It was my belief, and I confirmed this with Tom McCaffrey, Dock Inspector, that the policy to not charge a late fee to new residents was initiated within the last three years. I searched the Park & Open Space Commission meeting minutes for bacl~round and found none. The intent of waiving the late fee was to provide good public relations to new residents. The number of late fees that have been waived have been minimal due to t e majority of the sites being assigned in April. These applicants would be moving ~.~nd no sooner than March I of the current application year. The basis for not charging a late fee to a new resident is that by city ordinance a non- resident is not allowed to make an application for a dock site until they have established residency in Mound. In reviewing Section 510 of the Mound City Code, Subd. I this waiving of a late fee is not addressed. " It is staff's recommendation that this matter go to the Park and Open Space Commission for discussion on possible recommendation to the City Council for an ordinance change. Persons in attendance: Mayor Bob Polston, Councilmembers Andrea Ahrens, Mark Hanus, Liz Jensen and Phyllis Jessen. Also present were: City Attorney Curt Pearson, Building Official Jon Sutherland, City Manager Ed Shukle and Acting City Clerk Linda Strong. The following interested citizens were also present: Steve Kelm, Randy Lee, Pamela K. Anderson, Dennis and Shirley Flack, Jerry and Catherine Palen, R. Motyko, Peter Johnson, Leah Weycker, Marry and Marie Johnson. The Mayor called the meeting to order. The Pledge of Allegiance was recited. 1.1 Mayor APPROVE THE MINUTES OF THE NOVEMBER 28, 1995 REGULAR MEETING, THE DECEMBER 6, 1995 TRUTH IN TAXATION (BUDGET MEETING). Polston stated page 2 had been amended by the city attomey. MOTION by Jensen, Seconded by Hanus and carried unanimOusly to approve the Minutes of the November 28, 1995 regular Council meeting as amended. MOTION by Hanus, seconded by Ahrens to approve the Minutes of the December 6, 1995 Truth in Taxation meeting. The vote was 4 to 0, Jessen abstained. Motion carried. 1.2 PUBLIC HEARING: TO CONSIDER THE ISSUANCE OF A CONDITIONAL USE PERMIT TO ALLOW FOR A WARMING HOUSE AND TWO OUTDOOR SKATING RINKS ON PROPERTY ASSOCIATED WITH A PUBLIC SCHOOL AT 5600 LYNWOOD BLVD. Building Official Jon Sutherland reviewed the staff report for the Council stating the school district and the hockey association had applied for a. Conditional Use Permit to allow a 15' x 21' warming house, an outdoor hockey rink, an outdoor recreational skating rink, and lights for the hockey rink to be located on school property at 5600 Lynwood, just west of the Pond Arena. Staff and Planning Commission has unanimously approved the request. Minutes - Mound City Council December 12, 1995 Mayor Polston opened the public hearing asking if there was anyone present who wished to speak regarding this item. Peter Johnson, 3140 Priest Lane, stated he was with the hockey organization and stressed the need for the rinks and warming house. Pamela K. Anderson, 4100 Enchanted Lane, stated she was the President of the Mound Westonka Hockey Association. She apologized for starting the project before obtaining a permit; they were not aware of the requirement and wants the project to be done to code. She mentioned the need for the community as it pertains to additional skating facilities. The Mayor closed the public hearing. The Council discussion included the lighting plan which had not yet been submitted. The resolution was amended at lB to include the following, "Prior to the issuance of a building permit a lighting plan must be submitted by the applicant." Parking was discussed. The Building Official stated the City Planner had looked at the parking issue and felt there would be no problems. Council felt that the Conditional. Use Permit should be reviewed at the end of the season to see if there were parking problems. P&Z #95-52. The vote was unanimously in favor. Resolution carried. 1.3 CASE #95-49: GERALD AND CATHERINE PALEN, 6545 BARTLETT BLVD., LOT 18, HALSTEAD HEIGHTS, PID #22-117-24 44 0033. VARIANCE FOR A GARAGE. Building Official Jon Sutherland reviewed this issue-with the Council. The applicant is seeking a variance to allow construction of a detached garage that exceeds the height of the principal dwelling on the same lot. The Zoning Ordinance does not allow this. The applicants own two parcels referred to as parcel A on the lakeshore and parcel B between parcel A and Bartlett Blvd. The garage is planned to go on parcel B to serve the main dwelling on Parcel A. A suggestion was to lower the roof line on the garage, 2 Minutes - Mound City Council December 12, 1995 the applicants did not approve of this. The proposed garage is conforming to all setbacks. Staff recommended approval. The Planning Commission recommended denial. Staff was directed to work with the applicant. Jon and the City Planner discussed in depth. They discussed subdividing the properties, staff could not support this. The original request for a garage height variance is back before the Council. The Council discussed resubdividing, combining the two parcels and the eventual removal of the dwelling on parcel B. Councilmembers Jensen and Jessen agreed to the approval of a garage height variance thus keeping the two parcels tied together. MOTION by Jensen, seconded by Jessen to approve the garage height variance request. The vote carried 3 - 2, with Hanus and Ahrens voting nay. A resolution will be in the Council packet at the December 19, 1995 council meeting. 1.4 RESOLUTION APPROVING THE 1996 BUDGET AND TAX LEVY FOR 1996 (REVISED PAGES AND RESOLUTION WILL BE HANDED OUT AT TUESDAY'S MEETING). City Manager Ed Shukle referred to his memo regarding the budget changes the Council had requested. The amended pages of the budget were attached along with the resolution for approval of the 1996 budget. The expenditures are now less than the revenues. Mayor Polston thanked the staff and Council for working to come up with this revised budget and a reduction of $32,000. Councilmember Hanus moved and Councilmember Jessen seconded the following resolution: RESOLUTION #95-121 RESOLUTION APPROVING THE FINAL 1996 GENERAL FUND BUDGET IN THE AMOUNT OF $2,443,830; SETTING THE LEVY AT $1,850,295; LESS THE HOMESTEAD AGRICULTURAL CREDIT (HACA) OF $485,095, RESULTING IN A FINAL CERTIFIED LEVY OF $1,365,200 APPROVING THE OVERALL BUDGET FOR 1996. The vote was unanimously in favor. Resolution carried. 1.5 APPROVAL OF PERMANENT EASEMENT AND AUTHORIZING MAYOR AND CITY MANAGER TO SIGN AND EXECUTE EASEMENT AGREEMENT RE: COSSETTE PROPERTY/GLASS PLUS PROPERTY, 5533 SHORELINE DRIVE - AUDITOR'S ROAD IMPROVEMENT PROJECT (HANDOUTS WILL BE PROVIDED Minutes - Mound City Council December 12, 1995 AT TUESDAY'S MEETING). The City Manager stated that documents were not yet available on this item and he asked that the item be returned to the Council at the December 19, 1995 meeting. 1.6 COMMENTS AND SUGGESTIONS FROM CITIZENS PRESENT. There were none. 1.7 APPROVAL OF AN ORDINANCE GOVERNING TELECOMMUNICATIONS OR RELATED SERVICES IN THE PUBLIC GROUND OF THE CiTY OF MOUND. City Attorney Curt Pearson stated this model resolution was recommended by the League of Minnesota Cities for all municipalities to adopt. Thus, creating a solid environment for telecommunication companies to operate within. The Planning Commission had reviewed the proposed ordinance and recommend approval. Councilmember Jensen moved and Ahrens seconded the following: ORDINANCE #76-1995 AN ORDINANCE GOVERNING THE CONSTRUCTION, INSTALLATION, OPERATION, REPAIR, MAINTENANCE, REMOVAL, AND RELOCATION OF FACILITIES AND EQUIPMENT USED FOR THE TRANSMISSION OF TELECOMMUNICATIONS OR RELATED SERVICES IN THE PUBLIC GROUND OF THE CITY OF MOUND. The vote was unanimously in favor. Ordinance adopted. 1.8 SET BID OPENING RE: FIRE TANKER APPARATUS MODIFICATION. SUGGESTED DATE: DECEMBER 27, 1995, 11 AM. MOTION by Ahrens, seconded by Polston and carried unanimously to set December 27, 1995, 11 am for the bid opening for the fire tanker apparatus modification bids. 1.9 APPROVAL OF PAYMENT REQUEST NO. 2, MOUND/MINNETRISTA PUBLIC WORKS MATERIAL STORAGE PROJECT TO IMPERIAL DEVELOPER S IN THE AMOUNT OF $44,014.23. 4 Minutes - Mound City Council December 12, 1995 City Manager Ed Shukle stated this payment request was for the work completed through November 1995 at the joint Mound/Minnetrista Public Works storage site. MOTION by Jessen, seconded by Jensen and carried unanimously to approve the payment request of Imperial Developers in the amount of $~.~.,014.23 for work done through November 1995 at the Mound/Minnetrista Public Works storage site. 1.10 APPROVAL OF PAYMENT REQUEST FROM SUMMER HILL TREE FARM, MOUND/MINNETRISTA PUBLIC WORKS MATERIAL STORAGE PROJECT. City Manager Ed Shukle stated this payment request was for landscape work done at the Mound/Minnetrista Public Works material storage site. This was to appease neighboring property owners. MOTION by Ahrens, seconded by Hanus and carried unanimously to approve payment to Summer Hill Tree farm in the amount of $8850 for landscaping done at the Mound/Minnetrista Public Works storage site. 1.11 1.12 PAYMENT OF BILLS. MOTION made by Jensen, seconded by Jessen to authorize the payment of bills as presented on the pre-list in the amount of $354,590.61, when funds are available. He requested the Council go into Executive Session to briefly discuss. The Council went into executive session at 9:05 PM. At 9:30 pm, the Council returned from the Executive Session. They directed the City Attorney to prepare a memorandum listing the options before the Council. THAT PART OF LOT 18 LYING NORTH OF A LINE .... HALSTEAD HEIGHTS, PID 22-117-24 44 0033 P&Z CASE #95-49 WHEREAS, the owners, Gerald and Catherine Palen have applied for a variance to allow construction of a detached garage that will exceed the height of the principal dwelling on the same lot, and; WHEREAS, Zoning Ordinance Section 350:435, Subd. 2, states "No accessory building shall exceed the height of the principal building in the 'R' District", and WHEREAS, the subject property is located within the R-1 Single Family Residential Zoning District which according to City Code requires a lot area of 10,000 square feet, a 30 foot front yard setback, side yard setbacks of 10 feet and 6 feet for lots of record, and a 15 foot rear yard setback, and; WHEREAS, all setbacks and impervious lot coverage will be conforming, and; WHEREAS, the new garage is intended to serve the dwelling located on the sourtherly portion of lot 18, PID 22-117-24 44 0034, both parcels are owned by the Palen's, and; WHEREAS, the plans for the garage match the architecture of the dwelling on the southerly parcel, and this could be considered a positive step towards the eventual combination of these parcels and the elimination of the rental unit, and; WHEREAS, if the height of the garage was reduced, no variance would be required since the position of the garage is in a conforming location on the northerly parcel, and; WHEREAS, there does not appear to be a reasonable location for a garage on the southerly parcel, and; WHEREAS, staff investigated the possibility of moving the lot line separating the two parcels on Lot 18, however, did not support a subdivision when the result would be the creation of a nonconforming parcel, and; WHEREAS, this proposal encourages the combination of the two parcels to return the property to one parcel which could then easily accommodate all desired accessory structures, and; ~roposed ~eselutio~ Palen Page 2 WHEREAS, the Planning Commission has reviewed the request and recommended denial. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Mound, Minnesota, as follows: The City does hereby grant a building height variance for the construction of a 22' x 24' detached garage which will exceed the height of the principal building on the same lot, as shown on the survey dated September 21, 1995, subject to the following conditions: A minimum driveway/access width of 10 feet must be maintained for Parcel A. This can be accomplished by an easement for the driveway that can also include the utility services. An easement should be written to accommodate the existing situation for the driveway and utilities or they could be relocated to be within the easement. The proposed garage must not be placed over any utility services. All utilities must be identified on the survey and located within a proper easement. A drainage plan needs to be prepared by the applicant that incorporates the techniques listed in Zoning Ordinance Section 350:1225, Subd. 6.A.3. This plan could be reviewed and approved by staff prior to building permit issuance. d. The deck and encroaching shed located on Parcel B shall be removed. The City Council authorizes the alterations set forth below, pursuant to Section 350:420, Subdivision 8 of the Zoning Ordinance with the clear and express understanding that the use remains as a lawful, nonconforming use, subject to all of the provisions and restrictions of Section 350:420. It is determined that the livability of the residential property will be improved by the authorization of the following alteration-to a nonconforming use of the property to afford the owners reasonable use of their land: Construction of a 22' x 24' detached garage. Proposed Resolution Palen Page 3 e This variance is granted for the following legally described property: That part of Lot 18 lying north of a line running west at right angles from a point on the east line thereof distant 225 feet south of the northeast corner thereof, Halstead Heights, Hennepin County, Minnesota. This variance shall be recorded with the County Recorder or the Registrar of Titles in Hennepin County pursuant to Minnesota State Statute, Section 462.36, Subdivision (1). This shall be considered a restriction on how this property may be used. The property owner shall have the responsibility of filing this resolution with Hennepin County and paying all costs for such recording. A building permit for the subject construction shall not be issued until proof of recording has been filed with the City Clerk. They pertain to two ISTEA applications we are proposing. One application is being prepared by Hennepin County for the relocation of County Road 15 according to the Mound Visions concept plan. The second application is very similar to the one prepared this spring for the Lost Lake Greenway. Cost estimates and included work for the two projects are still being worked out. WHEREAS, the City of Mound has conducted a 5 year planning process called Mound Visions involving extensive citizen participation; and WHEREAS, relocation of County Road 15 is a main component of the Mound Visions plan; and WHEREAS, the design concept holds broad public approval and was adopted by the City Council in the Spring of 1992 as the framework for future public investment and solicitation of private investment; and WHEREAS, the City is preparing plans for the fa'st phase of downtown redevelopment to be constructed in 1997; and WHEREAS, realignment of County Road 15 is planned as the primary component of the second phase of redevelopment; and WHEREAS, realignment of County Road 15 will greatly improve transportation flow and safety in downtown Mound. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Mound, Minnesota: Ao The City of Mound supports Hennepin County's application for ISTEA funding for realignment and reconstruction of C.S.A.H. 15 through downtown Mound in accordance with the Mound Visions Concept Plan. WHEREAS, the City of Mound has conducted a three year planning process called Mound Visions involving extensive citizen participation; and WHEREAS, the primary emphasis of the Mound Visions design concept is to refocus downtown on the County Road 15/Auditors Road/Lost Lake area; and WHEREAS, the design concept holds broad public approval and was adopted by the City Council in the Spring of 1992 as the framework for future public investment and solicitation of private investment; and WHEREAS, the City is preparing plans for phase I downtown redevelopment which includes ISTEA funding for restoration of the Lost Lake Canal; and WHEREAS, the project being proposed enhances the transportation function of the Lost Lake Canal, and builds a multi-modal transportation system in downtown; and WHEREAS, the project will provide convenient facilities for pedestrian, bike, boat, car and bus transit; and WHEREAS, the transportation system being proposed enhances and is completely integrated with the economic and community functions of downtown. MINUTES OF A MI~.E~G OF TH'g~ MOUND ADVISORY PARK AND OPEN SPACE COMMI~qSION NOVEMBER 9, 1995 1996 DOCK LOCATION M~P: PUBLIC HEARING Jim Fackler, Parks Director, reviewed the proposed changes to the map as outlined within his memorandum. These changes need to be approved by the Council by January 15, 1996. Fackler noted that the Dock Location Map Attachment was Revised on 11/6/95 and copies were distributed to the Commission. He explained that duplicate numbers were found on the list, and that the list now reflects the correct number of dock sites at 448. /Following is a recap of the changes proposed to the map for 1996: 1. DOCK SITE NUMBERS: A listing of all dock site numbers, including Shoreline Type and Land Type is to be made as an attachment to the map. 2. pEMBROKE PARK: The area on the map shown as Pembroke Park will be corrected. 3. BRIGHTON COMMON: As shown on the attached copy of the original plat of Wychwood, the correct name for this area is Brighton Common and no change is proposed. 4. FISHING PIER: The fishing pier at Centerview Beach will be added to the map. Park and Open Space Commission Minutes November 9, 1995 WATERSIDE LANE VS. WATER BANK COMMON (DOCK SITES 20130 to 22600 Morton Lane): The original plat named this area Water Bank Common. Currently, the dock map shows this area as Waterside Common, and the plat map shows this area as Waterside Lane. History indicates that when the street names were changed by the City, the name of this area was also ~ changed. ~Through discussions with the City Engineer, it could be /possible to rename this area back to Water Bank Common, and / also to recognize the improved road on the plat map and dock ( map as Waterside Lane. The City Council would have to approve this change with an ordinance amendment. Pede~son commented that this is a unique area where a road is across the common. The road evolved from a path to a gravel road to a paved road. She visited the Registrar's Office at Hennepin County and they suggested that this road be described as an easement so that the abutting people will retain their "abutting" status. The Parks Director commented that regardless those residents would still be considered "abutting." He agreed that this area is unique as it is the only area with a road on the common. Tom Menken questioned the total number of dock sites within the City's dock program. The Dock Inspector confirmed that there are 448 dock sites, and this number has not changed for at least the last five years, and it is possible to add or remove dock sites. e NORTH PARK (22827 TO 23057): North Park is located just east of Morton Lane and has never been labeled on the map. The dock site numbers/lineal footage will need to be verified by the City Engineer. It was noted that the dock site numbers do not correlate with the list and should be corrected to read "22990 to 23070." LAKE BLVD. (23057 TO 23255): Lake Blvd. is located just east of Apple Lane and has never been labeled on the map. The dock site numbers/lineal footage will need to be verified by the City Engineer. It was noted that the dock site numbers do not correlate with the list and should be corrected to read "23090 to 23230." PRIVATE SHORELINE (23057): There is an 85 foot wide parcel of land located between North Park and Lake Blvd. that is private lakeshore. This area is currently shown on the map as a docking area and needs to be corrected. Dock site numbers will need to be adjusted to account for the loss of 85 lineal feet. Park and Open Space Commission Hinutes November 9, 1995 It was noted that the dock site numbers do not correlate with the list and should be corrected to read "(23090)." 9. TYPOGRAPHICAL ERRORS: a. Following 20830 is 22030, which is incorrect. 22030 should also be 20830. b. 212804 should be 21280. c. 23255 is shown as 23155. There may be other typographical errors, and as they are found they will be corrected. 10. SHORELINE TYPES: The map currently refers to "Shoreline Classifications." In order to be consistent with the Use Plan, it should be changed to read "Shoreline Types." 11. CRESCENT PARK: The spelling needs to be corrected "Crescent". Darling requested an explanation of the numbering system. Fackler explained that it is measured on lineal footage. Fackler commented it is his understanding there are about 6 miles of public shoreline. There are no commons docks on Langdon Lake or Dutch Lake. Chair Schmidt opened the public hearing. Tom Menken asked a question regarding dock spacing. He lives on the north side of Harrison Bay between Dove and Eagle abutting commons. His first summer at that residence, 2 years ago, the docks were spaced about 30 feet apart, but last s,~mmer the docks were spaced only about 25 feet apart. The Dock Inspector stated that the spacing in that area is 30 feet and those docks were probably not installed on-center. The numbering in that area has stayed the same. McCaffrey explained that each site has 30 feet of area and a site holder may place their dock anywhere within that 30 feet as long as it does not cause a problem for adjacent sites. McCaffrey offered to assist Mr. Menken in the spring to mark the spots. Alex Wilson and Geri Edwards informed the Commission that they reside on the north end of Avocet Lane, Jennings Bay, and they have a little boat launch off Avocet Lane that the neighbors use and snowmobilers use in the winter. They have a concern with a commons dock that somewhat obstructs their use of the boat launch because it is installed at such an angle. They would like the dock installed at a more appropriate angle. The Dock Inspector agreed to work on this issue next spring. They also expressed a concern about the wetlands disappearing in Jennings Bay cove. The Parks Director explained that the wetlands thrived during the drought, but the reeds do not live with the water depth consistently at a normal-level. Park and Open Space Commission Minu=es November 9, i995 Chair Schmidt closed the public hearing. Ahrens questioned if there is an ordinance requiring people to center their docks within their site? Ahrens suggested that if someone does not want to place their dock on-center, they should get approval from the other abutting dock site holders. Schmidt questioned what the concern is. Fackler stated that they try to work with the owners, and sometimes the LMCD helps mediate between private lakeshore owners and the City. Prior to the LMCD there was not a setback, and our system existed prior to 1968, so we work together. Ahrens stated that she is not suggesting the number of docks be reduced. She would like to see a recommendation that people install their docks on the center of their site. She does not feel that it necessarily has to be in the ordinance, but that it should be a policy. Ahrens elaborated that when one person places their dock off-center it creates a domino affect and eventually somebody down the line will be negatively affected. She would like a statement included on the "Attachment" to the Dock Location Map which lists all the dock site numbers which says that people should put their docks centered on these locations, and if they do not want to center it then they need the Dock Inspectors approval. The Dock Inspector noted that he would not want to advertise that you have to center your dock because people may think that they now have the opportunity to place their docks off-center. Ahrens commented that right now though there is no assurance that people are not doing this. Ahrens referred to her docking area which is suppose to have a limited number of docks because of the sand bar, but if someone wanted they could move their dock on the sand bar. Fackler agreed that there is some movement in her area. Ahrens commented that having docks off-center provides for a very cluttered look and it is unsightly. She would rather see a policy change rather than an ordinance change. The Dock Inspector confirmed that off-setting is rare and there should be no problem. Ahrens commented that she wants the Dock Inspector to enforce the policy. The Parks Director suggested that City Code Section 437:05, Subd. 5 would be a good place for this change. He confirmed there is nothing in the ordinance now requiring people to center their docks at their sites. Darling questioned what would happen if somebody did not agree with the Dock Inspector's decision on the dock placement, and it was noted that an individual would always have the right to appeal to the Council. Pederson suggested that the commons area at the east end towards Morton Lane could be listed as Waterside lane, and the commons area to the west of Tonkawood Road should be labled W~ter Bank Common. Pederson stated that she has deeds which call th~< property Water Bank Common. /The Parks Director clarified that a road is an easement and the /street easement for Waterside Lane was never denoted on the plat /map. The Commission noted that some areas of the common are now private, and therefore the common is divided. Ahrens suggested that they name one side Water Bank Common and other side Waterside Lane. Fackler noted that if the common is redesignated, it will clear-up any confusion and it will show on the map the location of the paved portion of the road as an easement. ahrens moved to amend the motion to include that the dock map and plat map be modified to properly reflect the improved road easement known as Waterside Lane, and to properly denote Water Bank Common. Casey seconded the motion to amend the motion. Motion carried 6 to 1. Ahrens, Casey, Schmidt, opposed. Those in favor were Goode, Meyer, Pederson. Following is a recap of the changes to the map for 1996: DOCK SITE NUMBERS: A listing of all dock site numbers, including Shoreline Type and Land Type is to be made as an attachment to the map. PEMBROKE PARK: The area on the map shown as Pembroke Park will be corrected. BRIGHTON COMMON: As shown on the attached copy of the original plat of Wychwood, the correct name for this area is Brighton Common and no change is proposed. 4. FISHING PIER: The fishing pier at Centerview Beach will be added to the map. WATERSIDE LANE VS. WATER BANK COMMON {DOCK SITES 20000 to 228277 Morton Lane): The original plat named this area Water Bank Common. Currently, the dock map shows this area as Waterside Common, and the plat map shows this area as Waterside Lane (note attached copies). History indicates that when the street names were changed by the City, the name of this area was also changed. Through discussions with the City Engineer, it could be possible to rename this area back to Water Bank Common, and also to recognize the improved road on the plat map and dock map as Waterside Lane. NORTH PARK (22827 TO 23057): North Park is located just east of Morton Lane and has never been labled on the map. The dock site numbers/lineal footage will need to be verified by the City Engineer. LAKE BLVD. (23057 TO 23255): Lake Blvd. is located just east of Apple Lane and has never been labled on the map. The dock site numbers/lineal footage will need to be verified by the City Engineer. PRIVATE SHORELINE (23057): There is an 85 foot wide parcel of land located between North Park and Lake Blvd. that is private lakeshore. This area is currently shown on the map as a docking area and needs to be corrected. Dock site numbers will need to be adjusted to account for the loss of 85 lineal feet. TYPOGRAPHICAL ERRORS: Following 20830 is 22030, which is incorrect. 22030 should also be 20830. b. 212804 should be 21280. c. 23255 is shown as as 23355. There may be other typographical errors, and as they are found they will be corrected. SHORELINE TYPES: The map currently refers to "Shoreline Classifications." In order to be consistent with the Use Plan, it should be changed to "Shoreline Types." "The Laker" on October 30, 1995 and MOUND PARK COMMISSION REVIEWS 1996 DOCK LOCATION MAP On Thursday, November 9, 1995, the Mound Advisory Park and Open Space Commission will hold a public hearing on the approval of the 1996 Dock Location Map. No specific changes are being proposed for 1996, other than minor format changes. Ahrens requested that the map show each dock site number instead of just a range of numbers. The Parks Director agreed that this could be done, and also suggested that the Type of Common for each dock site also be included. Pederson recalled that a task force member had mentioned an error on the map in the Devon area. The Parks Director confirmed that the error is that the map shows Pembroke Park on land that is actually privately owned and confirmed that this can be corrected. Pederson requested that Waterbank Common be correctly labeled, she noted that the map currently shows this area as Waterside Common. She also suggested that the Centerview Fishing Pier be added to the map. Byrnes requested that Wychwood Commons also be correctly labeled on the map. The Parks Director indicated that he will check the original plat on this issue. The Park Commission will hold a public hearing on November 9, 1995. MINUTES OF A MEETING OF THE MOUND ADVISORY PARK AND OPEN SPACE COMMISSION DECEMBER 14, 1995 1996 DOCK APPLICATION FORMS The Parks Director reviewed the revised forms and indicated that the Council had requested that the forms be simplified, as indicated in the City Council Minutes of November 14, 1995. Casey noted that the letter refers to a "minimum" late fee, and questioned what is the maximum. Ahrens stated that it is the intention that everyone pay a late fee if you are renewing your dock site and you miss the due date, whether you are an abutter or nonabutter. It was suggested that in the "Letter to the Applicant", #2.a., it could be modified to read, "All 1996 Dock License Application renewals must be received by February 29, 1996, . . ." Casey commented that he would agree that #2.c. is redundant with #2.a., and maybe this should be deleted. The Parks Director clarified when late fees are charged. Non- abutters are charged a late fee if their application is received after the due date, however, if their application is not received before April 1, they forfeit their dock site. He explained that in the past they had problems collecting dock license fees from some abutters because the late fee was a minimal charge of $5.00, so the late fee charge was raised to $20.00. If an abutter does not submit their application by April 1, their dock site could become available to a nonabutter, but only if it is an accessible site. Ahrens stated that she does not feel the changes made to the dock forms accurately reflect what happened at the City Council meeting, and feels that the forms still need to be fixed. Geffre suggested that at the form includea statement to let people know that City Ordinance Section 437 is available for viewing at City Hall. Applications for remodeling, maintaining or repairing existing boathouses, retaining walls, stonework, decks, landscaping, trimming of trees or brush, or other types of improvements on public lands may be obtained from the Building Department. Maintain the cleanliness of the area by your site, including grass cutting and weed trimming. Aquatic plants that are protected by law require permits prior to removal. Remove Eurasian Water Milfoil from the shoreline around your dock. Boats, dock sections, pipes, posts, and other materials cannot be stored on public land during the boating season, and must be removed by June 1. Sincerely, Tom McCaffrey, Dock Inspector PJ Enclosures MINUTES - MOUND CITY COUNCIL - NOVEMBER 14, 1995 1.5 REVIEW OF 1996 DOCK APPLICATION FORMS. City Manager Ed Shukle stated that the dock forms have been reviewed by the Parks and Open Space Commission, and now need to be reviewed by the Council. These forms will be mailed at the end of December to the current dock holders. He referred to three changes from last year: 1). Dates were changed as 1996 is a leap year and there is one more day in February, 2). A sentence was added regarding chemicals draining into the lake and causing serious environmental problems, and 3). Chemical drift and runoff adversely affects the quality of lakes and streams. Shukle also mentioned questions asked by Councilmember Ahrens, and they were answered in the handout. The questions dealt with commercial docks and why some are charged a fee and some are not, the type of inspection the City Dock Inspector does with commercial docks, why buoys are being phased out and can a buoy permit and a dock permit be held by one individual? Jim Fackler, Parks Director, responded to these questions in a memo. Councilmember Ahrens felt it unfair some commercial docks are being inspected by the city dock inspector and not paying fees, they should be as all commons dock holders pay fees to the City. Fackler's memo stated that the policy has been any commercial dock site that does not rent slips out to non residents of the complex or association they are affiliated with, are not charged a fee. However, a commercial dock that is renting sites to non residents, using excursion boats or for profit type of operation, a fee is charged as outlined in Section 510:15 of the City Code. According to Code, the commercial docks require more inspections and regulations than private docks on commons, and some of them do not pay any fee. City Attorney Curt Pearson stated that the LMCD regulates only to the water's edge and commercial dock sites have an effect on the neighborhood as to the parking, noise, etc. This is where the City's ordinance comes in, as to the effect of the neighborhood. The City has an interest in these docks. The question was asked if the LMCD charges a fee, and do they inspect the commercial docks? Mayor Polston suggested the City inquire with the LMCD to see what they do with regard to commercial dock inspections. The applications were discussed. Councilmember Hanus stated the forms did not flow well. To be eligible to lease one of these sites, you must be permanent or summer resident of Mound. Applications are available at City Hall on the first working day of the year for new applicants, and are mailed to licensee's from prior year during December each year. See dock application for current fees. These fees are due with the completed application by February 28th. The following priorities govern the issuance of dock licenses per the Mound City Code. aa. be Last Priority. Residents owning private lakeshore within the City which has dockable lake frontage shall have the last priority each year for a dock on public lands. First Priority. An abutting owner has first priority for a City designated location within his or her lot lines extended to the shoreline. Docks shall be located in accordance with the dock location map. Second Priority. A licensee or, if licensee has not applied for a new dock license, the shared owner as shown on the permit application for the preceding year, has second priority when applying for a dock permit for the same location held by the licensee the immediately preceding year. Second priority licensee has no priority of dock locations where a first priority license is in effect. Thir4 Priority. A duly qualified applicant has third priority on locations vacant after the first and second priority applications have been made within the prescribed time limit described in this ordinance. Licenses will be issued to such applicants in the order of application dates. There shall be no third priority where the first and second priorities are in effect. Residents owning private lakeshore within the City which has dockable lake frontage shall have the last priority each year for a dock on public lands. A4ministration of Priority. The Dock Inspector shall assign all locations to the applicants upon compliance with this ordinance and subject to reasonable conditions and Council approval. Ail applications received after February 28th shall be subject to a minimum late fee of $20.00, and will be placed in a third priority category. There will be no late fee charged :o new residents who apply after February 28th of the calendar year in which the resident to the City. Residents of the City of Mound, 65 years of age or older, shall pay 50% the required license fee for a dock. RULES AND REGULATIONS (PORTION OF CITY CODE SECTION 437) Subd. 1. Dock Location MaD Definition. There shall be on file in the City Hall a drawing of the City of Mound that is maintained by the Dock Inspector showing the approved locations of private docks that may be constructed on or abutting public shoreland under the control of the City. Subd. 2. Annual Review of Map. Approved dock location maps shall be kept and maintained by the Dock Inspector and shall be reviewed by the Park and Open Space Commission at least once a year. The Park Advisory Commission shall review the dock location map between September I and December 31 before each new boating season so their recommended changes may be referred to and considered by the City Council on or before January 15. Maps shall contain all approved dock locations as established by the Council upon the advice and recommendation of the Dock Inspector and Park Advisory Commission. Final approval of the dock location map and the number of dock licenses to be permitted shall be recommended by the Dock Inspector, reviewed by the Park Commission and Approved by the City Council. Subd. 3. Dock Inspector to Review Application. The Dock Inspector shall determine and approve the location of each permit according to the specifications of the approved dock location map. Subd. &. Costs of Erection and Maintenance. Licensed docks shall be erected and maintained by the licensee at his or her sole expense and liability for same. Subd. 5. Suspension of Eliqible Location. The CitY Council may suspend a dock location where it appears that a location as established on the dock location map reasonably interferes with the use of public waters or imposes a hardship on property owners abutting on public streets or public commons. Subd. 6. One Dock Per Family; Apartment Buildinq. No more that one dock shall be eermitted for each resident family. An apartment building or multiple dwelling owner shall ot apply for dock licenses for his renters or lessees. He or she is entitled to apply for an individual private dock license for himself or herself if he or she is a resident of the City. (INFO 12/3/92) NO'T- Subd. 7. Construction Materials; Use of Car Tires. Ail private docks shall be constructed of materials specified by the Building Inspector and the Dock Inspector and in accordance with all building codes of the City. The standards for the public health, safety, and general welfare and neither the materials or the workmanship for an approved licensed privat~ dock shall result in docks being located on public lands which are unsightly, unsafe or create a public nuisance. No tire or tires shall be hung or attached on dock posts, dock poles, or on dock hardware of any dock on or abutting public shoreland under the control of the City. (ORD. #40-1990, 1-29-90) Subd. 8. Inspections - Notice of Non-Compliance - License Revocation. The Dock Inspector or such other officer as may be designated by the City Manager or the City Council, may at any reasonable time inspect or cause to be inspected any dock erected or maintained upon or abutting upon any public street, road, park, or commons, and if it shall appear that any such dock has not been constructed or the area surrounding the dock site is not being maintained in accordance with the application or the license granted therefore, or with the plans or location approved by the Council, or shall it appear that such dock is in a condition that no longer complies with the requirements of this ordinance or other ordinances of the City, the City, by its City Manager or any other officer designated by him, shall forthwith notify the owner thereof in writing specifying the way or ways in which said dock does not comply with the ordinances of the City, after which said owner shall have ten days to remove such dock or make the same comply with the terms of the City's ordinances and the terms of the application and issuance of the license granted to said licensee. In the event such owner shall fail, neglect, or refuse to remove such dock or make the same comply with the terms of the City regulations within the period of ten days, the license therefor shall be revoked by direction of the City Council or the Dock Inspector and by notice in writing to the licensee, and said notice shall be issued by the City Manager or any other officer designated by him or her. Any appeal will be made in writing and submitted to the City Manager by a certified letter or by personal delivery to the City Manager for his or her consideration. Subd. 9. Notice of Revocation. Ail notices herein required shall be in writing by certified mail, directed to the licensee at the address given in the application. Subd. 10. Dock Storaqe. No person shall store, leave or abandon any dock, dock section, dock poles or dock hardware on any public road, street, park or Commons except for winter storage in approved areas. Subd. 11. Removal Deadline. Ail private docks abutting any public road, street, park, or commons must be removed from the waters of Lake Minnetonka or other navigable waters no late~ that November I of the license year unless it is a winter approved dock location as shown on the master dock map. Subd. 12. Dockinq of Non-Owned Watercraft. Docking of boats not owned by the dock licensee is not permitted for a period in excess of 48 hours. Section 437:15. Maximum Dimensions, Prohibited Design of Docks. Docks for which a license is required by this Section 437:15 shall not be less than 24" wide or more than 48" in width with the exception that one 72" x 72" section is allowed on L, T, or U shaped docks provided that this configuration be limited to a setback of 10 feet from private property and shall not infringe on an adjacent dock site. Docks shall not exceed 24 feet in length except where necessary to reach a water depth of 48", using Lake Minnetonka elevation levels of 929.49 feet above sea level. Channel docks, where navigation is limited and docks must be installed parallel to the shoreline, cannot be less than 24" wide or more that 72" in width. The length shall be limited to a setback of 10 feet from private property or not to infringe on an adjacent dock site. Docks shall be of plank or rail construction. Dock posts shall be of equal height above the dock boards and shall be at least two rail construction and constructed to comply to standards and specifications approved by the Dock Inspector. Ail docks shall be built or placed with the longitudinal axis thereof perpendicular to the shoreline unless variations otherwise may be permitted in accordance with the topographical conditions of the area. Docks which are in existence June 1, 1989, shall be brought into compliance with all provisions of the City Code when expansion or modification is requested, or replacement of 50% or more of any such dock that is-damaged, destroyed, or deteriorated. (ORD. $38-1989 - 1-2-90) Section 437=20. Penalties. Any person or persons who shall violate any of the prohibitions or requirements of this ordinance shall be guilty of a misdemeanor. In addition to any criminal penalties as above provided, the City Council may remove or cause to be removed any dock erected without a license as required by this Section 437, or where any license has been revoked as provided by this Section 437. Removal of unlicensed docks or docks which fail to comply with the City Code will be at the expense of the owner or licensee. No person convicted of violating City ordinances relating to docks will be issued a dock license for the present or for the next boating season, and said person forfeits any priorities set fortl in this Section 437. NOTE: The use of fertilizer, herbicides and pesticides is not recommended on city property. These chemicals drain into the lake and can cause serious environmental problems. Maintain the cleanliness of the area by your site, including grass cutting and weed trimming. Aquatic plants that are protected by law require permits prior to removal· Remove Eurasian Water Milfoil from the shoreline around your dock. Boats, dock sections, pipes, posts, and other materials cannot be stored on public land during the boating season, and must be removed by June 1. Winter storage is allowed in most areas, if neat and orderly, not obstructing area or creating a hazard. Response to request to correct infractions must be made during the time stated or dock permit will be in jeopardy. Special Permits for Certain Structures on Public Subd. 1. Construction on Public Land Permie. Construction of any kind on any public way, park or commons, or the alteration of the natural contour of any public way, park, or commons, is unlawful unless a special construction on public land permit is issued by the City Council. Any proposed construction, special use or land alteration shall require the applicant to provide necessary drawings to scale, specifications of materials to be used, proposed costs, and purpose for change. Ail special permits shall require a survey by a registered land surveyor before a special permit will be issued. Survey shall comply with the Mound Building Code survey requirements. Copies of such surveys, drawings, specifications of materials, proposed costs and statements of purpose shall be furnished to the City and kept on file in the City offices. No special permit shall be issued unless approved by a four-fifths vote of all the Council members. Subd. 2. Types of Construction Requirinq a Special Construction on Public Ls,d Permit. Ail stairways, retaining walls, fences, temporary structures, stone work, concrete forming, or any type of construction shall require a special permit. No special construction permit shall be issued for construction of! boathouses or other buildings on public land under Section 320 or any other! ordinance of the City. Subd. 3. Public Land Maintenance Permits. No person shall maintain any boathouse or other structure on public lands without first receiving therefor a special maintenance permit from the City in accordance with this subdivision. Applications for maintaining existing boathouses or other structures may be obtained from the Building Inspector at the City offices. Ail applications for special maintenance permits shall be reviewed by the City Council. The Council shall determine if the maintenance permit shall be granted or denied, and may order any structure to be removed. Special permits are required for any maintenance such as maintaining retaining walls, stonework, concrete or other types of improvements on public lands. The Council shall have the right to impose any reasonable conditions it may deem advisable to protect the public's use of the public shoreline. Ail structures, retaining walls, stonework, concrete, or other improvements on public lands are required to have a public land maintenance permit from and after April 1, 1976. Subd. 4. Land Alteration. A special land alteration permit shall be required from the City before any alterations are made on public lands which would result in any changes to the following: shoreline, drainage, grade, pitch, slope, trees, or which require the removal or placement of any fill, or which eliminates, adds or develops any access road or land. This section specifically includes any alterations to uses which are nonconforming on the date this ordinance becomes effective. No special permit shall be issued unless approved by a four-fifths vote of all Council members. Structures located on public lands which are ordered removed by the City Council or by the City Building Official under any code or law may proceed under the supervision and direction of the City Building Official without the necessity for obtaining removal permits from the City Council. Type of inspection done by the City Dock Inspector on commercial docks. 3. Why the buoys are being phased out. 4. Can a Buoy permit and a dock permit be held by one individual? I will address your questions in order. First, as you will note from the attached Exhibit #1, there are currently eleven permitted commercial docks. Of these eleven sites, seven do not pay a fee, but still make application to the City for a permit· Four sites pay a fee with their application for a permit. The policy currently is, and was present before I began working with the City of Mound in July of 1985, that any commercial dock site that does not rent slips out to non residents of the complex or association they are affiliated with, are not charged a fee. On the other hand, a commercial dock that is renting sites to non residents, using excursion boats or for profit type of operation, a fee is charged as outlined in the attached Exhibit #2, Mound City Code Section 510:15. printed on recycled paper Memorandum Information on Dock Forms and Charges November 13, 1995 Page 2 The inspection of all commercial dock sites'are done once a year or when a concern has been received. The City of Mound Dock Inspector verifies both the application sent to the City under its application process and the application sent to the Lake Minnetonka Conservation District (LMCD). The on-site inspection also includes looking at the condition of the dock structure for requirement under Mound City Code Section 436, note the attached Exhibit #3. The current policy that addresses buoys has been consistent since 1985, prior to my being employed at the City of Mound. This policy has been to phase out buoys based on the complications they had on dock use. They were deemed an obstruction for boat traffic because of their nature for the boat to swing with the wind. As of 1995 there is only one remaining buoy in Priest Bay at Ridgewood Park. Five other buoy permits were not re-issued after not being renewed. Note the attached Exhibit #4. It is part of the policy that a buoy site holder can also have a dock site, the one remaining buoy site holder does not have a dock site, they launch a small personal watercraft at Ridgewood Park to get to their boat. No person, association of persons, or families whether incorporated or not, through any arrangement, whether through co~mon or corporate ownership or otherwise, shall operate, carry on, or be engaged in the trade or business of docking, mooring, anchoring, keeping or storing of boats or make any arrangement for the use or joint use of lakeshore property for such dockage of boats and watercraft within the corporate limits of this City urithout having first obtained a license. Any person, firm, or corporation or ~roup or association of persons desiring such a license, shall make application in writing to the City Council, which application shall be signed by the applicant and filed with the City Clerk. The application shall se~ forth the names and residence of the applicant, exact location at which the applicant proposes to carry on his or her business or use of lakeshore property, and whether he or she is then or has heretofore been engaged in a similar business. The application shall be accompanied by a sketch of the proposed facilities, including location and type of buoy to be used therewith and the parking facilities as well as a statement outlining the manner, extent, and degree of use contemplated. The Clerk shall present the application to the City Council at its next regular meeting after the filing thereof. Mound City Code Section 436:10 Section 436: 10. Regulation of Commercial Boat Docks. In the event boat storage facilities are provided, any person owning or operating a Commercial Boat Dock shall comply with the following minimum standards: Subd. 1. Fire Hazards. Ail watercraft s~ll be stored in such a manner that they do not create a fire hazard. Subd. 2. Gasoline Storage. Any gasoline offered for sale or stored on the premises shall be placed in tanks or containers as may be required by the City Council and by City and State fire regulations, and such tanks or containers shall be stored underground or such distance from the storage facilities so as not to create a danger in the community. Subd. 3. Gasoline Sales. Gasoline sales shall not be made from the dock at which customer's water=raft are stored. Subd. 4. Buoys. The location and marking of all buoys shall be subject to the regulation of the Council. Subd. 5. Orderly Maintenance. The premises shall at all times be maintained in a neat and orderly manner. Subd. 6. Parking. Off-street park/ng shall be provided as follows: One off-street parking stall for each three rental boat stalls, buoys, or slips available to customers or joint users. Subd. 7. No Residential Use. No boat or other floating structure tied up or connected ~o such dock facilities shall be used as a permanent, temporary, or seasonal residence. Section 436:15. Limitation of Commercial Dockase. No person shall anchor, keep, moor, dock, or store a boat, canoe, raft, barge, or other watercraft within the harbor limits of this City except at a dock or buoy which is in compliance with the terms of this Section 436, except, however, that a riparian owner may dock or store boats and other watercraft, in the natural body of water adjoining his or her property in a manner which will not interfere with boat traffic, legitimate use of the lake, or infringe upon the riparian rights and privileges of abutting property owners. Section 436:20. Regulation of Commercial Boat Docks. Subd. 1. Prohibition. No person, firm, corporation, or association shall use any area of the lake as an authorized commercial dock use area, for commercial docks, moorings, or boat storage unless such use is specifically perm/tted and licensed under the provisions of this Section 436. Subd. 2. Authorized Commercial Dock Use Area. An authorized commercial dock use area is described as follows: (a) Length - The authorized commercial dock use area for sites bordering on the lake extends into the lake a distance equal to the site lake frontage to be measured at right angles to the side site lines and, except as provided herein, shall not extend into the lake a distance greater than 200 feet to be measured in a line parallel to the side site as extended into the lake. Notwithstanding the provisions of this MOund City Code Section 436:20, Subd. 3 subdivision, commercial docks in existence or authorized by other goverzunental agencies and ,,-der construction on the date this ordinaxtce becomes effective shall be considered non-conforming use and may continue in existence without the necessity for the granting of a variance under the provisions of Section 436:40. Said non-conforming docks shall be subject to the provisions and limitations set forth in Section 23.20 of the City Zonint Code and of all regulations subsequently adopted regarding non-conforming uses. (b) Width - The authorized dock use,area for sites bordering on the lake is limited in width by the setback limitations prescribed herein. The setback from side site lines as extended in the lake shall be as follows: For that portion of the length of the authorized commercial dock use area which extends from the shore The setback shall be Zero to 50 feet 50 to 100 feet 100 to 200 feet 10 feet 15 feet 20 feet. Subd. 3. Structures Not to Obstruct. No licensed dock, mooring, or other structure shall be so located as to obstruct a navigable channel, or so as to obstruct reasonable access to any other dock, mooring area, or similar structure authorized under this Section 436. No dock, mooring area, or similar structure shall be located or designed so that it unnecessarily requires or encourages boats using it to encroach into any other authorized commercial dock use area or into individually owned private dock areas. Subd. 4. Space Between Boats. Reasonable space shall be provided in mooring areas to allow navigation feeely between moored watercraft. Subd. 5. Extensions. No commercial dock or mooring area shall extend across the extended zone line between sites zoned differently by the City. Subd. 6. Unusual Configurations. Where the provisions of this Section 436 would cause the authorized commercial dock use area of two or more sites to overlap, or where there is any other unusual configuration of shoreline or extended lot lines, which causes a conflict between the owners of two or more adjacent or nearby sites as the use of the same area of the lake for docks, mooring areas, or other structures or for reasonable access thereto, the owner of any of the affected sites may apply to the Council for a variance. Subd. 7. Construction~ RepairandMaintenance Standards. (a) General Rule. All commercial docks, moorings, and other structures shall be constructed and maintained as provided in this Section 436. (b) Materials. Docks, moorings, and other structures, whether temporary or permanent, shall be constructed of such materials and in such a manner as the owner determines, provided that they shall be so built and main- rained that they do not constitute a hazard to the public using the waters of the lake. Mound City Code Section 436:20, Subd. ?(c (c) Safety. Commercial docks or mooring areas may be constructed of such materials and in such a,~nfler as the owner determines provided that such dock or mooring area shall be so built and maintained as to be safe for use by the public. Lighting. Commercial docks shall be suitably and adequately lighted in accordance with City re~lations. No oscillating, rotating, flashing or moving sign or light may be used on any dock. Dock lighting shall not be directed toward the lake in such a -~--er that it impairs the vision of . or confuses operators of watercraft. (e) Signs. No advertising signs may be displayed from any dock other than an identifying sign which shall be no larger than six square feet in area. (f) Fuel and Power Supply. Installation of electrical and fueling facilities on commercial docks, moorings, and other structures shall be in accordance with applicable building codes and subject to state and local inspection procedures. Persons making such electrical or fueling installations shall maintain records of compliance with state and local codes and regulations. (g) Factors Considered. In exercising its discretion in granting or denying licenses, the Council may consider, among other things, the following: (1) Whether the commercial dock or mooring area will be structurally safe for use by the intended users. (2) Whether the facility will comply with the regulations contained in this Section 436. (3) Whether the proposed facility will create a volume of traffic on the lake in the vicinity of the facility which will tend to be unsafe or which will cause an undue burden of traffic upon the lake in the vicinity of the facility. (4) Whether the proposed facility will be compatible with the adjacent development. (5) Whether the proposed facility will be compatible with the maintenance of the natural beauty of the lake. (6) Whether the proposed facility will affect the quality of the water of the lake and the ecology of the lake. (7) (8) Whether the proposed facility, by.reason of noise, fumes, or other nuisance characteristics, will tend to be a source of nuisance or ~-noyance to persons in the vicinity of the facility. Whether adequate sanitary facilities will be provided in connection with the proposed facility. Section 436:25. License Fee and License Applications. Subd. 1. Expiration and Fee. Any license issued by the Council pursuant to :his Section 436 shall expire on April 1 next following its issuance. The base fee for new applications and for renewal applications, plus an additional fee for each boat accommodation, shall be as set by the Council in Section 510: 15. "~ Mound City Code Section 436:30 Subd. 2. License Applications for Docks. License applications shall be obtained at the City offices. Such applications shall state completely the information required by Section 436:05 and by the City Manager or the Dock Inspector. Subd. 3. Application Filin~. Applications for licenses shall be filed with the Dock Inspector at the City offices and he shall recommend to the City Council that the license be approved or denied. No license will be recommended or authorized until the Dock Inspector determines that the proposed dock complies substantially with the terms of all City ord/nances. Subd. 5. Late Applications. Ail applications received on or after March 1 shall be subject to a late fee as set by the Council in Section 510: 15. Section 436:30. Issuance of License. Subd. 1. Any license issued by the Council pursuant to this Section 436 may contain restrictions as the Council- de-m~ necessary to protect the health, welfare, and safety of the general public from over-burdening the primary harbor limits of this City and the lakeshore at any particular location having in mind (among other things) parking problems, safety requirements for docking and mooring, contamination of the lake for boat traffic of all kinds. Each license when issued shall conta/n a statement of the restrictions and conditions and said license with. such restrictions end conditions shall be conspicuously posted on the licensed premises. Subd. 2. No license shall be issued by the Council pursuant to this Sect/~n 436 authorizing a commercial boat dock or boat dock/ng or storage upon property within the confines of this City contrary to the regulations and limitations applying to said property set forth in the City's Zoning Ordinance. Section 436:35. Inspection. The City Council or such officer as may be desi~nated by the Council for the purposes may, at reasonable times, inspect or cause to be inspected any such licensed commercial boat dock, and if it shall appear that such dock has not been constructed or is not beenE maintained or used in accordance with the license issued by the Council, or in accordance with the terms of this Section 436, the Council, by its City Manager, shall notify :he owner thereof in writing of the way or ways such dock does not comply with the license required in this Section, after which the owner shall have ten days to remove the dock or make the same comply with the terms of the license and this Section 436. If the violation is not corrected within the allotted time, the Council shall revoke the license. Notifica=ion under this Section 436 shall be made in writtng to the owner of the dock at the address given in the application. 'Fa/lure to have a valid license in force shall be prima facie evidence of a violation of this Section 436. VARIANCE FOR ADDITION The applicant is seeking a variance to allow construction of a second story addition over a portion of the existing dwelling. The proposed addition will not exceed the height of the existing house. The addition and this portion of the dwelling is setback 38 feet from the ordinary high water (OHW) of the lake. The deck on the first floor is setback 28 feet from the OHW, a 50 foot setback is required, resulting in recognition of a variance of 22 feet. The addition follows the existing footprint and will not encroach further into the nonconforming setback than the existing condition. This area is highly developed with relatively close setbacks to the lake. The neighbor to the east has structure that is located closer to the lake than the applicant's deck. Staff recommended the Planning Commission recommend approval of the request for the second story addition as proposed. The addition will enhance the use and function of the property will not substantially increase the negative impact to the nonconforming lake setback. Allowing the expansion of the nonconforming dwelling will not create a situation that is out of line with the adjoining properties. The nonconforming addition is located outside of the shore impact zone. Planning Commission Hinutes December 11, 1995 Weiland questioned if a permit was issued for the existing decks. The applicant, Bruce Hunerberg, indicated that there was no record of a permit for the decks on file, and he assumed they were constructed when the house was built. Weiland doubted the deck is more than ten years old. Weiland noted that question #5 on the Variance Application was not completed, and asked where the survey is for when the house was built. Weiland also questioned staff about the shore impact zone as referred to within the_recommendation. The Building Official clarified that the "shore impact zone" is a term within the zoning ordinance. The shore impact zone is recognized by the DNR as an especially sensitive area and there should not be encroachments into the area. Weiland sees the addition as an expansion of an existing encroachment and he does not agree with staff's recommendation. He understands that adjacent dwellings are closer, but feels this proposed addition creates a negative impact. The Building Official, Jon Sutherland, read question $5 from the variance application, "Which unique physical characteristics of the subject property prevents its reasonable use for any of the uses permitted in the zoning district?" Sutherland noted, that from the options listed, "shape of the lot" may apply, and it is an "existing situation." He noted that it is possible the house existed prior to the required 50 foot setback to the lake. Craig Goodrich of 1776 Lafayette Lane, representing the Driftwood Shores Association, stated that they are 100% in favor of the request. Hanus feels the impact of the addition is minimal considering the placement of the neighboring structures, however, expressed a concern about the one foot cantilever. Mueller stated that the additional one foot is not a substantial difference, but noted that if it is approved, the amount of the variance should be adjusted. Clapsaddle feels that the cantilever adds some style to the structure. Weiland requested that the association be advised that decks require building permits. MOTION by ross, seconded by Clapsaddle, to reoommend approval of the variance for the second stor~addition as proposed, including the one foot cantilever. Motion carried 6 to 1. Those in favor were: Clapsaddle, Hanus, Miohael, Glister, Voss, and Mueller. Weiland was opposed. Weiland stated that he is not in favor of the cantilever. This case is scheduled to be heard by the City Council on January 9, 1996. Planning Commission Hinutes O~o~mb~r II, 199~ CITY CODNClL REPREaENT/~TIVE'S REPORT The City Council Minutes of November 28, 1995 were included in the packet for review. voss noted that he was unable to attend the November 27th Planning Commission Meeting, and wanted to express a comment that domestic abuse shelters should be a county wide problem as they relate to criminal and civil matters which rightly belong under county administration. Weiland questioned if Glass Plus received a permit for the sign painted on the side of their building. It is his understanding that signs are not allowed to be painted directly on buildings. MOTION made by Voss, seconded by Glister, to adjourn the meeting at 8=04 p.m. Motion carried unanimously. MOTION by Jensen, seconded by Ahrens and carried unanimously to approve the Minutes of the October 24, 1995 regular City Council meeting and the verbatim coverage of a requested item, as amended. 1.2 CONTINUED DISCUSSION: PETITION FOR LOCAL IMPROVEMENT XXXX KILDARE ROAD, LOTS 21, 22, 23, 24, 25 & 26, BLOCK 11, SETON, PID'S 19- 117-23-22-0036 THRU 0041. (STREET WITH CURB, GU'Il'ER, WATER AND SEWER). Mayor Polston introduced Tracy Ingram, realtor for the owners of property along the unimproved Kildare Road. Ingram stated his client had questions regarding the results of a feasibility study and what would happen after it was completed. Mayor Polston restated the fact that there are two property owners, one with 6 lots and one with two lots along the unimproved road and the owner with the 6 lots does not want the improvement or the costs and that owner did not sign the petition. The owner not wanting the improvement would have the largest assessment. This was the reason this road was not improved in 1978. Mayor Polston suggested they work it out with the non interested owner. City Attorney Curt Pearson listed the process regarding what would take place: 2. 3. 4. The Council would direct a feasibility study to be done. If the Council accepts the feasibility study, they order a public hearing. The public hearing date is published in The Laker. Notices are mailed to all of the affected property owners informing them of the proposed improvement and inviting them to the public hearing. The public hearing is held. The City Council makes their determination. If the petition represents less than 35% in frontage of the real property abuttinq on the street '''~ *~ ...... "' .......... '~"'";-J"'"' *~-'; .......... * a 4/5 vote of the council is required. However, without the proper right-of-way, the City would have to consider condemnation if the non approving property owner would not grant an easement or negotiate the sale of an easement. If all this worked out positively, and the street improvement happened with water, sewer and curb, there would be a second public hearing for the assessments, costs and how they should be paid. The non approving property owner could then appeal the tax assessment. 2 MINUTES - COMMITTEE OF THE WHOLE - NOVEMBER 21, 1995 The meeting was called to order at 7:30 p.m. Members present: Mavor Bob Polston, Councilmembers Mark Hanus, Andrea Ahrens, and Phyllis Jessen. Absent: Councilmember Liz Jensen. Also present: Mark Koegler, CiW Planner; Jon Sutherland, Building Official; Gino Businaro, Finance Director and Ed Shukle, City Manager. The topic of Variance Streamlining was introduced by Mark Koegler, City Planner. He reviewed a memorandum dated November 14, 1995 regarding the Planning Commission's discussion on Variance Streamlining. He reviewed two different statements related to this matter. He then reviewed information that had been compiled by Peggy James, Secretary, and Mike Mueller, Planning Commissioner, relating to variances that had been approved in 1993, 1994 and 1995 and what impact the proposed streamlining statements would have on those particular variances. The impact was minimal and it was the consensus of the Council to have the Staff further review the impact of actual variances to see if streamlining will really make an impact. It was basically the consensus to have the variances studied and then recommend streamlining statements versus creating streamlining statements and then seeing what effect they would have on the typical variances that have been approved. The Staff will report further to the Planning Commission who will then discuss it and then will submit a recommendation back to the City Council. City Manager Ed Shukle asked for some clarification as it relates to Public Lands permits on City of Mound projects. He indicated that routine maintenance such as tree trimming along right-of-ways to clear tree branches from growing into power lines or trimming trees to avoid traffic hazards did not require Public Lands permits. He wanted the City Council's reaction to that. The consensus was that Public Lands permits did not apply in these cases. However, there was concern expressed by the Council as it relates to certain projects that the City Staff does that would involve major removal of trees and filling of areas and that it is important that the City of Mound follow the same standard as it requires citizens to follow. Jim Fackler was asked to come into the meeting from the Commons Task Force meeting to answer questions as it related to the project that was done on Beachside Road after the August 6, 1995 storm. He answered questions and clarified issues with regard to this matter. The 1996 Proposed Budget was then discussed. The Council reviewed some Capital Outlay items, line items and the consensus was to have the City Manager and Finance Director suggest a reduction in expenditures of $22,990 which represents the decrease in the Fund Balance as proposed. Committee of the Whole Further discussion then was held with regard to issues previously discussed: Educational incentive for the PhD program for the Police Chief Keeping City Hall open one night a week Reduction of one Community Service Officer position Reducing the Capital Outlay Expenditure for computers in the City Manager/ Clerk department and the Planning/Inspection department by $500 each Not increasing the Recycling charge by fifty cents ($.50) as proposed and to leave it at a $1.50 per household Depot improvements Adding $2,000 back into the Budget to assist the Westonka Professional and Retail Council in the purchase of the spring and summer banners for downtown Mound To cut the $1,500 from the Capital Improvement Fund for skating rink improve- ments No consensus was reached on any of the above except that the City Manager was directed to suggest cuts in the Budget of $22,990. Further discussion regarding the entire Budget will be held at the Public Hearing scheduled for Wednesday, December 6,1995, 7:30 p.m. at Mound City Hall. Other business discussed were the roles and responsibilities of the Council Liaison as it related to the Planning Commission. Councilmember Mark Hanus indicated that the Planning Commission had requested that the City Council define what the role of the Council Liaison to the Planning Commission is. Hanus suggested that he already had provided what he thought his role was in the form of a memo. Council will discuss this issue further at its November 28, 1995 regular meeting. It was noted that there will not be a Committee of the Whole meeting in December. The next Committee of the Whole meeting is scheduled for Tuesday, January 16, 1996, 7:30 p.m., Mound City Hall.
