NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Mound, Minnesota, as follows: 1. The City Council does hereby approve a conditional use permit for Meyer's Mound ,-- Service as a Minor Automobile Repair facility subject to the following conditions: t~ ' "/~/~ '~ // ~~7~¢~' ~'~/~'~'--a/'°'/~F'~nglon the site shall be limited to the area north of the structure. A building permit for the construction shall not be issued until proof of recording has been filed with the City Clerk. .~Boo RESOLUTION//96- RESOLUTION TO APPROVE A CONDITIONAL USE PERMIT TO ALLOW A MINOR AUTO REPAIR BUSINESS FOR MEYER'S MOUND SERVICE LOCATED IN THE B-1 CENTRAL BUSINESS DISTRICT AT 2620 COMMERCE BLVD. LOTS 1, 2, 3 & S. 1/2 OF 47, 48, 49, BLOCK 9, PID'S 23-117-24 14 0043 & 0050 P&Z CASE//96-26 WHEREAS, Richard R. & Connie L. Meyer, Owners of Meyer's Mound Service, have applied for an amendment to their Conditional Use Permit to allow an Auto Repair Business, and; WHEREAS, Mound Zoning Ordinance Section 350:640 allows Minor Auto Repair Businesses in the B-1 Zoning District with a Conditional Use Permit, and; WHEREAS, Resolution #79-427 approved a special (conditional) use permit for this property that allowed the operation of an automobile transmission repair facility with conditions that included no outside storage of parts, material and equipment; limited lighting; and no more than one car stored outside, and; WHEREAS, the applicant has requested parking for 25 vehicles, and; WHEREAS, complaints have been received about the overall appearance of the property and the number of vehicles parked on the site, the Building Official determined that the use of the property has changed substantially over the years without any update or modification of the conditional use permit, and; WHEREAS, in December of 1985, the Meyers purchased the residential property to the north of the auto service facility which is currently vacant and used for vehicle parking, and; WHEREAS, the gas pumps have been removed and sale of gasoline has discontinued, and; WHEREAS, the parking area currently has a gravel surface. The Zoning Code requires that all parking areas and access drives serving commercial property be paved with bituminous or concrete surfacing. The code also states that parking lots cannot be located closer than 5 feet from an adjacent lot zoned or used for residential purposes, and; WHEREAS, the code requires fencing along the east side of the parking lot. That provision requires that "a fence of adequate design, not over five (5) feet in height nor less than four (4) feet in height shall be erected along the Residential District property line," and; WHEREAS, City Code requires the screening of all dumpster enclosures. The original special use permit prohibited outside storage of parts, material and other equipment. The existing dumpster as well as all parts storage needs to be screened, and; MOUND CITY COUNCIL - JULY 9, 1996 1.1 PUBLIC II-EARING: CONSIDERATION OF A CONDITIONAL USE PERMIT TO ALLOW A M'fi'qOR AUTO REPAIR BUSINESS FOR MEYER'$ MOUND SERVICE LOCATED IN TI~ B-I CENTRAL BUSINESS DISTRICT AT 2610 COMMERCE BLVD., PID ~23-117-24 14 0043 & 0050. City Planner Mark Koegler stated the owners had applied for an amendment to their Conditional Use Permit to allow an Auto Repair Business in the B-1 District. He reviewed the conditions with the Council and stated staff and Planning Commission unanimously recommended approval. Councilmember Jensen questioned the actual number of vehicles allowed to be parked overnight on the lot. Discussion revolved around there not being a limited number of vehicles, rather keeping the parked vehicles within the north lot. Mayor Polston opened the public hea~fi, ng and asked if there was anyone present who wished to comment either for or against this item. Mr. Meyer was present and stated that he did not want a limit on the vehicles as vehicles will be coming and going frequently. Weather conditions often dictate the count of vehicles as his business was AAA authorized. Also, he had agreed, as the Planning Commission had requested, to not have any overnight parking on the south side of the property along Bartlett Boulevard. Then Mr. Meyer questioned item "g" in the conditions regarding the two parcels being combined. He stated he could not do this as the north lot was on a contract for deed and not paid off yet. He would like to have that portion of the resolution removed. Council discussed this and the City Attorney reworded item "g' to read: Tax parcels 23-117-23 14 0043 and 23-11%24 14 0050 shall be required to be under one ownership and if either parcel Ls sold or transferred, this Conditional Use Permit shall immediately become n_..ull, and void and the new owner or owners shal~ be required to reapply for a new Conditional Use Permit. Mr. Meyer was in agreement. City Man~ger Ed Shukle read a letter from a neighboring resident, Mr. Tom Reese, that stated his agreement w~da~the business proposal.. · Being no more comments for or against, Mayor Polston closed the public h ' g. Mayor Polston was concerned with the possibility of complaints of too many vehicles and if the resolution did not state an actual count, what guidelines did the City have to enforce over parldng? Councilmember Iensen suggested changing the word 'parking' to 'storage' of vehicles. Mayor Polston stated that if the resolution was not defined clearly, a precedence could be established. Consensus was to let the area in use be the definition. RECEIVEO JUL 5 1990 Suburbon FIIl once July 3, 1996 Suburban Alliance has for the past 23 years served well the needs of citizens in western Heunepin County. As you may have heard Suburban Alliance (West Hennepin Human Services) has recently experienced some financial difficulty which may force the organization into a rather difficult decision of survival (see press release dated June 24, 1996). Since that time the Hennepin County staffhave reversed their opinion and are recommending to the commissioners termination of the emergency services and planning and coordination contracts with Suburban Alliance. These contracts constitute the major portion of funding for our orgamzation. While county staff have assured us there would be no interruption of emergency services to people and famihes in need, we are concerned for the loss of planning and coordination services and the unique citizen input that has been the trademark of Suburban Alliance. Since Suburban Alliance was formed under a joint powers agreement among west Hennepin County's municipalities, the executive board thinks it is imperative that your municipality participate in a discussion of our current situation and the decision of the future existence of Suburban Alliance. A joint meeting of municipal representatives, the Board of Directors of Suburban Alliance and county staff is scheduled for 7:00 P.M. on Tuesday July 16, 1996, at the Plymouth Safety Building, 3400 Plymouth Boulevard, Plymouth, MN. 55447. During that ~e the agency has adv~a~ed, planned, coordinatea and delivered direct se~ices in the h~n se~ices arena. It has had a posi=ive impact on eve~ one of the twenty-one me,er municipali=ies from western ~ennepin County that subscribe to the joint powers agreement from which ~t was created. It has also benefitted ~on-me~er municipalities and assisted ~housanas of individuals. These have incluaed diverse m~ers of the co--unity such as senior citizens needing =ransportation =o 1~ income me,ers needing assistance and direction in such areas as finding job, obtaining eme=gency assistance and peer counselling. A service directo~published by the agency reached 40,000 people and became a staple reference ~or local police departments to advise people in need of social se~ice assistance as to where to go. Because of its unique ~osition within the h~an se~icee co.unity Suburban Alliance has also been asked to~ nurture fledgling non-profi~ organi=ations~ directly a~inister Ener~ Assistance dollars on behalf o~ the state and ~eral gover~ents~ and act as the ~iscal agen~ for various other hu~n s~rvice oTgani~ations that did not have the resources ~o hire and~intain sufficient staf~ of their ~. ~er ~he last ~wo years Suburban Alliance has endured a continuous onslaught of changes and setbacks in its financia~ picture. First, it lost its free office space in St. Louis Park. In Augus= o~ 1994 it moved to its pre~ent location in Hopkins at a rent currently acc~ing at $3,000 per month. Second, Suburban Alliance learned in lace 1994 =hat its long standing executive director intended to resign. The agency is governed by an all volunteer board consisting of appointees from its various signatory cities, associated humans service agencies/ organizations and members at large. A new director was hired in early 1995. There were contemporaneous indications from Washington that there would be unspecified cutbacks in BnergyAssistance funding. For the fiscal year 1993-94 the Energy Assistance contract involved the administration of 2.5 million dollars. For 1995 it was slightly over one million dollars and it may go below six figures for 1996- 97. These funding cutbacks have adversely affected the agency's internal budget dollars because it cause~ shrinkage in administrative overhead funds. In 1995 Suburban Alliance also lost two agencies for which it had been fiscal agent. This meant that funds Suburban Alliance had held for their benefit had to be repaid causing even more pressure on its cash flow and financial reserves. It also meant loss of additional income associated with the administration of their contracts. As these events unfolded the board was not able to react quickly enough. Much of this was due to the lack of critical financial data. The complexity of the agency's functions and accounting methods also tended to mask flnanciml problems. Past audits, including the 1994 audit, had not revealed any serious problems. Consequently, business tended to continue as usual. By late 1995 financial demands began to emerge which made it apparent that the agency would have to substantially reduce its administrative costs. This step was taken in the form of lay-offs, salary reductions and other cost reducing actions. The board's reaction was insufficient to meet the financial problems that were converging and compounding themselves. In early 1996 additional staff was laid off. In May of 1996 the executive director resigned. The agency has operated since early May, 1996, with a skeleton staff. Its board chair, Steve Mumma, has assumed, for ell intents and purposes, the role of volunteer executive director assisted by other board members in various roles. There have been numerous financial reforms instituted. Checks and balances have been installed to help ensure that the agency will react more quickly to financial pressures. A search for a replacement executive director has begun. The agency is being assisted in this process by a to9 General Mills executive offered to it through MAPP. The 1995 audit confirms that the agency over spent its revenue by approximately $78,000. Hennepin County is fully aware of the problem and has been provided with a copy of the agency's 1995 audit. The audit shows no illegality or wrongdoing, but does explain the nature and scope of the shortfall. A 91an of repayment is being developed. Throughout these difficulties the board of Suburban Alliance has remained strong and committed. Support for the agency has been expressed by its sister agencies such as the Northwest Human Services Council and Community Action for Suburban Hennepin. Assuming that accegtab~e assurances and re£orms a=e in place, the COUnty h&S uxpre~ i~s interest in continuing its planning and coordination contract and the Emergency Services contract with Suburban Alliance. The Department of Economic Security, as the responsible state agency ~or the Energy Assistance program, has remained supportive. Suburban Alliance is and will continue to be a vital and viable asset to the citizens of Hennepin County. Its role may be redefined in some ways, but its vision will always be the same- emgowerment o~ ~hose who are economically or socially challenged through 91anning, coordination and advocacy of appropria~e social service 9rograme. Those present: Mayor Bob Polston, Councilmembers Andrea Ahrens, Mark I-Ianus, Liz lensen and Phyllis Jessen. Also present: City Manager Edward J. Shulde, Jr., Building Official Jori Sutherland, City Attorney Curt Pearson and Acting City Clerk Linda Strong. The Mayor opened the meeting and welcomed those in attendance. Mayor Polston reopened the continued public hearing and asked if there was anyone present who wished to either speak in favor or against the vacation of a portion of Churchill Lane. Michael McDonald, 3018 Churchill Lane approached the Council. He is the applicant and stated that he had been maintaining this area for a long time and would like to upgrade the area. Being no more comments from the public, Mayor Polston closed the public hearing. Building Official Jori Sutherland stated that the applicants have requested the vacation of the 230 foot Minut~ - Mound City Council June 25, 1996 wide platted right-of-way located between Block 12, Lots 19-26, 5, 6, and 7, and Block 14, lots 4-17, all in Arden. He stated the staff and Planning Commission recommended approval. Councflmember Hanus stated that there were actually two issues here; the vacation of Churchill Lane and to approve variances to recognize an existing nonconforming street frontage and front yard setback to allow for the already constructed decks. Building Official Jon Sutherland stated the Planning Commission had many concerns and had recommended denial. The applicant, Raymond Baylor was present and stated to the Council his rebuttal to the Planning Commission's decisions. MOTION by Jensen to approve as the Staff recommended, directing staff to prepare a resolution of approval for the variance and bring it back to the Council at the July 9, 1996 meeting. Motion was seconded by Hanus and carried unanimously. Building Official Jon Sutherland stated the Boyer Building Corporation has applied for a minor subdivision to relocate a lot line in the manner required by Mound City Code Section 320. He stated the development consists of double units with a common wall that straddles the lot line. In the case of this unit, the commons wall was built in the wrong location and the developer is proposing to move the lot line to the common alignment position. SUGGESTED DATE: JULY 9. 1996 4 Minutes - Mound City Council June 25, 1996 MOTION by Jensen, seconded by Jessen, and carried unanimously to set July 9, 1996 for a public hearing to consider the approval of an amended Conditional Use Permit for Meyer's Service to operate an auto repair business at 2620 Commerce Blvd. 1.11 COMMENTS AND SUGGESTIONS FROM CITIZENS PRESENT. There were none. 1.12 APPLICATION FOR PUBLIC LANDS PERMIT - STEPHANIE COON, 4729 ISLAND VIEW DRIVE. Building Official Jon Sutherland stated the item was denied at the last Council meeting because of the private structures on public lands and this not being allowed. He suggested removing the playhouse and flag pole from the public land permit and allowing the applicants to replace the stairway and repair the retaining wall. Discussion referred to the Commons Task Force and their research and development of a plan to handle private structures on public lands. MOTION by Hanus, seconded by Ahrens, and carried unanimously to direct the staff to prepare a resolution to be brought back to the Council on July 9, 1996, to include replacement of stairs and repair of retaining wail and to not deal with the structures at this time. 1.13 PROPOSAL FOR NEW DOCK LOCATIONS - LONGFORD ROAD, BRENSHELL HOMES/FINE LINE DESIGN. City Manager Ed Shukle stated the Park and Open Space Commission had recommended the developer shall repay the cost to the City for the survey of Longford Road ($605.00). Also, when the seven slip dock is planned, the length and width of each slip size shall be reviewed, and if something other than a slip size of 10' x 24' is planned, it shall be brought back to the Park Commission for review. They are recommending that these docks be added to the system. Mr. Behnke, the developer was present. Hanus questioned staff with regards to clarifying whether there is suitable shoreline left to use in the computation that Mound can still use within its license with the LMCD. There were questions regarding the Boat Storage Units (BSU's) and Water Storage Units (WSU's). Council thought the numbers that were used by the Parks Director were received from the LMCD. Mayor Polston suggested requesting a letter from the LMCD requesting the number of miles Mound has of Commons shoreline and the formula they use to calculate how many boats, docks are allowed. Ahrens wanted to see the Mound Dock Location Map showing our computation of shoreline. Ahrens wanted to see something on paper from the LMCD and she would also like them to attend the meeting when this is brought back to the Council. 5 Minutes - Mound City Council June 25, 1996 MOTION by Hanus, seconded by Ahrens, to direct staff to provide the Council with calculations and a Dock Location Map showing how the computations were done indicating exactly how much shoreline Mound has, and to have the LMCD confirm their computations and figures in writing regarding the amount of shoreline and formula for number of boats and docks for the City of Mound. 1.14 APPLICATION FOR A CONSTRUCTION ON PUBLIC LANDS PERMIT FOR WATER PUMP AND WATER LINE BY DONALD AND GERALDINE SWENSON, 4857 ISLAND VIEW DRIVE, LOTS 5/6, BLOCK 14, DEVON, DOt~K SITE #43520, DEVON COMMON, TYPE C. Budding Official Jon Sutherland stated the applicant has requested a Construction on Public Lands Permit to allow a water pump and water line to be placed on Devon Common abutting their property at 4857 Island View Drive to accommodate for lawn sprinkling. There is an existing stairway on the commons used to access the applicant's dock site. It is procedure to update all existing encroachments n a site when a new Public Land Permit is applied for. CSAII .110 AT THREE POINTS BLVD., HENNEPIN COUNTY PROJECT NO. 9514, AND AI, JTHORIZING MAYOR AND CITY MANAGER TO SIGN AGREEMENT, City Manager Ed Shukle stated the Council had approved the preliminary plans for the traffic signal installation, approved a resolution and now the agreement needs to be approved and signed. MOTION by Polston, seconded by Jensen, and carried unanimously to approve the agreement for a traffic control signal at CSAH 110 and Three Points Blvd., and directing the Mayor and City Manager to sign agreement. 1.16 PETITION FOR TWO STOP SIGNS TO BE PLACED AT THE INTERSECTION OF LAMBERTON ROAD AND ISLAND VIEW DRIVE. (To be handed out Tuesday evening~ 6 Minutes - Mound City Council June 25, 1996 City Manager Ed Shulde stated there was a petition from the residents of Radnor Road, Lamberton Road and Island View Drive to install two stop signs at the intersection of Lamberton Road and Island View Drive. Officer Ewald had researched the request and stated the placement of the signs could be a problem with all of the close driveways in the area. He did recommend a reduced speed limit sign to lower the speed limit in the area. Chief Harrell had discussed this with Public Works Superintendent Oreg Skinner and it may be possible to install two stop signs in the area. MOTION by Hanus, seconded by Jessen and carried unanimously to refer the stop sign request at Island View Drive and Lamberton Road back to staff so signs can be placed in a location to comply with the City Code. 1.17 RESCHEDULING THE SEPTEMBER 10, 1996 REGULAR CITY COUNCIL MEETING DUE TO THE PRIMARY ELECTION BEING HELD THAT DAY. City Manager Ed Shulde stated that the September 10, 1996 regular City Council meeting falls on the night of the Primary Election and needs to be rescheduled. The suggested date is Wednesday, September 11, 1996. Goose Situation - Mound Bay Park Hanus mentioned he had received calls regarding the goose droppings at Mound Bay Park early in the mornings during swimming lessons.. He asked if the company called Lake Restoration, one that the City uses, could be contacted to spray the grass at the park to rid the area of geese. The Zoning Code requires that all parking areas and access drives serving commercial property be paved with bituminous or concrete surfacing. That provision requires that "a fence of adequate design, not over five (5) feet in height nor less than four (4) feet in height shall be erected along the Residential District property line," and; WHEREAS, City Code requires the screening of all dumpster enclosures. As a result of complaints received about the overall appearance of the property and the number of vehicles parked on the site, the Building Official determined that the use of the property has changed substantially over the years without any update or modification of the conditional use permit. A chronology of the site was reviewed. The gas pumps have been removed and sale of gasoline has discontinued. It is assumed that the underground gas tanks are still in place. It is important that Meyer's Mound Service have a conditional use permit that accurately reflects the business that is conducted on the site. Since the business has continued to grow and evolve over the past 15 years without updating the permit, there are now a number of ordinance requirements that apply to the property. Issues that need to be addressed in updating the conditional use permit include: Use of the property. The existing special use permit allows only transmission repair on the site. Based upon the application, materials submitted, it appears that the facility qualifies as a minor automobile repair business. On-site parking. The special use permit which has never been updated limits parking to one vehicle. The applicant has requested parking for 25 vehicles. Based on the 'capacity of the off-street parking area, it seems that limiting parking to 15 vehicles is consistent with the conditions placed on Shoreline Automotive is reasonable. Parking lot. The parking area currently has a gravel surface. The Zoning Code requires that all parking areas and access drives serving commercial property be paved with bituminous or concrete surfacing. Mueller confirmed that other similar businesses used for comparison are Shoreline Automotive, Mound Collision and the old Arco (now-Glass Plus). Koegler confirmed that within the B-1 zone, minor auto repair is allowed by conditional use permit, and commented that the applicant can address what nature of repairs are done on-site, but believes it is consistent with the definition of minor auto repair. Chair Michael opened the public hearing. Steve Kladstrup, owner of 5668 Bartlett Blvd. which is located two houses to the east expressed a concern about future expansion of the business. Koegler noted that the surrounding property is zoned residential and this type of use is not allowed in a residential zone. Kladstrup noted that Meyer's repaired a broken timing belt on his car two weeks ago and noted that this is the type of work they do. Kladstrup stated that when the wind comes from the west trash from Meyer's blows into his property, and he has a collection of this trash to prove it. He feels that expansion of the business would have a detrimental affect on the neighborhood. Tom Reese, owner of 5641 Bartlett Blvd., stated that he feels the station provides a service to the community and it deserves to remain, but that it should be maintained so it is a benefit to Mound. He agrees with the planning report, however, feels 15 cars is a bit strong. He would suggest ten cars, otherwise he supports the rest of the report. He is also concerned about the signage as it is out of date. there is a concern in the neighborhood that this business be updated and made current. Richard Meyer, owner of the station, stated that when the complaint about the number of cars was received by the City was when it was very cold weather. He would like the Planning Commission to consider his request for 25 cars. Today they had 16 cars parked outside and there was room for more. In the winter he needs to be able to park more cars. Relating to condition #5, he stated that he would like the flexibility to allow quick repairs outdoors, such as replacing a fuse or a tire. He has no other concerns with the report. Relating to parking, he emphasized that he has four employees and himself, so five of the cars parked outside are the employee's vehicles which would only allow for ten customer vehicles. He stated that they rarely have more than five or ten cars parked overnight on the lot as most people drop off their vehicles a leave them during the day while they go to work. Chair Michael closed the public hearing. Mueller agreed that incidental repairs, such as replacing a fuse or a tire outside should not be a problem. He would be concerned about engine work being done outside. Mueller asked Mr. Meyer if he is okay with the condition relating to bituminous surfacing. Meyer said this condition is okay, however, expressed a concern about hardcover requirements. Koegler noted that this property is clearly in the shoreland district, and the property is limited to 30% hardcover, however, the current use existed in its current form since the early 80's, and gravel is viewed the same as bituminous by ordinance, so it would not be considered a change. Meyer confirmed that when the fuel tanks are removed, the island will also be removed. Voss asked what will happen if they violate this conditional use permit, and noted that the property has been in violation for the last 10 years. Sutherland noted that after they have been through this process, he will have a better relationship with the owners, Mueller questioned if there should be screening abutting 110. Voss suggested that screening may promote theft and vandalism. Koegler confirmed that screening is required only on the east side where it abuts residentially "zoned" property, and agreed that a fence on. the street side may be more obtrusive than seeing a neatly organized parking lot. Clapsaddle noted that fences just get dilapidated. Voss suggested they could limit the number of vehicles stored on the property at night. Hanus agreed that this could be done and stated that the Council approved three vehicles to be parked outside at Glass Plus overnight. Koegler noted that the Council had also required a one year review period for Glass Plus and this could be done for Meyer's. Weiland asked if there is a law that states when the gas tanks have to be removed once gas sales have discontinued. Sutherland noted that this would be a PCA or Fire Code, he thinks it is one year, but he can check. Meyer stated that he will take out the tanks this September and that the tanks are now empty. Meyer stated that he could easily park 25 cars on the north side of the building. He confirmed that repairs are done strictly on automobiles, there are no boat motor or snowmobile repairs done at the station. Weiland suggested they could limit parking to the north side of the building only. Voss expressed a concern about being consistent with what has been approved for other similar stations. Hanus commented that they also need to be careful not to restrict the growth of a business. Clapsaddle reviewed his concerns. Michael clarified with staff that there have been only about three complaints on this property in 13 years. In February of 1985, Jan Bertrand, the Mound Building Official notified Mr. Meyer that he would need to secure a new conditional use permit due to changes in the business operation that included the repair of snowmobiles and exterior storage on the site. In December of 1985, the Meyers purchased the residential property adjacent to the auto service facility and on May 15, 1987, the City of Mound issued a demolition permit for the home that was located on the lot. The house was subsequently demolished and became a vacant site that is currently used for vehicle parking. City records indicate that the residential property abutting the auto service facility on the east side is also owned by Mr. and Mrs. Meyer. Another change that is obvious in looking at the property is that at some point in the past, the gas pumps were removed and the sale of gasoline was discontinued. It is assumed that the underground gas tanks are still in place. The City is unaware of any time schedule for their removal. COMMENT: It is important that Meyer's Mound Service have a conditional use permit that accurately reflects the business that is conducted on the site. Since the business has continued to grow and evolve over the past 15 years without updating the permit, there are now a number of ordinance requirements that apply to the property. Some of the requirements can be met with minimal cost and others will be more costly to implement. Therefore, the City may want to consider allowing the owner to phase any required improvements over a multiple year basis. The following is an overview of the issues that need to be addressed in updating the conditional use permit: Use of the Property The existing special use permit allows only transmission repair on the site. Based on the types of repair that have traditionally occurred on the property since it was acquired by Mr. and Mrs. Meyer, the current use fits within the minor automotive repair classification of the ordinance. Minor automobile repair is identified as "the replacement of any part or repair of any part which does not require the removal of the engine head or pan, engine, transmission or differential; incidental body and fender work, minor painting and upholstering service when said service above is applied to passenger automobiles and trucks not in excess of 7,000 pounds gross vehicle weight." Any types of service more intensive than those defined as minor automobile repair are classified in the code as major automobile repair. Major automobile repair facilities are not allowed in the B-1 zone. Based upon the application materials submitted, it appears that the facility qualifies as a minor automobile repair business. Meyer Conditional Use Permit Planning Report June 5, 1996 Page 3 On-Site Parking The number of vehicles parked on the site has been the subject of public complaint. The special use permit which has never been updated limits parking to one vehicle. The applicant has requested parking for 25 vehicles. He further stated that maximum use of parking is likely to occur only on extremely hot and cold days which result in increases in business activities. In looking at defining a reasonable amount of parking to support the business, two factors need to be considered. First, the business is located in a prominent location in Mound's commercial area and it is very visible to the public. Therefore, appearance is an important issue. Second, the business has two repair bays which is common in other automobile repair businesses in Mound. Therefore, it is appropriate to examine parking limits placed on those businesses compared to the Meyer's Mound Service site. The most recent conditional use permit approved for an automotive service facility was the one for Shoreline Automotive that was approved by the City Council in 1995. That permit limits the total number of vehicles on the site to 15. Like Meyer's Mound Service, Shoreline Automotive has two repair bays, however, the Shoreline Automotive site is substantially larger than the one owned by Mr. and Mrs. Meyer. During a recent site visit, there were 12 vehicles parked on the property including a tow truck and an empty boat trailer. Based on the capacity of the off-street parking area, it seems that limiting parking to 15 vehicles consistent with the conditions placed on Shoreline Automotive is reasonable. Parking Lot The residential property that was demolished in 1985 is now used for parking to support the business. The parking area currently has a gravel surface. Section 350:760 of the Zoning Code requires that all parking areas and access drives serving commercial property be paved with bituminous or concrete surfacing. The ordinance also contains other provisions that apply to commercial parking lots. Section 350:760, Subd. 1 D. states that parking lots can not be located closer than 5 feet from an adjacent lot zoned or used for residential purposes. The lots located both north and east of the Meyer's property are used for residential purposes. Section 350:760, Subd. 3 D. requires fencing along the east side of the parking lot. That provision requires that "a fence of adequate design, not over five (5) feet in height nor less than four (4) feet in height shall be erected along the Residential District property line." Trash and Parts Storage At the present time, trash is stored on the site in a dumpster that sits along the west side of the building. Tires are stored at the rear of the building in an open rack and bins are located on the north Meyer Conditional Use Permit June 5, 1996 Page 4 side of the building to accommodate old car parts such as mufflers, tail pipes, etc. None of the trash or dumpster storage is screened. City Code requires the screening of all dumpster enclosures. The original special use permit for this site prohibited outside storage of parts, material and other equipment. The existing dumpster as well as all parts storage needs to be screened. Screening has been a common requirement for similar businesses such as Glass Plus and Shoreline Automotive. RECOMMENDATION: Staff recommends that the Planning Commission recommend approval of a conditional use permit for Meyer's Mound Service as a Minor Automobile Repair facility subject to the following conditions: 1. Parking on the site shall be limited to a total of 15 vehicles. All vehicles parked on the site shall have current vehicle license tabs. The sale of vehicles on the property is prohibited. The parking lot on the north side of the building shall be improved consistent with City ordinance requirements. Said improvements shall include but not be limited to bituminous surfacing and construction of required fencing. 3. All trash and parts storage shall be screened. The applicant shall prepare and submit a screening plan for review and approval by the Mound Building Official. 4. Any future changes in signage for the business shall comply with the Mound Sign Ordinance. 5. All vehicle repair activities shall occur inside the building. Variances will be necessary in this area to afford property owners reasonable use of their land, and; WHEREAS, according to the survey, the elevation of the lowest finished floor of the home is 932.77 and the structure has a crawl space that is at an elevation of 929.04. Both these elevations are under the minimum floodplain elevation for Lake Minnetonka which is 933.0, and; WHEREAS, the entire lot is located within the existing floodplain. As such, it will require Watershed District approval of the minor amount of fill necessary to construct the garage and raise the floor elevation. The applicant is seeking variances to construct a garage addition, decks, and a second story addition. Northern Road is one of the tightest neighborhood areas in the City of Mound. The land area is limited by the location of the lakeshore and the County Road. Variances will be necessary in this area to afford property owners reasonable use of their land. The following addresses each of the variance issues applicable to this case: 1. Front Yard Setback - the plan shows a new attached garage with second story living space located on the front of the lot approximately .7 feet from the property line resulting in a 19.3 foot variance. The garage door opens to the side lot line eliminating the need to directly back into Northern Road. The face of the proposed garage door is approximately 28 feet from the western property line. Although the proposed garage is extremely close to the street, there is no reasonable method of locating a conforming garage on the lot. The proposed depth of the garage (22') is not excessive and as evidenced by materials stored along the side of the home, a garage is needed for storage. Upon approval and commencement of construction, an existing storage shed on the lot will be removed. Side Yard Setback - the west side of the existing home is located 5.9 feet from the lot line which is .1 feet under the 6 foot requirement. Relocation of the existing structure to a conforming location is not recommended by staff since it would qualify as a "practical difficulty" situation. Lakeshore Setback - It appears from the plans that the existing deck will either be reconstructed or modified to remove a small appendage that extends towards Lake Minnetonka. At its closest point, the deck is approximately 47 feet from the lake which is under the 50 foot setback requirement. Since it appears that the deck will be either rebuilt or modified, the deck should be brought into conformance with the lakeshore setback requirement. The deck that is shown on the plans on the second level of the home conforms to setback requirements. Floodplain Elevation - According to the survey, the elevation of the lowest finished floor of the home is 932.77 and the structure has a crawl space that is at an elevation of 929.04. Both these elevations are under the minimum floodplain elevation for Lake Minnetonka which is 933.0. The proposed improvements constitute a maior reconstruction of the existing home. In previous cases of a similar nature, conditions of approval have included raising the floor elevations above the minimum flood~evel. Raise the elevation of the floors of this home would also be appropriate. In addition to the floodplain elevation issue, the entire lot is located within the existing floodplain. As such, it will require Watershed District approval of the minor amount of fill necessary to construct the garage and raise the floor elevation. The applicant will also need to prepare a detailed grading and drainage plan identifying pertinent elevations and showing compensation measures as applicable. The proposed improvements will substantially upgrade the existing home while affording the owner reasonable use of the property. Staff recommended that the Planning Commission recommend approval of the front yard setback and side yard setback variances subject to the following conditions: The floor elevation of the existing home shall be raised to a minimum elevation of 933.0. The applicant shall prepare a grading and drainage plan for review and approval by the City Engineer. Said plan shall contain contours and spot elevations necessary to permit a full assessment of the grading impacts of the proposed improvements including, but not limited to compensation measures to comply with floodplain requirements. The applicant shall secure required approvals by the watershed district and other applicable agencies. Construction of new improvements shall be in conformance with the Mound floodplain regulations. 5. The existing storage shed shall be removed from the property. The Commission confirmed that staff is recommending the existing house be raised .23 feet. Staff clarified that if more than 50% of house is being altered, the existing is required to be brought into conformance. Sutherland noted that this case was reviewed with the DNR, and there are some acceptable methods of construction by allowing the floodplain to come into a crawl space, however, to get through this process they would need a civil engineer to prepare the plans. Weiland expressed a concern about snow removal and asked where the snow will go when they plow the street. Koegler commented that fortunately, in this area, the other side of the road is undeveloped, and therefore the snow can be directed to one side of the street, away from the garages. Weiland stated that this property would be over-built and considers this proposal as over- usage of the property. Hanus asked if the size of the garage could be reduced to be only 20 feet wide, which would allow for 2 more feet on the street side. Mueller commented that a 22 foot wide garage is not bad, and noted they have dealt with similar situations on Ridgewood, Edgewater, and Island View, and this property has the benefit of being able to push snow to the other side of the street. He feels this is a good improvement. Reifschneider stated that there are options that would be less encroaching, such as building a second story all the way across with a tuckunder garage. The owner stated that he wants to keep the vaulted ceiling in the existing portion of the home and noted that this home is a log house on the inside, and does not want to disturb the existing logs. Clapsaddle commented that this situation is the nature of the neighborhood. Clapsaddle moved staff recommendation. Mueller seconded the motion. Motion failed 4 to 5. She was told when she purchased her house that the likelihood that playhouse would be allowed to remain would be good because it is structurally sound. She related the history of the playhouse and noted that the City laid the foundation and moved it to the commons. Darling asked if the playhouse would not be a public structure now that it is on public land? Byrnes emphasized that you have to cross private property in order to get to this commons, so their stair would not be used by the public. Goode added that this commons is not traversable, without a stairway. Fackler commented that staff has not specifed who is required to do the removal, and that they hope at this time to work out an agreement with the adjacent land owner; if they want to keep the structure and take responsibility for it or if they do not want to take responsibility for it and 6P,rexfe;,t.hatit berem°ved- Coon emphasized that the playhouse is not alarge structure, itis only Darling quoted a statement made by Curtis A. Pearson, City Attorney, in a letter to Ed Shukle dated November 10, 1995, "I would also caution that stairways which are located on public lands are in effect open to the public's use." Darling questioned if this also applies to other private structures. Pederson commented that the dock is considered private, and questioned how this is different than stairs. It was noted that the dock is located in the water, not on land. Darling also quoted from the same letter, "There is a potential for litigation and even a potential for a loss where the steps are on public land..." May 9, 1996 Park and Open Space Commission Minutes Goode commented that logically, when commons are nonaccessible or nontraversable, structures should not be considered public. Darling stated that they need to follow rules that are in place today. Casey emphasized that there are also scenic and passive uses for the commons, and some people prefer to view a natural shoreline, rather than a shoreline cluttered with structures. Byrnes confirmed that Fackler had stated earlier that if an owner assumes responsibility for a structure it may remain, and then when it gets to a dilapidated state or is destroyed by natural causes, that it would eventually be removed. Stephanie Coon agreed to assume responsibility of the playhouse. Michael Pride, Stephanie Coon's husband, reviewed the plans submitted with their application which include replacement of the stairway, lights installed on the stairs, repair of the cement retaining wall, painting the retaining wall, and planting ivy or some other type of vegetation in front of the wall. Casey asked if they would consider native plantings. Pride commented that they will work with staff and plant whatever is recommended. It was noted that this is a south facing hillside which gets a lot of sun. Pride stated that they prefer to keep the flag pole, and noted that it is bordered with railroad ties, about 3' x 4'. MOTION by Byrnes, seconded by Ahrens approve a five year permit, as recommended by staff with the exception that the playhouse and the flag pole may remain, and that the applicant talk to staff about plantings and the retaining wall. Casey commented that they are perpetuating old mistakes by allowing things to remain, and he agrees with Darling that they need to make policy decisions and determine if these structures should be considered either public or private, and decide what uses they should allow. Casey stated that he would oppose the motion, and that he is not in favor of the lights or allowing the flag pole to remain. Goode is in favor of allowing the playhouse to remain, however, feels the flag pole is a separate issue because this area will never look like public land. Ron McCombs stated that the rest of Lake Minnetonka is not pristine, and asked why Mound is trying to make the commons look pristine, and emphasized that flag poles are not harmful to environment. Casey stated that every City has rules and codes and as a Park Commission they need to recommend where the line should be drawn. The Shoreland Management Ordinance is one of these codes which both private and public land must comply with. Motion carried 4 to 3. Those in favor were: Ahrens, Goode, Byrnes, and Pederson. Opposed were: Casey, Geffre, and Darling. Park and Open Space Commission Minutes May 9, 1996 Ahrens stated that the Council has determined that if an applicant does not agree with staff's recommendation, that the Council will approve the permit anyway, pending the recommendations from the Commons Task Force. Ahrens noted that the Commons task force is still meeting on the issue of encroachments. Darling moved that the City look at all nontraversable or nonaccessible commons that are not private and look at selling or leasing these commons to the adjacent property owners. Geffre seconded motion. Byrnes stated that the City does not own commons, so they cannot sell it. In order to vacate any land it has to be proven to be in the public's best interest to do so. Ahrens suggested that adjacent property owners could lease the commons. Darling questioned if it is realistic for the City to manage the commons when their is no public use. Jim reminded Commission how this type of action may affect the dock program. It was discussed how the lineal footage of public land affects the number of docks in the program. Casey would like to keep control of the shoreline and attempt to regain the beautiful natural shoreline they once had. He commented that the Shoreland Management Ordinance was mandated because the shorelines have become overdeveloped and it should be a public policy to protect this land from degradation. Goode suggested they hold off on Darling's motion until the commons task force finishes their review and recommendation regarding encroachments. Darling clarified that the intent for his motion is not to arbitrarily sell land, but to start the process of researching the possibility, understand the legal ramifications, and see if it makes sense. Byrnes stated that the Commons Task Force has been directed by Council to address the issue of encroachments on the commons. Motion failed with 3 in favor, 3 opposed, and 1 abstention. The ~urre-~nt benefit is $425 per month. Each firefighter must have served 20 years or more before receiving the pension benefit. The benefit is part of the incentive to recruit firefighters and to keep them around for 20 ye~sbefore they retire. The hourly rate of pay that a firefighter now receives is $6.~50_.per hour which is P~]3;-i/~I'~ at a Iow rate so that the firefighters can have funds allocat&d to the pension program. In 1996, we increased that hourly rate to $6.50 per hour from $6.00 per hour. That rate had not been increased since 1984. Thus, the association has rightfully asked for an increase in their pension benefit. We have reviewed the request and have determined it to be in order. We do have some concerns, however, relating to the unfunded accrued liability. Section 69.773, Subdivision 4 of Minnesota Statutes, states that the contribution requirement is equal to the normal cost, expenses and amortization of the unfunded accrued liability by December 31, 2007. In other words, the contributions must continually be increased so that by 12/31/2007, the unfunded accrued liability must be zeroed out and the liability will be erased. We have discussed this concern with the President of the Association and he has conveyed our concern to the remainder of the Board of Directors. In addition, we have expressed concern regarding other pension issues and it is the intent of City staff and the Mound Fire Relief Association Board of Directors to continue to work on those issues to come up with a carefully planned strategy to deal with those issues into the future. t-~ased upon an actuarial that was performed as of 12/31/95, the current pension contributions~ .(~_rom the various cities in the fire district along with the investment earnings on the pension printed on recycled paper Memo to Mayor and City Council July 3, 1996 Page 2 monies that are invested by the association, are at an adequate level to cover a pension benefit increase of $35. Now that the 1996 legislative session is over, I want to let you know what happened with fire service issues. On a couple of issues: assault on a firefighter has been raised to a felony. House File 2136 was incorporated in the final omnibus crime/judiciary finance bill which has been signed into law by the Governor. It provides that whoever assaults a municipal or volunteer firefighter, such that the assault inflicts demonstrable bodily harm, is guilty of a felony and can be sentenced to imprisonment and/or a fine. On pensions/I was co-author of the 1996 Omnibus Public Pension bill, House File 2417, and I worked to improve the funding of firefighter pensions. When I was your mayor in Mound from 1986 through 1990 and as State Representative, I have been able to help put into practice my belief. And that is, that one of the ways to get and keep good volunteer firefighters, is to provide good pensions. One thing the citizens of our communities do not do often enough .is simply say "thank you" to the members of the fire department. But we know that when we dial 911, you will leave your family to come and protect ours. So for that, and on behalf of our communities and our state, I want to simply say "thank you" You have my support and you will continue to have it. ETING JUNE 13, 1996 NEW DOCK LOCATI NS - LONGFORD ROAD continued discussion Parks Director, Jim Fackler informed the Commission that he has reviewed this issue with Greg Nybeck of the LMCD regarding the acceptance of these docks under their code. Faclder reviewed the letter from the LMCD dated June 5, 1996 and explained that the LMCD allows for one boat for each 50 feet of shoreline, and these docks could be added to the City's 1997 renewal application for our multiple dock license. Ann Jepson, owner of one of the two existing docks in question, stated they would be happy to comply with any rules, but they do not want to become part of a shared common dock with the neighbors. They do not want their decision to delay the installation of their neighbors docks. They are happy about the neighborhood being improved, but requested their dock be dealt with separately. She explained their dock is the one on the far east. The Parks Director noted that a survey would determine if their dock is actually on Longford Road or on private shoreline. If it is found their dock is on Longford Road, it would become part of the commons dock program, and would remain a single dock assigned to their home. Pederson confirmed with the Jepson's they have no problem becoming part of the dock program. (Ahrens arrived) Ahrens questioned if they are allowed to go over the 448 docks as the City is licensed for through the LMCD. The Parks Director explained that they are allowed to have one restricted watercraft for each 50 feet of continuous shoreline. Since Mounds shoreline is not continuous, the code allows Boat Storage Units (BSU's) provided the total number of BSU's for the city multiple dock license does not exceed one restricted watercraft for every 50 feet of shoreline. Faclder noted that Mound has more than enough available BSU's based on lineal footage and there is enough lineal footage along Longford Road to handle the number of boats proposed. Fackler clarified that BSU's are the number of boats, and WSU's are based on boat length. For example, one larger boat may count as 1.5 or 2 WSU's. Ahrens stated that right now there are 448 dock sites and each dock is allowed 4 boats, and fight now that is their privilege. Fackler commented that it is not likely that each dock will have 4 boats, but it is more likely that the size of the boats could increase, and as boats grow, the units diminish Geffre questioned the size of the proposed multiple docks and questioned if dredging will be n~_..ded? Fackler stated that no dredging will be needed. Fackter noted that the two-slip dock will be about 39 feet wide. Fackler confn-med that staff's recommendation is to have this area designated as a Type C Shoreline. Geffre questioned if they are reviewing both proposed docks as one proposal. Faclder emphasized that it is less costly to process these docks on one application through the DNR, and the survey costs are also less. Fackler confunned there would be a total of nine new dock sites on the two multiple docks and up to three other individual dock sites. Akrens requested clarification regarding BSU's and WSU's. Fackler explained that the City's LMCD Multiple Dock License is based on WSU's, and he reviewed the numbers from ther 1995 application: BSU' s_ WSU's 305 boats up to 20' long @ 1 305 145 21' to 24' long @ 1.5 218 34 25' to 32' long @ 2 68 5 33' x 40' long @ 2.5 13, 604 489 Fackler cl,a~,ified that based on lineal footage of shoreSne as shown on the Dock Location Map, 1,220 WSU s are allowed. ' Pederson asked if this area would be considered marsh land and nontraversible. Faclder agreed that it could be. Pederson referred to the Use Plan which describes Wildlife Areas as "marsh land and nontraversible," and questioned how this area differs from other Type E areas. The Parks Director stated that the Park Commission could recommend this area be designated as Type E, however, a request was received for docks, not for a Wildlife Area. Akrens commented that it is possible to traverse on foot down to the shoreline. that the steep portion of this property is actually located on private land. recommending stairs or paths as part of this request. Faclder noted Staff is not Ahrens questioned if both the existing docks are in question? Faclder stated that he will not know until the survey is complete. Ah.rens referred to the docks within the Lost Lake Subdivision which are all considered public docks, and the owners within that subdivision are not privy to those docks. Fackler commented that if these docks were to be open to the public, it would require a walkway easement in order to establish public access. Fackler noted that the abutting property owners will have priority to these docks. Meyer moved to recommend approval of the two multiple docks on Longford Road, one with 7 slips and one with 2 slips, subject to the condition that .~ intrusion to the marsh be minimized. Darling seconded the motion. Ahrens questioned how many dock applications were refunded this year because there were no sites available. The Dock Inspector noted that less than 20 were refunded, which is about average for the last three years. Darling commented that as much as we want to protect the lake, this is a community lake, and homes are being built, so we have to ask what is reasonable? Steve Behnke, representing the developer noted that one of the owners of the new houses does have a larger boat, but they are proposing standard size slips. He stated that they would be more comfortable if they were able to have a variation of sizes for the slips. Ahrens suggested they limit the area to a certain number of WSU's. Ahrens stated that she would vote against the motion as it reads because the motion does not address payment for the survey of Longford Road. She also feels that since this area is traversible, docks should be made available to the public. Pederson asked how many WSU's are alotted for this area? Faclder stated that even if there was not enough lineal footage in this area to accommodate the number of WSU's proposed, there is enough lineal footage left over from the entire dock system. He does believe this area would handle what is proposed. Geffre expressed a concerned about the size of the dock slips and noted that the two-slip docks are bigger. Fackler stated that the slip sizes of the new dock on Devon Common are basically 10' x 24'. It was noted that the large boat proposed to be docked at the two-slip dock is 30' long. Steve Behnke stated that they are akeady surveying their whole property as it is, and does not feel they should have to pay for the surveying of other peoples property. Fackler commented that they did utilize the survey for this property along with surveys of other neighboring properties in order to complete the entire survey of Longford which helped reduce the cost of the City's survey. Ahrens asked if this developer will be paying a park dedication fee? The secretary noted that they may not, it has not been determined yet. Ahrens again emphasized that the Lost Lake Subdivision had to give public easement and extra dockage for the public. Relating to paying for the survey, Ahrens noted that the developer is the main beneficiary of obtaining these docks. Geffre confirmed with the Parks Director that the City survey would not have been done unless this development came forth. Darling suggested a friendly amendment to the motion that the developer shall pay for the costs incurred by the city for surveying Longford Road. Steve Behnke commented that he would be in favor of paying for the survey costs if the survey totally related to their work, but the survey is also of other peoples docks. Meyer amended the motion to include the following conditions: 1. The developer shall recover the cost to the City for the survey of Longford Road ($605~00). When the seven slip dock is planned, the length and width of each sllp size shall be reviewed, and ff something other than a slip size of 10' x 24' is planned, it shall be brought back to the Park Commission for review. Currently, two homes are being built at 4622 and 4626 Kildare Road and another seven home sites are proposed for development on Kildare Road in the near future. Their location adjoins the unimproved Longford Road which is dry land above the Ordinary High Water elevation of 929.4. This land is under City con~ol and lies between these home sites and Lake Minnetonkz. There has been a request from the builder and future home owners to have dock locations established. Because of the marsh that is present where the docks would be located, the City must obtain a permit from the DNR. From my contact with the DNR this area seems to be in compliance with their regulations to establish dock sites. Their main concern is if the marsh is recognized as a protected fish spawning area, which it is not. The only other request of the DNR is that the docks limit their intrusion through the marsh. As you can see from the proposed plans, both sites have been consolidated to accomplish this. An application has to be submitted to the DN-R along with applicable fees and information. Grog Nybeck, LMCD, believes there will not be a problem adding this area to Mound's Multir~te Dock and Mooring Area License, we would just have to designate this on our 1997 application. If these sites are established, the Shoreline Type should be recognized as "Type 'C' on the Dock Location Map. The docks would be installed by the homeowners and have multiple slip sites. Each slip should be recognized as a single docking site with numbering as such. A base fee (currently $150.00) should be charged each year, per slip, and limited to one watercraft per slip, unless the Dock Inspector determines that the dock area may accommodate additional boats. Along with establishing this area, a survey of Longford Road must be done to recognize any other docks that are utilizing this area for access to the lake. This needs to be done so that the City is consistent in enforcing regulations of docks on properties under the control of the City. Ahrens questioned how they can increase the number of docks past 448 without going through the LMCD or without offsetting that number. Fackler stated that there is enough pubLic shoreland that was not included in the original linea/footage calculations to accommodate these additional dock sites. Ahrens questioned if they will need to take 9 dock sites away from somewhere else in order to add these 9. Ahrens feels they need to investigate this proposal further with the LMCD. Faclder emphasized that Grog Nybeck reviewed this issue with Gene Strommen, past Director of the LMCD and they did not think there would be a problem with the proposal. He also noted that the LMCD looks at boat count, not dock site count. Tom Stokes of Fine Line Development stated that these properties will be taxed as though they are lakeshore, so these properties should be eligible for a dock. He asked the Park Commission to approve the docks, subject to them meeting the requirements of other agencies. Doug Ripie, future owner of one of the houses currently under construction, stated that they designed the proposed dock to have least amount of impact on the lake. Goode asked if it wouldn't be better to relinquish Longford Road to the adjacent land owners? Do we need more commons.'? Pederson agreed, and emphasized that the property is not traversable, and there will never be a road there. Park and Open Space Cortm~sion Minutes May 9, 1996 °o Casey asked if the developer is paying the application f~s to the DNR? Fackter stated that the City would pay the application fee, however, this would be regained through the dock license fees. Fackler confirmed that he would expect the land survey to cost about $1,000, and this would be paid from the dock fund. MOTION by Darling to recommend approval of the multiple dock plan, as submitted, pending approval and compliance of any and all government agencies. Goode seconded the motion. Casey commented that the City is under no obligation to provide landowners with docks. He sees this area as a beautiful bluff, and asked if they should compromise their space to allow for docks in the marsh? He is concerned that they would be adding docks in a small channel that is pinched already. The two existing docks located on Longford Road were discussed. Casey questioned how Crescent Park was designated as a wildlife area? Darling withdraw his motion because he thou~t the two existing docks were going to be replaced with this one new multiple dock. Pete Buckner, future owner of one of the houses currently under construction, stated that instead of two new docks, they are proposing one joint dock, and asked why this is an issue? Geffre asked Fackler if the other two docks are actually on Longford Road. Fackler beleived they could be, but it was not cost effective at the time to survey the property, but now because of new surveys provided to the City from a developer, he realized that it is all public shoreline so now they should add it to the dock program. It is kis intent to bring the whole area into compliance. Goode asked if it would not be better to have one multiple dock for all. Fac!der noted that access to the dock would be an issue. Byrnes was excused from the meeting. Tom Stokes emphasized that these people own the land on the other side of Longford Road, even though it is underwater, and this property will be part of a Homeowners Association. Fackler asked where do you draw the line? Ahrens asked how many other people own private land on the other side of their commons? Casey moved to deny the two new docks sites as proposed. The Commission asked what action will be taken with the two existing docks? Should they be brought into the program? Ahrens asked what will justify the expense of the survey if the new docks are denied? Faclder stated that he received substantial evidence that public land existed, should he ignore it? Park and Open Space Commission Minutes May 9, 1996 Goode noted that some portions of the shoreline did abut private property and asked if the LMCD would suppor~ the placement of a private dock at these points. FacPder commented that the LMCD may have a concern regarding setbacks. He stated that the LMCD requires 50 feet of shoreline per boat, but offered to check with them on the issue. Ahrens stated she is not opposed to property that abuts the shoreline to have docks, but is opposed to having docks added to the program that do not have approval from the LMCD and she does not believe Greg Nybeck gave approval. She does not believe that the lineal footage was never computed in original permit. Fackder stated that the lineal footage has been increased over the years, the City has gained Lost Lake and the area off of Denbigh. Ahrens would like to confirm that the LMCD would allow this. She is concerned that if they surpass the number of 4~8 dock sites, what would prevent them from adding 20 sites to the new multiple dock by Pembroke Park or other areas? She does not want to set a precedent. Motion failed 5 to 1. Those in favor of denial were Goode, Geffre, Darling, Ahrens, and Pederson. Casey was opposed. MOTION made by Ahrens, seconded by Darling, to table this request until further information is received from the LMCD. Motion carried unanimously. The Commission clarified the information they want from the LMCD: saturation point? maximum number of docks? can docks be ins~led on shoreline which is less than 50 feet wide? Regarding the two existing docks, Faclder commented that this area is not recognized on the Dock Location Map as a docking area, at this time. He would like to see this entire area addressed. I have also been in contact with Greg Nybeck, LMCD, regarding the addition of this area to Mound's Multiple Dock and Mooring Area License. He believes there will not be a problem adding this area and that we would just have to designate it on our 1997 application. There will be no additional charge by the LMCD for Mound's Multiple Dock License until there are boats stored at the subject docks. Other cases included robbery, assault, burglary, arson, possession of stolen property, illegal dumping of hazardous waste, theft, stolen auto, damage to property, domestic abuse, theft by check, harassment, and absenting. Formal complaints were issued for overweight load, theft of service, open bottle, impersonating an officer, minor consumption, disorderly conduct, assault, damage to property, DWI, violation of court order, and driving after revocation. III. personnel/Staffing The department used approximately 86 hours of overtime during the month of June. Officers used 102 hours of comp-time, 90 hours of vacation, 55 hours of sick time, and 10 holidays. Officers earned 113 hours of comp- time. Michelle Alexander was hired as a police officer to fill an open position. James Packard and Patrick Clark were hired to fill the open Community Service Officer positions. Officer Huggett attended the regional canine competition with "Rainbo" in June and earned his PD 1 certificate. COMMUNITY SERVICE OFFICERS Officers Packard and Clark addressed 13 animal complaints, 17 ordinance violations, and 42 miscellaneous calls for services. 1 citation was issued in June. There were 34 Part I offenses reported. Those offenses included 1 criminal sexual conduct, 5 burglaries, 1 aggravated assault, 26 larcenies and 1 vehicle theft. There were 92 Part II offenses reported. Those offenses included 3 child abuse/neglect, 2 forgery/NSF checks, 1 weapon, 1 narcotic, 14 damage to property, 2 liquor law violations, 9 DUI's, 7 simple assaults, 13 domestics (8 with an assaults), 3 harassment's, 15 juvenile status offenses, and 22 other offenses. The three main points that impressed mc were: 1. Voters in thc metro area arc passing land referendums to purchase green space. 2. Mound has very few acres of' green space. After totalling Mound's grccn space acres as listed in thc Recreation Section of Mound's Comprehensive Plan (4/90), and subtracting Lost Lake's 40 acres and thc School District's 45 acres, I found that Mound is at the bottom end of the Metropolitan Council's recommendation of park land per 1,000 residents ratio for cities. 3. Mound ranks very low compared to thc area communities listed in thc Parks and People chart in the article. During Mound's early histo~, green space is what attracted tourists and settlers here. We need to concentrate on our strengths, which include our lakes, parks, and nature areas. There is a need for Mound to acquire more parkland. The Birch Lane property can be added to our parklands at no cost to the city or it's citizens. It's a win-win situation. Please vote to retain this parcel for parklands. Armed with petitions signed by some 200 people urging that the land near the intersection of Yankee Doodle Rd. and Federal Dr. be preserved as open space, they convinced the City Council this. spring not only to stop the developer, but to take ownership of,~he tax-forfeited property so it can'never be developed. iA similar public outcry helped kiQ'a proposal to build a housing de.'elopment around the Carriage Hills Golf Course in Eagan. ,Ken Vraa, the city's parks di- rector, said some opponents sim- plY'didn't want any more houses or'~residents in the neighborhood, while others wanted to continue to enjoy the open space around the course. A third group did not object to the development pro- posal but wanted the trees to be saved. Vraa and Mayor Tom Egan said that people in the fast-grow- ing Dakota County suburb are starting to feel a need for more breathing room. This fall resi- dents will be asked whether they are willing to spend $3.8 million to buy land for more parks and $800,000 to improve existing parks. No date has been set for the bond referendum. City officials and a citizen task force have pared a list of about 50 potential park sites to 23 loca- tions, including about 500 acres. The $3.8 million bond issue would be enough to buy about 100 acres, Vraa said. If the bond issue is approved, the Eagan City Council likely would seek additional money lat- er to develop athletic fields and install playground equipment on some of the new parkland. £gan said a recent survey of residents' park preferences re- vealed "a real change in taste." He said people want soccer fields, for instance, "although baseball is still popular. But we need fewer tennis courts." He said those feelings will be taken into consideratic aen the city decides which pad<s to develop and which to leave in a natural state. Parks are developed not only by cities, but by counties, the state, the Metropolitan Council and the federal government as well. In addition to its own 1,200 acres of parkland, Eagan is home to the the Met Council's Lake Byllesby Regional Park, a 420- acre facility that will soon gain another 200 acres. While there is no official gov- ernment standar: for the amount of parkland a corlmunity should have, the National Recreation and Parks Association, a private, nonprofit professional organiza- tion, has set a standard of 7 to 14 acres of parks per 1,000 people in cities. The Met Council has en- couraged cities to follow that standard. The Parks Director noted that this is a very nice lot, it is high ground and has a number of trees. The whole lot is on a hill. Ahrens suggested the lot be released for sale and the revenue, if any, be put in the park dedication fund. Meyer suggested that this is a piece of property that they could add to Mound's open space and see it saved. MOTION made by Ahrens to recommend the lot be released for sale, and the revenues, if any, be deposited in the park dedication fund. Due to lack of a second, the motion failed. MOTION made by Darling, seconded by Meyer, to recommend that the parcel be brought into the park system. It was noted that there is no cost for the City to retain the parcel. Faclder noted that the only future cost would be there was a hazardous tree situation on the property. Darling commented that this parcel is huge compared to other small strips of land which the city has control. This is a very large piece of open land which should develop naturally. Pederson commented that they need to plan for the future, there are only so many trees and open land, and she would like to see it retained. Ahrens commented that the day is coming when we will not be able to care for the land we have. Geffre stated there is no reason why we need to sell it now, it could always be sold in the future, so we should keep it for now. Ahrens suggested they get prepared to put up another "no dumping" sign. Meyer commented that beside the environmental reasons to retain this lot, it is one of the last woods where neighborhood kids play. Botko conf'u'rned that it would be easy to release the property for sale again. Motion carried 5 to 1. Those in favor were: Darling, Meyer, Geffre, Peterson, and Botko. Ahrens was opposed. Gross sales equalled $164,255. That compares to June of '95 when we did $158,382 in sales. Half of the year has gone by. At this point in time we stand at $753,115 in gross sales. Again, this compares to last year after the first six months when we stood at $705,496. June also saw some new and exciting changes to the exterior premises of our facility. Our parking lot has been restriped and with a different twist to it We now have angled parking directly in front of the store and in the middle. We lost two spaces up front but gained a few more in the middle rows. The slanted parking was accomplished by the installment of two barrier islands located on Domino's side. The intent is to have the flow of traffic enter in one direction and exit in another. This should hopefully also slow traffic down. We will see. We have four new trees on Wilshire Boulevard and two inside the barrier islands in the parking lot. When these trees mature they will provide ample shade to block the rays from the setting sun that enter our store in the early evening. We had some trouble with the sweepers this year. We had to replace rollers and conveyors on both of them. On the 1980 sweeper, the hydrostat transmission went out. This was replaced along with the PTO, that went out. This is the first major work we put into this sweeper and it is 16 years old. We started water main break repairs. We completed them in June. We will be putting on the final lift sometime in the month of July. We will be fixing a few holes on Gull Lane and Jennings Road due to the MCTO buses that drive over these roads during road restrictions. This happens every year with the buses when they drive on our 4 ton streets. Sealcoating will take place this July in the Highlands area. We will also do some work on Brighton Boulevard, Shorewood lane due to road break ups. City Days went fine for the public works. We did some sweeping prior to the event and after the event. We helped Jim Fackler with some items at Mound Bay Park. I spoke with the company that does the landscaping and yard repair work for the City. This month they will try to repair the cuts in grass caused by snowplows. They are busy, .due to the late spring. These should be done soon. In June we hauled some water main break fill and sweepings out of the Minnetrista stock pile to various locations in Minnetrista for people that are requesting fill. We are still trying to find more places to relocate this excess fill. Hopefully, durin~ rain days we will b~ able to get more out to make room for the water main breaks for this year. WATER DEPARTMENT The water meters are going well, readings are down to 4 or 4 and one half days at the most. We struck a deal with Schlumberger regarding a payment for some of the defective registers that we received during the change out program. It has been working well, they have done a very good job for us. There was a tremendous amount of locates for June from Gopher One Call, for different utilities for new construction. We have some problems with a few contractors regarding erosion control on their new construction sites. Jon Sutherland and myself have come up with a few ways of dealing with these contractors to get them to comply with our erosion control efforts. Hopefully, we will not have these problems in the future. SEWER DEPARTMENT There was one line backup that had to be routed out. It did not back up into any houses. The line was cleaned out. The crew has been out with the Jet Vac doing sewer line maintenance and cleaning sewers. There was a problem with the boom not rotating right or left. We had it fixed. We look forward to cleaning many sewer lines this summer. Lift stations are working fine. A few seals have been replaced in the pumps. One pump's seal went out too soon after installation. In looking into the pump, there was no oil, we believe it came this way from the factory. We will be working with Tri-State on this. I attended the AWWA conference in Toronto this month. I spoke with the owner of a company that we have our auto dialers with while I was there. The company is replacing 11-12 dialers that we are having problems with. He assured me they were working to correct the problem. They will help us get back on line and eliminate these problems. The beaches are all open and the summer parks programs are going well. We have been seeing a flock of around seventy five geese at Mound Bay Park. This again is creating a problem with keeping' the beach clean. Hopefully with the warmer weather people will be in the park at an earlier hour which keeps the geese away. With the lake level remaining high the Milfoil has not been as much of a problem, but I am seeing more erosion on the shore line from wave action. The four new water fountains were installed at Three Points, Swenson, Philbrook and Mound Bay Parks. DOCKS The dock inspector has been very busy making rounds to all the dock sites. Site holders have until June 1st to complete the installation of their dock. Notices are being sent out for noncompliance. TREES Three trees were removed from City property and one tree was marked as a hazard on private land. Weed notices are being handled by CSO's which can get faster compliance because they can write a citation. CEMETERY One of the trees taken down by the City was a very old hard Maple in the old "A" division. As part of the budget process, each department head prepares a line item by line item proposed budget. Finance made available to them budget sheets that include updated actual expenditures for 1995. We are assisting department heads through the process as needed. Property Tax Reform Who in St. Paul isn't talking about property tax reform? I attended a meeting at the League of Cities on the topic in preparation for next year's legislative session. Our lobbyists at the League are very concerned with this issue which affects the basic financing of cities. State Representative Ann Rest's property tax reform proposal was one of the main discussion items. Her pro- posal breaks the property tax into two separate taxes: * A local services tax for city, county, and special district expenses; and * A state education tax. Each tax would have a separate defined tax base. State aid still would be paid to local governments. The main concern raised so far on Representative Rest's proposal is the lack of details. There is a wealth of material relavent to the LMCD mission that is readily available on the net. This will also improve our ability to administer the District, and to archive records, which has been seriously lacking, 1.2 The draft 1997 budget was sent to the cities, There was very little comment. I am assuming that you have reviewed the budget and are in general agreement with it. 2.0 Exotic Species Task Force. 2.1 The boat washing program continues to struggle. Since voluntary participation seems to not work, some more stringent rules may have to be adopted for next year. 2.2 The harvesting commenced June 19, thus far 87 acres have been harvested, mostly in Grays, St Alban's and Gideon's Bays. 3.0 Water Structures 3,1 A simplified rule for High Water condition on the lake was adopted. It provides for a cushion each way before declaring a change. 3.2 Thc second reading ora code revision that would more clearly prohibit the storage of boats within boats on the lake was approved. This was occasioncd by the Bil Hawks boathouse structure on Halsted's Bay. we are Iikcy to hear more of this, perhaps thru the courts. 3.3 Minnetonka Beach has 22 fire lanes that they are presently using for city docks. These sites for the most part, have docks constructed with zero side setbacks to abutting neighbors. This has been challenged by a resident constructing a very large house next to a fire lane. Nothing in writing authorizes such a dock configuration. The potential impact on the city is large. 4.0 Lake Use. 4. Staff supports the vacation of Churchill Road provided that Parcels 141 and 147 (Lots 12 and 22) are combined. The Building Official confirmed that the owner of Parcels 141 and 147 has submitted a request to combine those parcels and it has been sent to the County. Chair Michael noted that at the last meeting the hearing was opened and closed, but the item was tabled for further discussion. Chair Michael asked if there was anyone present who wanted to speak on the issue. Applicant, Mike McDonald, reviewed with the Council that he has discussed this issue with his neighbors and have had not negative responses, other than his one neighbor to the south expressed a concern that if the remaining portion of Churchill is improved, they do not want to be assessed. Chair Michael closed the public hearing. The Building Official added that staff also recommends approval of the variance to allow the decks on the property. Also, approval should be made pending approval of the combination by Hennepin County. The Building Official reviewed the variance is for a deck located on the north side of the dwelling that has a zero setback. MOTION made by Weiland, seconded by Reifschneider to recommend approval of the street vacation and variance as recommended by staff. Planning Commission Minutes June 24, 1996 It was questioned when and how this dwelling was built in this location. The owner thinks the house was built in the mid-thirties. Weiland stated reviewed the history of the house and how it was once a garage and it was slowly added onto. Motion carried unanimously. This case will be heard by the City Council on June 25, 1996. CASE 96-34: VARIANCE FOR SHED, GAYLEN & WANYCE THOSTENSON, 502'~ BARTLETT BLVD., LOT 6, BLOCK 3, JOHNS S. CARLSON, PID 24-117-24 12 0007 The applicant is seeking a variance to allow construction of a 10' x 10' portable storage building that will be nonconforming to the north front yard setback. This property fronts on three streets, Bartlett to the south, Avon to the east, and Bayport to the north. Bayport Road is unimproved and it is unlikely it will be improved in the near future. City Code requires, for detached accessory buildings, a setback of 20 feet to the north. The shed is proposed to be placed 4 feet from the north property line, and 6 feet from the west property line. The shed will be portable and could be moved in the future, if needed, and there is a minimal impact at this time. Staff recommended the Planning Commission recommend approval of the front yard setback to allow construction of a portable 10' x 10' storage building, with a condition that if the street is improved the shed must be relocated to a conforming location. Weiland explained what the property looks like and he feels there is no need for Bayport to ever be improved. He also commented that the shed will not restrict usage of the fire hydrant. Reifschneider stated that the shed will look best in the location which is proposed. Motion made by Voss, seconded by Weiland to recommend approval of the variance as recommended by staff. Motion carried unanimously. The applicant, Gaylen Thostenson, requested his case to be heard by the City Council on June 25th. VARIANCE STREAMLINING: DISCUSS AND SET PUBLIC HEARINR The Planning Commission has no further comments on the issue or the proposed ordinance amendment. The hearing has been set for July 8, 1996. Planning Commission Minutes June 24, 1996 DOWNTOWN PLAN Clapsaddle asked if the Commission is interested in being more deeply involved with the downtown redevelopment. It is his opinion that they should have been more directly involved. Weiland recalled that they were told the Commission would be involved. Clapsaddle commented that nobody knows what kind of businesses they want to bring in, and he has other questions about the plan such as how they plan to acquire and assemble the land, zoning issues, how do they know what land they want to acquire, etc. Voss indicated that he is in favor of the plan. Clapsaddle expressed a concern that the plan has been changed since they last reviewed it, and noted that the street have been changed, in that Auditor's Road was suppose to be a main artery, but now is shown as a side street. The Secretary noted that Bruce Chamberlain is planning on coming to the second Planning Commission meeting in July to review the plan. Clapsaddle stated that he would also like Paul Meisel and some others directly involved in the plan. He would also prefer the meeting to be more of a work session, opposed to an informational session. Clapsaddle requested the Commission receive the most current copy of the plan prior to the meeting. This included nine new dwellings (none of which were at Pelican Point). This results in 20 new dwellings year-to-date, and last year at this point we had ten. Of the nine new dwellings, four will be built on lots where existing houses are to be demolished. This trend of demolition and rebuilding continues to improve our housing stock, it also results in improving the location of the structures on the lots with regards to setbacks. June was a banner month for our department. The monthly and year-to-date construction activity is record setting, nearly twice that of last years record breaker. A large portion of this month's construction value is also attributed to the addition at St. John's Church and a remodeling project at the Mound Medical building. In addition to our construction activity we worked on a proposal to provide inspection services to St. Boni which, to our disappointment, did not materialize. We also received a number of rental and zoning complaints that are in progress. We issued 28 plumbing, mechanical, and miscellanous permits for a total of 88 permits this month, and 343 year-to-date. PLANNING & ZONING The Planning Commission reviewed eight zoning cases in May including four variances, two minor subdivisions, one conditional use permit and one street vacation request which was continued from May. A public hearing for a proposed zoning ordinance amendment for streamlining variances was set for July 8, 1996. I forwarded a copy of this motion and related minutes to Greg Nybeck, Administrative Technician for the LMCD (Lake Minnetonka Conservation District), and have attached a copy of his letter written in response to the Council's concerns, see Exhibit #7. From records at City Hall I was able to collect a limited history on the number of dock sites and boat counts that were used when calculating the LMCD Commercial Dock License for the City of Mound from 1978 to present. As you will note on the attached Exhibit #1, from 1978 to 1981 the dock site count was 380. In 1982 there was an increase of 20 sites to 400. In 1988 the LMCD's method for calculating the license fee changed from counting dock site locations to counting boats. As shown on the bottom of the first page of Exhibit #2, the LMCD application form, boats are the same as Boat Storage Units (BSU's) and are computed, according the formula, into Water Storage Units (WSU's) to determine our annual fee. As you can see, by using this formula, Mound's fee can vary from year to year while the actual site locations remain consistent. The WSU's have varied by as many as 192 when comparing high and low counts, and BSU's have varied by 120. printed on recycled paper LMCD Memorandum July 9, 1996 Page 2 The BSU's that are allowed for the City of Mound's LMCD Commercial Dock License are based on the total lineal footage of the non-contiguous shoreline owned by the City that is above the DNR's ordinary high water elevation (OHW) of 929.4. The total lineal footage is divided by 50 lineal feet (one BSU = 50 ln. ft.) to determine the number of BSU's allowed for the City. In looking at how the City of Mound had represented its claimed shoreline in the past for a commercial license, I found four basic dock location maps that were used in the calculation. 1974 to 1976 the map did not reference lineal footage, see Exhibit//3. The dock site numbers on the map were random and the lineal footage is unknown. 1977 to 1982, Exhibit #4, was the first map that applied lineal footage to identify each dock site location. This map started the measurement of lineal footage at Avocet Lane on Three Points (West Arm Bay), and continued around the shoreline ending on Bay Ridge Road on Halsteads Bay. The total lineal footage noted was 70,050. In checking with the City Engineer on who prepared these maps, he said the information for the lineal footage was probably collected by City staff using a combination of surveys and half sections maps. 1982 to 1995, Exhibit #5, is a continuation of the 1977-82 map format, but it was visually enhanced by the engineering firm of McCombs Frank Roos and Associates. This map still used lineal footage, but shows a reduction in the total lineal feet of 8,735 to a total of 61,315. I am not aware of any history as to why this was changed, and what areas were affected. 1983 to present, Exhibit #6. The current dock location map shows nine revision dates, beginning in 1982, but still maintains the total lineal footage of 61,315. It has always been understood by staff that the dock program utilizes approximately 4-1/2 miles of shoreline which is a portion of the total 6 miles of noncontiguous shoreline under the City's control. In comparing 6 miles of claimed shoreline, or 31,680 lineal feet, this does not balance with the dock location map which shows 61,315 lineal feet. Yet when using the LMCD's requirement of one BSU per 50 lineal feet, 31,680 lineal feet would allow for 633.6 BSU's. As you can see from Exhibit #1, the number of BSU's has not exceeded the number allowed by the LMCD. LMCD Memorandum ,hdy 9, 1996 Page 3 Because there is an understandable question as to what is the correct lineal footage of non- contiguous City owned shoreline, the current dock location map can be updated and the amount of lineal footage clarified by one of two ways: Staff could make use of current records based on half section maps and the use of surveys that are currently on hand. This would give only a close approximation of the lineal footage. A Registered Land Surveyor could be contracted, which would cost about $20,000 to survey portions of the claimed shoreline in need of clarification while utilizing surveys already on file and half section maps. The results of an in-depth survey raises two scenarios: If it is found that the City is exceeding the allowable number of BSU's, then the City must reduce the count. This can only be done by removing boats. A method would have to be determined on how to reduce the BSU's. With 447 dock sites, the number of BSU's would have to be strictly controlled by the City and a policy or ordinance established to direct staff on how to issue maximum BSU's between the sites. This will put strict limitation on a dock site holders ability to change the number of boats at their dock site. If it is found the City has enough BSU's, we can continue on with a more up-to-date dock location map and accurate limits on BSU's that the dock program can accommodate. Only if the BSU's are nearing the maximum allowed by the LMCD is there a need for a policy or ordinance to be established to direct staff on how to control the issuing of BSU's per dock site. A LMCD representative will be present at the July 9th Council meeting. As previously outlined in the memo of 6/5/96, the maximum number of Boat Storage Units (BSU's) allowed in the City of Mound multiple dock license is directly related to accumulative shoreline. LMCD Code Section 2.02, Subd. 1 "allows for the storage of one watercraft for each 50 feet of continuous shoreline." The Code allows Mound to place BSU's in a specific location with a density greater than 1:50, provided, the total number of BSU's for the cities multiple dock license does not ex~eed one watercraft for every 50 feet of shoreline. LMCD staff does not have the ability to accurately determine the amount of accumulative shoreline in Mound dedicated for your multiple dock license. The records we have on file will be consistent with yours at the City of Mound. If your City Council determines there is a need for an updated shoreline count dedicated for your multiple dock license, you may want to recommend a survey be done. A representative from the LMCD will be available' at your 7/9/96 City Council to answer any questions the City Council may have. LMCD Code Section 2.02, Subd. i "allows for the storage of one restricted watercraft for each 50 feet of continuous shoreline.- In the calculation of shoreline for LMCD cities with a multiple dock license, LMCD Code allows these cities to accumulate total shoreline despite the shoreline may not be continuous. The Code also allows the cities to place Boat Storage Units (BSU's) in a specific location with a density greater than 1:50 provided the total number of BSU's for the city multiple dock license does not exceed one restricted watercraft for every 50 feet of shoreline. With regards to the docks to be placed on Longford Road, this would be allowed provided that all aspects of LMCD Code are complied with. In 1997 when your renewal application for your multiple dock license is submitted, an adjustment in BSU's will need to properly note t~e increase on Longford Road.
