Motion carried. 1.2 PUBLIC HEARING: CITY ATTORNEY,S SUMMARY, PROPOSED ORDINANCE ADDING SECTION 495 RELATING TO THE REQUIREMENT OF OBTAINING ~ LICENSE TO RENT HOUSINGm PROPOSED RENTAL HOUSING MAINTENANCE ORDINANCE (CHAPTER 319) The City Manager explained that the Planning Commission has been 55 April 28, 1992 working on this for a number of years. Section 495 relates to Licensing of Rental Housing and Section 319 relates to Housing Maintenance Regulations for Rental Housing. The Building official reviewed the Executive Summary of the two proposed sections. The purpose of the ordinances is to maintain the housing stock in the community and have people live in a habitable home. The Mayor opened the public hearing. JIM BEDELL, Z6Z$ Wilshire Blvd. stated he feels that rental homes and owner occupied homes will be treated differently if these ordinances are adopted. He thought landlords input should have been incorporated in these ordinances. He did not agree with all items in these ordinances, i.e. paved driveways and snow removal. Councilmember Jensen stated that the City does not want to intrude upon the accepted contractual relationship between tenant and landlord. She further stated that the Planning Commission did discuss items that were brought up by landlords at the June 25, 1991, public hearing. There was impasse on some of those items. The city Attorney stated he feels there are some things that need to be addressed before these ordinances are adopted, i.e. how the inspection process will be implemented (providing the time and people to carry out these ordinances), and a fee structure. MOTION made by Jensen, seconded by Jessen to adjourn the public hearing until the June 23, 1992, Council Meeting, to provide Staff the time to prepare a fee structure and a plan for how the inspection process will be implemented. The Planning Commission recommended approval unanimously. Councilmember Smith questioned the first condition granting the variance "contingent upon the removal of the existing nonconforming detached garage by May 28, 1993". He asked that the applicant be asked to enter into an agreement with the city that would guarantee that the garage would be removed or the city could enter the property, remove the garage, and assess the costs to the property owner. The city Attorney suggested the following language change in #1 under the Now, Therefore, Be It Resolved: ,' ..... contingent upon the preparation and execution of a recordable agreement that the City can enter the property, remove the existing nonconforming garage and specially assess the costs against the owner if it is not removed by May 28, 1993". The Council agreed to the amendment. Motion carried. Mr. Hanus asked to comment on a Staff policy. A permit was issued to a neighbor for reroofing. The structure is nonconforming as far as the side setback and is also encroaching on Mr. Hanus' property. He contacted the Building Dept. and the Building Official's opinion is that it is a personal issue between the two property owners and that he was not going to revoke the permit. The Building Official stated that the carport that is encroaching was done without a permit sometime ago. He further stated that he has notified the neighbor, Mr. Pflug that he will have to remove the encroachment. The City Attorney stated that if a survey was brought to the City showing an encroachment on another's property a permit should not be issued, but this was not the case for Mr. Pflug. Apparently the part Mr. Hanus is speaking about has been re-roofed and 'this is an after the fact item. The Council at this point cannot establish a policy, it will have to be on a case by case basis. If the Council wishes, they could refer the policy matter to the staff and attorney for review and bring it back. Otherwise it will be between Mr. Hanus and his neighbor. No further action was taken. 1.6 ~ASE NO. 92-008~ CHARLES CHASE, JR., 3048 HIG~L~qND BLVD.~ LOTS 13, 14, 15, BLOCK 2, ~ HIGHLANDS, PID #23-117-24 44 9005. VARIANCE - BOATaOUSE The Building Official reported that the applicant is requesting a variance to Section 330:15 to allow construction of a boathouse with the lowest floor 1 foot below the required minimum floor elevation of 933.5 for Lake Minnetonka. Staff recommended denial at the Planning Commission based on the strong wording of the Code. The Planning Commission recommended approval on a 4 to 3 vote based on the fact that the boat house ,,use'' is other than "habitable,, and it is an "accessory use" versus a "principal use". In the City Planner's report a number of communities were surveyed to see what their minimum floor elevations are and they range from 931.5 to 934.0. Mound is currently preparing a new floodplain ordinance and a new shoreland ordinance. The State or Federal governments require one foot of elevation above the 100-year contour. The Minnehaha Watershed District recommends that communities require at least 2 feet above the 100-year contour. 58 April 28, 1992 The Building Official further stated that in his opinion the boat house is new construction, it is not simply the repair of an existing facility. The contractor stated that when he started to repair the original boathouse, the ~ fell in and he proceeded to pour a new slab and put the newts up. Since the building is not complete, it is still possible to raise the existing floor one foot to comply with the required 933.5 elevation. By raising the minimum floor elevation above the 100-year flood, we would be providing a measure of flood protection for the structure. One foot seems to be a minimum, but a number of cities and the watershed district recommend two feet which provides an additiona1 measure of protection. Mr. Chase addressed the Council and stated that the same footings are being used and the boathouse is at the same elevation it has been at since it was originally constructed and has been that way for at least the last 28 years. The Watershed District was out and felt it was o.k. He stated that the boathouse has been through two 100-year storms in the last 20 years and there was no water up to or near the structure. Ahrens moved and Johnson seconded the following resolution: RESOLUTION #92-45 RESOLUTION TO APPROVE A VARIANCE TO SECTION 330~15, SUBD. 10 OF THE MOUND CODE OF ORDINANCES RELATING 'TO MINIMUM FLOOR ELEVATION FOR RECONSTRUCTION OF A BOATHOUSE AT 3048 HIGHLAND BLVD., LOTS 13t 14t 15~ BLOCK 2~ THE HIGHLANDS, PID #23-117-24 44 0005, P & Z CASE #92-008 Councilmembers Jensen and Jessen stated they would have to vote against approval because it does not meet the required elevation requirement. The vote was 3 in favor with Jensen and Jessen voting nay Motion carried. · 1.7 CASE NO. 92-009 & 92-010: RICHARD OL~XA, 6607 BARTLETT BLVD., LOT 9 & W 1/2 OF LOT 10, .HALSTED hEIGHTS, PID #22-117-24 43 0012. Mi~OR SUBDIVISION & VARIANCE~ The Building Official reported for the City Planner explaining that the applicant is proposing to move a property line that was approved previously in a minor subdivision. The Planning Commission recommended approval on a 6 to 1 vote with conditions. 59 April 28, 1992 The city Attorney pointed out that there is a platted street (Halsted Lane) that comes from the west in Halsted View. He questioned whether a street easement is necessary on Mr. Olexa's lots to extend Halsted Lane. The other question was about a water easement that is required by the proposed resolution. The Attorney recommended that this item be referred to the City Engineer and the City Planner for further revieW. MOTION made by Jensen, seconded by &hrens to table this item to the May lZth meeting after the proper easement or easements are obtained from Mr. Olexa. The vote was unanimously in favor. Motion carried. 1.8 COMMENTS ]tND SUGGESTIONS FROM CITIZENS PRESENT Nancy Hoy, 2146 Cardinal Lane - stated she would like to see the Council find out what the real cause is as to why people are not getting Building Permits before doubling and tripling permit fees. Also felt landlords should be allowed to comment on the rental housing ordinances. Jim Kuehn, 4633 Island View Drive - stated he would like an improved understanding of the policies and the commitment to help all commons users. He represents citizens for Commons' Sense and stated they would like to be involved in the decision making processes of the following: ,,* Commons' Policies Translate commons' policies into simple english. Examine the appropriateness of specific commons' policies, administration and categories. Make changes. * Re-examine the Docks Program To include fee structure, locations, and other concerns. * Commons' Property Tax Reform Promote an equitable property tax system, clearly defining differences between private lakeshore and commons' lakeshore. * Budget Accountability Line item accountability as it relates to commons' programs. * Enhance the public image of the City of Mound." The Council thanked the people who commented and suggested that the Staff and the Council hold another presentation session for the realtors in the area and inform them about commons. They also suggested have the Citizens for Commons' Sense meet with the Staff and Council and discuss their concerns. 6O April 28, 1992 Alan Greene, 2645 Casco Point Road~ Orono - was a resident of Mound for 20 years and is the former Chairman of the Park Commission in the mid 1960's to mid 1970's. He commented on the study that was done on the common's at that time. He explained that the study was precipitated because there were 3 groups of people out there then: 1. Inlanders who wanted to use the commons. 2. Residents abutting the commons who felt they were being encroached upon, particularly their privacy. 3. Residents abutting the commons who were very dissatisfied with what people were doing on the commons, i.e. leaving docks in all year and leaving debris on the commons. He then gave the background of why and how the dock ordinance came about. He explained that he was on the Park Commission when the survey of the commons was done to determine what structures were on the commons. At that time, the structures were grandfathered in but it was not the intention that the structures be allowed to stay indefinitely. Greg Knutson, 4701 Island View Drive - asked who is respOnsible for the structure on the commons abutting your property. The City Attorney stated that if the structure is there legally, it should have a maintenance permit, otherwise it should not be there, and if it has a maintenance permit it runs with the land so it transfers from one ownership to the next. Keith Foerster, 4645 Island View Drive - feels that the City needs to address all properties with housing maintenance, not just rental housing. Jayne Hetchler, 4913 Island View Drive - hopes that there will be recognition of the different types of commons. 1.9 .RECOMMENDATIONS FROM PARKS AND OPEN SPACE COMMISSION RE: PUBLIC LANDS PERMIT APPLICATION FOR LARRY HAUSKINSt 174~ ~LO~BIRD LANE, WIOTA COMMONS, DOCK SITE #13480 - TRIMMING OF VEGETATION The Park Director explained that this is an after the fact permit. The Park & Open Space Commission recommended approval on an 8 to 1 vote. Jessen moved and Ahrens seconded the following resolution: RESOLUTION %92-46 RESOLUTION TO APPROVE A PUBLIC LANDS - LAND ALTERATION PERMIT FOR TRIMMING OF TREES AND VEGETATION AT WIOTA COMMONS ABUTTING 1749 BLUEBIRD LANE, LOTS 13 & 14t BLOCK 9t DREAMWOODt DOCK SITE #13480 61 April 28, 1992 The vote was unanimously in favor. Motion carried. 1.10 R~QUEST FROM MOUND FIRE DEPARTMENT RELIEF ASSOCIATION TO INCREASE MONTHLY PENSION BENEFIT The City Manager explained that the Mound Fire Dept. Relief Association has had an actuarial study done on their pension fund. They are now requesting a $25.00 increase in their pension benefits. This would be a raise from $395.00 per month to $425.00 per month. He further indicated that the present level of contribution from the State, fire contract cities and pension fund investments will cover the proposed increase. Johnson moved and Smith seconded the following resolution: RESOLUTION #92-47 RESOLUTION APPROVING THE RELIEF ASSOCIATION'S REQUEST TO INCREASE PENSION BENEFITS AS REQUESTED The vote was unanimously in favor. Motion carried. 1.11 ~VIEW OF I{AZARDOUS BUILDING (BOATHOUSE) ON PUBLIC LANDS (DEVON COMMONS) t 4729 ISLAND VIEW DRIVE, CAROLE MUNSON The Building Official reviewed his report on the dilapidated boat house. The Staff recommends the following: OPTION #1 - The city Council direct staff and the City Attorney to proceed with removal of the boathouse due to its unsafe condition on public land. OR OPTION #2 - Allow the applicant continued use of the boathouse until the expiration of the current maintenance permit on December 10, 1994, upon the condition that the structure be restored to a safe condition by the applicant. The applicant shall submit a detailed list of corrections that address the concerns as listed by the Building Official in his report. Carole Munson was present and stated she feels comfortable with the boathouse as is. She requested that the Council stand by their decision on December 10, 1991, and honor the 3 year maintenance permit that was issued. The Council discussed the boathouse; the maintenance permit; what repairs to allow, if any; and the removal of the boathouse at the end of the maintenance permit period. The question is whether or not to repair the boathouse. The Building Official recommended that the applicant get a qualified person to review the building. The applicant stated she did intend to do some minimal things to the building, but no major 62 April 28, 1992 improvements. The Council explained that the maintenance permit was to allow use to the extent of the useful life of the structure. The City Attorney gave the following analogy: 1. The building Official has recommended removal on the basis of, it is his opinion that the building is hazardous. 2. The Council is saying no, we've given a permit and we're going to live with that permit for the balance of the three year period. The Council is also asking the Building Official what needs to be done to the building to make it safe. 3. The Building Official is saying here are some things he can think of off the top of his head but essentially he does not want to be responsible to redesign her building. The City Attorney suggested that the Council defer action on this item for 2 weeks and let the Building Official work with the applicant and whoever her representative is to do what the Council is basically saying, i.e. do the minimal work to protect the health, safety and welfare of anybody who may be in or around that building for the 3 year period. At that time, it should come back, and an agreement be drawn between the City and Ms. Munson that: 1. There be insurance to protect she and the City. 2. It should contain language which would require its removal at the end of the permit period, at her expense. Another question that needs to be addressed is: Does the City want to require people to record these permit documents on their title, which is the only way persons buying the property would have official notice? MO~N_~ad~ by Jessen, seconded by Smith to table this item un~ll the 4une ~th Meeting, in order to give Ms. Munson time to have a building contractor look at the building and meet with the Building Official to do the minimum to make the building safe. The vote was unanlmously in favor. Motion carried. 1.12 REOUEST FROM RICHARD INDRITZ, ATTORNEY, ON BEHALF OF CAROr.~: MUNSON, 4729 ISLAND VIEW DRIva TO RECONSIDER APPLICATION FOk pERMIT FOR CONSTRUCTION ON PUBLIC LANDS Mr. Richard Indritz, Attorney for Ms. Munson, addressed the Council asking for reconsideration of the Council's decision of December 10, 1991, requiring the removal of the deck that was built last year. Her contention is the same as it was back in December, the construction of this deck was just maintenance of an existing structure. He suggested that other people have been given after 63 April 28, 1992 the fact permits for decks on commons, i.e. the Konnads. Ms. Munson showed an overhead of the Commons with the deck, boathouse, stairway and playhouse. She stated she will need a walkway between the two sets of steps and therefore will need the deck to attach these steps to. There was discussion on other alternatives: 1. Landscaping, terracing and leaving the area open. 2. Steps can be built without having a deck to attach it to. Tom Casey, Park & Open Space Commission, stated that the scenic value of the property has been diminished because something is built on it. There is habitat that is being compromised because trees and shrubs are not there. Erosion control may be another item that has not been addressed. Bill Meyer, Planning Commission stated: Since it is an accessory building and is not on her property don't the same rules have to be followed as someone would if building an accessory building on their own property, i.e. setbacks, etc. He did not know when the City ever allowed an accessory building to be built without meeting the setbacks, etc. Mike Mueller, 5910 Ridgewood Road stated: That the structures were there before the applicant owned the property. If they are on City property the City should maintain them or pay to remove the structures. The Council reminded Mr. Mueller that the issue is the deck not the structures. The deck was added by the applicant since she purchased the property. MOTION made by Ahrens, seconded by Smith to amend the motion approved On December 10, 1991, to include the deck as part of the 3 year Maintenance Permit, thus deleting the portion of the motion which required that the deck be removed within 6 months of the date of that Meeting or June 10, 1992. The Council clarified that the permit given to Sandra Konnad was for Construction of Public lands, after the fact, not a Maintenance Permit. The vote was 2 in favor with Jensen, Jessen and Johnson voting nay. Motion fails. Johnson moved and Smith seconded the following resolution: RESOLUTION %92-48 RESOLUTION TO ISSUE A CONSTRUCTION ON PUBLIC LANDS PERMIT, (FEE WAIVED), TO 64 ~4~ril 28, 1992 CAROLE MUNSONv 4729 ISLAND VIEW DRIVEr TO ALLOW THE CONSTRUCTION OF A WALKWAY TO CONNECT THE TWO STAIRWAYS ON THE COMMONS, TO BE BUILT ACCORDING TO CODE. The vote was unanimously in favor. Motion carried. The Building Official asked that the applicant submit a sketch plan of how the two stairways will be connected and a permit will be issued. 1.13 RESOLUTION APPROVING STAFF RECOMMENDATION - STATES SALES TAY ~PPLICATION ON LOCAL GOVE_PJ;N~NT PURCHASE~ The City Manager explained that the Legislature has approved the application of the State's 6.5% sales tax to local government purchases. This was passed in lieu of the cuts in Local Government Aid. This will mean the City must cover approximately $12,000- $15,000 in sales tax for the remainder of this year. The City Manager has proposed the following personnel changes within the Police Department and the Parks Department to cover the amount: 1. Retirement of Sergeant Brad Roy, effective July 1, 1992, with realize a savings of $9,000. 2. Retirement of Bob Johnson and not replacing his position will realize a savings of $4,000. Councilmember Ahrens disagreed with the proposal by not replacing the position in the Parks Dept. The Council discussed maintaining the Park services at the present level and not replacing Mr. Johnson. Smith moved and Jensen Seconded the following resolution: RESOLUTION #92-49 RESOLUTION APPROVING STAFF RECOMMENDATION TO COVER STATE'S SALES TAX APPLICATION ON LOCAL GOVERNMENT PURCHASES The vote was 4 in favor with Ahrens voting nay. Motion carried. 1.14 APPROVAL OF ORDINANCE AMENDMENTS The City Clerk explained the proposed ordinance amendments. LAND USE CONSULTANTS MEMORANDUM TO: Mound City Council and Staff FROM: Mark Koegler, City Planner DATE: May 5, 1992 SUBJECT: Olexa Subdivision, Case #92-009 and 92-010 At the City Council meeting on April 28, 1992, action on the Olexa subdivision was tabled pending investigation of easement issues. The discussion at the City Council meeting focused on two types of easements: 1) a utility easement for water and 2) road easements (or right-of-way) to provide future street access in the area. Since the last meeting, the City Engineer has worked with Mr. Olexa to prepare and execute an easement agreement for the existing water line. Under the terms of John Cameron's recommendations, Mr. Olexa is to file the watermain easement at the time that the subdivision is filed with Hennepin County. Therefore, the issue of the watermain easement has been addressed. The second issue pertains to a possible easement or right-of-way for the easterly extension of Halsted Avenue. This issue was addressed in the Comment section' of the staff Planning Report dated April 7, 1992. That report expressed concern about the size of possible future lots should a street extension occur in the future. It sought to guarantee that suitable land is available to create conforming lots, it did not recommend acquisition of an easement or dedicated right-of-way at this time. The possible extension of Halsted Avenue is not a new issue in the City of Mound. A review of the half section map for the area (Exhibit 1) identifies that past Planning Commissions and City Councils have not only reviewed the issue but have approved subdivisions that have actually contained dedicated right-of-way for the road. The Halsted View subdivision includes Halsted Avenue. Furthermore, in 1989, the owner of Lots 1, 2, and 3 which abut the exiting terminus of Halsted Avenue submitted an application to create a single-family lakefront lot, south of the extension of Halsted Avenue. The application was withdrawn before it was reviewed by the Planning Commission. Additionally, Lots 4 and 5 were divided in 7401 Metro Blvd. · Suite 340 · Minneapolis. Due to existing topography, it would be virtually impossible to extend Halsted Avenue east of the Olexa property. Up to the Olexa property, however, the road is feasible from an engineering perspective. If the City of Mound is interested in securing the needed easement or right-of-way to accommodate the extension of Halsted Avenue, the most opportune time to do so is at the time of a proposed subdivision. In this case, the land needed for the street would probably need to accommodate a cul-de-sac since the continued extension of the street beyond the Olexa property is virtually impossible. At this point, two courses of action are possible: The City Council could find that it is appropriate to secure an easement or right-of-way for Halsted Avenue and request the City Engineer to examine the area and formulate recommendations on the location and size of such easement. Koegler commented that the City Engineer can create an easement agreement by using the easement description for the sanitary sewer from an existing Title Opinion or Certificate of Title. The applicant will only have marginal filing fees, the city will prepare the documents if the description is provided to use. The City is trying to complete this task as inexpensively as possible for all parties. Access to lot 2 will be via an easement over lot 1. COMMENT: On two previous occasions, the City of Mound found that a division creating either two or three lots was appropriate for the subject site. The current request which is very similar to the 1983 approval creates two lots, one of which does not have frontage on a public street. Since the request was approved previously and since on previous occasions, the subdivision was processed as a minor division, approval of the variances and subdivision is in order. The current request raises the issue of street access to the southern end of the parcel. Long term, the City may desire to extend Halstead Avenue through the properties in this area to provide street access. If Halstead Avenue was extended with a 50 foot width through the subject property, it appears that two lots could be created out of what is now lot 2, both of which would exceed 10,000 square feet in area. This conclusion has been reached utilizing half-section information combined with the applicants current survey. Due to scale, the accuracy of this information is questionable. It is in the City's best long term interest to see that conforming lots could be created in this area if the street extension ever occurs. Therefore, the applicant's surveyor could accurately project the right-of-way and calculate the corresponding lot area for the land lying north of the street extension. If the resulting lot is less than 10,000 square feet, the line separating proposed lots 1 and 2 could be shifted to the north thereby creating a future conforming parcel if an extension of Halstead Avenue occurs. RECOMMENDATION: Staff recommends that the Planning Commission approve a variance from the requirements of Section 330:20 (A) 2 of the Mound Code of Ordinances to allow the subject request to be processed as a minor subdivision. It shows the existing property descriptions as three separate parcels; however, Hennepin County's tax records show this property as two parcels which coincide with the subdivision approved in 1981 under Resolution No. 81-270. It does not appear that the subdivision created in 1983 by Resolution No. 83-61 was ever recorded. The second problem is with the existing watermain that crosses the southerly parcel. The original construction plan shows this watermain located within a 9-foot wide easement adjacent to the north side of the sanitary sewer easement. The survey Furnished with this request does not show an easement for the watermain. If indeed the easement does exist, the City should be furnished a copy of the document and if there is not an easement of record, we would recommend that one be dedicated as part of this approval. us. MINNESOTA 55364-1687 (6121 472-1155 FAX ~612~ 472-0620 P~S This time of the year we begin putting out all of the summer equipment, the picnic tables and garbage cans have been distributed; the tennis nets and volleyball nets have been installed. Soon the grass will begin growing and the mowing will be of high priority, so we try to get the seasonal repairs and installation done before the weather turns too nice. This year we will be pressed to perform some tasks early. As you are aware, Bob Johnson will not be returning. Generally, he would have begun working in mid-April along with Kent Kirsh. Kent will not be able to work until May llth. At which time the cemetery must be ready for Memorial Day and Mound Bay Park's beach must have all of the beach equipment installed. To add to this, one of my mowing crew members that would have been on hand the week before Memorial Day will be in Germany visiting relatives until May 25th. I do not expect the full crew back until May 26th, so please bear with us through the circumstances of man-power availability. Commons To say April in the docks program was busy would be an understatement. Tom has been issuing the 1992 dock sites, and with the high water there has been a tremendous amount of interest. Realtors have been calling for information due to the mortgage rates being good. Of course the inventory of the shoreline began, but was interrupted by the Carole Munson situation in which staff spent many hours preparing background for the Council's review. To-date we have completed the inventory of the island and half of three points. I would have been more comfortable being done with Three Points at this time, but with the effort and time put into the Munson situation, it is understandable. I still feel we will have a completed inventory in June. Cemeter~ The repair work to the graves from the winter of 1991-92 has been done so things are looking good for Memorial weekend. Tree Removal Two city trees were marked for removal in April, but will not be taken until mid-May. This is due to first road restrictions and during early part of April and then the ground being too wet to run heavy equipment on it. There were 30 plumbing, mechanical and miscellaneous permits issued for a total of 56 permits this month and 169 year-to-date. PLANNING & ZONING The Planning Commission reviewed proposed floodplain and shoreland ordinances drafted by the City Planner, Mark Koegler. The Planning Commission subcommittee is continuing its fast track review of the proposed Truth in Housing Ordinance. There were the usual numerous variance requests. CONSTRUCTION ON PUBLIC LANDS Parks Director Jim Fackler, Dock Inspector Tom McCaffrey, and I are continuing the inventory of public shoreline as directed by the City Council. The bids were opened on the 1992 Sealcoating Project and awarded to Allied Blacktop. April 7th was the Presidential Primary Election. This took up the better part of the first 10 days of April. We are required to remain open on the Saturday before the an election from 1:00 P.M. to 3:00 P.M. which had one person casting a vote. We are also required to be open until 7:30 P.M. on Monday evening before election day for absentee voting. No one came in that night. The judges sure enjoyed being in one polling place for a primary election and surprisingly I only had one person gripe about not knowing there would only be one polling location. The funny thing about that is that her husband was the first one in line at 7:00 A.M. Linda and I kept track of all our time as well as all the costs. This came to a staggering $7.08 per vote for this election. Out of 5935 registered voters, 573 voted. We will be reimbursed something for this election but it won't come close to the actual costs because the State is only allowing certain expenses. I have attached a summary of the election for your information. LEAF PICKUP This was held April 24 & 25, Westonka Sanitation picked up 380 cubic yards or 126 tons of leaves. SPECIAL RECYCLING This was also held April 24 & 25, these were 2 very busy days. We didn't have enough help to keep track of the number of cars that came though, but I'd estimate it at 1500. Friday, the 24th was a busy day, with 3 people collecting money, Saturday the 25th was very busy with at times 5 people collecting money. We took in $4,286.92. Now for the totals of recyclables collected. Tires - 24.6 tons Appliances - 30.11 tons - 305 appliances 12 air conditioners Goodwill - 18.1 tons Our total so far is 72.81 tons, with the scrap metal still being cleaned up. Our residents of Mound thought this was the best thing Mound's ever done and want to know when the next one will be. Knutson Services (the City's Recycling Company) came in the next Monday and stated there was alot more recycling out than US Ua 1 ~ printed on recycled paper OPERATION ..C._L_.E..A_N SWEEP It worked very well having our Special Recycling along with the Clean Sweep. They filled a 13 yd. dumpster and recycled many bags of cans and glass. Tires were brought right to the site of the Special Recycling. There were 36 Part I offenses reported. Those offenses included 3 criminal sexual conduct, 13 burglaries, 18 larcenies, and 2 arsons. There were 68 Part II offenses reported. Those offenses included 3 child abuse/neglect, 4 forgery/NSF checks, 1 narcotics, 10 damage to property, 1 liquor law violations, 6 DUI's, 11 simple assaults, 8 domestics (6 with assaults), 12 harassments, 6 juvenile status offenses, and 6 other offenses. The patrol division issued 128 adult citations and 11 juvenile citations. Parking violations accounted for an additional 29 tickets. Warnings were issued to 76 individuals for a variety of violations. There were 5 adults and 1 juvenile arrested for felonies. There were 25 adults and 4 juveniles arrested for misdemeanors. There were an additional 31 warrant arrests. The department assisted in 7 vehicular accidents, 1 with injuries. There were 27 medical emergencies and 63 animal complaints. Mound assisted other agencies on 6 occasions in April and requested assistance 11 times. Property valued at $22,372 was stolen. MOUND POLICE DEPARTMENT MONTHLY REPORT - APRIL, 1992 II. III. IV. Ve INVESTIGATION The investigators worked on 3 criminal sexual conduct cases and 7 child protection issues in April. Those 10 cases accounted for over 76 hours of investigative time. Additional cases investigated included assault, theft, burglary, forgery and NSF checks, stolen vehicle, damage to property, harassing communications, kidnaping, and absenting. Formal complaints were issued against individuals for assault, criminal sexual conduct and use of a minor in a sexual performance, forgery, false imprisonment, and vehicle theft. Personnel/Staffinq The department used approximately 70 hours of overtime during the month of April. Officers used 41.5 hours of comp-time, 37.5 hours of vacation, 112 hours of sick time, and 3 holidays. Officers earned 67 hours of comp-time. Training Officers attended 17 days of training during the month of April. The training consisted of courses in verbal judo, critical incidents, sexual harassment, animal control, EMT refresher, and firearms instructor. Three officers continue to attend the Wilson Course. The month was too wet, too cold, and too overcast. It was simply downright dreary and miserable. Customers were very owly and surly. Severe depression accurately describes the mood that people were in last month. Enough! On to a brighter topic. The registers are in. Arrived Monday morning, April 13th. Oh what joy! What rapture! I think I am in Love. No more inventory tickets! No more unsightly blight! I actually entertained the idea of amassing all the old inventory tickets, piling them in the parking lot, and tossing a match to them, and then, maybe, holding some kind of ceremony over the pyre. After the initial excitement abated and cooler thoughts prevailed, I realized such action could result in community eyebrow raising. The fire department would surely frown. Wouldn't I need a burning permit? The religious sects would undoubtedly "pooh-pooh: this seemingly satanic act. I mean how would it look with Julie, our staff and myself presiding over a burning pile invoking chants and incantations? And finally, there are the environmentalists feelings to consider. I asked myself, "Joe, you can't pollute the atmosphere no matter how fun and fulfilling this symbolic act would be to me." Progress. SUBJECT; April's Activity Report Guess what we did this month, sweep - sweep - sweep. We spent about 90% of our time cleaning streets, sidewalks and parking lots. We started the 26th of March and finished the 30th of April. We made good time considering the amount of debris that was on the streets. We put down 1500 tons more salt sand this season then we every have and also we didn't get the leaves picked up last Fall. The number of truck loads in the past years ranged from 250 to 265, 4 yard loads, this year 309 loads, as you can see a substantial increase in the amount of material picked up. As far as equipment break downs (NONE), I guess that shows that the 4 or 5 days we spend on repairs and maintenance, done before the sweeping season pays off. We've been spending some time lining up contractors to start repairing retaining walls, curb and gutters, watermain patches and some landscaping repairs. I prepare the worksheets, statements and notes to the financial statements. The audit report will be submitted to GFOA for evaluation in the Certificate of Achievement program. The previous three reports have received this award. The audit report is scheduled to be presented to the City Council on May 12, 1992. WORKERS COMPENSATION RATES A bill was passed during the past legislative session regarding a 16% w/c premium rate reduction. I contacted Peter Tritz of the League of Minnesota cities Trust (LMCIT), our w/c provider, to see what effect this legislation would have on our w/c rates. Peter stated that the 16% reduction in premiums was for w/c insurance companies and did not apply to LMCIT since we are self-insured and printed on recycled paper April Finance Department Report Page 2 are rated on our own group. However, the benefit changes within the legislation will have a beneficial effect to LMCIT on w/c rates in the future. Peter stated that the positive changes will be incorporated into the w/c rate structure next year. He also stated they will meet to discuss whether a mid-year rate adjustment is possible. SUBJECT; April's Activity Report In April we pumped 19,637,000 gallons of water. Meter repair was the big item this month. We have repaired outside readers for use this summer, we will not be purchasing any more of the Pro reads or Touchreads for exchanges. We will use the old outside reads and registers that we repaired. New construction will receive Pro Reads or Touchreads. Some repairs have been made to our streets that were dug up for main breaks this winter. We will start hydrant flushing and maintenance on May 17. SEWER DEPT. The Sewer Dept. has begun sewer line cleaning, this will be done 3 days a week until the end of Sept. We have completed the lift station work on M-1. This lift station was abandoned with the flow diverted to MWCC lift station on Tuxedo Blvd. The cost of this was $13,800. This means that we have one less lift station to upgrade in the future with a savings of about $31,000. printed on recycled paper MINUTES OF A MEETING OF THE MOUND ADVISORY PLANNING COMMISSION APRIL 27v 1992 Those present were: Bill Meyer, Geoff Michael, Jerry Clapsaddle, Frank Weiland, Michael Mueller, Bill Voss, Mark Hanus, and Brian Johnson, City Council Representative Liz Jensen, City Manager Ed Shukle, City Planner Mark Koegler, Building Official Jon Sutherland, and Secretary Peggy James. No other citizens were present. MINUTES The April 13, 1992 Planning Commission Minutes were presented for changes and/or additions. MOTION made by Mueller, seconded by Clapsaddle, to approve the April 13, 1992 Planning Commission Minutes as written. Motion carried unanimously. FLOODPLAIN ORDINANCE REVIEW City Planner, Mark Koegler, presented a draft of a new floodplain ordinance which will replace the current City Code Section 330:15 for comments and suggestions from the Commission. After this review, a copy will be forwarded to the DNR for preliminary comments. Koegler commented that the ordinance does not make any exceptions for boat houses or any other accessory structures. If desired by the Planning Commission, a separate standard for boat houses can be added to text. Mueller commented that he is in favor of having an exception for water oriented structures, allowing them a lowest floor elevation of one foot lower than the regulatory flood protection elevation, however, require that mechanical and electrical devices be placed at the regulatory flood protection elevation which is 2 feet above the Regulatory Flood. It was determined that the issue of boat houses would be discussed later with review of the Shoreland Ordinance. Mueller referred to 300:15, Subd. 2. c. "Interpretation," and suggested that the responsibility be taken away from the Building Official and make the applicant responsible to supply the materials necessary in order the clarify the actual elevation of the land. Hanus referred to the definition for "Basement" and questioned the intent of this definition and how staff interprets "base subgrade." Sutherland commented that the subgrade is the lowest floor below the grade at the exterior of the building. It was agreed to change Planning Commission Minutes April 27, 1992 the definition to read: "... base subgrade below ground level ~ ~ as defined by the Building Code." Mueller would like the definition to read "current" building code. Subd. 4. f. "Minimum Basement/Floor Elevations." It was suggested that the different elevations be listed in this section for the different lakes in Mound. Subd. 4. g. "Vehicular Access." Hanus noted that the second line could be changed to make it clearer, such as" . plain, in which the access area would be . . ." Koegler wi~l'review. Subd. 4. h. "Uses Accessory to Commercial and Manufacturing Uses." Koegler will try to re-write this section to make it sound less scientific. Hanus referred to Subd. 7. Variances, a. Procedures, which states, in part: "No variance shall allow a use prohibited in a district or permit a lower degree of protection than the Regulatory Flood Protection Elevation. Variances may be used to modify permissible methods of flood protection." Do these two sentences contradict each other? Koegler commented that additional language is needed on flood protection methods. Currently the proposed ordinance does not tell us what the permissible methods for flood protection are, so what would the variance be issued to? Koegler added, if the Planning Commission determines to recommend that boat houses be permitted in the City, and permit them to be 1 foot below the flood elevation, then this section would have to be modified. Koegler referred to the second sentence in "a." and commented that this refers to the "use." He will look into clarifying the third sentence relating to flood protection. Subd. 7, c. The Planning Commission determined that the specific rates noted should be deleted. Mueller referred to Subd. 9, c., in the 9th line, it states "within a specified time period . . ." Mueller suggested it read, "a reasonable time period" It was determined that "within a specified period of time not to exceed 30 days" may be better. It was noted that the City Attorney will review the proposed ordinance and will determine if this can be changed. Hanus referred to Subd. 9, d., Lack of Response, and suggested that the following be added "If the responsible party does not appropriately respond to the Building Official within the specified Planning Commission Minutes April 27, 1992 period of time after being properly notified, . . ." The Building Official, in turn, suggested that in "c." above, the first sentence could be modified to read, "The building Official shall follow due Droce~s of law in notifying the suspected party . . ." Hanus wants to ensure that the party involved gets notified and does not get lost in the shuffle. Hanus referred to the last sentence in Subd. 9, d. and suggested a change, as follows: "The Building Official shall, upon the lapse of the specified response period, notify the landowner to restore the land to the condition which existed prior to the "~'A ~ ~'~- ~ ~'- ~ construction, development or use that has cause for notification. Koegler commented, that regardless of when a violation occurred it could be a problem that needs to be rectified, all violations to- date should be corrected. If there is a grandfathered situation which existed prior to this ordinance, it is not a violation. The Commission does not want the land to be restored to a prior condition if that prior condition was a poor condition. Mueller suggested that the following be added to Subd. 9, d." . . · shall be prosecuted accordingly, and take the appropriate action to accomplish the same." Johnson referred to Subd. 9., a. Enforcement. It was determined to amend this section by deleting the word "suspected" in the first line. SHORELAND MANAGEMENT ORDINANCE DISCUSSION Guest Cottages: The Planning Commission agreed that no new guest cottages should be allowed. Controlled Accesses: It was suggested that this title be changed to "Private Controlled Accesses," to avoid any conflict with Mound's commons. The Planning Commission was in favor of Controlled Accesses for private parties. Placement of Structures: Mueller referred to 5.21 which states, ". . . Where structures exist on the adjoining lots on both sides of a proposed building site, structure setbacks may be altered without a variance to conform to the adjoining setbacks from the ordinary high water level, provided the proposed building site is not located in a shore impact zone or in a bluff impact zone." Koegler confirmed that the "shore impact zone" in Mound is 25' from the shoreline which is half the required setback of 50'. 3 Planning Commission Minutes April 27, 1992 The Commission was concerned about new construction lining up with existing houses which are closer than 50 feet to the shoreline, and as a result houses will eventually creep towards the minimum of 25 feet from the shoreline. Desiqn Criteria for Structures: Structures. Be Water-oriented Accessory Koegler commented that this is the section which the Planning Commission needs to decide if boat houses or other water-orientated structures should be allowed. Orono has proposed to only allow one lock-box type structure not to exceed 20 square feet or 4 feet in height. Mueller questioned how this will correlate with the proposed zoning code modifications which does not allow any structure within 50 feet of the lake. Mueller is not in favor of any new boat houses, however, would like to deal more leniently with the existing ones. Koegler commented that if the Commission decides to allow one structure, the zoning code can be modified to correspond. Koegler remarked to the Commissioner that he is not sure the DNR has a unified opinion, but generally they would like to see a natural and pristine shoreline. Chair, Bill Meyer, polled the Commissioner's on their opinion relating to water oriented structures in Mound. Koegler related the DNR's definition for water orientated structures: "Structures for viewing or using the lake, including boat houses, gazebos, screen houses, fish houses, pump houses, and detached decks." Clapsaddle: Likes boat houses and gazebos if they are constructed in a manner that correlates with the house. He does not want to see little storage shacks. He likes architectural elements which adds to the value and human use of the property. Hanus: In favor of allowing boat houses. Mound is an urban area, and if there are going to be boat houses and decks across the lake in another city, Mound should be afforded the same use. Johnson: The home owner has the right to have a deck, gazebo, or boat house. However, he is concerned about the maintenance of the structures. Fish houses should not be allowed. Weiland: Not in favor of any structures on the shoreline. Planning Commission Minutes April 27, 1992 Meyer: Not in favor of structures on the shoreline because they are not and cannot be maintained. If the structure blends into the land and looks nice, he may be in favor. Voss: Not in favor of any structures on the shoreline, he is in favor of a natural shoreline and agrees with the DNR's opinion. Mueller: Not in favor of any new structures, however, would like to see the people able to maintain existing structures. Decks would be okay if they do not exceed the hard cover limit. Michael: Is in favor of structures on the shoreline. Jensen: Is not in favor of boat houses. She prefers not to see boat houses as they tend to be an eyesore, however, in reality she does not believe they can be totally eliminated. We need a way to deal with them aesthetically. Clapsaddle commented that the City of Mound does not enforce their ordinances. Meyer commented that even if structures on the shoreline in Mound are maintained and look nice, it won't look nice in Mound because the lots are too narrow and it would look too crowded. Hanus commented that maybe boat houses should be considered separate from other water orientated structures; he is in favor of decks and storage buildings. Clapsaddle suggested that boat houses could be restricted o'n lots which do not meet a certain lot area requirement or certain amount of lake frontage. Koegler recited the State's definition for a boat house: "A structure designed and used solely for the storage of boats or boating equipment." Michael added that Mound's Zoning Code has an additional sentence to that definition which states "The top of which may be used as an enclosed deck with safety railings." Due to lack of consensus, the Commission determined that Council Representative Jensen will discuss this issue with the council and poll them on their opinions at the next COW meeting. Heiqht of Structures: The Commission agreed that a 15 foot height limitation for structures is acceptable. Planning Commission Minutes April 27, 1992 Shoreland Alterations: The City Planner presented an "Impervious Cover Inventory." The Commission determined that allowing 30% hardcover as proposed in the zoning code modifications is a feasible figure. It was confirmed that decks, driveways both paved and gravel, sidewalks, etc. are to be included in this 30%. Should decks be 100% deducted from impervious cover? The Commission was in favor of reducing the impervious value for decks and requested the City Planner research a feasible a figure. No specific comments were made on the balance of the proposed ordinance. TRUTH-IN-HOUSING: UPDATE FROH SUBCOMMITTEE Chair of the Committee, Michael Mueller, informed the Commission that they have completed their review of the proposed ordinance, the next step is to have staff make the changes and have the electrical inspector review the ordinance. Mueller questioned the Commission if they wanted an independent inspector/evaluator to review the ordinance. An evaluator may charge a fee to review the proposed ordinance. Mueller commented that the evaluators have an association and suggested we check with them and see if they would review the ordinance free of charge. Sutherland will check into getting it reviewed prior to the next workshop meeting. RESCHEDULE OR CANCEL MAY ZSTH PLANNING COMMISSION MEETING? Due to a conflict with Memorial Day, the regularly scheduled meeting of May 25th is rescheduled to May 18th. Specification of Boat Storage Units. a) Specification of Boat Storage Units. At the time of the issuance of a license pursuant to this section, all authorized Boat Storage Units at the licensed facility will be specified by number on a copy of the dock or mooring area plan for the facility. b) Storage Rule, No watercraft may be kept, stored, tied or moored except at the location of a Boat Storage Unit designated as such on a current license issued pursuant to th/s section, and no facilities requ/ring a license under' this Section may be used to keep, store, tie oP moor a greater number of watercraft than the total number of' designated Boat Storage Un/ts fop .that facility. Ads have gone out to crew thc operation for the 1992 season. Bids have been requested for the trucking operation. Wendy Kroll has been retained to do the data base gathering for the Sonar test in St Albans Bay. For $7000 she will provide both pre-treatment and post treatment assessment of the effectiveness. She is a doctoral candidate at the U of M who has worked with us previously. The bill sponsored by the County Commissioners and authored by Senator Judy Traub that would allow the county to fund $75,000 of our program each year did not ~,et out of the House. That is a real setback to our program, since we hav~ been told that the DNR will now concentrate its meager funds on prevention and eradication. 1.2 l~lanasement Plan The data sub-committee will meet in June to assess the present car trailer parking availability on the lake. Responses from the cities and actual count indicates that there are presently 373 spots with another 100 authorized in the new park. Biocentric Inc has been retained to do the 1992 plan work, which includes boat counts and attitudinal surveys. This will start Memorial Day. The new Environmental Committee will meet for the fLrst time next Tuesday. There has been good response from the 8 agencies and 14 cities Lnvited to pm~dcipate. 1.3 Other General Interest Items. A whole day work shop was held this month in order to familiarize new board members with the complexities of admininstering the lake codes, and to acquaint them with the history of the LMCD. It appears that for Forest Arms issue noted last month has been resolved, at least for the time being. 2.0 CITY SPECIFIC ITEMS - MOUND 2.1 The need for public destinations on the lake might be considered in the non-traversible commons issue. Bids have been requested for the trucking operation. Wcndy Kroll has been retained to do the data base gathering for the Sonar test in St Albans Bay. For $7000 she will provide both pre-treatment and post treatment assessment of the effectiveness. She is a doctoral candidate at the U of M who has worked with us previously. The bill sponsored by the County Commissioners and authored by Senator Judy Traub that would allow thc county to fund $75,000 of our program each year ' . That is a real setback to our program, since we have been told that the DNR will now concentrate its meager funds on prevention and eradication. 1.2 ~ The data sub-committee will meet in June to assess the present car trailer parking availability on the lake. Responses from the dries and actual count indicates that there are presently 373 spots with another 100 authorized in the new park. Biocentrie Ine has been retained to do the 1992 plan work, which includes boat counts and attitudinal surveys. This will start Memorial Day. The new Environmental Committee will meet for the first time next Tuesday. There has been good response from the 8 agencies and 14 dries Lnxdted to pardcipate. 1.3 J~~.~lJ~~L,lt~ A whole day work shop was held this month in order to familiarize new board members with the complexities of admininstering the lake codes, and to acquaint them with the history of the LMCD. It appears that for Forest Arms issue noted last month has been resolved, at least for the time being. 2.0 ~ 2.1 The need for public destinations on the lake might be considered in the non-traversible commons issue. Those who attended were very excited about the event and look forward to its continuation and growth. Attendance increased 500% this year and we received live coverage on WCCO's 5:00 p.m. news report. The event was also covered on a number of radio stations. Enclosed is an information sheet on a preliminary survey update of car/trailer parking spaces for 1992. The cities have cooperated in providing information for this survey. No determination has been made as to "acceptability" of the parking spaces. The subcommittee will discuss "acceptability" criteria. The Task Force will ultimately recommend what this committee believes should be designated. Please visit sites in operation now that the boating season is here. We need to see if any should be taken off the list, as well as if there are any areas used for car/trailer parking that have not been listed. We also want to identify the remaining car/trailer parking spaces that go into the "historic" count of 1172 spaces that appear in the 1983 Lake Minnetonka Task Force publication, Page 5. As you view each site, please note any problem you see with its use. For example, what kind of surface does it have: paved, gravel or grass? Is there storm-water runoff treatment before the water reaches the Lake? How far is parking from the launch ramp, by feet? Is the ramp parking visible from the Lake? Later we can use this information to help separate desirable parking from that which is not desirable for the.. Lake environment, aesthetics, and neighboring area compatibility. UPDATE OF PUBLIC ACCESS PARKING, 4/30/92, P. 2 (4) Estimate for one side of Williams St. within 1,500 ft., more ~pace available further distant on Williams St.~ but not likely in demand for this lesser-used access. {5) This access was not in existence during 1983 study. The access future is tied to the outcome of Hennepin Regional Park, now being developed. Access lightly used ¢6) Hennepin Regional Park is committed to 100 C/T spaces, with public availability one to two or more years away. (7) More space may be available in a commercial office building about 1,500 ft. from the access which could provide about 25 C/T spaces on weekends, and also some lesser number during weekdays. FINDINGS: There are a number of probable C/T spaces which could be added to the Lake Minnetonka inventory. These require further review and negotiation with property owners, such as the commercial building in Mound and public officials. Few additional spaces exist on streets~ the limitation being distance away from the access site. Readily available street parking has been identified and is being put into use formally or informally. Maxwell Bay access study represents a key in securing a block of new C/T spaces. The present DNR site recently acquired is to either be combined with or relinquished to a more efficient use of alternative sites within that area which could accommodate 50 or more new C/T spaces. At the same time, boat access to Maxwell Bay would be reduced through the acquisition of likely one marina in that area. e The City of Mound is taking public input on a concept to redevelop its downtown commercial district. The concept proposes new lake access through the Lost Lake Channel. An opportunity exists at this site to accommodate a public access as part of this redevelopment. The south side of Lake Minnetonka presents a challenge for locating an access which would accommodate a reasonable C/T space addition while maintaining the integrity of the surrounding residential area. LAKE MINNETONKA CONSERVATION DISTRICT MN DEPARTMENT OF NATURAL RESOURCES Lake Access Task Force April 15, 1992 TO: Data Sub-Committee FROM: Gene Strommen, LMCD Martha Reger, MN DNR SUBJECT: Car/Trailer City Parking Inventory Update An inventory of city places known to presently 'accommodate car/trailer (c/t) parking spaces in and around free public accesses was conducted 4/13-4/14 by Martha Reger, Trails & Waterways, and Gene Strommen, LMCD. Among the lake's 14 cities, Greenwood, Excelsior, Minnetonka Beach, Shorewood, Victoria and Woodland presently have no public boat launch access. Review by city of those which do have public boat launch accesses resulted in these findings: DEEPHAVEN, Carson's Bay City Access: * Free public parking at or adjacent to access -- none # Free public parking approximately. 1,000 ft. from access: An unmarked gravel lot presently accommodates 20-25 c/t. It was observed, however, that this number could be significantly increased by designating spaces with post markers and directional signs, possibly doubling the capacity. * Free public parking approximately 1/2 mile from access: School parking lots on Vine Hill Road would accommodate some c/t spaces. The distance would necessitate a shuttle service, agreement with school district. * Space on the south side of Cottagewood Road heading east could provide for about five additional c/t spaces, no adjacent residence being impacted. - Signs at the access are needed to direct public to permitted c/t parking. - Free arking by permit available to Deephave~ residents occupy 17 spaces along the railroad right-of-way by Mlnne- tonka Boulevard. Public may purchase this permit for $60. Few have been purchased in recent years. (checking) DEEPHAVEN, St. Louis Bay: * Boat launch access is provided near swim beach before June 15 and after Sept. 1, no parking associated with access, for launching boats for on-lake dock storage during season and removal at the season's end. Winter Access available via street ends, over city docks by foot on Minnetonka Blvd., and Carson's Bay vehicle access. C/T City Parking Inventory Update, 4/15/92, P. 2 ORONO, North Arm, Hendrickson Bridge County Access: Free public parking on improved, paved access site, 64 c/t spaces and ll car only spaces. * C/t parking starting 1,500 ft. from access permitted on south side of County Rd 51 from Balder Park Rd to Tonkawa Rd. {County 135) providing approximately 20 c/t spaces. * Nearby city streets posted no parking to preserve residential character of neighborhoods. * Unimproved shoulder parking on Shoreline Dr. (County 51), Browns's Bay, for hand-launched trailered or car-top fishing boats, estimating five available c/t spaces or more for cars only. * Designated shoulder parking on Shoreline Dr., Smith's Bay, east of Arcola Bridge, for 3 or 4 cars for shore fishing. * Proposed DNR Maxwell Bay access not considered at this time. Winter Access via street ends scattered among 28 miles of lake shoreline, with public use concentrated on city streets ending adjacent to county roads, well used. SPRING PARK~ Spring Park Bay~ Spring Park County Access: * Free public parking on improved, paved access site, 19 c/t spaces, 6 car only spaces. * Nearby County Rd. 51 parking, four c/t spaces about 400 ft. from access. * County public works maintenance yard about 1,500 ft. from access parking could serve 50 or more c/t spaces with more efficient spacing of county reserve sand/dirt piles and off-season equipment storage. Directional signs and markers to designate parking spaces are necessary. Signs at the access site designate availability of this lot for parking. It is well used, but use count varies. * Northern Avenue, about 1,500 ft. from the access, has extensive c/t parking available on the south side along the railroad right-of-way, or by improving the street shoulder. * Boaters presently do find parking open along Warren Ave., about .4 mile west and north of the access. Considering the popularity of this access~ this area has expansion potential with angle or perpendicular c/t parking. Area is commercial, and adjacent to city hall. * Advance Machine site, north of County 15 and west of 51, has interim parking possibilities. Considering the development potential of this site, and present use by Lord Fletcher's Restaurant, it is doubtful a long-term arrangement would be possible here. Car/Trailer Parking Inventory Update, 4/15/92, P. 3 Dakota Rail property east and west of County 51 on the south side of the tracks has further c/t parking potential. Property is presently for lease/sale, which could make a long-term (5 year minimum) arrangement doubtful. Land purchase/lease may be worth investigating. MOUND~ Cooks Bay, Mound Bay Park City Access: * Free public parking on access site on weekdays only, none available weekends or holidays. * Free public parking designated on sign at access entrance on Beachwood Rd., 1,000 ft. east of access. About 500 ft. of space available on one side of street, 10 c/t spaces. The new home development on other side of street may prompt requests to prohibit this parking in the future. * Free public parking designated on sign at access entrance on Commerce Blvd., 1,500 ft. north of access. About 15 c/t spaces available on approximately 800 ft. of street. * Public parking on Bartlett Blvd., 600 ft. north of access, prohibited for about first 600 ft. of this county road. Parking beyond this point is open for about six c/t. * Potential new parking identified by Mound city staff on a business site within 1,600 ft. of the access on Commerce Blvd. Only a few employees work on weekends. Some space may be available weekdays, or weeknights. Formal striped paved parking lot has 32 spaces, all of which could be used for c/t parking, trailers backed into open natural vegetative-cover border area. Lease arrangement with GTE owners could be mutually beneficial for up to 90% of parking space for weekends. * Minor summer access for car-top or hand-launched small boats exists among some neighborhood street ends, not expected to serve season-long general public access. * Six miles of city shoreline accommodate 4-1/2 miles of city commons dock sites. * A concept is presently being introduced to develop consider a redevelopment of downtown Mound, to include activating Lost Lake and its channel for possible new multi-family dwelling units. This poses the prospect of a public lake access share in this redevelopment plan. * A public fishing pier has been applied for through DNR in recent years, with approval still pending, at the Mound Bay Park site. Winter access is generous through a variety of street ends. Car/Trailer City Parking Inventory Update~ 4/15/92~ P. 4 MINNETRISTA, Halsted & Phelps Bays, City and DNR Access: * Williams Street (at corner of Halsted Drive}~ Halsted Bay~ city access~ has approximately 1/2 mile of roadway west of access~ which would allow approximately 30 c/t spaces within 1,500 ft. Some portions of street would allow parking on both sides. Potential parking count could reach 50 within 1,500 ft. Parking is available beyond 1,500 ft. but considered out of normal user reach. Since this is an unimproved access, dirt ramp and shallow except for small fishing boats, and at the far west end of the lake, it is unlikely 50 c/t spaces would be in demand except on possibly a prime day such as the fishing opener in May. Parking on Halsted Dr. north of the access, is not allowed. Some allowance would appear possible without interference to adjoining residential properties on one side of the street. * Kings Point~ Halsted Bay~ DNR access~ north end of Kings Point Rd.~ serves small fishing boats, total of 32 c/t spaces. Public route via Hwy 7, 1.5 miles to south. This access has been identified as intended to be taken out of use as the Hennepin Parks 100 c/t parking spaces are put in place. Tuxedo Blvd. access at Zimmerman Pass~ north of Red Bridge is essentially a street end which accommodates neighborhood use. City notes 4 c/t spaces available, more if users move farther back on residential streets. Crane and Eagle Islands access, Casameta Rd., West Upper Lake~ serves island residents and one main shore residence CBedor). Not considered a public launch access. Woodend Shores, ~West Upper Lake, a private homeowners assn. access~ gets some uninvited public access use. Fire lanes are open for winter access, Eastview Ave. in Sennings Bay well used. Shore fishing on County Rd. 44 adjacent to Halsted Bay accommodates the public. Roadside improvements could also aid hiking and biking. Ten car spaces now available. City Planner Jay Blake and City Council member/LMCD board member Scott Carlson point out the city's concern that lake access be spread across the designated zones, sharing the responsibility for public access with all cities. They also asked how non~riparians in a city get counted for public access? The city also hopes to keep up the natural characteristics of the lake at the west end. WAYZATA~ Grays and Wayzata Bays, City Access: * Grays Bay Causeway Access~ County Hwy 101~ presently unimproved, ramp and parking access gravel/dirt. First come parking on unmarked irregular surface results in variable space for cars using adjacent shore fishing and c/t units. * Re-designed Grays Bay Causeway Access is scheduled to provide 37 c/t and 6 car spaces, operated by county. C/T City Parking Inventory Update, 4/15/92, P. 5 * City Access, Wayzata Bay, County Rd. 16, between Wayzata Yacht Club properties, has designated c/t parking on north side, trailers angled into railroad right-of-way. Random piles of railroad-cut trees/brush restricts parking to about 10 c/t spaces adjacent to access. Additional parking starts north of railroad tracks into Circle Dr. and Circle Av. and east on Lake St. and along County 16 west to Wayzata Bay Center, including the Center parking lot. Approximately 25-30 such spaces are estimated in these undesignated adjacent street/Center parking lot * Winter access is available through above access, second non-summer access west of Rosecranz property~ and at Wayzata Public Swim Beach, west of Minnetonka Boat Works, near Barry Ay. MINNETONKA, Grays Bay Dam: * Present site operated by Hennepin County provides 19 c/t and ll car spaces. It is a fully-improved site with two lane access. Drawback is winding approach through narrow residential streets. No external signs to designate location on Minnetonka Blvd., but well-used. * Libbs Lake Park and Swim Beach, has ten car spaces which are used by persons shore fishing. TONKA BAY~ Lower Lake South, Gideon, LaFayette and Old Channel Bays provide the city's shoreline: * Principal lake access is through Fire Lanes which are divided into Class I, II and III. Class I has 15 fire lanes for pedestrian access, shore fishing and launching of car-top small boats. Class II includes four additional fire lanes which allow same as Class I plus winter snowmobile access. Class III has one fire lane, # 5 at N. Waseca Av., which provides only shore fishing~ boat launching and winter vehicular access to lake, but no parking of automobiles or c/t on or adjacent to fire lane. * City has a 23-slip public marina on Manitou Rd./County 19~ adjacent to city hall on south side. An unimproved dirt launch ramp provides access for small boats. City officials advise this is posted for no launching during season. Officials believe public access would invite vandalism to boats stored in marina. City has recently applied for and been granted an additional ten slide storage spaces which would provide for shore storage of small fishing boats, rentals open to city residents. Narrows channel is open to public shore fishing~ maintained by the county. - end -
