Ferrall and Evan Jones, with Atwln as Recorder. Trustee P. F. Winkel was unable to be present. Mr. Streater's Petition read as follows: To the Village GOuncil of the Village of Mo~d: Gentlemen: I hereby ~tition the Village Oouncil for an extension of water mains on the streets and at the locations listed herein- after for the p~pose of givi~ ade~te water service and f~e ~otection to the pro~rty in front of which t~mmains' will be .laid, and I re~esent and decl~e that I am the' owner of more than fifty-one (51) ~r ce~ in frontage of the real pro~'rty abuttl~ on the streets and p~ts of streets he, in na~. ~e locations of such proposed extensions of water ~ins are as follows: 1. Streater 'Pe~ i~ ione~ ~e above petition hav~g been read, the' clerk made the followi~ report: Petition for the extension of water mains on Lake- wood Avenue, on part of ~ounty Highway No. 7, and on parts of Harrison Avenue, Elm Street, Edgewater Drive and Rosedell Avenue having been filed with the Clerk of the Village ~ounctl of the Village of Mound, I hereby certify that upon comparison of the records in 548 VILLAGE OF MOUND the office of the Register of Deeds for Hennepin County, Minnesota, I find that Edward C. Streater is the owner in fee simple of more than fifty-one (51) per sent of the frontage of real property abutting on the streets named in the petition. Dated January 13th, 1941. (signed) LeR. V. Alwln The Council having heard the report of the Clerk, Trustee Jones presented the following resolution: to wit: WHEREAS a petition has been filed with the ~lerk of the Village of Mound by Edward C. Streater, praying for an extension of the water maine on Lakewood Avem~® from C'ounty Mighway No. ?, to Lot 13, Block 3, Shirley Mills, Unit D, and on COunty Highway No. 7 from Lot 5, Block 7, to Lot ll, Block 5, Shirley Hills, Unit N, and on Harrison Av~ue fro m County Highway No. 7 to Elm Street, and on Yale Avenue from Elm Street to the alley and along the alley to County EigP~ay No. 7, and on Edgewater Drive from County Highway No. ? to connect with the main now loc ated on said Edgewater Drive and on Rosedelll Avenue from the corner at Edgewater Drive to Lot l, Block 2, Shirley Hills, Unit B, and whereas the Village CTerk had duly reported that he has compared the signature on the petition with the re© rds in the office of the Register of Deeds of Me~mepin County, Minnesota, mud has found that the petitioner is the owner of more than fifty-one (51) percent in Trontage of the real property abutting on the streets and parts of Streets ns. med in the petition, NOW, THMR~0RE, be it hereby resolved that it is deter- mined that the petition is signed by the resulted percen, tage of owners in frontage of the real p~operty abutting on the streets and parts of streets named in said petition. The motion being for ~he adoption of the resolution and having received the second of Trustee Farrell, the vote stood as follows: 5 yeas, no nays. And so the resolution stood adopted. ~nd fe~.~.biltty To initiate a necessary examination as to cost~, Trustee Jones' offered the following resolution: A petition for the extension of water mains on L~.~kewood Avenue, aud on parts of County Highway No. 7, HarrisOn Avenue, Yale,Avenue, Edgewater Drive ~nd Rose- dell Avenue having been ir esented to the Council by Edward ~. Streater, N0~, THMRE~0R~, be it hereby resolved that the petition be referred to Eh~gineer ~. T. Madsen, a civil engineer, and that he be directed to report thereon to the Council with all convenient speed. The. motion for adoption having received the seco nd of Trustee VILLAGE OF MOUND 549 learrell, the vote of the council stood unanimous. As a step to initiate the necessary public hearing as reeuired by law, ~u~tee Jones pre~ented the folloWlng resolution: Petltion having been made by the owner of more than fifty-one (51) per cent in frontage of the real property abut%- lng on the streets hereinafter named for the extension of water mains on said streets, %o wit: 1. NOW, TH~EFORE, be it hereby resolved that said petition shall be considered and action taken in reference to the matte~ at the special meeting of the Village Gouncil of tbs Village of Nound, on Thursday, the 3Oth day of January, 1941, at 8 o'clock P.M., and that the village clerk be directed to give notice thereof to all persons by publication of this resolution once each week for two successive weeks in the Mtnntonka Pilot, the last publication to be at least seven days prior to the date of hearing. The imlm~ovement petit loned for is £or the extension of water mains for the purpose of furnishing adequate water service and fire ~otectlon in the pa rts of the village abuttl ng on said lots and adjacent thereto snd the estimated cost of said improvement is the sum of $8,660.00 The motion for adoption of the resolution having reeelved the suoport of Trustee Ferrall, the vote of the council stood unani~ous. And so the resolution stood adopted. It was the suggestion of Trustee Ferrall that the council take early action to transfer back to the Water Fund the $576.00 that was loaned to the General Fund to defray the costs of oiling the village streets last summer. Having concluded the above business, and having arranged for an 550 w--^G~ of MOU~O e~rly meeting - subject to the csll of the ~ayor - to consider further petl~en~ for w~.termsin exten~ion~, the meeting ~tood ~dJourned.
