enactment of that Chapter, the City was limited to charging

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section !. Minnesota Statutes 1978, Section 340.11, Subdivision 1 i, is amended to
read:
Subd. i I, ON-SALE LICENSES, INCLUDING ltOTELS, CLUBS,
RESTAURANTS, AND ON-SALE EXCLUSIVE LIQUOR STORES. "On-sale" licenses
may be issued by municipalities for the sale of intoxicating liquors in hotels, clubs,
restaurants and establishments for the sale of "on-sale" liquors exclusively within the
number authorized by this section. Except in a city of the first class and in addition to the
number of licenses authorized by this section, an "on-sale" license may be issued, if
approved by the commissioner of public safety, to a bona fide club which has been in
existence for 15 years or more or to a congressionally chartered veterans' organization
which has been in existence for I0 years. Such a club or veterans' organization shall be
incorporated in order to be eligible to apply for a license, and the license issued shall be
for the sale of intoxicating liquors to members and bona fide guests only. The license fee
for such an "on-sale" license issued, by a__ municipality pursuant to this subdivision is $100
unless the municipality sets a_ high. er amount. Except in cities of the first, second, and
third class, a license may be issued jointly to congressionally chartered veterans'
organizations which otherwise qualify under this subdivision.

SUBJECT: Easement - 1980 Streets
The Engineer has recommended that the storm water from Glenwood
Road and Oaklawn Lane be dumped into Lot 59, Auditor's Subdivision
168, which is what is commonly.referred to as the swamp in the High-
lands and has suggested we get an easement from the owner and not
assess the swampland for the streets.
The attached map shows in yellow an estimate of the swamp area.
Mrs. Priscilla Anderson has indicated she will sign the easement
and would like to see this area remain a swamp for all time.
If the Council agrees with the Engineer's recommendation, we will
ask the Attorney to draw up the easement.

Storm sewers are designed to carry the runoff from a 10
year rain, that is, the pipes are sized to handle the heaviest
rain that is expected to occur in a 10 year period. When a
heavier rain than this occurs some backup of water in the streets
and low lying areas will occur temporarily. In this project area
nearly all of the areas involved have a natural overflow, that
is if the storm sewer for any reason could not handle the runoff,
the surplus flow would go Overland to a wetland or lake, before
any.houses would be flooded. '~

SUBJECT: Water Rate Study
Attached hereto is a copy of the revised figures on the water rate study
as requested by the City Council.
Three alternatives are presented; each of which raises more money than
the proposed rates.
There are 2,819 residential customers and 67 industrial-commercial
accounts. If alternate number three were used and the Council retained
the $6.00 minimum; at $4 per year a reduction of $11,276 would be the
result leaving an estimated income Of $318,324.00
By keeping the $6.00 minimum, it would be aiding the consumer (especi-
ally the senior citizens) who constantly use less than the minimum.
This will be listed for discussion on February 5th.

This Table No. 2 clearly indicates that the additional revenue
produced in the three (3) alternates proposed by the City is
derived from Tonka Toys. Using alternate 3, Tonka Toys yearly
water bill would increase 59.4 percent from approximately $108,000
to $172,000.

The Council pass a resolution requesting the County to include
the construction of the connection over the Black Lake Bridge
when the bridge is constructed or if the County does not wish
to do this, they direct Hickok and Associates to prepare plans
and specifications to construct the interconnection when the

The Planning Commission on November 12, 1979 recommended the division

The Planning Commission minutes read: "that lots be so divided that

Recycling Spots
As requested by Councilman Polston in December we have investigated the
possibility of a recycling spot in Mound. The follow~n9 report is broken down
into sections by material.
1. Glass bottles and jars, Requirements are that they be thoroughly
rinsed. Remove all metal caps and rings. Sort by color - brown~ green
or clear.
These would have to be separated in barrels or containers. Companies
accepting this material will not furnish them and will send out a truck
only when you have enough to fill it.
Also it is required by P CA ' and EPA that this material be kept in a
buildin§ and not at random outside. They are currently forcing two private
recycling organizations to shut down unless they move inside.
About five years,,~ago:the BtYScouts and Girl Scouts in Mound tried this using
-different barrels across from the Post Office. Numerous problems .arose from
this effort. Scouts were on hand during the day to sort and check the glass.
When they left at night vandals moved in and smashed numerous bottles all over
the parking lot. Needless to say we never tried this venture again.
2. Cans - requirements are that they be rinsed and remove all paper labels.
Remove both ends and flatten all cans. Ste~l cans must be separated from
aluminum,
One of the major problems here is that someone must be present to check
all requirements are met. Also this will take numerous containers before
a truckload is built up to be hauled away.
3. Newsprint - all bundles must be in grocery sacks or tied securely. Phone
books and computer cards and copy paper are acceptable, Magazines and catalogs
are not accepted,
I feel that it would be harmful to many non-profit organizations in this City
if we entered into this phase of recycling,

Almost every church, school group and Scout Troop has at least one paper drive
each year. Scout Troap 569 holds one every three months. They have used this
money for summer camp and special trips for the troop every year.: for the last
8 years. .It has enabled the parents of these Scouts to get by with a very
small cost or no", cost at all if they couldn't pay.
Because of this recycling no boy has ever had to miss a camping trip'for the lack
of funds.
It would be very hard to come up with a cost for operation as it would depend on
how long the area would be kept open and how many days. A large amount of containers
for the various items would have to be obtained. If drop box containers are used
such as the ones Tonka uses they run at the following rates. $15.00 to drop
container¢ $125.00 to pick up and haul away,starting the third day an additional
$5.00 per day is charged.
At least one person must be present at all time that the area is open.
The Public Works Department can see no leasable way to run this operation without
great expense being encountered.

WHEREAS, Lake Minnetonka is a priceless natural resource
and recreational area of metropolitan significance, and
WHEREAS,f.'the value of..~Lake Minnetonka as a natural resource
an,d recreational area~and the ~.~uality of ~[fe in thi~' area may/best
be~preSe~ed by.directing commuter, traffi~d around and awav fr~m the
shores of ~ak~_{innetonka, and ~ " '
WHEREAS, the Hennepin County Board of Commissioners and
Hennepin County Highway Department were requested by the City of Orono
by resolution dated March 9, 1970 to undertake the development of plans
to provide alternative routes for the west Lake Minnetonka communities
to travel south to Highway 7 and north to Highway 12 to serve as a
circumference highway as an alternative to upgrading Highway 15 to a
four-lane highway, and
WHEREAS, the Hennepin Count}f Hiqhwa)z Department did undertake
such a study entitled Hennepin County Transportation System Study,
dated December, 1975, showing such circumference highways, and
WHEREAS, segments of the north bound alternative route to
Highway 12 were placed on the Hennepin County five-year capital improve-
ments program and subsequently dropped from the Hennepin County five-
year capital improvements program, and
WHEREAS, the City of Orono has constructed a diagonal route
from the corners of County Roads 19 and 84 to the intersection of
County Road 6 and Watertown Road as an alternative to the County's
proposals which h. ad been dropped from the Hennepin County five-year
capital improvements program, and
WHEREAS, th'e Hennepin County Highway Department is no~ proposing
upgrading County Road 15 from the City o~ }{ound to the intersection of
County Road 19 in Navarre to a four-lane undivided highway.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of Orono request the following action:
/~. That the Hennepin County Board of Commissioners and the ~
/Hennepin County Highway Department be requested to design and'~
/ construct a new di~on~l two-lane undivided street from the ~

It is recommended the City take the 20 feet for street purposes and allow
the balance be put on sale.
It is calculated the lots have 20,953 square feet prior to taking the 20
feet. After taking 20 feet, they should have ]3,825 square feet. The area
is zoned Residential B, which means there is enough room for a duplex or two
.single family homes. The Engineer is drawing a sketch of how this property
can be divided.
It is recommended the Council authorize the Mayor and Manager to request for
street and utility purposes the south 20 feet of Lots 19, 20 and 21, Abraham
Lincoln Addition to Lakeside Park and that the remainder be authorized for
sale.

SUBJECT: Addendum to C.M. 80-38 - Tax Forfeit Land
The Engineer attempted to divide what was left in Lots 18, 19, 20 and 21
after taking 20 feet for Lynwood Boulevard and found that because of the
setbacks, it would be difficult to build on them.
The land is zoned Residential B and a duplex could be built on the remain-
ing land as shown on the attached sketch.
The attached drawings show how the land can be divided or how to build a
duplex on the entire piece that is left.
It is recommended that the County be requested to put the remaining land
on sale as one parcel.

Present were: Mayor Kohman and City'Clerk Bren of St. Bonifacius, Mayor
Rockvam and Administrator Osmonson of Spring Park and Mayor Lovaasen and
City Manager Kopp of Mound.
Mayor Lovaasen opened the meeting at 7:50 p.m.
Mayor Rockvam suggested' policing on a joint powers agreement and said that
Spring Park was studying many alternatives. But what Spring Park was inter-
ested in was:
1. More imput in the budget.
2. More preventive patrol.
Clerk Bren stated that their resolution of cancellation was copied from
Minnetrista and that St. Bonifacius was interested in more bar patrol and
more patrol service.
Mayor Lovaasen went over the Minnetrista resolution point by point and made
some suggestions of what he would like to see in a joint powers contract.
Mayor Rockvam suggested a joint poWers agreement be drawn up for discussion
at a future meeting.
It was agreed that the next meeting be held on March 5, 1980 at 7:30 p.m.

'Dear Mr. Kopp:
We have received numerous inquiries as to when lot corners
taken out by construction would be replaced on the 1978, 1979,
and Tuxedo Road projects. Those corners which we found before
or during construction were tied off to their existing location.
We have been replacing them when requested by the owner. As
per our discussion, we will begin replacing all corners that
we have tied off. In a few cases, these would end up in the
gutter or blacktop and when this occurs, we will be setting
them one foot behind the curb.
We plan on having all corners replaced on the completed
portions of these projects by May 31, 1980.

Watermain Replacement

Dear Mr. Herzog:
We are enclosing for your review plan sheets showing the location of
the proposed watermain replacement on CSAH 110 between Lynwood Boulevard
and Grandview Boulevard. It is intended that the new 10" main will replace
the existing 6" main at its present location except between Lynnwood
Boulevard and Alder Road where a slight relocation is necessary to
eliminate a conflict with the existing 6" gas main. All existing hydrants
in this area will be removed and replaced at a location one foot inside
the new County right-of-way line.
As was requested, we looked at the possibility of relocating the'main
5 feet inside the easterly right-of-way line. Locating the main here will
cause many problems which would not be encountered at our proposed location.
A list of some of the more obvious problems follows.
This location will require working under existing overhead power lines
and the relocation or holding of power poles during construction.
The concrete planters in front of the medical clinic at Lynwood along
with the vegetation in the planters and the decorative light standard will
have to be removed and replaced.
Additional bituminous parking surface and concrete sidewalk in front
of the businesses at Lynwood will require removal and replacement.
A portion of the concrete retaining wall at Bethel Methodist Church
will have to be removed and replaced.

The wooden pedestrian bridge to the residence at 2044 Commerce Boulevard
will have to be dismantled and rebuilt.
It will be necessary to operate heavy excavation and compaction equip-
ment in close proximity to the existing buildings along the roadway. This
could lead to possible damage claims.
Approximately 12 good size trees which would otherwise be preserved will
be removed.
A portion of the wooden retaining wall at the apartments at 2020 Commerce
Boulevard will have to be removed and rep]aced.
Temporary construction easements will have to be obtained from the
property owners along the roadway.
Locating the existing water services for the buildings situated on the
west side of the roadway and extending them under the existing 6" gas main
will be a time consuming and costly operation. This would not be necessary
with our proposed alignment as these services would be found and reconnected
to the new main in the course of the mainline construction.
The above mentioned items will add substantially to the cost of the
project as well as increase the amount of inconvenience to the adjacent
property owners." For this reason we have chosen the alignment shown on the
plan sheets.

Gentlemen:
Pursuant to information I have received from Mr. Truelsen,
Building Inspector for the city of Mound - it is my understanding that on
February 19th - a hearing will be held regarding a special use permit for
either a yacht club or a racquet club at the Bay Point Apartments/Condominiums.
As an owner of a competitive apartment project - specifically Lord
Fletcher Apartments, Spring Park - I would like to express my deep concern
and opposition to the granting of any commercial special use permits for
residentially zoned properties.
First of all, are you aware that for the past couple of months -
the Bay Point company has already been utilizing this apartment complex
(which is zoned for residential use) for commercial enterprises?
They have mailed on three different occasions - to each tenant within
my complex,advertisements, guest passes, etc. - to the so-called and I quote
"Bay Point Pool and Yacht Club" - for membership.
Now, it does not take anyone of any intelligence to see why they
are mailing these to all 86 of my tenants - they are merely utilizing this
so-called commercial enterprise as a "come-on" to pirate tenants.
According to the information and advertisements to the tenants within
our building - the membership dues include a one-time fee of $195.00 and
monthly dues of $20.00 and $25.00 each. This is blatant commercial utiliza-
tion of a residentially zoned property.
At the very least, I would ask that you put a "restraining order"
on the owners to stop advertisement of a club which they do not have, at

least at present, proper zoning or permits for this use and - would cer-
tainly hope that you would not give any consideration to rezoning or granting
of a special use permit for a commercial enterprise within a residentially
zoned district.

Cabs were inspected on 2-2-80 at 1700 hrs. Cab #25, a 1976 Chevrolet, lic. EKA138
passed muster, However, cab #43, a 1974 Ford, lic. AHZ775 was rejected for the
following reasons: the front tire showed excessive wear, the emergency brake did
not work properly, and the interior dome 1.ight was inoperative. The cab company
was informed that this vehicle was not to serve the Mound area until the necessary
repairs had been made and had been inspected by the Mound Police Dept.
