Re: February 11, 2013 Special Planning Commission Meeting Joint Workshop with City
Council
In summary, the goal and objective of the joint session is to do a review of past projects and also
prioritize possible projects for the Planning Commission for 2013. Provided below is a brief summary
of some discussion points for items included on the workshop agenda.
Agenda Item No. 2(A) - Expansion Permits. Expansion permit regulations were incorporated into
City Code in 2010. Discussion is respectfully requested about the regulations, feedback on the process
to date, and whether any type of expansion permit can be handled administratively.
Agenda Item No. 2(B) - Parking Requirements. Discussion regarding the City's parking regulations
and possible modifications (i.e. reduction for non-productive space, mixed uses, etc.)
Agenda Item No. 2(C)- Building Height Definition and Determination. In November 2011, the
Planning Commission commenced its review of building height regulations including how they are
determined in other communities and also how they are applied in Mound. See attached
memorandum dated November 10, 2013. The project was continued to a future meeting pending
additional information and research .
Agenda Item No. 2 (D) - Financial/Tax Review of Development Proposals. In Fall 2012, Planning
Commission Member Linkert previously requested discussion with the Planning Commission about
inclusion of a new section in the Planning Report regarding a financial/tax evaluation of a
development project. This item was included on the December 2012 PC agenda but was deferred to
the upcoming joint workshop, as recommended by Staff, to allow for input from the Council and to
evaluate how it relates to the City Code and/or other guiding documents. So as to provide additional
information regarding the request, Commissioner Linker provided a project narrative which has been
included as an attachment. Useful information about the development of Planning Reports can be
found in City Code Sec 121 (Subdivision Regulations) and City Code Sec. 129 (Zoning) especially the
review criteria. Some thoughts to consider:
s How would this information weigh in for decision-making?
• What would be the method used for establishment of future values ?
• Would the added cost of this review be charged to the project proposer?

Agenda Item No. 2 (E) - Urban Agriculture — Bee Keeping, Chickens. Similar to perhaps many
communities, Staff has seen increased interest in urban agriculture activities including bee keeping
and chickens for personal food production. Specifically, in late 2012, Staff received an inquiry about
whether the City would entertain bee keeping activities in the community. At present, the
keeping of chickens in regulated in Sec. 14-9 of the City Code and is not allowed unless the activities
were in place on a specified date in 1960. Given that these activities could have impacts and/or
create possible nuisance conditions on surrounding properties, it is respectfully suggested that if the
City were to permit such activities it would be beneficial to create some type of a permitting and/or
licensing requirements.
Agenda Item No. 2 (F) - Interim/Special Use Permits Regulations. Some communities / counties /
townships have provisions for interim / special use permits. In summary, these types of regulations
may provide temporary use of property until a particular date or for a particular event. While these
permits provide a means through which a use could be terminated, the use can only be granted if the
terminating date or event can be specifically identified.
Agenda Item No. 2 (G) - Pawn Shops. In 2011, the City created second hand good store licensing
regulations and as part of the City's review of the study, the possible need for additional study of
pawn shops was discussed. Input and involvement by the Police Department would be required.

SUBJECT: Analysis of building height definition/determination
At the direction of the City Council, Planning Staff have undertaken a review of the City's
regulations pertaining to the determination of building heights. Code analysis was deemed
necessary following review of a building permit application that took place earlier this year
when application of the building height regulations was questioned.
City of mound Definitions
Building height can be important as it can impact the character of a neighborhood. Given the
topography in some areas of the community, determination of building height can be a multi-
step process. Section 129-2 of the City Code defines building height as follows:
Building Height, means the vertical distance to be measured from the average grade of a
building line to the top, to the cornice of a flat roof, to the deck line of a mansard roof,
to a point on the roof directly above the highest wall of a shed roof, to the uppermost
point on a round or other arch type roof, to the mean distance of the highest gable on a
pitched or hip roof.

To assist in understanding how other communities determine building height, Staff has
gathered definitions from a number of codes in surrounding communities. The focus of data
gathering was on Lake Minnetonka communities or other lake communities (Prior Lake,
Waconia, and White Bear Lake). It is important to note that the communities did not have
other clarifying definitions, such as "ground level", and generally did not provide a calculation
sheet like Mound does to assist in the calculation of building height.
Deephaven - Height of Building means the vertical distance between the highest adjoining
ground level at the building or ten feet above the lowest ground level, whichever is lower, and
the highest point of a roof or average height of the highest gable of a pitched or hipped roof.
Excelsior - Building Height. The lowest defined point to the top of a cornice or a flat roof, to the
deck line of a mansard roof, to a point on the roof directly above the highest wall of a shed
roof, to the uppermost point on a round or an arch type or to the mean distance of the highest
gable of a pitched, hip or gambrel.
Minnetonka Beach - Building Height. The vertical distance between the lowest ground level of
the building and the highest point of a flat roof or the highest point of any gable on a pitched or
hipped roof.
Shorewood - Building Height: A distance to be measured from the average land grade to the
top of a flat roof, to the mean distance(between eaves and peak) of the highest gable on a
pitched or hip roof, to the roof deck line of a mansard roof, to the uppermost point on all other
roof types.
Spring Park — Building height. A distance to be measured from the mean ground level to the top
of a flat roof, to the mean distance of the highest gable on a pitched or hip roof, to the deck line
of a mansard roof, to the uppermost point on all other roof types.
Tonka Bay - Building Height, Principal Buildings. The height of principal buildings measured
from the average ground level prior to construction to the top cornice of a flat and mansard
roof, to the uppermost point on a shed, round or other arch -type roof, or to the average height
of the highest gable of a pitched or hipped roof.
Waconia - Building Height: The vertical distance from the average elevation of the adjoining
ground level to the top of the highest point of the structure.

White Bear Lake - Building Height. A distance to be measured from the mean ground level to
the top of a flat roof, to the mean distance of the highest gable on a pitched or hip roof, to the
deck line of a mansard roof, to the uppermost point on all other roof types.
Woodland - Height of Building means the vertical distance between the highest adjoining
ground level at the building or 10 feet above the lowest adjoining ground level, whichever is
lower, and the highest point of any roof. Each such ground level will be measured using the
spot elevation existing on June 14, 2010 or the spot elevation as of the building permit
application date, whichever is lower.

In addition to review of and discussion of the aforementioned definition(s), Staff
specifically requests input on whether both the front and rear building lines of a
structure of an inland/non-lakeshore structure should be utilized for building height
calculation. This would be the same process that is utilized for lakeshore lots. Presently,
only the front building line abutting the street is used for building height determination
for non -Lakeshore lots. Staff will further comment on this at the meeting and will also
present some graphic depictions related to same.

Financial impacts of a Development
In my two years on the Mound Planning Commission, I have taken part in a couple discussions
around development and redevelopment of properties. In a time where the City of Mound is
undertaking serious cuts, an uncertain financial future, and inept financial policy coming out
of St. Paul and Washington DC, Mound needs to be sure to take care of itself, and it's own
financial situation. This proposal could be a step in having a more open, and frank discussion
about where Mound revenues and expenditures work, especially in land use.
Property owners consider the property tax implications of using their property all the time.
Property owners are fully aware any improvement done on their property might affect their
property tax. in fact, the system is rigged so property owners who minimally maintain their
property, like the tan commercial property on Commerce across the street from Our Lady of the
Lake, will have their property taxes steadily decrease while those property owners who make
improvements, get "rewarded" with paying higher property taxes. Our system is setup to benefit
those who do the least on their property!
Fortunately, the city can take the opportunity with it's land use policies, to improve a site, as well
as "expand the tax base"...

"3. Encourage improvement and redevelopment of existing commercial area to enhance
available services, provide employment opportunities and expand the tax base."
"8. Monitor and enforce ordinances standards and programs that affect land use to
ensure that they are reflective of community policy."
Beyond that, the city has "Fiscal Devices" that clearly show this discussion takes place between
a city and a developer regularly.
From the Mound Comp Plan - Official Controls - Fiscal Devices (page 10-5) - "The City
has established various fiscal tool that support implementation of the Comprehensive
Plan goals and policies, including tax increment financing(TIF) districts, special
assessments, development review fees, park dedication fees, write-down of publicly -
owned land for redevelopment purposes, public funding of contaminated land cleanup
and provision of a public parking structure/transit facility in downtown."
Clearly these discussions are legal, necessary and happen anyway, but where do they happen,
and when? The engineer worries about moving cars. The public works director runs the utilities
and is primarily concerned with new connections. The planner administers the zoning code and
is particularly zealous about parking ratios. Shouldn't the Finance director give a report at a
broad level showing how a particular development impacts our city in a similar manner?

1. A snapshot of the revenue generated from the site as is, after built, and in the future.
2. What investments the city already has spent in the site, and how much would it cost to
maintain infrastructure in the future, including when the infrastructure is rebuilt and replaced.

1. The Planning Commission Officers shall be:
a. Chair

3. Duties of the Officers:

1) The Chair shall preside at all meetings of the Commission.
2) The Chair shall preserve order and decorum and shall decide questions of order
3) The Chair shall appoint all assignment areas unless otherwise requested by a
majority.
4) The Chair may call special meetings stating the purpose of such meetings and be
posted in accordance with State Statute.
5) The Chair shall be responsible to have the staff report on the status of previous
recommendations made to the Council, stating the Planning Commission's
recommendation and Council action.
6) The Chair will be responsible for identifying and resolving performance issues
(including attendance) with Planning Commissioners. In the event the Chair
determines a Planning Commissioner may need to be removed from his (her)
position, the Chair will be responsible to recommend removal actions to the City
Council.
The Vice -Chair shall preside at all meetings in the absence of the Chair.
4. The Mound Planning Commission acts only as an advisory group to the Council to make
recommendations in the best interest of the citizens and the City.

1. The first Tuesday shall be considered the regularly scheduled official meeting night.
a. In the event that there are more board of appeals cases than can reasonably be
concluded by 11:00 p.m., the Chair and the Planning Staff shall be empowered to
schedule a second meeting for another Tuesday during the same month to take care
of the overload.
b. The Chair shall have prerogative to cancel or postpone any regularly scheduled
meetings.
2. All public hearings shall be held at the City Hall. All meetings shall be called at 7:00 p.m.
and shall conclude at 11:00 p.m. unless waived by the majority. Any business unfinished
at the scheduled closing time shall be taken up at a subsequent meeting designated by
the Chair.
3. The Commission, at the first regular meeting of the new year, shall elect from its group,
a Chair and a Vice -Chair.
4. A majority of members shall constitute a quorum. In the absence of a quorum, the
minority shall adjourn any item of business requiring official Commission action, to a
specified time.
5. A member may be excused from an individual meeting for reason of illness, work, or
out-of-town trips.
6. in the absence of the Chair and Vice -Chair, the remaining members shall elect a
Temporary Chair.
7. The Chair shall call the meeting to order and the Secretary to the Commission shall call
the roll and announce a quorum.

19. "Call for the question" or "previous question" is a motion and must be seconded. Itis
not debatable and must be voted upon immediately. A two-thirds majority is necessary
to call the previous question. If the two-thirds majority is given, the motion or question
on the floor must be immediately put to a vote without debate except for a motion to
table.
20. "Question"
is not a motion but only an indication to the Chair that the person making
statement is ready to have the motion or question put to a vote.
22. Members must limit their remarks to the subject matter being discussed and shall not
be repetitious. The speaking order shall be at the discretion of the Chair; however, all
members shall be allowed to speak in their turn.
23. All members are expected to attend meetings and perform any pre -work required for
these meetings. Members, who miss four or more scheduled meetings in a calendar
year without prior permission from the Chair, may face counseling from the Chair and
the sitting council member, or more serious consequences up to and including discharge
from the Commission by the City Council.
24. Any member having a direct financial and/or direct personal interest in an individual
action under consideration by the Commission shall excuse himself/herself from the
Commission and not vote on that particular matter. Said member will have the same
rights as any citizen who has an interest in any action being considered by the Planning
Commission.
25. These rules shall not be repealed or amended except by a majority vote of the
Commission.

limited to, previous work experience in either the public or private sector, relevant
training and education, past volunteer activities, and the candidate's submitted
application materials. At its option, the prescreening team of the Chair and City
Manager or designee may opt to hold a prescreening interview(s). The Chair, in
cooperation with the City Manager or designee, will recommend the slate of candidates
to the Planning Commission for the formal interview process to be undertaken in
accordance with the City's established procedures. Nothing shall prevent the Planning
Commission from interviewing all or a selection of candidates if deemed appropriate by
the Chair and City Manager or designee following completion of the prescreening
process.
3. The applicant is to be advised of the interview at least ten (10) days prior to the date of
the interview.
4. If the applicant is unable to attend the scheduled interview, the Planning Commission
may make the recommendation based on the information provided.
5. Following the interviews and at the same meeting, a written ballot method of voting will
be used (see Exhibit Q. The secretary will have the candidates names typed on the form
and the form will be sent to Planning Commissioners in their packet. Ballots will be kept
in the journal of the Planning Commission containing meeting minutes.
• The Planning Commission shall forward to the City Council, at their next regular
meeting, a list of the candidates and the number of votes they received.
1. City policy requires the submittal of an updated survey including all necessary
information and proposed improvements as part of its land use application
requirements. The Planning Commission will allow administrative approval for use of
an existing survey for a future land use application by Staff related to the follows:
a. Use of an existing survey which depicts the current location of a structure related to
the affected property lines for applications which are within the building footprint or
do not affect the setback. This includes but is not limited to, a request to allow
Muse" of an existing structure (i.e. CUP) which does not involve building and/or site
alteration activities.
b. For applications related to placement of structures on the property line(s), an
existing survey can be used as long as survey irons are evident in the field and
depicted on the survey.
c. If the survey shows existing structures and its relationship to affected property lines
and an addition is proposed to be_16-structed and/or added, the existing survey can

2. Staff reserves the right to forward any request to the Planning Commission for review
and determination of survey acceptance due to extraordinary or unique circumstances.
3. in the event an existing survey is used as part of a land use application, the Planning
Commission reserves the right to require the submittal of additional information as
necessary including but not limited to the submittal of an updated survey.

BE IT RESOLVED, that the City Council of the City of Mound, Minnesota, hereby
establishes the following policy:
Definitions of "Vacancy": A vacancy occurs when a term expires and the commissioner
holding that term does not desire reappointment. A vacancy also occurs when a
commissioner resigns his/her position prior to the term expiring.
1. When a vacancy occurs, the City Manager is directed to advertise in the City's
official newspaper that there are positions to be filled on a commission(s). Such
advertising shall be done in the form of a "news release".
2. Such news release shall include, but not be limited to, the number of vacancies,
the length of the term, or request for letter of interest and/oi resume, application
deadline date, etc. The news release shall also state that prospective applicants
will be required to interview with the city Council and respective commission
jointly. Such interviews will be conducted as soon as possible following the
application deadline. Each commission will formally recommend appointments
following the joint interviews. The City Council will review those
recommendations and will be responsible for making the appointments.
3. Current commission members who wish to be reappointed must indicate such
and the reasons for being reappointed in writing a minimum of sixty (60) days
prior to their term expiring.
4. It a member resigns during his/her term, such resignation must be in writing and
submitted to the City Manager.
5. In the case of member resigning with less than ninety (90) days remaining, on
his/her term, the City Council, at its discretion, may delay filling the vacancy
until the term officially expires."
The foregoing resolution was moved by Councilmember Jessen and seconded by
Councilmember Johnson.
The following Councilmembers voted in the affirmative: Jensen, Jessen, and Johnson.
The following Councilmembers voted in the negative: Ahrens And Smith.

BE IT RESOLVED, that the City Council of the City of Mound, Minnesota, hereby
establishes the following policy as it pertains to the interviewing of candidates for advisory
commission appointments:
Candidates for appointment to advisory commissions will be interviewed jointly by the
applicable commission and the city council at a regularly scheduled commission meeting.
Following the interviews and at the same meeting, the commission will establish a ranking of the
candidates, listing the candidates and the number of votes they have received. The results will
then be submitted to the Council at the next regular Council Meeting. The Council will then
make official appointments at that Council Meeting.
E IT FURTHER RES L , that if candidates who wish to be considered for
appointment cannot be present for the interviews that the commission and the city Council will
base their decisions on the resumes submitted.
The foregoing resolution was moved by Councilmember Smith seconded by
Councilmember Jensen.
The following councilmembers voted in the affirmative: Ahrens, Jensen, Jessen, Johnson
and Smith.
The following councilmembers voted in the negative: None.
