The City Manager explained that he met with the Park Director and the tree service and has spoken with Ms. Palm on the phone. He stated the stories do not match. His recommendation is that Ms. Palm be aasessed $1500. for the hazardous tree removal. This seemed to be agreeable to Ms. Palm. Councilmember Jensen asked that the sales tax of $97.50 be added to the $1500. The Council agreed. The City Attorney has drafted an ordinance amendment based on discussion at the COW Meeting for the Council's review. Def'mitions. For purposes of this Section the following definitions shall apply. (a) "Attendant" is the same as a competent, unimpaired adult. (c) "Competent, Unimpaired Adult" means a person over eighteen (18) years of age ',?,t who is not under the influence of alcohol or other drugs, who shall be the responsible party for directly supervising an open bum and who shall be responsible for ensuring compliance with this Section. (d) "Fire Chief" means the appointed Fire Chief or any individual designated by the Fire Chief to perform specific duties. (e) "Recreational Fh-e" means a fire set for cooking or warming or other recreational purpo~ which are is not more than three (3) feet in diameter and three (3) feet in flame height, and has a non-combustible separation between the fire area and adjoining combustible material such as bricks or stones and has had the ground five (5) feet from the base of the fire cleared of all combustible material. (0 "Starter Fuels" means dry, untrea~, unpainted wood or charcoal fire starter. Paraffin candles, commercially available products for use in starting charcoal grills and alcohols are permitted as starter fuels and as aides to ignition only. Propane gas torches or other clean burning devices causing minimal pollution may be used to start up an open fire. Starter fuels do not include gasoline, diesel fuel, kerosene, and hearing oil. (g) "Wood" means dry, clean fucl only such as twigs, branches, limbs, "Presto- logs", "duraflame logs", charcoal, cord wood, and untreated dimensional lumber, including clean pallets. "Fuel" does not include wood that is green; leaves or needles; grass clippings; garden waste; wood that is rotten, oil soaked or treated with paint, glue or preservative; plywood, particle board, chip board, finished paneling, or painted, treated, or stained cardboard or paper. 6 Mound City Council Minute~ - October 28, 1997 Subd. 2. Motion carried. 1.17 COMMENTS AND SUGGESTIONS FROM CITIZENS PREqENT. There was no response. 1.18 RESOLUTION 97- RESOL~ON REO~~G HENNEPIN COUNTY TO CONDUCT A FEASIBILITY STUDY REGARDING A STOPLIGHT TO BE LOCATEr~ AT SHOR~I,1NF, DRIVE AND WILSHIRE BLVD. The City Manager explained that he has received a request from a citizen for a stoplight to be installed at Shoreline Drive and Wilshire Blvd. Since Shoreline Drive is a County Road, he felt asking Hennepin County to conduct a feasibility study on this would be in order. He stated if the County feels it is warranted, it could cost the City $75,000 to $120,000. The Police Dept. reports that there has been about 21 accidents at this intersection in the past 3-4 years. The Council discussed the request and decided they would like to do some research and hold a public heating on this before requesting that the County conduct Mound City Council Minutes - Oaober 28, 1997 a feasibility study. No action was taken on this item at this time. 1.19 pLANNING COMMLqSION ITEMS Councilmember Hanus stated that at the Planning Commission meeting last night there was a case where a person wanted to add a conforming structure on a lot that was substandard in size. It was suggested that there are other cities they thought are using CDBG monies to alleviate some of these problems. He did not know if the city was using these funds to purchase undersized lots. The Planning Commission would like to see this researched to see if CDBG funds are available for this purpose. The City Manager will check into this. The City Attorney stated that the City of Richfield has a very aggressive scattered site housing program and one of their goals is to pick up substandard lots and lots that have blighted homes. The entire City has been set up as a redevelopment project area. Each new house is its own tax increment district and they are using the tax increment that the property generates to help finance a revolving fund to purchase new sites to keep the process going. The City Manager explained that six or seven years ago, the County took the money that was not used in CDBG was put in a discretionary pool and cities could apply for it. Mound did apply for $250,000 to use for scattered site housing. He had to go before a committee of citizens from all over the County and they couldn't understand why we wanted to do this and turned it down. He further explained that Mound's total allocation of CDBG money is about $65,000 per year and which helps fund the social services and private rehab. The City Attorney will forward Richfield's program information to the City Manager for review. The other issue was one that has been talked about at previous COW Meetings. The Planning Commission is asking to be directed to start drawing up or looking at a Truth in Zoning Ordinance. Councilmember Hanus stated he knows the City Council is split on this. He felt if given certain restrictions and certain conditions, he could support this depending on how it is written and how it is made up. The Council asked what the Planning Commission is trying to accomplish. Councilmember Hanus stated that someone goes to sell their property, the prospective buyer would be told whether or not the lot is conforming, if it's known, whether it's nonconforming, but primarily they are given a zoning sheet that tells them what the setbacks are for their zone. It would be purely informational and very minimal in cost. It would inform prospective buyers of the zone they are in and what the zoning restrictions and requirements are. It would be something that would be required by ordinance and everyone would be required to do it. The vehicle used for enforcement would be at closing where there would be a document that the City would require to be signed stating that prospective buyers have received this information. The Mayor stated he would be willing to make this information available upon request, but he is absolutely opposed to making the this a requirement of the City. Councilmember Ahrens stated she does not like the idea of the City being involved in all closings on the sale of property. The City Attorney stated there are several cities who have a zoning information handout that they make available for people who request it. He will get one for the Council to review for information purposes. Shukle, Jr., City Manager Attest: City Clerk MINUTES-CITY OF MOUND CITY COUNCIL AND WESTONKA SCHOOL BOARD- OCTOBER 29, 1997 The meeting was called to order at 7:30 p.m. at the Westonka Community Center. Members from City of Mound: Polston, Jensen, Hanus and Weycker; City Manager Ed Shukle. Members from Westonka School District: Pinegar and Charon; Superintendent of Schools Dr. Pam - Myers. Also Present: Bert Haglund, TSP/EOS. Review of Formal Response from Minnesota Department of Children, Families and Learning Ed Shukle, City Manager provided copies of the formal response from the Department of Children, Families and Learning under the review and comment requirement of Minnesota Statutes. The formal response gave approval to the joint project's application for positive review and comment. Dr. Pam Myers and Bert Haglund indicated that they had spoken to the State Department's representative who was assigned to review and comment on the project, regarding the withdrawal of Minnetrista from project. He said that this would have no effect on the response already given. Update on Brochure/Mailing The brochure has been printed and was ready for mailing on October 30, 1997. It would be mailed to 9,780 residents within the School District and surrounding area. Kristin Dodge Narjes arranged for 15,000 brochures to be printed. Extras will be distributed in the area as needed. Joint Powers Agreement Elements A more detailed discussion was held on this matter than previously. The outline from David Kennedy was followed and concepts were either agreed to or need further clarification. It was agreed that further discussion regarding the joint powers agreement be put aside until after approval of the referendum. Hanus asked the City Manager for a list of possible of revenues that could cover the City's portion of the operating costs if that portion was $190,000. Shukle indicated that he would provide that before the November 4 informational meeting. Preparation for Informational Meetings It was agreed that Mayor Polston and Chair Pinegar would introduce the project by providing background. Bert Haglund would present the preliminary design and cost estimate using A/V equipment. Questions would then be answered by Polston, Pinegar and Haglund. It was noted that the first informational meeting was scheduled for Tuesday, November 4, 1997, 7:30 p.m., Minnetrista City Hall. Canvassing of Election Results The Westonka School Board will canvass the results of the election immediately upon receiving the results on December 4, 1997. It is determined that the livability of the residential property will be improved by the authorization of the following alteration to a nonconforming use of the property to afford the owners reasonable use of their land: Building a second story addition and a 10 x 30 deck. 4. COMMENTS: A variance can be granted in Mound only on the basis of a finding of hardship or practical difficulty. Gordon stated that he discussed that with the applicant and the applicant agreed. Gordon suggested that the proposed deck be cut back to 10 feet and the concrete underneath be removed. The proposed deck will be 10 x 30 and will be conforming to the setbacks. MOTION by Weiland to motioned to approve staff recommendation with the condition of removing any concrete to the west of the home, with a reduction of the deck of 10 feet in width, Voss seconded. After variance approval, the foundation of the home was expanded. In 1989, the garage was expanded 6 feet to the south. In 1990, this item went before the Planning Commission and City Council to clarify the extent of the allowed home expansion. Specifically, Resolution 90-79 allowed a two story expansion of the structure. In the nine years since the initial variance approval, the only construction that occurred was the initial foundation expansion which remains uncompleted. The owner is now seeking variance approval to complete the project in three phases running from 1997 to 199. Since this request was initially reviewed in 1987 and again in 1990, Mound has instituted three changes in the Zoning Code which impact this case. The first involves hardcover restrictions. The subject site is no limited to a maximum of 40% hardcover. The limitation was not in place in 1990. The second change involves the applicable setbacks for the single family home. In order to acknowledge alleys and fire lanes that are 15 feet in width or less, the City added a provision to the code which states, "In residential districts, street frontages created by the existence of alleys, such alleys having a total width not exceeding 15 feet, shall be considered side yards or rear yards, as appropriate, and subject to applicable district setbacks." As a result, Manchester Lane is now considered the front yard subject to a 20 foot setback and Cambridge is considered the side yard subject to a 6 foot setback. The Mound Street and Utility Department does not consider Cambridge to be an improved street and it is not maintained by the City. The third change involves building completion. Planning Commission Minutes October 14, I996 Hanus questioned how the time limit works when phases are involved. The Planner indicated that when the building permit is issued for each phase they would have one year from that date, and each phase must be applied for in the year indicated. If the project is not completed in five years, the variance will become null and void. Weiland feels that it is too long to carry out the project and feels it is too much of an imposition on the neighborhood to have construction carry on for that amount of time. He feels the entire project should be completed in one year. Burma suggested the applicant's phase I should be to finish the exterior, and phase II could be to finish interior, etc. Dow requested clarification of Phase A. Sutherland reviewed that this phase includes new sheathing on the garage, the hole by the front door needs to be filled-in and capped, the soffit and fascia work on the garage needs to be finished, the floor needs to be poured, etc. Dow informed Sutherland that his house has a crawl space, it is not a slab. Sutherland informed Mr. Dow that the floor of the crawl space will need to be raised to an elevation of 933. The floodplain elevations were reviewed. Sutherland estimated that approximately 6 inches of fill will need to be placed in the crawl space and a surveyor will need to verify the finished lowest floor elevation. MOTION made by Weiland, seconded by Voss to recommend denial of the phase plan and to direct staff to work on a solution to get the outside completed so other properties do not have to be subjected to the on-going construction. There was discussion relating to the completion of the exterior. Dow stated that he would rather withdraw or table his request so he has time to rethink the project. The Commission discussed the issue of application time limit if the case is tabled. Koegler stated, if the applicant requests the tabling, the clock stops. Sutherland confirmed that Dow could continue work on the first floor items without the variance approval, however building permits will need to be issued to complete the siding and fill in the foundation. Despite the fact that the roles have changed, the specific request has not. Because of two prior approvals, staff feels that approval is once again warranted. The applicant's proposed phasing plan identifies the second floor addition over the garage as the first phase. Although this area will eventually become second floor living space, apparently it will be used on an interim basis for storage. The building plans call for the installation of a pull down stairway to gain access to the garage addition. The City does not specifically regulate phasing of building projects. In staff's view, the second floor garage addition will create a rather unbalanced appearance until such time as the remainder of the second floor is completed in 1998 and 1999. It is also unclear as to how the transition areas will be handled between second floor phases. Will the future interior wall be sided on the exterior or is it the applicant's intent to simply leave the sheathing in place until the next phase occurs? Prior to any new construction occurring, however, completion of the initial first floor improvements that began in 1987 needs to occur. RECOMMENDATION: Staff recommends that the Planning Commission recommend approval of the requested variances to allow expansion of the existing home in three phases from 1997 to 1999. Since that time, only the foundation of the structure has been built. He is now seeking a clarification as to whether the approval was for a single story addition or for a two story addition. His desire is to construct a two story addition from the new south wall of the home to the mid-point of the existing structure. COMMENT: In reviewing this case, the minutes from the meeting seem to imply that the approval was for a single story addition. At the Planning Commission meeting of July 13, 1987, Mr. Dow stated that "his home is too small to add a second floor; the first floor would be ruined." Resolution 87-141 which was adopted at the time makes no mention of a seconQ floor. Based on this information, this case becomes a request for a new variance, not a clarification of what happened in 1987. The ~xisting lot has a total area of 4700 square feet. Including the footprint of the new adQition, the house, garage and deck consume 62% of the lot area. Many cities have adopted an interim ordinance calling for a short moratorium to study the issue and develop recommendations on how to deal with the requests that are initiated by Personal Communication Services (PCS) companies such as US West, MCI, Sprint, etc. Our city planner's office has been contacted by US West Cellular regarding the availability of water towers or other sites/facilities to locate antennas for this type of equipment. We have been advised by the City Attorney's office to consider an interim ordinance which will give us some time to study what facilities might be available, franchise agreements if the company wishes to utilize existing water tower facilities, etc. Zoning issues, as well, need to be considered in developing a longer term ordinance to handle the various requests that will be coming in from the service providers. Staff recommends that you approve the interim ordinance amendment and that staff would then proceed to study the matter and bring you back an ordinance for consideration in the near future. The moratorium should be generally self- explanatory, but please keep two points in mind. First, the draft proposes a 90-day moratorium. While state law permits longer interim ordinances, federal law preempts anything but "reasonable" local regulation. In light of the current regulatory environment, the city will be at some risk if it attempts to stretch this moratorium much past 3 months. Second, the city does have an ordinance (Section 617) that requires permits for installation of these facilities on public ground. Because the city is considering a more comprehensive ordinance, it may be useful to also impose a moratorium on public-land installations. Doing so additionally reduces the risk that the moratorium will otherwise be claimed an impermissible attempt to force telecommunications providers to enter into lease agreements with the city. Several other considerations should form a part of the city's deliberations over a permanent ordinance. First, the city will need to determine when towers should be permitted uses, when conditional uses, and when prohibited uses. The general rule of thumb is that the city cannot prohibit the provision of telecommunication services or unreasonably interfere with their provision. Within that context, however, the city has a fair amount of flexibility in how to regulate these towers. There may also be ways to encourage location of towers on public property, for example by eliminating site plan approval for such towers on the basis that the city needs less time to review an application to operate a tower on land that the city owns and operates. At least one telecommunications company has vigorously complained about an ordinance that proposed a height limit of less than 175 feet, arguing that it rendered it difficult to provide adequately provide services. Third, the city will need to consider whether a public hearing will be a part of the approval process for towers that are otherwise permitted uses. There are, of course, both advantages and disadvantages to allowing public participation in a permit process in which the city has relatively little leeway to deny a permit. As I mentioned on the telephone, I have found that having a telecommunications provider representative at the planning commission and city council hearings on a permanent ordinance can serve to answer many of the technical questions that almost invariably arise during this process. Perhaps not surprisingly, these representatives will generally try to influence the direction of the ordinance and their comments should be heard with that in mind. Nevertheless, helping to ensure that a full and complete record exists will generally be of great assistance to the city if the ordinance should later face legal challenge. Please feel free to contact me if you have any questions or need additional assistance. Background. 1.01. The City of Mound ("City") currently regulates various types of wireless transmission and reception facilities through its official controls. 1.02. Among the facilities that are currently subject to regulation are antennas and towers having a fixed location and operated to furnish to the public commercial wireless telecommunication services (hereinafter "CWTS"), including cellular, personal communication services (PCS), specialized mobilized radio (SMR), enhanced specialized mobilized radio (ESMR), paging, and similar services that are marketed to the public. 1.03. Market demand, rapid advances in technology and expanding federal licensure of radio frequencies has resulted in the proliferation of CWTS in the recent past, and that trend can be expected to accelerate in the reasonably foreseeable future. 1.04. The City's regulation of antenna and tower transmission facilities, such as height and building size restrictions, fails to differentiate among the various types of facilities including CWTS. 1.05. The City Council is concerned that its official controls relating to antennas and towers may not adequately address issues related to these towers, such as the appropriate locations for the towers and the conditions under which they may be allowed within the City, including structural and construction requirements, collocation, setbacks, and height limitations. 1.06. The City has received inquiries from companies desiring to construct CWTS towers and other facilities in the City. 1.07. Minnesota Statutes, section 462.355, subdivision 4, allows the City to adopt an interim ordinance for the purpose of protecting the planning process and the health, safety and welfare of its citizens. t013 DJG132877 MU200-1 Section 2. Findings. 2.01. The City Council finds that it is necessary to conduct studies to determine if there is a need to amend the City's official controls or its comprehensive plan relating to CWTS's, and if so, to adopt the appropriate amendments. 2.02. The City Council finds that there is a need to adopt an interim moratorium ordinance for the purpose of protecting the planning process and the health, safety and welfare of its citizens regarding such matters. Section 3. Planning and Zoning Study; Moratorium 3.01. A study is authorized to be conducted by City staff to determine if the City's official controls need to be modified as they relate to CWTS's. 3.02. Pending completion of the study and adoption of any amendments to the City's official controls, there is hereby established a moratorium on the construction, erection, placement, reconstruction, enlargement, or expansion of CWTS towers within the City and on the development and use of property for such purposes. 3.03. During the period of the moratorium, applications for final site and building plan approval, building permits, and other permits and approvals related to such tower work shall not be accepted by the City; neither the Planning Commission nor the City Council shall consider or grant approval of any application for such work; and no building permits for such work shall be issued. 3.04. For the purposes of the moratorium, the term "CWTS tower" shall mean any pole, spire, structure, or combination thereof, including supporting lines, cables, wires, braces, and masts, intended primarily for the purpose of mounting an antenna or similar apparatus above grade, for the purpose of providing commercial wireless telecommunication services to the public. 3.05. The moratorium shall not apply to: (a) the lawful use of existing towers; (b) the repair and/or maintenance of any existing tower provided that such work does not enlarge or expand that tower; (c) work on a tower necessary to preserve health, safety, life, or property in the face of an emergency; or (d) tower work that has received all necessary permits and approvals from the City prior to the effective date of this ordinance. Section 4. Enforcement. The City may enforce this ordinance by mandamus, injunction or other appropriate civil remedy in any court of competent jurisdiction. Sec. 5. Duration. This ordinance shall remain in effect for 90 days from the date of its effective date or until such earlier time as said ordinance shall be revoked or otherwise amended. Sec. 6. Effective Date. This request was initiated by Minnetrista earlier this year and has been reviewed by the City of St. Bonifacius and its Fire Department which currently covers these areas in Minnetrista. The request also affects a small portion of Minnetrista which is currently covered by the Mound Fire Department which would now be covered by the St. Bonifacius Fire Department. The City of Minnetrista approved the revisions at their meeting of October 20, 1997. The City of St. Bonifacius, which has agreed to these changes, has sent a letter to Minnetrista asking them to delay the change until 1999 due to budgetary constraints. Minnetrista will review this issue at its meeting of November 17, 1997 and will have a representative at our City Council meeting on November 18, 1997. Fire Chief Steve Erickson has been involved in the process and is in agreement to accept the revisions as proposed. I see no reason to reject the proposed revisions. The areas mentioned are covered now through mutual aid agreements and if approved, will shift the financial burden to Minnetrista and will reduce the burden to the rest of the cities in the fire district which includes parts ofMinnetrista, Orono and Shorewood, all of Spring Park, Minnetonka Beach and Mound. BONIFACIUS FIRE DEPARTMENT EFFECTIVE JANUARY 1,199~ WHEREAS, the City of Mound has received a request from the City of Minnetrista to revise the Mound Fire Department Fire District to include additional properties in Minnetrista; and WHEREAS, a committee was established earlier this year to study this matter comprised of representatives from the cities of Minnetrista, St. Bonifacius and Mound; and WHEREAS, agreement was reached between the cities of Minnetrista and St. Bonifacius to revise the fire coverage area requesting the Mound Fire Department to assume responsibility for: County Road 44-Change from St. Bonifacius Fire Coverage to Mound Fire Coverage; all properties on County Road 44 from the south side of the Priests Bay/Halstead Bay Bridge south to 3790 County Road 44, Pine Circle, LythrumWay, Hardscrabble and Road and Eagle Bluff Road. County Road 110 West-Change from St. Bonifacius Fire Coverage to Mound Fire Coverage; all properties on County Road 110 West from the Mound City Limits westerly to Cardinal Cove Drive. Change from Mound Fire Coverage to St. Bonifacius Fire Coverage 7210 County Road 110 West Extension. WHEREAS, the Mound Fire Chief has participated in the discussions related to these proposed revisions and has approved of the changes as outlined above; and WHEREAS, the City of Mound and the remaining member cities of the Mound Fire District have no objection to these changes and that such changes will actually benefit the Mound Fire District particularly as it relates to financial considerations. NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Mound, Minnesota, hereby approves of the proposed changes as outlined above effective January 1, 1998. BE IT FURTHER RESOLVED, that the Mayor and City Manager be authorized to execute such documents related to these changes and that city staff prepare an addendum to be distributed to the member cities of the Fire District indicating these changes and the impact financially on the other members effective January 1, 199g. The City of St. Bonifacius does not necessarily disagree with changing the boundaries as outlined in Minnetrista Resolution No. 108-97. However, the timing of Minnetrista adopting this resolution is problematic not only for the City of St. Bonifacius, but also. for Laketown and Watertown Townships in terms of allocation of costs for the 1998 fire protection year. Obviously, all of the parties to the Fire Protection Contract have set their budgets and levies for 1998. Based on current contract dollars, the boundary change Minnetrista is proposing would have the tbllowing impact for the contract participants in 1998: St. Bonifacius increase Minnetrista decrease Watertown increase Laketown increase $3,641.37 $5,997.55 $1,070.99 $1,285.19 The increase will have to be absorbed by the City of St. Bonifacius and Watertown and Laketown Townships without the benefit of budgeting for such a payment. That is an issue of some concern for the City of St. Bonifacius but we are particularly cognizant of how the townships Will react to what they will deem a very significant increase in their fire protection costs. Accordingly, St. Bonifacius feels one of the following two alternatives is appropriate: The boundaries be adjusted effective January 1, 1998 (concurrent with the execution of the new Fire Protection Contract) but ~3 rider be attached to the contract indicating that Minnetrista will pay the additional sum of $5,997.55 in 1998; or Charlotte Erickson November 6, 1997 Page 2 o The boundary changes be made effective January 1, 1999 thus affording all effected participants to the Fire Protection Contract the opportunity, to adequately budget for the change in boundaries. BONIFACIUS APPROVE SUCH REVISIONS WHEREAS, the City of Minnetrista is a municipal corporation, organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of Minnetrista pursuant to Minnesota Statutes, Chapter 412, has within its power to provide for the protection of public and private property and promote health, safety and general welfare; and WHEREAS, the City Council, has pursuant to Minnesota Statutes, Chapter 412, the authority to make contracts that are deemed necessary to effectively carry out the power granted by the statutes; and WHEREAS, the City Council has entered into fire contract agreements with the Cities of Maple Plain, Mound and St. Bonifacius in order to provide fire protection of public and private property and has approved three fire coverage districts in the city; and WHEREAS, the City Council has received a report dated September 11, 1997, from Councilmember Brad Gerdes, that the Maple Plain Fire Chief, Mound Fire Chief and the St. Bonifacius Fire Chief and Councilmember Gerdes met during the summer of 1997 to discuss the various fire coverage districts and studied response times to each property in the City of Minnetrista; and WHEREAS, the Fire Chiefs agreed that the Maple Plain Fire Coverage District shall remain the same and that the St. Bonifac~Ls ~,qd the Mound Fire Coverage Districts, should be revised, as per the aforementioned report; and WHEREAS, all property owners affected by the revisions have been notified and given the opportunity to comment on the proposed revisions at a public hearing held October 6, 1997 before the Minnetrista City Council and the comments received were favorable to the changes. The presentation on Audits of Federal Programs was very pertinent because new standards will be implemented with the 1997 city audit. The Governmental Accounting Standard Board update dealt with topics that could have significant impact in the way cities report financial matters. - SAC rate will be $1,000 in 1998 The Metro Council - Environmental Services has established the 1998 SAC rates. SAC is collected as users connect to the Metropolitan Disposal System for the first time. The SAC funds collected pay for the reserve capacity portion of the debt service incurred to expand and improve sewer facilities. The new rate of $1,000 represent an increase of six percent. - 1998 Proposed Tax Rates My preliminary calculation of the 1998 proposed property tax levy seems to indicate that the City of Mound's proration of the levy will be 3.64% less on a $100,000 valued home. The calculation implies that all other factors would stay the same. The stock market plummeted severely on bad news from overseas. However, here in Mound, particularly at your local liquor store, the economic atmosphere was bucking the World Wide pessimistic trend. Perhaps they needed a few bumps to soften the blow. Who knows. There always seems to be a reason why people choose to drink. Well here are the particulars: Gross sales for the month of October were; $144,102.00. Last year for October sales were $134,172.00. Up 7.5 %. Having Halloween fall on Friday helped immensely. Normally this time of the year sales for a Friday are around $7,500.00 this Halloween sales were $10,460.00. For the year sales are up $13,000.00 over last year at this same time. I hope to match, in November, what we did last year for November. That was a good November last year. Then I hope to be up a couple of thousand in December. The increase at the end of the year will not be that much. The good news is that at least it will be on the plus side. From what I hear, other stores are moaning and groaning. There were 29 Part I offenses reported. Those offenses included 1 criminal sexual conduct, 7 burglaries, 1 aggravated assault, 19 larcenies, and 1 vehicle theft. There were 58 Part II offenses reported. Those offenses included 2 child abuse/neglect, 1 forgery/NSF checks, 7 weapons, 1 narcotics, 15 damage to property, 1 liquor law violation, 2 DUI's, 5 simple assaults, 6 domestics (4 with an assaults), 2 harassment's, 8 juvenile status offenses, and 8 other offenses. The patrol division issued 115 adult citations and 8 juvenile citations. Parking violations accounted for an additional 24 tickets. Warnings were issued to 90 individuals for a variety of violations. Other cases involved burglary, theft, assault, terroristic threats, fleeing a police officer, discharge of a firearm, domestic assault, damage to property, felony assault, receiving stolen property, harassment, and absenting. Formal complaints were issued for felony theft, assault, fleeing a police officer, disorderly conduct, driving after cancellation, noise nuisance, maltreatment of an animal, assault, and alcohol in the park. III. Personnel/Staffin~ The department used approximately 46 hours of overtime during the month of October. Officers used 37 hours of comp-time, 81 hours of vacation, 19 hours of sick time, and 9.5 holidays. Officers earned 35 hours of comp time. Officers attended EMT refresher and mandatory training in legal updates and handling the mentally ill. Officer Ringate attended a week long course on drug interdiction for patrol officers. I attended the International Association of Chiefs of Police conference in Florida. I was a presenter for "Partnerships in Community Policing for Juveniles and Seniors." The statistics indicate that there were 21 accidents (four with injuries) in a four year period at Shoreline Drive and Wilshire Boulevard. Shoreline Drive and Cypress Lane experienced 15 accidents (eight with injuries) over the same period of time. The traffic volume for the Superamerica station may be a contributing factor as well as the crosswalk at Cypress Lane. The intersection of Three Points Boulevard and County Road 110 experienced nine accidents (four with injuries) for the same four year period. It does not appear that there have been any accidents since the installation of the semaphore at County Road 110 and Three Points Boulevard. A review of the statistics indicates that the volume of personal injury accidents is higher at Cypress Lane; where over 50% of the accidents involved an injury. The need may be greater at that intersection than at Wilshire. Another factor to consider is the closing of Toro and the volume of pedestrians may change depending on the building use. First, I have received a report from the Police Department, a copy of which is enclosed, indicating that there have been 21 accidents involving personal injury, property damage and pedestrian injuo' from 1994 to the present. Second, I contacted Hennepin County to determine the procedure in which to request a traffic signa! at this location. The County needs to have the City request a feasibility study of this location to determine if the traffic warrants a signal. Third, I asked the City Council to approve a resolution at its October 28, 1997 meeting asking for the feasibility study to be conducted. The City Council did not approve the resolution because they need more information about how the number of accidents that have occurred at this location compares to the number that occurred from 1994 up until the traffic signal was installed at Three Points and County Road 110. In addition, they want accident data regarding the County Road 15 and Cypress (Superamerica) location and how that compares to the County Road 15 and Wilshire Blvd. location. Following receipt of that information from the Police Department, the City Council will be scheduling a public hearing on the matter. That is tentatively scheduled for Tuesday. December 9, 1997, 7:30 p.m., Mound City Hall. Finally, I wanted to advise you of what has been done on your request to date and that you may want to consider circulating a petition to the public for the project and asking that the City Council pass a resolution asking Hennepin County to study the project's feasibility. Staff is down to one part-time called in as needed and will be given more hours when the weather turns colder to allow for ice rink flooding. CEMETERY; The cemetery had three burials and has been marked for winter burials. TREE REMOVAL; There was one hazardous tree marked on private property and we were working with the home owner for the removal. A large tree was removed from Devon Common that was struck by lighting. DOCKS; The dock inspector has been busy inspecting dock site locations for adherences to code for storage of docks and lifts. BOARD OF APPEALS: CASE # 97-39: Variance to construct a non-conforming dwelling, Robert Steele, 23XX Driftwood Lane, Lots 10, Skarp's East Lawn, PID 13-117-24 44 0059 Applicant requested to table this case at this time, he would like some more time to gather information regarding this case before it is heard by the Commission. Mueller stated that there are 3 members not here this evening and that maybe this should be delayed until all members can be present to hear the case in its entirety. Minutes - Planning Commission November 10. 1997 A vote was taken and it was 3-3, it was decided to hear the case tonight, with the understanding that it will be tabled in the end. Building Official Jon Sutherland reviewed the case. The applicant, Robert Steele, is seeking variances on lot area, impervious surface, and lot width in order to allow construction of a new Single Family Dwelling. The proposed dwelling is conforming to the required setbacks for this parcel which is a lot of record. The existing dilapidated old cottage would be removed as part of the proposal. In the event the variance is approved, the floodplain modifications will require other agency approvals and this is addressed in the City Engineers report. This property is located in the R-1 zoning district which requires a minimum street frontage/lot width of 60 feet, a minimum lot area of 10,000 square feet, and building setbacks of 30 feet for the front, 6 and 10 foot to the side for lots of record, and a 50 foot setback to the lake. Included in the staff report are the comments of the Department of Natural Resources (DNR) who has recommended denial. Attached as staff's exhibit//1, (3 pages) is the Realtors advertisement just prior to the applicants purchasing of the property, this information identified the subject property (tax parcel /159) as being under one ownership with the adjacent parcel to the south (//60). The owner is in the process of filing to change the title over to a family member as noted in the submittle documents, the city currently has no control or regulation over this process. Nonconforming issues and comments: 1) Lot Area: The area of the lot is the area above the flood elevation of 931 as defined in the zoning code (section 350:310, Subd. 78.). This area is noted by the surveyor as 3,200 square feet, 10,000 is required in the R-1 zone resulting in a variance request of 6,800 square feet. Comments: The nonconformity of lot area is substantial and both the adjacent parcels are also substandard to lot area. The adjacent lot//9 to the north received a variance via resolution //96-50 and the background of this case is included in your packet. In comparison the current and the previous case the lot areas are similar however the use of the property and the conditions of each case are quite different. When the current applicant purchased this property the applicant had control over both parcel #59 and #60, both parcels on their own are substantially nonconforming to lot area and occupied by a large amount of floodplain. One option available would be to combine the nonconforming parcels, demolish the old cottage, and develop a proposal for one dwelling that is more consistent with the lot area provisions. 2) Lot Width: The existing lot width is 49 feet, 60 feet is required resulting in a variance request of 11 feet. Minutes - Planning Commission November 10, 1997 Comments: Combination of the parcels and elimination of the old cottage would result in a minor improvement to the lot width. The County Plat Map needs to be revised to reflect the apparent vacation of a portion of Driftwood Lane. 3) Floodplain: A substantial portion of this and adjacent property is in the floodplain. The applicant is proposing to fill and compensate on site, the City Engineer has addressed this issue in his report. Comments: According to the ordinance floodplain area cannot be used to calculate lot area. GENERAL COMMENTS: The criteria for granting variances requires that in order to grant a variance a finding of hardship or practical difficulty must be made and also that specific circumstances exist as outlined in Section 350:530. In this case staff cannot support a finding of hardship or practical difficulty as there are other options available to the applicant such as combining this property with the parcel #60 to the south that is also nonconforming to the floodplain and lot area. A combination of the parcels would be more consistent with the City Zoning Code, and also with the Comprehensive Plan statements related to the removal of nonconforming situations when possible regardless of whether they result from lot size, structural type or setbacks. STAFF RECOMMENDATION: Staff recommends the Planning Commission recommend denial of this case based on the conditions as stated above. If the Commission concurs with this recommendation a list of findings should be made that are consistent with this recommendation. DISCUSSION: Voss questioned what the differences between lots 9 and 10. Sutherland stated that Wigners house (Lot 9) was occupied and repairs could have been made instead of building a new one. They also had a nonconforming garage. It was the use of the property that sets the properties apart. Hanus questioned why that particular section was zoned R1 and not R1A. It was decided that it was probably due to the way the rest of the area is zoned. Weiland questioned why was lot 10 separated without having the required 10,000 square feet. Sutherland stated that on the original plat, lot 10 had its own PID number and lots 11-12-13 had one PID number and had the same ownership. Mueller stated that it is all under one legal description and doesn't understand how lot 10 can be divided off from the rest of the parcel without applying for a subdivision. Applicant, Bob Steele, 8515 Wood Lane, Germantown TN, purchased the property for himself and his daughter, his daughter lives in the house on lot 11. On page 8, #2 regarding Lot Width show on survey on page 22, the survey states that the Minutes - Planning Commission November 10, 1997 frontage is 55 feet. He stated that he will probably have another survey showing the street vacation. Made comments regarding the usage of the adjacent property. The difference between lot 9 and 10, lot 9 already had a foundation where the cottage on lot 10 does not. Sutherland stated that he needs to make a correction on page 8, #2 regarding lot width that it is 55' instead of 49' but needs to be verified by an updated survey. Mueller questioned the vacation of the road. Steele stated that the original plat at Hennepin county shows that it was platted for his property. Steele stated that he didn't feel that the use of the property was disclosed to him by the realtor. He stated that most of the homes on Driftwood are non conforming. Stated he filed for title on lot 10 two months ago. He currently has the titles. Lot 10 was owned by separate owner previously. He stated that the DNR stated that they may not have the jurisdiction to give a recommendation. His response to the Planning Commission is he would like to table the case until he can get some more information together for the Planning Commission. He feels that since the variance was given to lot 9 that the Commission should do the same for his case. Some of the ground has been eroded away over time. Hanus questioned why the property was not subdivided to make lot 10, 10,000 square feet. Steele stated that it would lose its lot of record status. Mueller stated the comprehensive plan to Mr. Steele. MOTION to table Voss, seconded by Weiland to table this case as per the request of the applicant. Motion carried 6-0. CASE # 97-54: Variance, lot size, yard and hardcover to build a second story addition, Thomas Alexander, 4994 Manchester Road, Lot 12, Block 33, Wychwood, PID 24-117-24 42 0005 Assistant Planner Loren Gordon reviewed this case. The applicant, Thomas Alexander, is seeking a variance to recognize the lot size, yard and hardcover variances to build a second story addition. The setback variance are listed below. Existing/Proposed Required Variance Lot Area 4,700 sf 6,000 sf 1,300 sf Hardcover 3,389 sf 1,880 sf 1,509 sf Front Yard 10.6' 20' 9.4' Rear Yard 6.2' 15' 8.8' This proposal is the second attempt to build a two story home on this property. you recall, this case is very similar to the Dow case held before the Planning Commission in October of 1996. In that case, the owner had also proposed a second story addition but never completed the project. As X0?0 Minutes - Planning Commission November 10, 1997 The current proposal is to push out the front wall of the house to match the garage and open foundation bricks. A second story addition would be built over the home leaving the garage in a one story design. The proposed addition would have a single hip roof to match the design of the garage. Cedar siding is proposed for the exterior for all of the house. The concrete patio on the lakeside would stay and a new deck is proposed on the south side of the patio which would stay behind the edge of the patio keeping it out of the Brighton Commons land. The proposed improvements will substantially improve the condition and livability of the property. A two story design fits well with the new home construction just south of Manchester Road. The hardcover issues remains unchanged from the previous request. Although the Brighton Commons area cannot be considered in the hardcover calculations, it will provide some relief for filtration. The commons area adjacent to the lot is approximately 2500 sf for that area between the north and south lot lines. If included in the property, hardcover would be under the required minimum. One issue not discussed in the previous case was that the house is built with a crawl space that is below the flood elevation. The Building Official has reviewed this issue and has determined a further review will need to be made. If the crawl space is determined to be a basement as per building code, the owner would need to fill it to a point above 933 feet. Based on the previous case history the recommendation from Staff was for approval of the improvements. The issues of this case are practically identical. RECOMMENDATION: Staff recommends the Planning Commission recommend Council approval of the variance as requested with the following condition: 1. A determination of the crawl space be made by the Building Official. DISCUSSION: Weiland would like see alot of the concrete removed. Gordon stated that he discussed that with the applicant and the applicant agreed. Gordon suggested that the proposed deck be cut back to 10 feet and the concrete underneath be removed. The proposed deck will be 10 x 30 and will be conforming to the setbacks. MOTION by Weiland to motioned to approve staff recommendation with the condition of removing any concrete to the west of the home, with a reduction of the deck of 10 feet in width, Voss seconded. Motion carried 6-0. This case will go to City Council on November 18,1997 Minutes - Planning Commission November 10, 1997 Information: City Council Minutes - October 28, 1997 Discussion was made regarding the truth-in-housing issue. Talked about making up a zoning sheet that could be distributed to realtors. Voss discussed the issue of the CDBG funds. He feels that it should be looked into again. This was discussed at length. Mueller made comments that he'd like to add regarding the Steele case, he doesn't feel that the two parcels are separate but are one and it should be a subdivision not a simple change of name even though they have separate PID numbers. Hanus stated that he would like to have the city attorney view this case before this case comes back to the planning commission. It was discussed and was determined to cancel the November 24th Planning Commission meeting. MOTION by Weiland, seconded by Reifschneider to adjourn the meeting at 9:20 p.m. The motion carried 6 - 0. STROMMEN Attorney at Law Direct Dial (612) 337-9233 MEMORANDUM TO: FROM: DATE: RE: SRA City Man~,Administrators/Director/Altemate Jim Stromme~4"~ October 30, 1997 PUC 612 Area Code Decision As you have heard on the news, on October 28, 1997, the PUC adopted an area code split that incorporated the SRA recommended approach of keeping municipalities intact. The surprise aspect of the PUC decision was the adoption of a north/south (primarily along Minneapolis/St. Paul lines) split using municipal boundary lines. This is a significant victory for cities because only the SRA originally advanced the position of re-drawing proposed area code boundaries along municipal boundaries, and to my knowledge, it has not been done yet anywhere in the country. The PUC decision was so unanticipated that an actual map of its intended split has yet to be prepared. The closest existing map is the Three-Way Split proposal along wire center boundaries. The Commissioners, however, definitively ordered the boundaries to follow municipalities, "where possible". The decision was clearly made following arguments by US West that it would be too expensive to partition wire centers to accomodate municipal lines. Therefore, it does not appear likely that the Commission will readily allow deviation from city boundaries. The decision in favor of the geographic split was four to one, with Commissioner Don Storm favoring the overlay method. Commissioner Gregory Scott was the first of the Commissioners JMS132806 SU160-31 to mention the need to keep municipalities intact when the boundaries were drawn. The PUC did not adopt the Department of Public Service inner-outer circle approach, probably because the Commissioners wanted to avoid splitting communities of interest normally attached to the Minneapolis or St. Paul area. The most notable exception to this approach is the inclusion of Burnsville in the new area code, aligned with St. Paul and suburbs. I am informed that Burnsville was included in the eastern area to maintain the Dakota County area and to keep the area codes in the local service territory of Frontier from having two different area codes. The Commissioners rejected US West's claims that partitioning wire centers along municipal boundaries would be too expensive. There is a likelihood, however, that US West will seek reconsideration of this decision or argue that certain wire centers cannot be partitioned when the boundaries are re-drawn. FUTURE ACTION The new area code will be assigned to the eastern Metro area some time in early 1998. The mandatory switch will begin January 1, 1999. Seven-digit dialing will be retained within each area code. Ten-digit dialing will be required between area codes, without paying an additional toll charge not otherwise charged for calls outside the Metro area. Because the Commissioners adopted a geographic split plan that had not been previously drawn along municipal boundaries, there are more unknowns associated with the feasibility and costs of such divisions. The SRA should monitor the next few months of this process closely to ensure that US West does not defeat the intended municipal boundary area code divisions by claiming it is not "possible". I would like to thank the cities that provided resolutions and articulated issues that could arise were a city split by area code. Karen Cole of our office, who appeared before the PUC, was able to use an example provided by the City of Edina of potential problems with municipal services were an area code split made within the city. JMS:sms JMS!22~06 SU160-31 CITY OF MOUND 5341 MAYINOOD ROAD MOUND, MINNESOTA 55364-1687 (612) 472-0600 FAX (612) 472-0620 MEMORANDUM November 13, 1997 TO: MAYOR AND CITY COUNCIL FROM: ED SHUKLE, CITY MANAGER SUBJECT: REVISIONS TO 1998 BUDGET PER YOUR REQUEST OF 10/20/97 COW Pursuant to your request at the October 20, 1997 Committee of the Whole Meeting, Gino and I have prepared the revisions to the 1998 Budget that reflect your discussion. We have reduced the fund balance to approximately 37% of the total expenditures and consequently, the tax levy has been reduced to a 1.91% increase. As I stated at the COW meeting, you should really think hard about taking this type of action. Please remember that you did not increase the tax levy for 1997; you kept it at the 1996 level. You took this action without any levy limits in place. Now that levy limits are in place for 1998 and 1999, we are falling further behind by not increasing the levy by 5.50% which is about 6% less than what the levy limit is. Reducing the fund balance, on a consistent basis, is not a prudent thing to do. Over a short period of time we will not have adequate reserves to cover increasing expenses and cash flow needed to operate. Fund #30 (Capital Improvement Fund) will not be around forever and the Liquor Store profits are not guaranteed. To further complicate the tax levy, the proposed operating expenses of a renovated Westonka Community Center will have to be considered. If the referendum passes and the City of Mound and the Westonka School District are successful in negotiating a joint powers agreement, estimated operating expenses of nearly $400,000 annually must be covered by both parties. In an earlier memorandum to you, we listed a number of financial resources for consideration. Of those listed, the property tax levy seemed to be the only consistent resource to tap for such expenditures. Although we did not propose a major increase in the property tax levy for these expenses, an increase would be necessary to supplement the Capital Improvement Fund and Liquor Fund. We indicated o95 printed on recycled paper Memorandum to the Mayor and City Council November 13, 1997 Page 2 to you that neither the Capital Improvement Fund or the Liquor Fund could be counted on into the distant future and that the property tax is the only major resource that we have to utilize for the renovation project. In order to finance the operating expenses, the city may have to look at reductions in other operations of the city to avoid major property tax increases. In summary, we have to analyze our responsibilities and obligations in providing municipal services to our residents. We cannot rely upon reserves to carry operations of the city into the future. Some property tax increases are necessary and residents must realize this if they are going to demand certain services. It is important to keep taxes to a minimum but if services are to be continued at present levels and additional services are going to be requested or demanded, be prepared to address them through the property tax; there is no other consistent revenue at our disposal. N \0185\04-246\MIP 11057 AES:irw DRAFT MINOR PLAN AMENDMENT Langdon Lake Restoration Project Description of the Project an0 Nee0: The overall purpose of the Project is to improve the water quality of Langdon Lake bv reducing internal phosphorus loads from the existing lake sediments. The PrQect involves application of liquid alum to the lake surface in areas deeper than five feet. The alum will produce a fl0c which ~ertles to the bottom effectively blanketing the sediments to inhibit the release of phosphoru~ to the lake water. The application is done bv boat equipped w/th alum tanks and diffuser pipes. Alum treatment is a proven and accepted meaa.~5._for reduction of internal phosphorus loads in lakes. Implementation of the project is expected to be completed within a time frame ofthree weeks. Need for the Project Langdon Lake c, nce received the effluent from the City of Mound wastewater treatment facility from 1963 to 1974. The City. of Mound wastewater treatment pond was not designed to remove phosphorus: the estimated phosphorus load to Langdon Lake durin~ 1969 tO 1970 was 17.880 pounds per year (Table I][-20). The pond is located near the western end of Langdon Lake. A large percentage of the influent phosphorus load would have ~ertled in the Langdon Lake sediments providing a source for present internal loads. Historical water sampling data characterizes Langdon Lake as hypereutrophic and having extremely poor water quality when compared to other lakes in the upper watershed. The average summer 8-umm~ epilimnetic phosphorus concentration of 898 gg/L reported__ia Table II-60 of this plan is are approximately 18 times higher than the 50 p,g/L goal set by this plan (Table L-I). Since wastewater discharges to the lake ceased in 1974, the lake has experienced gradual improvement, but in recent years the improvement has ~lowed. The average summer surface phosphorus concentration during 1993 through 1996 ~vas still 250 .ug/L. Water clarity is 10w with Secchi depths varying between 0.10 and 0.4 meters w'ifl~ no noticeable improvement trend over the past twenty years. In fact. as phosphorus concentrations have decreased. Chlorophyll-a, a measure of algal population. has generally increased with an average of 210 [tg/L over 1992 to 1996. Phosphorus profiles taken during the summer of 1997 indicate the strong upward gradient of soluble reactive phosphorus which iS indicative of internal phosphorus loading. Sediment samples also taken during 1997 indicate high levels Of` phosphorus in the lake bottom, Langdon Lake is intermittently a tributaw to Lake Minnetonka via a culvert under CSAH 15 so that the high concentrations in Langdon Lake cause phosphorus loadings to Lake Minnetonka. Therefore besides revitalizing Langdon Lake. the Project would have. a smaller secondar.v effect of reducing phosphorus loadings to Lake Minnetonka. The r""*~'*;~' ..... ....... ~'~" gccd ';.'atcr qua!i~' ;~ ..... ~ ~;~ Lanxdcn Lalc~ ears ts Evaluation of Alternatives Recent water quali _ty model calculations indicate that the total annual phosphorus load would have to be at least 3.200 pounds to cause summer epilimnetic concentrations of 250 .ug/L in Langdon Lake. With the external load estimated at about 460 pounds, about 85 percent of the total load must be internal. With this result, measures to reduce th~: external load would not be economically justified and the focus of the improvement project must be reduction of the internal load. With a drainage area tO lake area ratio of' just 6.4:1. the potential for improved water quali .fy with lowered internal loads is good. Alum treatment is the most effective, reliable and cost-effective means currently availabh, for controlling internal phosphorus loads from lake sediments. This was shou~n recently in the District's Jennings Bay Feasibility Study and Langdon Lake is not different in thi~,; regard.
