That Chaoter 23 of the Mou~d Code of Ordinances, e~titled~ "Zonings" be, and ~.ereby is, amended by reducing the Residential A-1 Use District~ as established by Section ~3.Ol! by removing therefrom the folloWi~g described tract, and by increasing the Co,mercia! THAT ALL HOUSES, BUILDINGS, OR PROPERTIES 3HALL BE CONNECTED TO THE PUBLIC SEWER SYSTEM NO LATER THAN JUNE 15, 1969~ AND AMENDING CHAI~rER 26, ENTITLED "BUILDING CODE" OF THE ~OUND CODE OF ORDINANCES, PROVIDING THAT NO EXISTING PRIVATE S]~WAGE DISPOSAL SYSTEM MAY BE REPAIRED OR EXTENDED IF SERVED BY MUNICIPAL SEWER AND MUST BE CONNECTED TO THE MUNICIPAL SEWER SYSTEM NO LATER THAN JUNE 15~ 1969 The Village CoUncil of the Village of Mound does ordain= Chapters 20 and'26 of the Mound Code of Ordinances are hereby amended as follows~ Sec. 20.03, Subds. Until such-'~onnection, the owners of all houses, buildings, or properties for human occupation, employment, recreation, or other purposes, so situated and abutting, shall comply with all ordinances and regulations applying to a public septic system and its use. The Village Manager shall be char~ed with the responsibility of enforcing the connect!°n of all the aforesaid house'sR.. buildings~ or properties to the public sewer system no later than June 15~"1969. Sec. 26.71, 26.72, and.26.73 shall be amended to read as follows: Sec. 26.71. Existing System; Repair Or Extension. Existing systems which" do ho~'mee~ 'the requirements of th'is ordinance and are located in an area which is not served by the public sewer system pursuant to Chapter' 20 of thiS code of 0rdin'anceS, may be repaired or extended if the repair or extension does not place the disposal system any closer than fifty (50) ~eet to an existing well, or in any other way increases the health hazard. No existing private sewage disposal system shall be repaired or ~Xtended if the property is served by the public sewer system or in any event all said properties shall be connected to the public sewer system in accordance with'Sec. 20.03~ subd. (d)~' and Sec. 20.04~ ~u~d~ (d)~ of the Village Code no later than June 15~ 1969. Sec. 26.72. Sewer and Water Connections. The owner of any property or properties abutting on or a'djacent ~ any street in which sewer and water mains have been laid shall, for existing dwelling or commercial buildings, within twelve mon~h~ of the installation of said sewer and water mains, install a toilet, connected with said sewer and water main, in each such buildSng. All dwellings, commercial buildings. and industrial plants sh'ali' Connect t4e Sa~d structureS to the pUblic sewer syst'em no later-~h~' .~une 1.~.~ 1969. Upon completion of the installation of sewer and 70 water mains in streets ~jacent to or abutting upon any such property, no building ~it will be granted for new construction of dwellings or comme,~ial!bUlldings thereon except where the plans and specifications therefor show provision for im- mediate connection to said sewer and water main. Sec. 26.73. 3ewer and Water Connections; Default. In the event that any owner ~ property abutting on or ~djacent to any street in which sewer and water mains have been laid fails, within twelve ~12) months of the completion thereof~ or june .15~._~969~ whichever date is earlier, to install i~-~y dWelling or o~her establishment thereon such to±let connection to said sewer and water mains as herein pro- v!ded, the village shall, as hereinbefore provided, install th~ same and charge the same against the property as a special assessment. (a) Upon expiration of said twelve (12) month period or the date of June 15~ 1969~ whichever event is earlier~ '.~~age~Manager shall Serve notice of '~he int~ntion of the village to make such connection by mailing a standard notice to the last known address of the record owner of said property by registered mail~ postage prepaid, which notice shall advise said record owner of the provisions of this ordinance, said twelve (12) month period~ or date of June 15~ 1969~ and that the village will install the same~ assess the cost thereof against the property after twenty (20) days from the date of mailing of said notice unless prior to said time the owner takes out a permit for such connection and such connection is actually c~mmencedo In the event such owner fails to comply with said notice, the Village Manager shall secure connection of the aforesaid toilet facilities to the public sewer system and shall have the cost thereof assessed as a special assessment against said property, in accordance with the provisions of Chapter 412.221~ Subds. 31 and 32~ and Chapter 429~ Minnesota Statutes. He felt his taxes should be to%~red because of the traffic on the commons in front of his house. He stated after some hestiation that the assessor had the value of his home about right.
