Extract of'Minutes cf Regular Meeting of the
Village Uouncil of the Village of Mound'
Hennepin County, Minnesots~, Hel~ May 7, 1935
Pursuant to due call and notice thereof, a regular meeting of
the Village Council of the Village of Mound, Hen_nepin County,
Minnesota, was duly held in the Oouncil Room ~n ,the basement
of the State Bank of Mound in said Village on the 7th day of May,
193§, at 8:00 o'clock P.M..
The following Trustees were present: W. fi. Huestis, president,
Yost, M~rch, Tuff and Horton..
The 0bier of the Fire Department presented their proposition as
to what they could do toward helping to purchase a smaller Fire
Truck to respond to outside calls, and on motion by
seconded by March, that fins/ action for the purchase of new
Fire Equipment be postponed until arrangements could be made
for financing same. Motion carried.
Minutes of the Regular Meeting held April 2nd and the ~inutee
of Special Meetings held April lSth and April ~gth were read and
approved as read.
The a~plication of Dr..J.H. Spears for & buXlding permit .was
read. A motion by Trustee March, seconded by Tuff, that permit
be granted to Dr. ~pears. Motion carried.
The road committee was instructed to secure the Deephaven Grader
at once and Shape up the streets.
The Clerk was instructed to purchase a dozen Flares for use on
the rosAs when left in dangerous condition over night.
Motion by Horton, seconded by Tuff, that the Telephone ~e moved
to the Pump House. Motion oamried.
allowed$50'00 for assistance given by him in checking lots for
the Water Main assessment. Motion carried,
Bills were read and on Motion by Yost, seconded by March, that
bills be paid and clerk draw warrants for same. Motion carried.
Petition having l~en made for the vacation of certain parts of
Fern L~ne, Maple, Willow and Linden streets, and all the owners
of the lots and parcels of land contiguous to the parts to ~e
vacated having assented thereto, a pbulic hearing to consider
said petition shall be held at the forthcoming, meeting of the
Village Council of the Village of Mound, i:..to be.. held on the 7th
day of May, 1935, at which time all persons interested m~y

The parts of said streets, which the petition requests may be
vacated, are as follows:
Fern Street from the South line of Lot 8, Block S, Abraham
Lincoln Addition as extended westwardly toward Todd avenue to
the South Line of Lot ~, Block ~.

Crocker'e First Division, Lakeside Park, as extended westerly
to Todd avenue.

to Todd avenue.
Linden street from the South line of Lot 1, Block 1~, A. L.
Crocker"s First Division, Lakeside Park, as extended to
Todd avenue.
A Petition was presented signed by property owners in the
locality objecting to the vacating of any of. the streets
above mentioned, Maple street particularly, and after due
consideration Trustee ¥oet offered the following Resolution
and moved its adoption: That all Streets above named be
vacated except Maple street. The motion for the adoption of
the foregoing zeeolution was duly seconded by Trustee Marchm
and upon vote' being taken th~eon, the following vote~d in
favor thereof: ¥oet; March, Tuff and Horton. The ~ollowing
voted ~gainet the same: None. Whereupon said Resolution
was declared duly passed and adopted.
A form of bond and contrast for the construction of Water
Main Improvement Number 3 was submitted to the Council for
its approval. After due consideration of the same Trustee
Yost introduced the following resolution and moved its
adoption:
RESOLUTION APPROVING BOND AND CONTRACT.
BE IT RESOLVED by the Village Council of the Village of
Mound, Minnesota, that the form of contract between the Village
of Mound, Minnesota, and Walter W. Magee company, the
successful bidder for the construction of Water Main Improvement
Number 3 be and the same is hereby approved, and the president
of the Council and Village Clerk are au%hmrized and directed
to execute the same on behalf of the Village.
BE IT FURTHER RESOLVED that the bond furnished by the successful
bidder with the Standard Accident Insurance company as surety
in the amount of $35Q0 be approved and filed with the Village
Clerk.

duly seconded by Trustee Tuff and upon vote being taken

Trustee Yost introduced the following resolution and moved its
adoption:
RESOLUTION DIRECTING PPEPARATION OF SCHEDULE OF ASSESSMENTS
BE IT RESOLVED by the Village Council of the Village of Mound
that the Clerk, with the assistance of the superintendent of the
work~ shall forthwith calculate the amount proper and necessary
to be specially assessed for Water Main Improvement Number $
against every assessable lot, piece or parcel of land within
the district affected, without regard to cash valuation, in
accordance with the provisions of Section 1915-S, Mason's
Minnesota Statutes.
BE IT FURTHER RESOLVED that the proposed assessment as made by
the Clerk shall be filed with the Clerk for public inspection.

Horton, and the following voted against the same: None. Where-
upon said resolution was declared duly passed and adopted.
Trustee March introduced the following resolution and moved its
adoption:
RESOLUTION DIRECTING NOTICE ON ASSESSMENTS
BE IT RESOLVED by the Village Council of the Village of Mound
that the proposed assessment heretofore prepared by the Village
clerk with the assistance of the engineer, and filed with the
clerk, and open for public inspection, is hereby accepted and
designated as the proposed assessment roll eot Watermain
Improvement No. 3 of the Village of Mound.
BE IT FURTHER RESOLVED that the Village Council shall meet on
the S3rd day of May, 1935, for the purpose of hearing and
passing upon all objections, if any, to the proposed assessment,
and to amend the same as to any lot or lots and pass a resolution
adopting such assessment.
BE IT FURTHER RESOLVED that notice of said meeting shall be
published once in the official newspaper of said Village not
less than one week, or seven full days, prior to the date of
said hearing, which notice shall be in substa~ntially the
following form:
NOTICE OF PROPOSED ASSESSMENT
NOTICE is hereby given that a meeting of the Village Council of
May 7, 1935
the Village of Mound will be held at the Connctl Room in the.

the ~d day of ~ay, 1935, to a~e u~on the proposed assessment
for Watermain I~rovement No. 3 of e~d Village more partl~larly
described in a resolution, ~d that the Council will he~ ~
pass upon all objections to e~d ~seeement, ~d ~y ~end the
proposed seesment to lot or lots.
At such meeting all persons interested in said assessment may
appear before the Village Council and present their reasons
why such proposed assessments or any particular item thereof
should' not be .adopted. ABy person desiring to object to said
assessment shall, on or before the date of said hearing, file
with the Village Clerk a written statement of the objections,.
and all objections not specified therein shall be deemed
waived.
Take further notice that such .proposed assessment is now on file
with the Village Clerk and is open to public inspection.

BE IT FURTHER RESOLVED that all the terms and provisions of
the above notice be, and the same hereby are adopted ae part
of this resolution as fully as though separately set forth
herein.

The motion for the adoption of the foregoing rewolution was
duly seconded by Trustee Tuff, and upon vote being taken

Tuff and Horton, and the following voted against the same:
none. Whereupon said resolution was declared duly passed
and adopted.
The Clerk thereupon reported that he had calculated the total
cost of said improvement including the contract cost thereof
and all fees.and expenses incurred or to be incurred in
pursuance thereof and found the same to be the amount of $335S.00.
T~upon Trustee Tuff introduced the following resolution and
moved its adoption:
RESOLUTION FIXING COST AND.DIRECTING SALE OF CERTIFICATES
OF INDEBTEDNESS.
BE I~ RESOLVED by the Village Council of the Village of Moun~,
Minnesota, as follows:
1. The total, cost of the improvement in the Village of Mound
designated as Watermain Improvement Number 3 is hereby determined
to be $3362.00.

2. The Village Council has determined ~nat the entire cost of
said improvement shall be assessed against property benefited
thereby.
3. In order to provide for the payment of the cost of said
improvement, there is hereby created a fund to be known as
Fund of Watermain Improvement Number 3 into which fund shall
be paid all monies received from the assessments for said
improvement and the receipts from the sale of Certificates of
Indebtedness as hereinafter provided for, out of which fund shall
be paid the cost of said improvem.~nt and the interest ~ud principal
of said Certificates of Indebtedness.
4. In anticipation of the collection of said assessments and in
order to defray expenses incurred and to be incurred in the making
of said improvement, it is hereby determined to issue and sell
$3350.00 Watermain Improvement Number 3 Certificates of Indebted-
ness in the denomination of $335.00 each, said Certificates to
be dated 7-1-1935, to bear interest at the rate specified by
the successful bidder, but not exceeding six per cent per annum,
payable semi-annually, and to mature serially on July 1, in the
years and amounts as follows: The years of 1936 to 1945
inclusive.
§. The Village Council is hereby directed to cause notice to
be published in the official newspaper of the Village of the sale
of said Certificates of Indebtedness for two successive weeks,
which notice shall be in subst~ntially the following form:
NOTICE OF SALE
NOTICE IS HEREBY GIVEN that the Village Council of Mound, Minnesota,
will meet at the Council Room in the basement of the State Bank
of Mound, on Friday, the $1st day of May, 1935, at 8 o'clock,
P.M., for the purpose of opening and receiving bids for and
awarding the sale of 3,350 Dollars Watermain Improvement Number ~
Certificates of Indebtedness of said Village. Said Certificates
are to be ten in number and in the denomination of ~5 Dollars
each, to be dated July 1, 1935, to b~ar interest at the rate
specified by the successful bidder, not to exceed ~six per cent
per annum, and to 'mature seria~lly on July 1st, in the years and
amounts as follows: The years of 1~36 to 1964 inclusive.
These Certificates are issued for the purpose of financing a
Watermain improvement in said Village pursuant to Chapter 4~,
Laws of 19~1, and are payable primarily from the assessments
collected for said Improvement but the full faith and credit
of the Village shall be pledged for their payment. Both
principal and interest will be payable at any suitable benk
or trust comoany designated by the successful bidder. The
Village will furnish the Certificates and the approving opinion
of Messrs. Junell, Driscoll, Fletcher, Dorsey & Barker both
without cost to the purchaser.
The Village reserves the right to reject any and all bids.

6. Each of the terms and provisions of the foregoing notice ar~
hereby adopted and confirmed as the terms and provisions of said
sale as fully as though each were specially set forth and
resolved herein.
