Dear Leonard:
I have checked with the Sander Company' r~garding a roof bond and
_.-it is not available. They will write an extended guarantee, for
an additional two years, which gives the city a five year guaran-
tee; but a 15 of 20 year bond isn't available.
The practice of bonding roofs is almost non-existant today.
Johns-Manville still does so on their roof, but bonding companies
no longer do so. This is consistent with our recent experience.
We have designed buildings for the Minneapolis School District,
University of Minnesota, Skate Community College System and
Corps of Engineers as well as private clients and none have roof
bonds as_they traditionally were written a few years ago.
The major problem was getting the bonding company to become'in-
volved. It usually had to be established that the roof leaked
before~they.would even look at it. In other words, if a skylight
may have been the problem, it would have to be absolutely ruled
out before'%he bonding company would investigate the roof as a
source of the trouble. The bonds in most cases weren't worth the
~ paper they were printed on.
The practice today at the University of Minnesota, for example,
is to obtain a 3 year wara~tee from theinstaller, against any
leakage other than tha~ caused by damage to the system.
In this case the additional two year gugrantee would cost $500.00
per year. We hope the council°will find this satisfactory and
authorized work to proceed.
I will be out of town for a few days. Please contact Bruce
Hassig of our office as he is in touch with the roofer and can
tell him to proceed if you so decide. The Sander Company will
have a purchase order with the City and we will reimburse the
city for 50 percent.

RE: 1979 Street Improvement Project
Dear Lyle:
As you know, we have just received the easements on Lakewood Lane and
recently on Driftwood. We will proceed with the work immediately. However,
we will require a time extension of approximately fourty five (45) days to
complete all of the new construction and final clean-up.
The final clean-up work on all other areas of the project seems to be
progressing satisfactorily and our goal is to be 100% complete by July 12th.
We've had some probelms with weather this spring; but the majority of. the
work has been completed despite it. The only area that is not close to being
finished at this time is the beach park, because we were ask'd to hold off
starting the work until about three weeks ago.
I feel that this is a realistic schedule and believe that we, and our
sub-contractors can meet it.
Please consider the above and advise.

CDBG Budget Items Needing Adjustment
As discussed at the May 13 City Council meeting, a number of year
3 and 4 HUD Block Grant budget items are in need of amending.
Our problem is with the successful implementation of a few allo-
cated budget items.
1. PARKS
Based on our recent park project bids, $17,000
is still remaining. The parks commission (see
attachment) is requesting approximately '$7,000
be spent on tots and picnic tables. Therefore,
a residual of $10,0OO is still remaining.

constitutes an excessive administrative effort

II. Alternative BudBets to Spend ~/~1,000 ~sidual ~DBG Funds
A couple alternatives to spending unallocated funds are recommended
and are in need of City Council determination:
A. CITY HALL ELEVATOR - Estimated at $90,000, $93,000 total.
If the unallo~ated $62,000 is combined with other improve-
ment equipment outlay funds and 1979 revenue sharing (from
discussions totalling approximately $20,000) approximately
an $82,000 elevator budget is possible. If alternative
funds equalling another $20,000 are available, i.e. the
bikeway project, etc., the project is feasible.
B. RETAIN $10,000 PARKS FUND AND REALLOCATE REMAINING $52,000
TOWARDS HOUSING REHABILITATION.
The housing rehabilitation fund could be spent this year and
would clear our CDBG books. While the special assessment
deferment project is a good one, spending the. funds, wou]d..not
be till next year and creates a problem with the HUD wanting
to spend the money this summer. Whatever project we go with,
the funds need to be spent this summer regardless. I am plan-
ning on the July 8 City Council meeting as the meeting to re-
solve this issue.

SUBJECT: Police
The present Police Clerk is resigning and should be replaced.
In view of recent happenings, we felt this should be discussed with
the Council prior to hiring a new clerk. The position is needed even
without Minnetrista and St. Bonifacius.
The other item that should be decided on is new quarters. The school
is still available. This will be on the July 8th agenda.

late control plan for the Twin Cities seven county metropolitan
area at its meeting on Wednesday, July 23, 1980, which begins at
10:00 a.m. at 1935 West County Road B2, Roseville, Minnesota 55113.

Based on the site plan submitted, and after meeting this afternoon
with Doctors Carlson and Romness, initial review of the proposed
townhouse project is generally in conformance with City Zoning
Code outside the following items:

the townhouse code for two bedroom units 4,000 square

meeting on the ordinance:
A. Relaxation of the sideyard regulations on small
lots of record
Discussion was centered on allowing two six by
six sideyard setbacks on undersized lots if ad-
equate parking is maintained through the construc-
ti.on of i.e. tuck-under garages. Such a provi-
sion would read:

setback requirements shall be observed for under-

Attached is a copy of the information received from the State
showing our levy limit for 1981 will be $872,665 compared with
$804,468 last year. This is a $68,197 increase in funds.
We haven't found out yet what our state aids will be.
Last year we asked for the increase tO the 5th percentile of
all cities in the county, so we can not do that again.

As required under Minnesota Statutes, 1979 Supplement, Section 275.52, Subdivision
4(d), the Department of Revenue has determined for each county the average 1980/1981
levy limit base per capita for those cities and towns in the county that are subject
to the 8% levy limitation. This provision permits any city or town which has a levy
limit base per capita that is below 85% of the average for its county to apply for
an adjustment to its 1980/1981 levy limit base.
The enclosed table shows the 1980/1981 levy limit base per capita for each city and
town in your county subject to the 8% levy limitation, the average levy limit base
per capita, and 85% of the average. A city which is joint in two or more counties
is considered one of the cities subject to the 8% levy limitation within each of
these counties. The following is an explanation of the table:
Column

Payable 1980 levy limit base before any street maintenance and refuse collection
adjustments and before the deduction of 1980 aids.
Payable 1980 levy limit base adjustment for street maintenance and refuse
collection claimed on the payable 1980 Form 280.
Base adjustment for one-half of the payable 1980 special levy for increased
industrial and commercial development costs which cannot be claimed as a
special levy for taxes payable in 1981.
Adjusted levy limit base (columns 1 + 2 + 3).
Payable 1981 levy limit base (column 4 X 1.08; 1.06 for Duluth, Minneapolis
and St. Paul).

capita in column 7 which is below 85% of the average 1980/1981 levy limit base per
capita of its county, shown in colum 9, application may be made to the Levy Limitations
Review Board to have its 1980/1981 levy limit base adjusted by an amount sufficient
to increase the town or city's 1980/1981 levy limit base per capita to 85% of the average.
If a joint city has a 1980/1981 levy limit base per capita in column 7 which is below
85% of the average 1980/1981 levy limit base per capita of one or more of the counties
containing it, shown in column 9, application may be made to the Levy Limitations
Review Board to have the city's 1980/1981 levy limit base adjusted. For each county
where the city's 1980/1981 levy limit base per capita is below 85% of the average, the
difference between 85% of the average and the city's 1980/1981 levy limit base per
capita would be multiplied by the portion of the population of the city in that county;
and this amount would be added to the 1980/1981 base.
To apply for a 1980/1981 levy limit base adjustment under Minnesota Statutes, Section
275.52, Subdivision 4(d) from the Levy Limitations Review Board, address a letter
requesting the adjustment to me. Ordinarily, a town or a city requests that the levy
limit base adjustment be the largest amount possible, since once it has received a
base adjustment under Minnesota Statutes, Section 275.52, Subdivision 4(d), it cannot
apply for another base adjustment under any of the clauses of Subdivision 4. However,
if a city or town received an adjustment to 80% of the county average levy limit base
per capita prior to June 1, 1979, and its 1980/1981 levy limit base per capita is
below 85% of the county average, it may still avail itself of this one time opportunity
to increase its levy limit base per capita to 85% of the county average.
To assist this Division in scheduling meetings of the Levy Limitations Review Board
and in calculating the 8% levy limitations, the application for a levy limit base
adjustment should be received by the Department of Revenue prior to August 1, 1980.
The members of the Levy Limitations Review Board are the Commissioner of Revenue,
the Chairman of the Minnesota Municipal Board, and a public member appointed by the
Governor. Representatives of the town or city are not required to attend the meeting
of the Board to recieve this base adjustment.

This will confirm our telephone conversation of July 2, 1980. You
have not been contacted by Mr. Rooney but this will confirm a
meeting to be held in my office on the morning of July 8, 1980
at 11:00 o'clock A.M. Mr. Rooney was going to be calling you to
arrange the meeting.
You have Asked for some information from me to aid. you in preparing
for the meeting and hopefully to help resolve this particular
problem. In accordance with that I am enclosing.a copy of a summary
sheet prepared by the engineers concerning the work up until last
week done by Hardri.ves to complete the work. The total of th'at
work is $45,658.81. There is then a breakdown as to how those
charges have been allocat.ed and it appears from the engineers deter-
ruination that $26,130.71 to that date would be charged against
Thomas. I believe this will be helpful to you in preparing for
the meeting.
You have also asked me for copies of correspondence which took place
in 1979. I have previously indicated to you that I believe that
your argument is with Thomas as is ours. We do not have a contrac-
tual arrangement with Midland and my basic purpose is to be sure
that everybody i~s properly advised so that we can move forward as
quickly as possible. I am therefore enclosing for your benefit
copies of some of the correspondence which took place which may aid
you in your evaluation of the case so that you may properly advise

assessments in our Contract areas. We have. recommended and the County Board has

First Annual 8 Kilometer MAZE RUN

On Saturday, August 2, 1980, the Community Services will host the First Annual
8 Kilometer MAZE RUN through the neighborhoods of Mound. This run will start
across from the Mound Medical Clinic in the north parking lot of the Mound
School Building. The run is planned to go north on Belaire to Elm, then west
to Grandview Drive through the neighborhoods in Brookton and back to a crossing
on Commerce Boulevard by the tennis courts. The event will continue towards
Seton to the point where Edgewater Drive crosses County Road #15 by the Westonka
Animal Hospital. It will then continue through the neighborhoods and come out
near the Shirley Hills School, then down Lakewood Lane to Bartlett Boulevard,
continue on Bartlett to Commerce and north on Commerce to Auditors Road, then.
east past the Laker Office and finish on the municipal parking lot th6t is
across from Johnson Printing Office.
The activity will start at 9:30 A.M. and should have cleared the streets by
10:30 A.M., and crowd dispersed by 11:00 A.M. The route of the run will in-
cldde a midpoint stop for water and time indication by the run officials. There
will be a series of markers that are temporary in nature which will be put in
place and removed after the race. The construction of the streets in the Brook-
ton are may very well cause a route change. The idea at this time is to expand
the run by including more streets in the area east of the school and in the
general area of the Belmont Apartments.
The P61ice Reserve and the Police Explorer Scouts (with their Mopeds) have been
requested to provide a total of twelve people. We have received a tentative
offer of manpower from one of the local organizations.
This activity is a cooperative venture with the business community to be a part
of a summertime community gettogether. At this~time their plans are in the
development stage and therefore I cannot indicate their other activities. The
entire concept'of this event is directed to the casual runner and not the advance
quality marathon type of individual. In many cases, to date, the entries are
from husband and wife. Enclosed you will note that we even give a certificate
to the "near trophy winners". Enclosed is a sample of the map and entry blank
for the event.

One water stop is provided (Lake Minnetonka); split time and place at 4-K.
Pre-registration cost is $2.00. Day of event (~:00-9:00 a.m.); $4.00. This
run is on in all weather except a tornado. A cool down jog of one mile brings
you to Surfside Beach where swim~ing and picnicing are .available.

Re: Parking on CSAH 125 near Black Lake Bridge
Dear Leonard:
As requested by the city our department has investigated the problems
caused by parked vehicles on CSAH 125 just south of the Black Lake bridge.
Space for parking approximately 12 vehicles has been designated on the east
side of the roadway.
As you are well aware, this is an extremely popular place for fishermen to
park. Even on weekdays.during the fishing season it is not unusual to
observe 8 to 10 vehicles parked in the designated area. This is the only
spot available for parking within a reasonable distance, since all other
parking is prohibited on both sides of CSAH 125 from the Wilshire to CSAH 15.
The designated area is also somewhat remote from any residences, therefore
having negligible adverse effect on the neighborhood. The location is
presently provided with a satilite and trash containers for sanitary purposes.
With recreational parking already at a premium in the lake area, the county
would be very reluctant to prohibit parking at this location.
There are a couple of improvements that can be undertaken that may help ease.
the parking problems and provide more comfort for passing motorists. Some
areas of the shoulder are uneven and eroded to some extent. Additional
crushed rock could provide a level, smooth surface for the parked vehicles.
Brush and other undergrowth overhangs the shoulder effectively narrowing its
width. Removal of some of this would provide a wider shoulder allowing vehicles
to park further from the roadway edge. Both these potential improvements will
be brought to the attention of our Environmental Department for implementation.

received its metro ranking of 5 out of 15 submitted. The ranking
appears to be within funding potential. Application funding is pre-
dicated on the federal budget now froze by the Carter administration
in terms of total amount coming from Washington. We will know final
disposition in the fall. Our original application was scaled back
by d~leting the boat parking/ramp project for DNR funding.
