Those present were: Mayor Bob Polston, Councilmembers Andrea Ahrens, Mark Hanus, Liz Jensen and Leah Weycker. Also in attendance were: City Manager Edward J. Councilmember Hanus suggested that the third Whereas in the resolution be amended as follows because it is contradictory to the fifth Whereas. Councilrnember Ahrens suggested that #2 in the NOW, THEREFORE, BE IT RESOLVED, be changed as follows: 2 Mound City Council Minutes - June 24, 1997 2. "The applicant will remove the currently existing nonconforming shed to ;.ncrcase decrease the impervious cover." The Council agreed. The City Planner stated these changes are consistent with the intent of the resolution. Motion carried. 1.6 FRONT YARD VARIANCE REQUEST AND RESOLUTION MODIFICATION CALIBER BUILDERS, FRED JOHNSON, 5100 DRUMMOND ROAD, TEAL POINTE~ LOT 3, BLOCK 1, PID//25-117-24 12 0233. The Building Official explained that this item was referred back to the Planning Commission at the May 27th Council Meeting. This was done to provide the public with an opportunity for input. Neighbors within 350 feet were notified, similar to the public hearing process. He reported that a few people attended the Planning Commission Meeting and their comments are in the June 9th Planning Commission Meeting Minutes. They spoke in opposition to the staff recommendation. The Planning Commission voted 3-2 in favor of the staff recommendation for approval. Hanus moved and Weycker seconded the following resolution: RESOLUTION 97-61 RESOLUTION AMENDING RESOLUTION //95-13 MODIFYING ITEM//16 FOR PARCELS 1, 2, 3, BLOCK 1, TEAL POINTE, AND TO APPROVE A 10 FOOT FRONT YARD SETBACK FOR LOT 3 ONLY The voted was unanimously in favor. Motion carried. COMMENTS AND SUGGESTIONS FROM CITIZENS PRESENT. There were none. Mound City Council Minutes - June 24, 1997 1.7 RECOMMENDATION FROM PARK AND OPEN SPACE COMMISSION RE: REQUEST TO SELL CONCESSIONS AT MOUND BAY PARK DEPOT, WESTONKA HELPING YOUTH (WHY) The City Manager explained that the Westonka Helping Youth Group (WHY) has asked for permission to sell concessions (candy, pop, and ice cream) at the Mound Bay Park Depot on Wednesdays, starting July 23 through August 20, from noon to 8:00 P.M. This would be done by children and young adults in the community. He explained that he and the staff feel that there needs to be adult supervision at all times when the concession area is open. He stated that Wendy Goldring, from the Community Education Department of the school has assured the City that there will be adults present during these times. This is a new program and the City has never been approached for something like this. The Park Commission recommended approval of the request with all fees waived and the net proceeds from the sales of concessions to be distributed to a charitable purpose. The Council discussed the request. They voiced concerns about the following: Clean-up of the area during and after the concession stand is open. Having an adult to supervise at all times. Paying the young adults who work a stipend versus giving whatever they make from the sales toward a park improvement or charitable cause. Not having some organized activity for these young people. No damage deposit. The Council asked that the City Attorney prepare a document that the Council can feel comfortable with that would give some guidelines to allow this to happen. This to be brought back at the next Council Meeting. No action was taken on this item. 1.8 DISCUSSION: PROPOSED ORDINANCE AMENDING SECTION 235:27, SUBD. 1 OF THE CITY CODE RELATING TO RECREATIONAL FIRES. The City Manager explained that this was before the Council a few meetings ago and the Council asked for more information. This ordinance amendment would address a problem that was identified by both the Fire Chief and Police Chief regarding recreational fires. The Fire Chief has put together a list of calls that they have had since 1995 that relate to recreational and illegal burning. The Fire Chief explained that they are trying to define recreational fires because there have been so many calls on this type of fire. He further explained that a lot of these fires are too big or not handled in a safe manner to be recreational fires. The Fire Dept. is not against recreational fires. There needs to be a definition of recreational fires so that they can control the situation. A definition needs to be adopted so there is a difference between a recreational fire and folks that are burning whatever, i.e. building materials, leaves, branches, etc. The Fire Chief stated he needs clarification on the following: 1. Size of the fire. ,XS:o 4 Mound City Council Minutes - June 24, 1997 Type of combustible used for a recreational fire. Location. Where it can take place. Distance from buildings. Times when recreational fires are allowed. What is a recreational fire. The Fire Chief explained that they do issue permits for other than recreational fires. The Council discussed the proposed amendment. Councilmember Hanus suggested measuring the height of the combustibles rather than the height of the flames. He did not like the time restriction. Para Amidon, 1909 Lakeside Lane, spoke in favor of the proposed ordinance amendment. Jim O'Hearn, 1786 Shorewood Lane, spoke in favor of allowing recreational fires. The Council referred the proposed ordinance amendment to the City Attorney, to be brought back to the next Council Meeting. No action was taken. 1.9 PROPOSED AGREEMENT WITH THE MINNEHAHA CREEK WATERSHED DISTRICT (MCWD) REGARDING "RULE B" ISSUES. The City Manager explained that following the Committee of the Whole Meeting and a meeting with the MCWD, the City Attorney has been working with the attorney for the Watershed District and a draft agreement is now ready. The Board of Managers of the MCWD has not yet seen the draft. The City Attorney distributed a marked up copy of the agreement with the changes highlighted. It is in the form of the document discussed at the last Council Meeting. He reviewed the draft with the Council citing the following: Page 1. It makes clear that this agreement relates to the downtown redevelopment area only. It is a cooperative agreement for ponding for water originating from drainage in the downtown area and our obligations begin and end with methods for handling that particular type drainage. There will be an attachment prepared which delineates the area of the watershed for the downtown area. Page 2. Limiting our obligations to issues of drainage relating to the downtown area. Page 3. Shifted the burden of maintaining the pond from the City to the Watershed District. At the meeting, the MCWD indicated a willingness to do this. Then when we agreed, they back peddled a little. They were suggesting at one point in the meeting that maybe we could work out a deal where they could pay the City to assist them in the maintenance. Therefore, the City Attorney added a sentence to 2.1.3. as follows: "Nothing in this Agreement shall preclude the MCWD and City from entering into an agency agreement whereby some or all of the MCWD's maintenance activities are to be undertaken by the City or others." Mound Ci~ Council Minutes - June 24, 1997 At the bottom of Page 3 he added a clause to the beginning of the last sentence of 2.2.1 that was deleted inadvertently, as follows: "unless it shall determine otherwise". Page 4. This just says that we have no responsibility for the expenditure of funds necessary for the acquisition of ponding areas which are required for receiving waters from areas outside the downtown area unless we determine otherwise. In other words, we are creating an opportunity or option on the part of the City if it were to choose to do so, to, in the future, acquire additional areas and expend funds for that purpose to provide for ponding to receive water from areas outside the downtown area. But, it would be absolutely the City's option and at the City's discretion and we could not be required by any other entity to do that if we chose not to do it. References the downtown area. Page 6. One of the concerns previously was that the first draft of this agreement was very short and the watershed district would probably not be able to complete all of its obligations of building ponds, etc. We are proposing the Agreement last until December 31, 2007. This could be controversial. We've said that developers, owners of land, who are availing themselves of Rule B are required to pay for the cost of acquisition of land, the cost of construction of ponds, and the cost of maintenance. If we have to pay for the acquisition of lands to cover the entire downtown area, then we should be freed of any further obligation to pay for construction or maintenance of those ponds, that are built as a result of the land that we have acquired for that purpose. We spent our money buying the land. Those are the changes that have been made to the draft. The Mayor, who is Mound's representative on the Watershed District's Stormwater Task Force updated the Council. The Task Force is comprised of 13 communities and agencies and it has been charged with the responsibility of addressing, specifically Rule B, and trying to get agreement among all the participating members of the Watershed District as to whether or not Rule B is workable. They will hold their first meeting in August and he will keep the Council posted on any changes in Rule B. The Mayor asked the City Engineer if we need to move forward with the draft agreement if things may change after the Task Force gives their recommendations. The City Engineer stated that if we get agreement with Hennepin County, we could possibly start construction on Auditor's Road yet this year which would mean we would need the Watershed Permit. The Mayor stated that from what he heard today, there will be changes in Rule B. The City Attorney stated that we could put some provisions in the draft agreement that if there are modifications, changes, or anything else happens to Rule B, that this agreement would be modified to reflect those changes. The Council agreed that should be put into the agreement. Mound CiO, Council Minutes - June 24, 1997 Ahrens moved and Jensen seconded the following resolution: RESOLUTION//97-62 RESOLUTION TO APPROVE THE PROPOSED AGREEMENT WITH THE MINNEHAHA CREEK WATERSHED DISTRICT (MCWD) Motion carried. 1.10 PRESENTATION OF CERTIFICATE OF RECOGNITION TO MOUND WESTONKA GIRLS The vote was unanimously in favor. SOFTBALL TEAM. The City Council presented a Certificate of Recognition to the Mound Westonka Girls Softball Team for winning the State Championship. 1.11 RESOLUTION REQUESTING MINNESOTA DEPARTMENT OF TRANSPORTATION (MNDOT), MUNICIPAL STATE AID (MSA) OFFICE, TO ADVANCE $500,000 IN FUTURE ALLOTMENTS OF MSA FUNDS FOR AUDITOR'S ROAD IMPROVEMENT PROJECT. The City Manager explained that the City Engineer has advised us that the City's MSA Construction Fund balance is not sufficient to construct the proposed Auditor's Road hnprovement Project. He is therefore recommending that the City request an advance from the MSA General Fund future allotments in the amount of $500,000.00. Polston moved and Ahrens seconded the following resolution: RESOLUTION #97-63 RESOLUTION REQUESTING MINNESOTA DEPARTMENT OF TRANSPORTATION (MNDOT), MUNICIPAL STATE AID (MSA) OFFICE, TO ADVANCE $500,000 IN FUTURE ALLOTMENTS OF MSA FUNDS FOR AUDITOR'S ROAD IMPROVEMENT PROJECT The vote was unanimously in favor. Motion carried. 1.12 DISCUSSION: PROPOSED IMPROVEMENTS TO SHERWOOD DRIVE/BIDS RECEIVED. The City Manager explained that the City received only 2 bids for the Sherwood Drive Reconstruction. Alber Asphalt $39,976.00 Buffalo Bituminous $32,777.50 Both were over the engineer's estimated construction cost of $29,275.00. The City Engineer felt the reasons for the higher bids are: 1. the time of year; 2. the size of the project; and 3. the work load of the contractors. MoutM City Council Minutes - June 24, 1997 The Council asked that new notices be sent to the residents advising them of the bids and notifying them of the new proposed assessments. The time of the weigh in will be 2:30 p.m. until approximately 4:00 p.m. We would need to set our weigh station pdor to the 2:30 time. This would entail the use of the park at the launch end and the use of shoreline for the boats while they are weighing their fish. This is a Operation Bass Red Man event. At the Dock and Commons Commission meeting on June 19, 1997 the Commission requested that I write you a letter in an attempt to resolve the situation with the dilapidated stairway on the Commons that serves your dock site. The Staff recommendation for your site is to remove the old stairs and to issue a 5 year permit to allow a new stairway to be constructed. In addition, staff would not issue a dock permit until the new stairway is installed, inspected and approved by the Building Official. You are not required to have a stairway at any time unless you decide to utilize the dock site. The old stairway is in such poor condition that we are seeking your cooperation in the removal of the stairway. If you are not willing to remove the stairway yourself staff, will recommend to the Council that they direct staff to take care of the removal. In some cases, the cost of removal of private encroachments on the Commons has been assessed to the abutting owner. Special permits are required for private encroachments located on public lands as specified in City Code Section 320. Please find attached "Batch #10", this is a listing of dock sites that have private encroachments such as stairways, lights, or some other type of encroachment, located on public lands. CITY OF MOUND DOCK & COMMONS ADVISORY COMMISSION THURSDAY, JUNE 19, 1997 - 7:30 P.M. Members present: Mayor Bob Polston, Mark Goldberg, Frank Ahrens, Jim Funk, Dennis Hopkins, and Gordy Tulberg. H. Empson. APPROVAL OF MAY 8, 1997 DCAC MINUTES Motion by Ahrens, seconded by Tulberg to approve the minutes of the May 8, 1997 DCAC Meeting as written. Motion carried unanimously. AGENDA CHANGES Steve Sexton was present to talk about Avalon multiple docks. He proposed this be discussed at the beginning of the agenda. Faclder stated Mr. Sexton has approached the City to permit a multiple slip dock at this location. He stated it is a tight area. He suggested it would be a very good location. If approved, individuals in the area must be notified and a meeting held. He stated it could be purchased this year and installed this year under the current budget. Seven boats are surrently at five dock sites. Goldberg asked if any individual has more than one boat. Sexton noted one individual has two, and the person sharing the dock has one. He believed another individual has two boats as well. Fac'kler stated the LMCD and setbacks could be a concern. Setbacks in this area would most likely be doubled from 10' to 20'. It was noted with 20', you would most likely lose two docks. Goldberg asked how many non-abutting dock holders were talked to. It was noted three were talked to. Dennis Hopkins arrived at 7:38 p.m. It was noted that currently one user cannot use one half of his dock because of the space available. Polston stated the problem will be those with more than one boat. It was noted there aren't any docks with more than two boats. Goldberg stated it would be possible to have a multiple dock and two individual ones. Fackler stated staff could be instructed to review the location and draw up a plan. Ahrens stated the setback requirements the LMCD requires must be met. If dock sites will be eliminated, then they should be. Motion by Polston, seconded by Ahrens to prepare Findings of Fact to look at developing a mnltiple dock at Avalon Park. Motion carried unanimously. II. Empson 4925 Island View Drive I have made phone contact with Mr. Empson and discussed the staff recommendation and the Dock and Commons Commission comments. Mr Empson has no objection and agrees with the staff recommendation to issue a five year permit for a new stair with the conditions as stated in the staff report. Mr Empson was very pleasant and cooperative and will be happy to remove of and dispose of the old stair. There hasn't been a dock there for a number of years. Polston stated he would be in favor of sending him a certified letter stating the dock will be removed. Fackler asked who would pay for removal. Sutherland stated the Council has authorized removal in the past. Polston stated Epson would be asked for his input. Hopkins asked if the dock space could be available to another person. It was noted it is Class C and would not be available to another person. Polston stated he should also be given the option of bringing the dock up to code. Ahrens asked if anyone else can access the stairs. It was noted they could but not legally. Sutherland suggested a letter be drafted for Council review. Motion by Goldberg, seconded by Tulberg to direct staff to draft a letter to Mr. Empson for Council review. Motion carried unanimously. Ahrens asked who would pay for removal of the stairs. It was noted the City would pay for it. Sutherland stated it is a minor item to remove, and it is up to the City Council to authorize assessing it back to the homeowner. Fackler discussed staff removal and problems with disposal. Polston stated if it is a safety hazard, it must be removed. Sutherland continued discussion of the public land permit report. Polston asked if the Sprague site is accessible to the public. Sutherland stated it is not. He believed the owner was willing to work with staff to correct the problem. He suggested a landing be constructed between the two sets of stairs and mount the lower stairway and making it moveable. He stated compliance must be met by next spring, or a dock permit will not be issued. Polston suggested correspondence also be sent to Mr. Sprague giving him the opportunity to correct the situation and respond to proper notice. Ahrens stated he would prefer Sutherland report back to this commission if no progress is made and then a letter be sent. Goldberg suggested a letter and a follow-up phone call. Sutherland suggested Sprague be given 30 days after Council direction. If no work progresses, he will report back to the DCAC. Commissioners discussed how Sprague should be contacted. Commissioners concurred Sprague should be contacted and given 30 days following Council authorization. Motion by Tulberg, seconded by Goldberg to contact Sprague following Council authorization and give him 30 days to comply. Motion carried unanimously. Sutherland reviewed the Capron site. He has a problem removing the pump, because it is very heavy. It has never been used, and Capron needs help removing the pump. Ahrens asked if that is something staff can help with. Fackler stated he is concerned about the removal and cost and time constraints. Polston believed any time the City can help, they City of Mound Dock & Commons Advisory Commission June 19, 1997 Page 5 should in order to bring it into compliance. Sutherland didn't believe it weighed more than 100 pounds. He, too, was concerned about having staff do the work because of time constraints. Sutherland suggested looking at it again and made a recommendation. Ahrens asked why it has to be removed. Sutherland stated the pump can remain, but it needs to be brought up to the electrical code. Sutherland stated staff will look at it prior to Council review. Sutherland noted the Capron stairway needs minor repairs, and he will make them. Sutherland continued review of the report. He noted Mrs. Norstrem is present tonight. He stated the flagpole is not on the Commons or is the deck portion. The state electrical inspector must be contacted regarding whether the lighting can be plugged in. He recommended approval. Motion by Funk, seconded by Tulberg to recommend approval of the Norstrem site. Motion carried unanimously. Ahrens asked if there is anyone in the batch that has not agreed to make these changes as recommended. Sutherland replied there is not. There is, however, some resistance, but property owners are willing to work with staff. Motion by Tulberg, seconded by Ahrens to recommend approval of the public land permits, Batch #10. Motion carried unanimously. 1998 DOCK FEES Commissioners reviewed the 1997 dock fee schedule. Fackler noted there is approximately $171,000 in the fund balance. He asked what amount should be in there for a year of operation. The amount remaining will provide for repairs to multiple docks. Motion by Polston, seconded by Tulberg to accept the Park Director's recommendation for dock fees. Motion carried unanimously. Ahrens asked if there is a list of commercial docks in Mound. Commercial docks were identified which includes homeowners associations. Ahrens asked if they are regulated because of LMCD requirements. Fackler stated if they have more than four docks, they must be licensed through the LMCD. The dock inspector noted if it is a not-for-profit organization, the City does not charge a fee, but the LMCD does. Ahrens was concerned commercial dock fees are less than those charged for leaseholders at the Commons. Commissioners reviewed fund balances and discussed line items in the budget. Fackler noted the LMCD fee will be increased and a fixed number set at 590. Commissioners discussed how the 590 was calculated. City of Mound Dock & Commons Advisory Commission June 19, 1997 Page 6 Goldberg discussed the need to determine how much of a fund balance is needed. Polston suggested rip rapping or dredging be done with the extra funds. Ahrens believed more could also be done with the multiple docks and suggested areas where improvements could be made. Goldberg asked if additional dock sections could be purchased. Fackler noted it is already in the budget. Commissioners discussed docks at Devon. Polston suggested public meetings be held to determine if there is acceptance from the neighborhood. Motion by Goldberg, seconded by Ahrens to plan a meeting with the Devon area residents in September to pursue a multiple dock for next year. Motion carried unanimously. ENCROACHMENT ATTACHMENT TO PROPERTY A. City Attorney Opinion, March 28, 1996 Commissioners reviewed the city attorney's opinion relating to encroachment attachment to property. Goldberg summarized it by stating if we are moving into the direction that abutters will be allowed to keep and maintain structures in encroachments, the City would not have any recourse. If the structure is abandoned, the City would be responsible. The structure could be bonded, or the abutting property owner could be assessed. The attorney states there is a liability issue. Permits could be of limited duration. He noted a sub-group has been meeting to discuss the encroachment issue, and more information available at a future meeting. Ahrens noted staff was asked for additional input. Polston asked if there is a time frame set for presentation of a draft to the City Council. Goldberg stated a recommendation is proposed at the meeting in August. Polston suggested the agenda be kept light, because it should be a public meeting. He also suggested the City Attorney also be in attendance. SHARED DOCK SITES Fackler reviewed information provided. Goldberg stated there is some confusion because of the two kinds of share situations. Tulberg suggested using the new ordinance and forget the old one. Fackler stated there is a need for both. Polston suggested a separate color of paper be used which discussed shared dock sites. Tulberg will provide information on the shared dock application and notification at the July meeting. City of Mound Dock & Commons Advisory Commission June 19, 1997 Page 7 Commissioners discussed dock rental. Moving from one to another will be allowed except for city-sponsored multiple docks. Motion by Ahrens, seconded by Hopkins to recommend approval of the proposed ordinance changes. Motion carried unanimously. CAPITAL OUTLAY 1998 Memo from Park Director Fackler reviewed 19@$ capital outlay to provide additional multiple docks and related costs to install and remove. Lighting is also included. Polston suggested some monies be incorporated to have access to funding to provide services (removal of items). Fackler stated he has $1,000 budgeted in the parks budgeted at the current time. Polston believed specific money needs to be budgeted in in the docks budget. Commissioners concurred money should be set aside for removal services. Motion by Polston, seconded by Ahrens to recommend staff develop a line item for public land permits, contractual services to cover assisting people using the program for special needs on the Commons ($5,000). Motion carried unanimously. Ahrens believed lighting would be needed on docks. Motion by Hopkins, seconded by Tulberg to recommend approval of the 1998 capital outlay program. Motion carried unanimously. FISHING DOCKS Hopkins stated there should be some money put aside for a fishing dock program. Goldberg liked the idea if it is done in such a way to benefit residents of a general neighborhood. Polston stated it may generate the need for additional parking. He asked if the Commission would be interested in looking at a pilot program with one neighborhood and limit the size of the pier to facilitate the neighborhood. He noted there will be an area at Lost Lake for a fishing pier. Hopkins was concerned the Commons areas are not marked, and no one knows where they can go fishing. Polston was not opposed to the fishing pier suggestion but was concerned about areas becoming congested with parking. i, ,j ,,j,., j ,,. ,, City of Mound Dock & Commons Advisory Commission June 19, 1997 Page 8 Commissioners discussed possible sites. Funk asked if the City would be obliged to provide parking if it is installed and designated as a neighborhood fishing pier. Polston suggested having staff look into the possibility of providing a dock in a neighborhood 'that will not generate additional traffic. A public meeting could be held with the neighborhood. Fackler stated the use plan identifies shore fishing throughout the city. It needs to be publicized more. Ahrens stated he would not be in favor of any program where fishing areas in neighborhoods are advertised. He didn't think fishing, swimming and boating mix well. Ahrens suggested looking at what other communities are doing. Hopkins stated he could do that. Ahrens believed a fishing pier would be more appropriate in a park setting. Funk suggested staff look into what would need to be done to manage the area and provide for parking, for example. Fackler stated a specific site would need to be looked at before those questions could be answered. Commissioners discussed dredging areas overgrown with weeds. Goldberg suggested continuing discussion to the July meeting. DOCK CONSTRUCTION, DESIGN & WINTER DOCK STORAGE Continued to July meeting. COUNCIL REQUEST FOR JOINT MEETING WITH ALL COMMISSIONS Commissioners discussed the Council's request for a joint meeting with all commissions. They agreed it was a good idea. FOR YOUR INFORMATION Fackler reviewed estimates to construct stairways. Polston suggested an engineer prepare a sketch to open up for bids to others. Goldberg was in favor of the wood rather than the keystone. Motion by Ahrens, seconded by Funk to direct staff to have plans and specifications developed for bidding to replace stairway. Stairway will be constructed of timber with stairs of a non-skid surface. Motion carried unanimously. The City Manager explained that the City has received 2 bids for the beginning of renovation of The Depot in Mound Bay Park. The renovation will consist of 6 items as follows: Furnish and install bracing for lower level concrete block wall· Furnish and install new concrete wash adjacent to present sidewalk. Furnish and install ten (10) combination (storm and screen) windows, plus one (1) main combination door, plus a pair of combination doors at the north end of the building. Furnish and install a pair of fir or hemlock wood panel or flush doors including new wood frame at north end of building· Add additional colums and structual supports to north end portico roof, plue patch deck, wood trim, plus repair insulation and siding at south end, plus repair railings· The bids received were as follows: 1. David Willette $10,800.00 2. Developers Construction, Inc. $11,500.00 This was budgeted in Revenue Sharing. Willette's bid of $10,800.00 The Staff recommends David Jessen moved and Peterson seconded a motion to approve the bid of David Willette in the amount of $10,800.00 for the renovation of The Depot. The vote was unanimously in favor. Councilmember Polston moved the following resolution, May 2, 1978 RESOLUTION NO. 78-208 RESOLUTION TO CONCUR WITH THE PARK COMMISSION & GRANT MAINTENANCE PERMIT FOR UP TO $ YEARS & RENEWABLE WHEREAS, it is necessary for property owners abutting Commons in the City to obtain Maintenance Permits for any personal property or fix- tures on said Commons, and WHEREAS, owner abutting Devon Commons has requested maintenance permits for storage shed, wall and steps, all existing previously. My inspection confirmed, that corrections to the receptacle and post light on the property had been made, and both the device and the fixture now have ground fault protection. Mr. and Mrs. Mason had the electrical corrections made by the licensed contractor who had originally performed the work in September of 1992. This work was inspected at that time, but a miscommunication on the inspection request cause the oversight and resultant code violation. We received two bids with the low bid from Buffalo Bituminous in the amount of $32,777.50. The next bid was from Alber Asphalt Company in the amount of $39,976.00. The low bid is 11% over the estimated construction cost included in the revised preliminary engineering report submitted in April to the City Council. We believe the high bids can be attributed to a number of factors, of which, the most obvious is that we received only 2 bids. Other reasons could be the time of year, the size of the project, the workload of the contractors or the estimate xvas too low. The City Engineer has stood by the estimate and believes that it was accurate. It also aopears that the engineering, legal, fiscal and administrative costs will also be higher due mainly 'to the fact that an addendum to the original preliminary engineering report was done, soil borings were taken and additional hearings were held which have all added to the cost. The City Council reviewed the bids at the last regular city council meeting and continued the matter until the July 8, 1997 regular meeting to give you an opportunity to participate in the discussion before any bid award is approved. Enclosed is a revised proposed assessment calculation which gives you an idea what your assessments would be using the low bid from Buffalo Bituminous. Other reasons could be the time of year, the size of the project, the work load of the contractors or the estimate was too low, which we do not believe is the case. It appears that the engineering, legal, fiscal and administrative costs will also be higher, due mainly to the fact that an addendum to the original preliminary engineering report was done, soil borings were taken and additional hearings held, which have all added to the cost. For comparison purposes, if the low bid were accepted and the percentage for engineering, legal, fiscal and administrative cost increased to 35% of the construction cost, the total estimated cost of the project would increase to $44,300.00 as compared to $38,400.00 as originally estimated. This would be an increase of just over 15%; therefore, the suggested assessments would also increase by this percentage. The average assessments were originally calculated to be approximately $3,000.00 per lot, whereas this increase would bring the average up to roughly $3,500.00. The largest parcel and thus the largest projected assessment would increase from $4,475.00 to approximately $5,160.00. A couple of options available would be to rebid the project or combine it with another City project such as Auditor's Road. We do not believe that rebidding the project at this time of year would reduce the cost enough to off-set the additional expense. Combining it with Auditor's Road also has drawbacks since there would be even more costs involved to revise the plans to State Aid Standards. At this point, there are no other City projects under consideration to combine it with. The consensus was to have the program continue until June 30, 1998 at which time the program, as we know it today, would cease. You discussed some modifications to the formula and suggested that lease credits or payments be made from the general fund in lieu of charging the non-providers of parking. The only cost to the participants would be the 1/4 of the snowplowing costs. On July 1st, city staff and Councilmember Mark Hanus met with a number of the CBD parking participants. The group was somewhat startled that the City Council would make this decision at this point in time and wondered if the expiration of the existing CBD program could be extended until County Road 15 undergoes its realignment. The participants, particularly the providers of parking, identified a number of issues related to access to the privately held lots which are now leased for public parking. They would prefer to have County Road 15 realigned which will have an impact on what lots the City may acquire for public parking purposes i.e., ramps, etc. We have been told that Hennepin County has now put the realignment of County Road 15 on a more permanent capital improvement program list where before it was on a provisional list. This permanent list still indicates that the improvement is scheduled for the year 2000 at the earliest. By extending the program until County Road 15 is realigned may mean only another 2 years of the program. The CBD participants were unanimous about the lease credits or payments being picked up by the City of Mound and that the only costs that the participants would have would be the 1/4 printed on recycled paper Memo to the Mayor and City Council-CBD Parking July 2, 1997 Page 2 snowplowing. The lease credits and payments total approximately $8,000 so you would be looking at about $24,000 coming out of the city's general fund if the program went out 3 years beyond the 6/30/98 proposed ending date. The City Manager explained that this was before the Council a few meetings ago and the Council asked for more information. This ordinance amendment would address a problem that was identified by both the Fire Chief and Police Chief regarding recreational fires. The Fire Chief has put together a list of calls that they have had since 1995 that relate to recreational and illegal burning. The Fire Chief explained that they are trying to define recreational fires because there have been so many calls on this type of fire. He further explained that a lot of this fires are too big or not handled in a safe manner to be recreational fires. The Fire Dept. is not against recreational fires. There needs to be a definition of recreational fires so that they can control the situation. A definition needs to be adopted so there is a difference between a recreational fire and folks that are burning whatever, i.e. building materials, leaves, branches, etc. The Fire Chief stated he needs clarification on the following: 1. 2. 3. 4. 5. Size of the fire. Type of combustible used for a recreational fire. Location. Where it can take place. Distance from buildings. Times when recreational fires are allowed. What is a recreational fire. The Fire Chief explained that they do issue permits for other than recreational fires. The Council discussed the proposed amendment. Councilmember Hanus suggested measuring the height of the combustibles rather than the height of the flames. He did not like the time restriction. Para Amidon, 1909 Lakeside Lane, spoke in favor of the proposed ordinance amendment. Jim O'Hearn, 1786 Shorewood Lane, spoke in favor of allowing recreational fires. The Council referred the proposed ordinance amendment to the City Attorney, to be brought back to the next Council Meeting. As I understand it, Council had questions as to whether or not such an ordinance is needed. It is my opinion an ordinance is needed to restrict the Open Burning that is taking place frequently in our coverage area. I am submitting a list of calls in the last 2 1/2 years that relate to recreational and illegal burns. These calls are costly to the taxpayers and tend to deteriorate morale of Fire Fighters. I understand that a local law officer (Highway Patrol) suggested to Council Member Hanus, there is no need for such an ordinance. I would like to invite this individual to leave his family or work and respond with the Fire Fighters on these calls. Perhaps seeing the issue first hand would create a better understanding of the situation. We at the Fire Department are not adverse to families enjoying a recreational fire, on their properties. We are concerned about the increase of illegal and potentially dangerous burning that is taking place in our community. Recreational fires shall be at least 25' from any building and shall be supervised at all times. The owner of any property upon which a recreational fire is started or originally ignited, in violation of the provisions of this division shall be responsible therefor and shall be subject to penalties provided in this code, unless such owner can addnce proof that such fire was started by a stranger or trespasser. No permit shall be required for any official fire set by any public official as provided in Section 490:20. Motion carried. 1.7 APPROVAL OF AN ORDINANCE AMENDING SECTION 235:27, SUBD. 1 OF THE CITY CODE RELATING TO RECREATIONAL FIRES 1545 Councilmember Hanus stated that he remembers addressing this about a year ago and what is being presented tonight is basically the same as then. He then asked why it is back? The City Manager explained that the Council did not taken action on this item before. This item has been reviewed by the Fire Dept. and the Police Dept. and now that Spring is hem, they are saying we need to do something about this ordinance because there are all kinds of people lighting fires that are not in compliance with either the existing ordinance or one that they would like to see in place of it. What is being suggested and proposed are changes that were made before but some things were added, i.e. the total area of 3 feet or less in diameter and 3 feet or less in height; the time recreational rims would be allowed; and the distance from any building was originally 20 feet and what is being proposed is 25 feet. This would give more teeth to the Fire Chief and Police Dept. and regulate people's ability to light recreational fires. They are getting a lot of calls about these rims. Councilmember Hanus stated that he was against this last year and is still against this. He has a problem with some of the language in the Exception part of the proposed amendment, i.e. diameter and height restrictions and how that could be a prosecution problem; the time that recreational fires would be allowed. The Council then extensively discussed the proposed ordinance amendment as it relates to the following: 1. 2. 3. 4. what people are burning; the size of the fires; the time limitation for when people can burn; and the distance from any building that a person could have a recreational fire. The City Manager reported that this proposed ordinance amendment was based on other cities in the metro area and how they deal with recreational fires. This amendment has been reviewed by the Police Chief, Fire Chief and Fire Inspector and they all gather their approval or made the changes they felt were necessary. The City Attorney suggested that the wording, "Recreational fires shall be at least 25' from any building and shall be supervised at all times.", could be changed to read as follows: "Recreational fires shall be at least 25' from any building which is intended for human occupancy and shall be supervised at all times." The City Manager explained that the only intent of this ordinance amendment is to regulate recreational fires, open burning is still not going to be allowed. 4 Councilmember Hanus asked that the "not" in the first sentence of the Exception be deleted because he felt it says that a fire place, incinerator or barbecue pit are not a recreational fire, but they are open burning, therefore they do not meet the criteria under either the exception or the open burning which prohibited. The City Attorney stated that he also feels the "not" in the Exception should be deleted. MOTION made by Polston to delete the word "not" from the Exception and the time frames in the proposed amendment. This motion died for lack of a second. MOTION made by Jensen to delete the work "not" from the Exception and revising the following sentence "Recreational fires shall be at least 25' from any building and shall be supervised at all times" to read as follows: "Recreational fires shall be at least 25' from any building intended for human occupancy and shall be supervised at all times." MOTION made by Hanus, seconded by Polston to leave the existing ordinance as is with the deletion of approved (HIS reason was that there is no criteria for approved fire rings.) and the addition of one sentence, as follows: Section 235:27, Subd. 1 of the City Code is amended to read as follows: Section 235:27. Burning Restrictions - Burning Permit Required. Subd. 1. Open Burning Prohibited. It shall be unlawful for any person to start or allow to burn any open fh'e on any property within the City of Mound without a permit, except for supervised recreational or cooking fires contained within approve~ fire rings, pits or barbecue grills. Only charcoal, coal, or clean, dry wood may be used for burning (no refuse. ~,rass. leaves, yard waste or other combustibles). No permit shall be required for any official fire set by any public official as provided in Section 490:20. The Council discussed this motion. MOTION made by Polston, seconded by Weycker to table this item. The vote was 3 in favor Jensen voting nay and Hanus abstaining. Motion carried. The Mayor asked that this item be sent back to Staff to come back with a report on why we are looking at this proposed ordinance amendment and what it is we are trying to accomplish and is it based on one complaint or a hundred complaints. This item will be brought back at the first meeting in June. The Family Service Collaborative is an organized which was organized and operates to provide family service networking assistance in the community. A more detailed explanation of its organization and purpose will be provided to the council in its materials for next Tuesday's meeting, it appears that although the Collaborative is not formally qualified as a charitable organization for tax purposes, its activities are all directly related to the sorts of activities which are generally carried out by formally qualified charitable orga.n_iz:~tions. !n fact, most of its participating organizations are, themselves, qualified charitable organizations. The Collaborative could also be viewed as being a "community civic organization" which in its broadest context includes organizations which are organized for the benefit of the citizens of the community. It would appear on the basis of the information provided that the council could reasonably conclude that the Collaborative is the type of organization which should be entitled to a rental fee waiver under the lease agreement. It also appears that the requirement of a $200 damage deposit is appropriate; and is expected of most organizations which rent the depot. Council Minutes - June 24, 1997 RECOMMENDATION FROM PARK AND OPEN SPACE COMM'ISSION RE: REQUEST TO SELL CONCESSIONS AT MOUND BAY PARK DEPOT, WESTONKA HELPING YOUTH (WHY) The City Manager explained that the Westonka Helping Youth Group (WHY) has asked if they could have permission to sell concessions (candy, pop, and ice cream) at the Mound Bay Park Depot on Wednesdays, starting July 23 through August 20, from noon to 8:00 P.M. This would be done by children and young adults in the community. He explained that he and the staff feel that there needs to be adult supervision at all tirnes when the concession area is open. He stated that Wendy Goldring, from the Community Education Department of the school has assured the City that there will be adults present during these times. This is a new program and the City has never been approached for something like this. The Park Commission recommended approval of the request with all fees waived and the net proceeds from the sales of concessions to be distributed to a charitable purpose. The Council discussed the request. They voiced concerns about the following: Clean-up of the area during and after the concession stand is open. Having an adult to supervise at all times. Paying the young adults who work a stipend versus giving whatever they make from the sales toward a park improvement or charitable cause. Not having some organized activity for these young people. No damage deposit. The Council asked that the City Attorney prepare a document that the Council can feel comfortable with that would give some guidelines to allow this to happen. There were 23 Part I offenses reported. Those offenses included 1 homicide, 2 burglaries, 1 aggravated assault, 17 larcenies, and 2 vehicle thefts. There were 62 Part II offenses reported. Those offenses included 4 child abuse/neglect, 2 forgery/NSF checks, 2 narcotics, 9 damage to property, 2 liquor law violations, 9 DUI's, 3 simple assaults, 4 domestics (1 with assault), 6 harassment's, 7 juvenile status offenses, and 14 other offenses. The patrol division issued 133 adult citations and 4 juvenile citations. Parking violations accounted for an additional 37 tickets. Warnings were issued to 182 individuals for a variety of violations. There was 1 adult arrested and 3 juveniles arrested for felonies. There were 32 adults and 9 juveniles arrested for misdemeanors. There were an additional 12 wan'ant arrests. The department assisted in 13 vehicle accidents, 3 with injuries. There were 17 medical emergencies and 50 animal complaints. Mound assisted other agencies on 15 occasions in June and requested assistance 5 times. Property valued at $7,565 was stolen and $1,250 was recovered in June. MOUND POLICE DEPARTMENT MONTHLY REPORT - JUNE 1997 II. INVESTIGATIONS The Mound Police investigated the first homicide in over a decade involving a 16 year old suspect and 18 year old victim. The investigators spent over 65 hours in preparing for the issuance of a formal complaint; not to mention all of the other support personnel involved. The investigators investigated 2 criminal sexual conduct cases and 3 child protection matters, accounting for another 26 hours of investigation time. Formal complaints were issued for murder in the first degree, gross misdemeanor DWI, driving after cancellation, no insurance, and illegal excavation. III. Personnel/Staffing The department used approximately 213 hours of overtime during the month of June. Officers used 109 hours of comp-time, 138 hours of vacation, 37 hours of sick time, and 15 holidays. Officers earned 112 hours of comp-time. The homicide added to an already large overtime expenditure due to Mound City Days. IV. Several officers attended intoxilyzer refresher and all officers attended a department shoot. The reserves donated 199 hours during the month of June. The summer staff that are college students have started work we are now at three seasonal full-time employees doing the mowing and one assigned general maintenance. The weather was quite dry for most of the month allowing us to catch up with the areas that needed to be mowed along with some repairs. We had Mound Bay Park ready for Mound city Days, extra hours were scheduled for the parks crew to pick up the garbage at both Mound Bay Park and the Pond. With the fire works being on Saturday rather then Sunday I was concerned about the trash pickup at the park but the Lions had a group of volunteers police up the park early in the morning and it looked great for the Sunday events. CEMETERY; The cemetery had one burial. TREE REMOVAL; There were two hazardous trees removed from city property and one hazardous tree marked on private property. DOCKS; The docks continue to be in great demand, allot of calls are received with residents looking to gain a site. That is because last year in June we had five Saturdays; this year we had only four. Gross sales for this year's June were $161,976, compared to $164,255 in June of '96. One thing that I have noticed after the first half of the year is gone is the extraordinary increase of credit card and check cashing card usage. For example, after the f~rst six months of the year, we have processed 2,650 transactions totaling $61,438. Last year for the same corresponding time frame, the transactions were 1,844 for $43,750. And in 1995, it was 980 for $25,054. I am not surprised, however, and I do not see the trend changing at all. Orono has requested a public hearing on the amount of levy increase. They appm'ently have forgotten that per the agreement with the cities two years ago, the LMCD has been reducing reserves to the agreed upon level by using them as operational costs. Not as much is available this year as in the past two. With the 1998 budget, the reserves will at the agreed upon level. I attended the comment meeting with the city representatives. No adverse comments were made. 1.2 The Bil Hawks boathouse saga continues. He pleaded guilty to violating the ordinances, and was given a minor sentence. That will probably end things until the civil suit is decided. 2.0 Exotic Species Task Force. 2.1 The 1997 harvesting season commenced June 16. Up to June 27th nearly 100 acres of milfoil have been harvested. 2.2 More than 160 boats were inspected and/or washed in connection with the recent FTW Bass Fishing Contest. 3.0 Water Structures 3,1 The boat launch that Wayzata has been sharing with thc Wayzata Yacht club is being upgraded with DNR funds. This is a very old grandfathered minimum site which probably does not meet present standards. They were allowed to continue the construction with the understanding that the papework would catch up later. 4.0 Lake Use. 4.1 No significant items. $.0 Mound Sl~ciflc Items S. 1 It appears that the Watershed will back off their requirement for lighted bouys in Dost Lake. Nybeck, Executive Director SUBJECT: 1998 Adopted LMCD Budget To comply with enabling act requirements, the Board certified and adopted the 1998 LMCD Budget at the 6/25/97 meeting. Enclosed is copy for your records. For your information, no changes were made to the budget presented to the cities at the June 5 meeting in the LMCD office. As outlined in the enabling act, if any city objects to the budget, the LMCD is required to hold a public heating to hear their objections. The City of Orono has expressed an objection to the approved 1998 and has requested a public heating be scheduled to address their concerns. The Board has scheduled this public hearing for Wednesday, July 23. If changes were to be made to the adopted budget, they would be communicated to all LMCD after the public heating. You will note in the adopted budget that projected reserve fund balances on 12/31/98 will meet what has been previously agreed upon. With projected reserve fund balances of $118,645 in Administration and $110, 061 in Eurasian Water Milfoil, this will achieve the agreed upon reserve fund balances of six months for Administration and 12 months for Eurasian Water Milfoil. Being familiar with both Springfield and Mound, Mound has a greater unkempt problem. I feel Mound property owners should be reminded of the ordinances. The city must initiate a program that will constantly monitor and demand compliance of such ordinances. Resolution of "messy" situations should be initiated by the city. Nybeck stated the milfoil harvesting will start on 6/16/97. B. Update on 1997 zebra mussel spraying program. Nybeck stated three tournaments have been held this season with only one boat being washed. Upcoming tournaments however have generated several calls from people wishing to schedule an appointment for a boat washing. Partyka stated he would like to see the boat washing sign changed so not such a large closed sign is showing. Nybeck agreed the sign could use some updating. Suerth stated he would like to see another letter sent to the DNR stating the LMCD only intends to spray the bilge, not the entire boat. Ce Additional Business. There was no additional business. e LAKE USE AND RECREATIONS A. Sunboat I and I1 1997 renewal beer and wine licenses. Babcock introduced the item stating there is a catch: the liquor control requires proof of insurance; however, many insurances require a license first. Be Pelican Point HOA, request for LMCD to place two slow-wake buoys at the approaches to the channel which separates Pelican Point from Pelican Point Island at the south end of Spring Park Bay, Continuation of 5/14/97 discussion. Babcock stated he sensed a consensus from the board on the boat tour that one buoy in the middle for the channel would aid navigation. MOTION: Gilman moved, Nelsen seconded to approve one buoy at Pelican Point HOA provided if one is not available at Hennepin Parks the applicant purchase the buoy to be consistent with others on the lake. VOTE: Ayes (8), Nays (0); Motion carried. Ce Suburban Hennepin Regional Park District, request for LMCD to place slow-wake buoys 300' from the shorelh~e at the Lake Minnetonka Regional Park, continuation of 5/14/97 discussion. Babcock stated concerns with the buoys not being consistent with others on the lake. Karen Bowen representing Hennepin Regional Park stated they would have no problem using consistent buoys. They believe the buoys are needed for safety reasons. Nelson stated a concern with other launching romps asking for buoys. Too mm~y buoys may make it confusing for boaters. Other launching areas currently without buoys were compared to this site. Maglich would hesitate to compare different sites and would like to see the applicant monitor the site and come back at a later date if needed. MOTION: Nelson moved, Gilman seconded that no buoys be placed in this year, during witch the applicant monitor the site and bring this item back before the board next year if they still feel the buoys are warranted. After some review of the situation it was determined the LMCD should review this issue. The applicant was unable to be at the meeting. Babcock stated some concerns that the lot lines show the ramp and dock on the Yacht Clubs property that may cause the Yacht Club problems with their density.
