of business, as authorized in Section 5, Subd. 1 hereof.
Section 7. Delivery to Minor. It shall be unlawful for any person to
deliver a prohibited drug to'"a minor unless such minor is a patient; and no
pharmacist or licensed druggist shall deliver, and no physician or licensed
practitioner shall deliver or order delivery, of a prohibited drug to any
minor, unless specific written authority therefor is given by a parent of
the minor.
Section 8. Delivery to Ward. It shall be unlawful for any person to
deliver a prohibit~ drug to a person under guardianship, unless the ward is
a patient. No physician or licensed practitioner shall deliver or order
delivery of a prohibited drug, and no pharmacist or licensed druggist shall
deliver a prohibited drug to a person under guardianship, unless specific
written authority therefor is given by the guardian of the ward.
Section 9. Possession by Minor or Person Under Guardianship. It shall
be unlawful for any' minor or any person under guardian~'hip to have possession
of or to Use a prohibited drug, except pursuant to a valid and subsisting
prescription. Any person under ~uardianship and any minor in possession of
prohibited drugs shall be deemed a user, unless such person is a patient.
Section 10. Delivery to User. No person shall deliver a prohibited
drug to a user.
Section 11. Use of Prohibited Drug. It shall be unlawful for any
person, Other ihan a patient,' to acquire, possess or to personally use a
prohibited drug.
Section 12. Police Notification. Any person residing in or employed
in the Village of Mound" who knows or believes, or should have known or shall
have reason to believe, that a person is a user of a prohibited drug, in the
Village of Mound, shall notify the Chief of Policeof this Village, and shall
supply the said Chief of Police with all information relative to such use and
user, except that no such duty to inform shall be imposed upon the husband,
wife, parent or child of the user of a prohibited drug.
Harboring User
Section 15./Whoever harbors, conceals or aids a user of prohibited
drugs,' 'knowing the person to be a user, with intent that such user shall avoid
or escape from arrest, trial, conviction or punishment, shall be guilty of a
misdemeanor, and punished as hereinafter provided, except that no offense
shall be deemed to have occurred if the person charged is the husband, wife
parent or child of the user. '
Section 14. Confiscation and Disposition of Prohibited Drugs. Any
prohib'i't'e~ drugs found ih the possessi0'h of any person convicted of a viola-
tion of this ordinance shall be confiscated and shall be forfeited to the
Chief of Police who shall make proper and timely disposition thereof by des-
troying them.
Section 15. Use of Original Containers and Labels Required. All
patients having possession of any prohibited d~ugs, by lawful prescription
of practitioner while such prohibited drugs are lawfully in such person's
possession, shall keep such prohibited drugs in the original container in
which they were delivered until used in accordance with such prescription,
and shall not remove the pharmacist's original label identifying the pre-
scription from such original container.
Violation Misdemeanor
Section 16./ Any person vioi~ting the provisions of this ordinance shall
be guilty of a misdemeanor and upon conviction shall be punished by a fine of
not more than one hundred dollars or by imprisonment for not to exceed 90 days.
Section 17. E~fective Date. This ordinance shall take effect fifteen days after
its publication.
