FIRST AMENDMENT TO ASSIGNABLE OPTION TO PURCHASE LAND City Attorney, John Dean, stated that this amendment with Rod Dietrich for the Post Office land is a change in the way the land is to be paid for, and a reduced land purchase price by $122,000, with Dietrich giving up the tax increment. This amendment is in line with what was discussed at the last HRA meeting. MOTION by Hanus, seconded by Brown to approve the First Amendment to Assignable Option to Purchase Land with Rod Dietrich. All voted in favor. Motion carried. -2- HRA Minutes — June 25, 2002 6. RESOLUTION APPROVING REDEVELOPMENT PROJECT AREA AND PLAN John Dean explained that the redevelopment project area designation is needed to proceed with the lease /purchase of the public safety facility, and recommends approval. These areas are the areas that would be replaced. It is our opinion after the our physical inspection and noticing the present leaking that the areas should be replaced at this time. The remaining roof areas #3, #4, and #5 appeared to be in an acceptable condition at this time and not in need of immediate replacement. Life expectancy of these areas could be 5+ years (with possibility of small repairs) before replacement would have to be considered according to Howard Dunham of C.S.I. Roofing. Proposal Summary 1. The 45 mil. EPDM (Ethylene Popylene Diene Monomer) • rubber membrane which is sufficient in strength as proposed in all bids except United Roofing which is proposing a 60 mil. membrane (cost is approx..12 sq ft difference). All bids are comparable as to the necessary flashing of roof drains, perimeters of walls and plumbing stocks, etc. Necessary insulation where needed will be Isocyanurate material which does not absorb water. The main reason the C.S.I. Roofing bid is substantially less than the others is that they do not feel that it is necessary to remove and replace all the existing insulation on roof section #6 which is very labor intensive plus the additional materials cost and debris disposal which accounts for the higher pricing of the other proposals. C.S.I. will be replacing all the existing insulation on roof sections #1 and #2. VIP Properties has contracted with on behalf of its clients with all of the mentioned Roofing Companies on various patch and total replacement types of proposals. The purchase was in anticipation of the development of the property along with the rest of the Auditor's Road district, which was under a preliminary agreement with Gramercy at the rime. The condition of the structure was such that the HRA determined not to renovate the building for temporary use pending development. It also became apparent that Gramercy was not interested in purchasing and demolishing the building until a final development agreement for Auditor's Road had been negotiated. As a result of these developments the HRA directed MFRA to begin preparation of • plans and specifications for the demolition of the building. In a letter dated August 23, 2001 MFRA recommended that due to cost and site difficulties the demolition of the Longpre building be delayed until it could be combined with the demolition of two adjacent buildings. A copy of that letter is attached. Based on that recommendation, and the pending redevelopment, the HRA decided to delay demolition, and proceeded instead to secure the structure. Nearly a year has passed since the MFRA letter, and the building still remains, and it has been the object of concern from at least one adjacent property owner. Staff has reviewed the situation regarding the building to determine if there is a basis for recommending that the HRA consider moving ahead with demolition at this time. Based on that review, staff would make the following report: 1. The points raised in the MFRA report of August 23, 2001 are still true and valid. There is a significant cost increase if the Longpre building is demolished before the other buildings. Neither the HRA nor the city currently has a funding source to cover the cost increase let alone the basic demolition cost. • JBD -2171 Rovl MU195 -2 -16- C, 2. The building has been boarded up; which while unattractive, should prevent trespass and the risks that flow from such entry. 3. While Gramercy has withdrawn as a developer of the Auditor's Road area, a new developer has recently been selected, and contract discussions are underway. If the development proceeds as envisioned, demolition of the properties in the area should take place by next Spring. 4. The HRA carries liability insurance on the building. If a fire or similar occurrence in the building resulting from the negligence of the HRA or its agents, damaged other property or persons, the policy would provide coverage up to its limits. The insurance does not include the building or its contents. 5. Unless the HRA determines that the building should be demolished now, certain steps could be taken to continue to assure that the building, while aesthetically unpleasant, will not pose a risk of harm to • surrounding property. Steps might include: a. Removal of steps and deck in back. b. Increased police patrols of the building. c. Verify that the building is secure from trespass. d. Ask the League to do a risk analysis of the building. (The League is not the insurer of the building so securing its review might be difficult). e. Have our fire inspectors review the situation and make any suggestions they may have. The subject will be on the agenda of the July 9, 2002 HRA meeting as a discussion item. The removal of the Lauer building at the same time is not as critical, however some cost saving could be realized if done as a package. For the reasons stated, we are recommending that the demolition of the Longpre building be delayed until control of the Larson and Lauer properties are obtained and demolition of all three buildings can be undertaken at the same time.
