Dear Mr. Kopp:
Enclosed is a letter from Hardrives, Inc. requesting that
the City reconsider their request for a reduction in retainage.
Their calculations show that they have completed 90% of the work
on the original contract, and therefore are eligible for.a reduction
in retainage.
The original contract of $2,236,517.65 with Hardrives will
probably underrun, partly because the street, sewer and water on
Kildare Lane was deleted from the project and also because there was
considerably less subgrade correction required than anticipated.
If you have any questions on this or need further information,
please advise.

As you know, we have requested a reduction of the ten per-cent retainage
of monies due us on this Project. We understand that the City Council has
indicated their approval, but feel that there are legal reasons why they
cannot release this money; the biggest being the amount of completion on
the Project.
Our original contract amount was $2,236,517.65. As of payment request
number seven (7) for December 1979, work completed was $1,832,430.37. In
reviewing the work remaining, we have calculated the dollar amount to be as

SUBJECT: Addendum to C.M. 80-61 Fire-Department Salaries
There were two things not mentioned in Council Memorandum 80-61 that
should be in order to clarify the proposals as presented.
The monies needed to pay the additional salaries for fire
fighting will come from the existing Fire Department Budget.
Additional funds required for the increase in the Pension
Fund will come from the General Fund non-budgeted money.
Added cost for the Pension Fund will be as follows:

Dear Larry:
Pursuant to the meeting held on February 4, 1980 between you as
Business Agent, Ray Tharalson, Union Steward, Leonard Kopp, City
Manager, Sgt. Bill Hudson, Acting Chief of Police for the City of
Mound, and. myself as City Attorney, I have prepared, a proposed
stipulation to resolve the grievance of Officer Ronald Bostrom.
I am enclosing herewith four copies of the agreement and request
that three of those copies be executed by you and Officer Ronald
Bostrom and. transmitted to Leonard Kopp for his signature. He
will then send. you one executed copy and will send. one executed
copy to me, keeping one executed, copy in the files of the City of
Hound. I hope that you find that the stipulation accurately
reflects the facts and the manner in which we have resolved this
grievance.
I do feel that it would be advantageous at this time to resta~.e
several of the other questions which came up at our meeting of
February 4 and. which apparently are continuing problems between
your union men~ers and. the administration of the City of ~_ound~. '
First, Officer Ronald Bostrom has now been reassigned to the patrol
division effective January 21, 1980 due to the manpower shortage
within the department. I assure you ah this time that %his reassign-
ment had absolutely nothing to do with the grievance or the manner
in which it was settled and relates strictly to the manpower shortage.
I am very hopeful that Officer Bostrom will continue his discussions
with the police administration regarding his performance in the

position of Investigator/Juvenile Officer. We have entered, into
this settlement with the specific understanding that Mr. Bostrom
is not required to meet any standards which may be prepared, for
that position but with the understanding that the purposes and
goals of the position will have to be met by Officer Bostrom or
anyone else who eventually serves in the position.
On October 2, 1979 when you and. Leonard and I met in my office, we
also indicated, that the City will be preparing standards which will
include testing for the position of Investigator and we will further
recommend, that if there is ever a change in the personnel serving
as Investigator/Juvenile Officer, that standards and testing be
prepared for that~position. The administration will also be estab-
lishing for both the Investigator and the Investigator/Juvenile
Officer position, purposes and goals which anyone serving in those
positions will be expected to meet.
I speak for Mr. Kopp and I believe for other members of the police
administration, that personalities are not the main question which
should be considered in these job assignments, but that we all have
a responsibility to find the best personnel for each of those jobs.
I have cautioned the police administration that in attempting to
obtain the best people for the position the City is still bound in
all respects to abide by the terms of the contract entered into by
the City and your union and their attention has been drawn to
Section 9.4 which reads as follows:
"Senior employees will be given preference with
regard to transfer, job classification assign-
ments and promotion when the relevant job
qualifications' o'f employees are e~ua_ _ ~. 1."
The evaluation of personnel is difficult in all cases, but that is
the reason Mr. Kopp and 'I have stressed that standards' be
established so that in determining if employees qualifications are
equal, there is a bench mark against which that determination can
be made.
The other question which was raised at the February 4 meeting related
to contact between members of your union and, members of the City
Council. I have tried, to give the same advice to members of the
Police Department that I have given to the City Council. Under the

provisions of Minnesota Statutes Section 412.661, the form of
government is designed to limit the council from becoming involved
in any way in the administration of any City department~ In part,
that section of the law states:
"Except for the purpose of inquiry, the council'
and its memDers shall d_eal with and control the
administrative service solely through the manager,
and neither the council nor any of the mer~ers
shall give orders to any subord~inate of the manager,
either publicly or privately."
The law is written to place the prohibition against the council and
its members, but by implication the law would~ be violated, if employees
contact members of the City Council without going through the City
Manager. I think you and your members can See in the long run that
with professional ad. ministration the statutory city plan B form of
government can only operate successfully if these statutory provisions
are followed, n6t Only by the City Council but by the City employees.
The City employee certainly benefits by knowing the persons to whom
they are responsible and_ not worrying about political involvement
or intrusion of political favoritism, and I am sure in your meetings
with your men, ers you will stress this point.
In conclusion, I want to thank you personally for the manner in which
you have conducted these negotiations and~ I believe that you and
Officer Tharalson do. have the best interests of the City at heart,
and hopefully we have accomplished something in our discussions'
in our recent meetings

STIPULATION OF ~GREEMENT
WHEREAS, Minnesota Teamsters Public and_ Law Enforcement
Employees Union, Local No. 320 filed a grievance relating to the
reassignment of Officer Ronald Bostrom from the position of
Investigator/Juvenile Officer to the position of Patrol' Officer
with a salary 'cut of $100 per month, and said reassignment was alleged
to be a violation of Section 9.4, the seniority provision, and Section
10.1D, the discrimination provision, which provides that demotions
may be made for just cause only, and the union asked for reinstate-
ment of Officer Bostrom as Investigator/Juvenile Officer with back
pay in the amount of $100 per month since the alleged demotion, and
WHEREAS, the Mound City Manager, Leonard Kopp, did on
July 27, 1979 deny the grievance of Officer Bostrom, and
WHEREAS, subsequent to that denial, negotiations have been
held. between the parties in an effort to resolve this grievance,
the parties, namely Officer Ronald Bostrom, the City of Mound and
Teamsters Local No. 320, have agreed to a complete and final settle-
ment of the grievance;
NOW, THEREFORE, IT IS STIPULATED AND AGREED by and between
the parties as follows:
1. Officer Ronald Bostrom shall be reinstated in the
position of Investigator/Juvenile 'Officer as of September 3, 1979.
2. Officer Ronald Bostrom agrees to waive any claim he
may have for the $100 per month extra pay called for by the contract
for that position for the period of March to September of 1979.
3. Purposes and goals for the position of Investigator/
Juvenile Officer shall be established and Officer Bostrom will be
expected to meet those goals, but the City is agreeing that Officer
Bostrom will not have to test to remain in the position of Investi-
gator/Juveni le Officer.
4. Upon execution of this Stipulation.and Agreement, the
grievance of Ronald. Bostrom is hereby determined to be settled by
agreement of the parties.

Mr. Hubert Sarrazin, vice president of Mickelson Media, Inc. of New Ulm appeared
before the Council to describe cable television potential for the City of Mound.
Ulrick moved and Lovaasen s.econded'a motion to express interest in cable tele-
vision and further examine the procedures to implement a service area of the lake
area communities. The vote was unanimously in favor.

The Planning Commission recommended dividing the three lots into two
building sites as requested:

Parcel 2 - Lot 5 and the westerly 30 feet of Lot 4 - 8,746 sq. ft.
There are no deficient assessments. The three lots were charged.2 sewer
units and 160 front feet.

Present were: Chairman Russell Peterson, Commissioners Harriet Dewey, Steve
Dornsbach, Gary Paulsen, Lorraine Jackson, George Stannard and Gerald Smith;
Council Representative Robert Polson; City Manager Leonard L. Kopp; City
Inspector Henry Truelsen and Secretary Marjorie Stutsman.
The Chairman welcomed the new Planning Commission Member, Steve Dornsbach,
and new Council Representative to the Planning Commission, Robert Polston.
MINUTES
The minutes of the Planning Commission meeting of January 14, 1980 were pre-
sented for consideration. Jackson moved and Paulsen seconded a motion to
approve the minutes as presented. The vote was unanimously in favor.

This subdivision is not the most favorable inasmuch as Parcel 1 will be an
undersized lot by 1,254 sq feet. However, Parcel 2 would meet requirements
of municipal zoning and would be a favorable lot for new construction and
inasmuch as the existing structure on Parcel I meets the setback require-
ments of the zoning (A-I, 10,000 sq. ft.) of that area and. there is adequate
area to build adequate size garage on property I feel this subdivision could
be granted on the basis.of no variances other than the undersized lot §i~ze.
Joseph F. Detling
This subdivision was befor'e the Planning Commission and City Council in 1977
and was approved. The applicant failed to properly record the subdivision
with the County and since the year termination is involved it is necessary
for him to reappear before the Commission and Council for reapproval. The
square footage is adequate for the zoning (A-I) and there is no apparent need
for any variances I feel it is favorabl.~ to once again approve the subdivision.

Attached is the proposal from Steven's Well with a price for finding out the
problem.
Mr. Elmer Korn would like to be at the meeting to give the proposal for McCarthy
Well Co. For some reason the gig well companies just don't want to put anything
in writing.
Bergerson - Caswell states they.will bring Well ~6 back into the AWWA standards
for minimum amount of sand for a price of $9,000.00, not including any'parts
which may be necessary. Their representative 1~. Bob Listerberger stated this
verbally but also stated that if we go out for written bids to forget it. They
will not put what they are going to do dm;n in wri%in§.
I will invite Tom Steven from~Steven's Well to be at this meeting also.

This sand would have to be entering the well through a hole in the
casing, past the lead packer or through the screen. The 20" cas-
ing should not have any holes since 'it was new 3 years ago. If the
packer was not properly swedged, it should have leaked long ago.
That leaves the stainless steel well screen.
The screen is 33 feet long setting between 141' and 174'. The top
10' is ~20 slot (finer) and the bottom 23' is~r~0 slot (coarser)
The slot alignment and sand size creates a dangerous situation in
this well. If sand has been coming from the bottom 23' of forma-

Dear Mr. Kopp:
'As requested, we submit the following study of the feasibility and
cost of installing a storm sewer and placing fill in Brookton Park in order
to eliminate the existing ditch around the park.
The ditch drains a watershed of 31 acres and outlets to a 30 inch
pipe at Clover Circle and Willow Road which drains to Dutch Lake. The
1980 Street Improvement Preliminary Engineering Report shows that five
separate storm sewers will outlet into the ditch.
The construction of these storm sewers and the street improvements
in the area will not significantly increase the total runoff through the
ditch but will increase the peak flow.
The attached drawing shows a proposed storm sewer and grading plan
for the park. The storm sewer would pick up all the existing and
proposed pipes which drain into the ditch. The grading would consist
of filling the entire park to a level where it would drain by surface
drainage to the surrounding streets. The ditch around the park would
be eliminated.
The amount of fill required to grade the park as shown is 17,400
cubic yards. This is roughly 1/2 of the fill that will be available
from the 1980 Street Construction. We would recommend that if the storm
sewer and grading is done that this work, as well as placing black dirt
and seeding the park after the fill is placed, be done as a part of the
1980 Street Improvements. The Contractor could remove and stockpile
Minneapolis - Hutchinson - Alexandria - Granite Falls
the existing black dirt on the site and respread it after the grading
is completed. The entire work could be completed in one construction
season.
The cost of the storm sewer is $40,100 and of the park grading
and seeding is $24,500. A detailed breakdown of the costs is attached.
If this work is to be done it should be done with the 1980 Street
Construction to take advantage of the free fill available.

The City has been receiving about $9,000 annually for maintenance funds
from M.S.A. If M.S.A. bond are issued, only M.S.A. funds can be used to
pay the interest and the only way we can get an increase in maintenance
funds is to show an increase in maintenance cost. Attached is a copy of
a letter outlining the maintenance cost problem which we recommend sending
to M.S.A.
In order to send the let. ter, the Council should pass a resolution authori-

The maintenance allottment from the 1980 MSA funds is $9,870 per year.
I have talked with Bob Shanley, Mound's Public Works Director and it
is our recommendation that the City establish a regular annual program for
maintenance of the bituminous streets in the City including seal coating
of the streets on a 4 or 5 year rotating basis.
The City has 133,000 square yards of bituminous surfaced streets on the
MSA system of which 87,600 square yards are on streets improved to MSA stand-
ards or scheduled for improvement in 1980. At 35¢ per square yard and on a
5 year rotating basis the annual cost of the seal coat program on the MSA
system is $9,300.
Some of the older improved MSA streets such as Tuxedo from County Road
125 to Clyde Road need extenSive maintenance work on settled areas and curb
repair. Other streets such as Wilshire Boulevard were improved as long as
18 years ago and increased maintenance, such as, concrete curb and gutter
repair can be anticipated in the coming years on these streets.
In addition to the increased maintenance costs generated by regular
annual maintenance programs the costs of routine maintenance has increased
much faster than the annual maintenance allottment.

WAGES FOR FIREFIGHTERS AND ESTABLIGHING
A THREE YEAR PAY PROGRAM FOR THE ~MOUND
FI RE DEPARTMENT
WHEREAS, the City currently is paying Mound firefighters
the sum of $3.50 per hour as a wage for responding to fire calls
and is contributing approximately $3. 30 per hour to the Mound Fire
Relief Fund for a total of approximately $6.80 per hour, and \~
WHEREAS, members of the ~ound Fire Department have
indicated to the City Council that they are desirous of an increase
in the wa~.es paid for responding to fire calls, and
?.~4EREAS, the 1980 budget has been adopted and the City
Council is limited in its ability to respond to the request of the
fire fighters, and
WHEREAS, discussions have been held between the City
Manager, City Council and members of the Mound Fire Department and-
a proposed plan has been reviewed in great detail and a proposal
for compensating Mound .firefighters has been discussed and agreed
upon by the Council and the members of the Mound Fire Department, and.
WHEREAS, the proposed wage and benefit plan is an effort
by the Mound City Council to tie the hourly wages and pension con-
tribution of the City to a standard which can be applied in the year
1980 and the years 1981 and 1982, and
WHEREAS, it is determined that Mound firefighters will be
compensated, through hourly wages and pension contributions in a sum
which, will be equivalent to what the City pays a maintenance man,
and
WHEREAS, the maintenance man's hourly wage in the year 1980
is $8.50 per hour and i.t is determined that the fireman's hourly
wages will be increased, in four steps through the year 1980 so that
by October 1, 1980 the hourly wages will be equivalent to 60% of the
maintenance man's hourly wage of $8.50 per hour and the City will
contribute 40% of $8.50 an hour for pension benefits for the Mound
fi re fighters;
NOW, THEP. EFORE, BE IT RESOLVED by the City Council of the
City of Mound, Minnesota:
1. Firefighter wages for responding to fire calls in the
City of Mound shall be as follows:
January 1, 1980

2. In the ca-lendar years 1981. and 1982 firefighters'

3. In the calendar year 1980 the City of Mound will
contribute 40% of $8.50, or $3.40, to the Fire Relief Pension Fund.
The estimated hours for the year 1980 are 7500 hours times $3.40,
or a total City contribution of $25,509. In addition thereto the
2% fire insurance refund to the City will be contributed to the
relief fund and this is estimated at $23,000. The total contribu-
tion to the pension fund in the year 1980 will be the composite
of 7500 hours times $3.40 per hour plus the 2% fire insurance
money s.
4. Contributions to the fire relief pension for the year
1981 shall be based on 7700 hours times 40% of the maintenance man's
hourly wage plus the 2% fire insurance funds.
5. Contributions to the fire relief pension for the year
1982 shall be 40% of the maintenance man's hourly wage times 7900
hours plus the 2% fire insurance moneYs.
6. This resolution and the aforedescribed pay plan shall
be retroactive to January 1, 1980 and a copy of this resolution shall
be signed by representatives of the Mound firefighters indicating
their willingness to.accept and abid~e by the aforedescribed pay
program for the years 1980, 1981 and 1982.

SUBJECT: Infiltration Study Sewer Lines
The Metropolitan Waste Control Commission has been conducting an
Infiltration/Inflow Assessment of the sewerage systems in the South-
west District.
They have determined that "All communities certified as having non-
excessive Infiltration/Inflow will not qualify for further funding
or analysis.

An assessment of the infiltration and inflow (I/I) rates was undertaken
for each of the 27 communities in the Southwest Study Area. The results
of these assessments were reported in an Interim Report, "Analysis of
Community Flows", which is on file with the MWCC. Based on these assess-
ments, evaluation of the impact that I/I has on MWCC facilities, and the
Minnesota Pollution Control Agency (MPCA) review, several communities
are recommended for further study.
The recommended action for each community is presented in Table 1. For
the three communities in Service Area Five and seven communities in Service
Area Four, no further study is recommended, but is recommended that the on-
goinq local programs to reduce I/I be continued. Pattern Interviews are
recommended for six of the communities in Service Area Four to further
determine the extent of local problems and the potential to eliminate sources
of I/I. Sufficient data are available to recommend conduct of an I/I analysis
with local flow monitoring for eleven other communities in Service Area Four.
IThe communities of Bloominaton, Eagan, Burnsville, Prior Lake', Eden Prairie,
Excelsior, Minnetonka, Min~etonka ~each and Mound were found to have peak
weekly infiltratibn rates of less than 1,500 gpd/inch diameter/mile. These
infiltration rates are indicative that the I/I is not exessive. The community
of Long Lake has previously conducted an I/I analysis subsequently certified
by MPCA as non-excessive. Inflow appears to be the result of storm water in-
trusion through man-hole covers and rings, but this infrequent ~ccur~ence.~'~l
become more infrequent as these communities improve local stormwater drainage
systems.
Pattern Interviews
Pattern interviews are recommended for those communities for which insufficient
information was available through this study to judge the potential for cost-
effectively reducing I/I. For Greenwood and Minnetrista, there are insufficient
flow data to estiamte the magnitude of I/I throughout these collection systems.
Interviews conducted with local representatives of these two communities were not
of sufficient detail to preclude the need for further study of these communities.
The assessment of I/I for Deephaven, Spring Park, St. Bonifaciou$, and Wacofiia
indicated that conduct of pattern interviews, were warcanted to' better define local
problems and the potential to reduce I/I. The I/I in Deephaven appears to be
quite low, but information presented at a public meeting indicates local problems
exist. Pattern interviews are recommended for Spring Park, Waconia and St.
Bonifacius to focus on inflow problems and the potential of reducing I/I.
Waconia has completed a program to reduce I/I but flow records indicate that I/I
remains to be a significant problem. The patten interview should address the
potential for futher reduction of I/I.

SUBJECT: Cable TV
There are some decisions to be made on Cable TV such as:
1. How much territory should we ask for iF Mound goes
alone?
2. Should we join with other communities?
All of the above have various ramifications.
There is a Cable Television Information Center that I would recommend
the City joining. The annual cost for a City under 25,000 population
is $200 per year.
if there is no objection from the Council, the City will subscribe to
the service.
