COUNCIL MEMORANDUM NO. 80-259
SUBJECT: Tax Forfeit Land
The County has added some lots to the tax sale list. These lots are
lots that people were buying tax forfeit and stopped making payments.
1. Lot 21, Block 7, Arden - This lot has about 5,700 square feet and
it is recommended it be resold.
2. Lots 20, 21 & 22, Block 6, Dreamwood - The Council combined Lots
1, 2, 3 & 4 for sale; there is little land with these three lots
(20, 21 & 22), so it is recommended they be combined with Lots
1-4 and make one building site.
3. "Lots 3 and 4,'Block 1,'Halstead View - These lots have no access.
Possibly we should ask they be held off sale.
4. Half (½) of LOt 6~'Block'4;'Woodland Point - Very small - 1,600
§~u~re feet. Recommend that we request it be held off sale. Also//'
the City has sewer through 1/2 the lot.
5. There are also two building sites on Cumberland Road that will be
going up for resale.

Dear Council Members:
This letter is to inform you, the present governing body of the City of
Mound, that James F. and Sally M. Lassek, as joint owners of the property
listed as 2431 Wilshire Blvd., go on record as objecting to the expansion
of the Fire Station located at 2415 Wilshire Blvd., as presently planned.
Our concerns are numerous! Since we purchased our home in 1974, our
privacy has slowly but surely deteriorated. First came the new well,
not only are there numerous trucks and workers mulling around in back,
but the constant high p~tched whine from the pumps is something we hear
24 hours a day. Since the community needed the well, we are willing
to accept that. Now comes the addition planned for the new hook and
ladder truck.
The new addition as planned is exactly 10 ft. from the lot line, with
asphalt driveway com~ing to the lot line itself. Is this necessary fo.r
the new truck, or is it necessary so ~mbers of the fire department can
gain access to the back of the fire station to wash their cars, trucks,
4x4's and also use the back hill as a dumping station for their campers.
Presently the side of the fire station is used by many to practice their
tennis strokes, with the addition of the new bay and additional asphalt
running right to the lot line, I can not see how our privacy will not
further be encroached upon.
In the past, the area between the lot line and present asphalt has been
used for snow removal. Does this mean that our yard will now be used
to pile snow on in'the winter? Since our lot is lower than the fire
station we are concerned about the runoff'from the additional building
and parking area affecting our property.
The lay of the property is such that at the rear our property is higher,
and at the front and side, lower than the fire station. Since the

parking lot or asphalt will not follow this contour, we are QOneerne8
as to how this will be landscaped. It is our understanding that the
hill in the back will have to be cut into to allow for the new access
to the back of the station. It is also our understanding that the hill
will be regraded. We firmly object to any change in our property.
After looking around the city, I cannot find any other home that is ten
foot from a two story cement block building, with a driveway right to
the property line.
When we purchased the property, we were willing to accept the activity
around the fire station. Since moving in, we have learned to accept
the whine of the well pumps and the activity necessary to maintain the
new well, however, we are not willing to accept what we feel is de-
valuation of our property and home because of a glaring white two story
cement block building!
If the plans are firm and there is no possibility of the bay being built
on the other side of the fire station, we request assurance that we
will not be affected by any runoff. That the building be architectually
attractive, and that the lot line be professionally landscaped, using
ties for the wall and some type of visual break.
As taxpayers and citizens of Mound, we object to the present plans.

Pursuant to due call and notice thereof, a regular meeting of the City Council
of the City of Mound, Hennepin County, Minnesota was held at 5341Maywood Road
in said City on July 16, 1980 at 7:30 p.m.
Those present were: Mayor Tim Lovaasen, Councilmembers Donald Ulrick, Gordon
Swenson and Robert Polston. Councilmember Withhart was-absent and excused.
Also present were City Manager Leonard L. Kopp and City Clerk Mary H. Marske..
MINUTES
The minutes of the meeting of July 8, 1980 were presented for consideration.
Swenson moved and Polston seconded a motion to approve the minutes of July 8,
1980 with a correction on page 80 under item POLICE, strike the word 'this'
and insert the words "the replacement of the secretary clerk" and direct the
clerk to check the tape regarding the Sports arena item.
The vote was unanimously in favor.

Lovaasen moved and Swenson seconded a motion to give preliminary approval to
the County plans for upgrading County Road 110 with the stipulation that the
parking area on the east side of Commerce Boulevard north of the intersection
with Lynwood Boulevard be resolved with the area merchants and returned to the
Council for approval and a traffic count be conducted at the Three Points inter-
section to determine a need for a semiphore and the bike hike path on the north-
erly end of County Road 110 be constructed up to the standards of other City
streets.
The vote was unanimously in favor.

Plans and Specifications - Three Points and Tuxedo Boulevard
The Mayor then opened the public hearing for input on said Plans and Specifications
for Three Points and Tuxedo Boulevard and persons present to do so were afforded
an opportunity to express their views thereon. The following.persons offered
comments or questions: Walter Baker, 5300 Three Points; Dick McCurdy, 5330 Three
Points; Janet Wolowicz, 5316 Three Points. The Mayor then closed the public
hearing.

regarding easements in this area.

If built only to Gull, the cost

The Engineer also lists the pros and cons of placing the walk.

Dear Mr. Kopp:
As requested, we have compared the estimated cost of a sidewalk on
the south side of Three Points Boulevard vs. the north side of the
street.
The cost of the sidewalk on the north side as shown on the plans is
$30,172. If this sidewalk were deleted 250 sq. ft. of retaining wall
at an estimated cost of $1,750 could also be deleted, for a total cost
savings of $31,922.
The cost of the sidewalk on the south side of the road from Commerce
to Resthaven is estimated at $30,525; however an additional 1003 sq. ft.
of retaining wall would have to be added at an estimated cost of $7,021
for a total added cost of $37,546.
If the sidewalk on the south side were built from Commerce to Gull
only, the estimated cost would be $23,551.
Some of the factors we looked at in placing the sidewalk on the north
side were:

The majority of the population of Three Points is located north
of Three Points Boulevard, including the concentrated population
of the Sea Horse Condominiums.

The PDQ store at Three Points and Commerce Boulevard is on the
north side. This could be the destination of many of the pedestrians
using the sidewalk. If the sidwalk were on the south side
pedestrians would tend to cross over to the store in mid block.
There are 8 street intersections on the north side and 14 on
the south, although the Sea Horse entrances could be considered
street intersections. There are 29 driveways on the north vs.
19 on the south. This is a factor weighing in favor of a sidewalk
on the south, however we do not feel a driveway crossing is as
significant a safety factor as a street intersection.
Another reason this may not be a significant factor is that some
of the driveways in the south will be coming out to the street with
walls on both sides. This creates a visibility problem especially
as it relates to pedestrians on a sidewalk.

If the sidewalk were constructed on the south side adjacent to
Three Points Park the slope from the street to the park which is
at a lower level would extend 5 feet further into the flat area
of the City Park.

WHEREAS, The "City", will be expending Municipal State Aid Funds on the
improvement of said Street, and
WHEREAS, said improvement does not conform to the approved minimum
standards as previously adopted for such Municipal State Aid Streets and that
approval of the proposed construction as a Municipal State Aid Street project
must therefore be conditioned upon certain parking restrictions, and
WHEREAS, The extent of these restrictions that would be a necessary
prerequisite to the approval of this construction as a Municipal State Aid
project in the "City", has been determined. '
NOW, THEREFORE, IT IS HEREBY AGREED by and between the parties hereto as
follows:
That the "City", shall prohibit the parking of motor vehicles on Three
Points, County Road llO to Resthaven Lane at all times, unless hereafter
authorized in writing by the Commissioner.

Sewer Repair
Dear Mr. Kopp,
The Contractor has completed televising approximately 3/4
of the sewers on the 1980 Street Improvement Projects.
Broken or badly cracked sewers have been found to date
which should be dug up and repaired. We have prepared a
change order on Buffalo Bituminous' contract to do this work.
The cost of the work required to make the 9 repairs is
approximately $21,500.
We recommend that the change order be approved so that
this work can be done before the streets are blacktopped.

professional bass fishing contest on Lake Minnetonka. The tournament
would be held on August 23rd, 1980. Our launch spot would be the
Surfside Club in Mound.
Our organization, the Fish Finder Magazine Tournaments of Minnesota,
holds a number of professional tournaments around the state. It is our
reputation to hold highly responsible, law abiding tournaments.
For your review I have enclosed one of our magazines and our
tournament fishing rules.. Also enclosed is our application for the D.N.R.
Particulars you may need are:
Our insurance coverage for tournaments is with St. Paul Fire and

This will acknowledge receipt of your letter of July 16, 1980.
I really see no point in my trying to argue this matter with you
or to try to convince you that the law is properly founded. It
is of course a matter of opinion as to the importance of the
South 1/2 of Lot 26 being added to Lot 11. The City Code requires
6,000 square feet. The lot was, prior to your conveyance, combined
in such a fashion that the 6,000 feet applied. The fact that a
property is non-conforming or as you say "grandfathered", does not
mean that it can go from the grandfathered or non-conforming status
to the conforming status and. then back to a non-conforming s~atus.
I am sending your letter along with a copy of this letter to Mr.
Kopp and I am sure he will transmit it on to the City Council. I
cannot offer you any hope or assistance other than that in my prior
letter. I have no authority to waive the requirements of the ordin-
ance nor would it be my place to try to influence the City Council
in the manner in which you suggest. I do not see any alternative
for you other than filing an application for a lot division, but I
believe in all honesty as set forth in my prior letter and in Mr.
Kopp's communications, there is not a good chance that the council
will grant your variance. Many of the points raised in your letter
are incorrect, but I really see no point in trying to argue them on
a point by point basis. I again thank you for the personal compli-
ments, but I think you over-estimate my influence or my ability to
resolve this problem.

address but delivered to and signed for by ~r.Kopp of June 9th. It actually takes
five days for a letter to travel from Hawaii to Mpls. So it wasn't too bad.
Just a few things I would like to share with you in response to your letter Re;
to Lot 11 Block 15 of Arden, Mound, Minn, the lot of concern.
1. The Home on the property was built in 1938 to 19A0: Five y~ars prior to your ordinance
of 6000 Sq. Ft for a buildable site. Nearly all of the homes in the area were built there-
~bouts or before and I'm reasonably sure they are "grandfathered" in as acceptable and
if they burned down would it not be'difficult to impose a subsequent ordinance to a
retroactive situation? MAY 27th , 195~ SHOW THE C~RTIFICATE OF TITLE ADDING THE DRIV~AY
KASF/,~NT ONTO A PART OF Lot 10. AT THAT POINT AND TI~, NO MENTION OF ½ of Lot 26 was

a convenience ,measure between Brother and Sister for enjoyment purposes and for a walking
access to the commons in the event the Sister should pass away: THE ½ LOT D~-LEGS from
the property and SERVES NO BUILDING VALUE: If it had run parralel with lot 11 and w~e in
fact ½ of lot 10 Or ½ of lot~ then what you propose would make sense. The Garage on
the other ½ of Lot 26 I beleive encroaches 6he ½ in question and would again be in violation
of you~ codes. Unless the newly adopted method or perhaps antiquated method of "Line of Sights"
method is used and has the flexability of overlooking this possible encroachment and would
thereby meet the Set back requirements. If the Dog-leg character of the lot is considered
as acceptable to bring an undersized lot up to Mounds _~B,i..l~Bg code then it wou~d be logical
for people on streets where they have swampc~n~.t_h..e,~0~s~t~_~i.d~;~ of the street to acquire
an additional amount of s~uare footage to bring an undersized up to Mounds code? ? ? ? ? ?

"CODE". Or. YOU. might find that if the Mound Citizens of Sound Mind and good judgement
might come and .picup the Members of both the Council and planning commission and deliver
them to· the~ "Loony Bin" for observation, First of all, Why would-anyone ALREADY LIVING
in a fully built home acquire an additional 2000 # lA. years later Just_to bring it up to
any citys newly adopted'b~ilding code. Both you and I know that this just doesn't make
any good sense~ If our tax dollars are being spent to have ~eople of such poor Judgement
and discretion in matter' like.this, better WE DON' T PAY OUR TAXES. ~ ·
"2. Upon the furnishing of a survey for Lot 11 Block 15 a building permit was issued for
a remodeling job on said prgperty. No mention was made or even question made as per an
under sized lot.
3. Denying .the Keven Flavins the right to pay their taxes on this property and NOT GRANTING
them homestead is rediculous: Homestead is granted to people who dwell in their 'property
and has nOthing to do with whether or not someone on the Village council thinks the lot is
correctly sized or not: The problem is not with the ½ Lot: The problem rests with the
people..... Mostly Mr. Nopp ... who has already decided BEFORE I FILL OUT THE APPLICATION,
THAT HE...MR KOPP.. · WILL TELL THE RESPECTIVE BOARDS TO TURN DOWN THE APPLICAT-ION. There is
no way that a willing citizen can comply with the regulations of the City...THE EGO of the
City Manager will not allow it. Where these patterns of behavior are carried out in other
parts of the World such as in Iran, internal Riots and plans to overthrow the government
take place:. It is conditions such as this display of beligerance that cause such reactions.

made an apglogy and requested a way to correct it... In light of all the above.. Mr Kopp ways

I beleive that this is where it is so important that you are on the Council and
can take ahold of situations when they get out of hand andbring them back into their
proper perspectives. I realize that this puts a heavy burden on you but in the case
of many such governing bodies, qualified people like yourself are so needed.
I trust that the things that I have shared with you will help you to see the
situation from the "other side of the table" and will help you to focus on reality.
I'm sure you agree thatthe "Letter of the Law" is' not operative in all situations and
therefore persons like yourself with the capability to think and reason are needed to
make prudent evaluations and clean unbiased , well founded decisions. Our Doctors are
finding today that empathy, compassion and "Aloha"( a less misunderstood word than love)
are largely the solutions to an ailing society in our trouble.d world. "Bedside Manners"
is also a term used by many doctors: I'm sure that in your Legal Proffession, you warm
the hearts of many distraught and discouraged people. Proffessional People like your-
self are so needed to bring balance to our lop-sided society. Keep up the Good work.
We moved to Hawaii because my wife has Rhuemotoid Polio. If I had stayed in Minnesota
~ would likely be wheeling my wife in a wheel chair whereas here she can walk eme~ though
it is with some difficulty. After nearly five months of hard work and lots of showings
in a new area .... even with9 years of experience in the Real Estate Industry, it has been
impossible to trigger even one sale. Tl~s has imposed a real hardship upon us. This is
~ hard to take after enjoying a comfortable living in Minneapolis. At nearlY age 60, starting
.o.ve? isn't easy .... for those who don't beleive it, they should try it sometime.

their corporate limits by the DNR.
To date, we have received comments from five municipalities. We request that

Council to extend the time period allowed fcr written
comments after the July 31 public hearing on the draft
guidelines for review of proposed amendments to local
comprehensive plans.
The Council will keep the public hearing record open
until the close of the business da.v on Tuesday, Sept. 2.
We hope that this extension will give you a reasonable
amount of time to prepare written comments.
In addition, if you are unable to testify at the public
hearing but wish to make verbal comments on the proposed
