September 21, 1977
Pursuant to due call and notice thereof, a special meeting of the City Council
of the City of Mound, Hennepin County, Minnesota was held at 5341Maywood Road
in said City on September 21, 1977 at 7:30 p.m.
Those present were Mayor Tim Lovaasen, Councilmembers Gordon Swenson, Orval
Fenstad and Robert Polston. Also present were City Engineer William McCombs,
Assistant City Engineer Lyle Swanson, City Manager Leonard L. Kopp and Acting
City Clerk Deloris Schwalbe.
SHIRLEY HILLS UNIT B - STREET & STORM SEWER ASSESSMENTS
The Acting City Clerk presented an affidavit of publication in the official
newspaper of the notice of public hearing on said street and storm sewer
assessments. Said affidavit was then examined, approved and ordered filed in
the office of the City Clerk.
City Engineer William McCombs outlined the project and stated the cost was
$96,919.O0 for the street and $10,112.00 for the storm sewer.
The ~layor then opened the hearing for public input on said street and storm
sewer assessments and persons present to do so were afforded an opportunity
to express their views thereon. Persons present offering questions or comments
included:

AN ORDINANCE AMENDING SECTION 26.9304
SUBDIVISION 10 OF THE CITY CODE PROVIDING
FOR WINTER DOCK STORAGE
The City of Mound does ordain:
Section 26.9304 Subdivision 10 of the Hound City Code of Ordinances
is amended to read as follows:
Subdivision 10. Winter dock storage by permit holders:
A. Docks may be left in the water during the winter months providing
the following conditions are met;
1. The required dock license for the following year must be
applied for and paid by the tenth day of January.
2. Docks may be partially removed, provided that those sections left
in public waters are complete. No poles, posts, stanchions or supports standing
alone shall remain in public waters.
3. Docks must be brought up to the construction standards outlined
in this ordinance within 2 weeks after the ice goes out in the spring off the
year. If not, the procedures as specified in subdivision 8 of this ordinance
will apply.
4. Docks may not be left in the water or on public land if they
conflict with the following uses as shown on the dock location map:
a. Slide area
b. Snowmobile crossings
c. Skating rinks
d. Trails
e. Road access
f. Other conditions or circumstances which are determined
by the:Council to have an adverse affect on adjacent
properties.
B. Docks may be stored on commons during the winter months providing
the following conditions are met:
1. Docks may not be stored on the commons if they conflict with
the following uses as shown on the dock location map:
a. Slide area
b. Snowmobile crossing
c. Skating rinks
d. Trails
e. Road access
f. Other conditions or circumstances which are determined
by the Council to have an adverse affect on adjacent
properties.
2. Docks may not be stored on commons shown on the dock location
map as having topographic conditions which are too steep, or have fragile flora
or where tree damage may occur due to tree density or where there is unstable
ground.
3. Docks may be stored only in areas designated for dock permits and
as shown on the dock location map.
4. All storage shall be done in an orderly, compact and unobtrusive
manner.

5. Docks and associated hardware must be removed from the commons
and/or public lands between June 1st and September 1st of each year.
6. Storage shall be restricted to dock materials, dismantled docks
and dismantled boat lifts.
7. The Park Commission, City Dock Inspector and City Council shall
review the dock location map each yaar and designate areas available for winter
storage and also designate the areas restricted because of the conditions here-
tofore stated.

TAX FORFEIT LAND
The City Manager informed the Council of a request from a property owner to
release some city owned park property to be attached to the individuals lots.

Polston moved and Lovaasen seconded a motion to table this item to a future
date to obtain additional information. The vote was unanimously in favor.

Duane's 66 requested a special use permit to operate a
truck rental lot on the subject property.
At the same meeting, a request was before the Council to
build a car wash on the property. The Council tabled
the truck rental request in favor of the car wash request.
A hearing was held and a special use permit issued for
the car wash. The person getting the request has decided
not to build the car wash so the truck rental request is
again before the Countil.
In order to use the land for truck rental, a special use
permit is required. It is recommended that the Council
call a public hearing on the special use permit. The
earliest date is in November.

Gentlemen:
This is to request a front yard setback variance from
twenty feet to six feet for a garage at 4649 Island View
Drive.
Our property drops off sharply from Island View Drive
resulting in a driveway that can become nearly impossible
in the winter. We are thus planning to build the garage
at street level with yard storage below similar to a
number of existing garages on the street.
Note on the Certificate of Survey and the Site Plan
that Island View Drive was constructed completely to
the far side and outside of its plotted 15' right-of-way.
The garage as proposed would be set back approximately
32'-8" from the edge of paving at its nearest point.
(The garages to either side of us are set back approx-
imately 12 feet and 5 feet.

because of the elevation of our houses on the hill back of the
Shaffer's property. For others of us the fence offers increased
privacy for our own property.
We underStand the Shaffer's desire to fence off their property so
that the property will not be used as a short-cut and their need
to obscure the cars parked on Ridgewood Road. We have no objections
to the proposed fenc/e."

The Council on September 27th discussed with Mr. Brooks
of 4601 Island View Drive the problem caused on the Commons
when the retaining wall crumbled during the big rain.
Attached is a report from the Engineer on alternate methods
the City can use on the Commons.
It was our interpretation from the Attorney that the City
has no liability. We have received no written word from
the DNR or other Agencies. The Public Works Director is
to check with the Agencies to see if something is forth-
coming.
The Engineer's report attached estimates two ways to repair
the Commons; one costing about $1,600. and the other $15,000.

and suggestions. The Public Works Office concours with the recommendation of'

The engineer and this office are both in agreement that the wall,.,as it was
constructed, w~s strong enough under normal conditions to hold b~ck.the fill
dirt behind it, however, with the extreme amount of w~ter that fell the clay
soil was completely saturmted and the wall broke loose and slide down ~nd into
the lake from excesslv¢ weight. It is our opinion from viewing the sight that
no liability to the City is present. The wall wss on }~. Brooks property

I have visited the site of the landslide at the Brooks.'-
property at 4601 Island View Drive and hzve the following
comments or recommendations to offer.
The 'slide appeared to be caused by the ~ailure of the
timber retaining wall during the 'last heavy rain. Apparently
the ground behind the wall became saturated and the resultant
pressure was more than the wall could withstand.
The wall was constructed on Hr. Brooks property very
close to the Commons. The landslide has pushed approximately
30 to 50 cubic yards of dirt into the lake. It will probably
be necessary to remove the material from the lake with a
dredge because a dragline could not reach it.
It is my recommendation that when the wall is rebuilt and
the area restored, that a plan for the wall prepared by a
Registered Engineer be required in order to assure that the
new wall have proper' anchorage' for.the soils in that a~ea,
From my conversation with Mr. Brooks it appeared that the old
wall was solidly built but when a clay soil becomes saturated,
tremendous pressures can be developed. Either the wall must be
designed to withstand these pressures or some method must be
provided to relieve the water pressure behind the wall.

Dear ;~r. Kopp:
As requested, we submit the following methods of repairing
the landslide at 4601 Island View Drive and cost estimates for
the work.
The attached sketch A shows the condition of the site at
the present time. The timber wall shown is in the construction
process. The most economical method of restoring the area
between the wall and the lake would be to simply dredge the
material which has slid into the lake, and shape the bank
between the lake and wall and seed it this fall. Next spring
plantings which develop heavy root growth could be planted on
the slope to prevent further erosion or sliding and to
restore the natural appearance of the bank.
The cost of this work is estimated at $1,000.00 for the
dredging and $600.00 for the seeding and plantings on the
bank.
When the bank plantings take hold the appearance of the
area would be pretty much the same as before the landslide
except that the bank would have a more irregular configuration.
We would not recommend to add material to the bank to smooth
it out because the added material would be very difficult to
stabilize and would probably wash away in the first heavy rain.
Sketch B shows a possible construction of additional
walls and terracing of the bank which would eliminate the possibility
of future slides in the area. This alternate is estimated to
cost $15,000.00 and would have the disadvantage of altering the
natural appearance of the lake shore.

Assessment Criteria
The assessment criteria originally discussed on Council Memoran-
dum 77-262 is rewritten below in a proposed resolution setting
out the criteria for assessing street construction:
RESOLUTION NO.
BE IT RESOLVED BY THE CITY COUNCIL OF MOUND that the following
criteria will be followed in the assessing of storm drainage
construction, street improvement and curb and gutter construction:
STORM DRAINAGE - Storm drainage is to be included as part
of the street project and assessed with the project.
STREETS, CURB AND GUTTER AND STORM SEWER - The assessment
is to be made on the following basis:
40% on the number of building units
30% on square footage
30% on front footage
Unit - A unit is determined on the land a dwelling is on.
In the case of vacant building sites, they are considered
a unit. Land subdivided after an assessment is made will
be subject to reassessment at the time of the division.
Multiple Dwellings - In determining the number of units
in an area where multiple dwelling exists, each residential
unit within the building will be considered as 3/4 (three
quarters) of a unit.
Example:
A four plex - 3 units
A 12 unit building - 9 units
A 50 unit building - 37.5 units
Square Footage - Square footage will be determined as
that land above 929.4 feet above sea level that is in a
building site or lot abutting a street.
Front Footage - Front footage is that part of a lot fronting
on the street or streets being assessed.

(A) Double front lots Will be assessed on both fronts
if they are in the same assessment. Otherwise, each
side will be assessed as the street it faces is
improved.
(B) Corner lots will be assessed on the same basis as
double front lots.
(C) Triangle lots - Lots that form a triangle having a
frontage on two streets are to be assessed on the
longest side only.
(D) Three sided lots - Lots that have streets on three
sides are to be assessed for the longest side plus
the average length of other two sides.
Lots on County Roads - Residential lots on County roads will
be assessed on the same basis as lots on a residential street
except the assessment will be based as follows:
Each site will be assessed as 1/2 unit.
Square footage - 50% to be assessed.
Front footage to be assessed as other lots.
Industrial and Commercial Property - When industrial and com-
mercial property is in the same assessment as residential
property., the industrial and commercial property will be
assessed at 150% of residential property.

Tipi Wakan Management Company has filed with the Commissioner of Revenue
an application for reduction in the assessed valuation of certain real
estate located in the City of Mound, Hennepin County, Minnesota. The
tax description of the property is Plat 37750, Parcel 1050.
The application states that a reduction in the assessed valuation for
the above-described property is warranted due to a court agreement on
stipulation values for January 2, 1974 and 1975[ the reduction for
January 2, 1975, is in the ~0~ o~ an 'a-b-atement. The application
requests that the assessed valuation for the assessment year 1975,
taxes payable in 1976, be reduced from $825,880 to $740,800. The
abatement has been recommended by the County Board, the County Auditor
and the County Assessor of Hennepin County.
Minnesota Statutes, Section 270.19, provides that where the reduction
in assessed valuation of any property exceeds $50,000, the city, town,
school district, and county in which the property is located may request
a hearing to object to the reduction. If your political subdivision
desires to have a hearing on this application, please send ~your request
to me within 20 days.
If I receive no request for a hearing within 20 days from any of the
political subdivisions affected by the reduction, the hearing will be
deemed to be waived, and the application will be considered by the
Commissioner of Revenue on its merits.

Your Involvement in a Project of Regional importance
The Metropolitan Waste Control Commission and the Minnesota Pollution
Control Agency are currently engaged in a Chemical Waste Landfill
Demonstration Project. This important effort is under the sponsorship
of the U.S. Environmental Protection Agency. l'he purpose of this
letter is to update you as to the present status of the project and
to encourage your participation in the Public Information Program and
Site Selection Process being conducted by the Commission.
PUBLIC ,NF~RMATiON PROGRAM
The Commissian is beginning an ongoing public information effort this
week. A variety of communications tools will be used to r~ach as
broad a spectrum of the public as possible, included will be meetings
with county, municipal and local officials, as well as planners and
environmental officers throughout the seven county Area. Ali f~cets
of the news media in the region will be kept up-to-date as the project
develops. Speakers will appear before a variety of civic and public
interest groups.
An important element in the communications process will be citizen
participation and feedback. The views and concerns of Area citizens.
organizations and officials are essential to full public pariticpation.
A major goal of the public information program is a well-informed
and involved populace.
SITE SELECTION.PROCESS
l'he site selection process has been a continuous effort since September,
1976. The process is using highly detailed criteria to evaluate
potential site locations in the Metropolitan Area. These criteria
include local and regional policies regarding land use, social implications,
economic impacts and transportation 'Factors. Additional Criteria
evaluate distance from sources of waste generation, local traffic impacts.
geological data on bedrock a~d grcundv:ater and soils and watershed
conditions. Finally, land availability, zoning ordinances and relation-
ships to water bodies and residential areas are considered.
The selection process is ~cheduled to identify a number of car, didate
search areas by mid-October, ~977. From these candidate search areas,
three potential sites are proposed to be selected by late fail, i977.
Final site selacti~m must ~e n:ade by ~,pril, 1978.

SITE SELECTION CRITERIA
The criteria which are being used to select sites have been completely documented
and described in reports by the Commission's project consultants, Henningson,
Durham and Richardson. Available for review at the Commission's office, the
reports are entitled:

- ~ite Criteria and Information, dated June, 1977
The criteria were established after detailed consultation with the U.S. Environ-
mental Protection Agency, the Minnesota Pollution Control Agency, Metropolitan
Council, local and county public officials, Minnesota Geological Survey,
Minnesota Department of Health, Minnesota Department of Natural Resources,
environmental officers, geologists, soils scientists and hydrologists.
Criteria shown in Attachment No. 1 emphasize the technical and environmental
considerations included in the December, 1976 report.
In April, 1977, the Metropolitan Council recommended use of the additional
criteria shown in Attachment No. 2 in order to more fully consider social and
economic problems related to Metropolitan Council policies and other government
ordinances. These criteria were incorporated into the June, 1977 report.

The Waste Control Commission is your manager for the Chemical Waste Landfill
Project. Our efforts are overseen by a special Ad Hoc Advisory Committee
made up of citizen board members of the Minnesota Pollution Control Agency, the
Metropolitan Council and the Commission. On behalf of the Ad Hoc Committee and
the Commission, I am issuing an invitation to all public and private organizations
in the Twin Cities Metropolitan Area. Become involved in the decision-making

At the September meeting of the Community Services Advisory Council passed a
resolution directing the Community Services Director to approach the City of
Mound and request consideration by the City of Mound to increase the lighting
facilities on open skating rinks within the community.
As a supportive action to this request the Advisory Council has requested that
the Board of Education accept the hockey boards offered by the City of Mound,
improve the lighting at the Shirley Hills open rink, and improve the lighting
at the Mound Westonka High School site.
The Advisory Council and its director are most sincere about working hand in
hand with the municipalities so as to complement each others efforts and $o as
to eliminate duplication of tax fund expenditures.

Under Section 208 of the federal Water Pollution Control Act, the Metropolitan''
Council is committed to the preparation and adoption, by November 1978, of a
20-year water quality management plan. The enclosed report describing Al. ret-
natives for Wastewater Management in the Twin Cities Metropo'.,itaP. Area is the
product of the Council's 208 planning.
The r~port presents wastewater flow projections to the year 2000 for communities
in the Area and identifies alternative ways of directing and treating projected
flow. The alternatives have been grouped within four gecgraphically define,5
study areas, whose boundaries are shown as Figure 3 in the report.
The next step is to evaluate the alternatives presented in this document. That
evaluation must o~ based upon the coml~ents and suggestions of the government
officials and residents of Area communities. We have therefore scheduled four
public meetings to receive comments on this report and suggestions for additicn~
al alternatives.
