June 23, 1987 MINUTES - MOUND CITY COUNCIL - REGULAR MEETING The City Council of Mound, Hennepin County, Minnesota, met in regular session on Tuesday, June 23, 1987, at 7:30 P.M. in the Council Chambers at 5361 Maywood Road, in said City. Those present were: Mayor Steve Smith, Councilmembers Don Abel, Liz Jensen, Phyllis Jessen and Skip Johnson. Also present were: City Manager Edward J. Shukle, Jr., City Clerk Fran Clark, City- Attorney Curt Pearson, City Engineer John Camerbn, City Planner Mark Koegler, Building Official Jan Bertrand, Finance Director John 'Norman, Hennepin County Assessors Don Monk and Keith Rennerfeldt, and the following interested citizens: Mohamed Hamoude, Anthony Barrett, Wayne E. The Mayor opened the meeting and welcomed the people in attendance. The Pledge of Allegiance was recited. MOTION made by Abel, seconded by~ jensen to approve the Work Session Minutes of June 3, 1987; Regular Meeting Minutes of June 9, 1987; and the Work Session Minutes of June'lS, 1987, as presented. The vote was unanimously in favor. Motion carried. ,. CONTINUATION OF PUBLIC HEARING ON METHOD OF. ASSESSING The Mayor reopened the public hearing. No one in the audience came forward to be heard. The Mayor closed the public hearing. · The Mayor then stated he sees one of three things can be done: 1. The Council could vote to cancel the assessing contract with Hennepin County; or 2. The Council could take no action; or 3. The Council could take this under advisement and seek out other contract services to see if those costs would be less than Hennepin County. He stated he favored number 3. Councilmember Jessen read the letter from Leonard Kopp, former City Manager, who stated he was in favor of staying with Hennepin County. She als° noted that former Mayor Bert Larson had also submitted a letter in favor of Hennepin County. 106 June 23, 1987 Councilmember Jensen state that she submitted a letter from Geoff Michael in favor of Hennepin County. MOTION made by Abel, seconded by Smith directing the City Manager to seek out other contract assessing services and compare the costs with what the City is now paying Hennepin County. There was discussion by the Council. The vote was ~ in favor with Councilmember Jessen voting nay. Motion carried. PUBLIC HEARING: CONSIDER MAKING STREET IMPROVEMENTS TO SHORE- ,LINE BL~I). (CTY. RD. 15) BETWEEN COMMERCE BLVD. AND THE MOUND CITY LIMITS AT SETON CHANNEL BY THE CONSTRUCTION OF CURB AND GUTTER, CONCRETE DRIVEWAY APRONS, SIDEWAL~ AND STORM SEWER The City Attorney explained the background of the proposed improvement and that this is Just a hearing to determine if the Council wants to proceed.with this project· He explained the City's responsibilities as they.relate to Minnesota Statute Chapter .429. The City Engineer explained that the County is in the last stages of finalizing plans for the upgrading of Count~ Road 15. Those final plans will come back to the Council for their approval. He handed out explanation sheets and reviewed them with the public (Exhibit A) for these costs and the proposed assessments. He stated that the watermain replacement would be paid from the Water Fund. The Mayor opened the public hearing. Mr. Jim Bedell, 4801 Shoreline Blvd., presented a petition signed by 27 persons and 3 persons that were polled by phone stating the following: "We the undersigned, as abutting property owners are opposed to being assessed for the-County Road 15 improvements." Will railroad be assessed? Yes, if benefit to their' property can be shown. 2... Will credit be given to people who have already been assessed for a previous street project? Credit for storm sewer would be given, but that is all. 3. When would this become an assessment? If passed tonight~'it would be a pending ass'~ssment on all the properties immediately. q. Don't need sidewalk on both si~s of Shoreline Blvd. 5. Don't want to lose trees or shrubs on property, 6. Generally against the entire project, including street lights. 7. Don't want sidewalks, only need good shoulders, curb and gutter, and good roads.. 8.. Are sidewalks really required? Engineer to check with Hennepln County.' - The City Engineer explained the MSA Construction Fund and that approximately $189,$00 of Mound's share would be eligible for reimbursement. The Mayor closed the public hearing. Council discussion on the number of years this project has been in. the works and the need for the i'mprovemen~s. Jessen moved and Abel seconded the following resolution: RESOLUTION ~87-112 RESOLUTION ORDERING THE ADDITIONAL COUNTY ROAD 15 IMPROVEMENTS AND PREPARATION OF PLANS & SPECIFICATIONS; AND DIRECTING THE STAFF. TO NEGOTIATE A CONTRACT WITH HENNEPIN COUNT! FOR THE UPGRADING OF COUNTY ROAD 15 Motion made by Smith, to delete the sidewalks from the proposed improvements. The motion died for lack of a second. The vote was q in favor with Smith voting nay. Motion carried. PUBLIC HEARING: CONSIDER MAKING IMPROVEMENTS ON SHORELINE BLVD. (CTY, RD. 15) BETWEEN COMMERCE BLVD, AND FAIR- ¥~W ~NE BY THE ADDITION OF STREET LIGHTS 108 June 23, 1987 The City Engineer presented his preliminary report and the estimated costs. He also went over the second page of (Exhibit A) which contained estimated assessments. The Mayor opened the public hearing. -The following persons spoke: Mark Lundgren, representing Balboa - not in favor of all the street lights proposed. Paul Pond - asked if the County was requiring the new street lights. The Engineer stated no and explained the cost of the old lights to maintain and operate as outlined in his report. The Engineer further stated that they ha~.a lighting expert look at the 'area at night and the light's presently in use are not adequate. The Mayor closed the public hearing. Abel moved and Smith seconded the following resolution: RESOLUTION ~87-113 RESOLUTION ORDERING THE STREET LIGHT IMPROVEMENT ON COUNTY RAOD 15 AND ORDERING THE 'PREPARATION OF PLANS AND SPECIFICATIONS FOR SANE The vote was unanimously in favor. Jensen moved and Abel seconded the following resolution: RESOLUTION ~87-114 RESOLUTION TO APPROVE'. THE DELINQUENT UTILITY BILLS IN THE AMOUNT OF $1,931.89 AND AUTHORIZING THE STAFF TO SHUT-OFF WATER SERVICE FOR THOSE ACCOUNTS The Vote was unanimously in favor. Motion carried. VARIANCE TO RECOGNIZE EXISTING NONCONFORMING HOUSE SIZE, LOT SIZE AND SETBACK The Building Official explained the request and stated that Mr. McCrehin's father was present representing him. Mr. McCrehin tonight is asking to have the 2.25 foot setback to the south property line for his new addition also. The Staff recommended denial of tonight's request. The Council agreed.' He then explained the request and asked that one more banner than was requested be approved. This Would be put on the side of the Koenig & Robin Building. The Council discussed this and changed the date for a meeting with the Planning Commission to July 13,. 1987. RESOLUTION ON 1988 BUD,GET Two.proposed resolutions were presented to the Council, one from Mayor Smith and one from Councllmember Jensen. Motion carried. LAKE MINNETONKA REGIONAL PARK The 'Mayor presented a letter written by Mound's L.M.C.D. Representative, Tom Reese, regarding the Lake Minnetonka Regional Park. .Mr. Reese has asked that the Council approve his letter and forward it on to the Suburban Hennepin County Parks Board of 'Commissioners for the hearing that will be held while Mr. Reese is out of town. MOTION made by Smith, seconded by Johnson to approve Mr. Reese's letter to the Suburban Hennepin County Parks Board of Commissioners regarding the Lake ginnetonka Regional Park and dated June 23, 1987. The City will send the letter. The vote was 4 in favor with Jessen abstaining. Berglund LOCATION: 4622-4658 Kildare Road EXISTING ZONING: Multi-family Residential (R-4) (3OMPRJ~SIVE PLAN: Multi-Family Residential ~AL: The applicant is proposing to rezone 28 lots from R-4 to R-2 with the intention of selling the property for the development of single-family residences. All of the land surrounding the existing R-4 zone is presently zoned R-2. Due to. the configuration of the lots (see enclosed map), the property can be divided into a maximum of 10 building sites under R-2 zoning. The stacked tier of lots in Block 11, Seton, provides building parcels which are approximately 40 feet by 200 feet which exceeds the 6000 square foot minimum lot size. Additionally, many of the lots will have lots on Black Lake attached to them providing docking rights. The applicant has also petitioned for the vacation of Longford Road which, although a separate case, is closely related to this request. Vacation of Lo~gford Road would result in seven contiguous lots with average dimensions of 40 feet by 340 feet. The existing R-4 zoning provisions allow single-family detached uses. Since the existing lots are Lots of Record, required setbacks under the R-4 zone are 10 feet on one sideyard and six feet on the other. Lots of Record in the R-2 zone are permitted to have two 6-foot sidelrard setbacks. Since the lots are only 40 feet wide, the applicant is trying to maximize the allowable building area. OOMMENTS: In order for the property to be rezoned, either conditions must have changed or a mistake had to have occurred in the original zoning designation. For approximately the past 10 years, the applicant has been attempting to market the property for a multi-family use. Due to market conditions, the effort has been unsuccessful. The applicant feels that single- family homes in the area would be more marketable. From the City'.s perspective, single-family homes would also be lower density in an area which has very narrow rights-of-way and streets. Kildare Road provides existing street frontage to four of the 10 lots. These four lots will be developed as Phase I with the development of the remaining lots requiring the westward extension of Kildare Road. Utility extensions to serve the second phase will also be necessary. Mr. Berglund's proposed rezoning comprises a m~jority, but not all of the R-4 zoned land along Kildare Road. Rezoning of only Mr. Berglund's holdings would result in small spot-zoned areas on both the east and west sides of the subject property. In order to alleviate this situation, it is suggested that the rezoning review include all of the existing R-4 land in the immediate vicinity. The Planning Co~mnission could recommend that 'the City Council's publ~ic hearing focus on the entire R-4 area rather than only on the property under Mr. Berglund's ownership. ~ATION: Staff recommends approval of the rezoning from R-4 to R-2 and amendment of the comprehensive plan designation from multiple-family to single-family residential for the property .subject to the following c~ndi t ions: The Rezoning and Comprehensive Plan Amendment shall include all of the R-4 designated land along Kildare Road. Koegler stated Mr. Bergland's land comprises the .majority of R-4 land, but does. not include all of it whichwould result in a number of little spot zoned parcels and suggested the C~,~ission could recu~L~nd the City Council's public hearing be published as one that would focus on'rezoning that entire areaof R-4 to possibly R-2. The staff reco~nds approval of the rezoning and also amending the comprehensive plan designation from multiple-family to single family residential for the property subject to the 4 conditions in .the Planner's report. The Chairman opened the public hearing. The following persons had cou,aents and generally objected to the rezoningbecause of the density and narrow- ness of the proposed parcels: JIM KUTZNER, JIM LANIEL, SALLY BOSIGER, HAROLD KUTZNER and GORDON WOLF. NORMANBERGLUND stated all the lots are 40 foot wide; they are requesting R-2 Single Family Residential Zoningbecause that zoning is all around this area of R-4; they also want to reduce the require- ment for side yard setbacks from 10 feet and 6 feet (R-4 requirement) to 6 feet on both sides which is allowed in R-2 Zoning for lots of record in order to allow the maximum building area on the lots. As there were no others wishing to be heard, the Chairman closed the public hearing. The Commission discussed the proposal andhadvarious co~,u,entsandquestions. including possibly changing zoning to larger lots, such as R-1 with 60 foot frontage required on the right-of-way. Some c~uents were that R-1 would be spot zoning just as much as the R-4 seems to be; a variance from the LMCDwould be required to put a dock on 40 foot wide lots, etc. The staff .noted that there was a plan drafted during the road improvement to provide street access and utilities to the remainder of those lots in the future and this or some plan would have to be put in place before those lots would be issued building permits. We would suggest that the City consider for vacation all of the right-of-way for Longford Road between Black Lake Lane and Kings Lane. At the present time, this platted R/W is not used by the City for either street purposes or City utilities and it appears it would not be feasible for such use in the future. All the lots in Blocks i and 2 adjacent to the proposed vacation are owned by the same parties that own the properties in Block ll, with the exception of Lots i and 2, Block 2. These two lots are owned by separate individuals who do not own any Other property in the vacinity. For the City to: completely vacate this street right-of-way, they would be denying these owners access to their property, even though both lots are completely in the flood plain. In discussing this matter with Jim Fackler of the Parks Department, we have learned that there are designated dock sites within the Kerry Lane R/W, but these sites are presently not used. From the information we have, it appears the City should not vacate Kerry Lane if they wish to retain dock sites in this area and if Longford Road is vacated, the City would need to retain some type of easement for pedestrian access to Kerry lane and also Lots i and 2, Block 2. A 15 foot wide easement would be more then adaquate for pedestrian access. Reason givenwas that it was not needed for access or lot area to make buildable sites and a concern for protection of public docks and to give the City some say in what future marina development might be. He has been doing tax rebates for 2 years from what this person did. I spoke to the City Clerk in Hanover and she reported that Hanover has property in two counties (Wright & Hennepin) and the Council feels having one person assess both the property in Wright and Hennepin Counties is more equal· She did mention that that they provide fire service for parts of several cities done by a private contract assessor and she does have a problem obtaining assessed values from him at fire contract time. * These cities are not counted in private assessing because the person doing them is either employed full time or part time as an employee· 2 other cities with property in 2 counties contract with the county in which most of the property lies for assessing. The ones that there are, are not interested in bidding Mound. One of the main points that most of the private contract assessors mentioned was having someone who is familiar with the ~area perform the work. Mound is a very unique city. It has lakeshore and non-lakeshore, very small parcels and large parcels, irregular lots, expensive and inexpensive homes, and for the most part is fully developed. Hennepin County's assessor for our area is Mike McDonald. Mr. McDonald lives in this area and assesses Mound, Spring Park, St. Bonlfacius and Minnetrista. He is very familiar with the area and often uses Mound's Council Chambers for his office, thus giving the citizens access to him by phone and in person. 3 Also please note that our Assessing Contract with Hennepin County states, "...this agreement will continue for an indefinite number of annual terms thereafter, except that the same may be terminated after the initial period of six months' notice, in writing, by either party, such notice to be given on or before July 1 of the year in which either party elects to terminate this agreement." The area in question appears to only effect two homes at the end of the block,~and users of the commons area. One of the residents, Mrs. LaPointe, has requested ~that parking be allowed On her side of the street.~ Both sides of the street from Wren Road to the dead-end are currently no-parking. To allow parking on one side of the street does not appear to present any major, problems from .apolice standpoint. A concern is the fact that Gull Lane is no-parking on the west side of the street from.Three Points Boulevard south to Wren Road and it may be more consistent to allow parking on the east side of the street south of Wren Road. The Fire Chief has indicated that eliminati.on of no parking on Gull Lane at Wren Road would cause a serious problem for fire fighting. It would be difficult to get a fire truck through the street. The inspection Department had 22 working days in June. Marge attended one Planning Commission meeting and the Park Commission meeting with one week's vacation during the month. Zoning reports were submitted to the Planning Commission. The Planning Commis- sion referred 14 zoning cases to the City Council for action which required 5 public hearings; 8 variances, 2 street vacations, 1 rezoning, I subdivision and 2 conditional use permits. Writing of correspondence, resolutions, and Planning Commission reports were sent out from the Department. Correspondence received during the month were reviewed; recording of inspections were made on a daily log. A substitute inspector was called in for the llth of June. One formal complaint was signed during the month of June as well as 3 citations were issued. Correction orders were given for the vacant building at 5900 Glen- wood Road and 4965 Hampton Road. Bids were obtained for boarding of the struc- ture on Glenwood Road. June 'Monthly Report July 8, 1987 - Page 2 Meetings were held with Paul Meisel, Dick Smith, and Jim Nordby to discuss vari- ous building construction projects. I met with the Fire Department regarding the installation of the gasoline tank for Surfside Marina. June Hyland, Animal Patrol, met wlth me to discuss the complaints received for exterior storage and progress of those complaints as wel'l as.the re-inspection of various sites. The Inspection Department met with Public Works, Engineering, and the City Planner to discuss construction, planning requests, and corrections to various properties. I met with Victor Niska of the School District to.discuss remodeling of the Shirley Hills and Grandview Middle School. -A Budget Meeting was conducted as well as the monthly Staff Meeting during the month of June. Plan review was conducted on. numerous homesand duplexes during the month of June. A contracted Plan Reviewer was hired to do 7 plan rev.iews for single family homes. I attended the North star Chapter meeting of I.C.B.O. in Rochester in conjunction with the League of Minnesota Cities. The subject'covered was the Code changes proposed at the September National meeting, the new Stat~ Legislation pertaining to Building Inspect'ion Departments, new material was presented for water piping. The afternoon'was a comparison with the National Fire Protection Association Life Safety Code lOl.and Uniform Building Code requirements. These two cOdes have the same intent and require some change in wordi'ng to align them together for better enforcement purposes. The normal shopping trips were made during the month of June; gasoline at Super- America, pick up f!lm at Snyders Drug Store, and picking up printed material at SOS Printing. The total number of building permits issued in the month of June was 46 with a'valuation of $768,817. The valuation figures are attached on the Building Activity Report for May and June. In addition, our Department prepared the .monthly calendar of the June City meetings and events. We arranged with the Public Works Department to have a grave site staked out for a burial and also several sites staked out for markers in the Mound Union Cemetery. Marge prepared the Park Commission agenda and wrote the minutes as well as typing some~material for the Parks Department. We have been working on this project for about two months. The problem being that we couldn't get any cooperation out of Dakota Rail, they always had some excuse why they couldn't work on it. Finally the 4th of June they called and said they were ready. They showed up with 7 men and no equipment, the understanding was that all the city had to do was cut the blacktop and repave the approach, well it didn't work out that way. The City crew did the completejob except lay the new rails and ties. We removed the rails and ties, subcut the track bed, hauled excess material away and repaved the approach. A job that should have taken 4 hours took the better part of 2 days. The street sweepers were busy this month, we cleaned the downtown area 7 times, mostly because of the contruction at the ~ank and VFW and also the City Days celebration. 'We repaved a section of Fairview Ln. that caved in 12' X 25' patch. We got 2 bids on some retaining wall repairs, 2 stone walls and 1 wood. Bjork County Stone Inc. got the bid, one stone wall was 30' X 4', the 2nd wall was 35' X 4' total price was $2,418.05. The wood wall was 80' X 18" cost to replace was $1,248.00, work has been completed. We had storm sewer problems on Emerald Dr. and Clover Cr. They were both dug up and repaired and the street patched. We are still working on streets and parking lots getting them ready for sealcoating. It's going slow because of all the extra work coming in. We hope to be ready the week of the 2Oth. STREET SIGN WORK We installed 2 Slow Children, 2 No Parking and 8 Stop signs. Someone is ripping off Stop signs, 6 in one weekend. I heard many positive comments about everything from the race up to the fireworks display. The weekend projected a positive image for the City of Mound. The compost site won't be open again till fall there was only 1 person showed up between the 2 Saturdays. During June's pickup 396 stops were made, that makes about 13 percent of the households in Mound are recycling. So far this year 113.68 tons of material has been recycled from the City of Mound. This years goal is 230 tons. This figure does not include anything from the compost site which is measured in late fall. I'm sure we'll go over our 230 tons. The League of Women Voter of Crystal/New Hope produced a video about Solid Waste Management Proposals in Hennepin County. The name of this video is "TRASH". It will be played on Channel 20 so watch the paper for the day and time. In the matter of Police equipment #844 th~ highest milage and oldest of the squads is starting to show its age. Major repairs will soon be needed. I believe this car is up for replacement after this budge~ year. June's Activity Report WATER DEPT. We pumped 37,900,000 gallons of water for June. This is up 8.5 million gallons over May due to the dry weather. Through the first 6 months of 1987 the average amount pumped per month is 25.5 million gallons. This is an increase of approximately 7%. Water main breaks were down for the first 6 month in 1987 by 3o 7 in 1987 as compared to 10 in 1986. Again partly due to the mild winter. The amount of new customers connected to the City water has doubled in the first 6 months of 1987 (31) as to 16 in 1986. With the new "get tough policy" on delinquent water bills the amount of turn-off for the first half of the year is down to 27 for 1987, compared to 41 in 1986. As for the month of June it was business as usual. There were 1029 meters ~read out of 1052, 68 final readings, 11 meters tested and ready to be put back in service. Construction is moving at a fast pace, lots of plans and questions. Steven's Well pulled the #1 pump at the Booster Station. The motor and bearings were making unusual noises. Pump is back in service now and working fine. SEWER DEPT. Sewer line maintenance has been keeping Scott busy. He is working in the Tonkawood area. With Scott working on sewer line Damon has been working on lift stations, manhole repair and with the Street Dept. on locations and raising of manhole covers for the sealcoating project. For the first 6 month of 1987 there were 4 sewer back-ups the same as 1986. STATISTICS The police department responded to 756 calls for service in June. There was a significant rise in Part I offenseS from May to June. Thirty-two Part I offenses were reported in June, up 68%. Those offenses included 25 larcenies, 4 burglaries, i criminal sexual conduct, and 2 vehicle thefts. Part II crimes accounted for 61 calls; including 4 child abuse/neglect, 4 forgery/NSF checks, 16 criminal damage to property, 4 liquor law violations, 3 DWI's, 6 simple assaults, 9 domestics with 5 assaults, 3 harassment complaints, 7 runaway/incorrigibility, and 9 other offenses. The patrol division issued 95 adult citations; including 19 parking violations. Juveniles received 23 citations for various driving offenses. A total of 51 warnings were issued. One adult and 10 juveniles were arrested for felony offenses during the month. Twelve adults and 34 juveniles were arrested for misdemeanor violations. The department'responded to 18 medical emergencies, 9 property damage accidents, and 4 personal, injury accidents. There were 90 animal complaints during the month. The department assisted on 18 mutual aid calls. Property valued at $7,535 was stolen during the month of June. Traffic violations are down for-the second month due to the de-emphasis on traffic and the prohibition on stationary radar. Officers are continuing to do additional follow-ups of cases to assist in the increase of cases needing additional investigative work. II. INVESTIGATION Approximately forty-two hours of investigative time was spent on 8 different cases of child abuse/neglect. One case alone accounted for 30 hours of investigative follow-up. That case involves a man in his twenties who has been sexually abusing an elementary school boy. The cases that were investigated during the month included 3 worthless check cases, 2 auto thefts, theft of video tapes, a domestic case, a runaway, and several thefts. SEt. Hudson attended a local socfal service providers committee.to' assist in defining local, needs. Sgt. Hudson was assigned for one week to work with Officer Limond who was hired in June. Hudson familiarized Officer Limond with the facilities used by local law enforcement, and also worked on report writing and proper forms to be used for reporting. Eight formal complaints were issued in June. Among.. the complaints were violation of a protection order, reckless driving, criminal sexual conduct in the first degree, fleeing a police officer, and DWI. The department, has had 38 child protection cases in the first six months of 1987~ III. MANPOWER Officer Todd Limond was hired June 22,1987, to replace Kyle Larson. Todd will be trained under a field training officez for a period of several months and will.serve a probation of one year. Officers used twenty-two days of vacation, 6 days of comp-time, 2 holidays, and 2 days towards training. The police secretary also used 8 vacation days in June. Officer Grand spent some time i~ the schools for the last week of the year to assist with control problems. Robert Meuwissen will be doing a two month internship with the department for his law enforcement degree through Mankato State University. IV. OVERTIME There were 15 hours of overtime used to cover short shifts in June. An addi- tional 22 hours of ~vertime was used during Mound City Days to provide security for the'race, parade, and the fireworks. There was some additional overtime due to late cases and. arrest situations. V. TRAINING Only two days were used for training in June. ThrOugh the s~,mmer months, training will be kept to a minimum due to vacations and patrol needs. VI. POLICE RESERVES 'The police reserves donated 371 hours to the police department in June. Community service functions accounted for 117 hours of time, including Mound City Days. Reserve officers were involved in 139.5 hours of ride-alongs with regular officers. Mound City Days required a lot of preparation of Mound Bay Park in trimming, painting and equipment placement to meet deadlines. Because of this, we fell behind in mowing City properties and parks. With the hiring of a new seasonal employee, to replace one who did not return from last season, has helped to catch up. With the addition of the rip rap project this season and for the next three years, there is a need for an additional seasonal employee. We are also looking at replacement of parks play equipment and installation of new equipment by city crews. If monies are approved for this equipment, we will have to have this additional seasonal person to do installation of equipment and site preparation. CEMETERY The lack of precipitation has not helped the grounds at the cemetery, and .bas slowed down the mowing needed. The caretaker, Howard Simar, has been busy resetting headstones that have settled. COMMONS The low water level of Lake Minnetonka continues to create problems. With docks not being accessible, both commons and private, we have been receiving alot of calls. The Jennings Bay dredge is still being worked on and has consumed alot of time. We hope to have a conclusion to this in July. It now is being looked at as a private dredge from the Jennings Bay Association with the City coming in later to dredge along Dove Lane only. PARKS DEPARTMENT JUNE 1987 REPORT JULY 1, 1~87 PAGE 2 TREE REMOVAL June has been slow on tree removal. We have scheduled four trees to be felled and Three Points Park trimmed. There has been three complaints on hazardous trees on private property that needed notices sent. SUMMER PARKS The parks program has began and is at Clover Circle Park, Three Points Park, Belmont Park and Swenson Park. Kelli Heyer is the Program Super- visor. PARKS We are in the process of getting the Parks caught up id mowing, li'tter pick up and equipment repair. Again with the rip rapping project on the Commons, there is a need for an additional seasonal maintenance man. Some of our parks are being used as a disposal for lawn clippings, brush and leaves. We hauled two pickup loads, from Three Points Park alone, that was left by residents. Sales for the month of June last year were $79,027. We had one more day of business in June of this year, compared to June of last year. To date this year, sales are $390,465. Last year at this time sales were $378,088. For the first six months of this year we have had 44,719 customers. This is almost identical with last year at the same time when our customer count was 44,447. Therefore, the $12,377 increase in sales is due primarily to the cost of goods rising. A good part of our time spent in June focused on adjusting liquor, wine and beer prices. For the most part, when I say adjusting I mean raising prices. The increase in state excise taxes went into effect June 1st on alcohol beverages. On the average, a bottle of liquor rose about 10¢ on a pint to anywhere between 20¢ to 40¢ on a one liter size. About 50¢ to 75¢ on a 1.75 liter size. Beer rose a nickel a six pack and 15¢ per case. Wine was affected also. A 750 ML-bottle went up about a dime. Larger size bottles of wine such as 3L's and 4L's took a 20¢ to 40¢ hike. Some.wine categories were hit more brutally. Sparkling wines (champagnes) and h~ghly fortified (high alcoholic content) dessert wines took a double beating. With the end of June comes our annual mid-year inventory. It seems to me every time I turn around we are having one. Inventory was conducted June 30th at 8:00 PM, after we closed for the day. Hopefully, by August 1st I will be able to report to you the outcome of the inventory. Legal notices for the two special meetings were prepared and published. There was Agenda preparation and items to clear up. after each meeting. The improvement hearing notices on the County Road 15 Improvements and street light replacement were prepared, published, posted and mailed in a timely manner to the affected property owners. The list of property owners affected supplied by the City Engineer was checked against Our tax books to assure that the current owner received the notice. Notices for all the public hearings on Planning Commission items that came to the Council in June and will come to the Council the beginning of July were sent' to all affected persons. Note that any notices sent on public hearings have affidavits of search, mailing (listing the persons and property identification numbers of each affected property), and some posting that have to be filled out and notarized to make them legal. Final Mound City Days preparation was handled on the parade and fireworks. I worked on a card index for the following: City owned property; Tax forfeit property that has been retained by the City for a public purpose; Tax forfeit property that falls into the following catagories: a. Property released for public sale; b. Property for sale only to adjoining property owners. There are 303 parcels. Each card has a PID (property identification number), plat and parcel, legal description, status (what it is, park, wetlands, tax forfeit, etc.), whose name it is in (State Land Dept. or City of Mound or both), any resolutions dealing with the parcel (date passed and resolution number). I still have to coordinate the Certificates of Titles, State Deeds, easements, etc., for the parcels that are the City's. This list, when all the information is on the cards and kept up-to-date will be invaluable when someone calls in to check on a parcel of land. I updated, by department, the pay increases for budget purposes. 10 parcels of land will be on the Council Agenda for July 14th. 9 of the parcels were tax forfeit at one time. 1 parcel is city owned land. COUNCIL APPOINTHENT 'WESTONKA PUBLIC SCHOOLS 5600 Lynwood Boulevard Mound, Minnesota 55364 REGULAR SCHOOL BOARD MEETING JUNE 8, 1987 (Minutes to be approved July 13, 1987) The regular meeting of the school board was called to order at 8:03 p.m. in the Lecture Hall of the Westonka Community Center. Present: Board Members Chelberg, Fritz, Hallowell, Mayer, Pechtel, Pitsch, and Schmidt; Member-elect Frahm; Asst. Supt. Myers, Business Manager Schmidt," P.R. coordinator, administrators, staff, students, parents, and public. Absent: Supt. Stevenson. The Oath of Office was administered to Gretchen Hallowell and Thomas Frahm, who were elected to three year terms on May lgth. Treasurer'Fritz welcomed John Lock and Charles Landsman, boy scouts, who were attending the meeting to earn merit badges in communications. Motion by Chelberg, seconded by Hallowell, that the school board approve as presented the minutes of the regular/election meeting of May 19, 1987. Motion approved by unanimous roll call vote, all members present. Treasurer Fritz thanked department heads for their input on budget cuts for 1988-89 and stated the materials will be shared at the June 22 study session. The Policy Committee will schedule a study session in July to study the proposed changes to the Attendance Policy. Motion by Chelberg, seconded by Schmidt~ that the school board approve as presented the current financial documents and Treasurer's Report indicating present balances, including bills paid after the last board meeting; and further resolved that the school board approve the payment of current bills and claims and routine transfer of funds for budget maintenance.* On roll call vote all members voted aye, all present. The following reports were presented: Larry Litman and Mary Harty- Norblom reviewed the district program for the Academically Talented. Victor Niska presented a summary of studies relative to the Use of Seat Belts on School Buses. Gaylen Thostenson and Dr. Wayne Smith reported on the Attainment of Respective Building Goals for the 1986-87 School Year. Dr. Pam Myers reported on the Implementation of Policy 6139 - Curriculum Review, 198§-87. Chelberg moved, seconded by Schmidt, that the personnel transactions be approved as recommended.* Roll call vote: all aye, all members present. Motion by Chelberg, dual second by Schmidt and Pechtel, that the school board appoint Carol Sandberg to the Community Services Advisory Council beginning June l, 1987, for a term of two years. On roll call vote the motion was approved unanimously, all members present. DIST. 287 JOINT BOARD REPRESENT. Motion by Chelberg, seconded by Hallowell, that the school board appoint Judson H. Anderson as a member of the District 287 Joint Board and representative of District 277 for a two-year term ending June 30, 198g. Motion unanimously approved on roll call vote, all members present. Mr. Anderson was present and suggested the new superintendent and board member be introduced to District 287 via a visit to the campus and dinner. MILK BIO BLOCK GRANT APPROVED. ENABLING BUDGET SUPT. EMPLOYED OPEN AGENDA Fritz seconded the motion by Chelberg that the school board accept the bid 'of Meyer Bros. Dairy, Inc. of Wayzata, for 1987-88 milk supplies.* Unanimously approved by roll call vote, all members present. Schmidt and Hallowell seconded the motion by Chelberg that the ~chool board approve application for available 1987-88 Block Grant monies, and does declare its intention to develop projects which expand and improve the educational program of the district, as stated in the Applicant Statement of Assurances,-and authorizes the Superintendent to execute and file application for and i.n behalf of the school district, and otherwise to act as its authorized representative in State 'and Federally funded programs. Dr. Myers gave an overview of the Block Grant history and variety of uses for the funds. On roll call vote the motion was unanimously approved, all members present. Motion by Chelberg, seconded by.P~chtel, that the school board approve the 1987-88 Enabling Budget as set forth in agenda Item #10.* All members voted aye on roll call vote, all present. Motion approved unanimously. Chelberg moved, seconded by Hallowell, that Dr. James L. Smith be employed as superintendent of the Westonka Public Schools, effective July l, 1987. On roll call vote, all members voted aye, all present. Chairman Pitsch thanked the Perosnnel Committee and all board members for the time spent conducting the superintendent search. Dr. Myers inquired whether the school bJard desired the district-wide survey results, now available, presented via an item in the school board agenda. Hallowell's question on setting of school board goals for next year was answered by Pitsch, who stated it will be done as early as possible after the new superintendent takes office. All present were reminded of the district-wide picnic planned for Sept. 13 by the Staff Renewal Committee. Chelberg thanked the community for the privilege of serving on the school board for the past nine years. Chairman Pitsch assured her all have appreciated the time and effort she has put forth over the years and all present gave her a standing ovation. Walsser Excelsior June 25, 1987 TO: ~ MINNETONKA CONSERVATION DISTRICT MUNICIPALITIES Attached is the 1988 Lake Minnetonka Conservation District budget which is generally categorized as to purpose. It has been certified by the LMCD Board of Directors at its regular meetin§ June 24, 1987. Minnesota. Statute Chapter 907, Section 4 ~pfovides: "Expense of the district shall be borne by the municipalities. The portion of the expenses borne by each municipality shall be in proportion to its assessed valuation." Section 5 provides: The board of directors of the district shall on -or before July 1 of each y.ear, prepare a detailed budget of its need for the next calendar year and certify the budget on that date to the governing body of each municipality in the district together' with a statement of the proportion of the budget to be provided by each municipality. The governing body of each municipality in the district shall review the budget, and the directors, upon notice from any.municipality, shall hear objec- tions to the budget and may, after the hearing, modify or amend the budget, and then give notice to the municipalities of modi- fications or amendments. It shall be the duty of the governing body or board of supervipors of each municipality in the dis- trict to provide the funds necessary to meet its proportion of the total cost to be borne by the municipalities as finally certified by the directors, the funds to be raised by any means within the authority of the municipalities and to pay the funds into the treasury of the district in amounts and at times the treasurer of the district may require. The municipalities may each levy a tax not to exceed one mill on the taxable prop- erty located therein, to provide such funds. Said levy shall be within all other limitations provided by law. This budget reflects anticipated changes in activity of the District to implement the recommendations of the Metro Task Force on Lake Minnetonka. To continue the development of a Comprehensive Lake Management Plan, $15i000 has been added in Consulting Service, and $25,000 in Contingency. The $50,000 for planning is expected for a three year period, with at least one half to be supported outside the tax levy. ~ake Minnetonka Conservation District LMCD Municipalities June 25, 1987 Pa§e 2 To ensure continued development of the Comprehensive Plan, $25,000 was placed in Contingency. Efforts will continue to gain financial support from interested area-wide agencies to offset a share of this expense. To further develop the LMCD Public Information Program, $10,000 has been budgeted. The District is continuing to develop its legislative program for 1988 to support research, development, and funding for the regional aspects of the program. The District has also adjusted its fee schedule for additional support. These programs have been initiated in response to the Metropolitan Council Task Force on Lake Minnetonka recommendations, which will be reported to the legislature next January. The total budget request of $194,148 represents an increase of $28,136 from last year's $62,912 levy, and an increase of $26,700 over last year's Other Income of $77,100. Other Income includes license and permit fees, court fines, interest, and other miscel- laneous revenue. Distribution of the levy to the villages would also be an increase of approximately 44.7% over last year, depending on relative changes in assessed values. The budget now levies approximately 45% of the 1/3 mil allowable under the Statute, compared with 32.8% last year, 39.8% in 1983, and 75% in 1975. The budget provides the following adjustments: 1. 4% for salary adjustments. 2. An increase of parttime office clerical from 12 to 15 hours per week° Continued adjustment in the Capital Outlay to replace funds expended for the Xerox, Memorywriter, 'and for other future office equipment purchases. 4. Office equipment maintenance contracts. 5. Provision has been made for increased insurance costs. e Provision has been made for an increase from $10,000 to $25,000 for anticipated consulting services, and $25,000 added to Con- tingency to develop a Comprehensive Plan. 7. $10,000 is included for a Public Information Program° The Metropolitan Council Task Force on Lake Minnetonka recommended certain changes in LMCD activity levels to meet increased management demands on Lake Minnetonka. The LMCD legislative proposals, the development of a Comprehensive Plan for the Lake, and an increase in Public Information Program to improve visibility of the District and its programs are proposed in response to the Task Force recom- mendations. The cost of these proposals for 1988 are reflected in this budget. Comprehensive Plan costs are to be spread over a three year period. Metro will report to the Legislature on the progress of these programs next January. Hickok and Associates DATE: June 18, 1987 RE: Lake Level, Flow and Precipitation summary for April and May, 1987. Lake levels in Lake Minnetonka have continued to decline through April and May as illustrated by the attached graph and lake elevations. There has been virtually no discharge from Lake Minnetonka into Minnehaha Creek since October 20, 1987. Minnehaha Creek at the Browndale Avenue Dam in Edina has maintained a flow rate of approximately 4 cfs throughout both April and May. This is shown by the Monthly Flow Summary. The 30 year average precipitation for April and May at the National Weather Service Station in Maple Plain is 6.28 inches. The actual precipitation recorded in Wayzata for April and May was 2.06. He reviewed the pYesent or'di.nance and the adoption dates:of: last year. He stated that the City'Council wants clarification on certain items within the exterior storage ordinance'such as: .Defining storage versus parking, and is the ordinance· tOO restrictive? ' Planning Commission Chairman opened discussion, to the audience and asked for comments; Marry Duhachek, 19$7'Lakeside Lane, questi?ned motor homes and what is allows? Don Cox, 5139 Emerald Drive, asked the commission to define, '5vhat is storage"? Bob Smith, .3232 Gla'dstone, commented that larger and bigger boats are being purchased, 30 foot maximum'length is not long enough; no definition to length should be applied; only reference to .derelict equipment. Gary Brown, 5971Gumwood Road. He stated he would llke to have stock cars on his property eve6'if it )s.to be :arped.. He forwarded to the Commission a definition of a stock car. Nick Scheuer.., 5019 Shoreline Boulevard, asked what the Commission's intent of the ordinance"pro¥is!ons are regarding an appeal process; does the. City have. property available..for storage? The planning Commission asked Steve Smith, in the audience, to state his intention to'limit the'ordinance. Steve stated his intention was to address the ordinance only to safety issues. The'Planner also stated that a variance 'to the provisions of the'Zoning Ordinance does apply to .exterior .storage, John Ruud, h560 Hanchester Road, stated he felt that 30 feet was too restrictive for recreation equipment:and also the front yard setback was too restrlctive. Ken Smith questioned race car'drivers as to why people would be calling to complaln, is it because they have-vehicles torn'apart and are 'in the process of rebuilding cars. Gary Brown said he understood'the complaints were.due to the residents considering them an eyesore. ~ John Thoresen, 5845 Fairfield Road, asked the Commission to concentrate on junk rather than recreation vehicles.or equipment. He presently has a pickup camper and a boat stored on his property, out-of-season'storage versus in-season storage. Commission should consider variances'on~corner lots, and he stated his neighbor presently has a hot air balloon, He questioned how the ordinance defined measure- ments of various dimensions. Ra¥"Frederickson, 6001..Gumwood Road, asked'why is the City concerned about recrea-~ tion storage? Shirley Gustafson, $1~2 Tuxedo 8ouievard, stated the City needs restrictlon on stor- age including recreation vehicles and uncovered equipment, weeds; it is unsightly -and dangerous to children. .~icky Theobald, 507D ~oodridge Road. She. didn't feel t'he ordinance would have.to put a limlt on length of'recreation equipment, but setbacks should be maintained. Don Cox, Emerald Drive. ~hat.iS the length of time that you can park on streets? for how.,long? The Planning Commission consensus'was they did not feel'overnight parking was 'restricted except during the winter months. The Chairman thanked all in attendance for their time and concerns. Bill Meyer asked questions of the aud.ience r.e§arding how many.ciS~want a law to govern? · ' Two in the audience raised 'their hand. Does the audience think we would be better off with..an ordinance to concentrate on junk and debris? There was no vote of the audience, but Mr. Meyer felt that the majority of people in Mound want some control with ordinance provisions regarding .recreation equipment. '- Shirle'y Gustafson stated tha:t pictures were taken and she would forward them to the Commission showing exterior storage on property that she felt was offensive and asked whether or not there were any excavation rules for landscaping yards? Oennls Stahlbusch, 4943 Monmouth Road, questioned the Commission on how ordinances' are adopted. Bill Thal explained the structure of the Planning Commission as an advisory body and. the structure of the City Council. Geoff Michael felt that the Mayor should comment as a private citizen at the Plannlng Commission meeting and Plannlng Commlssion Hinutes 'June 23, 1 87 - Page not as representing his office as Mayor. The-Planning Commission adjourned for ten minutes after closing the public hearing. The Planning Commisslon opened discUssion for the membership. Ken Smith discussed separating the Ordinances on debris.versus a'storage ordinance; We need a clarifi- cation of measurement of equipment, .and'a'property owner should be only able to store a 30'foot boat. Vern Anderson introduced the comments from Brad SohnS re- garding the present'ordinanceand some ideas he had on the handout. Brad asked if the Commission .would want. copies of his comments and they stated they did. Geoff Hichael .stated that the.length.measurement should be defined. Bill Heye~ discussed whether tarping boats, should be required.as deflning some perimeter of storage or blocking of boats.versus, trailering a boat on your yard. Frank Weiland commented that he feels a person:should 1|mit height, number o~ vehicles, as it could block light,' ventilation and view from a persons property; He also. mentioned whether or not fire equipment' could be brought unto a property and what possibly. would constitute a fire hazard. Chairman Reese stated that the neighbors are reluctant to' complain. He feels that persons attending a public hearing .tend to have many more negative comments than the general public. We need rational ordinances to keep'people.from getting abused. H'r. Andersen said.people that he had talked to did not want limitations..He ques-- tioned' approximately 20 to 30 people. · ........... Ken Smith and Tom Reese, both.made comment that if.peOpl~ are agalns't.somethin~ .than they will attend hearings. Bill Meyer stated'.that when you look at theSame area. you don't notice what may be objectionable to someone else. .When.you start traveling to an unfamiliar area, than you notice the'storage. 'Mr. Sohns said he heard people, say, if you have room, you can store equipment on your propertyt' ' They were concerned about overcrowdl'ng; Ken Smith commented that if restrictions are made in the ordinance, it cleans up the neighborhood area, such .as junk all over, storing of boatg, restoring of cars. Hr. Andersen asked'if there was a group represented 'in the City that would come out with a statement to oppose or.support the ordinance. Hr. Weiland said he 'had talked to people who were against 'height and large sized recreation equipment. would Tom Reese/like; the Commission to give the staff direction on the censensus of the Commission: 1. Define recreation vehlcles, recreation equipment:. (motor vehicles) 2. Race cars should be addressed in the ordinance. 3. Defining how a measurement of length should apply to r'ecreational equipment. h. Possibly define recreational vehicle unit, such as 2 snowmobiles on one trailer as one recreational unit. Broaden the definition of recreation.equipment to posslbly include fish house, exclude sno~obIles on trailers, remove length restriction, but're-instate sideyard and 'rear yard setbacks, keep front'yard setback. Six foot sldeyard or rear yard was discussed as a limitation. Exceptions for corner lots should apply', front yard setbacks could be from.the driving surface and/or sidewalk at 20 feet throughout the City. 9. Exclude wood piles. 10. Define storage, eliminate parking altogether as anything parked on the property would be considered storage, and posslbly look at active and inactive storage definition. 11. 12. Limit the area of a property covered by storage to a percentage of the lot. Residential areas or uses could be defined as there are residential properties In commercially zoned areas. The Planner suggested bringing these suggestions, back ~o the next meeting as the time is limited for respona., to the City Council. The City Planner will get materi~ to the Commission regarding new Supreme Court decision pertaining to Zoning as requested by Bill Thal.
