AN oRDINANCE AMENDING SECTIONS 23.06, 23.011 AND
23.05 BY REZONING CERTAIN LANDS FROM MULTIPLE
DWELLINGS TO RESIDENTIAL A-1 AND RESIDENTIAL B
The City of Mound does ordain:
Section 23.06, Subd. b, Subsection 8 and 9 of the Mound City Code
is amended as follows:
The following described property is hereby deleted from this
Multiple Use District:
Ail of Lots 19 and 20, Auditors Subdivision Number 170 and
also, Lots 28 to 32, inclusive, The Bartlett Place Upper
Lake Minnetonka.
Section 23.011, Subd. b, of the Mound City Code is amended by
adding subsection 39, which shall read as follows:
39. The following land is hereby rezoned to Residential Use District
A-l:
Ail of Lot 20 and that part of Lot 19 lying north of the north
line of Lot 18 and the same extended northeasterly across Lot
19 to intersect with the east boundary line of Lot 19, all in
Auditors Subdivision Number 170.
Section 23.05, Subd. b, of the Mound City Code is amended by adding
subsection 8 which shall read as follows:
8. The following land is hereby rezoned to Residential Use District
B:
That part of Lot 19, Auditors Subdivision Number 170, beginning
at the southeast corner of Lot 19 than southwesterly to the
southeast corner of Channel Town except dedicated road, than
~horthwesterly to northeasterly corner thereof than northeasterly
along the extension of the northwesterly line of Channel Town
to its intersection with east line of Lot 19 than south to north-
western corner of Lot 32, The Bartlett Place Uppe~ Lake Minnetonka,
then southerly to point of beginning; and also Lots 28 to 32,
inclusive, The Bartlett Place, Upper Lake Minnetonka.
The Zoning Map of the City on file with the City Clerk is hereby amended
in accordance with these rezoning provisions.

CO~S NOW the Petitioner and petitions the Court for review
of the 1978 real property assessment pursuant to Minnesota Statutes
Chapter 278, and in support of such Petition pleads certain objec-
tions and defenses together with allegations in support thereof as
follows:
The Petitioner herein has an estate, right, title or interest
in or lien upon the real estate involved in this Petition sufficient
to maintain this Petition pursuant to Minnesota Statutes Chapter 278.
II.
The real estate involved in this Petition and the assessment
of which the Petitioner is protest'ing is described and designated
in the tax statement or statements or other Memorandum attached
hereto as Appendix "A" and the descriptions or identifying numbers
thereon are herewith and hereby incorporated as though recited at
length and in full.
III.
The.real estate described in Exhibit "A" is located in the
City of Mound and Minneapolis.
IV.
The Petitioner has been discriminated against in the assess-
ment of its property as compared to other real property in the

taxing district herein concerned in that the other real property
has been systematically, arbitrarily and/or intentionally under
~alued, all of which is contrary to the requirements of uniformity
due process and equal protection of the'law required under the
Fourteenth Amendment of the Constitution of the United States,
and Section 7 of Article I and Section 1 of Article X of the
Constitution of the State °f'Minnesota.
The real estate herein concerned was not assessed equitably
.in reference to assessments of other like properties which is con-
trary to the Constitutions of the State of MinnesOta and of the
United States.
Classifications or the application of such classifications,
for purposes 'of taxation under Chapter 273 Of Minnesota Statutes,
of certain real property in the taxing district herein concerned
are contrary to the 'requirement of uniformity, due process and
equal protection of the law required under the Fourteenth Amend-
ment of. the constitution of the United State's, Section 7 of
Article I and Section 1 of Article X of the Constitution of the
State of Minnesota, causing the real estate taxes on Petitioner's
real estate payable in 1979 to be unlawfully high.
VII.
Special tax laws, or the application thereof, for purposes of
taxation under Chapter 273 of Minnesota Statutes and/or other
statutes, of certain real property in the taxing district herein
concerned are contrary to the requirements of uniformity, due
process and equal protection of the law required under the Four-
teenth Amendment of the Constitution of the United States, Section..7
and Article I and Section 1 of Article X of the Constitution of the
State of Minnesota, causing discrimination against Petitioner and
the taxation of his real estate.

WI{EI~FORE, the Petitioner-prays that the Court make its Order
as follows:
1. Determining that the estimated market value, limited 'mar-
ket value, assessed value and/or general taxes on the Petitioner's
real estate should be reduced i'n accordance with the evidence and
the laws of the State of Minnesota and the United States.
2. In the event the Petitioner has-.paid'.~ess than the full

real estate taxes and installments of special 'assessments, that no
penalty, costs or interest be levied on the unpaid portion %hereof.
3. The Petitioner recover interest at the legal rate on that
amount of the general real estate taxes paid in excess of the CoUrt
determination herein.

1979 Street Improvements
Dear Leonard:
Under our recently signed contract, any project that goes over two
million dollars the engineering fee will be negotiated. However, since
this project was started before the contract was signed and we had not
anticipated that it would go over two million dollars we have not negotiated
the engineering fee.
What I have proposed in the attached invoice is that we took a
percentage, agreed to in our contract, and applied it to $2,000,000
which gave us a total engineering fee of approximately $146,000. We
than took that total fee and divided it into the actual bid price of
$2,236,000.00 and came up with a proposed fee of 6.528%. What we have
done is charge you as if the bid was $2,000,000 even though the bid
price was higher. We think this is fair in determining our fees and
hope you concur. The ASCE Hanual No. 45 gives the Median Compensation
for a $2,200,000 project as 6.82%, so we are also less than that (copy
attached).

This communication is addressed to you for the purpose of inform-
ing you that the undersigned represents Larry D. and Virginia Elm
with respect to the damage that has occurred to the property of
our clients as the result of a storm sewer project. You have pre-
viously discussed this matter with my clients and at this time it
is our request that in the future you refrain from personal contact
with Mr. and Mrs. Elm and address your inquiries to me.
It seems evident at this time that the City has directly or through
its agents trespassed upon the property of Mr. and Mrs. Elm at
2012 Villa Lane and in the course of said trespassing has destroyed
trees and other vegetation while the City constructed a storm sewer
outlet on my client's property without an easement right thereon.
Prior to commencing to any litigation, I deem it advisable that we
explore various alternatives available for resolving the various
problems of this encroachment. If it is your desire in behalf of
your company and the City to discuss a settlement of this problem,
please contact the undersigned after you have given some thought
to alternatives available to resolving the problem.

Attached you will find a draft of the Metropolitan Health Board's Report on
Long-Range Hospital Planning. This report is the culmination of several years
of unprecedented community activity, involving hospital administrator's, hospital
trustees, medical personnel and concerned consumers.
The report makes strong recommendations for change in the health care delivery
system, in order to contain the inflationary rise in health care costs. These
recommendations suggest a reduction of acute care beds and consolidation of
seven specialized services: cardiac catheterization, open heart surgery, pediatrics,
obstetrics, perinatal services, megavoltage radiation therapy and CT scanning.
The draft report also sets forth procedures for eliminating excess capacity.
Despite the extensive public involvement that has preceded this draft, the
Health Bo~rd seeks additional comments from both health providers and consumers.
Interested parties are urged to s~udy the attached draft, and commen~ either in
writing or at the public forum. Those speaking at the forum are encouraged to
register by contacting Eleanor Sumeson at 291-6352, and to provide a written
copy of their remarks at the time of their testimony. The~forum record wii! be
kept open for additional comments for seven dmys after the forum, until ~he end
of the business day on June 27, 1979.

The big news was the outlawing of housing bonds by a proposed law, by a non-law.
Following Treasury's lead, Congress found it can rule effectively by proposing
a law with an immediately effective date whether or not the proposal ever becomes
law. Attorneys won't issue "tax exempt" opinions in the face of such proposed
laws or Treasury regs and, without such opinions, bonds aren't marketable. Such
laws can't be challenged because they are only "proposed"; any court challenge
would be premature.
It wasn't all bad in that some massive offerings were headed off just when casualty
insurance companies left the bond market. The market was about to be swamped.
Sometime we'll have to decide what public purposes are really entitled tp tax
exempt financing. A public purpose can be found in practically every activity.
(Even a driver's or pilot's license is or is not "in the public interest" and
therefore granted or denied.) Let's try a modest proposal: The test of whether
a purpose is entitled to tax exempt financing should rest on whether ownership
of the facility (long term lease or title or other legal control) will be in
public hands. Except possibly for health organizations, when the principal
beneficiary is a private entity the financing should not be entitled to a state's
constitutional exemption from federal taxation.
Only those facilities which serve the public and which will be owned and controlled
by the states or their subdivisions and, without which,the states' sovereignty
would be impaired would be constitutionally tax exempt. The constitutional argu-
ment is much stronger if only those functions essential to a state's sovereignty
are exempt from taxation by the federal government whose powers were originally
delegated by the states. Congress might still exempt certain borrowings from
federal taxation, but it would be by federal, not state, legislation.
The bond market remains remarkably steady
considering the inflation. One waits for
the other shoe to drop.

As requested, we have looked at the question of whether
the property owner or the City should maintain the rock and
timber retaining walls which are being construction with the
new streets.
I have talked with the Citites of Golden Valley and Rich-
field, bo'th of which have a lot of the same type of wall as
Mound. Both cities maintain these walls themselves. The City
of Golden Valley has had virtually no maintenance to do and
Richfield has occasionally replaced a stone or remortered a
portion of wall. I believe Bob Shanley has talked with a
number of other cities who maintain the walls. I am not aware
of any city which has the homeowner maintain a wall on street
R.O.W.
It is our recommendation that the City of Mound maintain
the walls which are built with the streets. This will assure
uniform maintenance quality. There are many elderly people
in the City who probably could not do even minor maintenance
work. If walls are damaged by collisions with cars etc. the
City could be reimbursed by the insurance on the car. Experience
in other cities has shown that wall maintenance is not a
significant expense.

please advise.

SUBJECT: Questionnaire Survey Distributed by Planning Commission
Attached is a copy of the questionnaire survey tabUlated by the City
Planner. See Pages 1570-1572 for the list of comments on the survey.

A questionnaire which addressed developmental issues facing Mound was dis-
tributed by the Planning Con~nission to city residents. Approximately 3,200
questionnaires were sent out to the residents listed 0n the City Hall mailing
lists. Three hundred and fifty six surveys were returned to the Planning
Commission; consequently, the Commission received input from nearly lO~ of
the residents of the community. Not all of the questions were answered by
all of the ?espondents; therefore, the total number of responses for each of
the questions are not equal. Some individuals chose to answer only certain
questions.
The survey consisted of nine multiple choice questions and a tenth question
asking respondents to make miscellaneous comments about issues concerning them.
Questions 1 - 7 were multiple choice questions which asked'the respondents to
choose which answer best answered each question. Answers for questions 2 and 7
contained write-in options which were later categorized for statistical
purposes. After the subtotals for each option to each question were determined,
the percentages of respondents favoring each option were calculated.
Ques.tions. 8 and 9 asked respondents to rank seven qualitieS that make Mound
a desireable place to live and five community development issues in their order
of importance. The Mean Rating was calculated by totalling the numerical
ratings assigned each issue and dividing this sum by the total number of
responses.

The issues and qualities with the lowest mean rating were of the greatest con-
ern to survey respondents. These issues and qualities were assigned relative
ranks in the Survey Summary.
A number of interesting and colorful miscellaneous comments were offered by
respondents. The topics of concern were quite varied.. Many comments were
traffic related, reflecting the ~op priority ranking of traffic patterns as
a development issue in question nine. Some respondents offered specific
suggestions and sites for improving the roads, cleaning the streets, expanding the
bus system, etc.. Some people were quite voicferous, protected by the anonymity
of the mail-in survey. One-shortcoming of the mail survey, as opposed to door-to-
door interviewing, is that the sample population is not truly random. A higher
percentage of people fill out a mail-in survey because they have a complaint to

air. Few people would take the time to write in a favorable comment.
Reading the miscellaneous comments offers a subjective picture of additional
issues concernin§ residents.
A variety of cross-tabulations could be calculated should the Planning
Commission wish to invest more effort into the survey. For instance,
developmental concerns may vary among precincts and age groups. Perhaps
families with children felt education to be of a higher development
priority.
General Summary of Issues
The three qualities most commonly sited as making Mound a desireable place to
live are environmentally related. The proximity to lakes and the natural environ-
mental setting of Mound received the highest priority among respondents.
Recreational opportunities in Mound was the third most popular characteristic
in the community.
Traffic patterns were the most important community issue. Many miscellaneous
comments were traffic related. People commented on cleaning the streets,
stricter traffic speed controls, and decorating main boulevards. Environmental
protection was the second highest priority. The residents, drawn to Mound for
environmental reasons (question 8) wish to protect the natural beauty of the
community. Many people felt that more money should be invested in the down-
town area. Businesses and restaurants should be attracted and the shopping
district should be revitalized.

WHEREAS, application has been made for a Planned Development Area pursuant
to Section 23.065 of the City Code, and
WHEREAS, said application has been processed by the Planning Commission which
has recommended approval and a public hearing has been held before
this Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOUND,

A Planned Development Area plan for Pelican Point is approved subject
to compliance with all of the following conditions:

All-utilities shall be constructed pursuant to the plans and spec-

after called the City Engineer. All utilities constructed shall be
inspected during construction by the City Engineer.

and made apartof this permit being the preliminary Site Plan dated
April 11, 1978, showing 13 individual structures numbered 1 through
11 and 26 and 27; and 14 units marked as numbers 12 through 25, being
doubles and one building with 4 units attached. All structures and
amenities shall be located and constructed pursuant to the final Plat.
Exhibit C, a copy of which is on file in the City Manager's office,
and made a part of this permit being the Drainage Plan dated April 11,
1978 showing elevations..All excavating and grading shall be pursuant
to Exhibit A and C.
Prior to any building permits being issued the applicant shall submit
and have approved by the City Engineer a final Erosion Plan.

All fire lanes shall be designated on a map and approved by the Mound
Fire Chief. All fire lane areas shall be marked to prohibit parking
or other obstructions on the fire lanes.
The developer shall pay cash in lieu of park land dedication, the
park dedication shall be in the amount of $23,875.00 pursuant to
Section 22.37 of the City Code. The applicant shall pay to the City
the sum of $1,000.00 for park dedication at the time they obtain a
building permit for each structure or unit until the total amount is
paid. The park dedication herein covers all land as shown or described

of any internal building site that could be served off of Devon Lane
could at sometime in the future deny public access to that site.

owner of Lot 5, who is concerned about elevations and drainage; further asked
that her letter (included ~ Exhibit A) be made a matter of record.
Stannard moved and Smith seconded a motion to recommend to Council that
we approve this variance and also consider vacating some unused portion
of cul-de-sac'(bubble) taking into account minimum front yard footages
for Lots 2, 3 and 4, The vote was unanimously in favor.

Street Vacation - Devon Lane from Carrick Road to Longford Road
Robert Winkler and Dave Moore, Realtor, present requesting vacation so
proposed duplex can front on Carrick Road and have sufficient side yard.
Discussed. An alternative was proposed as follows:
Smith moved and Jackson seconded a motion to recommend Uranting a
13 foot street front variance of Devon Lane because &t the present
time, Devon Lane is unimproved right-of-way and all ingress and egress
shall be for any and all proposed structures off of Carrick Road. The
probability' of any internal building site that could be served off of
Devon Lane could at sometime in the future deny public access to that
site. The vote on motion was unanimously in favor.
Non-conforming Use/Undersized Lot
Lot 5 and E. 10 ft. of Lot 6, Block 37, Wychwood
Ms. Martens wishes to move building on lot to meet setbacks and straighten
house out on lot.
Inspector asked clarification of whether she needed to apply for variance;
Planning Commission advised Inspector that she would need to reapply.
Eric Bodine present proposing to move house from Hopkins area to Lo~ 1.& 15,
Block 13, Dreamwood. His~plans include bringing house up to code to live
in except'he does request house size variance of 64 square feet.
Request made at this time without formal application as there is a limited
amount of time in which to get this house~moved from present site. House
has been inspected by Building Inspector.
Jackson moved and Paulsen seconded a motion to recommend variance for
undersize of structure be waived and structure be placed so further
expansion can be accomplished and still comply with existing setbacks.
Discussed. Chairman asked Staff to take care of application acceptance.
Hanson moved and Jackson seconded a motion to amend motion saying that
variance can be changed at June llth meeting, if after looking at site,
etc., they so desire. The vote on amendment was all in favor except
Smith who abstained. Vote on motion as amended was Smith abstained;
all others voted in favor.

At its meeting on May 31, 1979, the Board of Managers of the
Minnehaha Creek Watershed District reviewed the subject per-
mit application.
It approved the permit as requested with the following
conditions:
It approved the permit for a variance allowing for
a lakeshore setback of 60 feet. Such distance shall
be measured fr~m the Ordinary High Water Level
established for the lake of 929.4 NGVD.
2. Subject to final approval by the City of Mound.
All work shall be done in a manner to prevent
erosion and siltation both during and after
construction in accordance with the M.C.W.D.
guidelines, a copy of which is enclosed.
Permits are valid for one year.

to Shirley Hills Unit A addition lot 6 & 7 be required to comply with the
following special conditions:
Pravide for at least two special traffic control people. They will be
needed to reroute traffic at various locations because the roadway is
too narrow for even one lane of traffic in addition to the house. The
police department can provide this service at a rate of $15.21 per hour
per man with a 4 hour minimum per man.
2. The house should be moved on Sunday thru Thursday only between the

WHEREAS, pursuant to resolutions heretofore adopted by
the Council ordering the following described public improvements,
contracts have been entered into for construction thereof as
authorized by Sec. 429.011 to 429.111, Minnesota Statutes, and
said improvements have been completed or are in the process of
being completed, and that at least 20% of the costs of such
projects have either been assessed or will be assessed against
benefited properties, the number of each improvement and the
estimated total cost of each improvement being as follows:

WHEREAS, it is necessary that the City borrow the sum
of $3,070,000 to finance construction of the aforesaid
improvements by the issuance of General Obligation Improvement
Bonds as authorized by Chapter 429 and 475 of the Minnesota
Statutes,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Mound, Minnesota, as follows:
1. It is hereby determined that it is necessary to
sell bonds to provide funds for the purpose of financing the
aforedescribed public improvements and that the sum of $3,070,000
is necessary to defray the expenses of said projects.
2. It is further determined that the amount of
$3,070,000 should be supplemented by the issuance of additional
bonds as authorized by Minnesota Statutes 475.56 and that the
City shall sell and issue $3,100,000 of General Obligation
Improvement Bonds of 1979 with $30,000 of said bonds being
considered as additional interest. The sale resolution selling
these bonds shall contain a statement indicating the sum
considered necessary to finance public improvements, and further
indicating that the City is selling additional bonds to represent
the higher rate of interest as authorized by Minnesota Statutes
and that such additional bonds in the aforementioned amount does
not exceed 2% of the amount otherwise authorized. Bids submitted
to purchase bonds in the amount of $3,100,000 shall be at a price
of not less than $3,070,000 an~ that all amounts received by the
Treasurer in excess of said sum shall be credited to a sinking
fund for the payment of interest on these obligations.
3. That the City Clerk is hereby directed to cause
notice of said sale to be given by publication at' least 10 days
in advance of the sale in the official newspaper and in
Commercial West, a financial paper published in Minneapolis,
Minnesota, with general circulation throughout the State of
Minnesota, which notice shall recite that the City of Mound
proposes to issue and sell its bonds in denominations of $5,000
or such higher denominations as requested by the successful
bidder within 48 hours after sale of the bonds, and that the
bonds shall be numbered consecutively commencing with number 1,
shall be dated July 1, 1979, to bear interest on April 1, 1980,
and semiannually thereafter on the first day of October and April
in each year, maturing serially on April 1 in the years and
amounts as follows:

Bonds maturing after April 1, 1992, will be subject to
redemption in inverse numerical order on said date and any
interest payment date thereafter at par and accrued interest.
Said notice shall recite that the City within 40 days
from date of sale will furnish the printed bonds and approving
legal opinion of Messrs. LeFevere, Lefler, Pearson, O'Brien &
Drawz 1100 First National Bank Building, Minneapolis, Minnesota,
both without cost to purchaser, and that the bonds will be made
payable at any suitable bank or trust company designated by the
successful bidder, all bids to be accompanied by a good faith
check in the amount of at least $62,000 to be forfeited as
liquidated damages in the event the bid is accepted by the City
and the bidder fails to comply therewith; that no bid of less
than $3,070,000 will be accepted; that the Council reserves the
right to reject any and all bids, to waive informalities, and to
adjourn the sale if deemed expedient.
4. Sealed bids shall be received until 2:00 p.m. on
July 18, 1979, at which time said bids shall be~opened and
tabulated by the City Manager and/or City Clerk Treasurer who
shall tabulate said bids and present them to the City Council
which shall meet at the City Hall in said City on Wednesday, the
18th day of July, 1979, at 7:00 p.m. for the purpose of
considering said bids for the purchase of said bonds and take
such other action in respect thereto as may be found necessary or
expedient.
The motion for the adoption of the foregoing resolution

The bonds of the City are to be issued pursuant to Chapter 429
and 475 of the Minnesota Statutes. Bonds will be in the
denomination of $5,000 each unless the purchaser within 48 hours
after award specifies a higher denomination in multiples of
$5,000.
The bonds will bear interest at the rate or rates
specified by the successful bidder, subject to the limitations
stated below. Principal and interest will be made payable at any
suitable banking institution designated by the successful bidder
subject to the approval of the City and the City will pay
reasonable and customary paying agency charges. Within 40 days
after award of the sale and without cost to the purchaser, the
City will furnish and deliver to the successful bidder anywhere
in the Continental United States the printed and executed bonds
and the unqualified approving legal opinion of Messrs. LeFevere,
Lefler, Pearson, O'Brien & Drawz of Minneapolis, Minnesota, and
the customary final delivery papers, including a certificate
showing absence of litigation. Payment must be made in federal
or other immediately available funds.
Split rate bids may be submitted stating the same rate
or rates of interest from date of issue to maturity for all bonds
having a common maturity. No basic rate applicable to bonds
maturing in any one year may be lower than the basic rate
applicable to bonds maturing in any earlier year. Not more than
7 interest rates may be specified for the issue. Each interest
rate must be expressed in an integral mutiple of 5/100ths of one
percent (1%). No rate may exceed seven percent (7%) per annum on
any bond for any portion of its terms. Additional interest
coupons may not be used. Bidders are also requested to state
total interest cost and average interest rate.
Ail bids must be in writing, enclosed in a sealed
envelope, be unconditional except as to the above opinion, be
addressed to and left with the City Clerk-Treasurer prior to the
above time, be for all or none of the $3,100,000 worth of bonds,
must be accompanied by a certified check, bank draft or cashier's
check in the amount of at least $62,000 payable to the order of
the City of Mound to be forfeited as liquidated damages in the
event the bid is accepted and the bidder fails to comply
therewith.
The City will assume no obligation for the assignment
or printing of CUSIP numbers on the bonds or for the correctness
of any numbers printed thereon, but will permit such printing to
be done at the expense of the purchaser, if the purchaser waives
any extension of the time of delivery caused thereby.
No bid of less than $3,070,000 plus accrued interest on
$3,100,000 General Obligation Improvement Bonds at the coupon
rates specified to the date of delivery will be considered. Oral
bids will not be accepted. The bid offering the lowest total
interest cost (total interest from July 1, 1979, to stated
maturities, plus any discount belo%; par, less any cash premium
offered) will be deemed to be th~ most favorable.
The City reserves the right to waive any informality in

Mr. Haglund has been requested to give a temporary and permanent easement over
a portion of Lots 13 and 14, Block 10, Woodland Point.
Mr. Haglund is agreeable to doing the same, but requests that the City review
with him some problems that he would like to have resolved.
The first problem is the condition of the adjacent lot to the South of the
property owned by,Lt. Haglund. It is Mr. Haglund~s undezstanding that these
lots are owned by the City and are being used for a refuge dump. He would
greatly appreciate some assurance from the City that these lots will be
cleaned up and that ~n the future they will be more strictly control±ed.
Jennings Road when it was installed created a situation in which the water
flowing towards Lake MSnnetonka came onto the property described as Lots
13 and 14, Block 10, Woodland Point. A 15" C.M.P. is being fnstalled or has
been installed for the purpose of assisting the flowage of the water from Mr.
Haglund's property into Lake Minnetonka.. It is Mr. Haglund's opinion that
during the construction of the street that the grade of his property and the
adjacent road could be changed so that the water rather than running onto
Mr. Haglund's property and creating a pondl~ng problem on his property, could
be directed toward the other sSde of the street and pond on the property
owned by the City or be directed so ~t runs directly into the lake without
using Mr. Haglund's property as a ponding area, It is also noted, that the
City has not obtained from Mr. Haglund any easement which_ would allow water
to be ponded on his property to satisfy the drainage needs of the area.

It is noted that Lots 11 and 12 across Dove Avenue from the property owned by
Haglund had been mcquired by the City for tax purposes. Would it be possible
for Mr. Haglund to acquire the fee title to ~aid property for purposes of
having a place to install a dock for lake access. We would agree that any
ownership rights that we may acquire to said lot would not entitle us to
construct any assessory buildings or permanent structures thereon.
With regards to the easement I have inserted the following language:
"Grantee by accepting this deed agrees that any property covered by this
easement shall be included in determining lot sizes for building purposes and
all setbacks shall be from the lot lines and not from the easement lines.
Grantee agrees to repair all damages to property and to re-sod the area covered
by this easement."
Would you please let me know what the City's positions are on the three issues
that I brQught up, and as soon as Mr. Haglund has signed the easement I will be
in a position to deliver the same to you.

SUBJECT: Tax Forfeit Land
On June 6th, the Council discussed wiping out lot lines and in
effect replatting some of the land.
This idea has been discussed with the County Land Department and
the City Attorney.
The Attorney advises that resubdividing might not accomplish our
purpose, but purchasing and reselling the lots with a restriction
in the deed would.
In discussions with the County, they suggested keeping the middle
building site of three building sites off sale until the outer lots
are built upon.
Putting the two suggestions together, the City could try and resell
the middle lots with the restriction and allow the other two to go
on sale.
This will be discussed on June 12th.

COUNCIL MEMORANDUM NO. 79-203
SUBJECT: County Road 15
The following resolution is suggested for County Road 15:
RESOLUTION 79-
A RESOLUTION REQUESTING THE HENNEPIN COUNTY BOARD OF
COMMISSIONERS TO RECONSIDER CSAH 15 ROAD IMPROVEMENTS
WHEREAS, Hennepin County did propose to widen CSAH 15 from Navarre to
Mound prior to 1974 and subsequently removed this project from
their capital improvement plan upon the objection of another
municipality, and
WHEREAS, the County did in 1978 install a center median in Spring Park
as a temporary measure which has improved the traffic flow, but
is quickly becoming inadequate in view of the increased traffic,
which Hennepin County 1978 figures show to be 17,500 vehicles
per day, and
WHEREAS, increased summer traffic at the Spring Park boat launching ramp
creates hardships for all who travel this roadway, and
WHEREAS, when the proposed "ring route" to State Highway 12 is implemented
traffic on CSAH 15 will not be reduced but will increase due to
the westerly routing to reach the"ring route", and
WHEREAS, traffic at County Road 15 and Wilshire Boulevard increased .turning
and egress to County Road 15 difficulties, and
WHEREAS, the heavier commercial use of County Road 15 within Moun~ creates
greater problems between Cypress Lane and the T intersection at
Commerce Boulevard,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOUND:
That the Hennepin County Board of Commissioners and the Highway De-
partment reconsider placement of this project and the County Road 15
By Pass within Mound on their FiVe Year Capital Improvement Program
to install a modern four lane commercial type street with curb,
gutter, storm sewer, sidewalks and adequate pedestrian crosswalks in
the area from CSAH 19 to CSAH 110.

Dear Ms. Holm:
I have talked with two officers of the Mound Police Department in regards
to your request that the property taken pursuant to the search ~z-z~nt be
returned to you. I have also had conversations with the chief property
officer of the Minneapolis Police Department, and a Minneapolis City
Attorney. Beyond this, I have performed some research in or~er to determine
whether or not your request is reasonable an~ justified by existing law.
As I informed you on the phone, I have never been faced with a request such
as yours before, and I ~nted to be thoroughly informed before I reached a
determination. The results of my efforts are as followsl
1. Any proper~y with altered serial or inlentification numbers may
be reasonably considered to be contraband. It is my understanding, that the
pioneer stereo receiver has altered serial numbers. If this is true, the
Mound Police Department can reasonably retain this item in hopes of finding
the rightful owner. After the expiration of a reasonable remount of time
(usually considered to be one year), the property can be sold at a public
auction.
2. The police may reasonably retain the two car speakers belonging
to your son, since it is my understanding that your son f n~ormed the police
that the property was stolen before he acquired these items.
3. The shot gun and rifle should be returned to the registered
owner, I'm assuming that your ex-husban~ is the registered owner of the guns.
It is my understanding that the Mound Police Department has offered to return
the guns to him. I'm sure the police would return the guns to your possession
if your ex-husband would authorize the police to do so.
4. The hedgetrimmer may be reasonably retained by the Mound Police
since the previous owner of it has informed the police that it ~as stolen
at the time he acquired it.
5. Wayne Holm plead guilty to receiving the following propezty~
2 Audio Vox speakers, 2 Realistic spikers, misc. tools and bike paZtSo The
Petition stat~i theft the aggregate v~lue of these items were more than $100.00.
However, the charge ms reduced to ~eceivtng stolen prop~r~y value~ at under
a $100.00. Only the v~lue of the property ms reduced, the stolen items remained
as worded in the Petition. Naturally, these items c~nnot be returned to you or
you~ son.
I believe I have add~ressed myself to all the property you ~nted returned
to yo,~ possession (see your letter d~ted M~rch 25, 19~9, to the Mound
City Council). In conclusion, I believe the Mound Police Deparbment is
acting reasonably.

Dear Mr. Kopp:
This letter is a follow up of our telephone conversation in
regards to the owner of Lot 2 on Seton Channel setting up a con-
cession stand.
As I stated in our telephone conversation, the Water Patrol
is very concerned about the navigation problems which will be
caused by boats stopping at Mr. Schnebly's stand. This Channel
is one of the busiest channels on Lake Mlnnetonka and there is
already a navigation problem in this Channel because of the
excessive boat traffic. This will be compounded because of
bo~ts blocking each other while trying to cut across the Channel
to tie up at the concession stand.
I feel that a concession stand on one of the busiest channels
in the Lake wil. 1 create traffic and navigation problems which the
Water Patrol is neither staffed nor equipped to handle.

WESTONKA PUBLIC SCHOOLS

TO:
The school district's annual Community Services Conference is
scheduled for 7:00 p.m. in the faculty dining room of the
Mound Westonka High School. A regular school board meeting
follows at 8:00 p.m.
This conference is required by law if the school district'~
is to be authorized to levy and spend funds for community
services. We have already met a substantial portion of the
law by our recent invitation of some 100 persons to the
June 11 Conference. Such persons are all the members of the
Community Services Council, the three City Councils within
the school district, the Hennepin County Commissioners, 277
School Board, and the three local legislators.
This year, we expect the Conference to be chaired by Phyllis
O'Malley, Clerk of the School Board. We expect Don Ulrick,
Community Services Coordinator, to present some information
on the current state of coordination of services in our Westonka
community. Following that presentation, we expect to engage in
a general discussion. By this letter, I am re-issuing an
invitation to ke.y people whose presence is very important to
the Community Services Conference. I hope you will be there.
