JUNE 20, 1995, 7:30 PM. 1726 MINUTES - MOUND CITY COUNCIL - MAY 23, 1995 The City Council of Mound, Hennepin County, Minnesota, met in regular session on Tuesday, May 23, 1995 at 7:30 PM, in the Council Chambers at 5341 Maywood Road, in said City. Persons in attendance: Mayor Bob Polston, Councilmembers Andrea Ahrens, Mark Hanus, Liz Jensen and Phyllis Jessen. Also present were: City Manager Ed Shulde, City Attorney Curt Pearson, City Planner Mark Koegler, Building Official Jon Sutherland, Acting City Clerk Linda Strong and the following interested citizens: I.J. K_rider, Gene Zulk, Kelly Finnicum, Christine Cook, Flossie and Nell Finnicum, David and Jacquelyn Larson, Rod I_arson, Thomas Stokes, Matthew Orinstien, Matthew Hoy, Steve Swenson. The Mayor called the meeting to order and welcomed the people in attendance. The Pledge of Allegiance was recited. 1.1 INTRODUCTION OF KELLY FINNICUM AND CHRISTINE COOK, MOUND. WESTONKA HIGH SCHOOL STUDENTS RE: EAST ST. LOUIS, ILLINOIS PROJECT. Mayor Polston said he was pleased to introduce Mr. Gene Zulk, Principal of the Westonka High School who introduced Kelly Finnicum and Christine Cook, two senior students from the high school who had organized and promoted a fund drive to assist the schools in East St. Louis, Illinois, where there is a tremendous shortage of schoolroom supplies, materials and equipment for the teachers and students. Kelly and Christine shared with the Council the efforts they extended and the results. Mayor Polston presented each student a Resolution of Recognition and thanked them for all of the hard work they did to complete the project. RESOLUTION NO. 95-52 RESOLUTION RECOGNIZING THE EFFORTS OF KELLY FINNICUM AND CHRISTINE COOK AS ORGANIZERS OF A DRIVE TO COLLECT SCHOOL SUPPLIES FOR THE SCHOOLS OF EAST ST. LOUIS, ILLINOIS The vote was unanimously in favor. Motion carried. 1.2 APPROVE THE MINUTES OF THE MINUTES OF THE MAY 9, 1995 BOARD OF REVIEW, MAY 9, 1995 REGULAR MEETING AND THE MAY 16, 199~ COMMITTEE OF THE WHOLE MEETING. VARIANCE TO ALLOW ATTACHED GARAGE City Planner Mark Koegler stated the applicant is seeking variance approvals to construct a new conforming garage. An identical request was reviewed in May, 1994 and the request was denied unanimously by Resolution b94-79. Again, the Planning Commission unanimously recommended denial. I~IOTION by Jensen, seconded by Ahrens and camed unanimously to direct City Staff to prepare a resolution of denial for a variance to allow the remodeling of the dwelling at 6669 Halstead Avenue. 1.5 CASE//95-17: DENNIS ZYLLA, 4925 GLEN ELYN ROAD, LOT 22, BLOCK 24, SHADYWOOD POINT, PID//13-117-24 11 0097. VARIANCE TO CONSTRUCT NEW DWELLING City Planner Mark Koegler explained that the owners of the subject site requested a variance from the City of Mound in 1991. At that time, they were attempting obtain a variance to declare the lot buildable without any specific building plan. Because of the lack of a specific building plan, the request was denied. The area is currently zoned R-1 which requires a minimum lot size of 10,000 square feet. The subject parcel has a total lot area of 5,120 square feet resulting in a lot area variance request of 4,880 square feet. This lot is a lot of record having been established consistent with zoning provisions that were in place at the time of its platting· The fact that it does not comply with current lot area requirements and that it is reasonably impossible to add land to the lot constitutes a legitimate hardship. Therefore, approval of the lot area variance is recommended by staff. Council discussed the proposed resolution and added a new condition #3 "City Engineer shall review and approve drainage plan prior to issuance of building permit." Then renumbering the rest of the conditions as 4-7. 2 CITY COUNCIL MINUTES Builder Tom Stokes agreed to this condition. MAY 23, 1995 Mayor Polston moved and Jensen seconded the following resolution: RESOLUTION NO. 95-53 RESOLUTION TO APPROVE A LOT SIZE VARIANCE TO ALLOW CONSTRUCTION OF A NEW DWELLING AT 4925 GLEN ELYN ROAD, LOT 22, BLOCK 24, SHADYWOOD POINT, PID #13-117-24 11 0097, P&Z CASE g95-17 The vote was unanimously in favor. Motion carried. 1.6 CASE//95-18: DAVID & JACOUELYN LARSON, 4660 HAMPTON ROAD, LOTS 14 & 15, BLOCK 10, PEMBROKE, PID #19-117-23 33 0221. VARIANCE TG ALLOW PORCH AND DECK ADDITION Building Official Jon Sutherland stated the owners have applied for a variance to recognize existing nonconforming side yard setbacks of 4.9 feet to the west and 9.8 feet to the east side in order to construct a' conforming 14' x 18' three season porch and a deck. The owner said that there had been a 10' addition built without a permit or survey, before they purchased the home. That was why the setbacks were different than the survey on file at the City. Councilmember Ahrens moved and Hanus seconded the following resolution: RESOLUTION NO. 95-54 RESOLUTION TO APPROVE A VARIANCE TO RECOGNIZE EXISTING NON CONFORMING SIDEYARD SETBACKS TO ALLOW CONSTRUCTION OF A CONFORMING PORCH AND DECK AT 4660 HAMPTON ROAD, LOTS 14 & 15, BLOCK 10, PEMBROKE, PID #19-117-23 33 0221, P&Z CASE g95-18. The vote was unanimously in favor. Motion carried 1.7 COMIMENTS AND SUGGESTIONS FROM CITIZENS PRESENT. There were none. 1.8 APPLICATION FOR CONSTRUCTION ON PUBLIC LANDS PERMIT - #43575, STEVE SWENSON, 4865 ISLAND VIEW DRIVE: REQUEST TO ALLOW PLANTINGS Building Official explained that Mr. Swenson is requesting to plant 118 Juniper trees on the commons adjacent to his property. The previous ground cover and retaining wall from 1991 has failed. The staff recommends approval with some conditions which were listed in the resolution. I'ZZ q CITY COUNCIL MINUTES MAY 23, 1995 Through Council discussion they eliminated all of condition Itl, stating the permit shall expire in five years from approval date. Council felt that once the trees were planted, renewing a permit wasn't needed. Condition 112, which is now condition #1, they removed "shall be made concurrent with this permit,". Condition #4, which is now condition 3, the "Shall" is If, and the second "shall" is "will". Council also discussed the language of these types of permits and stated they hoped the new Commons Task Force would look into this and recommend improvements. Councilmember Jensen moved and Councilmember Ahrens seconded the following resolution: RESOLUTION NO. 95-55 RESOLUTION TO APPROVE A SPECIAL PERMIT TO ALLOW THE PLANTING OF VEGETATION ON DEVON COMMONS ABUTTING 4865 ISLAND VIEW DRIVE, LOTS 7 & 8, BLOCK 14, DEVON, PID//25- 11%24 11 0039, DOCK SITE//43575 The vote was unanimously in favor. Motion carried. 1.9 RESOLUTION AMENDING RESOLUTION NO. 95-37, RESOLUTION ESTABLISHING A TASK FORCE ON THE COMMONS DOCK PROGRAM TO REDUCE THE NUMBER OF MEMBERS FROM 12 TO 11. City Manager Ed Shukle related to Council they had advertised for 12 members and only 11 of the applicants were in the right categories as the Council had requested. He was presenting a new resolution to amend Resolution No. 95-37, reducing the number of members from 12 to 11. Councilmembers Jensen and Jessen stated that the task force was made up of more members representing the abutting dock holders, who were the minority of dock holders, than were representing the nonabutting dock holders, who were definitely in the majority. They both felt the representation was unfair. Mayor Polston said that the meetings would be open to the public and the first one is Tuesday, May 30, 1995 at 7:30 PM, at city hall. Mayor Polston also stated that all recommendations from this task force will go before the Parks and Open Space Commission and then to the Council. Councilmember Ahrens moved and Councilmember Hanus seconded the folloWing resolution: RESOLUTION NO. 95-56 RESOLUTION TO AMEND RESOLUTION //95-37, CHANGING THE COUNT OF THE MEMBERS OF A TASK FORCE ON THE COMMONS DOCK PROGRAM. The motion passed with 4 in favor. Councilmember Jensen voted no, stating she could not approve of the distribution of members. 1.10 RESOLUTION APPOINTING MEMBERS TO THE COMMONS TASK FORCE. City Manager Ed Shukle read the membership list and the types of categories established: Three /73o 4 CITY COUNCIL MINUTES MAY 23~ 2995 abutting property owners to Commons who have docks other than their own in front of their property; three abutting property owners to Commons who have only their docks in front of their property; four nonabutting Commons Dock users and one citizen at large. He also stated that the task force will meet for approximately 6 months and present their findings and recommendations to the Council on or before December 31, 1995. Councilmember Ahrens moved and Councilmember Hanus seconded the following resolution: RESOLUTION NO. 95-57 RESOLUTION APPOINTING MEMBERS TO THE COMMONS TASK FORCE. The vote was unanimously in favor. APPROVAL OF TRANSIENT MERCHANT LICENSE, VFW AUXILIARY, 2544 COMMERCE BLVD. RE: PILLOW CLEANING, SATURDAY, JUNE 3, 1995. MOTION by Jessen and seconded by Ahrens to approve the Transient Merchant License for the VFW Auxiliary for pillow cleaning on Saturday, June 3, 1995. APPROVAL OF PERMITS FOR MOUND CITY DAYS JUNE 16, 17 & 18, 1995 - CARNIVAL, CONCESSIONS, CRAFT SHOWS, ENTERTAINMENT, FIREWORKS, MERCHANT SALES AND PUBLIC DANCE. MOTION by Hanus, seconded by Ahrens and carried unanimously to approve the permits for Mound City Days June 16, 17 & 18, 1995, contingent upon all insurance and other forms being executed and turned in. APPROVAL OF PERMITS - MOUND FIRE DEPARTMENT FISH FRY JUNE 10, 1995 - PUBLIC DANCE PERMIT, SET-UP PERMIT, AND TEMPORARY ON-SALE NON-INTOXICATING MALT LIQUOR MOTION by Hanus, seconded by Jensen and carded unanimously to approve the permits for the Fire Department Fish Fry for June 10, 1995, contingent upon all insurance and other forms being executed and turned in. 17.51 CITY COUNCIL MINUTES MAY 23, 1995 1.15 RESOLUTION REAFFIRMING AUTHORIZATION OF CITY SPONSORSHIP OF STATE GRANT-IN-AID SNOWMOBILE TRAIL FUNDS City Manager Ed Shulde stated that for several years the City of Mound has endorsed the Southwest Trails Association's maintenance of snowmobile trails. The DNR needs a public entity authorizing sponsorship. Councilmember Jensen moved and Mayor Polston seconded the following resolution: RESOLUTION NO. 95-58 RESOLUTION REAFFIRMING AUTHORIZING THE CITY SPONSORSHIP OF STATE GRANT-IN AID SNOWMOBILE TRAIL FUNDS. Mayor Attest: Acting City Clerk RESOLUTION NO. 95- RESOLUTION DENYING THE REQUEST OF HEIDI HOY, 6669 HALSTEAD AVENUE FOR A VARIANCE TO REMODEL A NON-CONFORMING BUILDING, PID #22-117-24 43 0023 P&Z CASE #95-16 WHEREAS, the Minnesota Statutes Section 462.353 conveys authority to the City to plan and Section 462.357 provides enabling legislation for the City to adopt a zoning ordinance and zoning regulations; and WHEREAS, Section 350:620 of the Mound City Code establishes the single family residential district and Section 350:420 indicates the provision governing non-conforming uses and Section 350:530 authorizes the variance procedures in the City Code; and WHEREAS, the applicant in Case No. 95-16 is Heidi Hoy who resides at 6669 Halstead Avenue, and she has applied for a variance to allow reconstruction of the roof on the principal dwelling, expansion of the front entry with a 4' x 8' covered stoop, and the addition of a non-conforming 3' x 24.5' deck/platform on the lake side, and she acknowledges that there is another structure located on the property which she rents out; and WHEREAS, the applicant alleges that the two residences on the same property have existed for many, many years and were in existence when she purchased the property; and WHEREAS, the matter was considered by the City Council on May 23, 1995, and evidence was produced as prepared by the staff and the Planning Commission's review and recommendations o~8~=l~al were discussed; and WHEREAS, the parties agree that the property is non-conforming in that there are two principal structures on the property in a single family residential district and the detached garage has a non-conforming side yard setback and the lake side dwelling is currently 28.7 feet from the lake, and a 50 foot setback is required, and therefore the property is non-conforming; and WHEREAS, Section 350:420, Subd. 1 of the City Code reads as follows: "Any structure or use lawfully existing on the effective date of this Chapter may be continued at the size and in a manner of operation existing upon such date", Proposed Resolution Case #95-16 WHEREAS, the purpose of a non-conforming use provision in a zoning ordinance is to meet constitutional requirements that there is not a taking, but the non-conforming provisions are designed to bring the property into conformance with City ordinances and codes at some time in the future when the property is expanded or if for any reason it is destroyed or damaged beyond 50% of its value; and WHEREAS, the Council is understanding of the applicant's desire to allow reconstruction of the roof, expansion of the front entry, and the addition of a non- conforming deck, but the addition of these improvements will be an expansion of a non-conforming use and will undoubtedly extend the life of the non-conforming status of the property, and will also establish a precedence for other properties in the City which have two or more residential structures on a single family lot; and WHEREAS, Section 350:530 establishes the provisions for the granting of variances and indicates that a variance may be granted only in the event that certain circumstances exist including: "exceptional or extraordinary circumstances apply to the property which do not apply generally to other properties in the same zone and vicinity, and result from lot size or shape, topography, or other circumstances over which the owners of property since enactment of this Ordinance have no control". NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mound, as follows: 1. The application of Heidi Hoy for a variance to reconstruct the roof at 6669 Halstead Avenue on PID #22-117-24 43 0023 is hereby denied for the following reasons: a. The property is non-conforming in that it has two principal residential structures on one parcel of land in a single family district. b. The survey shows the garage structure is non-conforming in that it only has a 3.4 foot side yard setback and the lake side dwelling is set back 28.7 feet from the lake and the setback required is 50 feet. c. The requirements for granting a variance and the reasons for granting a variance in Section 350.530 are not met in that there are no exceptional or extraordinary circumstances which apply to this property over any other properties in the single family zone, and further the denial of a variance request does not deprive the applicant of rights generally enjoyed by other parties in the same district, and further the granting of the variance will confer to the applicant special privileges that are denied by the zoning ordinance to owners Proposed Resolution Case #95-16 of other single family lands or structures in this zoning district. d. The Whereas provision of this Resolution and the staff reports, Planning Commission minutes, and evidence presented by the neighbors have all been considered by this Council. 2. The City Council further finds the granting of this variance and the expansion of this non-conforming use would be detrimental to the public welfare and would convey privileges on this property which do not exist for other properties, and the economics of a rental unit does not justify the granting of a variance which would be contrary to the City's stated goals of bringing all properties into conformance with current codes. f3.~ The Planning Commission refused~o recomme_n~ approval of t_.he~z varia~nc~e. The City Council further finds that if standards and requirements are waived or relaxed for one property, other property owners have the right to expect the same kind of treatment or their constitutional rights would be adversely affected by failing to apply the equal protection laws of the Constitution to all residents. Simply put, more of the same old lousy weather, cold, rain, wind and overcast conditions predominated. We had one decent weekend out of the month. That being the fishing opener/Mother's Day weekend. I will give you a perfect example as to why the weather plays such a crucial role in this business during late spring, summer and early autumn around these parts. Last year on the Saturday before Memorial Day the temperature was in the high 80's and the sky was clear. Sales for that day were $14,729 and our customer count was 865. This year on the same corresponding Saturday, the temperature was in the upper 50's and lower 60's and it poured all day. Consequently, sales suffered big time. Gross receipts for the day were $10,646 and we had a customer count of 619. We have got to do something about widening the avenues of communication in our search for some divine intervention. Even though we had such foul weather, sales managed to reach $131,443 which is exactly what we did last year in May. There was about 24 repairs in the streets and a couple of frost boils that we dug out. We intend to have this completed probably the week of June 19th. Another frost boil was just found on Ridgewood, we will dig it out and repair it. All areas should have the final lift on soon. The month of June will be used preparing for sealcoating which should be done the end of July. There is odds and ends work to be done. Water Department There was some trouble with the master control panel at well #6, the problem was the regulating the pump starting and stopping. We had Automatic Systems out a few times. The system was put in in 1976. The possibility of updating the panel will be looked into next year. A quote is being sent, and I will put into Capitol Outlay for next year. This will get rid of our cards that run our telesteps, telemetry to each well and to the water tower in the Highlands. We still have some bugs in this meter system that was installed. It is getting better, the response from Schlumberger and the factory in Alabama. They are sending the parts back to us much quicker, the list is getting down. We have been getting "bad reads" or "dashes" on the reads. Hopefully, this will be done in a month. There have been a lot of locates after we lifted road restrictions, probably 10 a day. They have increased to 16-18 a day and printed on recycled paper Monthly Report, Greg Skinner Page 2. they take a lot of time. We are also trying to finish up yard repairs from snow plow wings and watermain breaks. We are taking care of the small ones, but I have contracted most of it out. Sewer Deoartment. We are having troubles with the automatic dialers that were installed this year. They have changed out two of them, sent one back to get repaired. They are still giving us the same problem. I spoke with the manufacturer and he has agreed to change out a total of five of them. Two have been installed. Hopefully, I will meet him in the next couple of weeks to ask him where the other three are and tell him we have a problem with a few other ones. I will try to get back to the old dialers that we had in the project in 1990 and 1992. Hopefully, we can get something worked out here. We had one pump installed in the 1992 project that burned up on Baywood Shores. There was a five year pro rated warranty on it, we just had it replaced. The 1996 H^CA has been cut by $16 million statewide. Now we are trying to catch up with the mowing. All of the beach buoys have been put in and the beaches cleaned for the beginning of the summer. The play structure that is being installed at Dundee park is coming along. We ran into a few problems that slowed the construction but it should be ready by mid June. Docks The Dock Inspector has been busy with issuing dock sites and marking locations for dock installations. This time of the year is busy for him as all docks have to be off of the shoreline by June 1st. Letters will have to be sent to all sites not in compliance. Cemetery Preparing the cemetery for Memorial weekend was the main objective for May. This last winter we did not have any burials but just before the holiday we had two. Trees One tree was removed from park property and three others are scheduled for removal. There were 30 Part I offenses reported. Those offenses included 1 criminal sexual conduct, 2 robberies, 1 aggravated assault, 4 burglaries, 19 larcenies, 2 vehicle thefts, and 1 arson. There were 76 Part II offenses reported. Those offenses included 4 child abuse/neglect, 1 forgery/NSF check, 1 weapon, 3 narcotics, 15 damage to property, 4 liquor law violations, 4 DUI's, 7 simple assaults, 9 domestics (2 with 'assaults), 7 harassment, 11 juvenile status offenses, and 10 other offenses. The patrol division issued 141 adult citations and 6 juvenile citations. Parking violations accounted for an additional 19 tickets. Warnings were issued to 62 individuals for a variety of violations. There were 13 juveniles arrested for felonies. There were 33 adults and 17 juveniles arrested for misdemeanors. There were an additional 10 warrant arrests. The department assisted in 8 vehicle accidents, 1 with injuries. There were 31 medical emergencies and 72 animal complaints. Mound assisted other agencies on 14 occasions in May and requested assistance 12 times. Property valued at $8,376 was stolen and $5,040 was recovered in May. /77 MOUND POLICE DEPARTMENT MONTHLY REPORT - MAY 1995 II. INVESTIGATIONS The investigators worked on 6 child protection issues and 4 criminal sexual conduct cases that accounted for 82 hours of investigative time. Other cases investigated included burglary, robbery, assault, theft, threatening communications, domestic assault, arson, violation of restraining order, and absenting. Formal complaints were issued for disorderly conduct, marijuana in a motor vehicle, assault, harassing communications, and gross DWI. III. Personnel/Staffillg The department used approximately 63 hours of overtime during the month of May. Officers used 84 hours of comp-time, 84 hours of vacation, and 119 hours of sick time. Officers earned 68 hours of comp-time. The department held a defensive tactics training session for all officers in May. Other courses attended by officers included field sobriety, Wilson Leadership seminar, and EMT refresher. The Mound Police Reserves donated 167 hours during the month of May. We'd li'ke to encourage Hennepin' County residents to I~e a par~ of the Fair's activities. Participate in or attend the 89th Hennepin County Fair in Corcoran on July 27 through the 30th. See motocross races, demolition derbies, a draft horse pull, a skid steer rodeo, mountain bike races, pig races, over 2500 creative activities entries, many commercial booths and food vendors, 4-H club competition, antique steam powered farm equipment, a country band, a beach band, a carnival and more. Easy to reach at the corners of county roads 101 and 10, three miles north of Highway 55, the Hennepin County Fair is a great place to bring the kids. The Teddy Bear Band, Tricia and the Toons, the Pedal Tractor Pull, Big Wheel races, and Fun at the Fair contests involve the kids in the Fair. The Children's Barnyard features llamas, goats, and a potbellied pig, while the new exotic petting zoo displays antelopes, a kangaroo, a baby camel, a baby zebra, emus and more. The Amateur Talent Contest offers three age divisions __ includin~ one ot~en to all ages, a 13 to 18 division for teens, and one for pre-teens 12 and under~ Contestants placing first through fourth receive cash prizes with winners advancing to the State Fair Talent Contest. Camel rides, pony fides, Monster Truck rides, and helicopter rides, weather permitting, are available at the Fair.
