Pursuant to due ~all and notice thereof, a regular meeting of the City Council
of the City of Mound, Hennepln County, Minnesota, was held at 5341Maywood Road
in said City on May 22, 1979 at 7:30 p.m.
Present were: Mayor Tim Lovaasen, Councilmembers Robert Polston, Gordon Swenson.,
Benjamin Withhart and Donald Ulrick. .Also present were City Manager Leonard L.
Kopp, City Attorney Curtis A. Pearson, City Engioeer William McCombs and Acting
City Clerk Marjorie Stutsman.
MINUTES
The minutes of the May l, 1979 Council meeting were presented for considerat, ion.
Swenson moved and Withhart seconded a motion to approve the minutes of the. May 1,
1979 meeting as presented. The vote was unanimously in favor.
The minutes of the May 8, 1979 Council meeting were presented for consideration.
Correct Resolution 79-177 on Page 58 to read, "Resolution to continue public
~earing on Inverness Lane'Sewer'Extensjpn and Street Improvement to June 5, 1979".
Withhart moved and Polston seconded a motion to approve the minutes of the May 8,
1979 meeting as corrected. The vote was unanimously in favor.

sented for consideration.. Swenson moved and.Polston seconded a motion to ap-
prove the minutes, of the May 15, 1979 meeting as presented. The vote was un-

the minutes of the May 15, 1979 Board ~f Review as presented. The vOte was
unanimously in favor.

The Mayor reopened the public hearing for imput on said special use permit and
persons present were afforded an opportunity to express their views thereon.
No persons present regarding this permit; the Mayor then closed the public
hearing.

Street ConStruction - Dorchester Road and Island View Drive
The following persons were present regarding their request to discuss an
alternate plan of a cul-de-sac on Dorchester rather than improving roadway
between Dorchester and Manchester, and offered comments or questions:

The Mayor introduced John Carlson..who was representing Congressman Tom Hagedorn
was h01ding "Listening Hours" in the City Manager's office this evening.
Mr. Carlson expressed appreciation for the use of the facility and invited all
persons with q'uestions or comments to talk with him.
.Bids - 1.979 Street & Storm Sewer Co'n'struction
City Engineer, William McCombs, presented a tabulation of .the bids, which showed
a revision in Hardrives' bid from $2,245,517.65 to $2,236,517.65, and reported
on their findings. They recommend accepting the low bid.

Post Office Beautification and Traffic
~ene Hanson and L. "Rock" Lindlan explained the Chamber of Commerce's proposal
relative to Post Office Area Beautification and Traffic Flow[
Ulrick moved and Polston seconded a motion to accept the $500 for a beautifi-
cation plan that is intended to implemen~ some short term traffic flow and
aesthetic improvement; that it be developed by a committee made up of a member
of the Chamber of Comme~ce, Public Works Director and Postmaster with review
of finished plan by City Planner (limit of $100 for Planner's time). Roll
Call vote was: Ulrick and Polston-Aye; Withhart, Swenson and Lovaasen-Nay.
Motion failed.
Lovaasen moved and Swenson seconded a motion that a Committee be set up of
Public Works Director, Postmaster and a representative of t~e Chamber of Com-
merce and they forward to us a rough draft and sketch of the conceptual Post
Office Plan, with review by the Planning Commission before being brought to
the Council.
The vote on this motion was unanimously in favor.

The Council asked that the subject Dock License be considered on June 5th.
The Dock Inspector has recommended the issuance of 15 dock sliFsfor A1 and
Alma's.
The Park Commission recommended the following;

is a recognized City Swimming Beach and as such has a 50 foot'setback,
jeopardizing swimmers with the many large cruisers that dock there,
encroaching onto beach area after beach hours expire.
Motion to recommend to Council, "Approve A1 and Alma's Commercial Dock
Permit with stipulations:
No parking of boats on beachside at any time;
Four foot minimum height for chain link fence installed the entire
length of dock on beachside." Unanimously approved.
The reason for stipulations would help resolve the conflict of a recog-
nized City Swimming Beach and the minimum setback normally required for
a swimming beach and help insure greater safety for those using the
beach area.
Ordinance 294 allowing commercial docks in residential areas can be con-
ditioned.
Any special use permit granted by the council shall be conditioned as
follows:
A. The residential property on which dockage is to be located and the
commercial property served shall be in common ownership and shall be
located within 300 feet of the property line of the commercial property,
B. The mooring of boats at such dock shall be limited to a maximum of four
hours.
C. No gas, oil or other product may be sold from the dock and no servicing
of boats will be permitted,
D. One sign for identification will be allowed but it shall not exceed a
total of six (6) square feet in size,

Ingress and egress from the residential lot shall be restricted to
the property held under common ownership and adequate safeguards
shall be provided so that persons docking will not trespass on private
property or on any public property except for properly designated
streets or sidewalks.
The Council shall specify any special conditions that they may require,
such as fencing, lighting or landscaping, and shall require a site plan
showing the location of any such fencing, lighting or landscaping. Any
lighting installed along the dock or the pathway from the residential
to the commercial property shall be in such a manner as to have no
direct source of light visible from a public right of way or adjacent
land in the residential use district. The Council may require a per-
formance bond to assure construction of the site improvements required
by the Special Use Permit.
The owner shall be required to maintain the premises in a neat and
clean manner and in accordance with the terms established by the
special use permit.
The Council shall determine in allowing such a special use permit that
this use will not be detrimental to the public welfare or injurious
to other property in the neighborhood.
The owner shall be required to meet and comply with all the standards
and requirements of the Lake Minnetonka Conservation District.

SUBJECT: Cemetery - Lot 1, Division A, Graves 1 Thru 4
Mr. Simon Wirtz claims that we have made a burial in Grave 4 which should
have been made in Grave 1. Our records indicate that there was a burial
made in Grave 1 in 1938 (prior to the cemetery being under the City of
Mound).
The City Cemetery workers feel certain that the burials as listed on the
attached are correct.
I have suggested to MK. Wirtz that he and Mrs. Wirtz. would sign the
necessary papers, the City would dig up Grave 1 (the one next to the fence).
If the City had made the error, we would correct it. However, if the City
is correct, then Mr. Wirtz will have to pay for the cost incurred.
If the Council has no objection, we will do as suggested above.

RE: Water Interconnection
Dear Mr. Kopp:
At their meeting on May 21st, the Spring Park Council voted
unanimously to move ahead on the water interconnections as
soon as possible.
We discussed doing the Black Lake Bridge connection at the
time of County construction of the new bridge and it was
agreed this was feasible and recommended. However, due to
spiraling costs the Council felt moving ahead immediately
was the best way to go on the Seton connection.
The Council also agreed to costs being split 50-50.
We hope the Mound Council will be in agreement with these
decisions so specs can be prepared and bids let to possibly
get construction going this year.

A RESOLUTION REQUESTING THE HENNEPIN COUNTY BOARD OF
COMMISSIONERS TO RECONSIDER CSAH 15 ROAD IMPROVEMENTS
WHEREAS, Hennepin County did propose to widen CSAH 15 from
Navarre to Mound prior to 1974 and subsequently removed this pro-
Ject from their capital improvement plan upon the objection of
another municipality, and ·
WHEREAS, the County did in 1978 install a center median as
a temporary measure which has improved the traffic flow, but is
quickly becoming inadequate in view of the increased traffic,
which Hennepin County 1978 figures show to be 17,500 vehicles
per day, and
WHEREAS, increased su~er traffic at the boat launching ramp
creates hardships for all who travel this roadway, and
WHEREAS, when the proposed "ring route" to State Highway 12
is implemented traffic on CSAH 15will noG be reduced but will
increase due to the westerly routing to reach the "ring route",
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Spring Park that the Hennepin County Board of Commissioners
and the Highway Department reconsider placement of this proJecton
their Five Year Capital Improvement Program to install a modern
four lane commercial type street with curb, gutter, storm sewer,
sidewalks and adequate pedestrian crosswalks in the area from
CSAH 19 to CSAH 110.

To assist you in your budgeting process, we are hereby communicating to you our
recommendations for pricing of contract work for the 1980 assessment, which will
be payable in September of 1980. As you may recall, the Hennepin County Board
established our present pricing policy in 1975. Our experience in the 1979
assessment confirms that we can continue to price our contract work at the same
price per parcel and recover our direct labor costs.
As new plats are filed, divisions made, and buildings are constructed, the price
is affected in that the base price per parcel for improved property is higher
than for vacant land. The cost for reappraising these additional parcels will
be reflected in the total price.
This estimate is based on reappraising 25% of your parcels annually as required
by law, plus the new construction which occurs during 1979. For those areas that
have had a considerable number of new parcels created, as well as construction of
new buildings, this will cause an increase in the total contract price even though
we are using the same price per parcel charges that have been used in the past.

city through Community Health Services subsidy monies, through United
Way support, and fees for certain service.

In developing long range plans for Suburban Public Health Nursing Ser-
vice (SPHNS), we are seeking input from local municipalities regarding
health needs within their respective communities. We hope you will
help us plan by responding to the following questions:
- What are the unmet health needs within your city?
- What new services do you feel SPHNS should offer?
- What programs do you feel should be expanded?
- What programs do you feel should be curtailed? Discontin-
ued?

DEFINITION OF SERVICEB
Nursin~_.C~re' o~..the Ill - Activities related to treatment, surveillance, and
maintainance of patients with medical or surgical conditions, accidents/injuries
or chronic disease. Service is provided under the direction of the patients
physician and may include dressing changes, injections, irrigations, and other
treatments.
Home Health Aide Service -. Activities related to personal care and activities
of daily living for homebound or semi-homebound patients whose care needs can
be safely performed by a non-professional person. Service provided under medical
direction and public health nurse supervision.
Health Promotion - Activities.dlrected toward maintaining or enhancing the health
status of apparently.well individuals throughpatient education, counseling, and
guidance regarding maternal and child health and adult health.
ppeclal Therapy Services - Activities related to treatment and rehabilitation of
patients with physical handicaps or speech disorders. Services provided under
the direction of the Patienfs physician.
Nutrition Consultation - Activities related to teaching of patients with special'
nutritional needs with consideration of family practices and economic status.
Services provided under the direction of patients physician.
Child Health Clinics - Activities directed toward maintaining and enhancing the
heal. th of infants and.pre-school children through provision of physical examination,
growth and development assessment, diagnostic tests, immunizations and counseling.
Immunization Clinics - Activities directed toward the prevention and control of
communicable disease through provision of immunizations against seven com_municable
diseases.

ANSWER
Comes now the defendant, City of Mound, a Minnesota municipal
corporation, and for its Answer to plaintiff's Complaint answers and
alleges as follows:
I.
Answers and alleges that it is without knowledge or informat'ion
sufficient to form a belief as to the truth of the allegations
contained in paragraph II of the complaint and therefore denies
the same and puts plaintiff to its proof thereon.
II.
Answers and alleges that paragraph I of the complaint is in-
correct as it relates to Exhibit A attached to said complaint and
the defendant specifically alleges that the property described
in said paragraph I and. Exhibit A exceeds the land. contained in
Block 8, Shir,ley Hills Unit B as platted and approved by the Village
Council of the Village of Mound on August 26, 1924, and as originally
recorded in the office of the Register of Deeds of Hennepin County.
III.
Answers and alleges that paragraph III of the complaint is
incorrect because the City of Mound did not construct and does not
maintain boat docks along Edgewater Drive or on or over the plaintiffs'
property. The defendant does not lease docks along Edgewater Drive
but does issue Dock Permits and licenses pursuant to Sections 26.93,
26.9301, 26~9302, 26.9303, 26.9304 and 26.9305 of the City Code of
Ordinances and Chapter 412, ~,linnesota Statutes, 1978.
IV.
The allegations of paragraphs IV and ~ of the complaint are
denied.
V.
Further the defendant specifically alleges that the plat of
Shirley Hills Unit B as recorded in August 1924 is the "mother': plat
for the Wilbur K. Palm Addition as recorded December 15, 1949; that
the Wilbur Ko Palm subdivision of Block 8, Shirley Hills Unit B
could nog subdivide more property than was contained in the original
platting of Block 8 as shown on the plat of Shirley Hills Unit B
and could not and did not remove any of the rights of the public to
access to Emerald Lake as shown along Edgewater Drive on the plat of
Shirley Hills Unit B; that the survey contained in the plat of
Wilbur K. Palm Ad. dition included, land. not in the "mother" plat and
is' erroneous and. the correct legal theory is that this property is
governed by a "water boundary" 'and that the lots in the Wilbur K.
Palm Addition do not have a definite boundary abutting Emerald
Lake but rather expand or contract with the water level of said
Emerald~ Lake; that the defend, ant regulates and licenses private docks
along public areas within the City and. has a separate licensing
provision for commercial docks, the docks abutting Edgewater Drive
.and located on Emerald Lake are not com~.ercial docks and that said.
d. ocks have been located along this street for at least 45 years; that
the City 'of Mound claims for the public all rights of way as
dedicated to the public by the plat of Shirley Hills Unit B and
as used by the public since the 1930s.
VI.
Alleges affirmatively that the plaintiff is estopped~ from
claiming title to these public waters and public street; that if
they or their predecessors in title had any rights to said lands or
public waters they have been guilty of laches in not determining said
rights, have known that licenses and permits for said private docks
have been issued for many years and have waive¢~ any rights 'they may
now have to restrict said use by the defendant and the public; that
said lands are also needed and used by the public to dispose
of storm waters.
WHEREFORE, defend, ant prays j. udgment for the defendant in
this action and.. for its costs and disbursements herein.
