NOTICE IS HEREBY GIVEN THAT THE CITY COUNCIL WILL MEET IN
SPECIAL SESSION ON WEDNESDAY, AUGUST 22, 2001, AT 5:30 P.M.
IN THE COUNCIL CHAMBERS AT 5341 MAYWOOD ROAD FOR
CONSIDERATION OF THE FOLLOWING AGENDA:
ITEM 1. CONSIDER, IN CLOSED SESSION, A PROPOSED
SETTLEMENT OFFER IN THE POLSTON, ET AL, LAWSUIT.
ITEM 2. ACT UPON THE PROPOSED SETTLEMENT OFFER IN OPEN
SESSION.
ITEM 3. APPROVE RESOLUTION ORDERING AN ENVIRONMENTAL
ASSESSMENT WORKSHEET (EAW) (This item to be considered only if item
immediately preceding is approved.)

RESOLUTION NO.
RESOLUTION AUTHORIZING PREPARATION OF
EAW FOR METROPLAINS PROJECT
WHEREAS, the City Council has adopted Resolution No.
settlement of certain pending litigation, (the "Settlement") and
approving the
WHEREAS, the Settlement calls for MetroPlains to "submit the Project of Mound for a
voluntary EAW, and
WHEREAS, the Settlement further provides that Mound "prepare and review the EAW for
the Project and decide expeditiously on the need for an environmental impact statement (EIS) for
the Project".
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Mound,
Minnesota that the City working through its staff and consultants is hereby directed to take the steps
necessary and do all things required to fully implement the above referenced provisions of the
Settlement.

RESOLUTION NO.
RESOLUTION AUTHORIZING SETTLEMENT
OF PENDING LITIGATION
(Robert Polston, et al vs'. Ci~_ of Mound)
WHEREAS, the City Council, meeting in closed session, has reviewed a proposed
settlement agreement involving a full and complete settlement of any and all of the claims made by
the plaintiffs concerning actions and approvals by the city in connection with the MetroPlains
project,; and has received the report and recommendation of its legal counsel regarding the
proposed agreement, and has been informed that the proposed agreement has been executed by all
of the plaintiffs and by MetroPlains; and
WHEREAS, the City Council has fully reviewed such matters and is fully informed as to
the circumstances.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Mound,
Minnesota as follows:
1. The proposed settlement is hereby approved.
2. The Mayor and City Manager are authorized and directed to execute the settlement
agreement on behalf of the City, and to fully perform all of the City's obligations thereunder.
