VARIANCE - DECK & SCREEN PORCW The Building Official explained the request. The Commission recommended approval, but not unanimously. The two staff recommendations which were as follows: Planning Deny the requested variance based on the lack of hardship and specifically referencing that the property already has a nonconforming deck and that the existing two foot encroachment represents the minimum variance necessary to allow reasonable use of the property. Approve the requested 6 foot sideyard variance resulting in a two foot sideyard setback based on a finding of practical difficulty. If this course is followed, the Planning Commission should identify the practical difficulty at it applies to this property. The Council discussed the two recommendations. MOTION made by Jessen, seconded by Jensen to instruct staff to prepare a resolution of denial for the requested variance based on the lack of hardship. The vote was unanimously in favor. There were none. 1.9 PUBLIC LANDS PERMIT APPLICATION FOR CONSTRUCTION ON PUBLIC L~NDS= REQUEST TO BUILD A STAIRWAY BY MIKE ROY, 4577 ISLAND VIEW DRIVE 82 May 26, 1992 1.10 PUBLIC LANDS PERMIT APPLICATION FOR CONSTRUCTION ON PUBLIC L~NDS~ REOURST'T0~ILD a STAIRWAY BY ROGE~ STEPHANSONr 4601 ISLAND VIEW DRIVE The Park Director explained that these two cases can be considered as one but dealt with separately because at the present time there is one shared stairway on Commons for both of these properties. The present stairway is in need of major repair and the applicants are asking to be allowed to install two separate stairways and remove the one shared stairway. The Park & Open Space Commission had a tie vote so there was no recommendation. The Council discussed shared use of one stairway versus 2 separate stairways. Tom Casey, Park Commissioner, asked that the Council consider a minimum number of structures on the Commons and consider the loss of vegetation allowing two new stairways as well as the vegetation under the current stairs. The applicants were present and stated they did sketch out a shared stairway in the same place and.as they split the stairs in order to get it out to where the docks would have to be in order to be above water you end up with a very large structure. Therefore they feel the impact on the Commons will be less with two separate stairways. They also stated they are in agreement and will provide erosion control on the area where the old stairway is as well as under the new stairways. The Council discussed the issues. Ahrens moved and Smith seconded the following resolution: RESOLUTION #92-61 RESOLUTION TO APPROVE A CONSTRUCTION ON PUBLIC LANDS PERMIT FOR CONSTRUCTION OF A STAIRWAY ON DEVON COMMONS ABUTTING 4577 ISLAND VIEW DRIVE, LOT 6, CLOCK 1, DEVON, DOCK SITE #41140 The Council asked that the following items be incorporated into the resolution: The City of Mound does hereby approve a Construction on Public Lands Permit to allow construction of a stairway on Devon Commons, (property address, description and dock site #). ae The Construction on Public Lands Permit will expire in five (5) years, at which time application shall be made for a Public Land Maintenance Permit. 83 May 26, 1992 be The stairway must comply with current building code. Councilmember Jessen expressed concern about the visual impact of two stairways on the lake. The vote was 4 in favor with Jessen voting nay. The Council asked that both the applicants from the previous two items get together with the Building Official and the Park Director and go over the plans so that all items are addressed, especially the erosion matter. 1.11 PUBLIC LANDS PERMIT APPLICATION FOR CONSTRUCTION ON PUBLIC LANDS: REQOEST TO RECONSTRUCT AN EXISTINO STAIRWAY ON DEVO~ COMMONS BY MARK GOLDBERG, 4853 ISLAND VIEW DRIVE The Building Official explained that the applicant is asking to reconstruct a stairway on Devon Commons. The Park and Open Space Commission recommended approval. The Council asked if the stairs were connected to the boathouse. The applicant stated no. Motion carried. 1.12 REQUEST FOR RECONSIDERATION OF & PERMIT FOR CONSTRUCTION ON PUBLIC LANDS FROM DE~N HANUS, 4737 ISL]%ND VIEW DRIVE The City Manager explained that a letter requesting reconsideration of the above item has been received from Mr. Dean Hanus. Mr. Hanus was present and explained he is looking for a reversal or at least a tabling of the resolution regarding his property until a more thorough investigation of these issues can be made. The Council asked if there was any additional information that was not presented in December with regard to his Permit for Construction on Public Lands. There was none. MOTION made by Smith, seconded by Jessen to deny a request for reconsideration of a Permit for Construction on Public Lands from Dean Hanus, 4737 Island View Drive. The vote was 4 in favor with Ahrens voting nay. It has been suggested by City staff that a cancellation policy be established for rental of the depot. The following language is suggested: "The deposit will be refunded if the cancelled date is reserved by another party or a sixty (60) day cancellation notice is given." Staff also recommended that any reference to "Island Park Hall" be deleted from the application. It was suggested that a $3 be added under "IN USE SUPERVISION"., as follows: "3. An adult supervisor must be on the premises at all times." The Commission questioned what age constitutes an "adult," is it 18 or 217 It was determined that the City Attorney will need to verify language. In addition, it was suggested that after FREE under the Rental Fees "commonly known" should be deleted. MOTION made by Eischeid, seconded by Ahrens to recommend approval of the referenced changes to the Depot application with the clarification on the age for an "adult." Motion carried unanimously. The City Manager commented that any change in fees can be discussed at the time of budget review. There are only three properties on this list. This memo is to deal with one of those properties. I have attached a plat map and highlighted the parcel (PID #24- 117-24 41 0079 - part of Lot 27, Block 26, Wychwood) that has been forfeited. Please note that it is a triangular piece that the assessor has valued at $100.00. Background. It is a separate parcel (divided probably in the 1940's or 1950's). I am assuming it was divided to be sold to the owner of Lot 26 to make the dwelling on Lot 26 no encroach on Lot 27. There is no survey for Lot 26 but the aerial shows that the dwelling is close to or on the Lot 27 property line. The parcel was tax forfeit in 1958 and the owner of Lots 27 & 28 purchased it in 1977, but it was never combined with his property. The home on Lots 27 & 28 sold last year, but this parcel was not sold and went tax forfeit in May of 1991. RECOMMENDATION. The city Engineer and myself would recommend that the City purchase this lot from Hennepin County for $100.00 and turn around and sell it to the owner of Lot 26. I have spoken to the Tax Forfeit Office and although this is against their policy, it is an unusual case and probably would be approved by the Hennepin County Board. SUBJECT; May's Activity Report We started out the month with our 3rd annual spring cleanup day. We moved all of the equipment across the street and washed down the floors and parking lot plus the sand bin. At the same time we cleaned all the department rooms and sign room. Everything was spic-an-span for a few days. Tim Johnson spent a week in the shop rebuilding the back 1/3 of the dump body on our 85, 2-1/2 ton dump truck. This is the second truck in 3 years that he has rebuilt. I'm estimating that this truck he rebuilt saved the city about $1500. Tim and Jerry also revamped truck #5 to accommodate the oiler, this means a new hitch and wiring harness. We've been having some problems with a storm sewer which drains some private property on Galway Rd., in Island Park. We dug it up by hand because the hole was in the driveway and we didn't want to make a big mess. We found a caved in pipe which we replaced so the problem is solved. The 18th we set out 37 planters on Shoreline Blvd. and Commerce Blvd. We also filled them with black dirt and compost. I noticed that we have a number of them that don't have flowers. We've been working on our streets that are slatted for sealcoating for the last two weeks. It takes a little longer to prepare a street for sealing, because we patch everything, cracks, holes, swales, ring manholes and gate valves. If the weather cooperates and everything runs smoothly, we should be printed on recycled paper /775' ready for sealing the first part of July. We've been hauling fill out of the Lost Lake site in our spare time, which we don't have much of. CEMETERY WORK We had our annual rush in the cemetery a week before Memorial Day, locating graves and setting stones, we also had 3 graves stake outs this month. The commons public shoreland issues continue to demand a great deal of staffs time. The informational public meeting call by the Mayor on May 30th regarding docks and commons had a good turn out and was productive in gathering information from and educating people about the commons. From these meetings there were minutes, resolutions and ordinances to be completed. I attended the annual IIMC (International Institute of Municipal Clerks) Conference from May 17 to 22. The theme this year was "Reach Out to Touch Your World". There were a variety of topics covered in the educational sessions, presentations and the exhibits. I feel this conference helps me to acquire knowledge that can be used in Mound to better serve the residents and my profession. There were over 40 different workshops on a variety of topics. IIMC now has over 10,000 members from all over the world. I just started my third year of a three year term on the IIMC Board of Directors representing Region VI (Iowa, Minnesota and Wisconsin). There are 11 regions in this organization with 2 directors from each region. I have also been appointed to the IIMC Educational/Personal Growth Committee. This Committee recommends programs and projects to enhance the educational opportunities for municipal clerks. It also reviews, recommends and evaluates continuing education programs leading to the CMC (Certified Municipal Clerk) and AAE (Academy for Advanced Education) designation. A reimbursement request was submitted to the Secretary of State's Office for the Presidential Primary. It will be interesting to see how close they come to paying what we have submitted. A number of items that had to be done and paid for were not eligible for reimbursement. This was as we expected. A group of metro and non-metro City Clerks have formed a users group for the optical scan voting equipment. This group will be dealing with the following issues: printed on recycled paper 5. 6. 7. There were 31 Part I offenses reported. Those offenses included 1 criminal sexual conduct, 4 burglaries, and 26 larcenies. There were 53 Part II offenses reported. Those offenses included 5 child abuse/neglect, 5 forgery/NSF checks, 1 weapons, 11 damage to property, 4 liquor law violations, 9 DUI's, 2 simple assaults, 3 domestics, 6 harassments, 1 juvenile status offenses, and 6 other offenses. The patrol division issued 85 adult citations and 1 juvenile citation. Parking violations accounted for an additional 20 tickets. Warnings were issued to 82 individuals for a variety of violations. There was 1 adult and 5 juveniles arrested for felonies. There were 26 adults and 4 juveniles arrested for misdemeanors. There were an additional 12 warrant arrests. The department assisted in 9 vehicular accidents, 4 with injuries. There were 27 medical emergencies and 93 animal complaints. Mound assisted other agencies on 11 occasions in May and requested assistance 2 times. Property valued at $13,482 was stolen and $4,217 was recovered in May. MOUND POLICE DEPARTMENT MONTHLY REPORT - MAY, 1992 II. III. IV. Ve INVESTIGATION There were eight child protection matters investigated in May that accounted for 55 hours of investigative time. Other cases investigated include forgery, theft, burglary, damage to property, exposing, trespass, careless driving, NSF checks, personal injury accident, vandalism, alcohol violation, vehicle theft DWI and harassment. ' ' Formal complaints were issued for forgery, theft, assault, gross misdemeanor DWI, driving after revocation, illegal sale of alcohol, and aiding and abetting in a theft. Inv. McKinley was promoted to sergeant May 13th and a replacement has not been made yet. Personnel/Staffing The department used approximately 80.5 hours of overtime during the month of May. Officers used 81 hours of comp-time, 170 hours of vacation, 119 hours of sick time, and 5 holidays. Officers earned 585 hours of comp-time. Officer Lotton sustained an off-duty back injury and used the bulk of the sick and vacation time. Officer Christenson was called back to help cover short shifts. Training officers attended 11 days of training during the month of May. Those courses include the Wilson Learning program, narcotics investigation, data practices, and a computer upgrade seminar. Ail officers attended PR-24 baton training. Police Reserves The Reserves donated 598 hours during the month of May. A fund raiser was held and it appears the Reserves netted approximately $1,500. We had an excellent month with $121,521 in gross receipts. I ran a two week beer promotion that was intended to kick off the opening of the fishing season. I felt it was very successful. Perhaps you noticed our ad in the back of the "Laker" newspaper. I also hired two new employees. They don't actually begin until June 1st. I lost one employee, Jon Muchich. He lost the full time job he had at office Max, and landed a position at Quality Wine & spirits as a merchandiser. He will occasionally work for us, about once a month. Jon had worked for the liquor store for almost two and one-half years. A remarkable length of endurance for a part-timer. I also lost, temporarily, another employee, Rick Hanson, due to illness. As soon as he is well he will certainly be welcomed back. Both people were excellent employees and their absence will be missed. On the 26th three of the remaining people were able to report to work. Generally, as I mentioned before, we would have had some positions filled by mid-April. So with this late start we are playing catch up with needed work and trying to prepare for the beaches opening. Again, the parks will be short one maintenance position with not re-hiring for Bob Johnson. So, we will see a little decline in how fast we can get projects done. With the Ford tractor no longer useable, wheels and tires bad and cut from budget request, there will be a problem with leveling the softball infields. The Ford has a blade that is used for this type of work. We will try to use the bobcat. DOCKS The physical count is done for the inventory of encroachments on public lands. Currently, staff will be separating the count by description and will provide it along with other information to the'C.O.W. CEMETERY The grounds were prepared for Memorial weekend, Phil Haugen, the Caretaker did a good job when you consider the amount of damage done last winter with the no cost burials. Ceres Trucking was the low bid for the trucking of the milfoil. This is a fh-xn that we have used previously. Hiring to staff the 1992 harvesting crews is completed. It is planned to commence training and then harvesting the week of June 15th. If there is no surface matting at this time, this will be postponed. Prof Newman at the U of M has finally received a grant to start the search for invertebrates for biological control of milfoil. They will commence sampling that will complement the work being done by Wendy Crowell in connection with the Sonar study. 1.2 Management Plan The LMCD has joined with the DNR in requesting a $3.5MM grant from LCMR funds to be used in the acquisition of additional public lake access. The Access Committee is actively working on the def'mition of an access. This is some modification from previous standards which were so stringent as to make additional access very difficult and expensive to achieve. The Environmental Committee which has been reconstituted and broadened in membership, in conformance with the Management Plan has had two meetings. Initial goals focus in on water quality objectives, fish monitoring, shoreland regulations, milfoil and other exotics. Biocentric Inc has commenced its boat count activity. Two (of 20) overflights have been conducted. 1.3 Other General Interest Items. Orono is considering an ordnance that will prohibit the use of stryofoam floatation docks unless the foam is encased. In the past these docks have disintrgrated, allowing particles of styrofoam to float up on beaches. While causing no pollution to the water, this stuff never dissolves, and provides a long lasting visual pollution to the lake. The 1993 LMCD budget has been tentatively approved. This will reduce the levy on the cities due to the increase in licenses and fees income. A considerable reserve has still been maintained to partially cover future increased costs due to implementation of the Management Plan. As of now, no funds to implement this plan have been earmarked by outside agencies. The annual on water inspection of the lake by the Board will take place this Saturday. 2.0 CITY SPECIFIC ITEMS - MOUND 2.1 The Halstead Acres residents have not filed a dock plan nor paid their fees, so as of now they have no license, even for the 7 slips they have been allowed. I am sure that this will be resolved soon. In keeping with the practice initiated in 1991, the 14 LMCD member municipalities are invited to review this preliminary discussion draft and offer their comments prior to the LMCD Board's adoption at its June 24 meeting. It should be further pointed out that cities may also comment on the budget after its June adoption and certification to the member municipalities as provided in LMCD's enabling legislation~ excerpt attached. A few points concerning the proposed budget are important in your review~ Revenue projections -- as a result of increases in new revenue generated from user fee schedules, the 1993 budget reflects a 44% decrease in administrative levy requirements, with the mill.il revenue staying the same. Individual line items are called to your attention= be Line 4, revenue from license and permit fees is increased as a result of the new fee schedule. This reflects the Management Plan policy to provide greater revenues from benefiting lake users. Line 2, reserve fund allocation from uncommitted reserves supplements a portion of revenue needs. Line 8b~ mill.il contributions~ presently reflects no other public agency support. The board is pressing it's concern for lack of funds from the DNR and Hennepin County. Explorations are taking place with county officials to redevelop needed support. 2. Disbursements reflecting new obligations aret Line 2~ Personnel Services, Management Plan Implementation, Part Time Technician, proposes staff assistance in implementing Management Plan objectives. Lines 35-42 outline the 1993 Milfoil weed harvest program which is reduced from the 1992 budget. It should be pointed out that the 1992 budget has also been revised downward for this year from $250,000 to $131~000 as a result of the decision to eliminate the more costly barge service. The barge elimination also reflects lighter weed volume experienced in the 1991 due to higher water levels, this same lighter volume projected for 1992. Corresponding reductions in 1992 revenue of $131,000 have also been projected. (a) A rule or regulation must be suitably titled. (b) A rule or regulation must be adopted by a majority vole ofall of the members of the board of directors. The adopted rule or regulation must be signed by the chair, attested by the secretary of the board, and published once in an official newspaper. (c) Proof of publication must be attached to and filed with the rule or regulation.
