RESOLUTION REfl.UESTING THE CITY COUNCIL OF THE CITY OF MOUND CALL FOR APUBLIC -'-vi~iviODIFICATION TO THE DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT N0.1 AND THE PROM OR TAX NCREMENT F NANCING TAX INCREMENT FINANCING PLA DISTRICT NO.1-1. (A REDEVELOPMENT DISTRICT) BE IT RESOLVED by the Housing and Redevollowsent Authority Commission of the City of Mound, Minnesota (the HRA) as f WHEREAS, the City Council ("the Council") of the City of Mound, Minnesota (the "City') has established Development District No. 1 pursuant to Minnesota inclusive, as amended, in an effort Statutes, Sections 469.001 through 469.047, to encourage the development and redevelopment of certain designated areas within the City; and WHEREAS, the City is proposing the modification to the Development Program for Development District No. 1 and the proposed modification to the Tax ursuant Increment Financing Plan for Tax Increment Financing District No. 1-1, p to and in accordance with Minnesota Statutes, Sections 469.001 through 469.047 and Sections 469.174 through 469.179, inclusive, as amended; NOW, THEREFORE BE IT RESOLVED by the Housing and Redevelopment Authority Commission as follows: 1. The HRA hereby requests that the Council call for a public hearing on April 24, 2001, to consider the proposed adoption of the modification to the Development Program for Development District No. 1 and the proposed modification to the Tax Increment Financing Plan for Tax Increment Financing District No.1-1 (collectively, the "Modifications") and cause notice of said public hearing to be given as required by law. 2. The HRA directs the Executive Director to transmit copies of the Modifications to the Planning Commission of the city and requests the Planning Commission's written opinion indicating whether the proposed Modifications are in accordance with the Comprehensive Plan of the City, prior to the date of the public hearing. 3. The Executive Director of the HRA is hereby directed to submit a copy of the Modifications to the Council for its approval. ~,.,.,. HRA RESOLUTION NO. 4. The HRA directs the Executive Director to transmit the Modifications to the county and the school district in which Tax Increment Financing District No. 1-1 is located not later than March 23, 2001. Chair, Pat Meisel Attest: Executive Director, Kandis Hanson FIRST AMENDMENT TO CONTRACT FOR PRIVATE REDEVELOPMENT THIS AGREEMENT, made and entered into as of the day of March, 2001, by and between the HOUSING AND REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF MOUND, MINNESOTA, a Minnesota public body corporate and politic (the "HRA"), and METROPLAINS DEVELOPMENT LLC., a Minnesota limited liability company (the "Redeveloper"). WITNESSETH: WHEREAS, the parties hereto did on or about December 4, 2000 enter into an agreement entitled, Contract for Private Redevelopment, (the "Contract"), calling for the redevelopment of an area of land (the "Property") lying within the City of Mound; and WHEREAS, events subsequent to the Contract have established that the land acquisition costs and the costs of constructing the necessary Public Improvements to serve the project are substantially greater than was then contemplated; and WHEREAS, the parties desire to address such matters through certain amendments to the Contract; and also to modify the form by which portions of the economic assistance will be provided to the HRA; NOW, THEREFORE, based upon the mutual covenants and undertakings hereinafter, and in the Contract provided, the Contract is hereby amended by amending Section 5.1 thereof to read as follows (New material underlined and deleted material stricken through): Section 5.1 Not later than 60 days following the execution of this Agreement, or by such later date as the parties shall agree to in writing, the parties will reach agreement on the design elements, construction timing and financial responsibility (which may include special assessment) for the following items: 1. Streetscape along Lynwood Boulevard and Commerce Boulevard. 2. County road traffic lane modification as required by Hennepin County. 3. Parking bay along north side of Lynwood Boulevard 4. Park improvements for residential areas. 5. Streetscape enhancements and parking along Adler Road. 6. Pedestrian trails to be constructed and dedicated to the public. 7. Improvements and betterments to be constructed within the Outlots to be conveyed to the public.
