NINUTES OF THE PJ~GULAR NEETING OF THE NOUND VILLAGE COUNCIL HELD
February 5th, 1946.
Present at this meeting were ~ayor Louuse Huestis, Trustees~Rondorf,
Breeckert, and Newcomb, with Alwin recording.
The minutes of the previous meeting being approved with minor:changes,
the meeting opened with a hearing given to Frank Groschen with refer-
ence %o a.house and lot , i. e., Lot ll, blk. 4, Crevier's Subdivision
of Lafayette Park, owned by Alonzo Boynton, and which automatically
becomes the ~ossession ~f the village of,Nound under the terms of a
Q~'Claim deed and upon the deaths of Alonzo Boynton and his wife.
S~nce the interest of Nr. Groschen involved a sale by the village
of this property, and since the village was not yet in possession
tuuder the !terms of the deed, the couneil.found itself in no position
to act. ~ ~.
A hearing was given to Alfred Nahns wh~ petitione~ the council for
the right to cut tr~essstanding on property, , presumably village owned,
and lying ~est of John Naas property, i. e., Lot 8, blk. ~., the
Highlands, It not being clear to the council as to whether the
tree~ in question were on village property or not, no definite
action was taken.

The council heard Peter Sollie in his complaint with reference to
the conversion of an erstwhile church building and property, located
on Lot S0,! Auditor's Subdivision #18~, into a feed sto~e. Since the
building and lot were located in the Commercial Zone, a~ recently platted,
the council found no reason to interfere with its legitimate use.
$. J. Nestaval, and associate, representing Hitchcock & Estabrook,
~onsulting Engineers, presented themselves with reference to the
newly proDosed water main extensions and a village sewage disposal
plant. The council assured them that they would be referred to
as soon aS things got under way.
Nayor Louise Huestls presented the petition of Nrs L. Lohmar requesting
permission to cut willow trees along the channel, namely Lot ~8,
Auditor~s~Subdivision I ~0. The purpose of the cutting being to
get firewood. The council found no objection in such cutting as
long as' i~ was done in a uniform and orderly fashion.
Upon the presentation of the treasurer's financial report for the
month of January, 1948, it was moved by trustee nNewcomb that the
same be a~proved and ordered fi~ed. Rondorf supported this motion,
the council agreeing.
The folloWing applications for Building Permits were presente~ ~ o
the council, and permits ordered issued:

Respondin !g to a suggestion originating with J. D. Nurphy, Land
Commissioner of Hennepin County, Trustee Rondorf moved that the
clerk be authorized to apply for ~ State Deed covering Lot ~5,
Auditor's iSubdivision No. 170. Broeckert seconded this motion, the
council carrying.

U?on proper presentation of an Ordinance Regulating Procee/dings of
the Village Council, Trustee Newcomb moved its ~option and that its
text .tntto~o be spread upon the minutes. Trustee Broeckert supported
this motion of adoption, the council responding with the following roll
call vote: Yeas; Newco~b, Rond~rf, Broeckert, Huestis, and Alwin.
Nays, None. And so the ordinance was adopted. It appears as
follows:
AN ORDINANCE REGULATI~NG PROCEED ING~S OF THE VILLAd-E COUNCIL.
SECTION 1. REGULAR MEETINGS.
Regular meeting of the village council shs. ll be held at the
Village Clerk! s Office on the first Tuesday 'after the first Monday
of each month at 8 o'clock P. M. except whem such Tuesday sh~.ll be a legal
holida$, when a regular meeting shall be held on the first succ_eeding ~~
business day. All meetings shall be open to the public. The
Village Marshal (~ht~ of Police) shall attend meetings of the
council when requested to do so by the president and preserve order
in the room
SECTION 2. SPECIAL ME~!'INGS.
Special meeting of the council may be called~ at the direction
of the President, &r by request of two councilmen in writing filed
with the clerk; all members of the council shall be seasonably
notified of ~every such special meeting by the President or Clerk.
Notive mas be in person, by telephone, or by mail. Any member of
the ,council not present at~ a special meeting shall be deemed to hs, v e
waived notice thereof unless at the next regular meeting at which
the minutes of said special meeting are read he shall notify the
co%uncil that he failed to receive seasons, ble notice of the meet[ng~
In such event all proceedings shall be deemed valid except those matters
specifically objected to by such absent member at said time, which
matters shall thereupon be reconsider~ed .
A special meeting mus~~ designate the purpose of such meeting and
no other busines.s may be considered at such meeting.
SECTION 3. ORDER OF BUSINESS AT COUNCIL L~ETING.
N° specified order of business shall be require~ at village
council meetings.
Business of the council shall be tskem up in such order as the
president shall determine, unless the members shall determine otherwise
by motion.
No person other than a member shall address the council except upon
request from the president.
SECTION 4. BUSINESS NOT ACTED UPON AUTONATICALLY TABLED.
Any business brought before the council includinE hearings
and metters adjourned or referred to a spe.cial meeting, and not
disposed of by motion or resolution or postponed to a definite date
shall be deemed indefinitely tabled and may be acted upon at any
subsequent meeting held within the same calendar year at which all
members of the council are p~esent.
SECTION 5. CON~ITTEES.

As soon as pr ,ct[cal after the first meeting in each year
the President, with'the approval of the couneil, shall appoint
one or more members~f the council to ae~ on and be Chairmen
of each of the following standing committees of the council,
which are hereby established; the personel of such committees is to be
subject to change by action of the Counc~il at any time:
Roads and Public Works,
Wat er,
Liquor,
All o~her departments shall be under the supervision of the council
as a whOle with the President as Chairman and the Village Clerk
as official recorder.
The Chairmen and members of such committees shall familiarize
themselves with the operations of the respec~ive departments or
functions of the village.
Detailsiof operation of each of the village departments or functions
shall be under the supervision of the Chairman of the respective
committee, and it ~shall be the duty of each such chairman to keep
the coUncil a~wised of operations under his supervision and to bring
before the council all matters requiring its direction or authorized
action
SECTION' 6. ROLL CALL VOTE.
, Roll call vote ahall not be required on matters before the
council unless demanded by members of the council or required by
laws of the State of Minnesota; provided that vote on verified
claims for payment shall be by roll call vote.
SEG~ION 7. GENERAL RULES OF ORDER.
T he village council shall proceed in accordance with Roberts
Rules of Parll_~:mentary Procedure, but no action of the Village
Council, or any member thereof, shall be deemed invalid because not
in .conformity with such rules unless at the time of the action taken,
or' promptly thereafter, a member of the council, or any persom
interested therein, shall object to the method of procedure and
point out to the council the particular rule whic$ it is claimed was
not observed.
SECTION 8. MOTIONS AND RESOLUTIONS.
Motions shall be set down by the clerk in his minutes and
read by!him before being submitted to a vote by the President.
Resolution shall be in writingmwhen presented to the village council
for vote, and shall be preserved by the Clerk, indexed as to meeting date
unless copied in full in his minutes.
A motion to adJouz~n shall always be in order, and a motion t~
adjourn, to lay on the table, and a call for the previous question
shall be decided withou~ debate and need not be in writing.
SECTION 9. ORDINANCES.

0rdinancex shall be in writing when presented to the Village
Council for a vote. Before an ordinance is sub$itted to a vote of
the Council for final adoption, if requested by any member of the cow
or other person present, it shall be read in full by the Clerk, and
persons present shall be given an opportunity to be heard on the
merits of the ordinance.

All ordinances or resolutions appropriating money or creating
any charge against the village other than the payment of claims
for purchase or work previously authorized by the Council shall
be acted upon by the Council at the next regular meeting,
provided that this provision may be suspended by affirmative action $~#$~r
by three-fourths of all me,abets of the Council present.
A roll call vote shall be taken and recorded on all appropria-
tions.
SECTION 10. BUDGET.
The council members in co-operation with the Village Clerk
and President shall in August of each year adopt a tentative
budget as a basis for tax levy f~r each ensuing year. T his
budget shall be examined by the council in January of the following
year for such revisions as they may deem advisable.
From time to time the council may make such revisions of the
budget as may be required
SECTIOL~ ll.
All ordinances, rules, and by-laws heretofore adopted
by the Village Council regulating~the mode of and establishing
rules for proceedihgs of the Village Council are hereby repealed.
SECTION 12..
This ordinance shall take effect from and after its
publication.
