RE: Proposed LMC Building
Last year at the annual meeting, Mayor Black, LMC President, charged the LMC Building
Committee with bringing back a proposal for an LMC building to this year's convention.
After literally years of exploring existing buildings and negotiating with their owners,
all of which proved fruitless, the LMC Building Committee and the LMC Board concluded
that new construction was the only prudent alternative.
The City of St. Paul offered LMC a few potential sites at no cost. With these sites
in hand, the Building Committee interviewed and selected architects, the Architectural
Alliance East. The goal of the Building Committee was to build a new home for LMC
that would be energy efficient, economical to maintain and representative of municipal-
ities throughout the state.
The purpose of th~s memo is to inform you that the results of the Building Committee
and architect's work will be presented to the annual LMC meeting in Duluth. The proposed
building would be built using a tax-exempt revenue bond issue. The resulting costs on
a per square foot basis, would be about the median market rate in downtown St. Paul
today. However, because of LMC ownership and because of substantial savings through
energy conservation, this cost would remain stable while market rate rents are expected
to rise steadily.
Along with the building proposal, different payment or assessment schedules will be pre-
sented. The costs will be apportioned on the same basis proportionately that member
cities now pay dues. The costs, if they were to be Paid up-front on a lump sum basis,
would be about twice the annual dues paid by each member city.
The Building Committee has worked long and hard on this proposal, and in order that the
committee may share its information with member cities, a special session on the proposed
building will be held at the convention in Duluth. Then, whatever formal action might
be taken would take place at the annual meeting.

Representatives from the DNR will present an overview of the program
referred to in the May 16, 1980 letter.
As implied, this'will be an informational meeting. It is not the intent
of the County or DNR to debate with the municipalities or individuals as to
whether specific properties should or should not be classified as public
waters. There are subsequent procedures set up in the legislation to
deal with this activity during various time intervals.
These procedures will be outlined during the meeting.
We would like to have your comments, regarding the proposed public waters
listed in your municipality, directed to us by letter. We would like
this done prior to the meeting.

I made a visual observation and took the enclosed picture at
11:30 A.M. on 5-29-80 at the premises of Patzy D'Avia at 1665
Eagle Lane, Mound, Mn.
' :Circle #1, is construction material, sand for the mixing of concrete.
Circle #2, small pile of debris left over from the construction of his
addition.
Circle #3, is left over construction material,~ wood of which he intends
to and has been cutting up into adequate size for the use and burning in
his wood stove he has within his home.
The remainder of the '.yard on the premises appeared to be very clean.
I know that in the past, the~e has been complaints on numerous occasions
regarding this property and I am aware there has been an attempt to re-
pair this property and retain it in an orderly manner.
About an hour after taking the picture ! accidently met with the owner
of the premises, Mr. D'Avia and informed him I took the picture and
suggested that as soon as possible, preferably within the Next 15 days,
that he undertake to clear up the small pile of construction debris and
he assured me he would. I am certain he will comply with the request as
he has done so in the past.

Pursuant to due call and notice thereof, The Board of Review convened in the
Council Chambers of the City of Mound, Hennepin County, Minnesota at 5341
Maywood Road in said City on May 20, 1980 at 7:30 p.m.
Those present were: Mayor Tim Lovaasen, Councilmembers Robert Polston, Gordon
Swenson and Donald Ulrick. Also present were City Manager Leonard L. Kopp,
City Assessor Milt Hilk, City Engineer William McCombs and Acting City Clerk
Marjorie Stutsman.
Councilmember Benjamin Withhart was absent - had to attend another meeting.

The Council made the following recommendations.
SUBJECT RECOMMENDATION
Type of Contract Joint Power with one community operating Police Department-
operate under that agreement for 5 years, then review at end
of 5 years.
Name ~ Consider either "Mound-Westonka" or "Westonka"
Board Composition Two members each Council to discuss things - meet on de-
finite dates for their input. Each City should have the
level of service they want subject to budget limitations
and costs to be paid by each City.
Budget Budget to be reviewed by Committee prior to presenting with
recommendations for approval by the Mound Coucnil.
Level of service for each City to be determined annually.
A reduction in level of service for a City would require
two years notice.
Police Department should be a total department with the level
of service for all cities determined.
Division of Costs To be set by formula agreed to by all parties and approved
by the Mound Council.
Personnel Be responsible to one City, but when Police Chief is being
hired, receive input from all Communities and recommendations
for approval by the Mound Council.
Police Policy To be considered by Committee and recommended for approval
by the Mound Council.
Meeting Dates Bi-monthly starting JanuaryS81 (can be oftener if
desired).
Time Table We will have to have agreement from the Cities by
July i, 1980 on ~.~hether or not they wish to continue
with Police Service
OTHER MATTERS
Discussed parking in Black Lake Bridge area. Council requested a letter be
sent to the County regarding traffic and safety concerns.

SUBJECT: Northern Lane
Attached is a copy of a letter requesting "sticker parking" on that
part of Northern Lane that is only 20 feet wide.
After Northern Lane is improved, it will be a no parking street since
it is only 20 feet wide. The only way parking could be accommodated
is if someone leased property and constructed a parking lot on that
land.
The people from this area plan to appear before the Council June 3rd.

Section 1
Gentlemen:
Bids were opened Friday, May 30 for the Section 1 portion of the
1980 Street Construction. A tabulation of the bids is attached.
Buffalo Bituminous was low bidder at $1,648,803.50. The Engineer's
estimate for the work was $2,044.500, therefore the low bid is 19%
below the Engineer's estimate. For comparison purposes we applied the
1979 project unit prices to this project and come up with a total of
$1,769,400 or 7% above the low bid for this project.
Buffalo Bituminous constructed the streets in Shirley Hills Unit
B in 1977 and Tuxedo Road in 1978-1979. While the finish product on
both these projects was satisfactory, there was a delay on the
completion of Tuxedo Road due to a strike. Representatives of Buffalo
Bituminous. will be at the Council meeting Tuesday night to answer any
questions the Council may have regarding their ability to do this
construction.
We recommend that the contract for the Section 1, 1980 Street
Improvements be awarded to Buffalo Bituminous, Inc.
If you have any questions on this we will be pleased to discuss
this further with you at your convenience.

We have also looked at the proposed assessments to the apartments on
Grandview and Commerce Boulevard. Under the existing policy, the assessment for
the 88 apartments here would be computed as follows:
Units - 88 units $ 2 = 44 (County Road frontage reduces units by one half.
44 x 3/4 = 33 units (apartments get 3/4 unit each)
Footage - actual footage is 260 1.f.
Area - One half area (County Road frontage) is 63,700 s.f.
Assessment - 33 units ~ 2230 = 73,590

63,700 s.f. ~ 0.13 = 8,281

We would suggest that the City Council discuss proposed assessment policy
changes at a meeting sometime in the near future. While the final decision on
policy will not be needed for a while, the'staff is getting a lot of inquiries
on pending assessments and it is important that accurate information be
available as some mortgage companies are requiring two times the pending
assessment be put in escrow when a property is sold.

Re: Tree Removal Bids
Dear Len:
This will acknowledge receipt of your note of
May 27, 1980. I have reviewed the two proposals for tree
removal as submitted. After reviewing these two proposals,
it would be my opinion that the Lutz Tree Service, Inc.
proposal is not consistent with the City solicitation for
bids and it should be disregarded. If I understand what Mr.
Lutz has written on the back of his proposal, it is that he
is in effect modifying the proposal by bidding nothing on a
certain group of trees. He also goes on to in effect enter
objections/ in advance indicating that if the City crews
remove a Certain number of trees, he will create a scene.
I do not believe his proposal is.'consistent with our request
and I cannot imagine a court approving or interpreting his
bid to mean that a tree 31.9 inches in diameter would cost
the City $429 to remove, but a tree 35.9 inches in diameter
would be removed free.
The total estimated bid price is not a base line
on which to award the contract where one of the persons making
a proposal has eliminated the unit extension for 80 trees. If
Mr. Lutz had wanted, to submit this kind of bid., he should have
'bid $1.00, $5.00 or some nominal amount on that series of trees,
but by bidding zero, I believe the whole bid could_ be contested
and. should, be thrown out.
It is my recommendation that the bid be awarded to
Eager Beaver Tree Removal where a unit price has been established
for each tree and where ~he proposals have not been in effect
conditioned by a long letter attached to the bid.

SUBJECT: Police Contracts
At the last Police meeting, the contracting Communities indicated
they were receptive to the outline of conditions the Mound Council
had offered (see copy attached).
Minnetrista-St. Bonifacius asked that they be assigned 5 patrolmen
between them and Spring Park asked for two men - 16 hours per day
plus general coverage the other 8 hours.
Based on that, the Police Chief has outlined a schedule and manpower
needs as pointed out on Plan B (copy attached).
Based on the plan, a schedule of costs with alternatives was presented
to Administrators when they met on Wednesday.
The Administrators accepted the Recommended Alternate No. 3 and asked
if all ~ities would ask their Councils to tentatively approve or dis-
approve as quickly as possible so each City could embark on final
approval.
Alternat~ No. 3 is recommended, but it is to be pointed out these
additional costs are based on 1980 budget figures so they will be
higher for 1981.

The Petitioner herein has an estate, right, title or
interest in or lien upon the real estate involved in this

The real estate involved in this Petition and the
assessment of which the Petitioner is protesting is.described
and designated in the tax statement or statements or other

The real estate described in Exhibit "A" is located in

The Petitioner has been discriminated against in the
assessment of its property as compared to other real property

The real estate herein concerned was not assessed

of Minnesota Statutes, of certain real property in th'% taxing
district herein concerned are contrary to the requirement of
uniformity, due process and equal protection of the law
required under the Fourteenth Amendment of the Constitution
of the United States, Section 7 of Article I and Section 1 of
Article X of the Constitution of the State of Minnesota,
causing the real estate taxes on Petitioner's real estate
payable in 1979 to be unlaWfully high.
VII.

poses of taxation under Chapter 273 of Minnesota Statutes
and/or other statutes, of certain real property in the taxing
district herein concerned are contrary to the requirements of
uniformity, due process and equal protection of the law
required under the Fourtheen Amendment of the Constitution of
the United States, Section 7 and Article I and Section 1 of
Article X of the Constitution of the State of Minnesota,
causing discrimination against Petitioner and the taxation of

INFORMATION MEMORANDUM NO. 80-50
SUBJECT: Boathouse - Phelps Island Park 1st Division
On December llth, the Council denied a variance for work on a
boathouse located on the private street near Lots 55 and 56,
Phelps Island Park 1st Division and further directed that the
building be removed by May 15th.
The building was not removed and the Manager requested informa-
tion from the Attorney on how we should proceed to remove the
structure.
The Attorney talked to the owner and the owner has asked his
brother, an attorney, to help him fight the City. Mr. Pearson
asked how much does the City wish to spend on this proceedings.

WHEREAS, Chapter 462 o{- the Minnesota Statutes authorizes the
City Council with the aid and assistance of the City Planning
Commission to c~rry out municipal planning activities which
guide and .control development and improvements within the comm.,unity,

WHEREAS, the City has ac/opted a zoning ordinance,' Chapter 23 of
the City Code, and the'intention of said ordinance is to correct past
errors in platting, building, and land nse ~herein m~ch development
took place in the City prior to the adoP.tion of any planning
regu. l. ations or planning thought and to direct, aid and assist develo
ment on an equal basis throughout the community for present and future
development, and
WHEREAS~ the City did provide in the Zoning Ordinance for non-
conforming uses to protect existing property values .and to meet
constitutional requirements protecting the rights of property
owners and to prevent the taking of lands or property without the
payment of compensation, and
WHEREAS, Courts throughout this country have uniformly recognized
non-conforming uses as a method of protecting said property rights but
Courts and treatises on zoning and planning have uniformly agreed
that non-conforming uses may be lost for a variety of reasons,
including deterioration, "and
WHEREAS, Section 23.20 of the ~[ound Code of Ordinances relates
to and provides regulati, ons regarding n ~ ' _. ,
. on- con ~.ormln~ uses and
Section 23.20, Subd. a, of the City Code states in' part as follows:
':The lawful use of a building or premises as of December 20,
1945, may be continued, although such use does not conform
to the provisions hereof. Such use may-be exhended through
the building provided no structural alterations- are made
therein other than those re~,.uired by law or ordinance,
or as may be necessary to establish conformity."

WHF. REAS, ~he proPer.ty located at 3100 Island View Drive
is a non-conforming use because all s~ruc~ures-are %o be'set back
50 feet from the lake side or front yard set back and the boat
house is not located on Lots 55 and 56 but rather is located on
an area marked private .~treet on the plat of Phelps Island Park
· First Division and is within several feet of the water depending
upon the water elevation at the time of measurement, and
WHEREAS, council members of their own personal knowledge. and
the building inspector have reviewed the area where the boat house
is located and makes the following findings:
a. A new roof has bee~ installed consisting of plywood
and wood hand. split shingles.
b. New siding consisting of cedar and ced. ar batten
strips has been installed and provision has been
made for electrical and/or telephone extensions to
the structure.
c.. The structure is located so close to the lake that
.it does not conform with city regulations or with
regulations of the ~4innehaha Creek Watershed District.
d. A new metal door and. glass side light have been'
installed.
e. A new chimney and. presumably a new stove have ~een
· installed.
New interior wall surfaces, subfloor, etc. have been
installed along wit]] a Franklin free standing wood
burning stove, and. all of the aforementioned improvements
have been ma~e without obtaining a building permit from
the City and the applicant did not apply for such
building permit until after it was discovered that ~his
work had been done or at least a large part of it had
been done,
and
WHEREAS, the Hennepin County Assessor acting as the City
Assessor informs the Council that the beach house or boat house
described on a Certificate of Sur~ey as of November 13, 1970,
was not listed on the tax rolls until 1973 and that at that time
had. a valuation of $500. The value was decreased to $200 in 1975,
and in ].976 it was determined to have no value. The assessor
further, advises that in lieu of the repairs and structural work on
the boat house structure, it was their intention to put a valuation
of $500 on it and to add it back onto the tax rolls, and

WHEREAS, 'it is th'e intention of the City ordinances and the rules
and regulations of the Minnehaha %'~atershed District and the Lake
Minne%onka Conservation District to correct these old encro~.chments
on the lake and by the use of non-conforming uses to eventually
bring all of these structures into compliance with currect
regulations, and
WHEREAS, the boat house (beach house) locate~ at 3100 Island
View Drive is and was a non-conforming use and should, be relocated
to comply with existing ordinances and regulations and the owner
has seen fit to improve and add many new structural 'improvements
to this use, all in violation of City ordinances and regulations;
NOW, THEREFORE, BE I~ RESOLVED By the City Council o'f .the
City of Mound: ' '
1. The structure located on the private street easterly of
Lots 55 and 56 of Phelps Island Park First Divis|on was and is a
non-conforming use and. has been structurally improved contrary to
the. provisions of Section 23.20, Subd. a of the City Code.
2. The apDlicant's request for a variance to in effect condone
and approve the reconstruction work on this non-conforming use is
hereby denied based on the following findin, gs:
The age of the structure is unknown, and the condition
of it prior to recent years is unknown, because the
City never ]]ad an opportunity to inspect or catalogue'
the structure.
The applicant has created his owh.hardship by illegally
proceeding to repair and. reconstruct m~..jor structural
changes throughout the building in question without
obtaining a building permit.
The Building Inspector has estimated that between $2,000
and $3,000 of improvements have been made to this structure
in recent time without any building permit contrary to
Section 26.01 of the Mound City Code and Section 104
and Section 301 of the state building code.
The property is a non-conforming use in that the structure
in question is located too close to Lake Minnetonka and
the request for a lake front set back of a minim~.nn distance
is contrary to tho zoning ordinances of the City and does
not conform to the Lake Minnetonka Conservation District
or the Minnehaha Watershed District reg, ulations.
The e×tensive repair work on this structure is considered
struct~lral changes within the provisions of~ Section 23.20
of the City Code.
f. It is the finding and determination of this Council that
based upon the fact situation as set forth in the ~.~hereas
provisions of this Resolution, the~ applicant's
current problem was created by the applicantis failure
to comply with City and District rules and regulations
prior, to the time 'he commenced making repairs.
3. It is a further finding of this Council ~hat the application
for a variance should be and. is hereby denied because the granting
of the variance would have an adverse and. detrimental affect on
the health, safety, and general welfare of the City, would be
contrary to City ord. inances, and would perpetuate and extend a non-
conforming use which would frustrate the purposes and intent of
the comprehensive plan and. the zoning ordinances of the City of
· . Mound. '
4. It is a further finding of this Council that %he non-conf~
use must now be removed and brought into compliance with City
ordi'nances and regulations of the Minnehaha. Wa-~?[~:rshed District '.and
the Lake Minnetonka Conservation District because to allow the
structure to now remain would perpetuate and extend a non-conform, in?
use and. would be there,.for ,many more .years contrary to the legal
reasons for having a non-conformin_o use which is to amortize the
value of the structure before causing its removal, and therefore the
owner of this property should be ~irected. by the City Manager %o
ren',ove~the structure and bring it into compliance, and if the
property owner refuses, the City !.~.anager shall repor~ back to the Co~
cil which 'shall then consid, er com~.encing an action in the District
Court for the removal and. relocation of the structure. It is the
sincere desire of this Council that the applicant comply with this
request, and if he does comply the City's prosecuting attorney
is requested to not proceed to bring charges for the remodelin_~
without a permit. The City Manager shall report to this Council
no later than May 15, 19S0, informing the Council if the applicant
has complied with the City's request. The applicant shall be given
a copy of this Resolution of Denial and Find. ings, and he is to be
informed that if there is no compliance, the City will pursue
this matter further in an attempt to bring this property into
comp li an ce.
A motion for the adoption of the foregoing resolution was duly seconded by
Council Withhart and upon vote being taken thereon, the following voted in

SCHOOL BOARD RESOLUTION OF MAY 19 PROHIBITING USE OF
CHEMICALS ON PUBLIC PROPERTY - SIGNS
The board voted to post notice on all school property that intoxicating beverages
and chemicals are prohibited on school property and that all laws will be strict-
1¥ enforced. The prohibition includes athletic fields used for softball and
baseball games. The use of intoxicating beverages on public property is a vio-
lation of state law except when a temporary license is in effect.
Bert, would you please determine with Don Ulrick, whose department grants use
permits, just how many signs we will need to comply with the resolution.
Then coordinate this order for signs'with an order Don is currently preparing for
entrances~to the Mound building, so that only one trip by one person'to the sign
company will be necessary.
I suggest the signs be about l' x 2' in size but you may alter that based on your
research and discussion with sign company representatives.
The signs might read as follows, or something like it.

I suggest you then take a drive around the district with Peggy Tuttle, if she
can spare the time, to orient her to the proposed sign locations. Also, re-
view sign language with her. If she's satisfied, I believe the Board would
accept that the resolution has been complied with.
Don, I ask that you work out the details of temporary,license issuance with the
City of Mound. That really has to be resolved before the signs are ordered if
the sign is to include any reference to where to obtain a temporary license.
Peggy had initially favored the use of "Intoxicating Chemicals" rather than
"Intoxicating Liquors" on the sign. The law appears to be limited to liquors,
however. I'll check that out and let you know whether or not we stand on the
law to include all intoxicating chemicals.
We must move on this rather rapidly if it is to have any effect this summer.
Following is the statute:
MISCELLANEOUS
624.701 LIQUORS IN CERTAIN BUILDINGS OR GROUNDS. Subdivision 1.
Any person who shall introduce upon, or have in his possession upon. or in, any
school ground, or any schoolhouse or school building, any intoxicating liquor or ~on-
intoxicating malt liquor as defined in chapter 340, except for experiments in laborator-
ies and except for those organizations who have been issued temporary licenses to se~]
nonintoxicating malt liquor pursuant to section 340.02, subdivision 2 and' any person
possessing nonintoxicating malt liquor as a result of a purchase from those organiza-
tions holding temporary licenses pursuant to section 340.02, subdivision 2, shall be
guilty of a misdemeanor.
Subd. 2. Any person who except by prescription of a licensed physician or per-
mission of the hospital administrator shall introduce upon. or have in his possession
upon. or in, any state hospital or grounds thereof under the responsibility of the cora-
missioner of public welfare any intoxicating liquor or nonintoxicating malt liquor as
defined in chapter 340 shall he guilty of a misdemeanor.

Three Way Stop Report
In November 1979 the Police Department requested we make a three way stop at
Oaklawnand Idlewood.
The public Works Department installed the extra stop signs as the Council
directed. At that time the Council asked for a report after six months.
The Public Works Department has received no complaints or comments on the extra
signs being placed at that location as of this date.
The Police Department will also turn in a report on this.

On May 1, 1980, Northern States Power Company (NSP) filed
with th~ Minnesota Public Service Commission an electric rate
increase, pursuant to Minnesota Statute 216B.16. NSP will place
the new rates into effect on July 30, 1980. The Public Service
Commission must decide by May 1, 1981, how much of an increase
(if any) will be approved. If the full increase is not approved,
the difference between the requested increase and the approved
increase, plus interest, will be refunded to customers in a manner
to be determined by the Commission.
NSP's ~roposed rates will generate approximately $77.5
million in additional revenues. An increase of 12.66 percent has
been requested, and each individual bill will be increased by this

Dear Herb:
We are getting complaints about the parking and other happenings
on the small area that parking is allowed on along County Road 125
on the Mound side of Black Lake Bridge.
The complaints are that doors open in front of on-coming traffic,
people steppi.ng in front of cars, as well as complaints on garbage
debris, etc. There have been requests that the parking be elimi-
nated.
Our Council asked that I write and ask if you can send a traffic
engineer to look at the problems and maybe there are some things
that can be done by either the County, City or L.M.C.D. to improve
the situation.

Municipalities began collecting Minnehaha Creek elevations on
April 18, 1980. A tabulation of these values is attached.
Elevations have been converted to flows where a rating curve was
available.
As a part of the hydro-data collection program the creek was gaged

Flows in Minnehaha Creek have been slowly decreasing for the
entire reporting period. Lake Minnetonka has contributed no flow
to Minnehaha Creek since March 18, 1980, when the gates on the new
Grays Bay Control Structure were closed.
The terms of the DNR Permit for the new control structure require
that, for the period April through July, discharge from Lake
Minnetonka shall be allowed only while lake levels are above
929.3. Since gate closure in March, 1980, lake levels have
ranged fromm928.6 to 929.2. They are presently at 929.07,
Flow in the creek to date has been sustained through the current
dry period by discharge from ground water storage which has
resulted from the above-normal precipitation of the past two
years. We have intended to establish flow rates in Minnehaha
Creek at each of the gaging stations recorded in the attached
tabulation. However, we will be unable to do so until we have
sufficient rainfall.
Water quality data is available upon request. If there are
questions, please call the District Engineer at 473-4224.

Dear Mr. Bischke:
Your letter of May 15 was given to the City Council at the May 20th
meeting and they said that, if you wanted formal consideration of
the lot division and lot size variance, it would first have to be
considered by the Planning Commission. Forms for formal application
are enclosed.
I might add that the reception to dividing two legal sized lots into
one oversized and one undersized was not very warm. Also ! can
assure you that when this goes to the Planning Commission, there will
be a recommendation of denial from the Staff.
As I told you last summer or fall when you advised me that you had
divided and sold the property, that I doubted the Planning Commission
and the Council would approve creating an undersized lot.
It is suggested that possibly you should put these properties back
the way they were, thus easing the problems.
If you have further questions on this, please contact me.

Dear Mr Pearson,
I am enclosing a copy of letter mailed to Mr. Kopp which I had mailed to him
along with a full number of surveys, Certificates of Title, Plat Map in an effort
to explain the above matter to him and request how the task can be accomplished.
I trust that all the items sent to him also reached your attention at the meeting
he mentioned.
First off, Last fall I asked Mr Eopp what was the procedure to do the above, and
his response was "It can't be Done". That has alw~F~ been a stock answer I have
received from Moundo...."NO" requirew nothing from anyone..No thinking°., no planning.
We then called the Financial Director of Minnesota and they turned us over to a person
who assissted us in doing the job and assured us that there was no problem. Tax
statements would be changed and We had carefully tsken care of the proper surveys and
each property was properly recorded. The buyers were happy and were charged ~ccordingly
to what they received. Each bought knowingly. The buyer of Lot 11 couldn't have afforded
the home if I would have had to charge bin for ½ of Lot 26 and to the buyers of Lot
25 and 26, it didn't matter if it cost a bit more...° In fact it only makes sense for
lots 25 and 26 to be together° EVERYONE~S SATISFIED UNTILL MOUND SCREWED IT UP.
I'm sure hhat you understand my "Bundl~ of Rights" as a property owner, to use
and enjoy and to sell. At this point I feel that my rights are being trespassed upone
I further fo~ and have felt along with many other people that I am being discriminated
against by the people of Mounds Council and Planning Commission. Are they jelous
because I have worked hard and made a li~ing? I well understand from several people
that matters wherein I have been invelved have been "Cut and ~ried" before I ever
get up before the council or plan~%ing commission. THIS IS DISCRIMINATION,
I have b~en at meetings in Mound whenbuilders have asked to build on undersized
lots and before the request gets out of their mouth~.o"I SO MOVE" and its granted.

My request is a simple one and a very valid one and a sensible one and I feel
that Mr. Kopp is just giving me a hard time. I understand the" PACK THEORY" where
we all stick together .... right or wrong .... Please don't do that to Me. When someone
tells me "IT CAN'T BE D0~NE" . They have just told me that h~ey are too lazy to think
or to try. THE~ IS ALWAYS A WAY ...... .
In coming to the Council Meetings and Planning Commission Meetings, I felt you
were one of the few that showed any sign of being there other than for personal benefits
which they could derive from being on either Board. I further felt that you displayed
intelligence and integrity as you dealt with the problems that would come up. I hope
that the confidence that you have. conveyed will not be betrayed on the hsndling of this'
matter. If, Mound Council and Planning Commission People are invloved, I hope that
they can behave as mature adults. I worked hard during myReal Estate years in the
Mound area to remove the DISGRACE AND STIGMA that Mound had built for itself. I
that these efforts wont be undone by imature acting people in leadership~

I ~m Writing this letter as a formal means of thanking
~allofyou for the opportunity of serving on the Park
Commission. I want to make apologies for my lack of
presence during the past two months. Due to conflict-
ing scheduling of job related meetings, I find it hard
to make my obligations with you. It is due to this
scheduling conflict that I have decided to give up my
position to someone with more opportunity for input.
I want to thank all of you again for the opportunity
to serve my community over the past three years. It
has indeed been my pleasure to have known and worked
with everyone on the Park Commission.

Meeting of 5-8-80

The meeting was called to order by Chmn Larson. Minutes of meeting on 4-10-80
were presented for approval. It was brought out that in the 3rd paragraph, August
should be deleted and July inserted and in 6th paragraph'delete Downtown Park and
insert Westonka High Scho61 as correct. Motion by Lynott seconded by Bailey to
accept the minutes, as corrected. Unanimously approved.
CITY MANAGER'S REPORT:
Kopp informed the Commission that the Revenue'Sharing Budget has been
approved and the Parks had received the bulk of it, $34,000.00 with appx. $5,000.00
of this to be used for the Summer Recreational Program.
Park equipment bids had been let and were $49,800.00 considerably under
the estimate, the surplus money might possibly be used for Bike/Hike improvements
on 3 Pts. Blvd. in 1980 and along County Road 110 in 1981. The Commission is to
continue working with the City Planner and City~nglneer on plans for parks and
proposed improvements to there is a clear, concise picture of what is to be done
and ultimate results on completion.
Residents of Lake Langdon are petitioning with regard to size of boats
on the lake and their being motorized and power of motors. Council reluctant to
act on this area until they have input or recommendation from Commission. Asked
how the Lake Langdon Environmental Assessment Study submitted by Rex Alwin was com-
ing along? Larson stated that with Law Con grant refused in this area of the
grant he had considered it a dead issue and it had been more or less set aside
until it became active again. Will review this assessment at the next discussion
meeting.
SUMMER RECREATIONAL DIRECTOR'S REPORT: "
Jackie Meyer informed the Commission that flyers had been drawn (encl.)
for distribution to the children. Will have 1,7OO printed for distribution through
schools to the youngsters to take home. Shay stated that through experience the
last week of school is not the time for notices to be issued in hopes they will
reach the home. Commission agreed that notices will be distributed to the schools
for the second to last week of school in the beginning of the week.
Has had good response to the Soccer Program, lots of inquiries and
some even interested in coaching. Have between 10 to 15 players signed up for each
park, The Highlands, Tyrone and downtown a'rea; games being competively played at
the old Mound HighSchoolo Soccer rules have been printed up and will be distributed
to the coaches. Official soccer goals are 6 ft. wide and 8 ft. high and would run
between $350 to $600 per pair, the summer program will use traffic cones t~ identify
the goals,and age of participants would make officials goals a handicap. Had divided
up the age groups into 5 to 8 year olds and 9 to 12 year olds. Most of the older.
youths play Little League Ball and if there are not enough applicants for the 9 to
12 year group this will be disbanded with only the smaller youths participating.
Desperately needs supervisors for the recreational progra.m, they must be at least
15 years old and will be paid for the hours spent in the summer program. Can also
use more soccer coaches, who must be aclults but teenagers can volunteer for assist-
ants to coaches, this would be strictly volunteer work with no salary attached.
Will have an instructor from the. downtown chapter of the Red Cross out
for a two hour session on First Aid Course to be available to all the playground
supervisors and possibly the coaches of the soccer teams if they are interested.

PARK DIRECTOR'S REPORT:
Bollis informed commission that bids were let on park equipment and
were between $t6 and $17,000 less than estimated. Will confer with City Planner
and Engineer and plan on equipping the project of the Tot Lot at. Island Park Park.
These funds can be used for new equipment, fiXtures, upgrading of area, maintenance,
tables, fireplaces etc. Doone Park had equipment shown on site plan and this can
now be added with these funds and recreational equipment Can be purchsed and in-
stalled in Avalon Park.
Law Con graqt'frozen for 1979 and grant for 1980 only 50% of original
amount but the City Planner thinks Mound Bay Park has a good chance of obtaining
funds for this grant.
Asked if'Women's Affiliated Garden Club would again be planting flowers
this year around the City? Bailey said she would try and find out.
Consensus of Commission that equipment should be durable and that a
combination of wood and steel be recommended for use throughout the parks, for con-
formity and strength.
MOTION by Bailey seconded by Lynot't, "Recommend that Chris work closely with City
Planner and City Engineer to originate plans for equipment for parks." Unanimously
approved.
Larson brought up the question of Bike Trails on Wilshi~e Blvd. Boilis
explained the background on this and they will be stripped this summer to be more
legible to motorists and bikers/walkers alike.
COUNCIL REPRESENTATIVE'S REPORT - Swenson absent
PLANNING COMMISSION REPORT - Jackson absent
RECREATION COMMITTEE REPORT - Bailey stated this area covered during discussion
throughout meeti'ng.
LONG RANGE PLANNING COMMITTEE REPORT:
Larson said the "Mound Parks Plan" had been gone over and they are in
the process of clarifying classification and definitations of the parks and how
they are described as to current condition and use..Many parks are identified as
"undeveloped" and this form is too vague. Only those parks or areas that are to
remain as nature/natural parks or areas should have this defination/classification
with no future development planned for them and leaving them in a natural state.
Asked members if they would be interested in a tour of the commons areas
this year? They had previously toured all the parks, and if interested, suggested
it be on a Saturday.
Letter on replacing members reviewed, will contact some members personally
on absenteeism.
Motion by Lynott seconded by Shay to adjourn to next scheduled Discussion Meeting of
May:22nd. Unanimously approved.
