1973-10-09MINUTES OF THE COUNCIL MEETING OF OCTOBER 9, 1773 at 8 P.M. at the SHIRLEY HILLS SCHOOL, MOUN~, MINNESOTA Present at roll call: Mayor John D. Kotula; Councilmen John Andreasen, Orval Fenstad, Donald Ulrick and Gordon Swenson; Village Manager Leonard Kopp; Attorney David Kennedy; Engineer K¢ith Englcsby. MINUTES Andre&sen moved and Swenson seconded a motion to accept the minutes of the September 25, 1973 meeting as presented. The vote was unanimously in favor, so carried. HEARING REZONING - Lot 1 Auditor's Subdivision #168 Forensic Engineering Charles Neitge - spoke against the rezoning~ because the rezoning could be used in other less acceptable businesses Shirley Emerson - against, parks not taken care of Jeanette Gellman - agaimst because of traffic at,their driveway Bob McClellan--ask if this might affect property values and feels a special use permit would be more suitable Mr. Emerson - against spot zoning Mayor Kotula - property &butts commercial property Councilman Fenstad - could this building be torn down and a typical brick cammercial building be built on this site if land is rezoned. Manager - answered, yes a commercial building could be built on the site if it were rezoned without consulting council or planning commission Councilman Ulrick asked - Mr° McClellan, Mr N¢itge and Mr. and Mrs Emerson if they would have no objection if a special use permit were granted instead of the rezoning. McClellan and Neitge - would accept a special use permit. Mr and Mrs Emerson - still against Fenstad moved and Swenson seconded a motion. HEARING FOR 01I SALE AND SUNDAY LIQUOR AT SURFSII]E Joel Essig and BFrne J Ghostley were present Essig stated that the doors have been changed; exit signs will be in on Monday; also exhaust system purchased will be installed in the immediate future, doors changed in the banquet room, back stairs have been repaired and hand rails installed and dockage will be reduced by approximately one half, air conditioning will reduce noise in the summer months when installed. Bob McClellan - he is a neighbor and does not hear any mmcessiver~n6lse>from the patio, is for the license Susan Burkhalter - feels on sale license is better than the present license (set-up) as people are not littering the lake and highways with empty bottles Charles Neitge - for the license James Werner - for the license Bruce Robinson - against license, feels noise is excessive from two outside speakers Jeanette Oellman - hears outside bands Bill Clark - noise is not excessive Mr Emerson - consider all complaints at this time Kotula i the $~,000 plus fee will make the owners more careful and they will maintain a better operation to protect their investment if nothing else Andreasen - more control of patrons with on sale license than with set-up license E. G. Hicks - for the license, police are on duty at all busy times so no problems that can't be taken care of Shirley Emerson - cites Ordinance 280 on noise pollution Ardel Skoglund - two bands on weekends, very loud music and type of music objectionable to her and her family Andreasen moved and Swenson seconded a motion RESOLUTION 73-311 RE~OLUTION GRANTING CLASS AANI] CLASS B LIQUOR LICENSES TO EURFgIOE INC (Class A - On Sale for Restaurant) (Class B - Sunday Sale) Kotula moved and Fenstad seconded a motion BE IT MOVE[], by the Village Council of the Village of Mound that a variance on the parking requirement of the ordinance be granted. The vote was Ulrick - nay all others aye, by roll call vote. Vote on Resolution 73-311 Roll call vote unanimously in favor Note: Ulrick wished his nay Vote on the amendment to be explained that he voted nay becausl~ he had certain reservations that did not reflect on the character of the new owners. PLANNING COMMISSION RECOMMKNDATIONS Wayne Burkhalter Lot 2 Block 2, Shadywood Point Request side yard variance (also need street front variance) Mr and Mrs Bttrkhalter appeared to appeal the denial of the Planning~ Commission Ulrick moved and Swenson seconded a motion to grant RESOLUTION 73-312 RESOLUTION GRANTING SIOE ANBSTREET FRONT YAR~ VARIANOES (Lot 2, Block 2, Shadywood Point) Side yard variance 6.8 ft. Street front variance 5 ft. The vote was unanimously in favor REZONING BEACHSIDE DEVELOPERS TO MULTIPLE Earl Nelson appeared and askedfor rezoning to Multiple part of Lot 3h Auditor's Subdivision 170 and Townhouse for part of Lot B Shirley Hills Unit D Fenstad moved and Swenson seconded a motion BE IT MOVED, by the Villa9e Council of the Village of Mound that the matter of rezonin9 for Beachside Developers be tabled. The vote was Andreasen nay; Fenstad, Ulrick, Swenson and Kotula, aye. James P. Kaiser Westwood Realty Lots 20 and 21 and parts of 17-19 and west half of Lot ~7, Block 6, Pembroke Subdivision of Land Staff request matter not be considered at this time Andreasen moved and Swenson seconded a motion BE IT MOVE2, by the Village Council off the Villa§e o£ Mound that the matter of subdivision of land for Westwood Realty be tabled. The vote was unanimously in favor. Clayton Law Lots 9-11 Block 6, Arden Request for lot size variance Ulrick moved and Swenson seconded a motion RESOLUTION 73-313 RESOLUTION WAIVING REQUIREMENTS OF CHAPTER 22 OF THE VILLAGE CODE RE~ING THE DIVISION OF PROPERTY (Eots 9~11~ Block 6, Arden) (Conditioned on the survey certificate bein§ part of the resolution package and no other variances be asked for. The vote was unanimously in favor. Robert Johnson Lots 85 and 86~ Mound Shores Side Yard Variance Andreasen moved and Swenson seconded a motion RESOLUTION 73-31h RESOLUTION GRANTING FRONT ANI]SIDE YARD VARIANC~ FOR UTILITY SHEll C~NI]ITIONED ON THE SIGNING OF A HOLD~f~~T ~iNFAVOROFT~E~.~SE (8 ft. front yard variance~ 2.6 side yard variance) The vote was unanimously in favor RIE~EWOOB ROAn BIDS The engineer recommends the bids be rejected as being too much over the estimate. Andreasen moved and Swenson seconded a motion RESOLUTION 73-31~ RESOLUTION REJECTING BII]S RECEIVED FOR RIE~EWOOD ROAD PROJECT (Project 73-21) The vote was unanimously in favor LOST LAKE PROJECT Andreasen moved and Ulrick seconded a motion RESOLUTION 73-316 RESOLUTION AUTHORIZING THE MAYORANI] MANAGER TO SIGN AGREEMENT WITH ENVIRONI~NTALSCIENCE CENTER TO DEVELOP A PLAN FOR L~ET LAKE AREA AT A CCST NOT TO EXCEED $2,800~ FUNI]ING TO BE WITH REVENUE SHARING FUNDS. The vote was unanimously in favor 127 Andrcasen moved and Ulrick seconded a motion RESOLUTION 73-317 RESOLUTION AUTHORIZING TRANSFER OF FUNDS The vote was unanimously in favor TAX LEVY Fenstad moved and Ulrick seconded a motion RESOLUTION 73-318 RESOLUTION LEVYING TAXES FOR 197h The vote was unanimously in favor NOTE: Councilman Fenstad commended the Village Manager for a §ood job done.
