C. L. Tuff and Bernard ?Tinkel, and LeRoy V.. Alwin, Recorder.
Trustee Frank ¥ost was absent.
After deliberation and discussion, Alwin Presented the following
resolution, to wit:
WHEREAS a resident of this village, personally known to members of
this board, and others associated with him, but not resident, have
seen fit to dispute the Judgement and the authority of the village
assessor, ~r. J. P. Reed, in his definition and application of an
agricultural classification to oertain real ~rope~rtles within the
village limits of Nound, and which recent law has fully authorized
him to do and,
WHEREAS the local Board of Review, members of this council, have,
as a matter of policy and fully cognlsant and appreciative 'of the
quest and the interest which brings people from a crowded city to
est~blish gardened homes within the village, fully sustained ~r. Reed
in his Judgement and classification. This, further, and in special
reference to the requirements of a recently enacted village zoning
law, which requires wider lots than those platted within the village, and
~EREAS the one, or two, persons above indicated, not being ~ble to
nullify or set ~.side local tax policy in order to enhance their own
personal ends, presented their case to the County Board. ~hich body,
acting hurriedly and through s. pparent prejudice, and without verified
complaint, or other legal or Justifiable cause, passed c resolution
ordering a reassessment of the village of Mound. Thus subverting local
authority and local self-determination in matters of local inter~st,
and
~HEREAS, after a hearing before the State Tax Commission - perforce
informal because of lack of legalgground - that body, instead of
dismissing the case for lack of legal ground - saw fit to sustain
the action of the County,
'Iv~IEREFORE be it resolved and it is hereby ordered that Nr. Frank ~urphy,
1305 Rand Tower, ~Inheapolis, attorney for the Village of ~ound,
proceed in such manner and to such lengths as will get Justice and
freedom for this village under the law.
Approved an~ adopted on this 2nd day of ~eptember, 1938, at a
~pecial Meeting of the Board of Trustees of the Village of ~ound,
duly held by a majority vote of all the members of the same.

The question before the council being on the adoption of the
resolution, the vote stood as follows:

And so the resolution stood adopted.
T here being no further business before the council, it stood
