Dean Subject: Process for Selection of Council Member You have asked that I provide you with some guidelines for the council as it considers the selection of a replacement council member. The key point is that the votes of each council member must be public, and be recorded in the minutes of the meeting. This means that "secret ballots" are not allowed. Who voted for whom, whether in writing or orally, must be recorded. Although there are a number of ways to conduct the selection, the one that seems to make the most sense would be to proceed as follows: · The mayor would call for each council member to make individual comments about where they are in their thinking on the matter, and which candidate, if any they are favoring. Those comments might be followed by further general comments among the council members. · Following conclusion of the discussion, it would be appropriate for a council member to move the appointment of one of the candidates. If seconded, and following any further discussion by the council, the vote would be taken. If four council members are present at the meeting, three affirmative votes would be needed to select. · If the moved candidate does not receive three votes, then another motion could be made, and so on. · If the process continues through several nominations, and it appears that no candidate will receive more than two votes, then the mayor can make the appointment. A few of other points are in order: 1. The meeting is a public meeting, and it would not be appropriate to exclude any of the candidates from the meeting. 2. An abstention by a council member does not change the need for three affirmative votes. 3. Although it is a public meeting, the task at hand is for the council members to decide among themselves as to the best appointment. Public involvement should only be used if it assists in that task. 4. If possible, once a selection has been made, it would be a valuable gesture if the council would vote to unanimously affirm the decision. JBD-207095vl MU220-1 CITY OF MOUND RESOLUTIO NO. 0'1-'102 RESOLUTION TO APPOINT COUNCILMEMBER TO FILL VACANT SEAT WHEREAS, Kim Anderson submitted her resignation from the City Council due to relocation outside the State of Minnesota; and WHEREAS, the City Council accepted the resignation of Kim Anderson on November 13, 2001; and, WHEREAS, the City Council declared a vacancy in the position of City Councilmember as of November 30, 2001; and WHEREAS, the City Council has accepted applications and conducted interviews for this vacant Council seat; NOW, THEREFORE BE IT RESOLVED that the City Council hereby appoint to fill the vacant City Council seat, effective with taking the Oath of Office for this position, and continuing until the seat is filled by special election at the next City general election.
