REGULAR NEETING
'OF THE
CITY COUNCIL
April 24, 1979
Pursuant to due call and notice thereof, a regular meeting of the City Council
of the City of Mound, Hennepin County, Minnesota was held at 5341Maywood Road
in said City on April 24, 1979 at 7:30 p.m.
Those present were: Mayor Tim Lovaasen, councilmembers Gordon Swenson, Robert
Polston, Benjamin Withhart and Donald Ulrick. Also present were City Manager
Leonard L. Kopp, City Attorney Curtis A. Pearson, City Engineer William McCombs
and Acting City Clerk Marjorle.Stutsman..
MINUTES
The minutes of.the meeting of April 3, 1979 were presented for consideration.
Polston moved and Ulri'ck seconded a motion to approve the minutes of,the meeting
of April 3, 1979 with the following correction: Page 43 .- Councilmember Ulrick
left at 10:00 .p.m. due to a 'death 'in the family. The vote was unanimously in
favor.
The minutes of the'meeting of April'lO, 1979 were presented for consideration.
Swenson noted the omission of his request for a progress report on "lights on'
Commerce" and "welcome signs" on the agenda of each meeting until they are com-
pleted. Add on Page 47 after Information Memorandums. Polston moved and With-'
hart seconded a motion to approve the minutes of the meeting of April 10, 1979
as corrected. The vote was unanimously in favor.
PUBLIC HEARINGS
Special Use Permits - Body Shop and Auto Repair Shop at 4839 and 4853 Shoreline
The Acting City Clerk presented an affidavit of publication in ~he official news-
paper of the notice of public hearing on said special use permits. Said affidavit
was then examined, approved and ordered filed in the office of the City Clerk.
The Mayor then.'opened the public hearing for imput on said special use p6rmits
and persons present to do so were afforded an opportunity to express their views
thereon. The following persons offered comments:

The· Mayor then closed the .public hearing. DiScussed having a plan sho~ing black-
topped and green areas, also .fenced area; same stipulations as before or more
restrictive stipulations as similar permits have'
Withhart moved and Swenson seconded a motion to continue this .public hearing to
May 1, 1979. The vote was unanimously in favor.
Ulrick requested Staff look at Special Use Permit granted property on Corner to
see if there were any stipulations not being complied with.
Sewer Extension and Street Improvement - Inverness Lane
The Acting City Clerk p~esented an affidavit of publication in the official news-
paper of the notice of public hearing on said sewer extension and street improve-
ment project. Said affidavit was then examined, approved and ordered filed in
the office of the City Clerk.

Ci£y Engineer William McC0mbs briefly explained the proposed project, possible
alternative plans including cul-de-sac and costs of each.
The Mayor then opened the public hearing for imput on said sewer extension and
street improvement and persons present to do so were afforded an opportunity to
express their views thereon.'. M.L. "Buzz" Sycks asked for a delay in order to
present a different plan.
The Mayor then closed the public, hearing.
Ulrick m~ved and Swenson seconded a motion to continue public hearing on Inverness
Lane to May 8, 1979. The vote was unanimously in favor.
BIDS - AERIAL LADDER TRUCK
Fire Chief Eugene Garvais presented copies of a letter relative to the bids to
the Council.' Discussed whether specifications had been met. Tentative date of
May 5th ~t IO:OO a.m. set for a demonstration of the two trucks.
DisCUssed outlining where differences are in the bids from the specifications and
also discussing this with the contracting communities.
Withhart moved and Polston seconded a motion to continue' the bid consi'deratlon ·
until May 8, 1979. The vote was unanimously in favor.
PLANNING COMMISSION REC'OMMENDATION -'Non-conforming Use, Tract A, R.L.s. # 1150
Withhart moved and Polston seconded a motion to remove from table. The vote was
unanimously in favor.
The Mayor requested the City Manager to review the background and status of this
fire damaged structure.
Mr. Zuckman,and h~s Attorney, Errol Kantor, were present. They will contest any
decision th'at structure more than 50% destroyed. Does request that in event the
Council determines damage to be more than 50%, a-variance be granted so Mr. Zuck-
man can rebuild.
Discussed having City Attorney .clarify ordinance after this has been decided.
Polston moved and Withhart seconded a motion to continue this item to May 8th and
direct the staff to try to get a det~_~rmlnation of the before and after value.
Withhart moved and Swenson seconded a substitute motion making a finding that the
building is less than 50% destroyed. Roll call vote:' Swenson and Withhart voted
Aye; Ulrick, Polston and Lovaasen voted Nay; substitute motion failed.
· The vote on the original motion was unanimously in favor; so continued to May 8th. '
MONTCLAIR ROAD WIDENING
The City Engineer reviewed the proposed plan-6, foot widening would be on side of
property owner making request.
The Mayor then afforded persons present the opportunity to express their views
thereon. The following persons offered comments and questions.

BACK TO BACK FOR THE ENTIRE LENGTH OF STREET
The vote was unanimously in favor.
Council directed staff to get survey and then write letter on encroachment of
structure overhang.

City Engineer reviewed a proposed plan realigning corner of Wilshire and Lakewood.

The vote was unanimously in favor.
Roger Illies' r~quested a sidewalk be planned to accommodate the children walking
through to Surfside.
DRURY LANE REQUESTED CLOSING
City Engineer polnted out area requested to be closed and noted that Plannlng
Commission and Public services did not recommend closing street.
A1Wigand requested this be continued and he receive copies of letters relative
to this from the Public Works, Planning Commission, etc.
Lovaasen moved and Swenson seconded a motion to continue this item to May 1, 1979.
The vote was unanimously in favor.
STRAFFORD STREET VACATION
City Engineer pointed OUt area requested for vacation. City Attorney stated street
can't be vacated if needed for public services.. The Thomas Gerolds' had comments
regar, dln9 their requests--feel street too close to their home.

DOVE LAME SEWER
City Engineer explained some problems that have been encountered in completing
this portion of the 1978 street project; can't get easements, etc.
The City Engineer presented a report on alternatives and recommended the project
with the alternatives.

RESOLUTION ACCEPTING THE ENGINEER'S FEASIBILITY REPORT

City Manager and City Attorney have reviewed details of the contract and made
a recommendation.

COMMENTS AND SUGGESTIONS BY CITIZENS PRESENT
Dick Catton, 2870 Pheasant Circle, Woodcrest, read from a statement he said was
signed by most everyone in development, "We, the undersigned, would like to voice
our disapproval of placement of structure owned by Mr. Essig of Surfside, Inc. on
Halstead Lane. We feel struc{ure is eyesore and not of same quality as other re-
sidences in neighborhood. Detracts from aesthetic and monetary value. Due to
lack of progress to make structure livable, we ask the Council to investigate the
reasons for inactivity ...... rectify the situation .... ".
Withhart moved and Polston seconded a motion to have Mayor write a letter to
Essig regarding concerns for status of progress on moved in house in Woodcrest
which Was part of total package.. The vote was unanimously in favor.

Dear Mr. Kopp:
Mr. Lawrence Baker, 1680 Bluebird Lane, has refused to
sign a temporary easement. He has two large trees very close
to the proposed curb line, which would have to be removed if
we installed our standard width street. Since he refused to
even talk to us, our only alternate is to narrow this section
of Bluebird by two feet from Three Points Boulevard north to
the lake.
Does the Council wish to pursue acquiring this easement
or should the street be narrowed to 26 feet back to back of
curb.

INFORMATION MEMORANDUM NO. 79-48
SUBJECT: Underground Gasoline Storage
A request has come in for permission to install underground
gasoline storage.
Our pr~sent ordinance, Section 25.06 reads as follows:
"Establishment'of Limits in Which Bulk Storage of Liquefied
Petroleum Gases is to be Restricted. The limits referred to in
Section 20.105 (a) of the MUFC, in which bulk storage of liquefied
petroleum gas is restricted, are hereby established as follows:
Ail residential A-I, A-2, B, all Multiple Dwelling and Town-
house Districts and Commercial and BuSingss land use zoned
areas. (Ord. 378 4-26-78)"
The above restricts, but doesn't prohibit underground storage.
Attached is a copy of a letter from the ~uilding Inspector.
The Fire Chief has also indicated he feels our ordinance should
be stronger.

Chapter 25 - Fire Prevention Code
In particular, Section 25.04 and relating to James Walton of 1952 Shorewood
Lane.
In conversation with the Mound City Fire Chief, he feels that the particular
section should be amended to read:
"Establishment of limits of districts in whi'ch storage of flammable
or combustible liquids in outside, ~above ground tanks is to be pro-
hibited.''
We both concur that the heading should be changed and/or amended to include
outside, above ground and below ground tanks. We feel that subsection (b) in
section 25.04 is inadequate, as it does not relate to the aforestated underground
tanks.
Inasmuch as petroleum products are seemingly to become more scare in their avail-
ability, we are becoming aware that residents are trying to appropriate direct
shipments of petroleum and their products, directly from bulk dealers.
If we could change our City Ordinances to be more stringent in this particular
factor, we feel that we can better insure and safe guard life and'personal pro-
perty within our City.

money-wise, are close,
In order to see what is being bid, arrangements have been made for the
Minnetonka Fire Department to demonstrate their Sutphen Aerial Tower Fire
Pumper Truck at the Mound Fire Station at 10:00 a.m., Saturday, May 5th.
You are invited to attend this demonstration,
The other truck that is close in the bidding is a L.T.I. Pumper Truck and
Shakopee'has one of those. For those who are interested, arrangements have
been made for Shakopee to demonstrate their truck in Shakopee late~ in the

We would greatly appreciate all Councilmen to see the demonstrations .... at
least, the one in Mound.
Also, the cost is exceeding the estimate and this can be discussed at the
same time.

The Mound housing and finance bonding bill was introduced
today as H.F. 1503. The bill was referred to Local and
Urban Affairs which is considering legislation of this
type including the statewide bill. I hope that we can
have hearings this summer on this legislation.

Street Lights
Drews Electric and the Public Works Department began working on the street lights
today. A short was found under the street by the telephone company. This is
presently being repaired and the lights on the west side of Commerce Blvd. should
be workin9 tonight.
The lights on the north side of Shoreline are still out but we are in the process
of 9ettin§ utility locations so a conduit can be pushed under the concrete. I
will have to give you an oral update on'~this at the meeting. I currently have 11
hours of extra time in ch~ckin9 these lights at night. If it is permissable, after
all the lights are back in working order I will take the hours in comp. time.
N. S. P. repaired three individual lights in the C.B.D. area in the last week
that I called in.

T~e siDns were picked up today and our tentative date for installation is May 8th,
weather permittin9.
Thomas & Sons
They have completed the water main-extension on Langdon Lane. The streets in
Three Points have been stripped out to the necessary width and they are moving
~ few utilities back that were missed last year. With Mound's luck I was notified
today that Steve Thomas picked up a set of specs, for bidding our 1979 project.

They moved into Tuxedo area end began setting forms for curbing today. They have
also picked up the specs, for the 1979 project. Also they let it be known that
they have no other l~rge contracts for this year.
Road Restrictions
They were lifted as of 12:01 a.m., April 30, 1979. The signs Were removed by
noon today.
Spring Clean-up
It has been set for the week of May lhth and the office staff has notified the
paper for publication. The clean-up will be done by the city crews this year.
Sweeping
The sweeper has the following 8reas completed: C.B.D., Shirley Hills and Tonkawood.
He is currently working the Highlands area.

~d{T!CLE i. Pu~oose of Agreement
This o~greement has as its purpose the promotion of harmonious
relations between the Employer, its Employees and the Union, the
furtherance of efficient governmental services; the establisEment
of an equitable and peacful procedure for the resolution of .disputes
that ~.uay arise ~-~thout interference or disruption of efficient
operation of the department~ and the establishment of a fo~aal
,understanding relative to all terms and conditions of employment.
ARTICLE II. Recoomaition '-
Section 1. The k~uployer recognizes 'the Union as the exclusive
representative under Minnesota Statutes 17~.71 Subdivision 3, for all
employees of the Nomud P.D. Stroerviso_~. bargaining unit as
identified, by the Bureau of Mediation Services; certification of

Section 1. The Employer retains the full and unres~ricted

its overal budget, utilization of technology, the organizational
structure, ~nd selection and direction and n~mber of personnel~ and'
to perfornt any inherent managerial function not specifically limited
by this Agreement.

Section 1. A. The enplo'yer agrees to cooperate ;.~ith the Union

p~;roll deduction. The ~,nployer agrees to remit-such regular ~.~onthly
dues in a m~nner to be prescribed by the Union.
B. The Union agrees to indenmify and hold the Mnployer han.mless
as.'ainst any ~d all claims, suits, orders or judf;~ents brought or
is.---ued a,j~,,inst the ~.:~loyer as a result of tony action taken or not
taken by the ~plOr under the provisions of p~aph A of this
Section. '
Section 2. The Employer agrees not to enter into any additional
agreements %~th employees, individually or collectively concerning
any terms or conditions of employment.
Section 3. The Union may designate members to' act as stewards
or offic~ers and shall, inform the Employee of such choice and of any
changes in stewards or officers in writing.
Section 4' The Employer agrees to' ma/ce space available on the
employer bulletin board for the posting of Union notice (s) and
announcements and to. make space available for Union meetings ~.~hen it
does not conflict x. rith the operation of the department..
Section 5. The Employer agrees to allow the officers and
representatives of the bargaining ~unit reasonable tLme off and
leaves of absence, with prior approval and without pay~ for the purpose
of conducting Union business ;-;hen such time ~.rill not unduly interfere
~ith the operations of the department.
Section 6. The Employer agrees to post all promotional.
opportunities ~.rithin the department; to publish the method by
;.~hich promotions shall be made ;-rithin the department; and to
mske copies of all work rules and requlations available to employees.
ARTICLE VI. ~nployer Security
Section 1. ]!either the Union, its.officers or agents, nor
any of the.~nployees covered by this Agreement%~ll engage in,
encourage, sanction, support or suggest any strike, slowdown, mass
resignations, mass absenteei~a, the ~illful absence from one's position~
the stoppage of wo~ or the absentence in whole or part of the full~
faithful and proper perfo.rmance of duties of employment for the
purpose of inducing, influencing, or coercing a change in the
conditions, compensation or the rights, privileges or obligations
o~ employment.
ARTICLE VI~. Equal Application
Section 1. The provision~ofthis Agreement shall be applied
equally to all Employees in the bargainingunit ~thout discrimination
as to race, color~ creed, sex, national origin,I religion or political
affiliation. The Union and the .Employees covered by this Agreement
shall share equally with the ~nployer the responsibilities established
by this Article.
Section 2. The Employer shal~not discriminate against,
interfere x.~th, restrain, or coerce an Plnployee from exercising %he
right to join or not to join the Union or participate in an official
capacity on behalf of the Union, which is in accordance ~,lth the
prov~.'~sions of this Agreement. The Union shall not discriminate against,
interfere with, r~strain, or coerce an Employer from ex~rcising .the
right to ~oin or not to join the Union and%~ll not discriminate
against any EmPloyee in the a~ainistration of the Agreement because
of non-membership in the Union.

Section 3. ~Union accepts its responsibi~es as
exclusive representative and' agrees to represent all~ployees in
the barsaining unit Without discrimination.
ARTICLE VIII. Prevailing Rights
Section 1. All benefits, rights and privileges now in effect
for employees and not specifically contained in this Agreement
shall remain in Tull force and effect, ~,~thout change or termination
by the ~nployer.
;~TICLE IX. Savings
Section 1. This Agreement is subject ~o the la~-zs of the
United States and the State of ~,~nnesota.
Section 2. In the event that any provision of this Agreement
shall be held to be contrary to law by a court of co~oetent juris-
(~ction from %-~hose final judgment or decree no appeal has been t~ken
~.~thin the time provided, such provision shall be voided. All other
provisions of this Agreement 'shall continue in full force and effect.
The voided provisions may be reneEotiated noon written request of
either party.
ARTICLE X~ Grievance Procedure.
Section 1. A. For the purpose of this Agreament the term
"grievance" means any disputes arising concerning the interpretation
or application of the express provisions of this Agreement or a~.y
term or condition o£~aployment.
B. In the eventof such grievance arising there shall be no suspension
of operations but an earnest effort shall be made ~o resolve such
grievances in the manner prescribed by this Agreement.-
C. The ~ployer and the Union agree that the investigation and
processing of grieVances shall'be accomplished during the normal
work day eithout a reduction in wages or loss of leawe time to the
aggrieved or the union steward while consistent x,ith employee duties
and responsibilities. ,
Sectmon 2. Procedure
Grievances~ as defined by Section 1, shall be resolved in
conformance ~-~th the following procedure:
Steo 1. Au Employee claiming a violation concerning the
interpretation or application of this Agreement shall, ~thin t~enty-
one (21) calendar days after such alleged violation has occurred,
present such grievance to the k~nployce's supervisor as designated
by the '~.ployer. The~oloyer-designated representative ~ill discuss
and give an ans~er to such Step 1 grievance ~ithin ten (10) calendar
days after receipt. A grievance not resolved in Step 1 and appealed
to Step 2 shall be placed in ~riting setting ~orth the nature of the
~;rievance, the facts on x~;hich it is based, the provision or provisions
of the Agreement allegedly violated, the rer~ed?? requested, ~nd shall
be ~pealed to Step 2 within ten (lC) calendar days after the
,~m. ployer-design~atcd representative's final an~.~er in Step 1.

Steo ~. A grievance unresolved in Step'3 and a~pealed to'
Step ~ by--Union shall be submitted to arbitration subject to
the provisions of the Public Employment Labor Relations Act of l~?l
as amended. The selection of an arbitrator shall be made in
accordance ~ith the "Rule Governing the Arbitration of Grievances"
as established by the Public Employment Relations Board.
Section 3. Arbitrator' s Authority
A. The arbitrator shall have no right to amend, ' modify, nullify,
ignore, add to, or subtract from the terms and conditions of this
Agreement. The arbitrator shall consider and decide only the
specific issue (s) submitted in ~-~riting by the ".~hployer and the
Union~ and:shall have no authority to make a decision on auy other
issue not so submitted.
B. The arbitrator's decision shall be submitted in ~-~riting within
thirty (30)'days follo~-~ing close of the hearing or the submission
of briefs by the parties, whichever be later, unless the parties
aEree to an extension.
C. The fees and expenses of the arbitrator's services and proceedings
shall be borne equally by the B~ployer and the. Union provided that
each party shall be responsible for compensating its-o~.m representatives
and witnesses.If either party desires a verbatim' record of the
proceedings, it may cause such a record to be made providing it pays
for the record. If both parties desire a werbatim record of the
proceedings the cost shall be shared equally.

Reference is made to our telephone conversation of April 24,
1979 regarding the cost of connecting the Spring Park water
system w~th your water system.
In talking with Bob Shanley I am under the impression that
if the cOnnections were made at the Black Lake and Seton Lake
bridges, said connections would normally be closed and that
the purpose of the interconnections is for emergency purposes
only o
I have prepared a cost estimate for the work'necessary to
connect the two systems. The estimate is very preliminary
and would need to be revised after ~he project were designed,
however, the estimate should be reasonable'but perhaps on
the conServative side.
The preliminary estimate is based on the following design
parameters:
1. Ail piping - 6 inch diameter
2. Length of Black Lake Connection - 884 feet
Length of Seton Lake Connection - 682 feet
4. Length of bridge crossings - 100 feet each

E. Clark is preparing the bond sale for 1979 Streets, etc., and
would like to set the sale for Wednesday, June 20th.
The bids could be opened at 3 P.M. and the Council could consider
them at any time that evening: 4:30 - 5:30 - 6:00 or 7:30. The
meeting would only last a few minutes.
The 'reason he suggests a Wednesday is that most bond sales are
on Monday and Tuesday with Tuesday being the most popular.
If the Council approves, they should set the time for a special

Dear Hank:
Thanks for your call about the bill that might prohibit
the issuance of revenue bonds for a housing program. It
prompted me this morning to talk with Senator Jerry
Anderson, Chairman of the Energy and Housing Committee,
and he reported the following.
Since so many communities, including the city of Mound,
are asking for special legislation to permit the sale
of such bonds, there is a bipartisan effort to pass
legislation that would enable all Minnesota cities to
issue such bonds. In other words, the'bill wo~ld not
"outlaw" them, but rather establish guidelines and
limits so that all cities could take advantage of this
financing without having to come to the legislature.
Briefly.he mentioned that cities would be limited in an
amount equal to $1,000 per person; i.e., $5 m~!lion for
a city of 5,000 people and would require that their
proposals be reviewed by the Minnesota Housing Finance
Agency.
Would appreciate any specific suggestions or p~oposals
-regarding this legislation so that it is useful and not
too restrictive.
Again, really appreciate your call bringing this issue
to my attention.

Subj: Lake Minnetonka Emergency O'il Spill Procedures

It has been reported recently that fuel oil spilled from an
bverturned delivery truck eventually ended up in the Lake Minne'~
tonka drainage system, causing the loss of 150 mallards.
Initial procedures followed By the oil company, local aUthorities,
and the MPCA appeared to be prompt and reasonable. The placement
of sand dams for absorption purposes was apparently adequate.
Unfortunately, from this point on, the Minnesota emergency pol-
lution control system completely broke down, and removal follow-up
was not made by (1) local police, .fire or street department
personnel involved; (2) the oil company or driver; or (3) the
HPCA emergency enforcement people. After several weeks t~e oil
seeped away through the drainage system, and the birds were lost.
Obviously Minnesota's emergency oil spill procedure is woefully
inadequate, and needs an overhaul to insure its proper function
of controlling pollution.
In the meantime, we r_e_quest that the LMCD be promptly notified of.
all emergency oil or dangerous chemical spills in the Lake
Minnetonka basin, and we will be happy to help assure that proper
~ollow-up procedures are adhered to. Please notify Frank Mixa,

The restoration for the shouldering project on Co Rd llO from the west city
limits easterly has not been completed. Our plans are to seed all the areas
within the next couple of weeks. We were real successful seeding these areas
last year when we used black dirt and fertilizer. Thus, we have no plans to
