Since that time, the property damage was assessed and adjusted by independent adjusters representing the insurance firms of both the City of Mound and Metropolitan Environmental Services. Both determined that their client was not at fault. To work through this matter, independent engineering professional, Don Brauer, has been hired as mediator. As an objective third party, Mr Brauer will direct the process, work through the issues and recommend a fair solution to the City Council, for their action. printed on recycled paper April 26, 2001 Mound City Council On April 22, 2001, the sewers on Langdon Lane backed up and flooded the lower levels of the homes with raw sewage for the second time in less than two years. Per Pat Meisel and Greg Skinner's request, we have obtained estimates, which are attached, outlining the work that needs to be done to remedy this problem. Also attached are lists of homes that are affected. Because the cause and corrective action from the 1999 occurrence did not correct the problem, we request the City of Mound and the Metropolitan Council cover the cost of the work. During Bob Brown's visit to our homes the day after the back up occurred, Bob suggested that our block hold a separate meeting with the City Council. This needs to occur before the May council meeting, as the threat of this problem happening again at any time, still exists. We recently inspected several homes with John Babler. We have also met with the City Public Works Department in order to determine exactly what happened on that date. We have learned the Metropolitan Waste (MCES) line at the end'of Langdon Lane paralleling the railroad tracks was surcharged on April 22, 2001 during a day of heavy rainfall. The city maintained sanitary line which connects to the Metropolitan Waste line was unable to drain into the Metro Waste line due to the high volume of water/sewage passing through the Metro Waste line. There are also reports that an act of vandalism may have been the cause of a partial blockage in the Metro Waste line. We have also learned that there was no obstruction in the city-maintained sanitary line servicing your home and, therefore, it is our opinion the City of Mound, Minnesota was not negligent in this sewer backup occurrence.
